3. Ṣalāh (Ritual Prayer)

3.554 [Machine] The person passes by the mosque without staying in it.

٣۔٥٥٤ بَابُ الْجُنُبِ يَمُرُّ فِي الْمَسْجِدِ مَارًّا وَلَا يُقِيمُ فِيهِ

[Machine] The Messenger of Allah ﷺ entered the mosque and found some of his companions' houses facing the mosque. He said, "Redirect these houses away from the mosque." Then, the Prophet ﷺ entered and the people did not do anything, hoping that he would give them permission to keep their houses as they were. However, the Prophet ﷺ came out to them again and said, "Redirect these houses away from the mosque, for I do not permit entry into the mosque for a menstruating woman or a sexually impure person." Abu Dawood said: "and this was the opinion of Al-A'miri." Al-Sheikh added that Moussa ibn Ismail reported it from Abdul Wahid except for the mention of Muhammad and the family of Muhammad ﷺ , which was narrated to us by Abu Bakr Muhammad ibn Ibrahim Al-Farsi. Ibrahim ibn Abdullah Al-Asbahani narrated it from Muhammad ibn Sulaiman ibn Faris, who reported it from Muhammad ibn Ismail Al-Bukhari, who mentioned it with his addition. Al-Bukhari said: "and according to Jassarat Al-Ajaa'ib, Urwah and Abbad ibn Abdullah reported from Aisha (may Allah be pleased with her) that the Prophet ﷺ closed all the doors except for Abu Bakr's door, and this is the most authentic narration." Al-Sheikh commented that if this is correct, it implies that one can stay within the boundaries of the mosque without having to pass through it, according to the evidence of the Quran.  

البيهقي:٤٣٢٣أنبأ أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ مُحَمَّدٍ الْفَقِيهُ أنبأ أَبُو بَكْرٍ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُسَدَّدٌ ثنا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ ثنا أَفْلَتُ بْنُ خَلِيفَةَ حَدَّثَتْنِي جَسْرَةُ بِنْتُ دَجَاجَةَ قَالَتْ سَمِعْتُ عَائِشَةَ ؓ تَقُولُ

جَاءَ رَسُولُ اللهِ ﷺ وَوُجُوهُ بُيُوتِ أَصْحَابِهِ شَارِعَةٌ فِي الْمَسْجِدِ فَقَالَ وَجِّهُوا هَذِهِ الْبُيُوتَ عَنِ الْمَسْجِدِ ثُمَّ دَخَلَ النَّبِيُّ ﷺ وَلَمْ يَصْنَعِ الْقَوْمُ شَيْئًا رَجَاءَ أَنْ تَنْزِلَ لَهُمْ رُخْصَةٌ فَخَرَجَ إِلَيْهِمْ بَعْدُ فَقَالَ وَجِّهُوا هَذِهِ الْبُيُوتَ عَنِ الْمَسْجِدِ؛ فَإِنِّي لَا أُحِلُّ الْمَسْجِدَ لِحَائِضٍ وَلَا جُنُبٍ قَالَ أَبُو دَاوُدَ وَهُوَ فُلَيْتٌ الْعَامِرِيُّ 4324 قَالَ الشَّيْخُ زَادَ فِيهِ مُوسَى بْنُ إِسْمَاعِيلَ عَنْ عَبْدِ الْوَاحِدِ إِلَّا لِمُحَمَّدٍ ﷺ وَآلِ مُحَمَّدٍ أَخْبَرَنَاهُ أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْفَارِسِيُّ ثنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ الْأَصْبَهَانِيُّ ثنا مُحَمَّدُ بْنُ سُلَيْمَانَ بْنِ فَارِسٍ ثنا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْبُخَارِيُّ ثنا مُوسَى فَذَكَرَهُ بِزِيَادَتِهِ قَالَ الْبُخَارِيُّ وَعِنْدَ جَسْرَةَ عَجَائِبُ قَالَ الْبُخَارِيُّ وَقَالَ عُرْوَةُ وَعَبَّادُ بْنُ عَبْدِ اللهِ عَنْ عَائِشَةَ ؓ عَنِ النَّبِيِّ ﷺ سُدُّوا هَذِهِ الْأَبْوَابَ إِلَّا بَابَ أَبِي بَكْرٍ وَهَذَا أَصَحُّ قَالَ الشَّيْخُ وَهَذَا إِنْ صَحَّ فَمَحْمُولٌ فِي الْجُنُبِ عَلَى الْمُكْثِ فِيهِ دُونَ الْعُبُورِ بِدَلِيلِ الْكِتَابِ

[Machine] In his statement {And do not approach them while you are in a state of janabah until you have bathed} [Surah An-Nisa: 43], he said: "Do not enter the mosque while you are in a state of janabah, unless you have a valid reason to be there, and do not sit in it." Abu Nuaim reported from Abu Ja'far that he said: "Except if you are passing through."  

البيهقي:٤٣٢٥أنبأ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا يَحْيَى بْنُ أَبِي بُكَيْرٍ ثنا أَبُو جَعْفَرٍ يَعْنِي الرَّازِيَّ ثنا زَيْدُ بْنُ أَسْلَمَ عَنْ عَطَاءِ بْنِ يَسَارٍ عَنِ ابْنِ عَبَّاسٍ

فِي قَوْلِهِ {وَلَا جُنُبًا إِلَّا عَابِرِي سَبِيلٍ حَتَّى تَغْتَسِلُوا} [النساء 43] قَالَ لَا تَدْخُلِ الْمَسْجِدَ وَأَنْتَ جُنُبٌ إِلَّا أَنْ يَكُونَ طَرِيقُكَ فِيهِ وَلَا تَجْلِسْ وَرَوَاهُ أَبُو نُعَيْمٍ عَنْ أَبِي جَعْفَرٍ وَقَالَ إِلَّا وَأَنْتَ مَارٌّ تَمُرُّ فِيهِ

[Machine] One of us used to pass by the mosque while he was in a state of major impurity (junub) and was just passing through.  

البيهقي:٤٣٢٦أنبأ أَبُو حَازِمٍ الْحَافِظُ أنبأ أَبُو أَحْمَدَ الْحَافِظُ أنبأ أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ إِسْحَاقَ الثَّقَفِيُّ فِي التَّفْسِيرِ ثنا زِيَادُ بْنُ أَيُّوبَ ثنا هُشَيْمٌ أنبأ أَبُو الزُّبَيْرِ عَنْ جَابِرٍ قَالَ

كَانَ أَحَدُنَا يَمُرُّ فِي الْمَسْجِدِ وَهُوَ جُنُبٌ مُجْتَازًا

[Machine] And Abu Hazim reported that Abu Ahmad Al-Hafiz reported that Abu Al-Abbas Al-Thaqafi narrated that Muhammad ibn Raffi narrated from Abdul Razzaq that Mammar reported from Abdul Karim from Abu Ubaydah ibn Abdullah from Ibn Mas'ud that he used to permit the one in a state of major ritual impurity (junub) to pass through the mosque as long as he was just passing by. He said, "And I only know this from the statement, 'And not in a state of junub, except those passing through [a place of prayer]'." (Quran 4:43)

وَأنبأ أَبُو حَازِمٍ أنبأ أَبُو أَحْمَدَ الْحَافِظُ أنبأ أَبُو الْعَبَّاسِ الثَّقَفِيُّ ثنا مُحَمَّدُ بْنُ رَافِعٍ ثنا عَبْدُ الرَّزَّاقِ أنبأ مَعْمَرٌ عَنْ عَبْدِ الْكَرِيمِ عَنْ أَبِي عُبَيْدَةَ بْنِ عَبْدِ اللهِ عَنِ ابْنِ مَسْعُودٍ أَنَّهُ كَانَ يُرَخِّصُ لِلْجُنُبِ أَنْ يَمُرَّ فِي الْمَسْجِدِ مُجْتَازًا قَالَ وَلَا أَعْلَمُهُ إِلَّا قَالَ {وَلَا جُنُبًا} [النساء 43] إِلَّا عَابِرِي سَبِيلٍ

[Machine] In his statement "and not [touching] women in menstruation except for passing through [the road]", he said that one may pass and not sit.

فِي قَوْلِهِ {وَلَا جُنُبًا إِلَّا عَابِرِي سَبِيلٍ} [النساء 43] قَالَ يَجْتَازُ وَلَا يَجْلِسُ

[Machine] I heard Ata' saying that menstruating women and those in a state of sexual impurity do not nullify a contract, nor a braid, and a menstruating woman does not pass through the mosque except out of necessity.  

البيهقي:٤٣٢٩أنبأ أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ ثنا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ ثنا أَحْمَدُ بْنُ عَبْدِ الْعَزِيزِ ثنا الْوَلِيدُ بْنُ مُسْلِمٍ ثنا أَبُو عَمْرٍو قَالَ

سَمِعْتُ عَطَاءً يَقُولُ الْحَائِضُ وَالْجُنُبُ لَا يَنْقُضَانِ عِقِاصًا وَلَا ضَفِيرَةً وَلَا تَمُرُّ حَائِضٌ فِي الْمَسْجِدِ إِلَّا مُضْطَرَّةً
