[Machine] The Messenger of Allah ﷺ and us, his companions, performed Hajj together until we reached Mecca on the morning of the fourth day of Dhul-Hijjah. We made tawaf (circumambulation) around the Kaaba, and performed sa'i (walking) between Safa and Marwa. Then the Messenger of Allah ﷺ commanded those who did not bring a sacrificial animal to perform hajj to do so. He did not give any specific instructions concerning women. Jabir (may Allah be pleased with him) said, "We waited until there were only five nights left between us and Arafah. Then the Messenger of Allah ﷺ commanded us to enter ihram (sacral state) and go to Arafah, while the sweat was dripping from our foreheads, and he himself had already performed the sa'i." Jabir (may Allah be pleased with him) continued, "So, we realized the command of the Messenger of Allah ﷺ and he stood up to address the people. He praised and thanked Allah and then mentioned what he had heard from the people. He said, 'You know that I am the most righteous among you, the most truthful, and the most sincere to Allah. If I had not sacrificed the sacrificial animal, I would have taken off ihram even if there was a matter that I wanted to proceed with and not completed it.' Jabir bin Abdullah said, 'We heard and obeyed, so we took off ihram.' Al-Layth said, 'He meant to enjoy the rights of marriage.' And Al-Layth did not mention the story of Suraqah bin Malik."

I heard Jabir bin ʿAbdullah in a gathering saying, "We, the companions of Messenger of Allah ﷺ assumed the state of Ihram to perform only Hajj without ʿUmra." Jabir added, "The Prophet ﷺ arrived (at Mecca) on the fourth of Dhul-Hijja. And when we arrived (in Mecca) the Prophet ﷺ ordered us to finish the state of Ihram, saying, "Finish your lhram and go to your wives (for sexual relation)." Jabir added, "The Prophet did not oblige us (to go to our wives) but he only made that legal for us. Then he heard that we were saying, "When there remains only five days between us and the Day of ʿArafat he orders us to finish our Ihram by sleeping with our wives in which case we will proceed to ʿArafat with our male organs dribbling with semen?' (Jabir pointed out with his hand illustrating what he was saying). Messenger of Allah ﷺ stood up and said, 'You (People) know that I am the most Allah-fearing, the most truthful and the best doer of good deeds (pious) from among you. If I had not brought the Hadi with me, I would have finished my Ihram as you will do, so finish your Ihram. If I had formerly known what I came to know lately, I would not have brought the Hadi with me.' So we finished our Ihram and listened to the Prophet ﷺ and obeyed him." (See Hadith No. 713, Vol. 2)

I, along with some people, heard Jabir b. 'Abdullah saying: We the Companions of Muhammad ﷺ put on Ihram for Hajj only. Ata' further said that Jabir stated: Allah's Apostle ﷺ came on the 4th of Dhu'l-Hijja and he commanded us to put off Ihram. 'Ata'said that he (Allah's Apostle) commanded them to put off Ihram and to go to their wives (for intercourse). 'Ata' said: It was not obligatory for them, but (intercourse) with them had become permissible. We said: When only five days had been left to reach 'Arafa, he (the Holy Prophet) commanded us to have intercourse with our wives. And we reached 'Arafa in a state as if we had just had intercourse (with them). He ('Ata') said: Jabir pointed with his hand and I (perceive) as if I am seeing his hand as it moved. In the (meantime) the Messenger of Allah ﷺ stood amongst us and said: You are well aware that I am the most God-fearing, most truthful and most pious amongst you. And if there were not sacrificial animals with me, I would also have put off Ihram as you have put off. And if I were to know this matter of mine what I have come to know later on, I would not have brought sacrificial animals with me. So they (the Companions) put off Ihram and we also put it off and listened to (the Holy Prophet) and obeyed (his command). Jabir said: 'Ali came with the revenue of the taxes (from Yemen). He (the Holy Prophet) said: For what (purpose) have you entered into the state of Ihram (whether you entered into the state purely for Hajj and, Umra jointly or Hajj and Umra separately)? He said: For the purpose for which the Messenger of Allah ﷺ had entered. (The Prophet had entered as a Qiran, i.e. Ihram covering both Umra and Hajj simultaneously.) Thereupon Messenger of Allah ﷺ said: Offer a sacrifice of animal, and retain Ihram. And 'Ali brought a sacrificial animal for him (for the Holy Prophet). Suraqa b. Malik b. Ju'shum said: Messenger of Allah, is it (this concession putting off Ihram of Hajj or Umra) meant for this year or is it forever? He said: It is forever.

"We, the Companions of the Prophet, entered Ihram for Hajj only, and nothing else. We came to Makkah on the morning of the fourth of Dhul-Hajjah, and the Prophet commanded us: "Exit Ihram and make it Umrah. He heard that we were saying: 'when there are only five days between us and 'Arafat he commands us to exit Ihram and we will go out to Mina with our male members dripping with semen (because of recent intimacy with our wives)?' the Prophet stood up and addressed us, saying: 'I have heard what you said. I am the most righteous and the most pious of you, and were it not for the Hadi I would have exited Ihram. If I had known what I know now, I would not have from Yemen and he said: 'for what did you enter Ihram?' He said: 'For that for which the Messenger of Allah entered Ihram.' Suraq bin Malik bin Jushum said: 'O Messenger of Allah, do you think that this Umrah of ours is for this year only or for all time?' He said: 'It is for all time."

[Machine] We went out with the Messenger of Allah ﷺ as pilgrims, with no intention except for Hajj. When we reached Sarif, Aisha menstruated. The Messenger of Allah ﷺ entered upon her while she was crying and asked, "Why are you crying?" She said, "O Messenger of Allah, I have been harmed!" He said, "Indeed, you are one of the daughters of Adam, and what afflicts them may afflict you." He added, "We have already arrived at the Kaaba in four days or nights of Dhul-Hijjah, then we performed Tawaf around the Kaaba and Sa'i between Safa and Marwa. Then the Messenger of Allah ﷺ commanded us and we performed all the rituals of Hajj except for the prohibited actions. So we discussed among ourselves and said, "We went out as pilgrims with no intention except for Hajj, and we don't intend anything else. Until there was no more than four days or nights between us and Arafat, so we went out to Arafat. Our women were experiencing discharge like that of men. The Messenger of Allah ﷺ was informed of this and he stood up to deliver a sermon, saying, "Indeed, the Umrah is included in the Hajj. If I had known beforehand what I came to know later, I would not have brought the Hadi (sacrificial animal) with me, and if there was no Hadi, I would have assumed Ihram for Umrah." Therefore, whoever does not have a Hadi with him should perform Tahlil (which refers to assuming Ihram for Hajj only by starting the Talbiyah at Meeqat and then remaining in Ihram till the end of Hajj). Suraqa bin Malik bin Ju'shum stood up and asked, "O Messenger of Allah, inform us about those who seem to have been born today, are they considered as if they were born today or forever?" He replied, "No, they are considered as if they were born forever." He then said, "We went to Arafat and then left it. Aisha said to the Messenger of Allah, "I find that I have assumed Ihram without my intention." He said, "You have what they have." She then said, "O Messenger of Allah, I feel something in myself." So he stopped at the highest point of Makkah and commanded her brother Abdullah bin Abu Bakr to cover her until she reached the place of Tan'im. Then she performed the rituals of Umrah and returned to the Prophet ﷺ .  

أحمد:١٤٩٤٢حَدَّثَنَا أَبُو أَحْمَدَ مُحَمَّدُ بْنُ عَبْدِ اللهِ يَعْنِي الزُّبَيْرِيَّ حَدَّثَنَا مَعْقِلٌ يَعْنِي ابْنَ عُبَيْدِ اللهِ الْجَزَرِيَّ عَنْ عَطَاءٍ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ

خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ حُجَّاجًا لَا نُرِيدُ إِلَّا الْحَجَّ وَلَا نَنْوِي غَيْرَهُ حَتَّى إِذَا بَلَغْنَا سَرِفَ حَاضَتْ عَائِشَةُ فَدَخَلَ عَلَيْهَا رَسُولُ اللهِ ﷺ وَهِيَ تَبْكِي فَقَالَ مَا لَكِ تَبْكِينَ؟ قَالَتْ يَا رَسُولَ اللهِ أَصَابَنِي الْأَذَى قَالَ إِنَّمَا أَنْتِ مِنْ بَنَاتِ آدَمَ يُصِيبُكِ مَا يُصِيبُهُنَّ قَالَ وَقَدِمْنَا الْكَعْبَةَ فِي أَرْبَعٍ مَضَيْنَ مِنْ ذِي الْحِجَّةِ أَيَّامًا أَوْ لَيَالِيَ فَطُفْنَا بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ إِنَّ رَسُولَ اللهِ ﷺ أَمَرَنَا فَأَحْلَلْنَا الْإِحْلَالَ كُلَّهُ قَالَ فَتَذَاكَرْنَا بَيْنَنَا فَقُلْنَا خَرَجْنَا حُجَّاجًا لَا نُرِيدُ إِلَّا الْحَجَّ وَلَا نَنْوِي غَيْرَهُ حَتَّى إِذَا لَمْ يَكُنْ بَيْنَنَا وَبَيْنَ عَرَفَاتٍ إِلَّا أَرْبَعَةُ أَيَّامٍ أَوْ لَيَالٍ خَرَجْنَا إِلَى عَرَفَاتٍ وَمَذَاكِيرُنَا تَقْطُرُ الْمَنِيَّ مِنَ النِّسَاءِ قَالَ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَامَ خَطِيبًا فَقَالَ أَلَا إِنَّ الْعُمْرَةَ قَدْ دَخَلَتْ فِي الْحَجِّ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا سُقْتُ الْهَدْيَ وَلَوْلَاالْهَدْيُ لَأَحْلَلْتُ فَمَنْ لَمْ يَكُنْ مَعَهُ هَدْيٌ فَلْيَحِلَّ فَقَامَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ فَقَالَ يَا رَسُولَ اللهِ خَبِّرْنَا خَبَرَ قَوْمٍ كَأَنَّمَا وُلِدُوا الْيَوْمَ أَلِعَامِنَا هَذَا أَمْ لِلْأَبَدِ؟ قَالَ لَا بَلْ لِلْأَبَدِ قَالَ فَأَتَيْنَا عَرَفَاتٍ وَانْصَرَفْنَا مِنْهَا ثُمَّ إِنَّ عَائِشَةَ قَالَتْ يَا رَسُولَ اللهِ إِنِّي أَجِدُ فِي نَفْسِي قَدِ اعْتَمَرُوا قَالَ إِنَّ لَكِ مِثْلَ مَا لَهُمْ قَالَتْ يَا رَسُولَ اللهِ إِنِّي أَجِدُ فِي نَفْسِي فَوَقَفَ بِأَعْلَى وَادِي مَكَّةَ وَأَمَرَ أَخَاهَا عَبْدَ الرَّحْمَنِ بْنَ أَبِي بَكْرٍ فَأَرْدَفَهَا حَتَّى بَلَغَتِ التَّنْعِيمَ ثُمَّ أَقْبَلَتْ

The Prophet ﷺ commanded us to perform Tawaf around the Kaaba and pray two Rak'ahs, then we performed Sa'y between Safa and Marwa. After that, he commanded us to shorten our hair. We asked him, "O Messenger of Allah, what does 'hala' mean?" He replied, "It means that which is permissible for men from women and perfume." So, the women covered themselves with their garments and their bangles were shining. Khalf was informed that some of them were saying, "Let one of us go to Mina and he will mention him dripping with semen." So, he gave a sermon praising and thanking Allah, then he said, "If I had known what I know now, I would not have brought the sacrificial animals until I performed the Hajj. And if I had not brought the sacrificial animals, I would have released myself from the obligation. So, take your rituals now." The people then got up to perform their rituals. When it was the Day of Tarwiyah (8th of Dhul-Hijjah) and they wanted to head towards Mina, they proclaimed the sanctity of Hajj. So, whoever found a Hadi (sacrificial animal) brought it, and whoever did not find a sacrificial animal fasted. He (the Prophet) also made a concession for them regarding their sacrifices, allowing them to share in them with seven other people for a goat, and with seven other people for a cow. Their Tawaf and Sa'y were for both Hajj and 'Umrah, and they performed them both in one go.

قَدِمْنَا مَعَ رَسُولِ اللهِ ﷺ صُبْحَ أَرْبَعٍ مَضَيْنَ مِنْ ذِي الْحِجَّةِ مُهِلِّينَ بِالْحَجِّ كُلُّنَا فَأَمَرَنَا النَّبِيُّ ﷺ فَطُفْنَا بِالْبَيْتِ وَصَلَّيْنَا الرَّكْعَتَيْنِ وَسَعَيْنَا بَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ أَمَرَنَافَقَصَّرْنَا ثُمَّ قَالَ أَحِلُّوا قُلْنَا يَا رَسُولَ اللهِ حِلُّ مَاذَا؟ قَالَ حِلُّ مَا يَحِلُّ لِلْحَلَالِ مِنَ النِّسَاءِ وَالطِّيبِ قَالَ فَغُشِيَتِ النِّسَاءُ وَسَطَعَتِ الْمَجَامِرُ قَالَ خَلَفٌ وَبَلَغَهُ أَنَّ بَعْضَهُمْ يَقُولُ يَنْطَلِقُ أَحَدُنَا إِلَى مِنًى وَذَكَرُهُ يَقْطُرُ مَنِيًّا قَالَ فَخَطَبَهُمْ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ إِنِّي لَوْ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا سُقْتُ الْهَدْيَ وَلَوْ لَمْ أَسُقِ الْهَدْيَ لَأَحْلَلْتُ أَلَا فَخُذُوا مَنَاسِكَكُمْ قَالَ فَقَامَ الْقَوْمُ بِحِلِّهِمْ حَتَّى إِذَا كَانَ يَوْمُ التَّرْوِيَةِ وَأَرَادُوا التَّوَجُّهَ إِلَى مِنًى أَهَلُّوا بِالْحَجِّ قَالَ فَكَانَ الْهَدْيُ عَلَى مَنْ وَجَدَ وَالصِّيَامُ عَلَى مَنْ لَمْ يَجِدْ وَأَشْرَكَ بَيْنَهُمْ فِي هَدْيِهِمُ الْجَزُورَ بَيْنَ سَبْعَةٍ وَالْبَقَرَةَ بَيْنَ سَبْعَةٍ وَكَانَ طَوَافُهُمْ بِالْبَيْتِ وَسَعْيُهُمْ بَيْنَ الصَّفَا وَالْمَرْوَةِ لِحَجِّهِمْ وَعُمْرَتِهِمْ طَوَافًا وَاحِدًا وَسَعْيًا وَاحِدًا

"We, the Companions of the Prophet, entered Ihram for Hajj only, and nothing else. We came to Makkah on the morning of the fourth of Dhul-Hajjah, and the Prophet commanded us: "Exit Ihram and make it Umrah. He heard that we were saying: 'when there are only five days between us and 'Arafat he commands us to exit Ihram and we will go out to Mina with our male members dripping with semen (because of recent intimacy with our wives)?' the Prophet stood up and addressed us, saying: 'I have heard what you said. I am the most righteous and the most pious of you, and were it not for the Hadi I would have exited Ihram. If I had known what I know now, I would not have from Yemen and he said: 'for what did you enter Ihram?' He said: 'For that for which the Messenger of Allah entered Ihram.' Suraq bin Malik bin Jushum said: 'O Messenger of Allah, do you think that this Umrah of ours is for this year only or for all time?' He said: 'It is for all time." [Machine] We went out with the Messenger of Allah ﷺ as pilgrims, desiring only the Hajj and intending nothing else. But when it reached the days of Sarif, Aisha menstruated and the Messenger of Allah ﷺ entered upon her while she was crying. He asked, "What makes you cry?" She said, "I have been afflicted with menstrual bleeding." He said, "You are from the daughters of Adam, and this is what afflicts them." We arrived in Mecca for four nights, free from the days of Hajj, so we performed Tawaf around the Ka'bah and Sa'i between Safa and Marwa, as the Messenger of Allah ﷺ commanded us to do. We were conversing among ourselves, saying, "We have gone out as pilgrims, desiring only the Hajj and intending nothing else, until there is only four nights between us and Arafat." Our impurities were dripping from the women, then the Messenger of Allah ﷺ was informed about that. He stood up to deliver a sermon, saying, "Indeed, Umrah is included in Hajj. If I had not brought the sacrificial animal, I would have dismounted. So whoever does not have a sacrificial animal with him should deconsecrate his Ihram." Surqah bin Malik bin Ju'shum Al-Mudlaji said, "O Messenger of Allah, tell us about a people who were born today. Is this Umrah of ours for this year only or forever?" He said, "Forever." So we came to Arafat, and when it was time to leave, Aisha said, "O Messenger of Allah, you all performed Tawaf around the Ka'bah and Sa'i between Safa and Marwa, but I did not perform Sa'i." He said, "You will have the same ruling as the people." She asked, "What do you think about me?" He halted in the highest part of Makkah's valley and 'Abdullah bin Abi Bakr assisted her until she reached Tan'im.

خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ حُجَّاجًا مَا نُرِيدُ إِلَّا الْحَجَّ وَلَا نَنْوِي غَيْرَهُ حَتَّى إِذَا كَانَ بِسَرِفٍ حَاضَتْ عَائِشَةُ فَدَخَلَ عَلَيْهَا رَسُولُ اللهِ ﷺ وَهِيَ تَبْكِي فَقَالَ «مَا يُبْكِيكِ؟» قَالَتْ أَصَابَنِي الْأَذَى قَالَ «إِنَّمَا أَنْتِ مِنْ بَنَاتِ آدَمَ يُصِيبُكِ مَا يُصِيبُهُنَّ» قَالَ فَقَدِمْنَا مَكَّةَ لِأَرْبَعِ لَيَالٍ خَلَوْنَ مِنْ ذِي الْحِجَّةِ فَطُفْنَا بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ كَمَا أَمَرَنَا رَسُولُ اللهِ ﷺ فَتَذَاكَرْنَا بَيْنَنَا فَقُلْنَا خَرَجْنَا حُجَّاجًا وَلَا نُرِيدُ إِلَّا الْحَجَّ وَلَا نَنْوِي غَيْرَهُ حَتَّى إِذَا لَمْ يَبْقَ بَيْنَنَا وَبَيْنَ عَرَفَاتٍ إِلَّا أَرْبَعُ لَيَالٍ وَمَذَاكِيرُنَا تَقْطُرُ الْمَنِيَّ مِنَ النِّسَاءِ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَامَ خَطِيبًا فَقَالَ «إِنَّ الْعُمْرَةَ قَدْ دَخَلَتْ فِي الْحَجِّ وَلَوْ أَنِّي اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا سُقْتُ الْهَدْيَ وَلَوْلَا الْهَدْيُ لَأَحْلَلْتُ فَمَنْ لَمْ يَكُنْ مَعَهُ هَدْيٌ فَلْيَحْلِلْ» فَقَالَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ الْمُدْلِجِيُّ يَا رَسُولَ اللهِ حَدِّثْنَا حَدِيثَ قَوْمٍ كَأَنَّمَا وُلِدُوا الْيَوْمَ عُمْرَتُنَا هَذِهِ لِعَامِنَا هَذَا؟ أَمْ لِلْأَبَدِ؟ قَالَ «لِلْأَبَدِ» فَأَتَيْنَا عَرَفَةَ فَلَمَّا كَانَ عِنْدَ الِانْصِرَافِ قَالَتْ عَائِشَةُ يَا رَسُولَ اللهِ إِنَّكُمْ قَدْ طُفْتُمْ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ وَلَمْ أَكُنْ طُفْتُ؟ فَقَالَ «إِنَّ لَكِ مِثْلَ مَا لِلْقَوْمِ» قَالَتْ فَإِنِّي أَجِدُ فِي نَفْسِي؟ قَالَ فَوَقَفَ لَهَا رَسُولُ اللهِ ﷺ فِي أَعْلَى وَادِي مَكَّةَ وَأَرْدَفَهَا عَبْدَ الرَّحْمَنِ بْنَ أَبِي بَكْرٍ حَتَّى أَتَتِ التَّنْعِيمَ

[Machine] We arrived with the Messenger of Allah ﷺ on the morning of the fourth day of Dhul-Hijjah, performing the rites of Hajj together. The Messenger of Allah ﷺ ordered us to perform Tawaf (circumambulation) around the Kaaba, pray, and then perform Sa'i (walking) between Safa and Marwa. He then ordered us to shorten our hair, and said, "You may now enter into a state of Ihram for whatever is permissible of women and perfume." The women then covered their faces, and the scent of their perfumes filled the air. The Messenger of Allah ﷺ heard someone asking, "Where should we go to release ourselves to Minah?" and he mentioned that semen may drip. He addressed them, praised and thanked Allah, and then said, "If it were not for my intention, I would not have performed the Hady (sacrifice)." Even if I did not perform the Hady, I would still have performed the Halq (shaving the head). So fulfill your rituals accordingly." The entire group stood still until it was the day of Tarwiyah (8th of Dhul-Hijjah), and they intended to head towards Minah. The people of Hajj were allowed, and the Hady (sacrifice) was to be performed by those who found the animal. The fasting was for those who did not find an animal. The dividing line between their sacrificed animals was the Jazur (a type of sheep) for seven people, and a cow for seven people. Their Tawaf (circumambulation) around the Kaaba and Sa'i (walking) between Safa and Marwa were to be performed together as one, whether it was for Hajj or Umrah. The story of Suraaqah ibn Malik was not mentioned.

I, along with some people, heard Jabir b. 'Abdullah saying: We the Companions of Muhammad ﷺ put on Ihram for Hajj only. Ata' further said that Jabir stated: Allah's Apostle ﷺ came on the 4th of Dhu'l-Hijja and he commanded us to put off Ihram. 'Ata'said that he (Allah's Apostle) commanded them to put off Ihram and to go to their wives (for intercourse). 'Ata' said: It was not obligatory for them, but (intercourse) with them had become permissible. We said: When only five days had been left to reach 'Arafa, he (the Holy Prophet) commanded us to have intercourse with our wives. And we reached 'Arafa in a state as if we had just had intercourse (with them). He ('Ata') said: Jabir pointed with his hand and I (perceive) as if I am seeing his hand as it moved. In the (meantime) the Messenger of Allah ﷺ stood amongst us and said: You are well aware that I am the most God-fearing, most truthful and most pious amongst you. And if there were not sacrificial animals with me, I would also have put off Ihram as you have put off. And if I were to know this matter of mine what I have come to know later on, I would not have brought sacrificial animals with me. So they (the Companions) put off Ihram and we also put it off and listened to (the Holy Prophet) and obeyed (his command). Jabir said: 'Ali came with the revenue of the taxes (from Yemen). He (the Holy Prophet) said: For what (purpose) have you entered into the state of Ihram (whether you entered into the state purely for Hajj and, Umra jointly or Hajj and Umra separately)? He said: For the purpose for which the Messenger of Allah ﷺ had entered. (The Prophet had entered as a Qiran, i.e. Ihram covering both Umra and Hajj simultaneously.) Thereupon Messenger of Allah ﷺ said: Offer a sacrifice of animal, and retain Ihram. And 'Ali brought a sacrificial animal for him (for the Holy Prophet). Suraqa b. Malik b. Ju'shum said: Messenger of Allah, is it (this concession putting off Ihram of Hajj or Umra) meant for this year or is it forever? He said: It is forever. (Using translation from Muslim 1216a)   

البيهقي:٨٨٦٤أَخْبَرَنَا أَبُو زَكَرِيَّا يَحْيَى بْنُ إِبْرَاهِيمَ بْنِ مُحَمَّدِ بْنِ يَحْيَى أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ بْنِ يُوسُفَ ثنا يَحْيَى بْنُ مُحَمَّدٍ ثنا مُسَدَّدٌ ثنا يَحْيَى ثنا ابْنُ جُرَيْجٍ أَخْبَرَنِي عَطَاءٌ سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ فِي أُنَاسٍ مَعِي قَالَ

أَهَلَلْنَا أَصْحَابَ رَسُولِ اللهِ ﷺ بِالْحَجِّ خَالِصًا وَحْدَهُ فَقَدِمَ النَّبِيُّ ﷺ صُبْحَ رَابِعَةٍ مَضَتْ مِنْ ذِي الْحِجَّةِ فَأَمَرَنَا بَعْدَ أَنْ قَدِمَ أَنْ نَحِلَّ فَقَالَ أَحِلُّوا وَأَصِيبُوا النِّسَاءَ قَالَ عَطَاءٌ وَلَمْ يُعَزِّمْ عَلَيْهِمْ أَنْ يُصِيبُوا النِّسَاءَ وَلَكِنَّهُ أَحلَّهُنَّ لَهُمْ قَالَ عَطَاءٌ قَالَ جَابِرٌ فَبَلَغَهُ عَنَّا أَنَّا نَقُولُ لَمَّا لَمْ يَكُنْ بَيْنَنَا وَبَيْنَ عَرَفَةَ إِلَّا خَمْسٌ أَمَرَنَا أَنْ نَحِلَّ إِلَى نِسَائِنَا فَنَأْتِيَ عَرَفَةَ تَقْطُرُ مَذَاكِيرُنَا الْمَنِيَّ قَالَ وَيَقُولُ جَابِرٌ بِيَدِهِ كَأَنِّي أَنْظُرُ إِلَى قَوْلِهِ بِيَدِهِ يُحرِّكُهَا فَقَامَ النَّبِيُّ ﷺ فِينَا فَقَالَ قَدْ عَلِمْتُمْ أَنِّي أَتْقَاكُمْ لِلَّهِ وَأَصْدَقُكُمْ وَأَبَرُّكُمْ وَلَوْلَا هَدْيِي لَأَحْلَلْتُ كَمَا تَحِلُّونَ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا أَهْدَيْتُ فَحَلُّوا قَالَ فَأَحْلَلْنَا وَسَمِعْنَا وَأَطَعْنَا قَالَ جَابِرٌ فَقَدِمَ عَلِيٌّ ؓ مِنْ سِعَايَتِهِ فَقَالَ لَهُ النَّبِيُّ ﷺ بِمَا أَهْلَلْتَ؟ قَالَ بِمَا أَهَلَّ بِهِ النَّبِيُّ ﷺ قَالَ فَاهْدِ وَامْكُثْ حَرَامًا قَالَ فَأَهْدَى لَهُ عَلِيٌّ ؓ هَدْيًا قَالَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ مُتْعَتُنَا هَذِهِ يَا رَسُولَ اللهِ لِعَامِنَا هَذَا أَمْ لِأَبَدٍ؟ قَالَ بَلْ لِأَبَدٍ

I, along with some people, heard Jabir b. 'Abdullah saying: We the Companions of Muhammad ﷺ put on Ihram for Hajj only. Ata' further said that Jabir stated: Allah's Apostle ﷺ came on the 4th of Dhu'l-Hijja and he commanded us to put off Ihram. 'Ata'said that he (Allah's Apostle) commanded them to put off Ihram and to go to their wives (for intercourse). 'Ata' said: It was not obligatory for them, but (intercourse) with them had become permissible. We said: When only five days had been left to reach 'Arafa, he (the Holy Prophet) commanded us to have intercourse with our wives. And we reached 'Arafa in a state as if we had just had intercourse (with them). He ('Ata') said: Jabir pointed with his hand and I (perceive) as if I am seeing his hand as it moved. In the (meantime) the Messenger of Allah ﷺ stood amongst us and said: You are well aware that I am the most God-fearing, most truthful and most pious amongst you. And if there were not sacrificial animals with me, I would also have put off Ihram as you have put off. And if I were to know this matter of mine what I have come to know later on, I would not have brought sacrificial animals with me. So they (the Companions) put off Ihram and we also put it off and listened to (the Holy Prophet) and obeyed (his command). Jabir said: 'Ali came with the revenue of the taxes (from Yemen). He (the Holy Prophet) said: For what (purpose) have you entered into the state of Ihram (whether you entered into the state purely for Hajj and, Umra jointly or Hajj and Umra separately)? He said: For the purpose for which the Messenger of Allah ﷺ had entered. (The Prophet had entered as a Qiran, i.e. Ihram covering both Umra and Hajj simultaneously.) Thereupon Messenger of Allah ﷺ said: Offer a sacrifice of animal, and retain Ihram. And 'Ali brought a sacrificial animal for him (for the Holy Prophet). Suraqa b. Malik b. Ju'shum said: Messenger of Allah, is it (this concession putting off Ihram of Hajj or Umra) meant for this year or is it forever? He said: It is forever. (Using translation from Muslim 1216a)

أَهَلَلْنَا أَصْحَابَ رَسُولِ اللهِ ﷺ بِالْحَجِّ خَالِصًا لَيْسَ مَعَهُ غَيْرُهُ خَالِصًا وَحْدَهُ قَالَ عَطَاءٌ قَالَ جَابِرٌ وَقَدِمَ النَّبِيُّ ﷺ مَكَّةَ صَبِيحَةَ رَابِعَةٍ مَضَتْ مِنْ ذِي الْحِجَّةِ قَالَ فَلَمَّا قَدِمْنَا أَمَرَنَا النَّبِيُّ ﷺ فَقَالَ أَحِلُّوا وَأَصِيبُوا النِّسَاءَ قَالَ عَطَاءٌ فَلَمْ يَعْزِمْ عَلَيْهِمْ أَنْ يُصِيبُوا النِّسَاءَ وَلَكِنْ أَحَلَّهُنَّ لَهُمْ قَالَ فَبَلَغَهُ عَنَّا أَنَّا نَقُولُ لَمَّا لَمْ يَكُنْ بَيْنَنَا وَبَيْنَ عَرَفَةَ إِلَّا خَمْسٌ أَمَرَنَا أَنْ نَحِلَّ إِلَى نِسَائِنَا وَنَأْتِيَ عَرَفَةَ تَقْطُرُ مَذَاكِيرُنَا الْمَنِيَّ قَالَ وَيَقُولُ جَابِرٌ بِيَدِهِ كَأَنِّي أَنْظُرُ إِلَى يَدِهِ يُحَرِّكُهَا فَقَامَ النَّبِيُّ ﷺ فَقَالَ هَلْ عَلِمْتُمْ أَنِّي أَتْقَاكُمْ لِلَّهِ وَأَصْدَقُكُمْ وَأَبَرُّكُمْ وَلَوْلَا الْهَدْيُ لَحَلَلْتُ كَمَا تَحِلُّونَ وَلَوِ اسْتَقْبَلْتُ مِنْ أَمْرِي مَا اسْتَدْبَرْتُ مَا أَهْدَيْتُ قَالَ فَأَحْلَلْنَا وَسَمِعْنَا وَأَطَعْنَا قَالَ جَابِرٌ فَقَدِمَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ مِنْ سِعَايَتِهِ فَقَالَ لَهُ النَّبِيُّ ﷺ بِمَ أَهَلَلْتَ يَا عَلِيُّ؟ قَالَ بِمَا أَهَلَّ بِهِ النَّبِيُّ ﷺ قَالَ فَأَهْدِ ثُمَّ امْكُثْ حَرَامًا كَمَا أَنْتَ قَالَ فَأَهْدَى لَهُ عَلِيٌّ هَدْيًا قَالَ فَقَالَ سُرَاقَةُ بْنُ مَالِكٍ مُتْعَتُنَا هَذِهِ يَا رَسُولَ اللهِ لِعَامِنَا هَذَا أَمْ لِلْأَبَدِ؟ فَقَالَ لَا بَلْ لِلْأَبَدِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ ابْنِ جُرَيْجٍ

I left for Mecca for Hajj-at-Tamattuʿ assuming Ihram for ʿUmra. I reached Mecca three days before the day of Tarwiya (8th Dhul-Hijja). Some people of Mecca said to me, "Your Hajj will be like the Hajj performed by the people of Mecca (i.e. you will lose the superiority of assuming Ihram from the Miqat). So I went to ʿAta' asking him his view about it. He said, "Jabir bin ʿAbdullah narrated to me, 'I performed Hajj with Messenger of Allah ﷺ on the day when he drove camels with him. The people had assumed Ihram for Hajj-al-Ifrad. The Prophet ﷺ ordered them to finish their Ihram after Tawaf round the Kaʿba, and between Safa and Marwa and to cut short their hair and then to stay there (in Mecca) as non-Muhrims till the day of Tarwiya (i.e. 8th of Dhul-Hijja) when they would assume Ihram for Hajj and they were ordered to make the Ihram with which they had come as for ʿUmra only. They asked, 'How can we make it ʿUmra (Tamattuʿ) as we have intended to perform Hajj?' The Prophet ﷺ said, 'Do what I have ordered you. Had I not brought the Hadi with me, I would have done the same, but I cannot finish my Ihram till the Hadi reaches its destination (i.e. is slaughtered).' So, they did (what he ordered them to do)." البيهقي:٨٧٨٨أَخْبَرَنَا أَبُو الْقَاسِمِ عُبَيْدُ اللهِ بْنُ عُمَرَ بْنِ عَلِيٍّ الْفَقِيهُ بِبَغْدَادَ فِي مَسْجِدِ الرَّصَافَةِ أنبأ أَحْمَدُ بْنُ سَلْمَانَ النِّجَادُ ثنا أَحْمَدُ بْنُ مُحَمَّدٍ ثنا أَبُو نُعَيْمٍ الْفَضْلُ بْنُ دُكَيْنٍ ثنا أَبُو شِهَابٍ مُوسَى بْنُ نَافِعٍ الْأَسَدِيُّ قَالَ

قَدِمْتُ مَكَّةَ وَأَنَا مُتَمَتِّعٌ بِعُمْرَةٍ فَدَخَلْتُ قَبْلَ التَّرْوِيَةِ بِثَلَاثَةِ أَيَّامٍ فَقَالَ لِي أُنَاسٌ مِنْ أَهَلِ مَكَّةَ تَصِيرُ الْآنَ حَجَّتُكَ مَكِّيَّةً فَدَخَلْتُ عَلَى عَطَاءِ بْنِ أَبِي رَبَاحٍ أَسْتَفْتِيهِ فَقَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّهُ حَجَّ مَعَ رَسُولِ اللهِ ﷺ يَوْمَ سَاقَ الْبُدْنَ وَقَدْ أَهَلَّوْا بِالْحَجِّ مُفْرِدًا فَقَالَ لَهُمْ رَسُولُ اللهِ ﷺ أَحِلُّوا مِنْ إِحْرَامِكُمْ بِالطَّوَافِ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ وَأَقْصِرُوا وَأَنْتُمْ حَلَالٌ فَإِذَا كَانَ يَوْمُ التَّرْوِيَةِ فَأَهِلُّوا بِالْحَجِّ وَاجْعَلُوا الَّتِي قَدَّمْتُمْ بِهَا مُتْعَةً قَالُوا كَيْفَ نَجْعَلُهَا مُتْعَةً وَقَدْ سَمَّيْنَا الْحَجَّ؟ فَقَالَ افْعَلُوا مَا أَمَرْتُكُمْ فَلَوْلَا أَنِّي سُقْتُ الْهَدْيَ لَفَعَلْتُ مِثْلَ الَّذِي أَمَرْتُكُمْ بِهِ وَلَكِنْ لَا يَحِلُّ مِنِّي حَرَامٌ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ فَفَعَلُوا
