12. Ḥajj and ʿUmrah (2/34)
١٢۔ كِتَابُ الْحَجِّ ص ٢
The people used to trade, in the beginning, at Mina, Arafat, the market place of Dhul-Majaz, and during the season of hajj. But (later on) they became afraid of trading while they were putting on ihram. So Allah, glory be to Him, sent down this verse: "It is no sin for you that you seek the bounty of your Lord during the seasons of hajj." Ubayd ibn Umayr told me that he (Ibn Abbas) used to recite this verse in his codex. (Using translation from Abū Dāʾūd 1734)
أَنَّ النَّاسَ فِي أَوَّلِ الْحَجِّ كَانُوا يَتَبَايَعُونَ بِمِنًى وَعَرَفَةَ وَسُوقِ ذِي الْمَجَازِ وَمَوَاسِمِ الْحَجِّ فَخَافُوا الْبَيْعَ وَهُمْ حُرُمٌ فَأَنْزَلَ اللهُ تَبَارَكَ وَتَعَالَى {لَيْسَ عَلَيْكُمْ جُنَاحٌ أَنْ تَبْتَغُوا فَضْلًا مِنْ رَبِّكُمْ} [البقرة 198] فِي مَوَاسِمِ الْحَجِّ زَادَ آدَمُ فِي رِوَايَتِهِ قَالَ فَحَدَّثَنِي عُبَيْدُ بْنُ عُمَيْرٍ أَنَّهُ كَانَ يَقْرَؤُهَا فِي الْمُصْحَفِ
12.12 [Machine] The possibility of Hajj
١٢۔١٢ بَابُ إِمْكَانِ الْحَجِّ
[Machine] From the Prophet ﷺ , he said: "Whoever is not prevented by illness, obvious need, or unjust ruler, and does not perform Hajj, then let him die as a Jew or a Christian, if he wishes." And even though its chain of narration is not strong, there is a witness from the words of Umar ibn Al-Khattab.
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ لَمْ يَحْبِسْهُ مَرَضٌ أَوْ حَاجَةٌ ظَاهِرَةٌ أَوْ سُلْطَانٌ جَائِرٌ وَلَمْ يَحُجَّ فَلْيَمُتْ إِنْ شَاءَ يَهُوَدِيًّا أَوْ نَصْرَانِيًّا وَهَذَا وَإِنْ كَانَ إِسْنَادُهُ غَيْرَ قَوِيٍّ فَلَهُ شَاهِدٌ مِنْ قَوْلِ عُمَرَ بْنِ الْخَطَّابِ ؓ
[Machine] He informed him that he heard Umar ibn al-Khattab saying, "Let him die as a Jew or a Christian," saying it three times. A man died without performing Hajj, and he found ease and his way was clear, so he performed Hajj, and I being unable to, would love for it to be more beloved to me than six or seven expeditions of Ibn Nuaym. If there is doubt about a battle that I will fight after performing Hajj, it would be more beloved to me than six or seven Hajj pilgrimages of Ibn Nuaym.
أَخْبَرَهُ أَنَّهُ سَمِعَ عُمَرَ بْنَ الْخَطَّابِ ؓ يَقُولُ لِيَمُتْ يَهُوَدِيًّا أَوْ نَصْرَانِيًّا يَقُولُهَا ثَلَاثَ مَرَّاتٍ رَجُلٌ مَاتَ وَلَمْ يَحُجَّ وَجَدَ لِذَلِكَ سَعَةً وَخُلِّيَتْ سَبِيلُهُ فَحَجَّةٌ أَحُجُّهَا وَأَنَا صَرُورَةٌ أَحَبُّ إِلَيَّ مِنْ سِتِّ غَزَوَاتٍ أَوْ سَبْعٍ ابْنُ نُعَيْمٍ يَشُكُّ وَلَغَزْوَةٌ أَغْزُوهَا بَعْدَمَا أَحُجُّ أَحَبُّ إِلَيَّ مِنْ سِتِّ حَجَّاتٍ أَوْ سَبْعٍ ابْنُ نُعَيْمٍ يَشُكُّ فِيهِمَا
12.13 [Machine] Sea travel for Hajj, Umrah, or military expedition.
١٢۔١٣ بَابُ رُكُوبِ الْبَحْرِ لِحَجٍّ أَوْ عُمْرَةٍ أَوْ غَزْوٍ
[Machine] The Messenger of Allah ﷺ said, "A man should not ride the sea except as a warrior, a pilgrim, or a person performing 'umrah. And indeed, beneath the sea is fire, and beneath fire is the sea." And it was narrated about Muttarif, from Bashir ibn Muslim, from Abdullah ibn 'Amr, that Abu 'Ali al-Rudhbary informed us, who was informed by Abu Bakr ibn Dasa, who was informed by Abu Dawud, who was informed by Sa'eed ibn Mansur, who was informed by Isma'il ibn Zakariyya, from Muttarif, who mentioned it and said, "One should not ride the sea." And we have been informed by Abu Bakr al-Farisi, who was informed by Ibrahim ibn Abdullah al-Asbahani, who was informed by Abu Ahmad ibn Faris, who said, Muhammad ibn Isma'il al-Bukhari said, "His hadith (referring to the hadith of Bashir ibn Muslim) is not authentic."
قَالَ رَسُولُ اللهِ ﷺ لَا يَرْكَبَنَّ رَجُلٌ بَحْرًا إِلَّا غَازِيًا أَوْ مُعْتَمِرًا أَوْ حَاجًّا وَإِنَّ تَحْتَ الْبَحْرِ نَارًا وَتَحْتَ النَّارِ بَحْرًا 8663 وَقِيلَ فِيهِ عَنْ مُطَرِّفٍ عَنْ بِشْرِ أَبِي عَبْدِ اللهِ عَنْ بَشِيرِ بْنِ مُسْلِمٍ عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا إِسْمَاعِيلُ بْنُ زَكَرِيَّا عَنْ مُطَرِّفٍ فَذَكَرَهُ وَقَالَ لَا يَرْكَبُ الْبَحْرَ 8664 وَقَدْ أَخْبَرَنَا أَبُو بَكْرٍ الْفَارِسِيُّ أَنْبَأَ إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ الْأَصْبَهَانِيُّ ثنا أَبُو أَحْمَدَ بْنُ فَارِسٍ قَالَ قَالَ مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْبُخَارِيُّ لَمْ يَصِحَّ حَدِيثُهُ يَعْنِي حَدِيثَ بَشِيرِ بْنِ مُسْلِمٍ هَذَا
[Machine] "He said that sea water does not suffice for purification or ritual impurity, for underneath the sea there is fire, then water, then fire, until it reaches seven seas and seven rivers. This is what was narrated while paused."
أَنَّهُ قَالَ مَاءُ الْبَحْرِ لَا يُجْزِئُ مِنْ وُضُوءٍ وَلَا مِنْ جَنَابَةٍ إِنَّ تَحْتَ الْبَحْرِ نَارًا ثُمَّ مَاءً ثُمَّ نَارًا حَتَّى عَدَّ سَبْعَةَ أَبْحُرٍ وَسَبْعَةَ أَنْيَارٍ هَكَذَا رُوِيَ مَوْقُوفًا
[Machine] The Messenger of Allah ﷺ said, "The sea is Hell, followed by [a fire] surrounding them with awnings." [Al-Kahf 29] He said, "By Allah, I will never enter it, and by Allah, not even a single droplet of it will touch me."
قَالَ رَسُولُ اللهِ ﷺ الْبَحْرُ هُوَ جَهَنَّمُ ثُمَّ تَلَا {نَارًا أَحَاطَ بِهِمْ سُرَادِقُهَا} [الكهف 29] قَالَ يَعْلَى وَاللهِ لَا أَدْخُلُهُ أَبَدًا وَاللهِ لَا تُصِيبُنِي مِنْهُ قَطْرَةُ أَبَدًا
[Machine] "That the Messenger of Allah ﷺ said: The reward for performing Hajj for one who has not previously performed it is greater than the rewards of ten military expeditions, and one military expedition for one who has already performed Hajj is greater than the rewards of ten Hajj pilgrimages. And a military expedition by sea is greater in reward than ten military expeditions by land. And whoever crosses the sea, it is as if they have crossed all the valleys, and the rewards for their deeds are multiplied, just as the reward for the one who has washed himself in his own blood."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ حَجَّةٌ لِمَنْ لَمْ يَحُجَّ خَيْرٌ مِنْ عَشْرِ غَزَوَاتٍ وَغَزْوَةٌ لِمَنْ قَدْ حَجَّ خَيْرٌ مِنْ عَشْرِ حِجَجٍ وَغَزْوَةٌ فِي الْبَحْرِ خَيْرٌ مِنْ عَشْرِ غَزَوَاتٍ فِي الْبَرِّ وَمَنِ اجْتَازَ الْبَحْرَ فَكَأَنَّمَا اجْتَازَ الْأَوْدِيَةَ كُلَّهَا وَالْمَائِدُ فِيهِ كَالْمُتَشَحِّطِ فِي دَمِهِ كَذَا
Umm Haram reported the Prophet ﷺ as saying “He who becomes sick on a stormy sea and vomits will have the reward of a martyr. And he who is drowned will have a reward of two martyrs. (Using translation from Abū Dāʾūd 2493)
النَّبِيِّ ﷺ أَنَّهُ قَالَ الْمَائِدُ فِي الْبَحْرِ الَّذِي يُصِيبُهُ الْقَيْءُ لَهُ أَجْرُ شَهِيدٍ وَالْغَرِقُ لَهُ أَجْرُ شَهِيدَيْنِ
[Machine] I heard from the Messenger of Allah ﷺ saying: "I said: Yes. He said: I heard the Messenger of Allah ﷺ saying: Indeed, I know of a land called Oman, where the sea flows along its side. The pilgrimage (hajj) from there is better than two other pilgrimages from elsewhere."
سَمِعْتُ مِنَ رَسُولِ اللهِ ﷺ يَقُولُ قُلْتُ بَلَى قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِنِّي لَأَعْلَمُ أَرْضًا يُقَالُ لَهَا عُمَانُ يَنَضَحُ بِجَانِبِهَا الْبَحْرُ الْحَجَّةُ مِنْهَا أَفْضَلُ مِنْ حَجَّتَيْنِ مِنْ غَيْرِهَا
12.14 [Machine] Performing Hajj on behalf of a deceased person and the obligation of a compulsory Hajj from one's wealth.
١٢۔١٤ بَابُ الْحَجِّ عَنِ الْمَيِّتِ وَأَنَّ الْحَجَّةَ الْوَاجِبَةَ مِنْ رَأْسِ الْمَالِ
[Machine] A woman came to the Prophet ﷺ and said, "O Messenger of Allah, I had made a bequest to my mother for a young girl. However, she passed away and left behind the girl. Should I fulfill my bequest and give her the girl?" The Prophet ﷺ replied, "Yes, you should fulfill your bequest and the girl shall be returned to you as part of the inheritance." The woman then asked, "But she had a missed fast. Can I fast on her behalf?" The Prophet ﷺ answered, "Yes, you may fast on her behalf." She further asked, "And if she had not performed the pilgrimage, can I perform it on her behalf?" The Prophet ﷺ replied, "Yes, you may perform the pilgrimage on her behalf." This hadith was narrated by Abu Nasr Al-Fami, from Abu Abdullah, from Muhammad ibn Shadhan, from Ali ibn Hujr, from Ali ibn Musheer, from Abdullah ibn Ata' through a similar chain of narration.
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي كُنْتُ تَصَدَّقْتُ عَلَى أُمِّي بِوَلِيدَةٍ وَإِنَّهَا مَاتَتْ وَتَرَكَتِ الْوَلِيدَةَ قَالَ وَجَبَ أَجْرُكِ وَرَجَعَ إِلَيْكِ فِي الْمِيرَاثِ قَالَتْ فَإِنَّهَا مَاتَتْ وَعَلَيْهَا صَوْمٌ فَيُجْزِئُ أَنْ أَصُومَ عَنْهَا؟ قَالَ نَعَمْ قَالَتْ وَلَمْ تَحُجَّ فَيُجْزِئُ أَنْ أَحُجَّ عَنْهَا؟ قَالَ نَعَمْ 8671 وَأَخْبَرَنَا أَبُو نَصْرٍ الْفَامِيُّ ثنا أَبُو عَبْدِ اللهِ ثنا مُحَمَّدُ بْنُ شَاذَانَ ثنا عَلِيُّ بْنُ حُجْرٍ أنبأ عَلِيُّ بْنُ مُسْهِرٍ عَنْ عَبْدِ اللهِ بْنِ عَطَاءٍ بِهَذَا الْإِسْنَادِ نَحْوَهُ
A woman came to the Prophet ﷺ and said, "My mother vowed to perform the Hajj but she died before performing it. Should I perform the Hajj on her behalf?" He said, "Yes! Perform the Hajj on her behalf. See, if your mother had been in debt, would you have paid her debt?" She said, "Yes." He said, "So you should pay what is for Him as Allah has more right that one should fulfill one's obligations to Him. " (Using translation from Bukhārī 7315)
أَنَّ امْرَأَةً جَاءَتْ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ يَعْنِي إِنَّ أُمِّي نَذَرَتْ أَنْ تَحُجَّ فَمَاتَتْ قَبْلَ أَنْ تَحُجَّ أَفَأَحُجُّ عَنْهَا؟ قَالَ نَعَمْ فَحُجِّي عَنْهَا أَرَأَيْتِ لَوْ كَانَ عَلَى أُمِّكِ دَيْنٌ أَكُنْتِ قَاضِيَتِهِ؟ قَالَتْ نَعَمْ قَالَ اقْضُوا حَقَّ اللهِ فَإِنَّ اللهَ أَحَقُّ بِالْوَفَاءِ
[Machine] I said, "O Messenger of Allah, my father has reached an old age and is unable to perform the obligation of Allah in Hajj. Should I perform Hajj on his behalf?" He replied, "Yes, perform Hajj on his behalf." I asked, "O Messenger of Allah, what about those from our family who have passed away without leaving instructions for Hajj? Should we perform Hajj on their behalf?" He said, "Yes, and you will be rewarded." I asked, "Should we also give charity on their behalf and observe fasting on their behalf?" He replied, "Yes, and charity is better. The same applies to vows and walking to the mosque. The chain of narration for this hadith is weak."
قُلْتُ يَا رَسُولَ اللهِ إِنَّ أَبِي أَدْرَكَتْهُ فَرِيضَةُ اللهِ فِي الْحَجِّ وَهُوَ شَيْخٌ كَبِيرٌ لَا يَتَمَالَكُ عَلَى الرَّاحِلَةِ فَمَا تَرَى أَنْ أَحُجَّ عَنْهُ؟ قَالَ نَعَمْ حُجَّ عَنْهُ قَالَ يَا رَسُولَ اللهِ وَكَذَلِكَ مَنْ مَاتَ مِنْ أَهْلِينَا وَلَمْ يُوصِ بِحَجٍّ فَنَحُجُّ عَنْهُ؟ قَالَ نَعَمْ وَتُؤْجَرُونَ قَالَ وَيُتَصَدَّقُ عَنْهُ وَيُصَامُ عَنْهُ؟ قَالَ نَعَمْ وَالصَّدَقَةُ أَفْضَلُ وَكَذَلِكَ فِي النُّذُورِ وَالْمَشْيِ إِلَى الْمَسْجِدِ إِسْنَادُهُ ضَعِيفٌ
[Machine] Ata and Tawus said: "The obligatory charity is taken from the capital."
عَنْ عَطَاءٍ وَطَاوُسٍ أَنَّهُمَا قَالَا الْحَجَّةُ الْوَاجِبَةُ مِنْ رَأْسِ الْمَالِ
12.15 [Machine] The heading translates to "Who does not have the right to perform Hajj on behalf of others?
١٢۔١٥ بَابُ مَنْ لَيْسَ لَهُ أَنْ يَحُجَّ عَنْ غَيْرِهِ
[Machine] The Messenger of Allah ﷺ heard a man saying "Labbayk" for Shubrumah, so he asked, "Who is Shubrumah?" The man mentioned that he was his brother or relative. The Messenger then asked, "Have you ever argued with him?" The man replied, "No." The Messenger said, "Then make this (Hajj) on your behalf, and perform Hajj for Shubrumah. This is a valid chain of narration, and there is no stronger chain in this matter."
أَنَّ رَسُولَ اللهِ ﷺ سَمِعَ رَجُلًا يَقُولُ لَبَّيْكَ عَنْ شُبْرُمَةَ فَقَالَ مَنْ شُبْرُمَةُ فَذَكَرَ أَخًا لَهُ أَوْ قَرَابَةً قَالَ أَحَجَجْتَ قَطُّ؟ قَالَ لَا قَالَ فَاجْعَلْ هَذِهِ عَنْكَ ثُمَّ حُجَّ عَنْ شُبْرُمَةَ هَذَا إِسْنَادٌ صَحِيحٌ لَيْسَ فِي هَذَا الْبَابِ أَصَحُّ مِنْهُ
[Machine] The Prophet ﷺ heard a man shouting on behalf of Shubrumah. He asked, "Who is Shubrumah?" The man replied, "He is my brother or a relative of mine." The Prophet then asked, "Have you performed Hajj before?" The man replied, "No." The Prophet said, "Perform Hajj on behalf of yourself first, and then perform it on his behalf." This narration is also reported from Muhammad ibn Abdullah al-Ansari and Muhammad ibn Bishr on the authority of Ibn Abi Aroobah. It was also narrated by Ghandar on the authority of Sa'id ibn Abi Aroobah, who attributed it to Ibn Abbas and others.
أَنَّ النَّبِيَّ ﷺ سَمِعَ رَجُلًا يُلَبِّي عَنْ شُبْرُمَةَ فَقَالَ مَنْ شُبْرُمَةُ؟ فَقَالَ أَخِي أَوْ ذُو قَرَابَةٍ لِي فَقَالَ حَجَجْتَ قَطُّ؟ قَالَ لَا قَالَ فَاجْعَلْ هَذِهِ عَنْ نَفْسِكِ ثُمَّ حُجَّ عَنْهُ وَكَذَلِكَ رُوِيَ عَنْ مُحَمَّدِ بْنِ عَبْدِ اللهِ الْأَنْصَارِيِّ وَمُحَمَّدِ بْنِ بِشْرٍ عَنِ ابْنِ أَبِي عَرُوبَةَ وَرَوَاهُ غُنْدَرٌ عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ مَوْقُوفًا عَلَى ابْنِ عَبَّاسٍ وَمَنْ
[Machine] The Prophet ﷺ heard a man saying, "Labbaik for so-and-so." The Prophet ﷺ said to him, "If you have performed Hajj for him, then say Labbaik on his behalf. Otherwise, perform Hajj for yourself, and then perform Hajj for him as well."
سَمِعَ النَّبِيُّ ﷺ رَجُلًا يَقُولُ لَبَّيْكَ عَنْ فُلَانٍ فَقَالَ لَهُ النَّبِيُّ ﷺ إِنْ كُنْتَ حَجَجْتَ فَلَبِّ عَنْهُ وَإِلَّا فَاحْجُجْ عَنْ نَفْسِكَ ثُمَّ احْجُجْ عَنْهُ وَكَذَلِكَ
[Machine] "ﷺ saw a man bidding farewell on behalf of another man and said to him, 'Have you bid farewell on behalf of yourself?' He said, 'No.' ﷺ said, 'Then bid farewell on behalf of yourself, and then bid farewell on behalf of so-and-so, and so on.'"
ﷺ رَأَى رَجُلًا يُلَبِّي عَنْ رَجُلٍ فَقَالَ لَهُ لَبَيْتَ عَنْ نَفْسِكِ ؟ قَالَ لَا قَالَ فَلَبِّ عَنْ نَفْسِكَ ثُمَّ لَبِّ عَنْ فُلَانٍ وَكَذَلِكَ
[Machine] The Prophet ﷺ heard a man saying "Labbaik (Here I am) on behalf of Shubrumah." So he said, "Did you perform Hajj for yourself?" The man replied, "No." The Prophet then said, "Perform Hajj for yourself." Then 'Ali narrated to us, and he narrated to us from Abu Bakr an-Naysaburi, Abu 'Ali as-Saffar, and Ibn Makhlad who said, 'Abbas at-Tarqifi narrated to us, who narrated from al-Firiyabi something similar to it.
سَمِعَ النَّبِيُّ ﷺ رَجُلًا يَقُولُ لَبَّيْكَ عَنْ شُبْرُمَةَ فَقَالَ حَجَجْتَ عَنْ نَفْسِكِ؟ فَقَالَ لَا قَالَ عَنْ نَفْسِكِ فَلَبِّ قَالَ وَحَدَّثَنَا عَلِيٌّ حَدَّثَنَاهُ أَبُو بَكْرٍ النَّيْسَابُورِيُّ وَأَبُو عَلِيٍّ الصَّفَّارُ وَابْنُ مَخْلَدٍ قَالُوا ثنا عَبَّاسٌ التَّرْقُفِيُّ ثنا الْفِرْيَابِيُّ نَحْوَهُ
[Machine] The Messenger of Allah ﷺ heard a man saying the talbiyah on behalf of Shubrumah. So, he called him and asked him, "Have you performed Hajj?" The man replied, "No." The Prophet said to him, "Then this is on your behalf, and perform Hajj for Shubrumah as well." This was narrated from Abdullah ibn Habib ibn Abi Thabit, from Ata, from Ibn Abbas, through a connected chain of transmitters. And the narration of whoever narrates the hadith of Ata as a mursal (chain of narrators missing a link) is more authentic. And Allah knows best.
سَمِعَ رَسُولُ اللهِ ﷺ رَجُلًا يُلَبِّي عَنْ شُبْرُمَةَ قَالَ فَدَعَاهُ فَقَالَ لَهُ هَلْ حَجَجْتَ؟ قَالَ لَا قَالَ فَهَذِهِ عَنْكَ وَحُجَّ عَنْ شُبْرُمَةَ وَكَذَلِكَ رُوِيَ عَنْ عَبْدِ اللهِ بْنِ حَبِيبِ بْنِ أَبِي ثَابِتٍ عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ مُسْنَدًا وَرِوَايَةُ مَنْ رَوَى حَدِيثَ عَطَاءٍ مُرْسَلًا أَصَحُّ وَاللهُ أَعْلَمُ
عَنْ شُبْرُمَةَ هَكَذَا رُوِيَ مَوْقُوفًا
[Machine] Narrated Ali ibn Ahmad ibn Abdan, Sulaiman ibn Ahmad ibn Ayyub al-Tabarani, al-Hadrami, Abu Kurayb, and Muawiya ibn Hisham, Sufyan said: Sulaiman only reported this hadith from Sufyan. As for the hadith that he...
لَهُ رَسُولُ اللهِ ﷺ حُجَّ حَجَّةَ الْإِسْلَامِ ثُمَّ حُجَّ لِنَذْرِكَ بَعْدُ أَخْبَرَنَاهُ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ ثنا سُلَيْمَانُ بْنُ أَحْمَدَ بْنِ أَيُّوبَ الطَّبَرَانِيُّ ثنا الْحَضْرَمِيُّ ثنا أَبُو كُرَيْبٍ ثنا مُعَاوِيَةُ بْنُ هِشَامٍ ثنا سُفْيَانُ قَالَ سُلَيْمَانُ لَمْ يَرْوِهِ عَنْ سُفْيَانَ إِلَّا مُعَاوِيَةُ وَأَمَّا الْحَدِيثُ الَّذِي
[Machine] The Prophet ﷺ heard a man asking about a dispute involving someone named Nubayshah. He said, "O advocate for Nubayshah, explain this matter regarding Nubayshah and defend yourself."
سَمِعَ النَّبِيُّ ﷺ رَجُلًا يُلَبِّي عَنْ نُبَيْشَةَ فَقَالَ أَيُّهَا الْمُلَبِّي عَنْ نُبَيْشَةَ هَذِهِ عَنْ نُبَيْشَةَ وَاحْجُجْ عَنْ نَفْسِكَ
[Machine] The Messenger of Allah ﷺ heard a man saying "Labbaik (Here I am) on behalf of Shubrumah." The Prophet ﷺ asked him, "Who is Shubrumah?" The man replied, "He is my brother." The Prophet ﷺ asked, "Have you performed Hajj?" The man said, "No." The Prophet ﷺ said, "Perform Hajj for yourself, then perform Hajj on behalf of Shubrumah." Ali narrated that this is the correct opinion, according to Ibn Abbas and those before him. However, some say that Al-Hasan ibn Amarah used to narrate it, then he corrected himself and narrated it in accordance with the narration of Ibn Abbas, and this narration is abandoned in any case.
أَنَّ رَسُولَ اللهِ ﷺ سَمِعَ رَجُلًا يَقُولُ لَبَّيْكَ عَنْ شُبْرُمَةَ فَقَالَ لَهُ النَّبِيُّ ﷺ مَنْ شُبْرُمَةَ؟ قَالَ أَخٌ لِي قَالَ هَلْ حَجَجْتَ؟ قَالَ لَا قَالَ حُجَّ عَنْ نَفْسِكَ ثُمَّ احْجُجْ عَنْ شُبْرُمَةَ قَالَ عَلِيٌّ هَذَا هُوَ الصَّحِيحُ عَنِ ابْنِ عَبَّاسٍ وَالَّذِي قَبْلَهُ وَهْمٌ يُقَالُ إِنَّ الْحَسَنَ بْنَ عُمَارَةَ كَانَ يَرْوِيهِ ثُمَّ رَجَعَ عَنْهُ إِلَى الصَّوَابِ فَحَدَّثَ بِهِ عَلَى الصَّوَابِ مُوَافِقًا لِرِوَايَةِ غَيْرِهِ عَنِ ابْنِ عَبَّاسٍ وَهُوَ مَتْرُوكُ الْحَدِيثِ عَلَى كُلِّ حَالٍ
12.16 [Machine] The man forbids voluntary pilgrimage if he has not performed the obligatory Hajj in Islam, or he forbids any absolute forbiddance and says: my forbiddance is like the forbiddance of so-and-so, and so-and-so was given a deferment for Hajj, so he becomes a pilgrim and it suffices him from the obligatory Hajj.
١٢۔١٦ بَابُ الرَّجُلِ يُحْرِمُ بِالْحَجِّ تَطَوُّعًا وَلَمْ يَكُنْ حَجَّ حَجَّةَ الْإِسْلَامِ أَوْ يُحْرِمُ إِحْرَامًا مُطْلَقًا وَيَقُولُ: إِحْرَامِي كَإِحْرَامِ فُلَانٍ وَكَانَ فُلَانٌ مُهِلًّا بِالْحَجِّ فَيَكُونُ حَاجًّا وَيُجْزِئُهُ عَنْ حَجَّةِ الْإِسْلَامِ
I, along with some people, heard Jabir b. 'Abdullah saying: We the Companions of Muhammad ﷺ put on Ihram for Hajj only. Ata' further said that Jabir stated: Allah's Apostle ﷺ came on the 4th of Dhu'l-Hijja and he commanded us to put off Ihram. 'Ata'said that he (Allah's Apostle) commanded them to put off Ihram and to go to their wives (for intercourse). 'Ata' said: It was not obligatory for them, but (intercourse) with them had become permissible. We said: When only five days had been left to reach 'Arafa, he (the Holy Prophet) commanded us to have intercourse with our wives. And we reached 'Arafa in a state as if we had just had intercourse (with them). He ('Ata') said: Jabir pointed with his hand and I (perceive) as if I am seeing his hand as it moved. In the (meantime) the Messenger of Allah ﷺ stood amongst us and said: You are well aware that I am the most God-fearing, most truthful and most pious amongst you. And if there were not sacrificial animals with me, I would also have put off Ihram as you have put off. And if I were to know this matter of mine what I have come to know later on, I would not have brought sacrificial animals with me. So they (the Companions) put off Ihram and we also put it off and listened to (the Holy Prophet) and obeyed (his command). Jabir said: 'Ali came with the revenue of the taxes (from Yemen). He (the Holy Prophet) said: For what (purpose) have you entered into the state of Ihram (whether you entered into the state purely for Hajj and, Umra jointly or Hajj and Umra separately)? He said: For the purpose for which the Messenger of Allah ﷺ had entered. (The Prophet had entered as a Qiran, i.e. Ihram covering both Umra and Hajj simultaneously.) Thereupon Messenger of Allah ﷺ said: Offer a sacrifice of animal, and retain Ihram. And 'Ali brought a sacrificial animal for him (for the Holy Prophet). Suraqa b. Malik b. Ju'shum said: Messenger of Allah, is it (this concession putting off Ihram of Hajj or Umra) meant for this year or is it forever? He said: It is forever. (Using translation from Muslim 1216a)
أَهَلَلْنَا أَصْحَابَ رَسُولِ اللهِ ﷺ بِالْحَجِّ خَالِصًا لَيْسَ مَعَهُ غَيْرُهُ خَالِصًا وَحْدَهُ قَالَ عَطَاءٌ قَالَ جَابِرٌ وَقَدِمَ النَّبِيُّ ﷺ مَكَّةَ صَبِيحَةَ رَابِعَةٍ مَضَتْ مِنْ ذِي الْحِجَّةِ قَالَ فَلَمَّا قَدِمْنَا أَمَرَنَا النَّبِيُّ ﷺ فَقَالَ أَحِلُّوا وَأَصِيبُوا النِّسَاءَ قَالَ عَطَاءٌ فَلَمْ يَعْزِمْ عَلَيْهِمْ أَنْ يُصِيبُوا النِّسَاءَ وَلَكِنْ أَحَلَّهُنَّ لَهُمْ قَالَ فَبَلَغَهُ عَنَّا أَنَّا نَقُولُ لَمَّا لَمْ يَكُنْ بَيْنَنَا وَبَيْنَ عَرَفَةَ إِلَّا خَمْسٌ أَمَرَنَا أَنْ نَحِلَّ إِلَى نِسَائِنَا وَنَأْتِيَ عَرَفَةَ تَقْطُرُ مَذَاكِيرُنَا الْمَنِيَّ قَالَ وَيَقُولُ جَابِرٌ بِيَدِهِ كَأَنِّي أَنْظُرُ إِلَى يَدِهِ يُحَرِّكُهَا فَقَامَ النَّبِيُّ ﷺ فَقَالَ هَلْ عَلِمْتُمْ أَنِّي أَتْقَاكُمْ لِلَّهِ وَأَصْدَقُكُمْ وَأَبَرُّكُمْ وَلَوْلَا الْهَدْيُ لَحَلَلْتُ كَمَا تَحِلُّونَ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا أَهْدَيْتُ قَالَ فَأَحْلَلْنَا وَسَمِعْنَا وَأَطَعْنَا قَالَ جَابِرٌ فَقَدِمَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ مِنْ سِعَايَتِهِ فَقَالَ لَهُ النَّبِيُّ ﷺ بِمَ أَهَلَلْتَ يَا عَلِيُّ؟ قَالَ بِمَا أَهَلَّ بِهِ النَّبِيُّ ﷺ قَالَ فَأَهْدِ ثُمَّ امْكُثْ حَرَامًا كَمَا أَنْتَ قَالَ فَأَهْدَى لَهُ عَلِيٌّ هَدْيًا قَالَ فَقَالَ سُرَاقَةُ بْنُ مَالِكٍ مُتْعَتُنَا هَذِهِ يَا رَسُولَ اللهِ لِعَامِنَا هَذَا أَمْ لِلْأَبَدِ؟ فَقَالَ لَا بَلْ لِلْأَبَدِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ ابْنِ جُرَيْجٍ
[Machine] The Prophet of Allah ﷺ sent me to Yemen. I met him in the year in which he performed Hajj and he asked me, "O Abu Musa, what did you say when you entered the state of ihram?" I replied, "I said, 'Here I am, O Allah, at Your service, (here I am)!' like the Ihram of the Prophet ﷺ ." He then asked, "Did you offer a sacrificial animal?" I replied, "No." He said, "Then proceed and perform Tawaf around the Kaaba and between Safa and Marwa, then shave your head." So, I went and performed Tawaf around the Kaaba and between Safa and Marwa, and then I approached some women from the family of Qais, meaning his paternal aunts, and they performed the ritual washing on my head. After that, during the caliphate of Umar (may Allah be pleased with him), I arrived as a pilgrim. While I was narrating to the people near the Kaaba what the Messenger of Allah ﷺ had commanded me, a man arrived and said, "Hold on, O man, with your narration, for you do not know what the Commander of the Faithful has introduced in the rituals." So, I said to the people, "Whoever has heard anything should not act upon it until the Commander of the Faithful arrives, and when he arrives, then follow his instructions." When Umar (may Allah be pleased with him) arrived, I said to him, "O Commander of the Faithful, have you introduced any changes in the rituals?" Umar (may Allah be pleased with him) became angry and said, "Indeed, if we were to adopt the Book of Allah alone, Allah has already commanded the completion (of the Hajj rituals), and if we were to follow the Sunnah of the Messenger of Allah ﷺ , our Prophet, it would not be permissible (to introduce changes) until the animal for sacrifice reaches its designated place."
كَانَ رَسُولُ اللهِ ﷺ بَعَثَنِي إِلَى الْيَمَنِ قَالَ فَوَافَقْتُهُ فِي الْعَامِ الَّذِي حَجَّ فِيهِ فَقَالَ لِي رَسُولُ اللهِ ﷺ يَا أَبَا مُوسَى كَيْفَ قُلْتَ حِينَ أَحْرَمْتَ؟ قَالَ قُلْتُ إِهْلَالٌ كَإِهْلَالِ النَّبِيِّ ﷺ فَقَالَ هَلْ سُقْتَ هَدْيًا؟ قُلْتُ لَا قَالَ فَانْطَلِقْ فَطُفْ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ أَحِلَّ فَانْطَلَقْتُ فَطُفْتُ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ عَمَدْتُ إِلَى نِسْوَةٍ مِنْ آلِ قَيْسٍ يَعْنِي عَمَّاتِهِ فَمَشَطْنَ رَأْسِي بِالْغُسْلِ فَلَمَّا كَانَ بَعْدَ ذَلِكَ فِي إِمَارَةِ عُمَرَ ؓ قَدِمْتُ حَاجًّا فَبَيْنَا أَنَا أُحَدِّثُ النَّاسَ عِنْدَ الْبَيْتِ بِمَا أَمَرَنِي رَسُولُ اللهِ ﷺ إِذْ قَدِمَ رَجُلٌ فَقَالَ دُونَكَ أَيُّهَا الرَّجُلُ بِحَدِيثِكَ فَإِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ فَقُلْتُ يَا أَيُّهَا النَّاسُ مَنْ سَمِعَ شَيْئًا فَلَا يَأْخُذْ بِهِ حَتَّى يَقْدَمَ أَمِيرُ الْمُؤْمِنِينَ فَبِهِ ائْتَمُّوا فَلَمَّا قَدِمَ عُمَرُ ؓ قُلْتُ لَهُ يَا أَمِيرَ الْمُؤْمِنِينَ أَحَدَثَ فِي النُّسُكِ شَيْءٌ فَغَضِبَ عُمَرُ أَمِيرُ الْمُؤْمِنِينَ مِنْ ذَلِكَ ثُمَّ قَالَ أَجَلْ لَئَنْ نَأْخُذَ بِكِتَابِ اللهِ فَقَدْ أَمَرَ اللهُ بِالتَّمَامِ وَأَنْ نَأْخُذَ بِسُنَّةِ رَسُولِ اللهِ ﷺ نَبِيِّنَا فَإِنَّهُ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْيُ مَحِلَّهُ
[Machine] I visited the Prophet ﷺ while he was performing Munakh (a type of ritual purification) in Al-Bat-ha. He asked me, "How did you perform Ihram?" I replied, "I said Labbaik with the Ihram of the Prophet ﷺ ." He said, "You did well. Perform Tawaf around the Kaaba and between Safa and Marwa, then perform halq (shaving the head) or qasr (cutting the hair)." He mentioned this hadith that was narrated by Shu'bah and in another narration by Tawus, that the Prophet ﷺ left Madinah without calling it Hajj or `Umrah (he did not explicitly mention his intention to perform Hajj or `Umrah). He was waiting for the qada' (fulfillment) of Hajj and `Umrah, and it was revealed to him between Safa and Marwa. He instructed those who had not brought a sacrificial animal to make it `Umrah instead. Ash-Shafi`i (may Allah have mercy on him) confirmed the authenticity of this Mursal (unsupported) narration with other Mawquf (stopped) Hadiths that were narrated about the rituals of Ihram.
قَدِمْتُ عَلَى النَّبِيِّ ﷺ وَهُوَ مُنِيخٌ بِالْبَطْحَاءِ فَقَالَ لِي كَيْفَ أَهْلَلْتَ ؟ قَالَ قُلْتُ لَبَّيْكَ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ أَحْسَنْتَ طُفْ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ أَحِلَّ فَذَكَرَ الْحَدِيثَ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ شُعْبَةَ وَفِي رِوَايَةِ طَاوُسٍ أَنَّ النَّبِيَّ ﷺ خَرَجَ مِنَ الْمَدِينَةِ لَا يُسَمِّي حَجًّا وَلَا عُمْرَةً يَنْتَظِرُ الْقَضَاءَ فَنَزَلَ عَلَيْهِ الْقَضَاءُ وَهُوَ بَيْنَ الصَّفَا وَالْمَرْوَةِ فَأَمَرَ مَنْ كَانَ مِنْهُمْ أَهَلَّ وَلَمْ يَكُنْ مَعَهُ هَدْيٌ أَنْ يَجْعَلَهَا عُمْرَةً وَأَكَّدَ الشَّافِعِيُّ رَحِمَهُ اللهُ هَذِهِ الرِّوَايَةَ الْمُرْسَلَةَ بِأَحَادِيثَ مَوْصُولَةٍ رُوِيَتْ فِي إِحْرَامِهِمْ تَشْهَدُ لِرِوَايَةِ طَاوُسٍ بِالصِّحَّةِ
[Machine] "Whoever has the sacrificial animal with him should proceed to perform the rituals of Hajj, and whoever does not have the sacrificial animal should enter into the state of Ihram for Hajj. As for me, I did not have a sacrificial animal, so I entered into the state of Ihram for Hajj. And Zubair had a sacrificial animal with him, so he did not enter into the state of Ihram for Hajj." She said, "So I changed into my Ihram garments and then went out. I sat with Zubair, and he said, 'Stand up and move away from me.' I said, 'Are you afraid that I will step on you?'"
ﷺ مَنْ كَانَ مَعَهُ الْهَدْيُ فَلْيَقُمْ عَلَى إِحْرَامِهِ وَمَنْ لَمْ يَكُنْ مَعَهُ هَدْيٌ فَلْيَحْلِلْ فَلَمْ يَكُنْ مَعِي هَدْيٌ فَحَلَلْتُ وَكَانَ مَعَ الزُّبَيْرِ هَدْيٌ فَلَمْ يَحْلِلْ قَالَتْ فَلَبِسْتُ ثِيَابِي ثُمَّ خَرَجْتُ فَجَلَسْتُ إِلَى الزُّبَيْرِ فَقَالَ قُومِي عَنِّي فَقُلْتُ أَتَخْشَى أَنْ أَثِبَ عَلَيْكَ
[Machine] He said about a man who had not performed Hajj: if he intends a voluntary pilgrimage or performs Hajj on behalf of someone else or performs Hajj in fulfillment of a vow, then this is the evidence of Islam. After that, he can perform Hajj on behalf of the man if he wishes, or on behalf of his vow.
أَنَّهُ قَالَ فِي رَجُلٍ لَمْ يَحُجَّ فَحَجَّ يَنْوِي النَّافِلَةَ أَوْ حَجَّ عَنْ رَجُلٍ أَوْ حَجَّ عَنْ نَذْرِهِ قَالَ هَذِهِ حَجَّةُ الْإِسْلَامِ ثُمَّ يَحُجُّ عَنِ الرَّجُلِ بَعْدُ إِنْ شَاءَ وَعَنْ نَذْرِهِ
12.17 [Machine] The Man Performs the Pilgrimage and He Has the Pillar of Islam
١٢۔١٧ بَابُ الرَّجُلِ يَنْذُرُ الْحَجَّ وَعَلَيْهِ حَجَّةُ الْإِسْلَامِ
[Machine] To fulfill his vow means the one who is obligated to perform Hajj and makes a vow to perform Hajj.
أَنْ يَقْضِيَ نَذْرَهُ يَعْنِي مَنْ عَلَيْهِ الْحَجُّ وَنَذَرَ حَجًّا
أَنْ يُيَسِّرَ لَهَا
لِيَبْدَأْ بِالْفَرِيضَةِ
12.18 [Machine] What is recommended for expediting the performance of Hajj when one is able to do so
١٢۔١٨ بَابُ مَا يُسْتَحَبُّ مِنْ تَعْجِيلِ الْحَجِّ إِذَا قَدِرَ عَلَيْهِ
The Prophet ﷺ said: He who intends to perform hajj should hasten to do so. (Using translation from Abū Dāʾūd 1732)
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَرَادَ الْحَجَّ فَلْيَتَعَجَّلْ
[Machine] "The Messenger of Allah ﷺ said, 'Hasten your departure to Makkah, for none of you knows what illness or need may befall him.' This narration was reported by Abu Isra'il Al-Mula'iyy from Fudayl."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ عَجِّلُوا الْخُرُوجَ إِلَى مَكَّةَ فَإِنَّ أَحَدَكُمْ لَا يَدْرِي مَا يَعْرِضُ لَهُ مِنْ مَرَضٍ أَوْ حَاجَةٍ وَرَوَاهُ أَبُو إِسْرَائِيلَ الْمُلَائِيُّ عَنْ فُضَيْلٍ
[Machine] "The Prophet ﷺ said: Whoever wishes to perform Hajj, let him hasten to do so, for indeed a person may fall ill, and misguidance may occur, and circumstances may arise. And Al-Qadi Abu Umar Muhammad ibn Al-Hussein informed us that Abu Abdullah Ahmad ibn Ja'far ibn Al-Mughirah narrated to us from Abu Al-Haytham Sayyar ibn Al-Hassan Al-Tastari, from Abu Al-Walid Hisham ibn Abdul-Malik, who mentioned it in a similar manner except that he said it was narrated by Ibn Abbas, or one of them. And Abbas ibn Al-Fadl Al-Asfati also said the same, narrating it from Abu Al-Walid with doubt."
النَّبِيَّ ﷺ قَالَ مَنْ أَرَادَ الْحَجَّ فَلْيَتَعَجَّلْ فَإِنَّهُ قَدْ يَمْرَضُ الْمَرِيضُ وَتَضِلُّ الضَّالَّةُ وَتَعْرِضُ الْحَاجَةُ 8697 وَأَخْبَرَنَا الْقَاضِي أَبُو عُمَرَ مُحَمَّدُ بْنُ الْحُسَيْنِ أنبأ أَبُو عَبْدِ اللهِ أَحْمَدُ بْنُ جَعْفَرِ بْنِ الْمُغِيرَةِ بِتُسْتَرَ ثنا أَبُو الْهَيْثَمِ سَيَّارُ بْنُ الْحَسَنِ التُّسْتَرِيُّ ثنا أَبُو الْوَلِيدِ هِشَامُ بْنُ عَبْدِ الْمَلِكِ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ عَنِ ابْنِ عَبَّاسٍ عَنِ الْفَضْلِ أَوْ عَنْ أَحَدِهِمَا وَكَذَلِكَ قَالَ عَبَّاسُ بْنُ الْفَضْلِ الْأَسْفَاطِيُّ عَنْ أَبِي الْوَلِيدِ بِالشَّكِّ
[Machine] I heard Ali saying: "Perform Hajj before you are unable to do so." It is as if I am looking at an Abyssinian with thick legs, demolishing a wall brick by brick with a pickaxe in his hand. I said to him, "What do you say according to your opinion or did you hear it from the Messenger of Allah ﷺ ?" He said, "No, but I heard it from your Prophet ﷺ ."
سَمِعْتُ عَلِيًّا ؓ يَقُولُ حُجُّوا قَبْلَ أَنْ لَا تَحُجُّوا فَكَأَنِّي أَنْظُرُ إِلَى حَبَشِيٍّ أَصْمَعَ أَفْدَعَ بِيَدِهِ مِعْوَلٌ يَهْدِمُهَا حَجَرًا حَجَرًا فَقُلْتُ لَهُ شَيْءٌ بِرَأْيِكَ تَقُولُ أَوْ سَمِعْتَهُ مِنْ رَسُولِ اللهِ ﷺ قَالَ لَا وَالَّذِي فَلَقَ الْحَبَّةَ وَبَرَأَ النَّسَمَةَ وَلَكِنْ سَمِعْتُهُ مِنْ نَبِيِّكُمْ ﷺ
[Machine] The Messenger of Allah ﷺ said, "The Kaaba will be destroyed by a man from Abyssinia with two braided locks of hair." And Abu Abdullah reported to us, Abu Bakr reported to us, Musa Ibn Ishaq al-Ansari reported to us, Abdullah Ibn Abi Shaybah reported to us, Sufyan bin Wahb reported a similar narration.
قَالَ رَسُولُ اللهِ ﷺ يُخَرِّبُ الْكَعْبَةَ ذُو السُّوَيْقَتَيْنِ مِنَ الْحَبَشَةِ 8700 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا أَبُو بَكْرٍ ثنا مُوسَى بْنُ إِسْحَاقَ الْأَنْصَارِيُّ ثنا عَبْدُ اللهِ بْنُ أَبِي شَيْبَةَ ثنا سُفْيَانُ بِنَحْوِهِ
[Machine] He informed him about the Prophet ﷺ saying, "It is as if I can see a black rugged crow tearing it down stone by stone," referring to the Kaaba.
أَخْبَرَهُ عَنِ النَّبِيِّ ﷺ قَالَ كَأَنِّي أَنْظُرُ إِلَى أَسْوَدَ أَفْحَجَ يَقْلَعُهَا حَجَرًا حَجَرًا يَعْنِي الْكَعْبَةَ
[Machine] The Messenger of Allah, ﷺ , said: "Perform Hajj before you cannot perform Hajj." It was asked: "What is the matter with Hajj?" He said: "The Arabs will sit on the tails of their valleys and no one will be able to reach Hajj."
قَالَ رَسُولُ اللهِ ﷺ حُجُّوا قَبْلَ أَنْ لَا تَحُجُّوا قِيلَ فَمَا شَأْنُ الْحَجِّ؟ قَالَ يَقْعُدُ أَعْرَابُهَا عَلَى أَذْنَابِ أَوْدِيَتِهَا فَلَا يَصِلُ إِلَى الْحَجِّ أَحَدٌ
12.19 [Machine] Delaying the Hajj
١٢۔١٩ بَابُ تَأْخِيرِ الْحَجِّ
[Machine] The obligation of Hajj was revealed to the Prophet ﷺ after his migration, and the Messenger of Allah ﷺ opened Mecca in the month of Ramadan and left it in Shawwal. At that time, he appointed 'Attab ibn Asid as its governor. He established the Hajj for the Muslims by the order of the Messenger of Allah ﷺ. The Messenger of Allah ﷺ was in Medina and was capable of performing Hajj along with his wives and most of his companions.
Later, the Messenger of Allah ﷺ left for Tabuk and sent Abu Bakr to lead the Hajj for the people in the ninth year. The Messenger of Allah ﷺ was still in Medina and was capable of performing Hajj, but he did not perform it, nor did his wives or any of his companions until he performed it in the tenth year.
Based on this, we deduced that performing Hajj is obligatory once in a lifetime, with the condition of reaching puberty, and it should be done before death. The Sheikh (scholar) mentioned that this is also mentioned in the reports and historical accounts.
As for the mention of the revelation of the obligation of Hajj after migration, as the Shafi'i scholars have mentioned, our companions have derived it from the Hadith of Ka'b ibn 'Ujrah, indicating that it was revealed during the time of Hudaybiyah.
نَزَلَتْ فَرِيضَةُ الْحَجِّ عَلَى النَّبِيِّ ﷺ بَعْدَ الْهِجْرَةِ وَافْتَتَحَ رَسُولُ اللهِ ﷺ مَكَّةَ فِي شَهْرِ رَمَضَانَ وَانْصَرَفَ عَنْهَا فِي شَوَّالٍ وَاسْتُخْلِفَ عَلَيْهَا عَتَّابُ بْنُ أَسِيدٍ فَأَقَامَ الْحَجَّ لِلْمُسْلِمِينَ بِأَمْرِ رَسُولِ اللهِ ﷺ وَرَسُولُ اللهِ ﷺ بِالْمَدِينَةِ قَادِرٌ عَلَى أَنْ يَحُجَّ وَأَزْوَاجُهُ وَعَامَّةُ أَصْحَابِهِ ثُمَّ انْصَرَفَ رَسُولُ اللهِ ﷺ عَنْ تَبُوكَ فَبَعَثَ أَبَا بَكْرٍ فَأَقَامَ الْحَجَّ لِلنَّاسِ سَنَةَ تِسْعٍ وَرَسُولُ اللهِ ﷺ بِالْمَدِينَةِ قَادِرٌ عَلَى أَنْ يَحُجَّ لَمْ يَحُجَّ هُوَ وَلَا أَزْوَاجُهُ وَلَا أَحَدٌ مِنْ أَصْحَابِهِ حَتَّى حَجَّ سَنَةَ عَشْرٍ فَاسْتَدْلَلْنَا عَلَى أَنَّ الْحَجَّ فَرْضُهُ مَرَّةٌ فِي الْعُمُرِ أَوَّلُهُ الْبُلُوغُ وَآخِرُهُ أَنْ يَأْتِيَ بِهِ قَبْلَ مَوْتِهِ قَالَ الشَّيْخُ وَهَذَا الَّذِي ذَكَرَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ مَوْجُودٌ فِي الْأَخْبَارِ وَالتَّوَارِيخِ أَمَّا مَا ذَكَرَهُ مِنْ نُزُولِ فَرِيضَةِ الْحَجِّ بَعْدَ الْهِجْرَةِ فَكَمَا قَالَ وَاسْتَدَلَّ أَصْحَابُنَا بِحَدِيثِ كَعْبِ بْنِ عُجْرَةَ عَلَى أَنَّهَا نَزَلَتْ زَمَنَ الْحُدَيْبِيَةِ
[Machine] The Messenger of Allah ﷺ stood beside me in Hudaybiyah while I had lice on my head. He asked, "Do your lice bother you?" I replied, "Yes, O Messenger of Allah." He said, "Shave your head." He also mentioned the verse starting with "So whoever among you is ill or has an ailment in his scalp" until the end of the verse. Then the Messenger of Allah ﷺ said, "Fast for three days, or give charity or offer sacrifice as compensation."
قَالَ وَقَفَ عَلَيَّ رَسُولُ اللهِ ﷺ بِالْحُدَيْبِيَةِ وَرَأْسِي يَتَهَافَتُ قَمْلًا فَقَالَ أَتُؤْذِيكَ هَوَامُّكَ؟ قُلْتُ نَعَمْ يَا رَسُولَ اللهِ قَالَ فَاحْلِقْ رَأْسَكَ أَوْ قَالَ فَاحْلِقْ قَالَ فَفِيَّ نَزَلَتْ هَذِهِ الْآيَةُ {فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ بِهِ أَذًى مِّنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ} [البقرة 196] إِلَى آخِرِهَا فَقَالَ رَسُولُ اللهِ ﷺ صُمْ ثَلَاثَةَ أَيَّامٍ أَوْ تَصَدَّقْ بِفَرَقٍ بَيْنَ سِتَّةٍ أَوِ انْسُكْ بِمَا تَيَسَّرَ
[Machine] And from some of the companions of the Messenger of Allah ﷺ , regarding his statement, "And complete Hajj and Umrah for Allah" [Al-Baqarah 196], he says: Establish Hajj and Umrah for Allah.
وَعَنْ نَاسٍ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ وَأَمَّا قَوْلُهُ {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} [البقرة 196] فَيَقُولُ أَقِيمُوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ
[Machine] The Sheikh and the time of Hudaybiyah was the sixth year of the Hijrah in the month of Dhul-Qa'dah.
الشَّيْخُ وَزَمَنُ الْحُدَيْبِيَةِ كَانَ سَنَةَ سِتٍّ مِنَ الْهِجْرَةِ فِي ذِي الْقَعْدَةِ
[Machine] The Battle of Hudaibiya took place in the sixth year after the Prophet's migration to Medina, in the month of Dhu al-Qa'da. The Treaty of Hudaibiya took place in the month of Dhu al-Qa'da in the seventh year. The conquest of Mecca took place in the month of Ramadan in the eighth year. Then, the Prophet ﷺ went out from there to Hunayn and Taif. When he returned in the month of Shawwal, he performed Umrah from Ji'ranah. Then, Attab bin Asid performed Hajj and the Messenger of Allah ﷺ used his Hajj as a model for the people. Abu Bakr performed Hajj in the ninth year, following the example of the Prophet ﷺ. Then, the Prophet ﷺ performed Hajj in the tenth year after his migration to Medina, which is known as the Farewell Pilgrimage. This indicates that the order of conquest, the use of Attab bin Asid's Hajj, followed by Abu Bakr's in the ninth year, and then the Prophet's in the tenth year, is as mentioned by Imam Shafi'i, may Allah have mercy on him. This is well-known among the people of military expeditions and is mentioned in the connected narrations separately.
كَانَتِ الْحُدَيْبِيَةُ سَنَةَ سِتٍّ بَعْدَ مَقْدِمِ النَّبِيِّ ﷺ الْمَدِينَةَ فِي ذِي الْقَعْدَةِ وَكَانَتِ الْقَضِيَّةُ فِي ذِي الْقَعْدَةِ سَنَةَ سَبْعٍ وَكَانَ الْفَتْحُ فِي رَمَضَانَ سَنَةَ ثَمَانٍ ثُمَّ خَرَجَ النَّبِيُّ ﷺ مِنْ فَوْرِهِ إِلَى حُنَيْنٍ وَالطَّائِفِ فَلَمَّا رَجَعَ فِي شَوَّالٍ اعْتَمَرَ مِنَ الْجِعْرَانَةِ ثُمَّ حَجَّ عَتَّابُ بْنُ أَسِيدٍ فَأَقَامَ لِلنَّاسِ الْحَجَّ اسْتَعْمَلَهُ رَسُولُ اللهِ ﷺ عَلَى الْحَجِّ ثُمَّ حَجَّ أَبُو بَكْرٍ سَنَةَ تِسْعٍ اسْتَعْمَلَهُ النَّبِيُّ ﷺ ثُمَّ حَجَّ النَّبِيُّ ﷺ سَنَةَ عَشْرٍ مِنْ مَقْدِمِهِ الْمَدِينَةَ وَهِيَ حَجَّةُ الْوَدَاعِ وَفِي هَذَا دَلَالَةٌ عَلَى أَنَّ أَمْرَ الْفَتْحِ وَاسْتِعْمَالَ عَتَّابِ بْنِ أَسِيدٍ ثُمَّ اسْتِعْمَالُ أَبِي بَكْرٍ فِي سَنَةِ تِسْعٍ ثُمَّ حَجُّهُ سَنَةَ عَشْرٍ مَا قَالَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ وَهُوَ مَشْهُوَرٌ فِيمَا بَيْنَ أَهْلِ الْمَغَازِي مَذْكُورٌ فِي الْأَحَادِيثِ الْمَوْصُولَةِ مُفَرَّقًا
[Machine] I asked Anas ibn Malik how many times did the Prophet ﷺ perform Hajj? He said, he performed Hajj once and he performed Umrah four times. The first Umrah was the one that the polytheists prevented him from entering the Kaaba, and the second Umrah was when they made peace with him, so he returned later that year. He also performed Umrah from Ji'ranah when he distributed the spoils of the Battle of Hunayn in the month of Dhul-Qa'dah, and he performed Hajj with Umrah together.
قُلْتُ لِأَنَسِ بْنِ مَالِكٍ كَمْ مِنْ حَجَّةٍ حَجَّهَا النَّبِيُّ ﷺ؟ قَالَ حَجَّةٌ وَاحِدَةٌ وَاعْتَمَرَ أَرْبَعَ عُمَرٍ عُمْرَتُهُ الَّتِي صَدَّهُ الْمُشْرِكُونَ عَنِ الْبَيْتِ وَالْعُمْرَةُ الثَّانِيَةُ حِينَ صَالَحُوهُ فَرَجَعَ مِنَ الْعَامِ الْمُقْبِلِ وَعُمْرَةٌ مِنَ الْجِعْرَانَةِ حِينَ قَسَمَ غَنِيمَةَ حُنَيْنٍ فِي ذِي الْقَعْدَةِ وَحَجَّةٌ مَعَ عُمْرَتِهِ
[Machine] The Messenger of Allah ﷺ participated in nineteen battles and performed Hajj once after emigrating, and he did not perform another Hajj after that except for the Farewell Hajj. Abu Ishaq said: "He (the Prophet) also performed another Hajj in Makkah." Al-Bukhari mentioned this in his Sahih (authentic book) through the narration of Amru bin Khalid, and Muslim also narrated it from another perspective through the narration of Zuhayr.
أَنَّ رَسُولَ اللهِ ﷺ غَزَا تِسْعَ عَشْرَةَ غَزْوَةً وَأَنَّهُ حَجَّ بَعْدَمَا هَاجَرَ حَجَّةً وَاحِدَةً لَمْ يَحُجَّ بَعْدَهَا حَجَّةً إِلَّا حَجَّةَ الْوَدَاعِ قَالَ أَبُو إِسْحَاقَ وَبِمَكَّةَ أُخْرَى وَأَخْرَجَهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ عَمْرِو بْنِ خَالِدٍ وَأَخْرَجَهُ مُسْلِمٌ مِنْ وَجْهٍ آخَرَ عَنْ زُهَيْرٍ
[Machine] The Messenger of Allah ﷺ performed three Hajj pilgrimages: two while he was in Makkah before the migration, and one was the Farewell Hajj. The scholar said, "The Hajj before the migration is performed before the obligatory Hajj is revealed, so it cannot be considered as a replacement for the obligatory Hajj that is revealed after it. And Allah knows best."
حَجَّ رَسُولُ اللهِ ﷺ ثَلَاثَ حِجَجٍ حَجَّتَيْنِ وَهُوَ بِمَكَّةَ قَبْلَ الْهِجْرَةِ وَحَجَّةَ الْوَدَاعِ قَالَ الشَّيْخُ وَحَجَّةً قَبْلَ الْهِجْرَةِ يَكُونُ قَبْلَ نُزُولِ فَرْضِ الْحَجِّ فَلَا يُعْتَدُّ بِهِ عَنِ الْفَرْضِ الْمُنْزَلِ بَعْدَهُ وَاللهُ أَعْلَمُ

١٢۔٢١ بَابُ بَيَانِ أَشْهُرِ الْحَجِّ
[Machine] Shawwal, Dhul-Qa'dah, and ten days from Dhul-Hijjah are mentioned in this regarding a narration from Ibn Umar and Urwah ibn Zubayr, from Umar, as being Mursal.
شَوَّالٌ وَذُو الْقَعْدَةِ وَعَشْرٌ مِنْ ذِي الْحِجَّةِ وَرُوِيَ فِي ذَلِكَ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ وَعَنْ عُرْوَةَ بْنِ الزُّبَيْرِ عَنْ عُمَرَ ؓ مُرْسَلًا
[Machine] In his saying: "Hajj is [during] well-known months" [Surah Al-Baqarah 197], he (Prophet Muhammad) said: "Shawwal, Dhul-Qa'dah, and ten days of Dhul-Hijjah."
فِي قَوْلِهِ {الْحَجُّ أَشْهُرٌ مَّعْلُومَاتٌ} [البقرة 197] قَالَ شَوَّالٌ وَذُوالْقَعْدَةِ وَعَشْرٌ مِنْ ذِي الْحِجَّةِ
[Machine] "Shawwal, Dhul-Qadah, and the first ten days of Dhul-Hijjah have been confirmed by Ikrimah from Ibn Abbas, if Allah wills."
شَوَّالٌ وَذُو الْقَعْدَةِ وَعَشْرٌ مِنْ ذِي الْحِجَّةِ وَقَدْ ثَبَتَ ذَلِكَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ وَذَلِكَ يَرِدُ إِنْ شَاءَ اللهُ
[Machine] The months of Hajj are Shawwal, Dhul-Qa'dah, and ten days of Dhul-Hijjah.
