19. Chapter
١٩۔ كِتَابُ الضَّمَانِ
[Machine] "The Messenger of Allah ﷺ said that the leader is responsible. Al-Muzanni said that the leader in language refers to the guarantor. The sheikh said that this was narrated from Qatadah from As-Suddi."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الزَّعِيمُ غَارِمٌ قَالَ الْمُزَنِيُّ وَالزَّعِيمُ فِي اللُّغَةِ هُوَ الْكَفِيلُ قَالَ الشَّيْخُ وَرُوِّينَاهُ عَنْ قَتَادَةَ عَنِ السُّدِّيِّ
[Machine] I heard the Messenger of Allah ﷺ saying, "I am the leader and the leader is the bearer for whoever believes in me, embraces Islam, and migrates for the sake of a house in the gardens of Paradise."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ أَنَا زَعِيمٌ وَالزَّعِيمُ الْحَمِيلُ لِمَنْ آمَنَ بِي وَأَسْلَمَ وَهَاجَرَ بِبَيْتٍ فِي رَبَضِ الْجَنَّةِ
"I heard the Messenger of Allah ﷺ say: 'I am a Za'im - and the Za'im is the guarantor - for the one who believes in me and accepts Islam, and emigrates: A house on the outskirts of Paradise and a house in the middle of Paradise. And I am a guarantor, for the one who believes in me and accepts Islam, and strives in the cause of Allah: A house on the outskirts of Paradise and a house in the middle of Paradise and a house in the highest chambers of Paradise. Whoever does that and seeks goodness wherever it is, and avoids evil wherever it is, may die wherever he wants to die.'" (Using translation from Nasāʾī 3133)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ أَنَا زَعِيمٌ وَالزَّعِيمُ الْحَمِيلُ لِمَنْ آمَنَ بِي وَأَسْلَمَ وَجَاهَدَ فِي سَبِيلِ اللهِ بِبَيْتٍ فِي رَبَضِ الْجَنَّةِ وَبَيْتٍ فِي وَسَطِ الْجَنَّةِ وَأَنَا زَعِيمٌ لِمَنْ آمَنَ بِي وَأَسْلَمَ وَهَاجَرَ بِبَيْتٍ فِي رَبَضِ الْجَنَّةِ وَبِبَيْتٍ فِي وَسَطِ الْجَنَّةِ وَبِبَيْتٍ فِي أَعْلَى غُرَفِ الْجَنَّةِ فَمَنْ فَعَلَ ذَلِكَ فَلَمْ يَدَعْ لِلْخَيْرِ مَطْلَبًا وَلَا مِنَ الشَّرِّ مَهْرَبًا يَمُوتُ حَيْثُ يَشَاءُ أَنْ يَمُوتَ وَذَكَرَ الْمُزَنِيُّ هَا هُنَا حَدِيثَ أَبِي سَعِيدٍ الْخُدْرِيِّ فِي الضَّمَانِ وَإِسْنَادُ حَدِيثِ أَبِي سَعِيدٍ ضَعِيفٌ فَالْأَوْلَى بِنَا أَنْ نُقَدِّمَ مَا
[Machine] The Messenger of Allah, ﷺ , was brought a funeral of a man from the Ansar, to pray upon him. He asked, "Does he have any debt?" They replied, "No." He asked, "Did he leave anything behind?" They said, "Yes." So he prayed upon him and another funeral was brought, and he asked again, "Does he have any debt?" They replied, "Yes." He asked, "Did he leave anything behind?" They said, "Yes." So he prayed upon him as well. Then another funeral was brought, and he asked again, "Does he have any debt?" They replied, "Yes." He asked, "Did he leave anything behind?" They said, "No." He said, "Pray for your companion." Abu Qatadah said, "It is for me, O Messenger of Allah!" So he prayed upon him, the Messenger of Allah, ﷺ .
أُتِيَ رَسُولُ اللهِ ﷺ بِجِنَازَةِ رَجُلٍ مِنَ الْأَنْصَارِ لِيُصَلِّيَ عَلَيْهَا فَقَالَ هَلْ عَلَيْهِ دَيْنٌ؟ فَقَالُوا لَا قَالَ هَلْ تَرَكَ شَيْئًا؟ قَالُوا نَعَمْ فَصَلَّى عَلَيْهِ وَأُتِيَ بِجِنَازَةٍ فَقَالَ هَلْ عَلَيْهِ دَيْنٌ؟ قَالُوا نَعَمْ قَالَ هَلْ تَرَكَ شَيْئًا؟ قَالُوا نَعَمْ فَصَلَّى عَلَيْهِ وَأُتِيَ بِجِنَازَةٍ فَقَالَ هَلْ عَلَيْهِ دَيْنٌ؟ قَالُوا نَعَمْ قَالَ هَلْ تَرَكَ شَيْئًا؟ قَالُوا لَا قَالَ صَلُّوا عَلَى صَاحِبِكُمْ قَالَ أَبُو قَتَادَةَ ؓ هُوَ عَلَيَّ يَا رَسُولَ اللهِ فَصَلَّى عَلَيْهِ رَسُولُ اللهِ ﷺ
[Machine] I was with the Prophet ﷺ when a funeral procession was brought. They said, "O Prophet of Allah, pray for him." He asked, "Did he leave any debts?" They said, "No." He asked, "Did he leave anything behind?" They said, "No." So, he prayed for him. Then, another funeral procession was brought. They said, "O Prophet of Allah, pray for her." He asked, "Did she leave any debts?" They said, "No." He asked, "Did she leave anything behind?" They said, "Three dinars." He said, "Pay them." Then, the third funeral procession was brought. They said, "O Prophet of Allah, pray for him." He asked, "Did he leave any debts?" They said, "Yes." He asked, "Did he leave anything behind?" They said, "No." He said, "Pray for your companion." Then, a man from the Ansar named Abu Qatadah said, "May Allah's ﷺ and his debt also." So, the Prophet ﷺ prayed for him accordingly as narrated by Yahya bin Sa'id and in another narration by Makkib bin Ibrahim in the other funeral procession they said, "Three dinars." So, he prayed for her.
كُنْتُ مَعَ النَّبِيِّ ﷺ فَأُتِيَ بِجِنَازَةٍ فَقَالُوا يَا نَبِيَّ اللهِ صَلِّ عَلَيْهِ قَالَ هَلْ تَرَكَ مِنْ دَيْنٍ؟ قَالُوا لَا قَالَ فَهَلْ تَرَكَ مِنْ شَيْءٍ؟ قَالُوا لَا فَصَلَّى عَلَيْهَا ثُمَّ أُتِيَ بِجِنَازَةٍ أُخْرَى فَقَالُوا يَا نَبِيَّ اللهِ صَلِّ عَلَيْهَا قَالَ هَلْ تَرَكَ عَلَيْهَا مِنْ دَيْنٍ؟ قَالُوا لَا قَالَ هَلْ تَرَكَ مِنْ شَيْءٍ؟ قَالُوا ثَلَاثَةَ دَنَانِيرَ قَالَ ثَلَاثَ كَيَّاتٍ قَالَ ثُمَّ أُتِيَ بِالثَّالِثِ فَقَالُوا يَا نَبِيَّ اللهِ صَلِّ عَلَيْهَا قَالَ هَلْ تَرَكَ عَلَيْهِ مِنْ دَيْنٍ؟ قَالُوا نَعَمْ قَالَ فَهَلْ تَرَكَ مِنْ شَيْءٍ؟ قَالُوا لَا قَالَ فَصَلُّوا عَلَى صَاحِبِكُمْ فَقَالَ رَجُلٌ مِنَ الْأَنْصَارِ يُقَالُ لَهُ أَبُو قَتَادَةَ صَلِّ عَلَيْهِ وَعَلَيَّ دَيْنُهُ قَالَ فَصَلَّى عَلَيْهِ هَكَذَا فِي رِوَايَةِ يَحْيَى بْنِ سَعِيدٍ وَفِي رِوَايَةِ مَكِّيِّ بْنِ إِبْرَاهِيمَ فِي الْجِنَازَةِ الْأُخْرَى قَالُوا ثَلَاثَةَ دَنَانِيرَ فَصَلَّى عَلَيْهَا
The Messenger of Allah ﷺ would not say funeral prayer over a person who died while the debt was due from him. A dead Muslim was brought to him and he asked: Is there any debt due from him? They (the people) said: Yes, two dirhams. He said: Pray yourselves over your companion. Then AbuQatadah al-Ansari said: I shall pay them, Messenger of Allah. The Messenger of Allah ﷺ then prayed over him. When Allah granted conquests to the Messenger of Allah ﷺ, he said: I am nearer to every believer than himself, so if anyone (dies and) leaves a debt, I shall be responsible for paying it; and if anyone leaves property, it goes to his heirs. كَانَ رَسُولُ اللهِ ﷺ لَا يُصَلِّي عَلَى أَحَدٍ عَلَيْهِ دَيْنٌ فَأُتِيَ بِمَيِّتٍ فَقَالَ هَلْ عَلَيْهِ دَيْنٌ؟ قَالُوا نَعَمْ يَا رَسُولَ اللهِ دِينَارَانِ قَالَ صَلُّوا عَلَى صَاحِبِكُمْ قَالَ أَبُو قَتَادَةَ هُمَا عَلَيَّ يَا رَسُولَ اللهِ فَصَلَّى عَلَيْهِ فَلَمَّا فَتَحَ اللهُ عَلَى رَسُولِهِ ﷺ قَالَ أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ فَمَنْ تَرَكَ دَيْنًا فَعَلَيَّ وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ
[Machine] The Messenger of Allah ﷺ was brought a funeral to pray over it, so he came forward to perform the prayer and then he turned to us and said, "Does your companion have any debt?" They said, "Yes." He said, "Has he left any of it paid off?" They said, "No." He said, "Pray for your companion." Ali bin Abi Talib said, "O Messenger of Allah, he has a debt upon me." So he came forward and prayed over him and said, "May Allah reward you, O Ali, with goodness, as you have removed the burden from your brother. There is no Muslim who removes the burden from his brother except that Allah will remove his burden on the Day of Resurrection." This hadith was narrated by Abdah bin Abdullah As-Saffar from Abu Nuaim Al-Fadl bin Dukayn, who completed it. He said, "O Messenger of Allah, I have been free from his debt and I guarantee what he owes." It was narrated by Zafr bin Sulaiman from Al-Wassaafi. Ali said, "O Prophet of Allah, I guarantee his debt." And the Hadith revolves around Ubaidullah Al-Wassaafi, who is very weak, and it has been narrated from another source with a weak Isnaad from Ali bin Abi Talib.
أُتِيَ رَسُولُ اللهِ ﷺ بِجِنَازَةٍ لِيُصَلِّيَ عَلَيْهَا فَتَقَدَّمَ لِيُصَلِّيَ فَالْتَفَتَ إِلَيْنَا فَقَالَ هَلْ عَلَى صَاحِبِكُمْ دَيْنٌ؟ قَالُوا نَعَمْ قَالَ هَلْ تَرَكَ لَهُ مِنْ وَفَاءٍ؟ قَالُوا لَا قَالَ صَلُّوا عَلَى صَاحِبِكُمْ قَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ عَلَيَّ دَيْنُهُ يَا رَسُولَ اللهِ فَتَقَدَّمَ فَصَلَّى عَلَيْهِ وَقَالَ جَزَاكَ اللهُ يَا عَلِيُّ خَيْرًا كَمَا فَكَكْتَ رِهَانَ أَخِيكَ مَا مِنْ مُسْلِمٍ فَكَّ رِهَانَ أَخِيهِ إِلَّا فَكَّ اللهُ رِهَانَهُ يَوْمَ الْقِيَامَةِ وَرَوَاهُ عَبْدَةُ بْنُ عَبْدِ اللهِ الصَّفَّارُ عَنْ أَبِي نُعَيْمٍ الْفَضْلِ بْنِ دُكَيْنٍ أَتَمَّ مِنْ ذَلِكَ وَفِيهِ قَالَ يَا رَسُولَ اللهِ بَرِئَ مِنْ دَيْنِهِ وَأَنَا ضَامِنٌ لِمَا عَلَيْهِ وَرَوَاهُ زَافِرُ بْنُ سُلَيْمَانَ عَنِ الْوَصَّافِيِّ فَقَالَ عَلِيٌّ ؓ يَا نَبِيَّ اللهِ أَنَا ضَامِنٌ لِدَيْنِهِ وَالْحَدِيثُ يَدُورُ عَلَى عُبَيْدِ اللهِ الْوَصَّافِيِّ وَهُوَ ضَعِيفٌ جِدًّا وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ بِإِسْنَادٍ ضَعِيفٍ
[Machine] The Messenger of Allah, ﷺ , used to not ask about any aspect of a person's deeds when a funeral procession was brought to him, except to ask about their debt. If it was mentioned that the deceased had a debt, he would refrain from praying the funeral prayer for them. And if it was mentioned that they did not have a debt, he would pray the funeral prayer for them. Then, a funeral procession came and when he stood up, he asked his companions, "Does your companion have any debt?" They replied, "He has two dinars of debt." The Messenger of Allah, ﷺ , then righted himself and said, "Pray for your companion." Ali bin Abi Talib said, "O Messenger of Allah, I will take care of these two for him." So the Messenger of Allah, ﷺ , prayed the funeral prayer for him, then he said to Ali, "May Allah reward you with goodness. Allah has fulfilled your pledge as you fulfilled the pledge of your brother. There is no deceased person who dies with a debt, except that he is held captive by his debt. So whoever fulfills the debt of a deceased, Allah will fulfill his debt on the Day of Resurrection." Some of them said, "Is this specifically for Ali or for all Muslims?" He, ﷺ , replied, "No, it is for all Muslims. The narrations on the authority of Abu Qatadah concerning the responsibility for the debt of the deceased are more reliable, and Allah knows best."
كَانَ رَسُولُ اللهِ ﷺ إِذَا أُتِيَ بِجِنَازَةٍ لَمْ يَسْأَلْ عَنْ شَيْءٍ مِنْ عَمَلِ الرَّجُلِ إِلَّا أَنْ يَسْأَلَ عَنْ دَيْنِهِ فَإِنْ قِيلَ عَلَيْهِ دَيْنٌ كَفَّ عَنِ الصَّلَاةِ عَلَيْهِ وَإِنْ قِيلَ لَيْسَ عَلَيْهِ دَيْنٌ صَلَّى عَلَيْهِ فَأُتِيَ بِجِنَازَةٍ فَلَمَّا قَامَ سَأَلَ أَصْحَابَهُ هَلْ عَلَى صَاحِبِكُمْ مِنْ دَيْنٍ؟ قَالُوا عَلَيْهِ دِينَارَانِ دَيْنٌ فَعَدَلَ عَنْهُ رَسُولُ اللهِ ﷺ فَقَالَ صَلُّوا عَلَى صَاحِبِكُمْ فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ يَا نَبِيَّ اللهِ هُمَا عَلَيَّ بَرِئَ مِنْهُمَا فَتَقَدَّمَ رَسُولُ اللهِ ﷺ فَصَلَّى عَلَيْهِ ثُمَّ قَالَ يَا عَلِيُّ جَزَاكَ اللهُ خَيْرًا فَكَّ اللهُ رِهَانَكَ كَمَا فَكَكْتَ رِهَانَ أَخِيكَ إِنَّهُ لَيْسَ مِنْ مَيِّتٍ يَمُوتُ وَعَلَيْهِ دَيْنٌ إِلَّا وَهُوَ مُرْتَهَنٌ بِدَيْنِهِ فَمَنْ فَكَّ رِهَانَ مَيِّتٍ فَكَّ اللهُ رِهَانَهُ يَوْمَ الْقِيَامَةِ فَقَالَ بَعْضُهُمْ هَذَا لِعَلِيٍّ خَاصَّةً أَمْ لِلْمُسْلِمِينَ عَامَّةً؟ فَقَالَ لَا بَلْ لِلْمُسْلِمِينَ عَامَّةً عَطَاءُ بْنُ عَجْلَانَ ضَعِيفٌ وَالرِّوَايَاتُ فِي تَحَمُّلِ أَبِي قَتَادَةَ دَيْنَ الْمَيِّتِ أَصَحُّ وَاللهُ أَعْلَمُ
[Machine] I came to the Prophet ﷺ and asked him about begging. He said, "Begging is forbidden except in three cases: a man who carries a burden, in which case begging is permitted until he repays it and is able to sustain himself; a man who is struck by a calamity that destroys his wealth, in which case begging is permitted until he finds a means of livelihood or a way to support himself, and then he should stop begging; and a man who is in extreme need or poverty, in which case he should seek help from three wise people from his community, and if they confirm his situation, then begging is permitted for him. Anything other than these cases is considered unlawful."
أَتَيْتُ النَّبِيَّ ﷺ أَسْأَلُهُ فِي حَمَالَةٍ فَقَالَ إِنَّ الْمَسْأَلَةَ حُرِّمَتْ إِلَّا فِي ثَلَاثٍ رَجُلٍ تَحَمَّلَ بِحَمَالَةٍ حَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُؤَدِّيَهَا ثُمَّ يُمْسِكُ وَرَجُلٍ أَصَابَتْهُ جَائِحَةٌ فَاجْتَاحَتْ مَالَهُ حَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُصِيبَ قِوَامًا مِنْ عَيْشٍ أَوْ سِدَادًا مِنْ عَيْشٍ ثُمَّ لِيُمْسِكْ وَرَجُلٍ أَصَابَتْهُ حَاجَةٌ أَوْ فَاقَةٌ حَتَّى تَكَلَّمَ ثَلَاثَةٌ مِنْ ذَوِي الْحِلْمِ مِنْ قَوْمِهِ فَقَدْ حَلَّتْ لَهُ الْمَسْأَلَةُ وَمَا سِوَى ذَلِكَ مِنَ الْمَسْأَلَةِ فَهُوَ سُحْتٌ
19.2 [Machine] The phrase provided translates to "What is implied by the fact that guarantee does not transfer rights, but rather increases the position of the right, so that the owner of the property may claim both.
١٩۔٢ بَابُ مَا يُسْتَدَلُّ بِهِ عَلَى أَنَّ الضَّمَانَ لَا يَنْقِلُ الْحَقَّ بَلْ يَزِيدُ فِي مُحِلِّ الْحَقِّ فَيَكُونَ لِرَبِّ الْمَالِ أَنْ يَأْخُذَهُمَا وَكُلُّ وَاحِدٍ مِنْهُمَا
[Machine] Jabir said, "A man passed away, so we washed and shrouded him. Then we brought him to the Prophet ﷺ to pray upon him. He stepped over a line and asked, 'Does he owe anything?' We said, 'Yes, two dinars.' He then turned away and Abu Qatadah took responsibility for them. We went to the Prophet ﷺ and Abu Qatadah said, 'He owed two dinars to me.' The Prophet ﷺ said, 'The debt of the deceased has been taken care of by his good deeds, and the debtor is free from it.' Abu Qatadah said, 'Yes.' The Prophet ﷺ prayed upon him and then said, 'What did he do with the two dinars afterward?' They said, 'He died yesterday, so they came back to him as if it was tomorrow.' The Prophet ﷺ said, 'I have settled them.' Then the Messenger of Allah ﷺ informed us in this narration that his skin has become cold due to the fulfillment of the debt. And his statement, 'The debt of the deceased has been taken care of by his good deeds, and the debtor is free from it,' if it is confirmed that Ibn Aqil preserved it, then he has brought it forward. And Allah knows best. It is your responsibility as the creditor to demand payment from them alone if you wish, just as if he had a right over you from another aspect. And the deceased is free from it, and it is your responsibility to demand payment from him alone if you wish. And Allah knows best."
قَالَ جَابِرٌ تُوُفِّيَ رَجُلٌ فَغَسَّلْنَاهُ وَكَفَّنَّاهُ ثُمَّ أَتَيْنَا بِهِ النَّبِيَّ ﷺ لِيُصَلِّيَ عَلَيْهِ فَتَخَطَّى خُطًى ثُمَّ قَالَ عَلَيْهِ دَيْنٌ؟ قُلْنَا نَعَمْ دِينَارَانِ قَالَ فَانْصَرَفَ فَتَحَمَّلَهُمَا أَبُو قَتَادَةَ فَأَتَيْنَاهُ فَقَالَ أَبُو قَتَادَةَ ؓ الدِّينَارَانِ عَلَيَّ فَقَالَ النَّبِيُّ ﷺ حَقُّ الْغَرِيمِ وَبَرِئَ مِنْهُمَا الْمَيِّتُ قَالَ نَعَمْ قَالَ فَصَلَّى عَلَيْهِ فَقَالَ بَعْدَ ذَلِكَ بِيَوْمٍ مَا فَعَلَ الدِّينَارَانِ؟ فَقَالَ إِنَّمَا مَاتَ أَمْسِ فَعَادَ عَلَيْهِ كَالْغَدِ فَقَالَ قَدْ قَضَيْتُهُمَا فَقَالَ رَسُولُ اللهِ ﷺ الْآنَ بَرَدَتْ عَلَيْهِ جِلْدُهُ فَأَخْبَرَ ﷺ فِي هَذِهِ الرِّوَايَةِ أَنَّهُ بِالْقَضَاءِ بَرَدَ عَلَيْهِ جِلْدُهُ وَقَوْلُهُ حَقُّ الْغَرِيمِ وَبَرِئَ مِنْهُمَا الْمَيِّتُ إِنْ كَانَ حَفِظَهُ ابْنُ عَقِيلٍ فَإِنَّمَا عَنَى بِهِ وَاللهُ أَعْلَمُ لِلْغَرِيمِ مُطَالَبَتُكَ بِهِمَا وَحْدَكَ إِنْ شَاءَ كَمَا لَوْ كَانَ لَهُ عَلَيْكَ حَقٌّ مِنْ وَجْهٍ آخَرَ وَالْمَيِّتُ مِنْهُ بَرِيءٌ كَانَ لَهُ مُطَالَبَتُكَ بِهِ وَحْدَكَ إِنْ شَاءَ وَاللهُ أَعْلَمُ
[Machine] "By Allah, I will not leave you until you give me or provide me with someone who will bear it for me." He said, "By Allah, I do not have any wealth, and I do not find anyone who will bear it for me." So, he went to the Messenger of Allah ﷺ and said, "O Messenger of Allah, this is my obligation and I have been expecting it for one month, but he refuses until I fulfill it or bring someone who will bear it for me." So, I said, "By Allah, I do not find anyone who will bear it, and I do not have the means to fulfill it today." The Messenger of Allah ﷺ said to him, "Do you expect it for only one month?" He said, "No." He said, "Then I will bear it for you." The Messenger of Allah ﷺ took it and went. He brought him the amount he promised. The Messenger of Allah ﷺ said to him, "Where did you get this gold?" He said, "From a mine." He said, "Go, we have no need for it. It is not good." The Messenger of Allah ﷺ fulfilled it for him. In this, it is like an indication that the debt remains with him even after someone takes it until the extent of the waiting time is confirmed. Then, he voluntarily took on the debt and refrained from dealing with the wealth from the mine. Allah knows best. And it has been narrated from the Prophet ﷺ that he said, "The soul of the believer is suspended by his debt until it is fulfilled."
فَوَاللهِ لَا أُفَارِقُكَ حَتَّى تُعْطِيَنِي أَوْ تَأْتِيَ بِحَمِيلٍ يَتَحَمَّلُ عَنْكَ قَالَ وَاللهِ مَا عِنْدِي قَضَاءٌ وَمَا أَجِدُ مَنْ يَتَحَمَّلُ عَنِّي فَجَرَّهُ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ هَذَا لَزِمَنِي وَاسْتَنْظَرْتُهُ شَهْرًا وَاحِدًا فَأَبَى حَتَّى أَقْضِيَهُ أَوْ آتِيَهُ بِحَمِيلٍ فَقُلْتُ وَاللهِ مَا أَجِدُ حَمِيلًا وَلَا عِنْدِي قَضَاءٌ الْيَوْمَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ هَلْ تَسْتَنْظِرُهُ إِلَّا شَهْرًا وَاحِدًا؟ قَالَ لَا قَالَ فَأَنَا أَتَحَمَّلُ بِهَا عَنْكَ فَتَحَمَّلَ بِهَا رَسُولُ اللهِ ﷺ فَذَهَبَ الرَّجُلُ فَأَتَاهُ بِقَدْرِ مَا وَعَدَهُ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ مِنْ أَيْنَ جِئْتَ بِهَذَا الذَّهَبِ؟ قَالَ مِنْ مَعْدِنٍ قَالَ اذْهَبْ فَلَا حَاجَةَ لَنَا فِيهَا؛ لَيْسَ فِيهَا خَيْرٌ قَالَ فَقَضَاهَا عَنْهُ رَسُولُ اللهِ ﷺ وَفِي هَذَا كَالدَّلَالَةِ عَلَى أَنَّ الْحَقَّ بَقِيَ فِي ذِمَّتِهِ بَعْدَ التَّحَمُّلِ حَتَّى أَكَّدَ عَلَيْهِ مِقْدَارَ الِاسْتِنْظَارِ ثُمَّ إِنَّهُ ﷺ تَطَوَّعَ بِالْقَضَاءِ عَنْهُ وَتَنَزَّهَ عَنِ التَّصَرُّفِ فِي مَالِ الْمَعْدِنِ وَاللهُ أَعْلَمُ وَقَدْ رُوِّينَا عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ نَفْسُ الْمُؤْمِنِ مُعَلَّقَةٌ بِدَيْنِهِ حَتَّى يُقْضَى عَنْهُ
19.3 [Machine] Return of the guarantor on the insured against what he paid and guaranteed by his order
١٩۔٣ بَابُ رُجُوعِ الضَّامِنِ عَلَى الْمَضْمُونِ عَنْهُ بِمَا غَرِمَ وَضَمِنَ بِأَمْرِهِ
[Machine] The Messenger of Allah ﷺ came to me while he was slightly unwell and had a severe headache. His head was tied with a cloth. He said, "Hold my hand, O Fadl." So I held his hand until he sat on the pulpit. Then he mentioned a speech until he said, "Whoever I owe money to, this is my wealth, let him take from it." A man stood up and said, "O Messenger of Allah, I have three dirhams with you." He said, "As for me, I do not deny someone's claim nor do I swear falsely. What was it used for?" He said, "Do you not remember that a beggar passed by you and you ordered me to give him three dirhams?" He said, "Give it to him, O Fadl."
أَتَانِي رَسُولُ اللهِ ﷺ وَهُوَ يُوعَكُ وَعْكًا شَدِيدًا وَقَدْ عَصَبَ رَأْسَهُ فَقَالَ خُذْ بِيَدِي يَا فَضْلُ فَأَخَذْتُ بِيَدِهِ حَتَّى قَعَدَ عَلَى الْمِنْبَرِ ثُمَّ قَالَ فَذَكَرَ الْحَدِيثَ إِلَى أَنْ قَالَ مَنْ قَدْ كُنْتُ أَخَذْتُ لَهُ مَالًا فَهَذَا مَالِي فَلْيَأْخُذْ مِنْهُ فَقَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ إِنَّ لِي عِنْدَكَ ثَلَاثَةَ دَرَاهِمَ فَقَالَ أَمَّا أَنَا فَلَا أُكَذِّبُ قَائِلًا وَلَا أَسْتَحْلِفُ عَلَى يَمِينٍ فِيمَ كَانَتْ لَكَ عِنْدِي؟ قَالَ أَمَا تَذْكُرُ أَنَّهُ مَرَّ بِكَ سَائِلٌ فَأَمَرْتَنِي فَأَعْطَيْتُهُ ثَلَاثَةَ دَرَاهِمَ؟ قَالَ أَعْطِهِ يَا فَضْلُ
19.4 [Machine] Guarantee for the deceased
١٩۔٤ بَابُ الضَّمَانِ عَنِ الْمَيِّتِ
[Machine] The Messenger of Allah ﷺ was brought a funeral, and they said, "O Prophet of Allah, pray upon him." He said, "Did he leave anything behind?" They said, "No." He said, "Did he leave any debt behind?" They said, "No." He then prayed for him. Then another funeral was brought, and they said, "O Prophet of Allah, pray upon him." He said, "Did he leave any debt behind?" They said, "Yes." He said, "Did he leave anything behind?" They said, "No." He said, "Pray for your companion." Abu Qatadah said, "O Prophet of Allah, his debt is upon me." So he prayed for him.
أُتِيَ رَسُولُ اللهِ ﷺ بِجِنَازَةٍ فَقَالُوا يَا نَبِيَّ اللهِ صَلِّ عَلَيْهَا قَالَ هَلْ تَرَكَ مِنْ شَيْءٍ؟ قَالُوا لَا قَالَ هَلْ تَرَكَ مِنْ دَيْنٍ؟ قَالُوا لَا قَالَ فَصَلَّى عَلَيْهَا ثُمَّ أُتِيَ بِجِنَازَةٍ فَقَالُوا يَا نَبِيَّ اللهِ صَلِّ عَلَيْهَا قَالَ هَلْ تَرَكَ مِنْ دَيْنٍ؟ قَالُوا نَعَمْ أَوْ قَالُوا لَا قَالَ فَهَلْ تَرَكَ مِنْ شَيْءٍ؟ قَالُوا ثَلَاثَةَ دَنَانِيرَ قَالَ ثَلَاثَ كَيَّاتٍ قَالَ هَكَذَا بِيَدِهِ ثُمَّ أُتِيَ بِجِنَازَةٍ أُخْرَى فَقِيلَ يَا نَبِيَّ اللهِ صَلِّ عَلَيْهَا قَالَ هَلْ تَرَكَ مِنْ دَيْنٍ؟ قَالُوا نَعَمْ قَالَ هَلْ تَرَكَ مِنْ شَيْءٍ؟ قَالُوا لَا قَالَ صَلُّوا عَلَى صَاحِبِكُمْ قَالَ أَبُو قَتَادَةَ يَا نَبِيَّ اللهِ عَلَيَّ دَيْنُهُ قَالَ فَصَلَّى عَلَيْهِ
[Machine] Jabir said, "A man passed away, so we washed him, perfumed him, and shrouded him. Then we went to the Prophet ﷺ and asked him, 'Should we offer the funeral prayer for him?' He stood up and took a few steps, then asked, 'Does he owe anything?' It was said, 'Two dinars.' He then turned away. Abu Qatadah offered to pay the debt, and we went after the Prophet ﷺ. Abu Qatadah said, 'I owe two dinars on his behalf.' The Prophet ﷺ declared, 'The debt is discharged and the deceased is free from it.' He then prayed for him, and after that, he asked him, 'What happened to the two dinars?' He replied, 'He actually passed away yesterday.' The Prophet ﷺ, as if he had returned after a day, said, 'You have actually settled both of them now.' The skin of his face brightened with joy."
قَالَ جَابِرٌ تُوُفِّيَ رَجُلٌ فَغَسَّلْنَاهُ وَحَنَّطْنَاهُ وَكَفَّنَّاهُ ثُمَّ أَتَيْنَا النَّبِيَّ ﷺ فَقُلْنَا لَهُ تُصَلِّي عَلَيْهِ؟ فَقَامَ فَخَطَا خُطًى ثُمَّ قَالَ عَلَيْهِ دَيْنٌ؟ قَالَ فَقِيلَ دِينَارَانِ قَالَ فَانْصَرَفَ قَالَ فَتَحَمَّلَهُمَا أَبُو قَتَادَةَ قَالَ فَأَتَيْنَاهُ قَالَ فَقَالَ أَبُو قَتَادَةَ الدِّينَارَانِ عَلَيَّ فَقَالَ النَّبِيُّ ﷺ حَقُّ الْغَرِيمِ وَبَرِئَ مِنْهُمَا الْمَيِّتُ قَالَ نَعَمْ فَصَلَّى عَلَيْهِ رَسُولُ اللهِ ﷺ قَالَ فَقَالَ لَهُ بَعْدَ ذَلِكَ بِيَوْمٍ مَا فَعَلَ الدِّينَارَانِ؟ قَالَ إِنَّمَا مَاتَ أَمْسِ قَالَ فَعَادَ إِلَيْهِ كَالْغَدِ قَالَ قَدْ قَضَيْتُهُمَا فَقَالَ النَّبِيُّ ﷺ الْآنَ بَرَدَتْ عَلَيْهِ جِلْدُهُ
[Machine] Narrated by Abu Al-Walid Al-Tayalisi from Isa, he said, "A man died, and the Messenger of Allah ﷺ came to him. We said, 'O Messenger of Allah, should we offer prayer for him?' He said, 'Does he owe anyone debt?' We said, 'Yes.' He said, 'Has he left someone to guarantee payment?' We said, 'No.' He said, 'What will benefit you to offer prayer for a man who is burdened by debt in his grave until Allah resurrects him on the Day of Judgment and holds him accountable?' "
حَدِّثْنَا حَدِيثًا سَمِعْتَهُ مِنْ رَسُولِ اللهِ ﷺ يَنْفَعُنَا اللهُ بِهِ قَالَ مَاتَ رَجُلٌ فَجَاءَ رَسُولُ اللهِ ﷺ فَقُلْنَا يَا رَسُولَ اللهِ أَتُصَلِّي عَلَيْهِ؟ فَقَالَ هَلْ عَلَيْهِ دَيْنٌ؟ قُلْنَا نَعَمْ قَالَ أَفَيَضْمَنُهُ مِنْكُمْ أَحَدٌ حَتَّى أُصَلِّيَ عَلَيْهِ؟ قَالُوا لَا قَالَ فَمَا يَنْفَعُكُمْ أَنْ أُصَلِّيَ عَلَى رَجُلٍ مُرْتَهَنٍ فِي قَبْرِهِ حَتَّى يَبْعَثَهُ اللهُ يَوْمَ الْقِيَامَةِ فَيُحَاسِبَهُ؟ وَرَوَاهُ أَبُو الْوَلِيدِ الطَّيَالِسِيُّ عَنْ عِيسَى فَأَدْخَلَ بَيْنَهُ وَبَيْنَ أَنَسِ بْنِ مَالِكٍ عَبْدَ الْحَمِيدِ بْنَ أَبِي أُمَيَّةَ
[Machine] There was a man who said to Abu Hamzah, "If you were to tell us a hadith that Allah may benefit us with." He said, "Whoever among you is able to die without any debt, then let him do so. For I have witnessed the Messenger of Allah ﷺ perform the funeral prayer for a man and he asked, 'Does he have any debt?' They replied, 'Yes.' He then said, 'What benefit is there for me to pray for a person whose soul is still bound in his grave and cannot ascend to Allah? If a man's debt is guaranteed, I get up and perform the funeral prayer for him.' So, my prayer is beneficial for him."
لَهُ رَجُلٌ يَا أَبَا حَمْزَةَ لَوْ حَدَّثْتَنَا حَدِيثًا عَسَى اللهُ أَنْ يَنْفَعَنَا بِهِ قَالَ مَنِ اسْتَطَاعَ مِنْكُمْ أَنْ يَمُوتَ وَلَيْسَ عَلَيْهِ دَيْنٌ فَلْيَفْعَلْ؛ فَإِنِّي شَهِدْتُ رَسُولَ اللهِ ﷺ وَأُتِيَ بِجِنَازَةِ رَجُلٍ لِيُصَلِّيَ عَلَيْهِ فَقَالَ عَلَيْهِ دَيْنٌ؟ قَالُوا نَعَمْ قَالَ فَمَا يَنْفَعُهُ أَنْ أُصَلِّيَ عَلَى رَجُلٍ رُوحُهُ مُرْتَهَنٌ فِي قَبْرِهِ لَا تَصْعَدُ رُوحُهُ إِلَى اللهِ فَلَوْ ضَمِنَ رَجُلٌ دَيْنَهُ قُمْتُ فَصَلَّيْتُ عَلَيْهِ؛ فَإِنَّ صَلَاتِي تَنْفَعُهُ 11408 أَخْبَرَنَا أَبُو بَكْرٍ الْفَارِسِيُّ أَنْبَأَ إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ الْأَصْفَهَانِيُّ أَنْبَأَ أَبُو أَحْمَدَ بْنُ فَارِسٍ قَالَ قَالَ الْبُخَارِيُّ قَالَ أَبُو الْوَلِيدِ هُوَ ضَعِيفٌ يَعْنِي عِيسَى بْنَ صَدَقَةَ هَذَا وَخَالَفَهُمَا عُبَيْدُ اللهِ بْنُ مُوسَى فَقَالَ صَدَقَةُ بْنُ عِيسَى وَوَافَقَ يُونُسَ فِي ذِكْرِ سَمَاعِهِ مِنْ أَنَسٍ
[Machine] I heard Anas say that the Prophet ﷺ was brought a man who had died, and the Prophet ﷺ asked if the man had any debts. They said yes. The Prophet ﷺ then said, "If you guarantee his debt, I will pray for him." Al-Bukhari also narrated this, and Abu Dawood narrated it from the report of Sadaqah Abu Muhriz, who heard it from Anas.
سَمِعْتُ أَنَسًا يَقُولُ أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ يُصَلِّي عَلَيْهِ فَقَالَ عَلَيْهِ دَيْنٌ؟ قَالُوا نَعَمْ قَالَ إِنْ ضَمِنْتُمْ دَيْنَهُ صَلَّيْتُ عَلَيْهِ قَالَ الْبُخَارِيُّ وَقَالَ أَبُو دَاوُدَ ثنا صَدَقَةُ أَبُو مُحْرِزٍ سَمِعَ أَنَسًا
[Machine] The Messenger of Allah ﷺ prayed one day. When he finished, he said, "Is there anyone from the tribe of so-and-so here?" The people remained silent, as they usually did when he began with something. Then he said, "Is there anyone from the tribe of so-and-so here?" A man said, "This is so-and-so." He said, "Your companion has been detained at the gates of Paradise due to a debt he owed." A man said, "I will pay off his debt." And he fulfilled it with its intended meaning.
صَلَّى رَسُولُ اللهِ ﷺ ذَاتَ يَوْمٍ فَلَمَّا أَقْبَلَ قَالَ هَا هُنَا مِنْ بَنِي فُلَانٍ أَحَدٌ؟ فَسَكَتَ الْقَوْمُ وَكَانَ إِذَا ابْتَدَأَهُمْ بِشَيْءٍ سَكَتُوا ثُمَّ قَالَ هَا هُنَا مِنْ بَنِي فُلَانٍ أَحَدٌ؟ فَقَالَ رَجُلٌ هَذَا فُلَانٌ فَقَالَ أَمَا إِنَّ صَاحِبَكُمْ قَدْ حُبِسَ عَلَى بَابِ الْجَنَّةِ بِدَيْنٍ كَانَ عَلَيْهِ فَقَالَ رَجُلٌ عَلَيَّ دَيْنُهُ فَقَضَاهُ وَبِمَعْنَاهُ
“The soul of the believer is attached to his debt until it is paid off.” (Using translation from Ibn Mājah 2413)
قَالَ رَسُولُ اللهِ ﷺ نَفْسُ الْمُؤْمِنِ مُعَلَّقَةٌ بِدَيْنِهِ حَتَّى يُقْضَى عَنْهُ
[Machine] The Messenger of Allah ﷺ said, "The soul of the believer remains suspended as long as there is a debt upon him."
قَالَ رَسُولُ اللهِ ﷺ نَفْسُ الْمُؤْمِنِ مُعَلَّقَةٌ مَا كَانَ عَلَيْهِ دَيْنٌ
19.5 [Machine] What is included in the guarantee in terms of a person who has a right?
١٩۔٥ بَابُ مَا جَاءَ فِي الْكَفَالَةِ بِبَدَنِ مَنْ عَلَيْهِ حَقٌّ
The Prophet ﷺ said, "An Israeli man asked another Israeli to lend him one thousand Dinars. The second man required witnesses. The former replied, 'Allah is sufficient as a witness.' The second said, 'I want a surety.' The former replied, 'Allah is sufficient as a surety.' The second said, 'You are right,' and lent him the money for a certain period. The debtor went across the sea. When he finished his job, he searched for a conveyance so that he might reach in time for the repayment of the debt, but he could not find any. So, he took a piece of wood and made a hole in it, inserted in it one thousand Dinars and a letter to the lender and then closed (i.e. sealed) the hole tightly. He took the piece of wood to the sea and said. 'O Allah! You know well that I took a loan of one thousand Dinars from so-and-so. He demanded a surety from me but I told him that Allah's Guarantee was sufficient and he accepted Your guarantee. He then asked for a witness and I told him that Allah was sufficient as a Witness, and he accepted You as a Witness. No doubt, I tried hard to find a conveyance so that I could pay his money but could not find, so I hand over this money to You.' Saying that, he threw the piece of wood into the sea till it went out far into it, and then he went away. Meanwhile he started searching for a conveyance in order to reach the creditor's country. One day the lender came out of his house to see whether a ship had arrived bringing his money, and all of a sudden he saw the piece of wood in which his money had been deposited. He took it home to use for fire. When he sawed it, he found his money and the letter inside it. Shortly after that, the debtor came bringing one thousand Dinars to him and said, 'By Allah, I had been trying hard to get a boat so that I could bring you your money, but failed to get one before the one I have come by.' The lender asked, 'Have you sent something to me?' The debtor replied, 'I have told you I could not get a boat other than the one I have come by.' The lender said, 'Allah has delivered on your behalf the money you sent in the piece of wood. So, you may keep your one thousand Dinars and depart guided on the right path.' عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ ذَكَرَ أَنَّ رَجُلًا مِنْ بَنِي إِسْرَائِيلَ سَأَلَ بَعْضَ بَنِي إِسْرَائِيلَ أَنْ يُسْلِفَهُ أَلْفَ دِينَارٍ قَالَ ائْتِنِي بِالشُّهُودِ أُشْهِدْهُمْ عَلَيْكَ قَالَ كَفَى بِاللهِ شَهِيدًا قَالَ فَأْتِنِي بِكَفِيلٍ قَالَ كَفَى بِاللهِ كَفِيلًا قَالَ فَدَفَعَهَا إِلَيْهِ إِلَى أَجَلٍ مُسَمًّى قَالَ فَخَرَجَ فِي الْبَحْرِ وَقَضَى حَاجَتَهُ ثُمَّ الْتَمَسَ مَرْكَبًا يَقْدَمُ عَلَيْهِ لِلْأَجَلِ الَّذِي أَجَّلَهُ فَلَمْ يَجِدْ مَرْكَبًا فَأَخَذَ خَشَبَةً فَنَقَرَهَا فَأَدْخَلَ فِيهَا الدَّنَانِيرَ وَصَحِيفَةً مِنْهُ إِلَى صَاحِبِهَا ثُمَّ سَدَّ مَوْضِعَهَا ثُمَّ أَتَى بِهَا الْبَحْرَ فَقَالَ اللهُمَّ إِنَّكَ تَعْلَمُ أَنِّي تَسَلَّفْتُ مِنْ فُلَانٍ أَلْفَ دِينَارٍ وَسَأَلَنِي كَفِيلًا فَقُلْتُ كَفَى بِاللهِ كَفِيلًا فَرَضِيَ بِكَ وَسَأَلَنِي شُهُودًا فَقُلْتُ كَفَى بِاللهِ شَهِيدًا فَرَضِيَ بِكَ وَقَدْ جَهِدْتُ أَنْ أَجِدَ مَرْكَبًا أَبْعَثُ إِلَيْهِ الَّذِي لَهُ فَلَمْ أَجِدْ مَرْكَبًا وَإِنِّي أَسْتَوْدِعُكَهَا فَرَمَى بِهَا فِي الْبَحْرِ حَتَّى وَلَجَتْ فِيهِ ثُمَّ انْصَرَفَ وَهُوَ فِي ذَلِكَ يَطْلُبُ مَرْكَبًا يَخْرُجُ إِلَى بَلَدِهِ فَخَرَجَ الرَّجُلُ الَّذِي كَانَ سَلَّفَهُ رَجَاءَ أَنْ يَكُونَ مَرْكَبٌ قَدْ جَاءَ بِمَالِهِ وَإِذَا هُوَ بِالْخَشَبَةِ فَأَخَذَهَا لِأَهْلِهِ حَطَبًا فَلَمَّا كَسَرَهَا وَجَدَ الْمَالَ وَالصَّحِيفَةَ ثُمَّ قَدِمَ الرَّجُلُ فَأَتَاهُ بِأَلْفِ دِينَارٍ فَقَالَ وَاللهِ مَا زِلْتُ جَاهِدًا فِي طَلَبِ مَرْكَبٍ لِآتِيَكَ بِمَالِكَ فَمَا وَجَدْتُ مَرْكَبًا قَبْلَ الَّذِي أَتَيْتُ فِيهِ فَقَالَ هَلْ كُنْتَ بَعَثْتَ إِلِيَّ بِشَيْءٍ؟ قَالَ نَعَمْ فَإِنَّ اللهَ ﷻ قَدْ أَدَّى عَنْكَ فَانْصَرِفْ بِالْأَلْفِ دِينَارٍ رَاشِدًا
[Machine] That the Messenger of Allah ﷺ detained a man on charges, and he said another time that he took a guarantor from an accused person for stability and precaution, Ibrahim ibn Khuthaym is weak.
أَنَّ رَسُولَ اللهِ ﷺ حَبَسَ رَجُلًا فِي تُهْمَةٍ وَقَالَ مَرَّةً أُخْرَى أَخَذَ مِنْ مُتَّهَمٍ كَفِيلًا تَثَبُّتًا وَاحْتِيَاطًا إِبْرَاهِيمُ بْنُ خُثَيْمٍ ضَعِيفٌ
[Machine] That Umar sent him as a trustworthy individual and a man fell on the wife of another man, so Hamzah took custody of the man until he came to Umar, and Umar had already whipped him a hundred times, but he believed them and excused him due to ignorance.
أَنَّ عُمَرَ ؓ بَعَثَهُ مُصَدِّقًا فَوَقَعَ رَجُلٌ عَلَى جَارِيَةِ امْرَأَتِهِ فَأَخَذَ حَمْزَةُ مِنَ الرَّجُلِ كُفَلَاءَ حَتَّى قَدِمَ عَلَى عُمَرَ وَكَانَ عُمَرُ قَدْ جَلَدَهُ مِائَةً فَصَدَّقَهُمْ وَعَذَرَهُ بِالْجَهَالَةِ
[Machine] The testimony of a man is not valid as evidence against another man in matters of punishment or guarantee. It has also been narrated from Shurayh, Masrooq, and Ibrahim. A hadith with a weak chain of narration has also been narrated on this matter.
لَا تَجُوزُ شَهَادَةُ الرَّجُلِ عَلَى شَهَادَةِ الرَّجُلِ فِي حَدٍّ وَلَا كَفَالَةَ فِي حَدٍّ وَرُوِّينَاهُ أَيْضًا عَنْ شُرَيْحٍ وَمَسْرُوقٍ وَإِبْرَاهِيمَ وَرُوِيَ فِيهِ حَدِيثٌ بِإِسْنَادٍ ضَعِيفٍ
[Machine] The Prophet (saws) said: "There is no guarantee in a punishment." Abu Ahmad Umar ibn Abu Umar al-Dimashqi, a person known for rejecting unreliable narrations, said that the sheikh, referring to himself, mentioned this alone, while the rest of the information is from Abu Muhammad Umar ibn Abu Umar al-Kala'iyyi, who is among the unknown scholars and his narrations are unreliable. أَنَّ النَّبِيَّ ﷺ قَالَ لَا كَفَالَةَ فِي حَدٍّ قَالَ أَبُو أَحْمَدَ عُمَرُ بْنُ أَبِي عُمَرَ الدِّمَشْقِيُّ مُنْكَرُ الْحَدِيثِ عَنِ الثِّقَاتِ قَالَ الشَّيْخُ تَفَرَّدَ بِهِ بَقِيَّةُ عَنْ أَبِي مُحَمَّدٍ عُمَرَ بْنِ أَبِي عُمَرَ الْكَلَاعِيِّ وَهُوَ مِنْ مَشَايِخِ بَقِيَّةَ الْمَجْهُولِينَ وَرِوَايَاتُهُ مُنْكَرَةٌ وَاللهُ أَعْلَمُ
[Machine] A man disputed with the son of Shurayh and entrusted him with a man who owed him money. Shurayh imprisoned him. When night came, he said to him, "Go to Abdullah with a bed and food." And his son was named Abdullah.
خَاصَمَ رَجُلٌ ابْنًا لِشُرَيْحٍ إِلَى شُرَيْحٍ كَفَلَ لَهُ بِرَجُلٍ عَلَيْهِ دَيْنٌ فَحَبَسَهُ شُرَيْحٌ فَلَمَّا كَانَ اللَّيْلُ قَالَ اذْهَبْ إِلَى عَبْدِ اللهِ بِفِرَاشٍ وَطَعَامٍ وَكَانَ ابْنُهُ يُسَمَّى عَبْدَ اللهِ
[Machine] About al-Hakam and Hammad, they said regarding a man who took responsibility for another man's life, and then the man died. One of them said, "He is liable for the debts," and the other said, "He is not responsible for anything."
عَنِ الْحَكَمِ وَحَمَّادٍ أَنَّهُمَا قَالَا فِي رَجُلٍ تَكَفَّلَ بِنَفْسِ رَجُلٍ فَمَاتَ الرَّجُلُ قَالَ أَحَدُهُمَا يَضْمَنُ الدَّرَاهِمَ وَقَالَ الْآخَرُ لَيْسَ عَلَيْهِ شَيْءٌ
