I, along with some people, heard Jabir b. 'Abdullah saying: We the Companions of Muhammad ﷺ put on Ihram for Hajj only. Ata' further said that Jabir stated: Allah's Apostle ﷺ came on the 4th of Dhu'l-Hijja and he commanded us to put off Ihram. 'Ata'said that he (Allah's Apostle) commanded them to put off Ihram and to go to their wives (for intercourse). 'Ata' said: It was not obligatory for them, but (intercourse) with them had become permissible. We said: When only five days had been left to reach 'Arafa, he (the Holy Prophet) commanded us to have intercourse with our wives. And we reached 'Arafa in a state as if we had just had intercourse (with them). He ('Ata') said: Jabir pointed with his hand and I (perceive) as if I am seeing his hand as it moved. In the (meantime) the Messenger of Allah ﷺ stood amongst us and said: You are well aware that I am the most God-fearing, most truthful and most pious amongst you. And if there were not sacrificial animals with me, I would also have put off Ihram as you have put off. And if I were to know this matter of mine what I have come to know later on, I would not have brought sacrificial animals with me. So they (the Companions) put off Ihram and we also put it off and listened to (the Holy Prophet) and obeyed (his command). Jabir said: 'Ali came with the revenue of the taxes (from Yemen). He (the Holy Prophet) said: For what (purpose) have you entered into the state of Ihram (whether you entered into the state purely for Hajj and, Umra jointly or Hajj and Umra separately)? He said: For the purpose for which the Messenger of Allah ﷺ had entered. (The Prophet had entered as a Qiran, i.e. Ihram covering both Umra and Hajj simultaneously.) Thereupon Messenger of Allah ﷺ said: Offer a sacrifice of animal, and retain Ihram. And 'Ali brought a sacrificial animal for him (for the Holy Prophet). Suraqa b. Malik b. Ju'shum said: Messenger of Allah, is it (this concession putting off Ihram of Hajj or Umra) meant for this year or is it forever? He said: It is forever. (Using translation from Muslim 1216a)

The Prophet (along with his companions) reached Mecca in the morning of the fourth of Dhul-Hijja assuming Ihram for Hajj only. So when we arrived at Mecca, the Prophet ﷺ ordered us to change our intentions of the Ihram for ʿUmra and that we could finish our Ihram after performing the ʿUmra and could go to our wives (for sexual intercourse). The people began talking about that. Jabir said surprisingly, "Shall we go to Mina while semen is dribbling from our male organs?" Jabir moved his hand while saying so. When this news reached the Prophet ﷺ he delivered a sermon and said, "I have been informed that some peoples were saying so and so; By Allah I fear Allah more than you do, and am more obedient to Him than you. If I had known what I know now, I would not have brought the Hadi (sacrifice) with me and had the Hadi not been with me, I would have finished the Ihram." At that Suraqa bin Malik stood up and asked "O Messenger of Allah ﷺ! Is this permission for us only or is it forever?" The Prophet ﷺ replied, "It is forever." In the meantime ʿAli bin Abu Talib came from Yemen and was saying Labbaik for what the Prophet ﷺ has intended. (According to another man, ʿAli was saying Labbaik for Hajj similar to Messenger of Allah ﷺ's). The Prophet ﷺ told him to keep on the Ihram and let him share the Hadi with him.

I heard Jabir bin ʿAbdullah in a gathering saying, "We, the companions of Messenger of Allah ﷺ assumed the state of Ihram to perform only Hajj without ʿUmra." Jabir added, "The Prophet ﷺ arrived (at Mecca) on the fourth of Dhul-Hijja. And when we arrived (in Mecca) the Prophet ﷺ ordered us to finish the state of Ihram, saying, "Finish your lhram and go to your wives (for sexual relation)." Jabir added, "The Prophet did not oblige us (to go to our wives) but he only made that legal for us. Then he heard that we were saying, "When there remains only five days between us and the Day of ʿArafat he orders us to finish our Ihram by sleeping with our wives in which case we will proceed to ʿArafat with our male organs dribbling with semen?' (Jabir pointed out with his hand illustrating what he was saying). Messenger of Allah ﷺ stood up and said, 'You (People) know that I am the most Allah-fearing, the most truthful and the best doer of good deeds (pious) from among you. If I had not brought the Hadi with me, I would have finished my Ihram as you will do, so finish your Ihram. If I had formerly known what I came to know lately, I would not have brought the Hadi with me.' So we finished our Ihram and listened to the Prophet ﷺ and obeyed him." (See Hadith No. 713, Vol. 2)

"We, the Companions of the Prophet, entered Ihram for Hajj only, and nothing else. We came to Makkah on the morning of the fourth of Dhul-Hajjah, and the Prophet commanded us: "Exit Ihram and make it Umrah. He heard that we were saying: 'when there are only five days between us and 'Arafat he commands us to exit Ihram and we will go out to Mina with our male members dripping with semen (because of recent intimacy with our wives)?' the Prophet stood up and addressed us, saying: 'I have heard what you said. I am the most righteous and the most pious of you, and were it not for the Hadi I would have exited Ihram. If I had known what I know now, I would not have from Yemen and he said: 'for what did you enter Ihram?' He said: 'For that for which the Messenger of Allah entered Ihram.' Suraq bin Malik bin Jushum said: 'O Messenger of Allah, do you think that this Umrah of ours is for this year only or for all time?' He said: 'It is for all time."

[Machine] We went out with the Messenger of Allah ﷺ as pilgrims, with no intention except for Hajj. When we reached Sarif, Aisha menstruated. The Messenger of Allah ﷺ entered upon her while she was crying and asked, "Why are you crying?" She said, "O Messenger of Allah, I have been harmed!" He said, "Indeed, you are one of the daughters of Adam, and what afflicts them may afflict you." He added, "We have already arrived at the Kaaba in four days or nights of Dhul-Hijjah, then we performed Tawaf around the Kaaba and Sa'i between Safa and Marwa. Then the Messenger of Allah ﷺ commanded us and we performed all the rituals of Hajj except for the prohibited actions. So we discussed among ourselves and said, "We went out as pilgrims with no intention except for Hajj, and we don't intend anything else. Until there was no more than four days or nights between us and Arafat, so we went out to Arafat. Our women were experiencing discharge like that of men. The Messenger of Allah ﷺ was informed of this and he stood up to deliver a sermon, saying, "Indeed, the Umrah is included in the Hajj. If I had known beforehand what I came to know later, I would not have brought the Hadi (sacrificial animal) with me, and if there was no Hadi, I would have assumed Ihram for Umrah." Therefore, whoever does not have a Hadi with him should perform Tahlil (which refers to assuming Ihram for Hajj only by starting the Talbiyah at Meeqat and then remaining in Ihram till the end of Hajj). Suraqa bin Malik bin Ju'shum stood up and asked, "O Messenger of Allah, inform us about those who seem to have been born today, are they considered as if they were born today or forever?" He replied, "No, they are considered as if they were born forever." He then said, "We went to Arafat and then left it. Aisha said to the Messenger of Allah, "I find that I have assumed Ihram without my intention." He said, "You have what they have." She then said, "O Messenger of Allah, I feel something in myself." So he stopped at the highest point of Makkah and commanded her brother Abdullah bin Abu Bakr to cover her until she reached the place of Tan'im. Then she performed the rituals of Umrah and returned to the Prophet ﷺ .

خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ حُجَّاجًا لَا نُرِيدُ إِلَّا الْحَجَّ وَلَا نَنْوِي غَيْرَهُ حَتَّى إِذَا بَلَغْنَا سَرِفَ حَاضَتْ عَائِشَةُ فَدَخَلَ عَلَيْهَا رَسُولُ اللهِ ﷺ وَهِيَ تَبْكِي فَقَالَ مَا لَكِ تَبْكِينَ؟ قَالَتْ يَا رَسُولَ اللهِ أَصَابَنِي الْأَذَى قَالَ إِنَّمَا أَنْتِ مِنْ بَنَاتِ آدَمَ يُصِيبُكِ مَا يُصِيبُهُنَّ قَالَ وَقَدِمْنَا الْكَعْبَةَ فِي أَرْبَعٍ مَضَيْنَ مِنْ ذِي الْحِجَّةِ أَيَّامًا أَوْ لَيَالِيَ فَطُفْنَا بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ إِنَّ رَسُولَ اللهِ ﷺ أَمَرَنَا فَأَحْلَلْنَا الْإِحْلَالَ كُلَّهُ قَالَ فَتَذَاكَرْنَا بَيْنَنَا فَقُلْنَا خَرَجْنَا حُجَّاجًا لَا نُرِيدُ إِلَّا الْحَجَّ وَلَا نَنْوِي غَيْرَهُ حَتَّى إِذَا لَمْ يَكُنْ بَيْنَنَا وَبَيْنَ عَرَفَاتٍ إِلَّا أَرْبَعَةُ أَيَّامٍ أَوْ لَيَالٍ خَرَجْنَا إِلَى عَرَفَاتٍ وَمَذَاكِيرُنَا تَقْطُرُ الْمَنِيَّ مِنَ النِّسَاءِ قَالَ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَامَ خَطِيبًا فَقَالَ أَلَا إِنَّ الْعُمْرَةَ قَدْ دَخَلَتْ فِي الْحَجِّ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا سُقْتُ الْهَدْيَ وَلَوْلَاالْهَدْيُ لَأَحْلَلْتُ فَمَنْ لَمْ يَكُنْ مَعَهُ هَدْيٌ فَلْيَحِلَّ فَقَامَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ فَقَالَ يَا رَسُولَ اللهِ خَبِّرْنَا خَبَرَ قَوْمٍ كَأَنَّمَا وُلِدُوا الْيَوْمَ أَلِعَامِنَا هَذَا أَمْ لِلْأَبَدِ؟ قَالَ لَا بَلْ لِلْأَبَدِ قَالَ فَأَتَيْنَا عَرَفَاتٍ وَانْصَرَفْنَا مِنْهَا ثُمَّ إِنَّ عَائِشَةَ قَالَتْ يَا رَسُولَ اللهِ إِنِّي أَجِدُ فِي نَفْسِي قَدِ اعْتَمَرُوا قَالَ إِنَّ لَكِ مِثْلَ مَا لَهُمْ قَالَتْ يَا رَسُولَ اللهِ إِنِّي أَجِدُ فِي نَفْسِي فَوَقَفَ بِأَعْلَى وَادِي مَكَّةَ وَأَمَرَ أَخَاهَا عَبْدَ الرَّحْمَنِ بْنَ أَبِي بَكْرٍ فَأَرْدَفَهَا حَتَّى بَلَغَتِ التَّنْعِيمَ ثُمَّ أَقْبَلَتْ

I am the most righteous and the most pious of you, and were it not for the Hadi I would have exited Ihram. The Prophet (along with his companions) reached Mecca in the morning of the fourth of Dhul-Hijja assuming Ihram for Hajj only. So when we arrived at Mecca, the Prophet ﷺ ordered us to change our intentions of the Ihram for ʿUmra and that we could finish our Ihram after performing the ʿUmra and could go to our wives (for sexual intercourse). The people began talking about that. Jabir said surprisingly, "Shall we go to Mina while semen is dribbling from our male organs?" Jabir moved his hand while saying so. When this news reached the Prophet ﷺ he delivered a sermon and said, "I have been informed that some peoples were saying so and so; By Allah I fear Allah more than you do, and am more obedient to Him than you. If I had known what I know now, I would not have brought the Hadi (sacrifice) with me and had the Hadi not been with me, I would have finished the Ihram." At that Suraqa bin Malik stood up and asked "O Messenger of Allah ﷺ! Is this permission for us only or is it forever?" The Prophet ﷺ replied, "It is forever." In the meantime ʿAli bin Abu Talib came from Yemen and was saying Labbaik for what the Prophet ﷺ has intended. (According to another man, ʿAli was saying Labbaik for Hajj similar to Messenger of Allah ﷺ's). The Prophet ﷺ told him to keep on the Ihram and let him share the Hadi with him. [Machine] The Messenger of Allah ﷺ and us, his companions, performed Hajj together until we reached Mecca on the morning of the fourth day of Dhul-Hijjah. We made tawaf (circumambulation) around the Kaaba, and performed sa'i (walking) between Safa and Marwa. Then the Messenger of Allah ﷺ commanded those who did not bring a sacrificial animal to perform hajj to do so. He did not give any specific instructions concerning women. Jabir (may Allah be pleased with him) said, "We waited until there were only five nights left between us and Arafah. Then the Messenger of Allah ﷺ commanded us to enter ihram (sacral state) and go to Arafah, while the sweat was dripping from our foreheads, and he himself had already performed the sa'i." Jabir (may Allah be pleased with him) continued, "So, we realized the command of the Messenger of Allah ﷺ and he stood up to address the people. He praised and thanked Allah and then mentioned what he had heard from the people. He said, 'You know that I am the most righteous among you, the most truthful, and the most sincere to Allah. If I had not sacrificed the sacrificial animal, I would have taken off ihram even if there was a matter that I wanted to proceed with and not completed it.' Jabir bin Abdullah said, 'We heard and obeyed, so we took off ihram.' Al-Layth said, 'He meant to enjoy the rights of marriage.' And Al-Layth did not mention the story of Suraqah bin Malik."

أَهْلَلْنَا أَصْحَابَ النَّبِيِّ ﷺ بِالْحَجِّ خَالِصًا لَيْسَ مَعَهُ غَيْرُهُ بِالْحَجِّ خَالِصًا وَحْدَهُ فَقَدِمْنَا مَكَّةَ صُبْحَ رَابِعَةٍ مَضَتْ مِنْ ذِي الْحِجَّةِ فَأَمَرَنَا النَّبِيُّ ﷺ فَقَالَ «حِلُّوا وَاجْعَلُوا عُمْرَةً» فَبَلَغَهُ عَنَّا أَنَا نَقُولُ لَمَّا لَمْ يَكُنْ بَيْنَنَا وَبَيْنَ عَرَفَةَ إِلَّا خَمْسٌ أَمَرَنَا أَنْ نَحِلَّ فَنَرُوحَ إِلَى مِنًى وَمَذَاكِيرُنَا تَقْطُرُ مِنَ الْمَنِيِّ فَقَامَ النَّبِيُّ ﷺ فَخَطَبَنَا فَقَالَ «قَدْ بَلَغَنِي الَّذِي قُلْتُمْ وَإِنِّي لَأَبَرُّكُمْ وَأَتْقَاكُمْ وَلَوْلَا الْهَدْيُ لَحَلَلْتُ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا أَهْدَيْتُ» قَالَ وَقَدِمَ عَلِيٌّ مِنَ الْيَمَنِ فَقَالَ «بِمَ أَهْلَلْتَ؟» قَالَ بِمَا أَهَلَّ بِهِ النَّبِيُّ ﷺ قَالَ «فَأَهْدِ وَامْكُثْ حَرَامًا كَمَا أَنْتَ» قَالَ وَقَالَ سُرَاقَةُ بْنُ جُعْشُمٍ يَا رَسُولَ اللهِ أَرَأَيْتَ عُمْرَتَنَا هَذِهِ أَلِعَامِنَا هَذَا أَوْ لِلْأَبَدِ؟ قَالَ «هِيَ لِلْأَبَدِ»

The Prophet (along with his companions) reached Mecca in the morning of the fourth of Dhul-Hijja assuming Ihram for Hajj only. So when we arrived at Mecca, the Prophet ﷺ ordered us to change our intentions of the Ihram for ʿUmra and that we could finish our Ihram after performing the ʿUmra and could go to our wives (for sexual intercourse). The people began talking about that. Jabir said surprisingly, "Shall we go to Mina while semen is dribbling from our male organs?" Jabir moved his hand while saying so. When this news reached the Prophet ﷺ he delivered a sermon and said, "I have been informed that some peoples were saying so and so; By Allah I fear Allah more than you do, and am more obedient to Him than you. If I had known what I know now, I would not have brought the Hadi (sacrifice) with me and had the Hadi not been with me, I would have finished the Ihram." At that Suraqa bin Malik stood up and asked "O Messenger of Allah ﷺ! Is this permission for us only or is it forever?" The Prophet ﷺ replied, "It is forever." In the meantime ʿAli bin Abu Talib came from Yemen and was saying Labbaik for what the Prophet ﷺ has intended. (According to another man, ʿAli was saying Labbaik for Hajj similar to Messenger of Allah ﷺ's). The Prophet ﷺ told him to keep on the Ihram and let him share the Hadi with him. البيهقي:١١٤٢٠أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو بَكْرِ بْنُ إِسْحَاقَ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ثنا أَبُو النُّعْمَانِ ثنا حَمَّادُ بْنُ زَيْدٍ ثنا عَبْدُ الْمَلِكِ بْنُ جُرَيْجٍ عَنْ عَطَاءٍ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ وَعَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ قَالَ

قَدِمَ رَسُولُ اللهِ ﷺ صَبِيحَةَ رَابِعَةٍ مِنْ ذِي الْحِجَّةِ مُهِلِّينَ بِالْحَجِّ لَا يُخَالِطُهُ شَيْءٌ فَلَمَّا قَدِمْنَا أَمَرَنَا فَجَعَلْنَاهَا عُمْرَةً بِأَنْ نَحِلَّ إِلَى نِسَائِنَا فَفَشَتْ فِي ذَلِكَ الْمَقَالَةُ قَالَ عَطَاءٌ قَالَ جَابِرٌ فَيَرُوحُ أَحَدُنَا إِلَى مِنًى وَذَكَرُهُ يَقْطُرُ مَنِيًّا قَالَ جَابِرٌ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَامَ خَطِيبًا فَقَالَ بَلَغَنِي أَنَّ أَقْوَامًا يَقُولُونَ كَذَا وَكَذَا وَاللهِ لَأَنَا أَتْقَى مِنْهُمْ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا أَهْدَيْتُ وَلَوْلَا أَنَّ مَعِيَ الْهَدْيَ لَأَحْلَلْتُ قَالَ فَقَامَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ ؓ فَقَالَ يَا رَسُولَ اللهِ هِيَ لَنَا أَمْ لِلْأَبَدِ؟ فَقَالَ لَا بَلْ لِلْأَبَدِ قَالَ وَجَاءَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ فَقَالَ أَحَدُهُمَا يَقُولُ لَبَّيْكَ بِمَا أَهَلَّ بِهِ رَسُولُ اللهِ ﷺ وَقَالَ الْآخَرُ لَبَّيْكَ بِحِجَّةِ رَسُولِ اللهِ ﷺ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُقِيمَ عَلَى إِحْرَامِهِ وَأَشْرَكَهُ فِي الْهَدْيِ

I, along with some people, heard Jabir b. 'Abdullah saying: We the Companions of Muhammad ﷺ put on Ihram for Hajj only. Ata' further said that Jabir stated: Allah's Apostle ﷺ came on the 4th of Dhu'l-Hijja and he commanded us to put off Ihram. 'Ata'said that he (Allah's Apostle) commanded them to put off Ihram and to go to their wives (for intercourse). 'Ata' said: It was not obligatory for them, but (intercourse) with them had become permissible. We said: When only five days had been left to reach 'Arafa, he (the Holy Prophet) commanded us to have intercourse with our wives. And we reached 'Arafa in a state as if we had just had intercourse (with them). He ('Ata') said: Jabir pointed with his hand and I (perceive) as if I am seeing his hand as it moved. In the (meantime) the Messenger of Allah ﷺ stood amongst us and said: You are well aware that I am the most God-fearing, most truthful and most pious amongst you. And if there were not sacrificial animals with me, I would also have put off Ihram as you have put off. And if I were to know this matter of mine what I have come to know later on, I would not have brought sacrificial animals with me. So they (the Companions) put off Ihram and we also put it off and listened to (the Holy Prophet) and obeyed (his command). Jabir said: 'Ali came with the revenue of the taxes (from Yemen). He (the Holy Prophet) said: For what (purpose) have you entered into the state of Ihram (whether you entered into the state purely for Hajj and, Umra jointly or Hajj and Umra separately)? He said: For the purpose for which the Messenger of Allah ﷺ had entered. (The Prophet had entered as a Qiran, i.e. Ihram covering both Umra and Hajj simultaneously.) Thereupon Messenger of Allah ﷺ said: Offer a sacrifice of animal, and retain Ihram. And 'Ali brought a sacrificial animal for him (for the Holy Prophet). Suraqa b. Malik b. Ju'shum said: Messenger of Allah, is it (this concession putting off Ihram of Hajj or Umra) meant for this year or is it forever? He said: It is forever. (Using translation from Muslim 1216a)
