12. Ḥajj and ʿUmrah

١٢۔ كِتَابُ الْحَجِّ

12.10 [Machine] The man hires himself from a man who serves him, then he tempts him to perform Hajj with him or rents his camel and then performs Hajj and his Hajj is completed.

١٢۔١٠ بَابُ الرَّجُلِ يُؤَاجِرُ نَفْسَهُ مِنْ رَجُلٍ يَخْدُمُهُ ثُمَّ يُهِلُّ بِالْحَجِّ مَعَهُ أَوْ يُكْرِي جِمَالَهُ ثُمَّ يَحُجُّ فَيُجْزِئُهُ حَجُّهُ.

[Machine] Abu Al-Abbas Al-Asam reported that Al-Rabi' narrated from Al-Shafi'i, who narrated from Muslim and Sa'id, who reported from Ibn Jurayj, who reported from 'Ata', who reported from Ibn 'Abbas (may Allah be pleased with him) that a man asked him: "I would like to accompany these people and perform the rituals with them. Will I be rewarded?" Ibn 'Abbas said: "Yes, they will have a share of what they have earned, and Allah is swift in taking account." [Surah Al-Baqarah, 202]  

البيهقي:٨٦٥٥أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَسَنِ الْقَاضِي

ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ مُسْلِمٌ وَسَعِيدٌ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ ؓ أَنَّ رَجُلًا سَأَلَهُ فَقَالَ أُؤَاجِرُ نَفْسِي مِنْ هَؤُلَاءِ الْقَوْمِ فَأَنْسَكُ مَعَهُمُ الْمَنَاسِكَ أَلِيَ أَجْرٌ؟ فَقَالَ ابْنُ عَبَّاسٍ نَعَمْ {أُولَئِكَ لَهُمْ نَصِيبٌ مِمَّا كَسَبُوا وَاللهُ سَرِيعُ الْحِسَابِ} [البقرة 202]

[Machine] "And Allah, for them is a share from what they have earned, and Allah is swift in account-taking." [Al-Baqarah 202] And similarly,  

البيهقي:٨٦٥٦أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ مِنْ أَصْلِ كِتَابِهِ ثنا أَبُو مَنْصُورٍ مُحَمَّدُ بْنُ الْقَاسِمِ الْعَتَكِيُّ الضُّبَعِيُّ إِمْلَاءً ثنا اللَّبَّادُ يَعْنِي أَحْمَدَ بْنَ نَصْرٍ ثنا أَبُو نُعَيْمٍ ثنا الْأَعْمَشُ عَنْ مُسْلِمٍ الْبَطِينِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَالَ جَاءَ رَجُلٌ إِلَى ابْنِ عَبَّاسٍ فَقَالَ إِنِّي أَكْرَيْتُ نَفْسِي إِلَى الْحَجِّ وَاشْتَرَطْتُ عَلَيْهِمْ أَنْ أَحُجَّ أَفَيُجْزِئُ ذَلِكَ عَنِّي؟ قَالَ أَنْتَ مِنَ الذِّينَ قَالَ

اللهُ {أُولَئِكَ لَهُمْ نَصِيبٌ مِمَّا كَسَبُوا وَاللهُ سَرِيعُ الْحِسَابِ} [البقرة 202] وَكَذَلِكَ

I was a man who used to give (riding-beasts) on hire for this purpose (for travelling during the pilgrimage) and the people would tell (me): Your hajj is not valid. So I met Ibn Umar and told him: AbuAbdurRahman, I am a man who gives (riding-beast) on hire for this purpose (i.e. for hajj), and the people tell me: Your hajj is not valid. Ibn Umar replied: Do you not put on ihram (the pilgrim dress), call the talbiyah (labbayk), circumambulate the Ka'bah, return from Arafat and lapidate jamrahs? I said: Why not? Then he said: Your hajj is valid. a man came to the Prophet ﷺ and asked him the same question you have asked me. The Messenger of Allah ﷺ kept silence and did not answer him till this verse came down: "It is no sin for you that you seek the bounty of your Lord." The Messenger of Allah ﷺ sent for him and recited this verse to him and said: Your hajj is valid. (Using translation from Abū Dāʾūd 1733)   

البيهقي:٨٦٥٧أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو بَكْرِ بْنُ إِسْحَاقَ أنبأ أَبُو الْمُثَنَّى ثنا مُسَدَّدٌ ثنا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ ثنا الْعَلَاءُ بْنُ الْمُسَيَّبِ ثنا أَبُو أُمَامَةَ التَّيْمِيُّ قَالَ كُنْتُ رَجُلًا أُكْرِي مِنْ هَذَا الْوَجْهِ وَكَانَ النَّاسُ يَقُولُونَ إِنَّهُ لَيْسَ لَكَ حَجٌّ فَلَقِيتُ ابْنَ عُمَرَ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ إِنِّي رَجُلٌ أُكْرِي فِي هَذِهِ الْأَوْجُهِ وَإِنَّ أُنَاسًا يَقُولُونَ لِي إِنَّهُ لَكَ حَجٌّ فَقَالَ

أَلَسْتَ تُحْرِمُ وَتُلَبِّي وَتَطُوفُ بِالْبَيْتِ وَتُفِيضُ مِنْ عَرَفَاتٍ وَتَرْمِي الْجِمَارَ قَالَ قُلْتُ بَلَى قَالَ فَإِنَّ لَكَ حَجًّا جَاءَ رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهُ عَنْ مِثْلِ مَا سَأَلْتَنِي عَنْهُ فَسَكَتَ عَنْهُ رَسُولُ اللهِ ﷺ فَلَمْ يُجِبْهُ حَتَّى نَزَلَتْ هَذِهِ الْآيَةُ {لَيْسَ عَلَيْكُمْ جُنَاحٌ أَنْ تَبْتَغُوا فَضْلًا مِنْ رَبِّكُمْ} [البقرة 198] فَأَرْسَلَ إِلَيْهِ رَسُولُ اللهِ ﷺ وَقَرَأَ هَذِهِ الْآيَةَ عَلَيْهِ وَقَالَ لَكَ حَجٌّ
