[Machine] "That the Prophet ﷺ said: 'When one of you marries his slave girl or hired worker, he should not look at her private parts.' This is what my father said about her private parts."  

البيهقي:٣٢١٩أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ مَيْمُونٍ ثنا الْوَلِيدُ ثنا الْأَوْزَاعِيُّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ

أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا زَوَّجَ أَحَدُكُمْ عَبْدَهُ أَمَتَهُ أَوْ أَجِيرَهُ فَلَا يَنْظُرَنَّ إِلَى عَوْرَتِهَا كَذَا قَالَ أَبِي عَوْرَتِهَا

[Machine] The Prophet ﷺ said, "When one of you marries his servant, slave, or hired worker, he should not look at what is below the navel and above the knee." Abu Dawud said that the correct interpretation is the narration of Suwar ibn Dawud. The scholar said that this narration, when combined with the narration of Al-Awza'i, indicates that the purpose of the hadith is to prohibit the master from looking at the 'awrah (private parts) of the female slave after marrying her. And the 'awrah of the female slave is what is between the navel and the knee. Various ways of interpreting this hadith lead to the conclusion that the purpose is to prohibit the female slave from looking at the 'awrah of the master after reaching the age of marriage. So the information about the extent of the 'awrah of the man is mentioned, but not the extent of the 'awrah of the female slave. We will mention this in the following chapter, if Allah wills.  

البيهقي:٣٢٢٠وَأَخْبَرَنَا أَبُو عَلِيٍّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا زُهَيْرُ بْنُ حَرْبٍ ثنا وَكِيعٌ ثنا دَاوُدُ بْنُ سَوَّارٍ الْمُزَنِيُّ عَنْ عَمْرِو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ

عَنِ النَّبِيِّ ﷺ قَالَ إِذَا زَوَّجَ أَحَدُكُمْ خَادِمَهُ عَبْدَهُ أَوْ أَجِيرَهُ فَلَا يَنْظُرَنَّ إِلَى مَا دُونَ السُّرَّةِ وَفَوْقَ الرُّكْبَةِ قَالَ أَبُو دَاوُدَ صَوَابُهُ سِوَارُ بْنُ دَاوُدَ قَالَ الشَّيْخُ وَهَذِهِ الرِّوَايَةُ إِذَا قُرِنَتْ بِرِوَايَةِ الْأَوْزَاعِيِّ دَلَّنَا عَلَى أَنَّ الْمُرَادَ بِالْحَدِيثِ نَهْيُ السَّيِّدِ عَنِ النَّظَرِ إِلَى عَوْرَتِهَا إِذَا زَوَّجَهَا وَأَنَّ عَوْرَةَ الْأَمَةِ مَا بَيْنَ السُّرَّةِ وَالرُّكْبَةِ وَسَائِرُ طُرُقِ هَذَا الْحَدِيثِ يَدُلُّ وَبَعْضُهَا يَنُصُّ عَلَى أَنَّ الْمُرَادَ بِهِ نُهِيُ الْأَمَةِ عَنِ النَّظَرِ إِلَى عَوْرَةِ السَّيِّدِ بَعْدَ مَا زُوِّجَتْ أَوْ نُهِيُ الْخَادِمِ مِنَ الْعَبْدِ أو الْأَجِيرِ عَنِ النَّظَرِ إِلَى عَوْرَةِ السَّيِّدِ بَعْدَ مَا بَلَغَا النِّكَاحَ فَيَكُونُ الْخَبَرُ وَارِدًا فِي بَيَانِ مِقْدَارِ الْعَوْرَةِ مِنَ الرَّجُلِ لَا فِي بَيَانِ مِقْدَارِهَا مِنَ الْأَمَةِ وَسَنَأْتِي عَلَى ذِكْرِهَا فِي الْبَابِ الَّذِي يَلِيهِ إِنْ شَاءَ اللهُ تَعَالَى

[Machine] "Who is this woman?" He was told, "This is a slave girl of so-and-so, a man from his tribe." So he sent to Hafsah and said, "Who allowed you to bake this bread and bring it to me, and to make her look like a married woman until I was tempted to commit adultery with her? I consider her to be a married woman, don't compare slave girls to married women."  

البيهقي:٣٢٢١أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَحْمَدُ بْنُ عَبْدِ الْحَمِيدِ ثنا أَبُو أُسَامَةَ عَنِ الْوَلِيدِ يَعْنِي ابْنَ كَثِيرٍ عَنْ نَافِعٍ أَنَّ صَفِيَّةَ بِنْتَ أَبِي عُبَيْدٍ حَدَّثَتْهُ قَالَت خَرَجَتِ امْرَأَةٌ مُخْتَمِرَةٌ مُتَجَلْبِبَةٌ فَقَالَ عَمْرُ

ؓ مَنْ هَذِهِ الْمَرْأَةُ؟ فَقِيلَ لَهُ هَذِهِ جَارِيَةٌ لِفُلَانٍ رَجُلٍ مِنْ بَنِيهِ فَأَرْسَلَ إِلَى حَفْصَةَ ؓ فَقَالَ مَنْ حَمَلَكِ عَلَى أَنْ تُخَمِّرِي هَذِهِ الْأَمَةَ وَتُجَلْبِبِيهَا وَتُشَبِّهِيهَا بِالْمُحْصَنَاتِ حَتَّى هَمَمْتُ أَنْ أَقَعَ بِهَا لَا أَحْسَبُهَا إِلَّا مِنَ الْمُحْصَنَاتِ لَا تُشَبِّهُوا الْإِمَاءَ بِالْمُحْصَنَاتِ

[Machine] Be the handmaidens of Omar, who served us as healers revealing their emotions and striking their chests. The sheikh said, "The narrations from Omar bin Al-Khattab in this regard are authentic and indicate that her head, neck, and what is visible of her in a time of distress should not be considered an 'awrah (a part of the body that should be covered)." As for the hadith of Amr bin Shu'ayb, there is disagreement concerning its content, so it should not be relied upon when determining the 'awrah of a woman. However, it can be used as evidence along with other similar narrations when determining the 'awrah of a man.

And with Allah is the success. Some of our companions have used a hadith as evidence in this matter.  

البيهقي:٣٢٢٢وَأَخْبَرَنَا أَبُو الْقَاسِمِ عَبْدُ الرَّحْمَنِ بْنُ عُبَيْدِ اللهِ الْحِرَفِيُّ بِبَغْدَادَ أنبأ عَلِيُّ بْنُ مُحَمَّدِ بْنِ الزُّبَيْرِ الْكُوفِيُّ ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ ثنا زَيْدُ بْنُ الْحُبَابِ عَنْ حَمَّادِ بْنِ سَلَمَةَ قَالَ حَدَّثَنِي ثُمَامَةُ بْنُ عَبْدِ اللهِ بْنِ أَنَسٍ عَنْ جَدِّهِ أَنَسِ بْنِ مَالِكٍ قَالَ

كُنَّ إِمَاءُ عُمَرَ ؓ يَخْدِمْنَنَا كَاشِفَاتٍ عَنْ شُعُورِهِنَّ تَضْرِبُ ثُدِيُّهُنَّ قَالَ الشَّيْخُ وَالْآثَارُ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ فِي ذَلِكَ صَحِيحَةٌ وَإِنَّهَا تَدُلُّ عَلَى أَنَّ رَأْسَهَا وَرَقَبَتَهَا وَمَا يَظْهَرُ مِنْهَا فِي حَالِ الْمِحْنَةِ لَيْسَ بِعَوْرَةٍ فَأَمَّا حَدِيثُ عَمْرِو بْنِ شُعَيْبٍ فَقَدِ اخْتُلِفَ فِي مَتْنِهِ فَلَا يَنْبَغِي أَنْ يُعْتَمَدَ عَلَيْهِ فِي عَوْرَةِ الْأَمَةِ وَإِنْ كَانَ يَصْلُحُ الِاسْتِدْلَالُ بِهِ وَبِسَائِرِ مَا يَأْتِي عَلَيْهِ مَعَهُ فِي عَوْرَةِ الرَّجُلِ وَبِاللهِ التَّوْفِيقُ وَقَدِ احْتَجَّ بَعْضُ أَصْحَابِنَا فِي ذَلِكَ بِحَدِيثٍ

[Machine] The Messenger of Allah ﷺ said: "Whoever wishes to buy a slave girl or has already bought one, let him look at her entire body except for her 'awrah. Her 'awrah is what is between the knot of her waist-wrapper and her knees." Abu Sa'ad al-Malini narrated to us, Abu Ahmad ibn 'Adi al-Hafiz relayed to us, reporting from Ahmad ibn Salih al-Farisi, who reported from Al-Husayn ibn 'Isa, who reported from Muhammad ibn Isma'il al-Madinin, who narrated from Muhammad al-Tamimi, who narrated from 'Isa ibn Maymun. Abu Ahmad (may Allah have mercy on him) said: he mentioned that the name of 'Isa ibn Maymun is actually Muhammad ibn Nuh. The Sheikh said: thus, this chain of narrators is not strong enough to be considered a reliable proof and 'Isa ibn Maymun is weak. It has also been narrated from Hafs ibn 'Umar from Salih ibn Hassan from Muhammad ibn Ka'ab, and he is also weak.  

البيهقي:٣٢٢٣عَنْ عِيسَى بْنِ مَيْمُونٍ عَنْ مُحَمَّدِ بْنِ كَعْبٍ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ

قَالَ رَسُولُ اللهِ ﷺ مَنْ أَرَادَ شِرَاءَ جَارِيَةٍ أَوِ اشْتَرَاهَا فَلْيَنْظُرْ إِلَى جَسَدِهَا كُلِّهِ إِلَّا عَوْرَتَهَا وَعَوْرَتُهَا مَا بَيْنَ مَعْقِدِ إِزَارِهَا إِلَى رُكْبَتِهَا أَخْبَرَنَاهُ أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ ثنا أَحْمَدُ بْنُ صَالِحٍ الْفَارِسِيُّ بِصُورَ ثنا الْحُسَيْنُ بْنُ عِيسَى ثنا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْمَدِينِيُّ عَنْ مُحَمَّدٍ التَّمِيمِيِّ عَنْ عِيسَى بْنِ مَيْمُونٍ فَذَكَرَهُ قَالَ أَبُو أَحْمَدَ رَحِمَهُ اللهُ هُوَ مُحَمَّدُ بْنُ نُوحٍ قَالَ الشَّيْخُ فَهَذَا إِسْنَادٌ لَا تَقُومُ بِمِثْلِهِ حُجَّةٌ وَعِيسَى بْنُ مَيْمُونٍ ضَعِيفٌ وَقَدْ رُوِيَ عَنْ حَفْصِ بْنِ عُمَرَ عَنْ صَالِحِ بْنِ حَسَّانَ عَنْ مُحَمَّدِ بْنِ كَعْبٍ وَهُوَ أَيْضًا ضَعِيفٌ

[Machine] The Messenger of Allah ﷺ said, "It is permissible for a man to look at a slave girl if he wants to buy her, and to examine her from her nakedness up to the knot of her waistcloth."  

البيهقي:٣٢٢٤أَخْبَرَنَاهُ أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ أنبأ عُمَرُ بْنُ سِنَانٍ ثنا عَبَّاسٌ الْخَلَّالُ ثنا يَحْيَى بْنُ صَالِحٍ ثنا حَفْصُ بْنُ عُمَرَ ثنا صَالِحُ بْنُ حَسَّانَ عَنْ مُحَمَّدِ بْنِ كَعْبٍ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ

قَالَ رَسُولُ اللهِ ﷺ لَا بَأْسَ أَنْ يُقَلِّبَ الرَّجُلُ الْجَارِيَةَ إِذَا أَرَادَ أَنْ يَشْتَرِيَهَا وَيَنْظُرَ إِلَيْهَا مَا خَلَا عَوْرَتَهَا وَعَوْرَتُهَا مَا بَيْنَ رُكْبَتِهَا إِلَى مَعْقِدِ إِزَارِهَا
