21. Chapter
٢١۔ كِتَابُ الْوَكَالَةِ
I intended to go (on expedition) to Khaybar. So I came to the Holy Prophet ﷺ, greeted him and said: I am intending to go to Khaybar. He said: When you come to my agent, you should take from him fifteen wasqs (of dates). If he asks you for a sign, then place your hand on his collar-bone. (Using translation from Abū Dāʾūd 3632)
أَرَدْتُ الْخُرُوجَ إِلَى خَيْبَرَ فَأَتَيْتُ النَّبِيَّ ﷺ فَسَلَّمْتُ عَلَيْهِ وَقُلْتُ إِنِّي أَرَدْتُ الْخُرُوجَ إِلَى خَيْبَرَ فَقَالَ إِذَا أَتَيْتَ وَكِيلِي فَخُذْ مِنْهُ خَمْسَةَ عَشَرَ وَسْقًا؛ فَإِنِ ابْتَغَى مِنْكَ آيَةً فَضَعْ يَدَكَ عَلَى تَرْقُوَتِهِ
[Machine] The Messenger of Allah ﷺ commanded me, so I stood over the camels. He commanded me, so I divided their meat. Then he commanded me, so I divided their carcasses and their skins. And Abu Abdullah Al-Hafiz informed us that Abu Al-Abbas Muhammad ibn Ahmad Al-Mahbubi narrated to us, narrating from Ahmad ibn Sayyar, narrating from Muhammad ibn Kathir, who narrated from Sufyan, who narrated from Ibn Abi Najih, who mentioned it in a similar manner, except that he said: The Messenger of Allah ﷺ sent me to the camels.
أَمَرَنِي رَسُولُ اللهِ ﷺ فَقُمْتُ عَلَى الْبُدْنِ فَأَمَرَنِي فَقَسَمْتُ لُحُومَهَا ثُمَّ أَمَرَنِي فَقَسَمْتُ جِلَالَهَا وَجُلُودَهَا 11434 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ أَحْمَدَ الْمَحْبُوبِيُّ ثنا أَحْمَدُ بْنُ سَيَّارٍ ثنا مُحَمَّدُ بْنُ كَثِيرٍ أنبأ سُفْيَانُ حَدَّثَنِي ابْنُ أَبِي نَجِيحٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ بَعَثَنِي رَسُولُ اللهِ ﷺ عَلَى الْبُدْنِ
I met Bilal, the Mu'adhdhin of the Messenger of Allah ﷺ at Aleppo, and said: Bilal, tell me, what was the financial position of the Messenger of Allah ﷺ? He said: He had nothing. It was I who managed it on his behalf since the day Allah made him Prophet of Allah ﷺ until he died. When a Muslim man came to him and he found him naked, he ordered me (to clothe him). I would go, borrow (some money), and purchase a cloak for him. I would then clothe him and feed him. A man from the polytheists met me and said: I am well off, Bilal. Do not borrow money from anyone except me. So I did accordingly. One day when I performed ablution and stood up to make call to prayer, the same polytheist came along with a body of merchants. When he saw me, he said: O Abyssinian. I said: I am at your service. He met me with unpleasant looks and said harsh words to me. He asked me: Do you know how many days remain in the completion of this month? I replied: The time is near. He said: Only four days remain in the completion of this month. I shall then take that which is due from you (i.e. loan), and then shall return you to tend the sheep as you did before. I began to think in my mind what people think in their minds (on such occasions). When I offered the night prayer, the Messenger of Allah ﷺ returned to his family. I sought permission from him and he gave me permission. I said: Messenger of Allah, may my parents be sacrificed for you, the polytheist from whom I used to borrow money said to me such-and-such. Neither you nor I have anything to pay him for me, and he will disgrace me. So give me permission to run away to some of those tribes who have recently embraced Islam until Allah gives His Apostle ﷺ something with which he can pay (the debt) for me. So I came out and reached my house. I placed my sword, waterskin (or sheath), shoes and shield near my head. When dawn broke, I intended to be on my way. All of a sudden I saw a man running towards me and calling: Bilal, return to the Messenger of Allah ﷺ. So I went till I reached him. I found four mounts kneeling on the ground with loads on them. I sought permission. The Messenger of Allah ﷺ said to me: Be glad, Allah has made arrangements for the payment (of your debt). He then asked: Have you not seen the four mounts kneeling on the ground? I replied: Yes. He said: You may have these mounts and what they have on them. There are clothes and food on them, presented to me by the ruler of Fadak. Take them away and pay off your debt. I did so. He then mentioned the rest of the tradition. I then went to the mosque and found that the Messenger of Allah ﷺ was sitting there. I greeted him. He asked: What benefit did you have from your property? I replied: Allah Most High paid everything which was due from the Messenger of Allah ﷺ. Nothing remains now. He asked: Did anything remain (from that property)? I said: Yes. He said: Look, if you can give me some comfort from it, for I shall not visit any member of my family until you give me some comfort from it. When the Messenger of Allah ﷺ offered the night prayer, he called me and said: What is the position of that which you had with you (i.e. property)? I said: I still have it, no one came to me. The Messenger of Allah ﷺ passed the night in the mosque. He then narrated the rest of the tradition. Next day when he offered the night prayer, he called me and asked: What is the position of that which you had (i.e. the rest of the property)? I replied: Allah has given you comfort from it, Messenger of Allah. He said: Allah is Most Great, and praised Allah, fearing lest he should die while it was with him. I then followed him until he came to his wives and greeted each one of them and finally he came to his place where he had to pass the night. This is all for which you asked me. لَقِيتُ بِلَالًا مُؤَذِّنَ النَّبِيِّ ﷺ بِحَلَبَ فَقُلْتُ يَا بِلَالُ حَدِّثْنِي كَيْفَ كَانَتْ نَفَقَةُ النَّبِيِّ ﷺ؟ فَقَالَ مَا كَانَ لَهُ شَيْءٌ إِلَّا أَنَا الَّذِي كُنْتُ أَلِي ذَلِكَ مِنْهُ مُنْذُ بَعَثَهُ اللهُ إِلَى أَنْ تُوُفِّيَ فَكَانَ إِذَا أَتَاهُ الْإِنْسَانُ الْمُسْلِمُ فَرَآهُ عَارِيًا يَأْمُرُنِي فَأَنْطَلِقُ فَأَسْتَقْرِضُ فَأَشْتَرِيَ الْبُرْدَةَ وَالشَّيْءَ فَأَكْسُوَهُ وَأُطْعِمَهُ حَتَّى اعْتَرَضَنِي رَجُلٌ مِنَ الْمُشْرِكِينَ فَقَالَ يَا بِلَالُ إِنَّ عِنْدِي سَعَةً فَلَا تَسْتَقْرِضْ مِنْ أَحَدٍ إِلَّا مِنِّي فَفَعَلْتُ فَلَمَّا كَانَ ذَاتَ يَوْمٍ تَوَضَّأْتُ ثُمَّ قُمْتُ لِأُؤَذِّنَ بِالصَّلَاةِ فَإِذَا الْمُشْرِكُ فِي عِصَابَةٍ مِنَ التُّجَّارِ فَلَمَّا رَآنِي قَالَ يَا حَبَشِيُّ قَالَ قُلْتُ يَا لَبَيَّهِ فَتَجَهَّمَنِي وَقَالَ قَوْلًا غَلِيظًا فَقَالَ أَتَدْرِي كَمْ بَيْنَكَ وَبَيْنَ الشَّهْرِ؟ قَالَ قُلْتُ قَرِيبٌ قَالَ إِنَّمَا بَيْنَكَ وَبَيْنَهُ أَرْبَعُ لَيَالٍ فَآخُذُكَ بِالَّذِي لِي عَلَيْكَ فَإِنِّي لَمْ أُعْطِكَ الَّذِي أَعْطَيْتُكَ مِنْ كَرَامَتِكَ وَلَا مِنْ كَرَامَةِ صَاحِبِكَ وَلَكِنْ أَعْطَيْتُكَ لِتَجِبَ لِي عَبْدًا؛ فَأَرُدُّكَ تَرْعَى الْغَنَمَ كَمَا كُنْتَ قَبْلَ ذَلِكَ فَأَخَذَ فِي نَفْسِي مَا يَأْخُذُ فِي أَنْفُسِ النَّاسِ فَانْطَلَقْتُ ثُمَّ أَذَّنْتُ بِالصَّلَاةِ حَتَّى إِذَا صَلَّيْتُ الْعَتَمَةَ رَجَعَ النَّبِيُّ ﷺ إِلَى أَهْلِهِ فَاسْتَأْذَنْتُ عَلَيْهِ فَأَذِنَ لِي فَقُلْتُ يَا رَسُولَ اللهِ بِأَبِي أَنْتَ وَأُمِّي إِنَّ الْمُشْرِكَ الَّذِي ذَكَرْتُ لَكَ أَنِّي كُنْتُ أَتَدَيَّنُ مِنْهُ قَدْ قَالَ كَذَا وَكَذَا وَلَيْسَ عِنْدَكَ مَا تَقْضِي عَنِّي وَلَا عِنْدِي وَهُوَ فَاضِحِي فَأَذِنَ لِي أَنْ آتِيَ إِلَى بَعْضِ هَؤُلَاءِ الْأَحْيَاءِ الَّذِينَ قَدْ أَسْلَمُوا حَتَّى يَرْزُقَ اللهُ رَسُولَهُ ﷺ مَا يَقْضِي عَنِّي فَخَرَجْتُ حَتَّى أَتَيْتُ مَنْزِلِي فَجَعَلْتُ سَيْفِي وَجِرَابِي وَرُمْحِي وَنَعْلِي عِنْدَ رَأْسِي وَاسْتَقْبَلْتُ بِوَجْهِيَ الْأُفُقَ فَكُلَّمَا نِمْتُ انْتَبَهْتُ فَإِذَا رَأَيْتُ عَلَيَّ لَيْلًا نِمْتُ حَتَّى انْشَقَّ عَمُودُ الصُّبْحِ الْأَوَّلِ فَأَرَدْتُ أَنْ أَنْطَلِقَ فَإِذَا إِنْسَانٌ يَسْعَى يَدْعُو يَا بِلَالُ أَجِبْ رَسُولَ اللهِ ﷺ فَانْطَلَقْتُ حَتَّى أَتَيْتُهُ فَإِذَا أَرْبَعُ رَكَائِبَ عَلَيْهِنَّ أَحْمَالُهُنَّ فَأَتَيْتُ النَّبِيَّ ﷺ فَاسْتَأْذَنْتُ فَقَالَ لِيَ النَّبِيُّ ﷺ أَبْشِرْ؛ فَقَدْ جَاءَكَ اللهُ بِقَضَائِكَ فَحَمِدْتُ اللهَ وَقَالَ أَلَمْ تَمُرَّ عَلَى الرَّكَائِبِ الْمُنَاخَاتِ الْأَرْبَعِ؟ قَالَ فَقُلْتُ بَلَى قَالَ فَإِنَّ لَكَ رِقَابَهُنَّ وَمَا عَلَيْهِنَّ وَإِذَا عَلَيْهِنَّ كِسْوَةٌ وَطَعَامٌ أَهْدَاهُنَّ لَهُ عَظِيمُ فَدَكٍ فَاقْبِضْهُنَّ إِلَيْكَ ثُمَّ اقْضِ دَيْنَكَ قَالَ فَفَعَلْتُ فَحَطَطْتُ عَنْهُنَّ أَحْمَالَهُنَّ ثُمَّ عَقَلْتُهُنَّ ثُمَّ عَمَدْتُ إِلَى تَأْذِينِ صَلَاةِ الصُّبْحِ حَتَّى إِذَا صَلَّى رَسُولُ اللهِ ﷺ خَرَجْتُ إِلَى الْبَقِيعِ فَجَعَلْتُ أُصْبُعِي فِي أُذُنِي فَنَادَيْتُ وَقُلْتُ مَنْ كَانَ يَطْلُبُ رَسُولَ اللهِ ﷺ دَيْنًا فَلْيَحْضُرْ فَمَا زِلْتُ أَبِيعُ وَأَقْضِي وَأَعْرِضُ وَأَقْضِي حَتَّى لَمْ يَبْقَ عَلَى رَسُولِ اللهِ ﷺ دَيْنٌ فِي الْأَرْضِ حَتَّى فَضُلَ عِنْدِي أُوقِيَّتَانِ أَوْ أُوقِيَّةٌ وَنِصْفٌ ثُمَّ انْطَلَقْتُ إِلَى الْمَسْجِدِ وَقَدْ ذَهَبَ عَامَّةُ النَّهَارِ فَإِذَا رَسُولُ اللهِ ﷺ قَاعِدٌ فِي الْمَسْجِدِ وَحْدَهُ فَسَلَّمْتُ عَلَيْهِ فَقَالَ لِي مَا فَعَلَ مَا قِبَلَكَ؟ قَالَ قُلْتُ قَدْ قَضَى اللهُ كُلَّ شَيْءٍ كَانَ عَلَى رَسُولِ اللهِ ﷺ فَلَمْ يَبْقَ شَيْءٌ فَقَالَ فَضُلَ شَيْءٌ؟ قُلْتُ نَعَمْ دِينَارَانِ قَالَ انْظُرْ أَنْ تُرِيحَنِي مِنْهُمَا فَلَسْتُ بِدَاخِلٍ عَلَى أَحَدٍ مِنْ أَهْلِي حَتَّى تُرِيحَنِي مِنْهُمَا فَلَمْ يَأْتِنَا فَبَاتَ فِي الْمَسْجِدِ حَتَّى أَصْبَحَ وَظَلَّ فِي الْمَسْجِدِ الْيَوْمَ الثَّانِي حَتَّى كَانَ فِي آخِرِ النَّهَارِ جَاءَ رَاكِبَانِ فَانْطَلَقْتُ بِهِمَا فَكَسَوْتُهُمَا وَأَطْعَمْتُهُمَا حَتَّى إِذَا صَلَّى الْعَتَمَةَ دَعَانِي فَقَالَ مَا فَعَلَ الَّذِي قِبَلَكَ؟ قُلْتُ قَدْ أَرَاحَكَ اللهُ مِنْهُ فَكَبَّرَ وَحَمِدَ اللهَ شَفَقًا مِنْ أَنْ يُدْرِكَهُ الْمَوْتُ وَعِنْدَهُ ذَلِكَ ثُمَّ اتَّبَعْتُهُ حَتَّى جَاءَ أَزْوَاجَهُ فَسَلَّمَ عَلَى امْرَأَةٍ امْرَأَةٍ حَتَّى أَتَى فِي مَبِيتِهِ فَهَذَا الَّذِي سَأَلْتَنِي عَنْهُ
21.2 [Machine] Authorization in Disputes with Presence or Absence
٢١۔٢ بَابُ التَّوْكِيلِ فِي الْخُصُومَاتِ مَعَ الْحُضُورِ وَالْغِيبَةِ 11436 - أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ , أَنْبَأَ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ عَبْدِ اللهِ الصَّفَّارُ، ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ الْقَاضِي، ثنا سُلَيْمَانُ بْنُ حَرْبٍ، ثنا حَمَّادُ بْنُ زَيْدٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بُشَيْرِ بْنِ يَسَارٍ مَوْلَى الْأَنْصَارِ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، وَرَافِعِ بْنِ خَدِيجٍ، أَنَّهُمَا حَدَّثَاهُ , أَوْ حَدَّثَا أَنَّ عَبْدَ اللهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ بْنَ مَسْعُودٍ أَتَيَا خَيْبَرَ فِي حَاجَةٍ، فَتَفَرَّقَا فِي النَّخْلِ، فَقُتِلَ عَبْدُ اللهِ بْنُ سَهْلٍ، فَجَاءَ أَخُوهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَابْنَا عَمِّهِ مُحَيِّصَةُ وَحُوَيِّصَةُ إِلَى رَسُولِ اللهِ ﷺ، فَذَكَرَا أَمْرَ صَاحِبِهِمَا، فَبَدَأَ عَبْدُ الرَّحْمَنِ فَتَكَلَّمَ، وَكَانَ أَقْرَبَ، فَقَالَ رَسُولُ اللهِ ﷺ: " الْكُبْرَ " قَالَ يَحْيَى: لِيَلِي الْكَلَامَ الْكُبْرُ، فَتَكَلَّمَا فِي أَمْرِ صَاحِبِهِمَا، وَذَكَرَ الْحَدِيثَ. رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ سُلَيْمَانَ بْنِ حَرْبٍ وَرَوَاهُ مُسْلِمٌ عَنِ الْقَوَارِيرِيِّ، عَنْ حَمَّادٍ
[Machine] Ali, the son of Abu Talib, used to dislike quarrels. So, whenever he had a dispute, he would delegate it to Aqil, the son of Abu Talib. But when Aqil grew up, he delegated it to me.
كَانَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ يَكْرَهُ الْخُصُومَةَ فَكَانَ إِذَا كَانَتْ لَهُ خُصُومَةٌ وَكَّلَ فِيهَا عَقِيلَ بْنَ أَبِي طَالِبٍ فَلَمَّا كَبِرَ عَقِيلٌ وَكَّلَنِي
أَبُو الزَّيَّادِ الْقَحْمُ الْمَهَالِكُ
21.3 [Machine] The merit of representation for those who do not guide
٢١۔٣ بَابُ فَضْلِ النِّيَابَةِ عَمَّنْ لَا يَهْدِي
[Machine] A man came to the Prophet Muhammad ﷺ and asked him, "O Messenger of Allah, which deeds are the best?" The Prophet replied, "Believing in Allah and striving in His cause." The man then asked, "Which form of charity is the best?" The Prophet replied, "To give of one's self." The man asked further, "What if I am unable?" The Prophet replied, "Then you should assist the laborer and engage in good deeds." The man asked again, "What if I am not capable?" The Prophet replied, "Then you should refrain from harming others, for that would be a charity by which you benefit yourself."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَسَأَلَهُ فَقَالَ يَا رَسُولَ اللهِ أِيُّ الْأَعْمَالِ أَفْضَلُ؟ قَالَ إِيمَانٌ بِاللهِ وَجِهَادٌ فِي سَبِيلِ اللهِ قَالَ فَأِيُّ الْعَتَاقَةِ أَفْضَلُ؟ قَالَ أَنْفَسُهَا قَالَ أَفَرَأَيْتَ إِنْ لَمْ أَجِدْ؟ قَالَ فَتُعِينُ الصَّانِعَ وَتَصْنَعُ لِأَخْرَقَ قَالَ أَفَرَأَيْتَ إِنْ لَمْ أَسْتَطِعْ؟ قَالَ تَدَعُ النَّاسَ مِنْ شَرِّكَ؛ فَإِنَّهَا صَدَقَةٌ تَصَدَّقُ بِهَا عَلَى نَفْسِكَ
[Machine] I said, "O Messenger of Allah, the wealthy people have taken all the rewards." He said, "Are you not the ones who pray, fast, strive, and give charity?" I said, "Yes, but they do the same; they pray, fast, strive, and give charity, but we don't give charity." He said, "Surely, in you there are many acts of charity. Surely, your explanation to someone in need is an act of charity, and your listening to someone with bad hearing is an act of charity, and your guiding a blind person on the road is an act of charity, and your assisting the weak with your strength is an act of charity, and your removing harm from the road is an act of charity, and your gentle treatment of your family is an act of charity." I said, "O Messenger of Allah, can one of us fulfill his desire and still be rewarded?" He said, "Do you not consider that if you fulfill it in an unlawful manner, would there be a burden on you?" I said, "Yes." He said, "So why do you reckon the bad but not the good?" And this was narrated to us from different sources other than Abu Dharr.
قُلْتُ يَا رَسُولَ اللهِ ذَهَبَ الْأَغْنِيَاءُ بِالْأَجْرِ فَقَالَ أَلَسْتُمْ تُصَلُّونَ وَتَصُومُونَ وَتُجَاهِدُونَ؟ قَالَ قُلْتُ بَلَى وَهُمْ يَفْعَلُونَ كَمَا نَفْعَلُ يُصَلُّونَ وَيَصُومُونَ وَيُجَاهِدُونَ وَيَتَصَدَّقُونَ وَلَا نَتَصَدَّقُ قَالَ إِنَّ فِيكَ صَدَقَةً كَثِيرَةً إِنَّ فِي فَضْلِ بَيَانِكَ عَنِ الْأَرْتَمِ تُعَبِّرُ عَنْهُ حَاجَتَهُ صَدَقَةٌ وَفِي فَضْلِ سَمْعِكَ عَلَى السَّيِّئِ السَّمْعِ تُعَبِّرُ عَنْهُ حَاجَتَهُ صَدَقَةٌ وَفِي فَضْلِ بَصَرِكَ عَلَى ضَرِيرِ الْبَصَرِ تَهْدِيهِ الطَّرِيقَ صَدَقَةٌ وَفِي قُوَّتِكَ عَلَى الضَّعِيفِ تُعِينُهُ صَدَقَةٌ وَفِي إِمَاطَتِكَ الْأَذَى عَنِ الطَّرِيقِ صَدَقَةٌ وَفِي مُبَاضَعَتِكَ أَهْلَكَ صَدَقَةٌ قَالَ قُلْتُ يَا رَسُولَ اللهِ أَيَأْتِي أَحَدُنَا شَهْوَتَهُ وَيُؤْجَرُ؟ قَالَ أَرَأَيْتُمْ لَوْ جَعَلْتَهُ فِي غَيْرِ حِلِّهِ أَكَانَ عَلَيْكَ وِزْرٌ؟ قَالَ قُلْتُ نَعَمْ قَالَ أَفَتَحْتَسِبُونَ بِالشَّرِّ وَلَا تَحْتَسِبُونَ بِالْخَيْرِ؟ وَرُوِّينَا هَذَا مِنْ أَوْجُهٍ أُخَرَ عَنْ أَبِي ذَرٍّ ؓ
21.4 [Machine] The Sin of One Who Engages or Assists in a Frivolous Dispute
٢١۔٤ بَابُ إِثْمِ مَنْ خَاصَمَ أَوْ أَعَانَ فِي خُصُومَةٍ بِبَاطِلٍ
[Machine] The Messenger of Allah ﷺ said, "Whoever intercedes beyond the limits set by Allah, has indeed transgressed against Allah in His dominion. And whoever dies while still having a debt, then there is no currency of dinar or dirham, but rather it is good deeds and bad deeds. And whoever disputes in falsehood while knowing it, he remains in the displeasure of Allah until he stops. And whoever speaks about a believer that which is not in him, he is imprisoned in the pit of slander until he comes out of what he said." And Abu Ali Al-Ruzbary informed us that Abu Bakr ibn Dasa narrated to us, and Abu Dawud narrated to us, and Ahmed ibn Yunus mentioned it in a similar way, except for his statement "And whoever dies while still having a debt."
قَالَ رَسُولُ اللهِ ﷺ مَنْ حَالَتْ شَفَاعَتُهُ دُونَ حَدٍّ مِنْ حُدُودِ اللهِ فَقَدْ ضَادَّ اللهَ فِي مُلْكِهِ وَمَنْ مَاتَ وَعَلَيْهِ دَيْنٌ فَلَيْسَ ثَمَّ دِينَارٌ وَلَا دِرْهَمٌ وَلَكِنَّهَا الْحَسَنَاتُ وَالسَّيِّئَاتُ وَمَنْ خَاصَمَ فِي بَاطِلٍ وَهُوَ يَعْلَمُ لَمْ يَزَلْ فِي سَخَطِ اللهِ ﷻ حَتَّى يَنْزِعَ وَمَنْ قَالَ فِي مُؤْمِنٍ مَا لَيْسَ فِيهِ حُبِسَ فِي رَدْغَةِ الْخَبَالِ حَتَّى يَخْرُجَ مِمَّا قَالَ 11442 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ يُونُسَ فَذَكَرَهُ بِنَحْوِهِ دُونَ قَوْلِهِ وَمَنْ مَاتَ وَعَلَيْهِ دَيْنٌ
"He who assits in a dispute unjustly deserves the anger of Allah, Most High. (Using translation from Abū Dāʾūd 3598)
عَنِ النَّبِيِّ ﷺ بِمَعْنَاهُ قَالَ وَمَنْ أَعَانَ عَلَى خُصُومَةٍ بِظُلْمٍ فَقَدْ بَاءَ بِغَضَبٍ مِنَ اللهِ
[Machine] The Messenger of Allah ﷺ said: "Whoever walks with a group and claims to witness something that he did not witness, then he is a false witness. And whoever supports a dispute without knowledge, he is in the anger of Allah until he withdraws. Fighting against a believer is disbelief, and insulting him is disobedience."
قَالَ رَسُولُ اللهِ ﷺ مَنْ مَشَى مَعَ قَوْمٍ يَرَى أَنَّهُ شَاهِدٌ وَلَيْسَ بِشَاهِدٍ فَهُوَ شَاهِدُ زُورٍ وَمَنْ أَعَانَ عَلَى خُصُومَةٍ بِغَيْرِ عِلْمٍ كَانَ فِي سَخَطِ اللهِ حَتَّى يَنْزِعَ وَقِتَالُ الْمُؤْمِنُ كُفْرٌ وَسِبَابُهُ فُسُوقٌ
21.5 [Machine] What Was Stated in the Statement, He Withdraws if He is Dismissed and Even If He Does Not Know About It
٢١۔٥ بَابُ مَا جَاءَ فِي الْوَكِيلِ يَنْعَزِلُ إِذَا عُزِلَ وَإِنْ لَمْ يَعْلَمْ بِهِ
[Machine] Umar spent his life in a nation that he conquered and commanded a man to sell her. Then her owner appeared and he freed her and testified to that. The slave girl had already been sold, so they thought that since she was freed before being sold, Umar decided that she should be freed and the price should be returned and her bride price should be taken, because he had already consummated with her. 11446 He said, "Abu Al-Walid informed us that Al-Hasan bin Sufyan narrated from Hibban from Ibn Al-Mubarak who mentioned something similar and said, "Umar bin Abdul Aziz decided."
قَضَى عُمَرُ فِي أَمَةٍ غَزَا مَوْلَاهَا وَأَمَرَ رَجُلًا بِبَيْعِهَا ثُمَّ بَدَا لِمَوْلَاهَا فَأَعْتَقَهَا وَأَشْهَدَ عَلَى ذَلِكَ وَقَدْ بِيعَتِ الْجَارِيَةُ فَحَسَبُوا فَإِذَا عِتْقُهَا قَبْلَ بَيْعِهَا فَقَضَى عُمَرُ ؓ أَنْ يُقْضَى بِعِتْقِهَا وَيُرَدَّ ثَمَنُهَا وَيُؤْخَذَ صَدَاقُهَا لَمَّا كَانَ قَدْ وَطِئَهَا 11446 قَالَ وَأنبأ أَبُو الْوَلِيدِ ثنا الْحَسَنُ بْنُ سُفْيَانَ عَنْ حِبَّانَ عَنِ ابْنِ الْمُبَارَكِ فَذَكَرَ نَحْوَهُ وَقَالَ فِيهِ فَقَضَى عُمَرُ بْنُ عَبْدِ الْعَزِيزِ ؓ
