12. Ḥajj and ʿUmrah (1/34)
[Machine] In His saying, "And whoever disbelieves - then indeed, Allah is Free from need of the worlds." [Al Imran 97] It means that whoever disbelieves in the obligation of Hajj and does not perform it with righteousness, nor refrains from committing sins.
[Machine] When the verse "And whoever seeks a religion other than Islam, it will never be accepted of him" [Quran 3:85] was revealed, the Jews said, "We are Muslims." Allah replied, "Dispute with them regarding their claim." The Prophet ﷺ said to them, "Indeed, Allah has commanded the Muslims to perform Hajj to the Ka'bah for those who are able to make the journey." They said, "It was not prescribed for us, and we refuse to perform Hajj." Allah then said, "And whoever disbelieves - indeed, Allah is Free of need from the worlds." [Quran 3:97] Ikrima said, "And whoever disbelieves among the people of various religions - indeed, Allah is Free of need from the worlds."
[Machine] In His saying, "{And whoever disbelieves - then indeed, Allah is Free from need of the worlds}" [Al Imran 97], it is reported that whoever performs Hajj, he has not seen any good, and whoever abandons it, he has not seen any evil. It has also been narrated from Mujahid similar to what Ikrimah said.
[Machine] About Mujahid's statement regarding the verse "And whoever desires other than Islam as religion, never will it be accepted from him" (Quran 3:85), when this verse was revealed, the people of different religions said, "We are all Muslims." So Allah revealed the verse "And pilgrimage to the House is a duty unto Allah for mankind" (Quran 3:97), indicating that it is obligatory for Muslims to perform Hajj, while the polytheists abandoned it.
[Machine] While we were with the Messenger of Allah ﷺ on a certain day, a man with extremely white clothes and intense black hair appeared. There were no signs of travel on him and we did not know him until he sat down next to the Messenger of Allah ﷺ . He leaned his knees against the Prophet's knees and placed his hands on his thighs. Then he said, "O Muhammad, tell me about Islam. What is Islam?" The Messenger of Allah ﷺ replied, "Islam is to testify that there is no god but Allah and that Muhammad is His servant and Messenger, to establish prayer, to give Zakat, to fast in Ramadan, and to perform Hajj if you are able to do so." The man said, "You have spoken the truth." Then he listed the rest of the Hadith. Then the Messenger of Allah ﷺ said to me, "O Umar, do you know who the questioner was?" I replied, "Allah and His Messenger know best." He said, "That was Gabriel. He came to teach you your religion."
We were forbidden that we should ask anything (without the genuine need) from the Holy Prophet. It, therefore, pleased us that an intelligent person from the dwellers of the desert should come and asked him (the Holy Prophet) and we should listen to it. A man from the dwellers of the desert came (to the Holy Prophet) and said: Muhammad, your messenger came to us and told us your assertion that verily Allah had sent you (as a prophet). He (the Holy Prophet) remarked: He told the truth. He (the bedouin) said: Who created the heaven? He (the Holy Prophet) replied: Allah. He (the bedouin again) said: Who created the earth? He (the Holy Prophet) replied: Allah. He (the bedouin again) said: Who raised these mountains and who created in them whatever is created there? He (the Holy Prophet) replied: Allah. Upon this he (the bedouin) remarked: By Him Who created the heaven and created the earth and raised mountains thereupon, has Allah (in fact) sent you? He (the Holy Prophet) said: Yes. He (the bedouin) said: Your messenger also told us that five prayers (had been made) obligatory for us during the day and the night. He (the Holy Prophet) remarked: He told you the truth. He (the bedouin) said: By Him Who sent you, is it Allah Who ordered you about this (i. e. prayers)? He (the Holy Prophet) said: Yes. He (the bedouin) said: Your messenger told us that Zakat had been made obligatory in our riches. He (the Holy Prophet) said. He has told the truth. He (the bedouin) said: By Him Who sent you (as a prophet), is it Allah Who ordered you about it (Zakat)? He (the Holy Prophet) said: Yes. He (the bedouin) said: Your messenger told us that it had been made obligatory for us to fast every year during the month of Ramadan. He (the Holy Prophet) said: He has told the truth. He (the bedouin) said: By Him Who sent you (as a prophet), is it Allah Who ordered you about it (the fasts of Ramadan)? He (the Holy Prophet) said: Yes. He (the bedouin) said: Your messenger also told us that pilgrimage (Hajj) to the House (of Ka'bah) had been made obligatory for him who is able to undertake the journey to it. He (the Holy Prophet) said: Yes. The narrator said that he (the bedouin) set off (at the conclusion of this answer, but at the time of his departure) remarked: 'By Him Who sent you with the Truth, I would neither make any addition to them nor would I diminish anything out of them. Upon this the Prophet remarked: If he were true (to what he said) he must enter Paradise. (Using translation from Muslim 12a)
[Machine] The Messenger of Allah ﷺ said: The pen is lifted from three people; the sleeper until he awakens, the young child until he reaches the age of puberty, and the insane person until he regains his sanity. This hadith was narrated to us by Abu Thabyan and Abu Al-Dhuhay from Ali.
[Machine] The Messenger of Allah ﷺ said: "Whoever performs Hajj as a child and then reaches puberty, he must perform Hajj again. And whoever from the Bedouins performs Hajj and then migrates, he must perform Hajj again. And whoever performs Hajj as a slave and then is freed, he must perform Hajj again."
[Machine] "He said, if the Bedouin performs Hajj and then migrates, then he has the Hajj of Islam, and the same applies for the slave and the young child."
12.2 [Machine] The obligation of Hajj once
Messenger of Allah ﷺ addressed us and said: O people, Allah has made Hajj obligatory for you; so perform Hajj. Thereupon a person said: Messenger of Allah, (is it to be performed) every year? He (the Holy Prophet) kept quiet, and he repeated (these words) thrice, whereupon Messenger of Allah ﷺ said: If I were to say" Yes," it would become obligatory (for you to perform it every year) and you would not be able to do it. Then he said: Leave me with what I have left to you, for those who were before you were desroyed because of excessive questioning, and their opposition to their apostles. So when I command you to do anything, do it as much as it lies in your power and when I forbid you to do anything, then abandon it. (Using translation from Muslim 1337)
[Machine] I heard Jabir bin Abdullah say, "We have declared the companions of the Messenger of Allah ﷺ as pure by performing the Hajj sincerely." Then he mentioned the Hadith and said, "Suraqah bin Malik asked, 'O Messenger of Allah, is this permission for our year only or forever?' He said, 'No, it is forever.'"
[Machine] The Prophet ﷺ delivered a sermon and said, "O people, Allah has made Hajj obligatory upon you." Al-Aqra' bin Habis stood up and asked, "O Messenger of Allah, is it obligated every year?" He replied, "If I were to say yes, it would become obligatory and you would not be able to fulfill it every year. However, whoever performs it voluntarily, it will be counted as a means of reward." Sufyan bin Husayn and Muhammad bin Abi Hafsah narrated this from Az-Zuhri, who learned it from Abu Sinan Ad-Dawli. In a narration by Jabir bin Abdullah, Suraqah bin Malik asked, "O Messenger of Allah, is this (taking slaves as captives) a temporary dispensation for us or is it lawful forever?" He answered, "No, rather it is lawful forever."
12.3 [Machine] Women's Hajj
[Machine] The Messenger of Allah ﷺ said, "However, the best form of jihad and the most excellent is performing the pilgrimage, a pilgrimage that is accepted (by Allah)." Aisha responded, "Then, I will never abandon performing the pilgrimage after I heard this from the Messenger of Allah ﷺ."
[Machine] "Suhaib asked the Prophet ﷺ for permission to participate in jihad, and the Prophet ﷺ replied, 'Is it enough for you to perform Hajj or is it your jihad?' 8620 Abu Abdullah Al-Hafiz and Abu Zakariya reported that Abu Bakr Ahmad bin Kamil narrated from Ahmad bin Saeed from Qabisa from Sufyan from Habib bin Abi Umayrah from Aisha bint Talha from Aisha Umm al-Mu'minin from the Prophet ﷺ in a similar manner. Both Bukhari in his authentic book and Qabisa bin Uqba narrated it."
[Machine] Umar granted permission to the Prophet's wives to perform Hajj, so he sent with them Uthman bin Affan and Abdur Rahman bin Auf. Uthman announced to the people that no one should approach them or look at them except by glancing, as they were in Al-Hawdaj riding on camels. They were brought down at As-Sa'dar and Abdul Rahman bin Auf and Uthman descended while acknowledging their mistake, and no one sat with them.
[Machine] "Allah ﷺ said to his wives during the Farewell Pilgrimage, then the time of confinement came. The Sheikh mentioned about Aisha's pilgrimage and others from the mothers of the believers that after the Prophet ﷺ , there is evidence that the intention of this news is the obligation of Hajj upon them once, as he clarified its obligation upon men once, not preventing them from doing it more than once, and Allah knows best."
12.4 [Machine] The statement of the path that necessitates Hajj when it becomes possible to do so
[Machine] It was said, "O Messenger of Allah, what is the way to perform Hajj?" He said, "The way is to have provisions and means of transportation." And it has been narrated from the Hadith of Al-Hasan Al-Basri from the Prophet ﷺ as a hadith Mursal.
[Machine] The Prophet ﷺ was asked about the way. He replied, "The provisions and the means of transportation." This is supported by the narration of Ibrahim ibn Yazid al-Khuzai, and it is also narrated from Ibn Abbas that he said it while being attributed to him.
12.5 [Machine] The wandering in his body does not apply to a ship, and he is able to control or hire it, so he must perform the duty of Hajj.
‘Abd Allah bin Abbas said Al Fadl bin Abbas was riding the Camel behind the Apostle of Allaah ﷺ. A woman of the tribe of Khath’am came seeking his (the Prophet’s) decision (about a problem relating to Hajj). Al Fadl began to look at her and she too began to look at him. The Apostle of Allaah ﷺ would turn the face of Fadl to the other side. She said Apostle of Allaah ﷺ Allaah’s commandment that His servants should perform Hajj has come when my father is an old man and is unable to sit firmly on a Camel. May I perform Hajj on his behalf? He said yes, That was at the Farewell Pilgrimage. (Using translation from Abū Dāʾūd 1809)

Do you think he should perform Hajj on behalf of him?' He replied, 'Yes.' Sufyan said, 'This is how I have memorized it, that she said, 'Do you think he should perform Hajj on behalf of him?' Others have narrated it in a different way, 'Do you think I should perform Hajj on behalf of him?'' Sufyan said, 'Amr bin Dinar narrated to us first from Az-Zuhri from Sulaiman bin Yasir from Ibn Abbas, and he asked, 'Will that benefit him, O Messenger of Allah?' He replied, 'Yes, just as if one of you had a debt and it was paid off.' When Az-Zuhri narrated to us, I looked into it and he did not mention this statement which

She mentioned that her father is an old man who cannot ride on a camel. So, is it sufficient if she performs Hajj on his behalf? The Messenger of Allah ﷺ replied, "Yes."

[Machine] A man from Khaitham came to the Prophet ﷺ and said, "O Messenger of Allah, my father has embraced Islam, but he is an elderly man who cannot ride a camel. The obligation of Hajj (pilgrimage) is prescribed on him, so should I perform Hajj on his behalf?" The Prophet ﷺ asked, "Are you his eldest son?" He replied, "Yes." The Prophet ﷺ then asked, "What if your father had a debt, and you paid it off, would that suffice?" He answered, "Yes." The Prophet ﷺ then advised, "Then perform Hajj on his behalf." There was a difference of opinion regarding this matter, and it was resolved by Mansur. Jareer ibn Abd al-Hamid narrated the incident in this manner.
[Machine] A man came to the Prophet ﷺ and said, "Indeed, my father is an old man who is unable to perform Hajj." The Messenger of Allah ﷺ said, "If your father had a debt and you paid it off for him, would that be accepted from you?" He replied, "Yes." The Prophet ﷺ said, "Allah is more merciful to fulfill the rights of your father regarding Hajj." Abu Al-Hasan Al-Muqri’ informed us, on the authority of Al-Hasan ibn Muhammad ibn Ishaq, on the authority of Yusuf ibn Ya’qub, on the authority of Muhammad ibn Abi Bakr, on the authority of Abdul Aziz ibn Abdul Samad, who mentioned and narrated it. Israel reported it from Mansur, from Mujahid, from the freed slave of the descendants of Ibn Zubayr, from Ibn Zubayr, that Sawdah said, "O Messenger of Allah!" Then he mentioned it and Ath-Thawri reported it from Mansur, saying that Yusuf ibn Zubayr reported it from Mujahid, who reported it from Yusuf ibn Zubayr, who reported it from Ibn Zubayr, from the Prophet ﷺ. And this is what Al-Bukhari stated.

[Machine] A man came to the Prophet ﷺ and said, "Indeed, my mother is a very old woman whom we cannot carry on the camel, as she is not able to hold on, and if I tie her, I fear that she may die. Should I perform Hajj on her behalf?" He (the Prophet) said, "Yes, the narrations of Ibn Sirin from Ibn Abbas indicate that it can be done on behalf of someone else. And it has also been narrated from Auf bin Abi Jamilah from Ibn Sirin from Abu Hurairah, and the narration of Ayyub is the most authentic. And Allah knows best."

12.6 [Machine] The man can endure walking but does not have provisions or means of transport, so it is not clear whether he is obligated to perform Hajj. Imam Shafi'i, may Allah have mercy on him, said: Narrations have been reported from the Prophet ﷺ indicating that it is not obligatory for someone to walk to perform Hajj, even if he is capable of doing so, except in certain cases that are disputed among the scholars of Hadith regarding their authenticity. Then he mentioned the narration that...

[Machine] We sat with Abdullah bin Umar and I heard him say that a man asked the Messenger of Allah ﷺ , "What is Hajj?" The Prophet ﷺ replied, "To perform Tawaf around the Kaaba." Then another man stood up and asked, "O Messenger of Allah, which Hajj is superior?" The Prophet ﷺ replied, "Al-Ajj and Al-Thajj." Then another man stood up and asked, "O Messenger of Allah, what is the means (of performing Hajj)?" The Prophet ﷺ replied, "Provisions and transportation." This is what Ash-Shafi'i referred to in his saying, "Some of it is permissible to differentiate among scholars in its correctness, but they only refrained from it because the hadith is attributed to Ibrahim bin Yazid Al-Khawzi, and the scholars weakened him in hadith (narration)." Ahmad bin Saad Al-Malini informed us that Abu Ahmad bin Adi Al-Hafith narrated to us on the authority of Ali bin Ahmad bin Sulaiman, who narrated on the authority of Ahmad bin Sa'id bin Abi Maryam, who said, "I heard Yahya bin Ma'in say, 'Ibrahim bin Yazid Al-Khawzi narrated the hadith of Muhammad bin Abbad, but he is not trustworthy.'"

It was asked, "O Messenger of Allah, what is the way?" He replied, "Whoever finds provisions and means of transportation, this is what is meant." This narration is transmitted by Qatadah from Al-Hasan from the Prophet ﷺ as a Mursalan (undisputed) narration, and likewise.

[Machine] The Mother of the Believers, the wife of the Messenger of Allah ﷺ , narrated to us that Abu Abdullah Al-Hafiz informed me that Abu Amr ibn Abi Ja'far narrated to me from Al-Hasan ibn Sufyan, who narrated from Abu Bakr ibn Abi Shaybah, who narrated from Ibn Ulayyah, who narrated from Ibrahim, who narrated from Al-Aswad, who narrated from the Mother of the Believers and Qasim, who both said: I said, "O Messenger of Allah, people perform two rituals, and I perform only one." He said, "Wait until you become pure, then go out to the Tan'eem and announce your Ihram, and then we will perform the rituals together at such and such place." I think he said, "Tomorrow," but it depends on your period or your menstruation, or as the Messenger of Allah ﷺ said.

[Machine] The Messenger of Allah ﷺ said: "Spending in Hajj is like spending in the cause of Allah, seventy times."
[Machine] The people of Yemen used to perform Hajj without taking provisions with them, and they would say, "We rely on Allah." They would perform Hajj to Makkah and ask people for provisions. Then, Allah revealed the verse, "And take provisions, but indeed, the best provision is Taqwa (piety)." (Surah Al-Baqarah, 197)
[Machine] That the Messenger of Allah ﷺ performed Hajj on a riding camel and his companion was with him.
[Machine] To look at the most similar companions who accompanied the Prophet ﷺ in his final Hajj, when they arrived for the Farewell Pilgrimage, one should observe this group.
[Machine] My eyes witnessed my beloved, the Messenger of Allah ﷺ , standing in Arafat with the people, on a red, slender camel. Underneath him was a woolen saddle blanket. He was saying, "O Allah, make this a Hajj devoid of hypocrisy, show, or fame." And the people were saying, "This is the Messenger of Allah ﷺ ." Said bin Bashir said, "So I asked Abdullah bin Hakim, 'O Abu Hakim, what is "Al-Quswa"?' He said, 'I think it means the ears, as the ears of a camel are cut off for them to hear properly.'"

[Machine] Abu Amr Al-Adib informed us that Abu Bakr Al-Isma'ili informed us that Al-Hadrami narrated from Harun ibn Ishaq from his book, who narrated from Waki' from Sufyan from Tariq who said, "I heard Ibn Abi Awfa being asked about a man who borrows and performs Hajj. He said, 'He relies on Allah for sustenance and does not borrow.' He said, 'We used to say that no one borrows unless he has the means to repay.'"

12.10 [Machine] The man hires himself from a man who serves him, then he tempts him to perform Hajj with him or rents his camel and then performs Hajj and his Hajj is completed.
[Machine] Abu Al-Abbas Al-Asam reported that Al-Rabi' narrated from Al-Shafi'i, who narrated from Muslim and Sa'id, who reported from Ibn Jurayj, who reported from 'Ata', who reported from Ibn 'Abbas (may Allah be pleased with him) that a man asked him: "I would like to accompany these people and perform the rituals with them. Will I be rewarded?" Ibn 'Abbas said: "Yes, they will have a share of what they have earned, and Allah is swift in taking account." [Surah Al-Baqarah, 202]
[Machine] "And Allah, for them is a share from what they have earned, and Allah is swift in account-taking." [Al-Baqarah 202] And similarly,
I was a man who used to give (riding-beasts) on hire for this purpose (for travelling during the pilgrimage) and the people would tell (me): Your hajj is not valid. So I met Ibn Umar and told him: AbuAbdurRahman, I am a man who gives (riding-beast) on hire for this purpose (i.e. for hajj), and the people tell me: Your hajj is not valid. Ibn Umar replied: Do you not put on ihram (the pilgrim dress), call the talbiyah (labbayk), circumambulate the Ka'bah, return from Arafat and lapidate jamrahs? I said: Why not? Then he said: Your hajj is valid. a man came to the Prophet ﷺ and asked him the same question you have asked me. The Messenger of Allah ﷺ kept silence and did not answer him till this verse came down: "It is no sin for you that you seek the bounty of your Lord." The Messenger of Allah ﷺ sent for him and recited this verse to him and said: Your hajj is valid. (Using translation from Abū Dāʾūd 1733)
12.11 [Machine] Trade in Hajj
[Machine] There were markets in 'Ukaz, Majannah, and Dhul-Majaz during the pre-Islamic era. When Islam came, they were forbidden from engaging in trade there. Allah then revealed the verse: "There is no blame upon you" (Surah Al-Baqarah 198) to seek the bounty of your Lord during the seasons of Hajj.
