١٢۔ كِتَابُ الْحَجِّ ص ٢٨
[Machine] Malik, who was ordered to be killed, said: "Indeed, whatever attacks people and terrifies them, like lions, tigers, leopards, and wolves, is the crippled dog."
قَالَ مَالِكٌ الْكَلْبُ الْعَقُورُ الَّذِي أُمِرَ الْمُحْرِمُ بِقَتْلِهِ إِنَّ كُلَّ مَا عَقَرَ النَّاسَ وَعَدَا عَلَيْهِمْ وَأَخَافَهُمْ مِثْلَ الْأَسَدِ وَالنَّمِرِ وَالْفَهْدِ وَالذِّئْبِ فَهُوَ الْكَلْبُ الْعَقُورُ
[Machine] In his saying, "And the dog Al-Aqur," he said: "It has reached me from Sufyan ibn Uyayna that he said, its meaning is every male dog, without specifying it to the dog." Abu 'Ubayd said: It is permissible to say for the wolf 'dog', do you not see that they mention in the battles that 'Utbah ibn Abi Lahab was harshly harming the Prophet ﷺ , so he said: "O Allah, set upon him a dog from Your dogs." So 'Utbah left to the Levant with his companions and they stayed in a house, and a lion came upon them, so it passed by them towards him and killed him. So here, the name of the dog became attached to it. And from this is His saying, magnified is He, {And you have not been taught of the birds whatever is trained as hunting animals} [Al-Ma'idah: 4]. So this is a derived name from the dog, and then it entered the hunting of the cheetah, falcon, and hawk. So for this reason, for every wild or tame animal from the predators, it is said 'dog al-aqur'. And it has also been narrated that Swayd ibn Ghaflah said: 'Umar ibn al-Khattab commanded us to kill snakes, scorpions, mice, and wasps while we are in a state of pilgrimage.
فِي قَوْلِهِ وَالْكَلْبُ الْعَقُورُ قَالَ بَلَغَنِي عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ أَنَّهُ قَالَ مَعْنَاهُ كُلُّ سَبُعٍ يَعْقِرُ وَلَمْ يَخُصَّ بِهِ الْكَلْبَ قَالَ أَبُو عُبَيْدٍ قَدْ يَجُوزُ فِي الْكَلَامِ أَنْ يُقَالَ لَلسَّبُعِ كَلْبٌ أَلَا تَرَى أَنَّهُمْ يَرْوُونَ فِي الْمَغَازِي أَنَّ عُتْبَةَ بْنَ أَبِي لَهَبٍ كَانَ شَدِيدَ الْأَذَى لِلنَّبِيِّ ﷺ فَقَالَ اللهُمَّ سَلِّطْ عَلَيْهِ كَلْبًا مِنْ كِلَابِكَ فَخَرَجَ عُتْبَةُ إِلَى الشَّامِ مَعَ أَصْحَابِهِ فَنَزَلَ مَنْزِلًا فَطَرَقَهُمُ الْأَسَدُ فَتَخَطَّى إِلَيْهِ مِنْ بَيْنِ أَصْحَابِهِ فَقَتَلَهُ فَصَارَ الْأَسَدُ هَا هُنَا قَدْ لَزِمَهُ اسْمُ الْكَلْبِ قَالَ وَمِنْ ذَلِكَ قَوْلُهُ تَعَالَى {وَمَا عَلَّمْتُمْ مِنَ الْجَوَارِحِ مُكَلِّبِينَ} [المائدة 4] فَهَذَا اسْمٌ مُشْتَقٌّ مِنَ الْكَلْبِ ثُمَّ دَخَلَ فِيهِ صَيْدُ الْفَهْدِ وَالصَّقْرِ وَالْبَازِيِّ فَلِهَذَا قِيلَ لِكُلِّ جَارِحٍ أَوْ عَاقِرٍ مِنَ السِّبَاعِ كَلْبٌ عَقُورٌ وَرُوِّينَا عَنْ سُوَيْدِ بْنِ غَفَلَةَ قَالَ أَمَرَنَا عُمَرُ بْنُ الْخَطَّابِ ؓ أَنْ نَقْتُلَ الْحَيَّةَ وَالْعَقْرَبَ وَالْفَأْرَةَ وَالزُّنْبُورَ وَنَحْنُ مُحْرِمُونَ
[Machine] "The first time I saw Al-Zuhri, I approached him while he was talking to people. I heard him say that Salim ibn Abdullah informed him that his father said Umar ibn al-Khattab was asked about killing a snake, and he replied that it is an enemy, so kill it wherever you find it."
أَوَّلَ مَا رَأَيْتُ الزُّهْرِيَّ انْتَهَيْتُ إِلَيْهِ وَهُوَ يُحَدِّثُ النَّاسَ سَمِعْتُهُ يَقُولُ أَخْبَرَنِي سَالِمُ بْنُ عَبْدِ اللهِ عَنْ أَبِيهِ قَالَ سُئِلَ عُمَرُ بْنُ الْخَطَّابِ ؓ عَنِ الْحَيَّةِ يَقْتُلُهَا الْمُحْرِمُ قَالَ هِيَ عَدُوٌّ فَاقْتُلُوهَا حَيْثُ وَجَدْتُمُوهَا
[Machine] Hammad was a man in Kufa who was very knowledgeable in interpreting the teachings of Ibrahim. This was due to his limited knowledge of the Prophet's hadith (sayings) and his inability to follow and imitate the ways of the people of Kufa like the scholar Sha'bi, who was known for his extensive knowledge.
حَمَّادٌ مَا كَانَ بِالْكُوفَةِ رَجُلٌ أَوْحَشَ بِرَدِّ الْآثَارِ مِنْ إِبْرَاهِيمَ؛ وَذَلِكَ لِقِلَّةِ مَا سَمِعَ مِنْ حَدِيثِ النَّبِيِّ ﷺ وَلَا كَانَ رَجُلٌ بِالْكُوفَةِ أَحْسَنَ اتِّبَاعًا وَلَا أَحْسَنَ اقْتِدَاءً مِنَ الشَّعْبِيِّ؛ وَذَلِكَ لِكَثْرَةِ مَا سَمِعَ
[Machine] I heard Al-Shafi'i Muhammad bin Idris saying in Makkah: "Ask me whatever you want, and I will answer you from the Book of Allah and the Sunnah of His Messenger." Then I said to him, "May Allah rectify your speech. How can it be permissible to kill a wasp during the sacred month?" He replied, "Yes, In the name of Allah, the Most Gracious, the Most Merciful. Allah the Exalted says, 'Whatever the Messenger gives you, take it, and whatever he forbids you from, abstain from it.'" [Surah Al-Hashr, verse 7]
سَمِعْتُ الشَّافِعِيَّ مُحَمَّدَ بْنَ إِدْرِيسَ بِمَكَّةَ يَقُولُ سَلُونِي مَا شِئْتُمْ أُجِبْكُمْ مِنْ كِتَابِ اللهِ ﷻ وَمِنْ سُنَّةِ رَسُولِ اللهِ ﷺ قَالَ فَقُلْتُ لَهُ أَصْلَحَكَ اللهُ مَا تَقُولُ فِي الْمُحْرِمِ يَقْتُلُ زُنْبُورًا؟ قَالَ نَعَمْ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ قَالَ اللهُ تَعَالَى {مَا آتَاكُمُ الرَّسُولُ فَخُذُوهُ وَمَا نَهَاكُمْ عَنْهُ فَانْتَهُوا} [الحشر 7]
[Machine] The Messenger of Allah, ﷺ , said, "Follow those who come after me, Abu Bakr and Umar."
قَالَ رَسُولُ اللهِ ﷺ اقْتَدُوا بِاللَّذَيْنِ مِنْ بَعْدِي أَبِي بَكْرٍ وَعُمَرَ
[Machine] "That he commanded the person in charge to kill the wasps."
أَنَّهُ أَمَرَ الْمُحْرِمَ بِقَتْلِ الزُّنْبُورِ
12.313 [Machine] The forbidden person cannot redeem himself unless his meat is eaten. As evidence from what has passed, and that Allah, may He be glorified and exalted, has forbidden them in ihram, as He says: {And He has forbidden upon you the game of the land while you are in ihrām} [Al-Mā'idah: 96], whatsoever was permissible for them before ihram they may eat.
١٢۔٣١٣ بَابٌ: لَا يَفْدِي الْمُحْرِمُ إِلَّا مَا يُؤْكَلُ لَحْمُهُ اسْتِدْلَالًا بِمَا مَضَى, وَبِأَنَّهُ ﷻ إِنَّمَا حَرَّمَ عَلَيْهِمْ فِي الْإِحْرَامِ بِقَوْلِهِ {وَحُرِّمَ عَلَيْكُمْ صَيْدُ الْبَرِّ مَا دُمْتُمْ حُرُمًا} [المائدة: 96] مَا كَانَ حَلَالًا لَهُ قَبْلَ الْإِحْرَامِ يَأْكُلُونَهُ
[Machine] That he saw Umar ibn al-Khattab taking a bath and washing his hair while he had a camel tied in the water, and it was prohibited.
أَنَّهُ رَأَى عُمَرَ بْنَ الْخَطَّابِ ؓ يُقَرِّدُ بَعِيرًا لَهُ فِي طِينٍ بِالسُّقْيَا وَهُوَ مُحْرِمٌ هَكَذَا
[Machine] About Malik in Al-Muwatta, they added to it and it is forbidden.
عَنْ مَالِكٍ فِي الْمُوَطَّأِ زَادُوا فِيهِ وَهُوَ مُحْرِمٌ
[Machine] He saw Umar ibn Al-Khattab riding a camel in the mud, while it was in a state of consecration.
أَنَّهُ رَأَى عُمَرَ بْنَ الْخَطَّابِ ؓ يُقَرِّدُ بَعِيرًا لَهُ فِي الطِّينِ بِالسُّقْيَا وَهُوَ مُحْرِمٌ
[Machine] It is said that the smallest thing for one camel is a "qamqama", and when it grows, it becomes a "hamnana", and when it becomes bigger, it becomes a "halmama". It is said that Ibn Abbas did not see any harm in tying the camel with a rope made of mud or with the hand.
يُقَالُ لِلْقُرَادِ أَصْغَرَ مَا يَكُونُ لِلْوَاحِدَةِ قَمْقَامَةٌ فَإِذَا كَبِرَتْ فَهِيَ حَمْنَانَةٌ فَإِذَا عَظُمَتْ فَهِيَ حَلَمَةٌ قَالَ وَالَّذِي يُرَادُ مِنْ هَذَا أَنَّ ابْنَ عَبَّاسٍ لَمْ يَرَ بِتَقْرِيدِ الْمُحْرِمِ الْبَعِيرَ بَأْسًا وَالتَّقْرِيدُ أَنْ يُنْزَعُ مِنْهُ الْقُرْدَانُ بِالطِّينِ أَوْ بِالْيَدِ
[Machine] Abu Al-Abbas Al-Asamm narrated to us that Al-Rabi' said: I am Al-Shafi'i, I am a Muslim. Ibn Jurayj reported that 'Ata' said: The forbidden game should not be redeemed except for its edible meat.
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا مُسْلِمٌ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ قَالَ لَا يَفْدِي الْمُحْرِمُ مِنَ الصَّيْدِ إِلَّا مَا يُؤْكَلُ لَحْمُهُ
12.314 [Machine] The killing of lice
١٢۔٣١٤ بَابُ قَتْلِ الْقُمَّلِ
تِلْكَ الضَّالَّةُ لَا تُبْتَغَى
[Machine] Did you get rid of the lice? It does no good to scratch your head and what you wanted from it, and we were only forbidden from killing the prey.
بَعُدْتَ مَا لِلْقَمْلَةِ؟ مَا يُغْنِي مِنْ حَكِّ رَأْسِكَ وَمَا إِيَّاهَا أَرَدْتَ وَمَا نُهِيتُمْ إِلَّا عَنْ قَتْلِ الصَّيْدِ
ابْنُ عُمَرَ ؓ أَهْوَنُ قَتِيلٍ
[Machine] That he used to dye his beard while fasting and look at himself in the mirror while in a state of ihram. He said: "The person in ihram should not shave his head unless he slaughters an animal or cuts off the head of an animal."
أَنَّهُ كَانَ يَسْتَاكُ وَهُوَ صَائِمٌ وَيَنْظُرُ فِي الْمَرْآةِ وَهُوَ مُحْرِمٌ قَالَ وَقَالَ يَحُكُّ الْمُحْرِمُ رَأْسَهُ مَا لَمْ يَقْتُلْ دَابَّةً أَوْ جِلْدَةَ رَأْسِهِ أَنْ يُدْمِيَهُ
[Machine] I heard Ibn Umar saying regarding the lice, the forbidden one kills it by giving a small amount or a handful of food in charity.
سَمِعْتُ ابْنَ عُمَرَ يَقُولُ فِي الْقَمْلَةِ يَقْتُلُهَا الْمُحْرِمُ يَتَصَدَّقُ بِكَسْرَةٍ أَوْ قَبْضٍ مِنْ طَعَامٍ
12.315 [Machine] The prohibition of killing ants, whether they are prohibited or not, as well as what does not harm from what is not eaten.
١٢۔٣١٥ بَابُ كَرَاهِيَةِ قَتْلِ النَّمْلَةِ لِلْمُحْرِمِ , وَغَيْرِ الْمُحْرِمِ وَكَذَلِكَ مَا لَا ضَرَرَ فِيهِ مِمَّا لَا يُؤْكَلُ
[Machine] Narrated by the Messenger of Allah ﷺ , that an ant bit one of the prophets, so he ordered for the ant village to be burned. Then, Allah revealed to him, "Are you to destroy an entire nation of ants because one ant bit you while magnifying Me?"
عَنْ رَسُولِ اللهِ ﷺ أَنَّ النَّمْلَةَ قَرَصَتْ نَبِيًّا مِنَ الْأَنْبِيَاءِ فَأَمَرَ بِقَرْيَةِ النَّمْلِ فَأُحْرِقَتْ فَأَوْحَى اللهُ إِلَيْهِ أَفِي أَنْ قَرَصَتْكَ نَمْلَةٌ أَهْلَكْتَ أُمَّةً مِنَ الْأُمَمِ تُسَبِّحُ؟
A prophet got down beneath a tree and he was stung by an ant. He ordered regarding the baggage and it was removed from beneath it. He then ordered regarding it and it was burnt. Allah then revealed to him : why not (just) one ant? (Using translation from Abū Dāʾūd 5265)
قَالَ رَسُولُ اللهِ ﷺ نَزَلَ نَبِيٌّ مِنَ الْأَنْبِيَاءِ تَحْتَ شَجَرَةٍ فَلَدَغَتْهُ نَمْلَةٌ فَأَمَرَ بِجَهَازِهِ فَأُخْرِجَ مِنْ تَحْتِهَا وَأَمَرَ بِهَا فَأُحْرِقَتْ فِي النَّارِ فَأَوْحَى اللهُ إِلَيْهِ فَهَلَّا نَمْلَةً وَاحِدَةً؟
The Prophet ﷺ prohibited to kill four creatures: ants, bees, hoopoes, and sparrow-hawks. (Using translation from Abū Dāʾūd 5267)
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ قَتْلِ أَرْبَعٍ مِنَ الدَّوَابِّ النَّمْلَةِ وَالنَّحْلَةِ وَالْهُدْهُدِ وَالصُّرَدِ
[Machine] The Messenger of Allah ﷺ said: A woman was punished in Hell for keeping a cat captive until it died of hunger. He said: By Allah, I know that she did not feed it or give it drink when she kept it captive, and she did not allow it to go out and eat from the plants of the earth. In another narration by Ibn Wahb, it is mentioned that she entered the Fire and it will be said to her: By Allah, I know that you did not feed it or give it drink when you kept it captive, and you did not allow it to go out and eat from the plants of the earth until it died of hunger.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ عُذِّبَتِ امْرَأَةٌ فِي هِرَّةٍ حَبَسَتْهَا حَتَّى مَاتَتْ جُوعًا فَدَخَلْتِ النَّارَ قَالَ فَقَالَ وَاللهُ أَعْلَمُ لَمْ تُطْعِمْهَا وَلَمْ تَسْقِهَا حِينَ حَبَسَتْهَا وَلَمْ تُرْسِلْهَا فَتَأْكُلَ مِنْ خَشَاشِ الْأَرْضِ وَفِي رِوَايَةِ ابْنِ وَهْبٍ فَدَخَلَتْ فِيهَا النَّارَ وَيُقَالُ لَهَا وَاللهُ أَعْلَمُ لَا أَنْتِ أَطْعَمْتِهَا وَسَقَيْتِهَا حِينَ حَبَسْتِهَا وَلَا أَنْتِ أَرْسَلْتِهَا فَتَأْكُلُ مِنْ خَشَاشِ الْأَرْضِ حَتَّى مَاتَتْ جُوعًا
أَنْ يَقْتُلَ الرَّجُلُ مَا لَا يَضُرُّهُ
أَنْ يَقْتُلَ الرَّجُلُ مَا لَا يَضُرُّهُ
12.316 [Machine] Collective Blockade Gates
١٢۔٣١٦ جُمَّاعُ أَبْوَابِ الْإِحْصَارِ
12.317 [Machine] Who is prohibited and targeted by an enemy
١٢۔٣١٧ بَابُ مَنْ أُحْصِرَ بِعَدُوٍّ وَهُوَ مُحْرِمٌ قَالَ اللهُ تَعَالَى {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ وَلَا تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ بِهِ أَذًى مِنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ} , قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَلَمْ أَسْمَعْ مِمَّنْ حَفِظْتُ عَنْهُ مِنْ أَهْلِ الْعِلْمِ بِالتَّفْسِيرِ مُخَالِفًا فِي أَنَّ هَذِهِ الْآيَةَ نَزَلَتْ بِالْحُدَيْبِيَةِ حِينَ أُحْصِرَ النَّبِيُّ ﷺ فَحَالَ الْمُشْرِكُونَ بَيْنَهُ وَبَيْنَ الْبَيْتِ , وَأَنَّ النَّبِيَّ ﷺ نَحَرَ بِالْحُدَيْبِيَةِ وَحَلَقَ , وَرَجَعَ حَلَالًا وَلَمْ يَصِلْ إِلَى الْبَيْتِ وَلَا أَصْحَابُهُ إِلَّا عُثْمَانَ بْنَ عَفَّانَ وَحْدَهُ
That Messenger of Allah ﷺ saw him with the lice falling (from his head) on his face. Messenger of Allah ﷺ said, "Are your lice troubling you? Kaʿb said, "Yes." Messenger of Allah ﷺ thus ordered him to shave his head while he was at Al-Hudaibiya. Up to then there was no indication that all of them would finish their state of Ihram and they hoped that they would enter Mecca. Then the order of Al-Fidya was revealed, so Messenger of Allah ﷺ ordered Kaʿb to feed six poor persons with one Faraq of food or slaughter a sheep or fast for three days. أَنَّ رَسُولَ اللهِ ﷺ رَآهُ وَالْقُمَّلُ يَسْقُطُ عَلَى وَجْهِهِ فَقَالَ لَهُ أَيُؤْذِيكَ هَوَامُّكَ؟ قَالَ نَعَمْ فَأَمَرَهُ أَنْ يَحْلِقَ قَالَ وَهُمْ بِالْحُدَيْبِيَةِ لَمْ يَتَبَيَّنْ لَهُمْ أَنَّهُمْ يَحِلُّونَ بِهَا وَهُمْ عَلَى طَمَعٍ مِنْ دُخُولِ مَكَّةَ فَأَنْزَلَ اللهُ الْفِدْيَةَ وَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُطْعِمَ فَرَقًا بَيْنَ سِتَّةِ مَسَاكِينَ أَوْ صَوْمُ ثَلَاثَةِ أَيَّامٍ أَوْ نُسُكُ شَاةٍ
[Machine] We made the pilgrimage to the Kaaba just as we did with the Messenger of Allah ﷺ . He performed Umrah and set off until he reached an open space. He turned to his companions and said, "I only see them as one. Bear witness that I have combined Hajj with Umrah." He continued until he reached the Kaaba and performed tawaf around it seven times. He also performed seven sa'is between Safa and Marwa. He did not add anything to that. He saw that he had fulfilled its obligation and narrated the words of Yahya ibn Yahya. In another narration of Ibn Bukayr, he performed Umrah because the Messenger of Allah ﷺ performed Umrah during the year of Hudaybiyyah. The rest of the statement has the same meaning. Ash-Shafi'i (may Allah have mercy on him) said, "If I am prevented from reaching the Kaaba, we will do as we did with the Messenger of Allah ﷺ , meaning we will declare it lawful as we declared it lawful with the Messenger of Allah ﷺ during the year of Hudaybiyyah."
عَنِ الْبَيْتِ صَنَعْنَا كَمَا صَنَعْنَا مَعَ رَسُولِ اللهِ ﷺ فَخَرَجَ فَأَهَلَّ بِعُمْرَةٍ وَسَارَ حَتَّى ظَهَرَ عَلَى الْبَيْدَاءِ الْتَفَتَ إِلَى أَصْحَابِهِ فَقَالَ مَا أُرَاهُمَا إِلَّا وَاحِدًا أُشْهِدُكُمْ أَنِّي قَدْ أَوْجَبْتُ الْحَجَّ مَعَ الْعُمْرَةِ فَخَرَجَ حَتَّى إِذَا جَاءَ الْبَيْتَ فَطَافَ بِهِ سَبْعًا وَبَيْنَ الصَّفَا وَالْمَرْوَةِ سَبْعًا لَمْ يَزِدْ عَلَيْهِ وَرَأَى أَنَّهُ مُجْزِئٌ عَنْهُ وَأَهْدَى لَفْظُ حَدِيثِ يَحْيَى بْنِ يَحْيَى وَفِي رِوَايَةِ ابْنِ بُكَيْرٍ فَأَهَلَّ بِعُمْرَةٍ مِنْ أَجْلِ أَنَّ رَسُولَ اللهِ ﷺ أَهَلَّ بِعُمْرَةٍ عَامَ الْحُدَيْبِيَةِ وَالْبَاقِي بِمَعْنَاهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ إِنْ صُدِدْتُ عَنِ الْبَيْتِ صَنَعْنَا كَمَا صَنَعْنَا مَعَ رَسُولِ اللهِ ﷺ يَعْنِي أَحْلَلْنَا كَمَا أَحْلَلْنَا مَعَ رَسُولِ اللهِ ﷺ عَامَ الْحُدَيْبِيَةِ
[Machine] Ibn Makhrama and Marwan Ibn Al-Hakam both confirmed the narration of each other. They said: The Messenger of Allah ﷺ left Hudaybiyah with around ten thousand of his companions until they reached Al-Hulayfah. The Messenger of Allah ﷺ performed the Tawaf, wore the Ihram, and began the Umrah. He then mentioned the narration about his stay in Hudaybiyah and his journey until the furthest point in Hudaybiyah. Then, he mentioned the arrival of Suhayl Ibn Amr and what incidents occurred when they prevented him from entering the Ka'bah. When he finished dealing with the contractual agreements, the Messenger of Allah ﷺ said to his companions, "Get up and perform the sacrifice, then shave your heads." He said this three times, but no one from among them stood up. Finally, a man stood up and went to Umm Salamah and informed her about what the people were doing. She said, "O Messenger of Allah, do you desire this?" He replied, "Go out and do not speak to any of them until you have slaughtered your sacrificial animal and asked your hairdresser to shave your head." He then went out and did not speak to any of them until he slaughtered his sacrificial animal and asked his hairdresser to shave his head. When they saw this, they all stood up and began slaughtering their sacrificial animals. Some of them were even helping each other to shave their heads to the point that it seemed like they were about to kill each other out of jealousy and competition.
بْنِ مَخْرَمَةَ وَمَرْوَانَ بْنِ الْحَكَمِ يُصَدِّقُ حَدِيثُ كُلِّ وَاحِدٍ مِنْهُمَا صَاحِبَهُ قَالَا خَرَجَ رَسُولُ اللهِ ﷺ زَمَنَ الْحُدَيْبِيَةِ فِي بِضْعَ عَشْرَةَ مِائَةٍ مِنْ أَصْحَابِهِ حَتَّى إِذَا كَانُوا بِذِي الْحُلَيْفَةِ قَلَّدَ رَسُولُ اللهِ ﷺ الْهَدْيَ وَأَشْعَرَ وَأَحْرَمَ بِالْعُمْرَةِ وَذَكَرَ الْحَدِيثَ بِطُولِهِ فِي نُزُولِهِ أَقْصَى الْحُدَيْبِيَةِ ثُمَّ فِي مَجِيءِ سُهَيْلِ بْنِ عَمْرٍو وَمَا قَاضَاهُ عَلَيْهِ حِينَ صَدُّوهُ عَنِ الْبَيْتِ قَالَ فَلَمَّا فَرَغَ مِنْ قَضِيَّةِ الْكِتَابِ قَالَ رَسُولُ اللهِ ﷺ لِأَصْحَابِهِ قُومُوا فَانْحَرُوا ثُمَّ احْلِقُوا قَالَ فَوَاللهِ مَا قَامَ مِنْهُمْ رَجُلٌ حَتَّى قَالَ ذَلِكَ ثَلَاثَ مَرَّاتٍ فَلَمَّا لَمْ يَقُمْ مِنْهُمْ أَحَدٌ قَامَ فَدَخَلَ عَلَى أُمِّ سَلَمَةَ فَذَكَرَ لَهَا مَا لَقِيَ مِنَ النَّاسِ فَقَالَتْ أُمُّ سَلَمَةَ ؓ يَا رَسُولَ اللهِ أَتُحِبُّ ذَلِكَ؟ اخْرُجْ ثُمَّ لَا تُكَلِّمْ أَحَدًا مِنْهُمْ كَلِمَةً حَتَّى تَنْحَرَ بُدْنَكَ وَتَدْعُوَ حَالِقَكَ فَيَحْلِقَكَ فَقَامَ فَخَرَجَ فَلَمْ يُكَلِّمْ أَحَدًا مِنْهُمْ حَتَّى فَعَلَ ذَلِكَ نَحَرَ هَدْيَهُ وَدَعَا حَالِقَهُ فَحَلَقَهُ فَلَمَّا رَأَوْا ذَلِكَ قَامُوا فَنَحَرُوا وَجَعَلَ بَعْضُهُمْ يَحْلِقُ لِبَعْضٍ حَتَّى كَادَ بَعْضُهُمْ يَقْتُلُ بَعْضًا غَمًّا
[Machine] "O Messenger of Allah, do not blame them, for the people have been struck by a great affair upon seeing you taking responsibility for the reconciliation and your departure without being granted victory. So, O Messenger of Allah, go out and do not speak to anyone until you perform your Hajj rituals and sacrifice. For when the people see you doing that, they will follow your example. So the Messenger of Allah left the place without speaking to anyone until he reached his destination and performed his Hajj rituals and sacrifice. When the people saw the Messenger of Allah doing this, they got up and followed his example and performed the Hajj rituals and sacrifice, some shaving their heads and others trimming their hair. The Messenger of Allah supplicated, 'O Allah, forgive those who have shaved their heads thrice.' It was said, 'O Messenger of Allah, what about those who have trimmed their hair?' He repeated, 'O Allah, forgive those who have shaved their heads thrice.' It was said, 'O Messenger of Allah, what about those who have trimmed their hair?' He then said, 'And forgive those who have trimmed their hair once.' Then the Messenger of Allah returned and Ibn Ishaq narrated that Abdullah bin Abi Najeeh narrated from Mujahid from Ibn Abbas that he was asked, 'Why did the Messenger of Allah single out three for those who shaved their heads and one for those who trimmed their hair?' He replied, 'Because they did not hesitate.'"
يَا رَسُولَ اللهِ لَا تَلُمْهُمْ فَإِنَّ النَّاسَ قَدْ دَخَلَهُمْ أَمْرٌ عَظِيمٌ مِمَّا رَأَوْكَ حَمَلَتْ عَلَى نَفْسِكَ فِي الصُّلْحِ وَرَجْعَتِكَ وَلَمْ يُفْتَحْ عَلَيْكَ فَاخْرُجْ يَا رَسُولَ اللهِ فَلَا تُكَلِّمْ أَحَدًا مِنَ النَّاسِ حَتَّى تَأْتِيَ هَدْيَكَ فَتَنْحَرَ وَتَحِلَّ فَإِنَّ النَّاسَ إِذَا رَأَوْكَ فَعَلْتَ ذَلِكَ فَعَلُوا كَالَّذِي فَعَلْتَ فَخَرَجَ رَسُولُ اللهِ ﷺ مِنْ عِنْدِهَا فَلَمْ يُكَلِّمْ أَحَدًا حَتَّى أَتَى هَدْيَهُ فَنَحَرَ وَحَلَقَ فَلَمَّا رَأَى النَّاسُ رَسُولَ اللهِ ﷺ قَدْ فَعَلَ ذَلِكَ قَامُوا فَفَعَلُوا فَنَحَرُوا وَحَلَقَ بَعْضٌ وَقَصَّرَ بَعْضٌ فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ اغْفِرْ لِلْمُحَلِّقِينَ ثَلَاثًا فَقِيلَ يَا رَسُولَ اللهِ وَالْمُقَصِّرِينَ فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ اغْفِرْ لِلْمُحَلِّقِينَ ثَلَاثًا قِيلَ يَا رَسُولَ اللهِ وَلِلْمُقَصِّرِينَ فَقَالَ وَلِلْمُقَصِّرِينَ ثُمَّ انْصَرَفَ رَسُولُ اللهِ ﷺ رَاجِعًا وَعَنِ ابْنِ إِسْحَاقَ قَالَ حَدَّثَنِي عَبْدُ اللهِ بْنُ أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ قِيلَ لَهُ لِمَ ظَاهَرَ رَسُولُ اللهِ ﷺ لِلْمُحَلِّقِينَ ثَلَاثًا وَلِلْمُقَصِّرِينَ وَاحِدَةً؟ فَقَالَ إِنَّهُمْ لَمْ يَشُكُّوا
12.318 [Machine] The besieged is slaughtered and subdued wherever he is besieged
١٢۔٣١٨ بَابُ الْمُحْصَرِ يَذْبَحُ وَيَحِلُّ حَيْثُ أُحْصِرَ
[Machine] We sacrificed with the Messenger of Allah ﷺ in Hudaybiyah: a camel for each of the seven and a cow for each of the seven.
نَحَرْنَا مَعَ رَسُولِ اللهِ ﷺ بِالْحُدَيْبِيَةِ الْبَدَنَةَ عَنْ سَبْعَةٍ وَالْبَقَرَةَ عَنْ سَبْعَةٍ
[Machine] We accompanied the Messenger of Allah ﷺ as pilgrims, and when the disbelievers of Quraysh blocked our way to the Kaaba, the Messenger of Allah ﷺ sacrificed his sacrificial animal and shaved his head, then we returned.
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ مُعْتَمِرِينَ فَحَالَ كُفَّارُ قُرَيْشٍ دُونَ الْبَيْتِ فَنَحَرَ رَسُولُ اللهِ ﷺ هَدْيَهُ وَحَلَقَ رَأْسَهُ ثُمَّ رَجَعَ
[Machine] We went out with the Messenger of Allah ﷺ and the disbelievers of Quraysh blocked the way to the Kaaba. So the Messenger of Allah ﷺ sacrificed his offering, shaved his head, and I bear witness that I have obliged myself to perform Umrah, if Allah wills, I will soon depart. If I am prevented from reaching the Kaaba, I will do as the Messenger of Allah ﷺ did when he was prevented. So I arrived in Mecca and performed Umrah at Dhu al-Hulayfah. Then he set out for a while and said, "Their affairs are the same." I bear witness that I have obliged myself to perform Hajj along with Umrah. They did not become lawful from it until the day of sacrifice, and he made Sa'iy between Safa and Marwa in one Tawaf. When he entered Mecca.
قَدْ خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فَحَالَ كُفَّارُ قُرَيْشٍ دُونَ الْبَيْتِ فَنَحَرَ رَسُولُ اللهِ ﷺ هَدْيَهُ وَحَلَقَ رَأْسَهُ وَأُشْهِدُكُمْ أَنِّي قَدْ أَوْجَبْتُ عُمْرَةً إِنْ شَاءَ اللهُ أَنْطَلِقُ فَإِنْ خُلِّيَ بَيْنِي وَبَيْنَ الْبَيْتِ طُفْتُ وَإِنْ حِيلَ بَيْنِي وَبَيْنَهُ فَعَلْتُ كَمَا فَعَلَ رَسُولُ اللهِ ﷺ وَأَنَا مَعَهُ فَأَهَلَّ بِعُمْرَةٍ بِذِي الْحُلَيْفَةِ ثُمَّ سَارَ سَاعَةً فَقَالَ إِنَّمَا شَأْنُهُمَا وَاحِدٌ أُشْهِدُكُمْ أَنِّي قَدْ أَوْجَبْتُ حَجَّةً مَعَ عُمْرَتِي فَلَمْ يَحِلَّ مِنْهُمَا حَتَّى حَلَّ يَوْمُ النَّحْرِ وَأَهْدَى وَكَانَ يَقُولُ مَنْ جَمَعَ الْحَجَّ وَالْعُمْرَةَ وَأَهَلَّ بِهِمَا جَمِيعًا فَإِنَّهُ لَا يَحِلُّ حَتَّى يَحِلَّ مِنْهُمَا جَمِيعًا يَوْمَ النَّحْرِ وَيَطُوفُ عَنْهُمَا جَمِيعًا طَوَافًا وَاحِدًا وَبَيْنَ الصَّفَا وَالْمَرْوَةِ يَوْمَ يَدْخُلُ مَكَّةَ
[Machine] The Prophet ﷺ performed 'Umrah (pilgrimage to Makkah) and the disbelievers of Quraysh prevented him from reaching the Ka'bah. So he sacrificed his offering and shaved his head in Hudaybiyah. He settled with them on the condition that he perform 'Umrah the following year and not carry any weapons except what they deemed necessary. He performed 'Umrah in the following year as well as his companions. When he had performed it three times, they ordered him to leave, so he left. Abu 'Amr Muhammad ibn 'Abdullah al-Adibi informed us, Abu Bakr al-Isma'ili informed me, and Abu Ya'la Ahmad ibn 'Ali narrated to me, from Abu Khaythamah Zuha'ir ibn Harb, from Suraij ibn Nu'man, from Fuleih, he mentioned it in a similar manner, except that he said: "He should not carry any weapons except swords."
أَنَّ النَّبِيَّ ﷺ خَرَجَ مُعْتَمِرًا فَحَالَ كُفَّارُ قُرَيْشٍ بَيْنَهُ وَبَيْنَ الْبَيْتِ فَنَحَرَ هَدْيَهُ وَحَلَقَ رَأْسَهُ بِالْحُدَيْبِيَةِ وَقَاضَاهُمْ عَلَى أَنْ يَعْتَمِرَ الْعَامَ الْمُقْبِلَ وَلَا يَحْمِلَ عَلَيْهِمْ بِسِلَاحٍ وَلَا يُقِيمَ بِهَا إِلَّا مَا أَحَبُّوا فَاعْتَمَرَ مِنَ الْعَامِ الْمُقْبِلِ كَمَا كَانَ صَالَحَهُمْ فَلَمَّا أَقَامَ بِهَا ثَلَاثًا أَمَرُوهُ أَنْ يَخْرُجَ فَخَرَجَ 10082 وَأَخْبَرَنَا أَبُو عَمْرٍو مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي أَبُو يَعْلَى أَحْمَدُ بْنُ عَلِيٍّ ثنا أَبُو خَيْثَمَةَ زُهَيْرُ بْنُ حَرْبٍ ثنا سُرَيْجُ بْنُ النُّعْمَانِ عَنْ فُلَيْحٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ وَلَا يَحْمِلَ سِلَاحًا عَلَيْهِمْ إِلَّا سُيُوفًا
[Machine] Ibn Abbas, may Allah be pleased with him, had been confined by the Messenger of Allah ﷺ , so he shaved his head, had sexual relations with his wives, and sacrificed his sacrificial animal, until he performed Umrah for a year's duration.
ابْنُ عَبَّاسٍ قَدْ أُحْصِرَ رَسُولُ اللهِ ﷺ فَحَلَقَ وَجَامَعَ نِسَاءَهُ وَنَحَرَ هَدْيَهُ حَتَّى اعْتَمَرَ عَامًا قَابِلًا
[Machine] On the authority of Qatadah who said: "Allah revealed the following verse to the Prophet ﷺ after his return from Hudaybiyah, while his companions were feeling sad and disappointed as barriers were placed between them and performing the pilgrimage. They had also sacrificed their animals at Hudaybiyah. The Prophet ﷺ said: 'Certainly, Allah has revealed a verse to me that is more beloved to me than the entire world.' He then recited it to his companions and they said: 'May you be fortunate and rewarded, O Messenger of Allah! Allah has clearly shown what He will do with you, so what will He do with us?' Then Allah revealed the following verse in response to their question: 'That He may admit the believing men and the believing women to gardens beneath which rivers flow.' (Surah Al-Fath, 5)".
عَنْ قَتَادَةَ قَوْلَهُ {لِيَغْفِرَ لَكَ اللهُ مَا تَقَدَّمَ مِنْ ذَنْبِكَ وَمَا تَأَخَّرَ وَيُتِمَّ نِعْمَتَهُ عَلَيْكَ وَيَهْدِيَكَ صِرَاطًا مُسْتَقِيمًا} [الفتح 2] قَالَ حَدَّثَنَا أَنَسُ بْنُ مَالِكٍ أَنَّهَا أُنْزِلَتْ عَلَى رَسُولِ اللهِ ﷺ مَرْجِعَهُ مِنَ الْحُدَيْبِيَةِ وَأَصْحَابُهُ مُخَالِطُونَ الْحُزْنَ وَالْكَآبَةَ قَدْ حِيلَ بَيْنَهُمْ وَبَيْنَ مَنَاسِكِهِمْ وَنَحَرُوا الْهَدْيَ بِالْحُدَيْبِيَةِ فَقَالَ نَبِيُّ اللهِ ﷺ لَقَدْ أُنْزِلَتْ عَلَيَّ آيَةٌ هِيَ أَحَبُّ إِلِيَّ مِنَ الدُّنْيَا جَمِيعًا فَقَرَأَهَا عَلَى أَصْحَابِهِ فَقَالُوا هَنِيئًا مَرِيئًا يَا نَبِيَّ اللهِ قَدْ بَيَّنَ اللهُ مَاذَا يَفْعَلُ بِكَ فَمَاذَا يَفْعَلُ بِنَا؟ فَأَنْزَلَ اللهُ ﷻ فِي ذَلِكَ {لِيُدْخِلَ الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ جَنَّاتٍ تَجْرِي مِنْ تَحْتِهَا الْأَنْهَارُ} [الفتح 5]
[Machine] "The Messenger of Allah ﷺ performed three Umrahs, all of them in the month of Dhu al-Qa'dah. One of these Umrahs was the Umrah of Hudaybiyyah, where the offering was rejected. The Messenger of Allah ﷺ sent messengers to the people of Makkah and made a pact with them that he would return to them the following year. Then the Messenger of Allah ﷺ sacrificed the offering in al-Hudaybiyyah, where he settled near the tree, and then he departed."
اعْتَمَرَ رَسُولُ اللهِ ﷺ ثَلَاثَ عُمَرٍ كُلُّهَا فِي ذِي الْقَعْدَةِ مِنْهَا الْعُمْرَةُ الَّتِي صُدَّ فِيهَا الْهَدْيُ فَرَاسَلَ رَسُولُ اللهِ ﷺ أَهْلَ مَكَّةَ فَصَالَحُوهُ عَلَى أَنْ يَرْجِعَ عَنْهُمْ فِي عَامِهِ ذَلِكَ قَالَ فَنَحَرَ رَسُولُ اللهِ ﷺ الْهَدْيَ بِالْحُدَيْبِيَةِ حَيْثُ حَلَّ عِنْدَ الشَّجَرَةِ وَانْصَرَفَ
[Machine] I heard Ata saying, "The Prophet's ﷺ house in Hudaibiya was located in Harra and it was there that the sacrificial animal was slaughtered." Ash-Shafi'i (may Allah have mercy on him) said, "We have the opinion that the animal was slaughtered in Hill because Allah Almighty says: 'They are the ones who disbelieved and hindered you from the Sacred Mosque and prevented the offering from reaching its place of sacrifice.' (Quran 48:25) And the entire Haram is its place of sacrifice according to the people of knowledge." Ash-Shafi'i said, "Hudaibiya is a location on earth, part of it is in Hill and part of it is in Haram. We slaughtered the sacrificial animal in Hill and in it is the Mosque of the Messenger of Allah ﷺ , under the tree where the pledge of allegiance was given. Allah Almighty revealed: 'Certainly, Allah was pleased with the believers when they pledged allegiance to you under the tree.' (Quran 48:18) And regarding His statement: 'And do not shave your heads until the offering reaches its place of sacrifice.' (Quran 2:196) The place of sacrifice is known to Allah, and Allah knows best. It resembles the situation when the animal is surrounded for sacrifice, its place of sacrifice is where it is being surrounded. And the place of sacrifice is not limited to the confines of the Haram or the place of sacrificing, and this is a broad Arabic statement. The Sheikh said, "It was narrated from Ibn Abbas that it indicates the correctness of this."
سَمِعْتُ عَطَاءً يَقُولُ كَانَ مَنْزِلُ النَّبِيِّ ﷺ بِالْحُدَيْبِيَةِ فِي الْحَرَّةِ وَفِيهَا نَحَرَ الْهَدْيَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَإِنَّمَا ذَهَبْنَا إِلَى أَنَّهُ نَحَرَ فِي الْحِلِّ؛ لِأَنَّ اللهَ تَعَالَى يَقُولُ {هُمُ الَّذِينَ كَفَرُوا وَصَدُّوكُمْ عَنِ الْمَسْجِدِ الْحَرَامِ وَالْهَدْيَ مَعْكُوفًا أَنْ يَبْلُغَ مَحِلَّهُ} [الفتح 25] وَالْحَرَمُ كُلُّهُ مَحِلُّهُ عِنْدَ أَهْلِ الْعِلْمِ قَالَ الشَّافِعِيُّ وَالْحُدَيْبِيَةُ مَوْضِعٌ مِنَ الْأَرْضِ مِنْهُ مَا هُوَ فِي الْحِلِّ وَمِنْهُ مَا هُوَ فِي الْحَرَمِ فَإِنَّمَا نَحَرَ الْهَدْيَ عِنْدَنَا فِي الْحِلِّ وَفِيهِ مَسْجِدُ رَسُولِ اللهِ ﷺ الَّذِي بُويِعَ فِيهِ تَحْتَ الشَّجَرَةِ فَأَنْزَلَ اللهُ تَعَالَى {لَقَدْ رَضِيَ اللهُ عَنِ الْمُؤْمِنِينَ إِذْ يُبَايِعُونَكَ تَحْتَ الشَّجَرَةِ} [الفتح 18] وَقَالَ فِي قَوْلِهِ {وَلَا تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ} مَحِلُّهُ وَاللهُ أَعْلَمُ هَا هُنَا يُشْبِهُ أَنْ يَكُونَ إِذَا أُحْصِرَ نَحَرَ حَيْثُ أُحْصِرَ وَمِحَلُّهُ فِي غَيْرِ الْإِحْصَارِ الْحَرَمُ وَالْمَنْحَرُ وَهُوَ كَلَامٌ عَرَبِيٌّ وَاسِعٌ قَالَ الشَّيْخُ قَدْ رُوِيَ عَنِ ابْنِ عَبَّاسٍ مَا يَدُلُّ عَلَى صِحَّةِ ذَلِكَ
[Machine] Yahya and Husain went out with Uthman ibn Affan on his journey.
يَحْيَى وَكَانَ حُسَيْنٌ خَرَجَ مَعَ عُثْمَانَ بْنِ عَفَّانَ ؓ فِي سَفَرِهِ ذَلِكَ
12.319 [Machine] No ruling on the besieged person except if he is unable to perform the Hajj of Islam, he should perform it. Al-Shafi'i said: According to the saying of Allah Almighty, "But if you are prevented, then [offer] what can be obtained with ease of sacrificial animals" (Al-Baqarah: 196), it does not mention a ruling. He said: And what I understand from the reports of the people of battles is similar to what I mentioned from the apparent meaning of the verse, and that is that we have known from the overlapping of their narrations that there were known men present with the Messenger of Allah ﷺ in the year of Hudaybiyah. Then the Messenger of Allah ﷺ performed the Umrah al-Qada', and some of them stayed in Madinah without necessity. Even if they were obliged to perform it, the Messenger of Allah ﷺ would have commanded them not to stay behind if Allah wills. Al-Bukhari mentioned in his book: And Rawh narrated from Ibn Najih, from Mujahid, from Ibn Abbas: "The substitute is only for the one who breaks his Hajj for pleasure. As for the one who is prevented due to an excuse or other than that, it is permissible for him and he does not have to repeat it. And if he has a sacrificial animal and he is besieged, he should slaughter it if he is unable to send it. And if he is able to send it, it is not permissible for him to slaughter it until the sacrificial animal reaches its specified place.
١٢۔٣١٩ بَابٌ: لَا قَضَاءَ عَلَى الْمُحْصَرِ إِلَّا أَنْ لَا يَكُونَ حَجَّ حَجَّةَ الْإِسْلَامِ فَيَحُجَّهَا قَالَ الشَّافِعِيُّ : مِنْ قِبَلِ قَوْلِ اللهِ تَبَارَكَ وَتَعَالَى {فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ} [البقرة: 196] لَمْ يَذْكُرْ قَضَاءً , قَالَ: وَالَّذِي أَعْقِلُ فِي أَخْبَارِ أَهْلِ الْمَغَازِي شَبِيهٌ بِمَا ذَكَرْتُ مِنْ ظَاهِرِ الْآيَةِ , وَذَلِكَ أَنَّا قَدْ عَلِمْنَا فِي مُتَوَاطِئِ أَحَادِيثِهِمْ أَنْ قَدْ كَانَ مَعَ رَسُولِ اللهِ ﷺ عَامَ الْحُدَيْبِيَةِ رِجَالٌ مَعْرُوفُونَ بِأَسْمَائِهِمْ , ثُمَّ اعْتَمَرَ رَسُولُ اللهِ ﷺ عُمْرَةَ الْقَضِيَّةِ , وَتَخَلَّفَ بَعْضُهُمْ بِالْمَدِينَةِ مِنْ غَيْرِ ضَرُورَةٍ وَلَوْ لَزِمَهُمُ الْقَضَاءُ لَأَمَرَهُمْ رَسُولُ اللهِ ﷺ إِنَّ شَاءَ اللهُ بِأَنْ لَا يَتَخَلَّفُوا عَنْهُ قَالَ الْبُخَارِيُّ فِي كِتَابِهِ: وَقَالَ رَوْحٌ , عَنِ ابْنِ نَجِيحٍ , عَنْ مُجَاهِدٍ , عَنِ ابْنِ عَبَّاسٍ : " إِنَّمَا الْبَدَلُ عَلَى مَنْ نَقَضَ حَجَّهُ بِالتَّلَذُّذِ , فَأَمَّا مَنْ حَبَسَهُ عُذْرٌ وَغَيْرُ ذَلِكَ فَإِنَّهُ يَحِلُّ وَلَا يَرْجِعُ وَإِنْ كَانَ مَعَهُ هَدْيٌ وَهُوَ مُحْصَرٌ نَحَرَهُ إِنْ كَانَ لَا يَسْتَطِيعُ أَنْ يَبْعَثَ بِهِ , وَإنِ اسْتَطَاعَ أَنْ يَبْعَثَ بِهِ لَمْ يَحِلَّ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ "
[Machine] That the Messenger of Allah ﷺ and his companions settled in Hudaybiyyah. They sacrificed the sacrificial animals, shaved their heads, and performed all the different forms of non-ritual slaughter before they circled the Kaaba and before the sacrificial animals reached their destination. Then we did not know that the Messenger of Allah ﷺ ordered any of his companions or anyone who was with him to do anything or to return to anything.
أَنَّ رَسُولَ اللهِ ﷺ حَلَّ هُوَ وَأَصْحَابُهُ بِالْحُدَيْبِيَةِ فَنَحَرُوا الْهَدْيَ وَحَلَقُوا رُءُوسَهُمْ وَحَلُّوا مِنْ كُلِّ شَيْءٍ قَبْلَ أَنْ يَطُوفُوا بِالْبَيْتِ وَقَبْلَ أَنْ يَصِلَ إِلَيْهِ الْهَدْيُ ثُمَّ لَمْ نَعْلَمْ أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ أَحَدًا مِنْ أَصْحَابِهِ وَلَا مِمَّنْ كَانَ مَعَهُ أَنْ يَقْضُوا شَيْئًا وَلَا أَنْ يَعُودُوا لِشَيْءٍ
[Machine] This 'Umrah was not obligatory, but it was a condition for the Muslims to perform it in the month when the polytheists prevented them.
لَمْ تَكُنْ هَذِهِ الْعُمْرَةُ قَضَاءً وَلَكِنْ كَانَ شَرْطًا عَلَى الْمُسْلِمِينَ أَنْ يَعْتَمِرُوا قَابِلَ فِي الشَّهْرِ الَّذِي صَدَّهُمُ الْمُشْرِكُونَ فِيهِ
12.320 [Machine] Whoever does not see the renewal of the Ihram with restriction due to illness, Allah says: "And complete the Hajj and 'Umrah for Allah. But if you are prevented, then [offer] what can be obtained with ease of sacrificial animals" (Surah Al-Baqarah: 196). Imam Al-Shafi'i, may Allah have mercy on him, said: "So whoever is hindered by illness from reaching the Ka'bah is not considered to be included in the meaning of the verse, because the verse was revealed regarding the enemy's barrier, and Allah knows best.
١٢۔٣٢٠ بَابُ مَنْ لَمْ يَرَ الْإِحْلَالَ بِالْإِحْصَارِ بِالْمَرَضِ قَالَ اللهُ تَعَالَى {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ} [البقرة: 196] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَمَنْ حَالَ بَيْنَهُ وَبَيْنَ الْبَيْتِ مَرَضٌ حَابِسٌ فَلَيْسَ بِدَاخِلٍ فِي مَعْنَى الْآيَةِ؛ لِأَنَّ الْآيَةَ نَزَلَتْ فِي الْحَائِلِ مِنَ الْعَدُوِّ , وَاللهُ أَعْلَمُ
[Machine] He said, "There is no confinement except the confinement of the enemy." One of them added, "The confinement is gone now."
أَنَّهُ قَالَ لَا حَصْرَ إِلَّا حَصْرَ الْعَدُوِّ زَادَ أَحَدُهُمَا ذَهَبَ الْحَصْرُ الْآنَ
[Machine] Abu al-Abbas narrated: "I am al-Rabi' ibn Sabih, I am al-Shafi'i, I am Malik." And Abu Ahmad al-Mihrjani informed us: "I am Abu Bakr Muhammad ibn Ja'far, narrated to me Muhammad ibn Ibrahim, narrated to me Ibn Bukayr, narrated to me Malik, from Ibn Shihab, from Salim ibn Abdullah, from his father, who said: 'Whoever is confined due to illness away from the Kaaba, it is not permissible for them until they perform Tawaf around the Kaaba and between Safa and Marwah."
ثنا أَبُو الْعَبَّاسِ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا مَالِكٌ ح وَأَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ جَعْفَرٍ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ سَالِمِ بْنِ عَبْدِ اللهِ عَنْ أَبِيهِ قَالَ مَنْ حُبِسَ دُونَ الْبَيْتِ بِمَرَضٍ فَإِنَّهُ لَا يَحِلُّ حَتَّى يَطُوفَ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ
[Machine] "He said that the pilgrim must not remove his ihram until he performs tawaf (circumambulation) around the Kaaba and between Safa and Marwa. However, if he is compelled to wear some necessary clothing, he may do so and offer a ransom. Al-Shafi'i said in his book Al-Manasik that Al-Muhsar refers to someone who is prevented from completing the rituals due to illness. And Allah knows best."
أَنَّهُ قَالَ الْمُحْصَرُ لَا يَحِلُّ حَتَّى يَطُوفَ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ فَإِنِ اضْطُرَّ إِلَى شَيْءٍ مِنْ لُبْسِ الثِّيَابِ الَّتِي لَا بُدَّ لَهُ مِنْهَا صَنَعَ ذَلِكَ وَافْتَدَى قَالَ الشَّافِعِيُّ فِي كِتَابِ الْمَنَاسِكِ هُوَ الْمُحْصَرُ بِالْمَرَضِ وَاللهُ أَعْلَمُ
[Machine] That I performed the Hajj and stayed in that place for seven months, then I performed the Umrah.
أَنْ أَحِلَّ فَأَقَمْتُ عَلَى ذَلِكَ الْمَاءِ سَبْعَةَ أَشْهُرٍ ثُمَّ حَلَلْتُ بِعُمْرَةٍ
[Machine] I traveled through those waters for six or seven months until I arrived at the house of Abu Al-Ala Yazeed bin Abdullah bin Al-Shakheer, who is one of the trustworthy people from Basra.
فَتَنَقَّلْتُ تِلْكَ الْمِيَاهَ سِتَّةَ أَشْهُرٍ أَوْ سَبْعَةَ أَشْهُرٍ حَتَّى وَصَلْتُ إِلَى الْبَيْتِ هُوَ أَبُو الْعَلَاءِ يَزِيدُ بْنُ عَبْدِ اللهِ بْنِ الشِّخِّيرِ مِنْ ثِقَاتِ الْبَصْرِيِّينَ
[Machine] Abu Al-Abbas Al-Asamm narrated to us, Rabee’ narrated to us, Al-Shafi'i narrated to us, and Malik reported. Abu Ahmad Al-Mihrajani narrated to us, Muhammad ibn Ja'far Al-Muzakki narrated to us, Muhammad ibn Ibrahim Al-Abdi narrated to us, Ibn Bukair narrated to us, and Malik reported from Yahya ibn Sa'id from Sulaiman ibn Yasar that Ibn Umar, Marwan, and Ibn Zubair were consulted regarding Ibn Huzabah Al-Makhzoomi who fell ill during his journey to Makkah while being in the state of Ihram. It was forbidden for him to seek treatment that is necessary or to redeem himself. However, if he recovers, he must perform Umrah, release himself from his state of Ihram, and then he must perform Hajj the following year, and he must also offer a sacrifice.
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا مَالِكٌ ح وَأَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنا مُحَمَّدُ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْعَبْدِيُّ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّ ابْنَ عُمَرَ وَمَرْوَانَ وَابْنَ الزُّبَيْرِ أَفْتَوُا ابْنَ حُزَابَةَ الْمَخْزُومِيَّ وَإِنَّهُ صُرِعَ بِبَعْضِ طَرِيقِ مَكَّةَ وَهُوَ مُحْرِمٌ أَنْ يَتَدَاوَى بِمَا لَا بُدَّ مِنْهُ وَيَفْتَدِيَ فَإِذَا صَحَّ اعْتَمَرَ فَحَلَّ مِنْ إِحْرَامِهِ وَكَانَ عَلَيْهِ أَنْ يَحُجَّ عَامًا قَابِلًا وَيُهْدِيَ
[Machine] She said, "We do not know anything that is prohibited except for circumambulation around the Kaaba, and we do not mention it, God willing, in the matter of exception in Hajj. This is a proof in this matter, and success is from Allah."
أَنَّهَا قَالَتْ مَا نَعْلَمُ حَرَامًا يَحِلَّهُ إِلَّا الطَّوَافُ بِالْبَيْتِ وَمَا نَذْكُرُهُ إِنْ شَاءَ اللهُ فِي مَسْأَلَةِ الِاسْتِثْنَاءِ فِي الْحَجِّ دَلِيلٌ فِي هَذِهِ وَبِاللهِ التَّوْفِيقُ
12.321 [Machine] Who witnessed the renewal through confinement in illness?
١٢۔٣٢١ بَابُ مَنْ رَأَى الْإِحْلَالَ بِالْإِحْصَارِ بِالْمَرَضِ
[Machine] He heard the Messenger of Allah ﷺ say: "Whoever is disabled or has a difficulty in walking has been given a replacement and will also have another reward." I then narrated it to Ibn Abbas and Abu Hurayrah, and they both said: "The wording of the hadith of Abd al-Warith is correct." Another narration is also reported from Ruh from al-Hajjaj ibn Amr al-Ansari, who said: "He has been given a replacement and will also have another argument." The remaining part has the same meaning, and it is similar to that.
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ كُسِرَ أَوْ عُرِجَ فَقَدْ حَلَّ وَعَلَيْهِ أُخْرَى قَالَ فَحَدَّثْتُ ابْنَ عَبَّاسٍ وَأَبَا هُرَيْرَةَ فَقَالَا صَدَقَ لَفْظُ حَدِيثِ عَبْدِ الْوَارِثِ وَفِي رِوَايَةِ رَوْحٍ عَنِ الْحَجَّاجِ بْنِ عَمْرٍو الْأَنْصَارِيِّ وَقَالَ فَقَدْ حَلَّ وَعَلَيْهِ حَجَّةٌ أُخْرَى وَالْبَاقِي بِمَعْنَاهُ وَهَكَذَا
[Machine] The Messenger of Allah ﷺ said: "Whoever is injured or is sick, then he is allowed to perform Hajj from the place that he is able to reach." 'Ikrima said: "So I informed Ibn Abbas and Abu Hurayrah, and they said: 'Al-Hajjaj has spoken the truth and its meaning.'"
قَالَ رَسُولُ اللهِ ﷺ مَنْ كُسِرَ أَوْ عُرِجَ فَقَدْ حَلَّ وَعَلَيْهِ الْحَجُّ مِنْ قَابِلٍ قَالَ عِكْرِمَةُ فَحَدَّثْتُ ابْنَ عَبَّاسٍ وَأَبَا هُرَيْرَةَ فَقَالَا صَدَقَ الْحَجَّاجُ وَبِمَعْنَاهُ
[Machine] Abdullah, send the gift and make a designated day between you and him. When the gift is sacrified in Mecca, this statement is true. Abu Ubaid said Al-Kissa'i the marker that is known by it, says make a day between you that you recognize so that you do not differ.
عَبْدُ اللهِ ابْعَثُوا بِالْهَدْيِ وَاجْعَلُوا بَيْنَكُمْ وَبَيْنَهُ يَوْمَ أَمَارٍ فَإِذَا ذَبَحَ الْهَدْيَ بِمَكَّةَ حَلَّ هَذَا قَالَ أَبُو عُبَيْدٍ قَالَ الْكِسَائِيُّ الْأَمَارُ الْعَلَامَةُ الَّتِي يُعْرَفُ بِهَا الشَّيْءُ يَقُولُ اجْعَلُوا بَيْنَكُمْ يَوْمًا تَعْرِفُونَهُ لِكَيْلَا تَخْتَلِفُوا
12.322 [Machine] Exception in Hajj
١٢۔٣٢٢ بَابُ الِاسْتِثْنَاءِ فِي الْحَجِّ
[Machine] The Messenger of Allah ﷺ passed by Duba'ah bint Zubayr and said, "Don't you want to perform Hajj?" She replied, "I am sick." He told her, "Perform Hajj and make a condition that my place of confinement will be considered." Al-Shafi'i said in his book of rites, "If the narration of 'Urwah from the Prophet ﷺ about exceptions is established, I will not rely on any other narration because it is not permissible for me to go against what is established from the Messenger of Allah ﷺ." The scholar said, "This narration has been proven from multiple chains of transmission from the Prophet ﷺ. As for the narration of Ibn Uyaynah from Hisham, it has been transmitted consecutively."
أَنَّ رَسُولَ اللهِ ﷺ مَرَّ بِضُبَاعَةَ بِنْتِ الزُّبَيْرِ فَقَالَ أَمَا تُرِيدِينَ الْحَجَّ؟ فَقَالَتْ إِنِّي شَاكِيَةٌ فَقَالَ لَهَا حُجِّي وَاشْتَرِطِي أَنَّ مَحِلِّي حَيْثُ حَبَسْتَنِي قَالَ الشَّافِعِيُّ فِي كِتَابِ الْمَنَاسِكِ لَوْ ثَبَتَ حَدِيثُ عُرْوَةَ عَنِ النَّبِيِّ ﷺ فِي الِاسْتِثْنَاءِ لَمْ أَعْدُهُ إِلَى غَيْرِهِ؛ لِأَنَّهُ لَا يَحِلُّ عِنْدِي خِلَافُ مَا ثَبَتَ عَنْ رَسُولِ اللهِ ﷺ قَالَ الشَّيْخُ قَدْ ثَبَتَ هَذَا الْحَدِيثُ مِنْ أَوْجُهٍ عَنِ النَّبِيِّ ﷺ أَمَّا حَدِيثُ ابْنِ عُيَيْنَةَ عَنْ هِشَامٍ فَقَدْ رُوِيَ مَوْصُولًا
[Machine] The Prophet ﷺ passed by Duba'ah, who was lamenting. He asked her, "Do you want to perform Hajj?" She replied, "Yes." He then said, "Perform Hajj and stipulate, 'O Allah, I am allowed to perform Hajj wherever You have prevented me.' Abdullah bin al-Jabbar narrated this, who is trustworthy according to Sufyan. Others have also transmitted this narration, including Abu Usamah Hammad Ibn Usamah, Ma'mar Ibn Rashid from Hisham, from his father, from Aisha. Ma'mar also narrated it from Az-Zuhri, from Urwah, from Aisha."
النَّبِيَّ ﷺ مَرَّ بِضُبَاعَةَ وَهِيَ شَاكِيَةٌ فَقَالَ أَتُرِيدِينَ الْحَجَّ؟ قَالَتْ نَعَمْ قَالَ فَحُجِّي وَاشْتَرِطِي وَقُولِي اللهُمَّ مَحِلِّي حَيْثُ حَبَسْتَنِي وَصَلَهُ عَبْدُ الْجَبَّارِ وَهُوَ ثِقَةٌ عَنْ سُفْيَانَ وَأَرْسَلَهُ غَيْرُهُ وَقَدْ وَصَلَهُ أَبُو أُسَامَةَ حَمَّادُ بْنُ أُسَامَةَ وَمَعْمَرُ بْنُ رَاشِدٍ عَنْ هِشَامٍ عَنْ أَبِيهِ عَنْ عَائِشَةَ وَمَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ
