20. Chapter
٢٠۔ كِتَابُ الشَّرِكَةِ
The Prophet (along with his companions) reached Mecca in the morning of the fourth of Dhul-Hijja assuming Ihram for Hajj only. So when we arrived at Mecca, the Prophet ﷺ ordered us to change our intentions of the Ihram for ʿUmra and that we could finish our Ihram after performing the ʿUmra and could go to our wives (for sexual intercourse). The people began talking about that. Jabir said surprisingly, "Shall we go to Mina while semen is dribbling from our male organs?" Jabir moved his hand while saying so. When this news reached the Prophet ﷺ he delivered a sermon and said, "I have been informed that some peoples were saying so and so; By Allah I fear Allah more than you do, and am more obedient to Him than you. If I had known what I know now, I would not have brought the Hadi (sacrifice) with me and had the Hadi not been with me, I would have finished the Ihram." At that Suraqa bin Malik stood up and asked "O Messenger of Allah ﷺ! Is this permission for us only or is it forever?" The Prophet ﷺ replied, "It is forever." In the meantime ʿAli bin Abu Talib came from Yemen and was saying Labbaik for what the Prophet ﷺ has intended. (According to another man, ʿAli was saying Labbaik for Hajj similar to Messenger of Allah ﷺ's). The Prophet ﷺ told him to keep on the Ihram and let him share the Hadi with him. قَدِمَ رَسُولُ اللهِ ﷺ صَبِيحَةَ رَابِعَةٍ مِنْ ذِي الْحِجَّةِ مُهِلِّينَ بِالْحَجِّ لَا يُخَالِطُهُ شَيْءٌ فَلَمَّا قَدِمْنَا أَمَرَنَا فَجَعَلْنَاهَا عُمْرَةً بِأَنْ نَحِلَّ إِلَى نِسَائِنَا فَفَشَتْ فِي ذَلِكَ الْمَقَالَةُ قَالَ عَطَاءٌ قَالَ جَابِرٌ فَيَرُوحُ أَحَدُنَا إِلَى مِنًى وَذَكَرُهُ يَقْطُرُ مَنِيًّا قَالَ جَابِرٌ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَامَ خَطِيبًا فَقَالَ بَلَغَنِي أَنَّ أَقْوَامًا يَقُولُونَ كَذَا وَكَذَا وَاللهِ لَأَنَا أَتْقَى مِنْهُمْ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا أَهْدَيْتُ وَلَوْلَا أَنَّ مَعِيَ الْهَدْيَ لَأَحْلَلْتُ قَالَ فَقَامَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ ؓ فَقَالَ يَا رَسُولَ اللهِ هِيَ لَنَا أَمْ لِلْأَبَدِ؟ فَقَالَ لَا بَلْ لِلْأَبَدِ قَالَ وَجَاءَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ فَقَالَ أَحَدُهُمَا يَقُولُ لَبَّيْكَ بِمَا أَهَلَّ بِهِ رَسُولُ اللهِ ﷺ وَقَالَ الْآخَرُ لَبَّيْكَ بِحِجَّةِ رَسُولِ اللهِ ﷺ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُقِيمَ عَلَى إِحْرَامِهِ وَأَشْرَكَهُ فِي الْهَدْيِ
[Machine] "The Messenger of Allah, ﷺ , participate in the sacrifice."
رَسُولُ اللهِ ﷺ اشْتَرِكُوا فِي الْهَدْيِ
[Machine] He was a partner of the Prophet ﷺ in the early days of Islam in trade. So, on the day of conquest, he said, "Welcome to my brother and partner, do not cover up or hide."
أَنَّهُ كَانَ شَرِيكَ النَّبِيِّ ﷺ فِي أَوَّلِ الْإِسْلَامِ فِي التِّجَارَةِ فَلَمَّا كَانَ يَوْمُ الْفَتْحِ قَالَ مَرْحَبًا بِأَخِي وَشَرِيكِي لَا تُدَارِي وَلَا تُمَارِي
I came to the Prophet ﷺ. The people began to praise me and make a mention of me. The Messenger of Allah ﷺ said: I know you, that is, he knew him. I said: My father and mother be sacrificed for you! you were my partner and how good a partner ; you neither disputed nor quarrelled. (Using translation from Abū Dāʾūd 4836)
أَتَيْتُ النَّبِيَّ ﷺ فَجَعَلُوا يُثْنُونَ عَلَيَّ وَيَذْكُرُونَنِي فَقَالَ رَسُولُ اللهِ ﷺ أَنَا أَعْلَمُكُمْ بِهِ قُلْتُ صَدَقْتَ بِأَبِي أَنْتَ وَأُمِّي كُنْتَ شَرِيكِي فَنِعْمَ الشَّرِيكُ كُنْتَ لَا تُدَارِي وَلَا تُمَارِي
20.2 [Machine] Company Accountability and Abandoning Betrayal.
٢٠۔٢ بَابُ الْأَمَانَةِ فِي الشَّرِكَةِ وَتَرْكِ الْخِيَانَةِ
[Machine] The Messenger of Allah ﷺ said, "Allah says, 'I am the third of the two partners as long as neither of them betrays his companion. But when one of them betrays the other, I will withdraw from between them.'" Abu Ali Al-Roudhbary narrated to us, who told us Abu Bakr ibn Dasa, who narrated to us Abu Dawood, who narrated to us Muhammad ibn Sulaiman Al-Mississi with his chain of narrators, he said, "Abu Hurairah narrated to me and said, 'Verily, Allah Most High says, so He mentioned it.'"
قَالَ رَسُولُ اللهِ ﷺ يَقُولُ اللهُ ﷻ أَنَا ثَالِثُ الشَّرِيكَيْنِ مَا لَمْ يَخُنْ أَحَدُهُمَا صَاحِبَهُ فَإِذَا خَانَ خَرَجْتُ مِنْ بَيْنِهِمَا 11425 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ سُلَيْمَانَ الْمِصِّيصِيُّ بِإِسْنَادِهِ هَذَا عَنْ أَبِي هُرَيْرَةَ رَفَعَهُ قَالَ إِنَّ اللهَ تَعَالَى يَقُولُ فَذَكَرَهُ
20.3 [Machine] The company in sales
٢٠۔٣ بَابُ الشَّرِكَةِ فِي الْبَيْعِ
[Machine] From his grandfather Abdullah ibn Hisham, who had met the Prophet ﷺ, his mother Zainab bint Humayd took him to the Messenger of Allah ﷺ. She said, "O Messenger of Allah, give him your pledge of allegiance." The Prophet ﷺ replied, "He is still young." Then he stroked his head and supplicated for him. He used to sacrifice one sheep for his entire family.
عَنْ جَدِّهِ عَبْدِ اللهِ بْنِ هِشَامٍ وَكَانَ قَدْ أَدْرَكَ النَّبِيَّ ﷺ وَذَهَبَتْ بِهِ أُمُّهُ زَيْنَبُ بِنْتُ حُمَيْدٍ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ بَايِعْهُ فَقَالَ النَّبِيُّ ﷺ هُوَ صَغِيرٌ وَمَسَحَ عَلَى رَأْسِهِ وَدَعَا لَهُ وَكَانَ يُضَحِّي بِالشَّاةِ الْوَاحِدَةِ عَنْ جَمِيعِ أَهْلِهِ
20.4 [Machine] The company in the loot
٢٠۔٤ بَابُ الشَّرِكَةِ فِي الْغَنِيمَةِ
I Ammar, and Sa'd became partners in what we would receive on the day of Badr. Sa'd then brought two prisoners, but I and Ammar did not bring anything. (Using translation from Abū Dāʾūd 3388)
اشْتَرَكْتُ أَنَا وَعَمَّارُ بْنُ يَاسِرٍ وَسَعْدٌ فِيمَا نُصِيبُهُ يَوْمَ بَدْرٍ فَلَمْ أَجِئْ أَنَا وَلَا عَمَّارٌ بِشَيْءٍ وَجَاءَ سَعْدٌ بِرَجُلَيْنِ
20.5 [Machine] The Condition in Partnership and Other Matters
٢٠۔٥ بَابُ الشَّرْطِ فِي الشَّرِكَةِ وَغَيْرِهَا قَدْ رُوِّينَا فِي حَدِيثِ عَائِشَةَ ؓ أَنَّ النَّبِيَّ ﷺ قَالَ: " مَا كَانَ مِنْ شَرْطٍ لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ "
[Machine] The Prophet ﷺ said, "Muslims are bound by their conditions." Sufyan added in his narration, "What is agreed upon as true from it, and we have narrated that with its addition from the hadith of Khushayf, from Urwah, from Aisha, and from Ata', from Anas bin Malik, in a marfu' form."
أَنَّ النَّبِيَّ ﷺ قَالَ الْمُسْلِمُونَ عَلَى شُرُوطِهِمْ قَالَ وَزَادَ سُفْيَانُ فِي حَدِيثِهِ مَا وَافَقَ الْحَقَّ مِنْهَا وَقَدْ رُوِّينَا ذَلِكَ بِزِيَادَتِهِ مِنْ حَدِيثِ خُصَيْفٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ وَعَنْ عَطَاءٍ عَنْ أَنَسِ بْنِ مَالِكٍ مَرْفُوعًا
[Machine] The Messenger of Allah ﷺ said, "Muslims are bound by their conditions, except for a condition that prohibits what is permissible or allows what is prohibited." Abu Bakr ibn al-Harith al-Faqih narrated to us, who informed us that Abu Muhammad ibn Hayyan narrated to him, that Abu Isa al-Khutuli narrated to him, who narrated from Abdullah ibn Muhammad al-Azrami, who narrated from Marwan ibn Muawiyah, who mentioned it likewise.
قَالَ رَسُولُ اللهِ ﷺ الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ إِلَّا شَرْطًا حَرَّمَ حَلَالًا أَوْ شَرْطًا أَحَلَّ حَرَامًا 11431 وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ ثنا أَبُو عِيسَى الْخُتُلِّيُّ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ الْأَذْرَمِيُّ ثنا مَرْوَانُ بْنُ مُعَاوِيَةَ فَذَكَرَهُ وَكَذَلِكَ
