12. Ḥajj and ʿUmrah (29/34)
Messenger of Allah ﷺ entered upon Dubaa bint Az-Zubair and said to her, "Do you have a desire to perform the Hajj?" She replied, "By Allah, I feel sick." He said to her, "Intend to perform Hajj and stipulate something by saying, 'O Allah, I will finish my Ihram at any place where You stop me (i.e. I am unable to go further)." She was the wife of Al-Miqdad bin Al-Aswad. (Using translation from Bukhārī 5089)
[Machine] The Prophet entered the house of Dhuba'ah bint al-Zubayr ibn Abdul-Muttalib, and she said, "I desire to perform Hajj but I am ill." The Prophet said, "Perform Hajj and make the condition that your designated place of residence is where you are currently confined." 10106 He said, "And Abdur-Razzaq narrated to us, from Ma'mar, from Hisham ibn Urwah, from his father, from Aisha, a similar narration."
Duba’ah bint Zubair bin ‘Abdul- Muttalib came to the Messenger of Allah ﷺ and said: “I am a heavy woman and I want to go for Hajj. How should I enter Ihram?” He said: “Enter Ihram and stipulate the condition that you will exit Ihram from the point where you are prevented.” (Using translation from Ibn Mājah 2938)
[Machine] "The fox came to the Messenger of Allah ﷺ and said, 'I am a heavy woman, and I want to perform Hajj. What do you command me?' He said, 'Take your family for Hajj and stipulate that my location is where you imprisoned me.' And she understood."
[Machine] That the Prophet ﷺ ordered Duba'ah bint Zubair to stipulate conditions for Hajj, and she did so by the command of the Messenger of Allah ﷺ.
[Machine] That the Messenger of Allah ﷺ visited Duba'ah bint Zubair while she was intending to perform Hajj. The Messenger of Allah ﷺ said to her, "Specify a place for me at your Ihram where you confined me, as it will be yours."
[Machine] "Daughter of Zubayr, O Messenger of Allah, I want to perform Hajj. Should I stipulate any condition?" He said, "Yes, stipulate a condition." She asked, "What should I say?" He said, "Say: Labbayka Allahumma Labbayk, Mahilli 'ani al-ardh, haythu habastani." It was narrated from 'Abbad, from al-Hajjaj al-Sawwaf, from Yahya ibn Abi Kathir, from 'Ikrimah, from Ibn 'Abbas, from the Prophet ﷺ something similar to this.
[Machine] "That the Prophet ﷺ said to the buyer (Dhuba'ata), 'Make a condition that my place of confinement will be wherever you confine me.' Abu 'Amr said that Abu al-'Abbas al-Sarraj narrated it from Ahmad ibn Mani'."
[Machine] Abu Abdullah Al-Hafiz informed us that Abu Abdullah Al-Shaybani narrated to us that Ahmad bin Sahl and Ibrahim bin Abi Talib narrated to us that Ishaq bin Ibrahim informed us that Abu Aamir Al-Aqadi narrated to us that Rabah bin Abi Ma'ruf Al-Makki narrated to us from Ata' bin Abi Rabah from Ibn Abbas that the Prophet ﷺ commanded the female camels to be milked, and he specified that their place be where they confine me.
[Machine] "That the Messenger of Allah ﷺ said to the person selling my sacrificial animal, 'Make sure to specify that the place where you kept me captive is my location.'"
[Machine] The Prophet ﷺ said to Dubaa'ah bint Zubayr, "Perform Hajj and specify that my place of dwelling will be where you imprison me."
[Machine] "That the Prophet ﷺ said to her, 'Perform Hajj and set a condition.'"
[Machine] "O Messenger of Allah, I want to perform Hajj. How do I become eligible for Hajj?" He ﷺ said, "Say: 'O Allah, I am eligible for Hajj if You grant me permission to perform it, assist me in doing so, make it easy for me, and if You prevent me, then let me perform Umrah. And if You prevent me from both, then make my place of detention wherever You have detained me.'"
[Machine] 'Umar ibn al-Khattab said to me, "O Abu Umayyah, perform the Hajj pilgrimage and make conditions, for indeed you will receive what you have stipulated, and by Allah, you will receive what you have stipulated."
[Machine] Perform the Hajj (pilgrimage) and specify it, and say: "O Allah, I intend to perform the Hajj for Your sake only, and if any obstacles arise, I will do Umrah (lesser pilgrimage) instead."
[Machine] She used to say during Hajj, "O Allah! I intended to perform Hajj and then performed it, so if You complete it for me, it is Hajj, but if not, then it is Umrah." And she used to order her companions to do the same.
[Machine] Aisha, do you exempt yourself if you perform Hajj? So, I said to her, "What should I say?" She said, "Say, 'O Allah, I intend to perform Hajj and I have approached it, so if You make it easy for me, then it is Hajj, and if You detain me, then it is Umrah."
[Machine] Umm Salamah, the wife of the Prophet ﷺ , used to instruct us when we performed Hajj with specific conditions. Abu Bakr Muhammad ibn Ibrahim al-Farsi informed us, and I am Abu Ishaq al-Asbahani. Muhammad ibn Sulaiman ibn Farris narrated to us, and Muhammad ibn Ismail al-Bukhari narrated to him. Ubayd ibn Ya'ish narrated to me, and I am Muhammad ibn Ishaq, narrating from Abu Bakr ibn Muhammad ibn Umar ibn Abi Salamah, from his father, who mentioned it.
12.323 [Machine] Who rejects the condition in Hajj?
"Ibn 'Umar used to denounce stipulating conditions in Hajj, and said: 'Is not the Sunnah of the Messenger of Allah sufficient for you? If one of you is prevented from performing (finishing) Hajj let him circumambulate the House and (perform Sai) between As-Safa and al-Marwah, then exit Ihram completely until he performs Hajj the following year. And let him offer a Hadi or fast if he con not find a Hadi. (Using translation from Nasāʾī 2769)
[Machine] He used to deny the requirement in Hajj and would say, "Is it not sufficient for you the Sunnah of the Messenger of Allah ﷺ ?" Abu Amr Al-Adibi informed us that Abu Bakr Al-Isma'ili informed us that I am the son of Najiyyah. They narrated to us from Ahmad ibn Mani'a, Al-Hasan ibn 'Arfatah, and 'Ali ibn Muslim. They said: Abd Allah ibn Al-Mubarak narrated to us from Ma'mar from Al-Zuhri, and he mentioned it similarly.
12.324 [Machine] Restricting a woman is prohibited without her husband's permission
[Machine] The Messenger of Allah ﷺ said, "She is not allowed to travel except with the permission of her husband, and it is not permissible for a woman to travel for three nights without a Mahram accompanying her." Muhammad ibn Abi Ya'qub also narrated this from Hassan ibn Ibrahim.
12.325 [Machine] Who said: "He is not forbidden from performing the obligation of Hajj at the Sacred Mosque"?
[Machine] The Messenger of Allah ﷺ said, "When one of you seeks permission from his wife to go to the mosque, do not withhold him due to their mutual conversation."
[Machine] The Messenger of Allah ﷺ said, "Do not prevent the female servants of Allah from the mosques of Allah."
12.326 [Machine] Women are required to perform Hajj if there is a way to do so and they can do it with confidence among other women on a safe and populated route. The saying of Allah, "And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a way" [Al-Imran: 97] and we have been narrated from the Prophet ﷺ"that the way is the provision and the means of transportation.
[Machine] Narrated by Ibn Umar, he heard it from the Prophet ﷺ who said: "Whoever has the ability to travel to it." [Al-Imran, 97]. Al-Zad and Al-Rahilah were mentioned to us from various reliable narrations from Al-Hasan Al-Basri, who narrated it from the Prophet ﷺ through a chain of transmission with strength for this hadith.
While I was sitting with Messenger of Allah ﷺ two person came to him; one of them complained about his poverty and the other complained about the prevalence of robberies. Messenger of Allah ﷺ said, "As regards stealing and robberies, there will shortly come a time when a caravan will go to Mecca (from Medina) without any guard. And regarding poverty, The Hour (Day of Judgment) will not be established till one of you wanders about with his object of charity and will not find anybody to accept it And (no doubt) each one of you will stand in front of Allah and there will be neither a curtain nor an interpreter between him and Allah, and Allah will ask him, 'Did not I give you wealth?' He will reply in the affirmative. Allah will further ask, 'Didn't send a messenger to you?' And again that person will reply in the affirmative Then he will look to his right and he will see nothing but Hell-fire, and then he will look to his left and will see nothing but Hell-fire. And so, any (each one) of you should save himself from the fire even by giving half of a date-fruit (in charity). And if you do not find a hall datefruit, then (you can do it through saying) a good pleasant word (to your brethren). (See Hadith No. 793 Vol. 4). (Using translation from Bukhārī 1413)
While I was in the city of the Prophet, a man came and complained to him (the Prophet, ) of destitution and poverty. Then another man came and complained of robbery (by highwaymen). The Prophet said, "Adi! Have you been to Al-Hira?" I said, "I haven't been to it, but I was informed about it." He said, "If you should live for a long time, you will certainly see that a lady in a Howdah traveling from Al-Hira will (safely reach Mecca and) perform the Tawaf of the Kaʿba, fearing none but Allah." I said to myself, "What will happen to the robbers of the tribe of Tai who have spread evil through out the country?" The Prophet ﷺ further said. "If you should live long, the treasures of Khosrau will be opened (and taken as spoils)." I asked, "You mean Khosrau, son of Hurmuz?" He said, "Khosrau, son of Hurmuz; and if you should live long, you will see that one will carry a handful of gold or silver and go out looking for a person to accept it from him, but will find none to accept it from him. And any of you, when meeting Allah, will meet Him without needing an interpreter between him and Allah to interpret for him, and Allah will say to him: 'Didn't I send a messenger to teach you?' He will say: 'Yes.' Allah will say: 'Didn't I give you wealth and do you favors?' He will say: 'Yes.' Then he will look to his right and see nothing but Hell, and look to his left and see nothing but Hell." ʿAdi further said: I heard the Prophet ﷺ saying, "Save yourself from the (Hell) Fire even with half a date (to be given in charity) and if you do not find a half date, then with a good pleasant word." ʿAdi added: (later on) I saw a lady in a Howdah traveling from Al-Hira till she performed the Tawaf of the Kaʿba, fearing none but Allah. And I was one of those who opened (conquered) the treasures of Khosrau, son of Hurmuz. [Machine] It is said that Safiyyah traveled with him to Mecca, and in another narration, it is said that Ibn 'Umar performed Hajj with a slave girl named Safiyyah, riding on a weak camel. Al-Shafi'i mentioned in Al-Jadid that we have received similar statements from Aisha, Ibn 'Umar, and Urwah regarding women traveling for Hajj even if they do not have a male guardian accompanying them. This is also mentioned by Ata' from Malik ibn Anas in the past.

[Machine] The Messenger of Allah ﷺ gave a sermon and said, "No man should be alone with a woman, and a woman should not travel except with a mahram." Then, a man stood up and said, "O Messenger of Allah, my wife has gone out for a need and I have been registered for a military expedition." He replied, "Go and argue with your wife, as the narration of Ali mentioned."
A man came to the Prophet ﷺ and said, "O Messenger of Allah ﷺ! I have enlisted in the army for such-andsuch Ghazwa, and my wife is leaving for Hajj." Messenger of Allah ﷺ said, "Go back and perform Hajj with your wife." (Using translation from Bukhārī 3061)

[Machine] The Messenger of Allah ﷺ said, "A woman should not travel a distance of three days or more, unless she is accompanied by her father, brother, son, or a close relative."

The Messenger of Allah (SWAS) as saying : A muslim woman must not make a journey of a night unless she is accompanied by a man who is within the prohibited degrees. (Using translation from Abū Dāʾūd 1723)
[Machine] The Prophet ﷺ said: "It is not permissible for a believing woman in Allah and the Last Day to travel the distance of a day's journey without a male relative."
[Machine] About the Prophet ﷺ, he said to his wives during his pilgrimage: "Then the beginning of the restriction."
[Machine] The Messenger of Allah ﷺ said to his wives during the Farewell Pilgrimage, "This is the last Hajj that we will perform before the restriction is imposed." All of them then traveled for Hajj, except Zainab and Sawdah, as they said, "We will not be moved after we heard from the Messenger of Allah ﷺ ." Saleh bin Ka'isan narrated this from Saleh bin Nabhani, and we have narrated it in the beginning of the book from the Hadith of Abu Waqid Al-Laythi. Ash-Shafi'i (may Allah have mercy on him) said that 'Umar bin Al-Khattab prevented the wives of the Prophet ﷺ from performing Hajj, based on the statement of the Messenger of Allah ﷺ , "This is the last Hajj that we will perform before the restriction is imposed." The sheikh (may Allah have mercy on him) said, "We have narrated in the beginning of the book on Hajj, in the chapter on the Hajj of women, from 'Umar that he granted permission for them to perform Hajj in the last Hajj he performed, and he sent with them Uthman bin 'Affan and 'Abdur Rahman bin 'Awf. In it, and in the Hajj of other women, there is evidence that the intent of the statement of the Messenger of Allah ﷺ , "This is the last Hajj that we will perform before the restriction is imposed," is that Hajj is only obligatory once, and he chose for them to refrain from traveling after fulfilling the obligation.

And He said, "And of the grazing livestock are carriers [of burdens] and those [too] small. So eat of what Allah has provided for you" [Al-An'am 142]. He said, "Yes." He said, "Did you hear Allah saying, 'O you who have believed, do not kill game while you are in the state of ihram'? Until His saying, 'a specified offering brought to the Ka'bah'" [Al-Ma'idah 95]? So the man said, "Yes." Ali said, "You have indeed been informed by Allah that a specified offering brought to the Ka'bah" [Al-Ma'idah 95].
