19. Chapter
١٩۔ كِتَابُ الضَّمَانِ
The Prophet ﷺ said, "An Israeli man asked another Israeli to lend him one thousand Dinars. The second man required witnesses. The former replied, 'Allah is sufficient as a witness.' The second said, 'I want a surety.' The former replied, 'Allah is sufficient as a surety.' The second said, 'You are right,' and lent him the money for a certain period. The debtor went across the sea. When he finished his job, he searched for a conveyance so that he might reach in time for the repayment of the debt, but he could not find any. So, he took a piece of wood and made a hole in it, inserted in it one thousand Dinars and a letter to the lender and then closed (i.e. sealed) the hole tightly. He took the piece of wood to the sea and said. 'O Allah! You know well that I took a loan of one thousand Dinars from so-and-so. He demanded a surety from me but I told him that Allah's Guarantee was sufficient and he accepted Your guarantee. He then asked for a witness and I told him that Allah was sufficient as a Witness, and he accepted You as a Witness. No doubt, I tried hard to find a conveyance so that I could pay his money but could not find, so I hand over this money to You.' Saying that, he threw the piece of wood into the sea till it went out far into it, and then he went away. Meanwhile he started searching for a conveyance in order to reach the creditor's country. One day the lender came out of his house to see whether a ship had arrived bringing his money, and all of a sudden he saw the piece of wood in which his money had been deposited. He took it home to use for fire. When he sawed it, he found his money and the letter inside it. Shortly after that, the debtor came bringing one thousand Dinars to him and said, 'By Allah, I had been trying hard to get a boat so that I could bring you your money, but failed to get one before the one I have come by.' The lender asked, 'Have you sent something to me?' The debtor replied, 'I have told you I could not get a boat other than the one I have come by.' The lender said, 'Allah has delivered on your behalf the money you sent in the piece of wood. So, you may keep your one thousand Dinars and depart guided on the right path.' عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ ذَكَرَ أَنَّ رَجُلًا مِنْ بَنِي إِسْرَائِيلَ سَأَلَ بَعْضَ بَنِي إِسْرَائِيلَ أَنْ يُسْلِفَهُ أَلْفَ دِينَارٍ قَالَ ائْتِنِي بِالشُّهُودِ أُشْهِدْهُمْ عَلَيْكَ قَالَ كَفَى بِاللهِ شَهِيدًا قَالَ فَأْتِنِي بِكَفِيلٍ قَالَ كَفَى بِاللهِ كَفِيلًا قَالَ فَدَفَعَهَا إِلَيْهِ إِلَى أَجَلٍ مُسَمًّى قَالَ فَخَرَجَ فِي الْبَحْرِ وَقَضَى حَاجَتَهُ ثُمَّ الْتَمَسَ مَرْكَبًا يَقْدَمُ عَلَيْهِ لِلْأَجَلِ الَّذِي أَجَّلَهُ فَلَمْ يَجِدْ مَرْكَبًا فَأَخَذَ خَشَبَةً فَنَقَرَهَا فَأَدْخَلَ فِيهَا الدَّنَانِيرَ وَصَحِيفَةً مِنْهُ إِلَى صَاحِبِهَا ثُمَّ سَدَّ مَوْضِعَهَا ثُمَّ أَتَى بِهَا الْبَحْرَ فَقَالَ اللهُمَّ إِنَّكَ تَعْلَمُ أَنِّي تَسَلَّفْتُ مِنْ فُلَانٍ أَلْفَ دِينَارٍ وَسَأَلَنِي كَفِيلًا فَقُلْتُ كَفَى بِاللهِ كَفِيلًا فَرَضِيَ بِكَ وَسَأَلَنِي شُهُودًا فَقُلْتُ كَفَى بِاللهِ شَهِيدًا فَرَضِيَ بِكَ وَقَدْ جَهِدْتُ أَنْ أَجِدَ مَرْكَبًا أَبْعَثُ إِلَيْهِ الَّذِي لَهُ فَلَمْ أَجِدْ مَرْكَبًا وَإِنِّي أَسْتَوْدِعُكَهَا فَرَمَى بِهَا فِي الْبَحْرِ حَتَّى وَلَجَتْ فِيهِ ثُمَّ انْصَرَفَ وَهُوَ فِي ذَلِكَ يَطْلُبُ مَرْكَبًا يَخْرُجُ إِلَى بَلَدِهِ فَخَرَجَ الرَّجُلُ الَّذِي كَانَ سَلَّفَهُ رَجَاءَ أَنْ يَكُونَ مَرْكَبٌ قَدْ جَاءَ بِمَالِهِ وَإِذَا هُوَ بِالْخَشَبَةِ فَأَخَذَهَا لِأَهْلِهِ حَطَبًا فَلَمَّا كَسَرَهَا وَجَدَ الْمَالَ وَالصَّحِيفَةَ ثُمَّ قَدِمَ الرَّجُلُ فَأَتَاهُ بِأَلْفِ دِينَارٍ فَقَالَ وَاللهِ مَا زِلْتُ جَاهِدًا فِي طَلَبِ مَرْكَبٍ لِآتِيَكَ بِمَالِكَ فَمَا وَجَدْتُ مَرْكَبًا قَبْلَ الَّذِي أَتَيْتُ فِيهِ فَقَالَ هَلْ كُنْتَ بَعَثْتَ إِلِيَّ بِشَيْءٍ؟ قَالَ نَعَمْ فَإِنَّ اللهَ ﷻ قَدْ أَدَّى عَنْكَ فَانْصَرِفْ بِالْأَلْفِ دِينَارٍ رَاشِدًا
[Machine] That the Messenger of Allah ﷺ detained a man on charges, and he said another time that he took a guarantor from an accused person for stability and precaution, Ibrahim ibn Khuthaym is weak.
أَنَّ رَسُولَ اللهِ ﷺ حَبَسَ رَجُلًا فِي تُهْمَةٍ وَقَالَ مَرَّةً أُخْرَى أَخَذَ مِنْ مُتَّهَمٍ كَفِيلًا تَثَبُّتًا وَاحْتِيَاطًا إِبْرَاهِيمُ بْنُ خُثَيْمٍ ضَعِيفٌ
[Machine] That Umar sent him as a trustworthy individual and a man fell on the wife of another man, so Hamzah took custody of the man until he came to Umar, and Umar had already whipped him a hundred times, but he believed them and excused him due to ignorance.
أَنَّ عُمَرَ ؓ بَعَثَهُ مُصَدِّقًا فَوَقَعَ رَجُلٌ عَلَى جَارِيَةِ امْرَأَتِهِ فَأَخَذَ حَمْزَةُ مِنَ الرَّجُلِ كُفَلَاءَ حَتَّى قَدِمَ عَلَى عُمَرَ وَكَانَ عُمَرُ قَدْ جَلَدَهُ مِائَةً فَصَدَّقَهُمْ وَعَذَرَهُ بِالْجَهَالَةِ
[Machine] The testimony of a man is not valid as evidence against another man in matters of punishment or guarantee. It has also been narrated from Shurayh, Masrooq, and Ibrahim. A hadith with a weak chain of narration has also been narrated on this matter.
لَا تَجُوزُ شَهَادَةُ الرَّجُلِ عَلَى شَهَادَةِ الرَّجُلِ فِي حَدٍّ وَلَا كَفَالَةَ فِي حَدٍّ وَرُوِّينَاهُ أَيْضًا عَنْ شُرَيْحٍ وَمَسْرُوقٍ وَإِبْرَاهِيمَ وَرُوِيَ فِيهِ حَدِيثٌ بِإِسْنَادٍ ضَعِيفٍ
[Machine] The Prophet (saws) said: "There is no guarantee in a punishment." Abu Ahmad Umar ibn Abu Umar al-Dimashqi, a person known for rejecting unreliable narrations, said that the sheikh, referring to himself, mentioned this alone, while the rest of the information is from Abu Muhammad Umar ibn Abu Umar al-Kala'iyyi, who is among the unknown scholars and his narrations are unreliable. And Allah knows best.
أَنَّ النَّبِيَّ ﷺ قَالَ لَا كَفَالَةَ فِي حَدٍّ قَالَ أَبُو أَحْمَدَ عُمَرُ بْنُ أَبِي عُمَرَ الدِّمَشْقِيُّ مُنْكَرُ الْحَدِيثِ عَنِ الثِّقَاتِ قَالَ الشَّيْخُ تَفَرَّدَ بِهِ بَقِيَّةُ عَنْ أَبِي مُحَمَّدٍ عُمَرَ بْنِ أَبِي عُمَرَ الْكَلَاعِيِّ وَهُوَ مِنْ مَشَايِخِ بَقِيَّةَ الْمَجْهُولِينَ وَرِوَايَاتُهُ مُنْكَرَةٌ وَاللهُ أَعْلَمُ
[Machine] A man disputed with the son of Shurayh and entrusted him with a man who owed him money. Shurayh imprisoned him. When night came, he said to him, "Go to Abdullah with a bed and food." And his son was named Abdullah.
خَاصَمَ رَجُلٌ ابْنًا لِشُرَيْحٍ إِلَى شُرَيْحٍ كَفَلَ لَهُ بِرَجُلٍ عَلَيْهِ دَيْنٌ فَحَبَسَهُ شُرَيْحٌ فَلَمَّا كَانَ اللَّيْلُ قَالَ اذْهَبْ إِلَى عَبْدِ اللهِ بِفِرَاشٍ وَطَعَامٍ وَكَانَ ابْنُهُ يُسَمَّى عَبْدَ اللهِ
[Machine] About al-Hakam and Hammad, they said regarding a man who took responsibility for another man's life, and then the man died. One of them said, "He is liable for the debts," and the other said, "He is not responsible for anything."
عَنِ الْحَكَمِ وَحَمَّادٍ أَنَّهُمَا قَالَا فِي رَجُلٍ تَكَفَّلَ بِنَفْسِ رَجُلٍ فَمَاتَ الرَّجُلُ قَالَ أَحَدُهُمَا يَضْمَنُ الدَّرَاهِمَ وَقَالَ الْآخَرُ لَيْسَ عَلَيْهِ شَيْءٌ
