12. Ḥajj and ʿUmrah
١٢۔ كِتَابُ الْحَجِّ
I heard Messenger of Allah ﷺ as saying: Four are the vicious (birds, beasts and reptiles) which should be killed in the state of Ihram or otherwise: kite (and vulture), crow, rat, and the voracious dog. I (one of the narrators, ʿUbaidullah b. Miqsam) said to Qasim (the other narrator who heard it from ʿA'isha): What about the snake? He said: Let it be killed with disgrace. (Using translation from Muslim 1198a)
سَمِعْتُ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ تَقُولُ سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ أَرْبَعٌ كُلُّهُنَّ فَوَاسِقُ يُقْتَلْنَ فِي الْحِلِّ وَالْحَرَمِ الْحَدَأَةُ وَالْغُرَابُ وَالْفَأْرَةُ وَالْكَلْبُ الْعَقُورُ
[Machine] The Messenger of Allah ﷺ said, "There are five animals, all of them are sinful and should be killed in the Sacred Mosque: the crow, the kite, the dog with a crooked tail, the scorpion, and the mouse."
قَالَ رَسُولُ اللهِ ﷺ خَمْسٌ مِنَ الدَّوَابِّ كُلُّهَا فَاسِقٌ يُقْتَلْنَ فِي الْحَرَمِ الْغُرَابُ وَالْحِدَأَةُ وَالْكَلْبُ الْعَقُورُ وَالْعَقْرَبُ وَالْفَأْرَةُ
[Machine] The Prophet ﷺ said: "There are five transgressors that are killed in both sacred and prohibited areas: the mouse, the scorpion, the weasel, the rabid dog, and the spotted crow."
النَّبِيَّ ﷺ قَالَ خَمْسٌ فَوَاسِقُ يُقْتَلْنَ فِي الْحِلِّ وَالْحَرَمِ الْفَأْرَةُ وَالْعَقْرَبُ وَالْحِدَأَةُ وَالْكَلْبُ الْعَقُورُ وَالْغُرَابُ الْأَبْقَعُ
[Machine] The Messenger of Allah ﷺ said that there are five animals that are not considered Haram to kill: the crow, the kite, the scorpion, the rat, and the desert dog.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ خَمْسٌ مِنَ الدَّوَابِّ لَيْسَ عَلَى الْمُحْرِمِ فِي قَتْلِهِنَّ جُنَاحٌ الْغُرَابُ وَالْحِدَأَةُ وَالْعَقْرَبُ وَالْفَأْرَةُ وَالْكَلْبُ الْعَقُورُ
[Machine] A man asked the Prophet ﷺ , "What animals are considered harmful for a pilgrim to kill?" The Prophet ﷺ replied, "The mouse, the scorpion, the crow, the hedgehog, and the dog that is loose." I asked Nafi' about the snake, and he said, "There is no difference of opinion regarding the snake."
أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ مَا يَقْتُلُ الْمُحْرِمُ مِنَ الدَّوَابِّ؟ قَالَ الْفَأْرَةُ وَالْعَقْرَبُ وَالْغُرَابُ وَالْحِدَأَةُ وَالْكَلْبُ الْعَقُورُ قُلْتُ لِنَافِعٍ الْحَيَّةُ قَالَ الْحَيَّةُ لَا يُخْتَلَفُ فِيهَا
[Machine] From the Prophet ﷺ that he said: There are five animals that there is no sin on the one who kills them in the sacred months and sacred land: the crow, the rat, the dog, the scorpion, and the hedgehog.
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ خَمْسٌ مِنَ الدَّوَابِّ لَا جُنَاحَ عَلَى مَنْ قَتَلَهُنَّ فِي الْحِلِّ وَالْحَرَمِ الْغُرَابُ وَالْفَأْرَةُ وَالْكَلْبُ الْعَقُورُ وَالْحِدَأَةُ وَالْعَقْرَبُ
[Machine] Hafsah, the wife of the Prophet ﷺ, narrated from the Prophet ﷺ who said, "There are five types of animals, all of which are considered sinful to kill. There is no blame upon the one who kills them: the scorpion, the crow, the kite, the mouse, and the rabid dog." This is the wording of the hadith of Harmalah, and in another narration, Asbagh said, "The Messenger of Allah ﷺ mentioned five types of animals for which there is no blame upon the one who kills them," and then he mentioned them.
حَفْصَةُ زَوْجُ النَّبِيِّ ﷺ عَنِ النَّبِيِّ ﷺ قَالَ خَمْسٌ مِنَ الدَّوَابِّ كُلُّهُنَّ فَوَاسِقُ لَا جُنَاحَ عَلَى مَنْ قَتَلَهُنَّ الْعَقْرَبُ وَالْغُرَابُ وَالْحِدَأَةُ وَالْفَأْرَةُ وَالْكَلْبُ الْعَقُورُ لَفْظُ حَدِيثِ حَرْمَلَةَ وَفِي رِوَايَةِ أَصْبَغَ قَالَ رَسُولُ اللهِ ﷺ خَمْسٌ مِنَ الدَّوَابِّ لَا حَرَجَ عَلَى مَنْ قَتَلَهُنَّ ثُمَّ ذَكَرَهُنَّ
Abu Hurairah reported the Apostle of Allaah ﷺ as saying There are five(creatures) the killing of which is lawful in the sacred territory. The Snake, the Scorpion, the Kite, the Rat and the biting Dog. (Using translation from Abū Dāʾūd 1847)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ خَمْسٌ قَتْلُهُنَّ حَلَالٌ فِي الْحَرَمِ الْحَيَّةُ وَالْعَقْرَبُ وَالْحِدَأَةُ وَالْفَأْرَةُ وَالْكَلْبُ الْعَقُورُ
[Machine] The Messenger of Allah ﷺ said: "The forbidden (haram) animal kills the snake and the scorpion, and it throws stones at the crow, but it does not kill it. It kills the male dog, the crossbreed, the guard dog, the hunting dog, and the biting dog."
قَالَ رَسُولُ اللهِ ﷺ يَقْتُلُ الْمُحْرِمُ الْحَيَّةَ وَالْعَقْرَبَ وَيَرْمِي الْغُرَابَ وَلَا يَقْتُلُهُ وَيَقْتُلُ الْكَلْبَ الْعَقُورَ وَالْفُوَيْسِقَةَ وَالْحِدَأَةَ وَالسَّبُعَ الْعَادِيَ
[Machine] I heard Ibn Umar say that the Messenger of Allah ﷺ commanded the killing of the wolf, the mouse, and the harmful snake. It was said to him, "What about the snake and the scorpion?" He replied, "It has been said." Yazid ibn Harun, meaning Al-Muharram Al-Hajjaj ibn 'Urata, said, "It is not to be relied upon." And we have narrated a good Marasil hadith from Ibn Misjah.
سَمِعْتُ ابْنَ عُمَرَ يَقُولُ أَمَرَ رَسُولُ اللهِ ﷺ بِقَتْلِ الذِّئْبِ وَالْفَأْرَةِ وَالْحِدَأَةِ فَقِيلَ لَهُ وَالْحَيَّةُ وَالْعَقْرَبُ فَقَالَ قَدْ كَانَ يُقَالُ ذَلِكَ قَالَ يَزِيدُ بْنُ هَارُونَ يَعْنِي الْمُحْرِمَ الْحَجَّاجُ بْنُ أَرْطَاةَ لَا يُحْتَجُّ بِهِ وَقَدْ رُوِّينَا مِنْ حَدِيثِ ابْنِ الْمُسَيِّبِ مُرْسَلًا جَيِّدًا
[Machine] The Prophet (PBUH) said, "One who slays a protected animal and a wolf, it is like killing them both." Ibn Wahb informed us, reporting from Ibn Jurayj, from Abu Zubair, from Mujahid, from Abu Ubaidah, from Abdullah bin Mas'ud that the Messenger of Allah (PBUH) said the same about killing a snake.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ يَقْتُلُ الْمُحْرِمُ الْحَيَّةَ وَالذِّئْبَ 10044 قَالَ وَأَخْبَرَنَا ابْنُ وَهْبٍ أَخْبَرَنِي ابْنُ جُرَيْجٍ عَنْ أَبِي الزُّبَيْرِ عَنْ مُجَاهِدٍ عَنْ أَبِي عُبَيْدَةَ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ عَنْ رَسُولِ اللهِ ﷺ مِثْلَهُ فِي الْحَيَّةِ
[Machine] We were with the Messenger of Allah ﷺ in Mina when a snake appeared in front of us. The Messenger of Allah ﷺ said, "Kill it." We rushed to kill it, but it disappeared before we could reach it. The Messenger of Allah ﷺ then said, "Your enemy has been protected from you, just as you were protected from its harm."
كُنَّا مَعَ رَسُولِ اللهِ ﷺ بِمِنًى فَوَثَبَتْ عَلَيْنَا حَيَّةٌ فَقَالَ رَسُولُ اللهِ ﷺ اقْتُلُوهَا فَابْتَدَرْنَا فَسَبَقَتْنَا فَقَالَ رَسُولُ اللهِ ﷺ وُقِيَتْ شَرَّكُمْ كَمَا وُقِيتُمْ شَرَّهَا
[Machine] The Messenger of Allah ﷺ ordered Muharrim to kill a snake in Mina. Abu Abdullah Al-Hafiz narrated to us, I am Abu Abdullah bin Ya'qub, narrated to us Muhammad bin Ishaq, narrated to us Abu Kurayb, and Muslim narrated it in Sahih from Abu Kurayb.
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ مُحْرِمًا بِقَتْلِ حَيَّةٍ بِمِنًى أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا أَبُو كُرَيْبٍ وَرَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ أَبِي كُرَيْبٍ
[Machine] The Messenger of Allah ﷺ said that the gecko is a harmful creature and I have not heard him ordering its killing.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْوَزَغُ فُوَيْسِقٌ وَلَمْ أَسْمَعْهُ أَمَرَ بِقَتْلِهِ
[Machine] The Prophet ﷺ ordered the killing of the lizard and called it "Fuwaisiqan" as their names are equal.
أَمَرَ النَّبِيُّ ﷺ بِقَتْلِ الْوَزَغِ وَسَمَّاهُ فُوَيْسِقًا لَفْظُهُمَا سَوَاءٌ
[Machine] The Messenger of Allah ﷺ ordered the killing of Magpies.
رَسُولَ اللهِ ﷺ أَمَرَ بِقَتْلِ الْأَوْزَاغِ
[Machine] Al-Humaidi, everything that causes you discomfort is the humpback
الْحُمَيْدِيُّ كُلُّ شَيْءٍ يَعْقِرُكَ فَهُوَ الْعَقُورُ
[Machine] Malik, who was ordered to be killed, said: "Indeed, whatever attacks people and terrifies them, like lions, tigers, leopards, and wolves, is the crippled dog."
قَالَ مَالِكٌ الْكَلْبُ الْعَقُورُ الَّذِي أُمِرَ الْمُحْرِمُ بِقَتْلِهِ إِنَّ كُلَّ مَا عَقَرَ النَّاسَ وَعَدَا عَلَيْهِمْ وَأَخَافَهُمْ مِثْلَ الْأَسَدِ وَالنَّمِرِ وَالْفَهْدِ وَالذِّئْبِ فَهُوَ الْكَلْبُ الْعَقُورُ
[Machine] In his saying, "And the dog Al-Aqur," he said: "It has reached me from Sufyan ibn Uyayna that he said, its meaning is every male dog, without specifying it to the dog." Abu 'Ubayd said: It is permissible to say for the wolf 'dog', do you not see that they mention in the battles that 'Utbah ibn Abi Lahab was harshly harming the Prophet ﷺ , so he said: "O Allah, set upon him a dog from Your dogs." So 'Utbah left to the Levant with his companions and they stayed in a house, and a lion came upon them, so it passed by them towards him and killed him. So here, the name of the dog became attached to it. And from this is His saying, magnified is He, {And you have not been taught of the birds whatever is trained as hunting animals} [Al-Ma'idah: 4]. So this is a derived name from the dog, and then it entered the hunting of the cheetah, falcon, and hawk. So for this reason, for every wild or tame animal from the predators, it is said 'dog al-aqur'. And it has also been narrated that Swayd ibn Ghaflah said: 'Umar ibn al-Khattab commanded us to kill snakes, scorpions, mice, and wasps while we are in a state of pilgrimage.
فِي قَوْلِهِ وَالْكَلْبُ الْعَقُورُ قَالَ بَلَغَنِي عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ أَنَّهُ قَالَ مَعْنَاهُ كُلُّ سَبُعٍ يَعْقِرُ وَلَمْ يَخُصَّ بِهِ الْكَلْبَ قَالَ أَبُو عُبَيْدٍ قَدْ يَجُوزُ فِي الْكَلَامِ أَنْ يُقَالَ لَلسَّبُعِ كَلْبٌ أَلَا تَرَى أَنَّهُمْ يَرْوُونَ فِي الْمَغَازِي أَنَّ عُتْبَةَ بْنَ أَبِي لَهَبٍ كَانَ شَدِيدَ الْأَذَى لِلنَّبِيِّ ﷺ فَقَالَ اللهُمَّ سَلِّطْ عَلَيْهِ كَلْبًا مِنْ كِلَابِكَ فَخَرَجَ عُتْبَةُ إِلَى الشَّامِ مَعَ أَصْحَابِهِ فَنَزَلَ مَنْزِلًا فَطَرَقَهُمُ الْأَسَدُ فَتَخَطَّى إِلَيْهِ مِنْ بَيْنِ أَصْحَابِهِ فَقَتَلَهُ فَصَارَ الْأَسَدُ هَا هُنَا قَدْ لَزِمَهُ اسْمُ الْكَلْبِ قَالَ وَمِنْ ذَلِكَ قَوْلُهُ تَعَالَى {وَمَا عَلَّمْتُمْ مِنَ الْجَوَارِحِ مُكَلِّبِينَ} [المائدة 4] فَهَذَا اسْمٌ مُشْتَقٌّ مِنَ الْكَلْبِ ثُمَّ دَخَلَ فِيهِ صَيْدُ الْفَهْدِ وَالصَّقْرِ وَالْبَازِيِّ فَلِهَذَا قِيلَ لِكُلِّ جَارِحٍ أَوْ عَاقِرٍ مِنَ السِّبَاعِ كَلْبٌ عَقُورٌ وَرُوِّينَا عَنْ سُوَيْدِ بْنِ غَفَلَةَ قَالَ أَمَرَنَا عُمَرُ بْنُ الْخَطَّابِ ؓ أَنْ نَقْتُلَ الْحَيَّةَ وَالْعَقْرَبَ وَالْفَأْرَةَ وَالزُّنْبُورَ وَنَحْنُ مُحْرِمُونَ
[Machine] "The first time I saw Al-Zuhri, I approached him while he was talking to people. I heard him say that Salim ibn Abdullah informed him that his father said Umar ibn al-Khattab was asked about killing a snake, and he replied that it is an enemy, so kill it wherever you find it."
أَوَّلَ مَا رَأَيْتُ الزُّهْرِيَّ انْتَهَيْتُ إِلَيْهِ وَهُوَ يُحَدِّثُ النَّاسَ سَمِعْتُهُ يَقُولُ أَخْبَرَنِي سَالِمُ بْنُ عَبْدِ اللهِ عَنْ أَبِيهِ قَالَ سُئِلَ عُمَرُ بْنُ الْخَطَّابِ ؓ عَنِ الْحَيَّةِ يَقْتُلُهَا الْمُحْرِمُ قَالَ هِيَ عَدُوٌّ فَاقْتُلُوهَا حَيْثُ وَجَدْتُمُوهَا
[Machine] Hammad was a man in Kufa who was very knowledgeable in interpreting the teachings of Ibrahim. This was due to his limited knowledge of the Prophet's hadith (sayings) and his inability to follow and imitate the ways of the people of Kufa like the scholar Sha'bi, who was known for his extensive knowledge.
حَمَّادٌ مَا كَانَ بِالْكُوفَةِ رَجُلٌ أَوْحَشَ بِرَدِّ الْآثَارِ مِنْ إِبْرَاهِيمَ؛ وَذَلِكَ لِقِلَّةِ مَا سَمِعَ مِنْ حَدِيثِ النَّبِيِّ ﷺ وَلَا كَانَ رَجُلٌ بِالْكُوفَةِ أَحْسَنَ اتِّبَاعًا وَلَا أَحْسَنَ اقْتِدَاءً مِنَ الشَّعْبِيِّ؛ وَذَلِكَ لِكَثْرَةِ مَا سَمِعَ
[Machine] I heard Al-Shafi'i Muhammad bin Idris saying in Makkah: "Ask me whatever you want, and I will answer you from the Book of Allah and the Sunnah of His Messenger." Then I said to him, "May Allah rectify your speech. How can it be permissible to kill a wasp during the sacred month?" He replied, "Yes, In the name of Allah, the Most Gracious, the Most Merciful. Allah the Exalted says, 'Whatever the Messenger gives you, take it, and whatever he forbids you from, abstain from it.'" [Surah Al-Hashr, verse 7]
سَمِعْتُ الشَّافِعِيَّ مُحَمَّدَ بْنَ إِدْرِيسَ بِمَكَّةَ يَقُولُ سَلُونِي مَا شِئْتُمْ أُجِبْكُمْ مِنْ كِتَابِ اللهِ ﷻ وَمِنْ سُنَّةِ رَسُولِ اللهِ ﷺ قَالَ فَقُلْتُ لَهُ أَصْلَحَكَ اللهُ مَا تَقُولُ فِي الْمُحْرِمِ يَقْتُلُ زُنْبُورًا؟ قَالَ نَعَمْ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ قَالَ اللهُ تَعَالَى {مَا آتَاكُمُ الرَّسُولُ فَخُذُوهُ وَمَا نَهَاكُمْ عَنْهُ فَانْتَهُوا} [الحشر 7]
[Machine] The Messenger of Allah, ﷺ , said, "Follow those who come after me, Abu Bakr and Umar."
قَالَ رَسُولُ اللهِ ﷺ اقْتَدُوا بِاللَّذَيْنِ مِنْ بَعْدِي أَبِي بَكْرٍ وَعُمَرَ
[Machine] "That he commanded the person in charge to kill the wasps."
أَنَّهُ أَمَرَ الْمُحْرِمَ بِقَتْلِ الزُّنْبُورِ
