12. Ḥajj and ʿUmrah (23/34)
١٢۔ كِتَابُ الْحَجِّ ص ٢٣
[Machine] "And Abu Abdullah al-Hafiz informed us that Abu Abdullah al-Saffar narrated to us, who narrated to us Ismail ibn Ishaq, who narrated to us Amr ibn Marzouq, who narrated to us Shu'bah, who narrated from Abu Bishr, who said: I heard a man from the Banu Abd al-Dar saying, 'A man came to Abdullah ibn Amr and asked him about a prohibited matter that occurred with his wife, but he did not say anything.' He (the man) then went to Ibn Abbas and mentioned it to him, so Abdullah ibn Amr said, 'If there was anyone who could inform him about it, it would be the cousin of the Messenger of Allah ﷺ .' Ibn Abbas said, 'Let them complete what remains of their rituals, and when they come to the place where the incident occurred, they should separate and each of them should have a sacrificial animal.' Abu Bishr said, 'So I mentioned that to Sa'id ibn Jubair, and he said, 'This is how Ibn Abbas used to say.'"
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ الصَّفَّارُ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا عَمْرُو بْنُ مَرْزُوقٍ أنبأ شُعْبَةُ عَنْ أَبِي بِشْرٍ قَالَ سَمِعْتُ رَجُلًا مِنْ بَنِي عَبْدِ الدَّارِ قَالَ أَتَى رَجُلٌ عَبْدَ اللهِ بْنَ عَمْرٍو فَسَأَلَهُ عَنْ مُحْرِمٍ وَقَعَ بِامْرَأَتِهِ فَلَمْ يَقُلْ شَيْئًا قَالَ فَأَتَى ابْنَ عَبَّاسٍ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ عَبْدُ اللهِ بْنُ عَمْرٍو إِنْ يَكُنْ أَحَدٌ يُخْبِرُهُ فِيهَا بِشَيْءٍ فَابْنُ عَمِّ رَسُولِ اللهِ ﷺ قَالَ فَقَالَ ابْنُ عَبَّاسٍ يَقْضِيَانِ مَا بَقِيَ مِنْ نُسُكِهِمَا فَإِذَا كَانَ قَابِلٌ حَجَّا فَإِذَا أَتَيَا الْمَكَانَ الَّذِي أَصَابَا فِيهِ مَا أَصَابَا تَفَرَّقَا وَعَلَى كُلِّ وَاحِدٍ مِنْهُمَا هَدْيٌ أَوْ قَالَ عَلَيْهِمَا الْهَدْيُ قَالَ أَبُو بِشْرٍ فَذَكَرْتُ ذَلِكَ لِسَعِيدِ بْنِ جُبَيْرٍ فَقَالَ هَكَذَا كَانَ ابْنُ عَبَّاسٍ يَقُولُ
[Machine] Ibn Abbas, as for your Hajj this year, it has become invalid. So, perform Umrah and afterwards leave from where you prepared for Umrah until you reach the location where you put on your Ihram. Then, separate from each other and do not see each other until you both stone the Jamrat and sacrifice a camel.
ابْنُ عَبَّاسٍ أَمَّا حَجُّكُمَا هَذَا فَقَدْ بَطُلَ فَحُجَّا عَامًا قَابِلًا ثُمَّ أَهِلَّا مِنْ حَيْثُ أَهْلَلْتُمَا حَتَّى إِذَا بَلَغْتُمَا حَيْثُ وَقَعْتَ عَلَيْهَا فَفَارِقْهَا فَلَا تَرَاكَ وَلَا تَرَاهَا حَتَّى تَرْمِيَا الْجَمْرَةَ وَأَهْدِ نَاقَةً وَلْتُهْدِ نَاقَةً
[Machine] If he (or she) has sexual intercourse, then each of them is required to perform a ritual purification.
إِذَا جَامَعَ فَعَلَى كُلِّ وَاحِدٍ مِنْهُمَا بَدَنَةٌ
[Machine] A dispute/arbitration is taking place between them.
يُجْرَى بَيْنَهُمَا جَزُورٌ
[Machine] If it helped you, each of you should give a fine and well-fed she-camel. And if it didn't help you, then you should give a fine and well-fed she-camel. It was narrated from Jabir ibn Zaid Abu Sha'tha' that he said: "They should complete their Hajj and perform Hajj Qabil (sacrifice)." And if it is accompanied by Maysarah, he should give a sheep. And it was narrated from Ibrahim an-Nakha'i that they should separate and not meet until they have completed their Hajj.
إِنْ كَانَتْ أَعَانَتْكَ فَعَلَى كُلِّ وَاحِدٍ مِنْكُمَا نَاقَةٌ حَسْنَاءُ جَمْلَاءُ وَإِنْ كَانَتْ لَمْ تُعِنْكَ فَعَلَيْكَ نَاقَةٌ حَسْنَاءُ جَمْلَاءُ وَرُوِّينَا عَنْ جَابِرِ بْنِ زَيْدٍ أَبِي الشَّعْثَاءِ أَنَّهُ قَالَ يُتِمَّانِ حَجَّهُمَا وَعَلَيْهِمَا الْحَجُّ مِنْ قَابِلٍ وَإِنْ كَانَ ذَا مَيْسَرَةٍ أَهْدَى جَزُورًا وَعَنْ إِبْرَاهِيمَ النَّخَعِيِّ يَفْتَرِقَانِ وَلَا يَجْتَمِعَانِ حَتَّى يَفْرُغَا مِنْ حَجِّهِمَا
[Machine] Saeed, a man who committed adultery with his wife while he was in a state of ihram (ritual consecration), sent a question to the city (of authority) asking about this matter. Some people told him that they should be separated until the next year. Saeed ibn Al-Musayyib said, "They should continue their pilgrimage until they complete the rituals which they have corrupted. Once they are done, they should return. And if the time for Hajj comes upon them, then they should perform Hajj and offer the sacrifice as required. They can go back to where they were residing prior to the Hajj which they corrupted. They should separate until they fulfill their Hajj."
سَعِيدٌ إِنَّ رَجُلًا وَقَعَ بِامْرَأَتِهِ وَهُوَ مُحْرِمٌ فَبَعَثَ إِلَى الْمَدِينَةِ يَسْأَلُ عَنْ ذَلِكَ فَقَالَ لَهُ بَعْضُ النَّاسِ يُفَرَّقُ بَيْنَهُمَا إِلَى عَامِ قَابِلٍ قَالَ سَعِيدُ بْنُ الْمُسَيِّبِ لِيَنْفُذَا لِوُجُوهِهِمَا فَلْيُتِمَّا حَجَّهُمَا الَّذِي أَفْسَدَا فَإِذَا فَرَغَا رَجَعَا وَإِذَا أَدْرَكَهُمَا الْحَجُّ فَعَلَيْهِمَا الْحَجُّ وَالْهَدْيُ وَيُهِلَّا مِنْ حَيْثُ كَانَا أَهَلَّا بِحَجِّهِمَا الَّذِي كَانَا أَفْسَدَا وَيَتَفَرَّقَا حَتَّى يَقْضِيَا حَجَّهُمَا
12.257 [Machine] The harm caused by the prohibition affects his wife except during intercourse
١٢۔٢٥٧ بَابُ الْمُحْرِمِ يُصِيبُ امْرَأَتَهُ مَا دُونَ الْجِمَاعِ
[Machine] The one who kisses his wife while in a state of ihram (pilgrim sanctity) should shed blood, as mentioned in a narration from Ibn Abbas. It is also narrated that he should complete his Hajj, according to Sa'id ibn Jubayr and Qatadah, as well as the scholars.
مَنْ قَبَّلَ امْرَأَتَهُ وَهُوَ مُحْرِمٌ فَلْيُهْرِقْ دَمًا هَذَا مُنْقَطِعٌ وَقَدْ رُوِيَ فِي مَعْنَاهُ عَنِ ابْنِ عَبَّاسٍ وَأَنَّهُ يُتِمُّ حَجَّهُ وَهُوَ قَوْلُ سَعِيدِ بْنِ جُبَيْرٍ وَقَتَادَةَ وَالْفُقَهَاءِ
12.258 [Machine] The one who cannot afford a camel for Hajj can slaughter a cow, and if they cannot afford a cow, they can slaughter seven sheep as an alternative.
١٢۔٢٥٨ بَابُ الْمُفْسِدِ لِحَجِّهِ لَا يَجِدُ بَدَنَةً ذَبَحَ بَقَرَةً فَإِنْ لَمْ يَجِدْهَا ذَبَحَ سَبْعًا مِنَ الْغَنَمِ اسْتِدْلَالًا بِمَا:
[Machine] We sacrificed with the Messenger of Allah ﷺ in Hudaybiyyah; a camel for each seven people, and a cow for each seven people. And according to Ibn Wahb's narration, it was in the year of Hudaybiyyah.
نَحَرْنَا مَعَ رَسُولِ اللهِ ﷺ بِالْحُدَيْبِيَةِ الْبَدَنَةَ عَنْ سَبْعَةٍ وَالْبَقَرَةَ عَنْ سَبْعَةٍ وَفِي رِوَايَةِ ابْنِ وَهْبٍ عَامَ الْحُدَيْبِيَةِ
[Machine] A man came to the Prophet Muhammad ﷺ and said, "I have made a vow to sacrifice a sheep but I cannot find it." The Prophet Muhammad ﷺ then said, "Sacrifice seven sheep instead."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنِّي نَذَرْتُ بَدَنَةً فَلَمْ أَجِدْهَا فَقَالَ النَّبِيُّ ﷺ اذْبَحْ سَبْعًا مِنَ الْغَنَمِ وَكَذَلِكَ
12.259 [Machine] Choice regarding compensation for harm
١٢۔٢٥٩ بَابُ التَّخْيِيرِ فِي فِدْيَةِ الْأَذَى
[Machine] "So I went to the Prophet ﷺ and he said to me, 'Approach.' So I came close to him two or three times. Then he asked me, 'Does your headache bother you?' I think he said yes. He said, 'And Abu Huraira narrated from Mujahid: Does your headache bother your head?' So he ordered me to fast for three days or give charity to six poor people or offer a sheep as a sacrifice, whatever I could afford. Ibn 'Aun explained to me that Mujahid had said this, but I forgot. Then Ayub informed me that he heard it from Mujahid, who said, 'Fast for three days or give charity to six poor people or offer a sheep as a sacrifice.'"
فَأَتَيْتُ النَّبِيَّ ﷺ فَقَالَ لِي ادْنُ فَدَنَوْتُ مَرَّتَيْنِ أَوْ ثَلَاثًا فَقَالَ أَيُؤْذِيكَ هَوَامُّكَ؟ أَظُنُّهُ قَالَ نَعَمْ قَالَ وَقَالَ أَيُّوبُ عَنْ مُجَاهِدٍ أَيُؤْذِيكَ هَوَامُّ رَأْسِكَ فَأَمَرَنِي بِصَوْمٍ أَوْ بِصَدَقَةٍ أَوْ بِنُسُكٍ مَا تَيَسَّرَ قَالَ ابْنُ عَوْنٍ فَفَسَّرَ لِي مُجَاهِدٌ فَنَسِيتُ فَأَنْبَأَنِي أَيُّوبُ أَنَّهُ سَمِعَهُ عَنْ مُجَاهِدٍ قَالَ صِيَامُ ثَلَاثَةِ أَيَّامٍ أَوْ صَدَقَةُ سِتَّةِ مَسَاكِينَ أَوْ نُسُكُ شَاةٍ
[Machine] He (the Prophet) was in a state of ihram with the Messenger of Allah ﷺ when lice were bothering him. The Messenger of Allah ﷺ commanded him to shave his head and said, "Fast for three days, or feed six poor people, or sacrifice a sheep." So, he asked, "Which one should I do?" The Prophet ﷺ said, "You can choose whichever one you prefer. This is sufficient for you." And it has been reported in the correct manner.
أَنَّهُ كَانَ مَعَ رَسُولِ اللهِ ﷺ مُحْرِمًا فَآذَاهُ الْقُمَّلُ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يَحْلِقَ رَأْسَهُ وَقَالَ صُمْ ثَلَاثَةَ أَيَّامٍ أَوْ أَطْعِمْ سِتَّةَ مَسَاكِينَ مُدَّيْنِ مُدَّيْنِ أَوِ انْسُكْ شَاةً أِيَّ ذَلِكَ فَعَلْتَ أَجْزَأَ عَنْكَ هَذَا هُوَ الصَّحِيحُ وَقَدْ
12.260 [Machine] The arrangement in the tranquility of enjoyment and every blood requires the omission of sacrifices.
١٢۔٢٦٠ بَابُ التَّرْتِيبِ فِي هَدْيِ التَّمَتُّعِ وَكُلِّ دَمٍ وَجَبَ بِتَرْكِ نُسُكٍ
[Machine] When the Messenger of Allah ﷺ arrived in Mecca, he said to the people, "Whoever among you has brought a sacrifice, then it is not permissible for him to abstain from anything that he has been forbidden from until he has completed his Hajj. And whoever among you has not brought a sacrifice, then let him perform Tawaf (circumambulation) around the Kaaba, walk between Safa and Marwa, and shorten his hair. Then he may enter the state of Ihram (pilgrim consecration) for Hajj and offer a sacrifice. And whoever cannot find a sacrifice, then let him fast for three days during Hajj and for seven days when he returns to his family."
فَلَمَّا قَدِمَ رَسُولُ اللهِ ﷺ مَكَّةَ قَالَ لِلنَّاسِ مَنْ كَانَ مِنْكُمْ أَهْدَى فَإِنَّهُ لَا يَحِلُّ مِنْ شَيْءٍ حُرِمَ مِنْهُ حَتَّى يَقْضِيَ حَجَّهُ وَمَنْ لَمْ يَكُنْ مِنْكُمْ أَهْدَى فَلْيَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ وَلْيُقَصِّرْ وَلْيَحْلِلْ ثُمَّ لِيُهِلَّ بِالْحَجِّ وَلْيُهْدِ فَمَنْ لَمْ يَجِدْ هَدْيًا فَلْيَصُمْ ثَلَاثَةَ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةً إِذَا رَجَعَ إِلَى أَهْلِهِ
12.261 [Machine] The location of gifts and food to Mecca and Mina and fasting wherever desired.
١٢۔٢٦١ بَابُ مَحِلِّ الْهَدْيِ وَالطَّعَامِ إِلَى مَكَّةَ وَمِنًى وَالصَّوْمِ حَيْثُ شَاءَ
[Machine] "The Prophet ﷺ said, 'I have made my sacrificial offering here in Mina, and the entire Mina is a place of sacrifice, so you may also sacrifice your animals during your journeys."
أَنَّ النَّبِيَّ ﷺ قَالَ نَحَرْتُ هَا هُنَا بِمِنًى وَمِنًى كُلُّهَا مَنْحَرٌ فَانْحَرُوا فِي رِحَالِكُمْ
[Machine] The Messenger of Allah ﷺ said, "Every alley of Makkah is a path and a sanctuary."
قَالَ رَسُولُ اللهِ ﷺ كُلُّ فِجَاجِ مَكَّةَ طَرِيقٌ وَمَنْحَرٌ
12.262 [Machine] The man affects his wife after the first dissolution and before the second.
١٢۔٢٦٢ بَابُ الرَّجُلِ يُصِيبُ امْرَأَتَهُ بَعْدَ التَّحَلُّلِ الْأَوَّلِ وَقَبْلَ الثَّانِي
[Machine] So, sacrifice a fat camel and feed it to the poor.
فَانْحَرْ نَاقَةً سَمِينَةً فَأَطْعِمْهَا الْمَسَاكِينَ
[Machine] He had a thick body and his pilgrimage was completed. Abu Abdullah Al-Hafiz informed me that Abu Muhammad bin Ziyad informed them saying: Ibn Khuzaymah narrated to me that Salamah bin Junadah narrated to us from Wakee' from Sufyan from Shu'bah from Habib bin Abi Thabit, and he mentioned it.
عَلَيْهِ بَدَنَةٌ وَتَمَّ حَجُّهُ أَنْبَأَنِيهِ أَبُو عَبْدِ اللهِ الْحَافِظُ أَنَّ أَبَا مُحَمَّدِ بْنَ زِيَادٍ أَخْبَرَهُمْ قَالَ أنبأ ابْنُ خُزَيْمَةَ قَالَ ثنا سَلَمَةُ بْنُ جُنَادَةَ ثنا وَكِيعٌ عَنْ سُفْيَانَ وَشُعْبَةَ عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ فَذَكَرَهُ
[Machine] They sacrifice a goat between them and there is no obligation of Hajj upon them.
يَنْحَرَانِ جَزُورًا بَيْنَهُمَا وَلَيْسَ عَلَيْهِمَا الْحَجُّ مِنْ قَابِلٍ
[Machine] Malik said, "And that is the best thing I have heard."
مَالِكٌ وَذَلِكَ أَحْسَنُ مَا سَمِعْتُ
[Machine] About a man who fell upon his family while in a state of ihram (pilgrim sanctity) in Mina before it was time for him to pour the water from his head, the Shafi'i scholar ordered him to sacrifice a camel instead. Malik said that he must perform 'umrah - a minor pilgrimage - sacrifice a camel, and his Hajj is complete. This was narrated from Rabi'ah, rejecting the opinion of Ibn 'Abbas, and it was also narrated from Thawr ibn Zayd from 'Ikrimah, who thought it was narrated from Ibn 'Abbas, but his opinion is weak in 'Ikrimah, and no one finds it acceptable for him to narrate his statements. He narrates with certainty from 'Ata' from Ibn 'Abbas, contrary to him. 'Ata' is reliable according to him and according to the people. The Sheikh said: "And we have also narrated it from the scholars of Madinah."
عَنْ رَجُلٍ وَقَعَ عَلَى أَهْلِهِ وَهُوَ مُحْرِمٌ وَهُوَ بِمِنًى قَبْلَ أَنْ يُفِيضَ فَأَمَرَهُ أَنْ يَنْحَرَ بَدَنَةً قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَبِهَذَا نَأْخُذُ قَالَ مَالِكٌ عَلَيْهِ عُمْرَةٌ وَبَدَنَةٌ وَحَجُّهُ تَامٌّ وَرَوَاهُ عَنْ رَبِيعَةَ فَتَرَكَ قَوْلَ ابْنِ عَبَّاسٍ لِرَأْيِ رَبِيعَةَ وَرَوَاهُ عَنْ ثَوْرِ بْنِ زَيْدٍ عَنْ عِكْرِمَةَ يَظُنُّهُ عَنِ ابْنِ عَبَّاسٍ وَهُوَ سَيِّئُ الْقَوْلِ فِي عِكْرِمَةَ لَا يَرَى لِأَحَدٍ أَنْ يَقْبَلَ حَدِيثَهُ وَهُوَ يَرْوِي بِيَقِينٍ عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ خِلَافَهُ وَعَطَاءٌ ثِقَةٌ عِنْدَهُ وَعِنْدَ النَّاسِ قَالَ الشَّيْخُ وَرُوِّينَاهُ عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ
12.263 [Machine] The pilgrim does not approach his wife from the time he leaves to complete the circumambulation around the Kaaba, Safa, and Marwa, until he shaves or trims his hair.
١٢۔٢٦٣ بَابُ الْمُعْتَمِرِ لَا يَقْرَبُ امْرَأَتَهُ مَا بَيْنَ أَنْ يُهِلَّ إِلَى أَنْ يُكْمِلَ الطَّوَافَ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ وَقَبْلَ أَنْ يَحْلِقَ أَوْ يُقَصِّرَ
I asked Ibn ʿUmar, "Can a person who has performed the Tawaf around the Kaʿba for ʿUmra but has not performed the (Saʿi) Tawaf of Safa and Marwa, have a sexual relation with his wife?" Ibn ʿUmar replied "When the Prophet ﷺ reached Mecca he performed the Tawaf around the Kaʿba (circumambulated it seven times) and offered a two-rakʿat prayer (at the place) behind the station (of Abraham) and then performed the Tawaf (Saʿi) of Safa and Marwa, and verily in Messenger of Allah ﷺ you have a good example." Then we put the same question to Jabir bin ʿAbdullah and he too replied, "He should not go near his wife (for sexual relation) till he has finished the Tawaf of Safa and Marwa." عَنْ رَجُلٍ اعْتَمَرَ فَطَافَ بِالْبَيْتِ وَلَمْ يَطُفْ بَيْنَ الصَّفَا وَالْمَرْوَةِ أَيَقَعُ بِامْرَأَتِهِ فَقَالَ ابْنُ عُمَرَ قَدِمَ رَسُولُ اللهِ ﷺ فَطَافَ بِالْبَيْتِ سَبْعًا وَصَلَّى خَلْفَ الْمَقَامِ رَكْعَتَيْنِ وَطَافَ بَيْنَ الصَّفَا وَالْمَرْوَةِ قَالَ اللهُ ﷻ {لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللهِ أُسْوَةٌ حَسَنَةٌ} [الأحزاب 21] قَالَ عُمَرُ وَسَأَلْتُ جَابِرَ بْنَ عَبْدِ اللهِ فَقَالَ لَا يَقْرَبْهَا حَتَّى يَطُوفَ بَيْنَ الصَّفَا وَالْمَرْوَةِ
[Machine] An expiation for fasting, or a charity, or a sacrifice. I said, "So which is better?" He said, "A sheep or a cow." I said, "So which is better?" He said, "A sheep." Ayyub disagreed with Sa'id.
فِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ فَقُلْتُ فَأِيُّ ذَلِكَ أَفْضَلُ؟ قَالَ جَزُورٌ أَوْ بَقَرَةٌ قُلْتُ فَأِيُّ ذَلِكَ أَفْضَلُ؟ قَالَ جَزُورٌ خَالَفَهُ أَيُّوبُ عَنْ سَعِيدٍ
[Machine] A man and his wife both went on Umrah pilgrimage and completed all of the rituals except for Tawaf al-Ifadah. Before she could complete it, she fainted. Ibn Abbas was asked about this and he said that it was a seizure. It was mentioned to him that she can hear, so he became embarrassed and said, "Didn't you know that?" He then told her to sacrifice an animal. She asked, "Which one is better?" He said, "A camel." And perhaps this is more similar.
أَنَّ رَجُلًا أَهَلَّ هُوَ وَامْرَأَتُهُ جَمِيعًا بِعُمْرَةٍ فَقَضَتْ مَنَاسِكَهَا إِلَّا التَّقْصِيرَ فَغَشِيَهَا قَبْلَ أَنْ تُقَصِّرَ فَسُئِلَ ابْنُ عَبَّاسٍ عَنْ ذَلِكَ فَقَالَ إِنَّهَا لَشَبِقَةٌ فَقِيلَ لَهُ إِنَّهَا تَسْمَعُ فَاسْتَحْيَا مِنْ ذَلِكَ وَقَالَ أَلَا أَعْلَمْتُمُونِي؟ وَقَالَ لَهَا أَهْرِيقِي دَمًا قَالَتْ مَاذَا؟ قَالَ انْحَرِي نَاقَةً أَوْ بَقَرَةً أَوْ شَاةً قَالَتْ أِيُّ ذَلِكَ أَفْضَلُ؟ قَالَ نَاقَةٌ وَلَعَلَّ هَذَا أَشْبَهُ
لَمْ يَذْكُرْ فِيهِ ابْنَ عَبَّاسٍ
[Machine] About a woman who came as a pilgrim, so she made the pilgrimage around the Kaaba, Safa, and Marwa. Her husband encountered her before she had shaved her head. He said to her, "You should offer a sacrifice of either a camel or a cow." Humeid reported that Ibn Abdullah mentioned that Ibn Abbas was asked about this, and he said, "It is just a tradition." He was then told, "But the woman is a witness." He remained silent for a while, then said, "She should offer a sacrifice of either a camel or a cow."
عَنِ امْرَأَةٍ قَدِمَتْ مُعْتَمِرَةً فَطَافَتْ بِالْبَيْتِ وَالصَّفَا وَالْمَرْوَةِ فَوَقَعَ عَلَيْهَا زَوْجُهَا قَبْلَ أَنْ تُقَصِّرَ قَالَ لِتُهْدِي هَدْيًا بَعِيرًا أَوْ بَقَرَةً قَالَ حُمَيْدٌ وَذَكَرَ ابْنُ عَبْدِ اللهِ أَنَّ ابْنَ عَبَّاسٍ سُئِلَ عَنْ ذَلِكَ فَقَالَ إِنَّهَا لَشَبِقَةٌ قَالَ فَقِيلَ لَهُ إِنَّ الْمَرْأَةَ شَاهِدَةٌ قَالَ فَسَكَتَ ثُمَّ قَالَ لِتُهْدِيَنَّ هَدْيًا بَعِيرًا أَوْ بَقَرَةً
12.264 [Machine] The one who corrupts his 'Umrah and the one who corrupts his Hajj
١٢۔٢٦٤ بَابُ الْمُفْسِدِ لِعُمْرَتِهِ يَقْضِيهَا مِنْ حَيْثُ أَحْرَمَ مَا أَفْسَدَ وَكَذَلِكَ الْمُفْسِدُ لِحَجِّهِ رُوِّينَا عَنْ عَطَاءٍ , عَنْ عُمَرَ بْنِ الْخَطَّابِ فِي مُحْرِمٍ بِحَجَّةٍ أَصَابَ امْرَأَتَهُ وَهِيَ مُحْرِمَةٌ , قَالَ: " يَقْضِيَانِ حَجَّهُمَا وَعَلَيْهِمَا الْحَجُّ مِنْ قَابِلٍ مِنْ حَيْثُ كَانَا أَحْرَمَا " وَرُوِّينَا , عَنِ ابْنِ عَبَّاسٍ , وَأَمَّا مَنْ ذَهَبَ إِلَى أَنَّ عَائِشَةَ رَفَضَتْ عُمْرَتَهَا ثُمَّ أَمَرَهَا رَسُولُ اللهِ ﷺ بِأَنْ تَقْضِيَهَا مِنَ التَّنْعِيمِ فَقَدْ دَلَّلْنَا فِيمَا مَضَى أَنَّ النَّبِيَّ ﷺ إِنَّمَا أَمَرَهَا بِإِدْخَالِ الْحَجِّ عَلَى الْعُمْرَةِ فَكَانَتْ قَارِنَةً , وَإِنَّمَا كَانَتْ عُمْرَتُهَا شَيْئًا اسْتَحَبَّتْهُ
[Machine] He ﷺ said to Aisha, "Your tawaf around the Kaaba and between Safa and Marwa is enough for your Hajj and Umrah."
ﷺ قَالَ لِعَائِشَةَ ؓ طَوَافُكِ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ يَكْفِيكِ لِحَجِّكِ وَعُمْرَتِكِ
[Machine] The Prophet ﷺ said: "One tawaf (circumambulation) after completing the rites of your Hajj and Umrah is sufficient for you."
أَنَّ النَّبِيَّ ﷺ قَالَ يَكْفِيكَ طَوَافٌ وَاحِدٌ بَعْدَ الْمُعَرَّفِ لِحَجِّكِ وَعُمْرَتِكِ
Your circumambulation would suffice both Hajj and Umra. She, however, felt reluctant. Thereupon the Prophet ﷺ sent her with 'Abd al-Rahman to Tan'im and she performed Umra (with separate rituals) after Hajj. (Using translation from Muslim 1211x)
أَهَلَّتْ بِعُمْرَةٍ وَحَاضَتْ وَلَمْ تَطُفْ بِالْبَيْتِ حِينَ حَاضَتْ فَنَسَكَتِ الْمَنَاسِكَ كُلَّهَا وَقَدْ أَهَلَّتْ بِالْحَجِّ فَقَالَ لَهَا النَّبِيُّ ﷺ يَوْمَ النَّفْرِ سَعْيُكِ لِحَجِّكِ وَعُمْرَتِكِ فَأَبَتْ فَبَعَثَ مَعَهَا عَبْدَ الرَّحْمَنِ إِلَى التَّنْعِيمِ فَاعْتَمَرَتْ بَعْدَ الْحَجِّ
12.265 [Machine] Understanding the Hajj by understanding Arafah before dawn on the Day of Sacrifice.
١٢۔٢٦٥ بَابُ إِدْرَاكِ الْحَجِّ بِإِدْرَاكِ عَرَفَةَ قَبْلَ طُلُوعِ الْفَجْرِ مِنْ يَوْمِ النَّحْرِ
[Machine] I heard Abdullah bin Ya'mar saying: I witnessed the Prophet ﷺ saying, "The Hajj is Arafat. Whoever reaches Arafat before dawn has indeed reached Hajj, or completed his Hajj if he stays in Mina for three days. Whoever hastens to leave within two days, then there is no sin upon him. And whoever delays, then there is no sin upon him."
سَمِعْتُ عَبْدَ الرَّحْمَنِ بْنَ يَعْمَرَ يَقُولُ شَهِدْتُ النَّبِيَّ ﷺ يَقُولُ الْحَجُّ عَرَفَةُ الْحَجُّ عَرَفَاتٌ مَنْ أَدْرَكَ عَرَفَةَ قَبْلَ أَنْ يَطْلُعَ الْفَجْرُ فَقَدْ أَدْرَكَ الْحَجَّ أَوْ تَمَّ حَجُّهُ أَيَّامُ مِنًى ثَلَاثَةُ أَيَّامٍ فَمَنْ تَعَجَّلَ فِي يَوْمَيْنِ فَلَا إِثْمَ عَلَيْهِ وَمَنْ تَأَخَّرَ فَلَا إِثْمَ عَلَيْهِ
I came to the Holy Prophet ﷺ when he was in Arafat. Some people or a group of people came from Najd. They commanded someone (to ask the Prophet about hajj). So he called the Messenger of Allah ﷺ, saying: How is the hajj done? He (the Prophet) ordered a man (to reply). He shouted loudly: The hajj, the hajj is on the day of Arafah. If anyone comes over there before the dawn prayer on the night of al-Muzdalifah, his hajj will be complete. The period of halting at Mina is three days. Then whoever hastens (his departure) by two days, it is no sin for him, and whoever delays it there is no sin for him. The narrator said: He (the Prophet) then put a man behind him on the camel. He began to proclaim this loudly. Abu Dawud said: This tradition has been narrated by Mahran from Sufyan in a similar way. This version adds: The Hajj, the Hajj, twice. The version narrated by Yaya b. Sa'id al-Qattan has the words: The Hajj only once. (Using translation from Abū Dāʾūd 1949)
أَتَيْتُ رَسُولَ اللهِ ﷺ وَهُوَ بِعَرَفَاتٍ فَأَتَاهُ نَفَرٌ مِنْ أَصْحَابِهِ فَأَمَرُوا رَجُلًا فَنَادَى يَا رَسُولَ اللهِ كَيْفَ الْحَجُّ كَيْفَ الْحَجُّ؟ قَالَ فَأَمَرَ رَجُلًا فَنَادَى الْحَجُّ يَوْمُ عَرَفَةَ مَنْ جَاءَ قَبْلَ صَلَاةِ الصُّبْحِ مِنْ لَيْلَةِ جَمْعٍ فَقَدْ تَمَّ حَجُّهُ أَيَّامُ مِنًى ثَلَاثَةٌ مَنْ تَعَجَّلَ فِي يَوْمَيْنِ فَلَا إِثْمَ عَلَيْهِ ثُمَّ أَرْدَفَ رَجُلًا مِنْ خَلْفِهِ فَنَادَى بِذَلِكَ
[Machine] I heard 'Urwah ibn Mudarris ibn Aws ibn Harithah ibn Lamah say: "I came to the Messenger of Allah ﷺ with Al-Muzdalifah, and I said, 'O Messenger of Allah, I came from the two mountains of Tayy' and by Allah, I did not come until I exhausted myself and exhausted my mount, and I did not leave anything in these mountains without stopping by it. Do I have a Hajj?' The Messenger of Allah ﷺ said, 'Whoever witnesses this prayer, the Fajr prayer, with us in Al-Muzdalifah, and has already stood at Arafat before that, whether at night or during the day, his Hajj has been completed and he has fulfilled his obligations.' Sufyan said, and Zakariyya added concerning it, 'He was the most memorized among the three in this hadith.' I said, 'O Messenger of Allah, I came at this time from the two mountains of Tayy' and I have exhausted my mount and exhausted myself. Do I have a Hajj?' He said, 'Whoever witnesses this prayer with us and stands with us until it floods, and he has already stood at Arafat before that, whether at night or during the day, his Hajj has been completed and he has fulfilled his obligations.' Sufyan said, and Dawud ibn Abi Hind added, 'I came to the Messenger of Allah ﷺ when dawn had broken and he mentioned the hadith, and the wording of the hadith of Ibn Bashran was mentioned.'"
سَمِعْتُ عُرْوَةَ بْنَ مُضَرِّسِ بْنِ أَوْسِ بْنِ حَارِثَةَ بْنِ لَامَ يَقُولُ أَتَيْتُ رَسُولَ اللهِ ﷺ بِالْمُزْدَلِفَةِ فَقُلْتُ يَا رَسُولَ اللهِ جِئْتُ مِنْ جَبَلَيْ طَيِّئٍ فَوَاللهِ مَا جِئْتُ حَتَّى أَتْعَبْتُ نَفْسِي وَأَنْضَيْتُ رَاحِلَتِي وَمَا تَرَكْتُ مِنْ هَذِهِ الْجِبَالِ شَيْئًا إِلَّا وَقَفْتُ عَلَيْهِ فَهَلْ لِي مِنْ حَجٍّ؟ فَقَالَ رَسُولُ اللهِ ﷺ مَنْ شَهِدَ مَعَنَا هَذِهِ الصَّلَاةَ صَلَاةَ الْفَجْرِ بِالْمُزْدَلِفَةِ وَكَانَ قَدْ وَقَفَ بِعَرَفَةَ قَبْلَ ذَلِكَ مِنْ لَيْلٍ أَوْ نَهَارٍ فَقَدْ تَمَّ حَجُّهُ وَقَضَى تَفَثَهُ قَالَ سُفْيَانُ وَزَادَ زَكَرِيَّا فِيهِ وَكَانَ أَحْفَظَ الثَّلَاثَةِ لِهَذَا الْحَدِيثِ قَالَ فَقُلْتُ يَا رَسُولَ اللهِ أَتَيْتُ هَذِهِ السَّاعَةَ مِنْ جَبَلَيْ طَيِّئٍ قَدْ أَكْلَلْتُ رَاحِلَتِي وَأَتْعَبْتُ نَفْسِي فَهَلْ لِي مِنْ حَجٍّ؟ فَقَالَ مَنْ شَهِدَ مَعَنَا هَذِهِ الصَّلَاةَ وَوَقَفَ مَعَنَا حَتَّى يُفِيضَ وَكَانَ قَدْ وَقَفَ قَبْلَ ذَلِكَ بِعَرَفَةَ مِنْ لَيْلٍ أَوْ نَهَارٍ فَقَدْ تَمَّ حَجُّهُ وَقَضَى تَفَثَهُ قَالَ سُفْيَانُ وَزَادَ دَاوُدُ بْنُ أَبِي هِنْدَ قَالَ أَتَيْتُ رَسُولَ اللهِ ﷺ حِينَ بَرَقَ الْفَجْرُ وَذَكَرَ الْحَدِيثَ لَفْظُ حَدِيثِ ابْنِ بِشْرَانَ
[Machine] "The Messenger of Allah ﷺ said: Whoever departs from Arafat before dawn has completed their Hajj, and whoever misses it has missed the Hajj."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَفَاضَ مِنْ عَرَفَاتٍ قَبْلَ الصُّبْحِ فَقَدْ تَمَّ حَجُّهُ وَمَنْ فَاتَهُ فَقَدْ فَاتَهُ الْحَجُّ
[Machine] The Hajj is not complete until the dawn breaks on the night of Arafah. He said, "I asked 'Ata', Did the Prophet ﷺ inform you of that?' 'Ata' said, 'Yes, 9817.' And with this chain, Ibn Wahb informed me that Ibn Jurayj informed me from Abu Zubair from Jabir ibn Abdullah that he said that."
لَا يَفُوتُ الْحَجُّ حَتَّى يَنْفَجِرَ الْفَجْرُ مِنْ لَيْلَةِ جَمْعٍ قَالَ قُلْتُ لِعَطَاءٍ أَبَلَغَكَ ذَلِكَ عَنْ رَسُولِ اللهِ ﷺ؟ قَالَ عَطَاءٌ نَعَمْ 9817 وَبِهَذَا الْإِسْنَادِ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي ابْنُ جُرَيْجٍ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ أَنَّهُ قَالَ ذَلِكَ
عَنْ عَبْدِ اللهِ بْنِ عُمَرَ مِثْلَهُ
12.266 [Machine] What does someone who missed Hajj do?
١٢۔٢٦٦ بَابُ مَا يَفْعَلُ مَنْ فَاتَهُ الْحَجُّ
[Machine] "He said, 'Whoever reaches the night of sacrifice (the 10th of Dhul-Hijjah) while performing Hajj and stands in Arafat before dawn breaks, has indeed performed Hajj. But whoever does not reach Arafat before dawn breaks, has missed Hajj, so let him come to the Ka'bah and perform Tawaf (circumambulation) around it seven times, and then perform Sa'i (walking between Safa and Marwah) seven times. After that, let him shave his head or trim his hair if he wishes. And if he has brought a sacrificial animal, let him slaughter it before shaving. When he is done with Tawaf and Sa'i, let him shave his head or trim his hair. Then, let him return to his family. If he encounters the Hajj (pilgrimage) from the opposite direction, let him perform Hajj if he is able to, and let him sacrifice an animal. If he is not able to find an animal for sacrifice, then let him fast for three days during Hajj and seven days when he returns to his family.'"
أَنَّهُ قَالَ مَنْ أَدْرَكَ لَيْلَةَ النَّحْرِ مِنَ الْحَاجِّ فَوَقَفَ بِجِبَالِ عَرَفَةَ قَبْلَ أَنْ يَطْلُعَ الْفَجْرُ فَقَدْ أَدْرَكَ الْحَجَّ وَمَنْ لَمْ يُدْرِكْ عَرَفَةَ قَبْلَ أَنْ يَطْلُعَ الْفَجْرُ فَقَدْ فَاتَهُ الْحَجُّ فَلْيَأْتِ الْبَيْتَ فَلْيَطُفْ بِهِ سَبْعًا وَيَطُفْ بَيْنَ الصَّفَا وَالْمَرْوَةِ سَبْعًا ثُمَّ لِيَحْلِقْ أَوْ يُقَصِّرْ إِنْ شَاءَ وَإِنْ كَانَ مَعَهُ هَدْيُهُ فَلْيَنْحَرْهُ قَبْلَ أَنْ يَحْلِقَ فَإِذَا فَرَغَ مِنْ طَوَافِهِ وَسَعْيِهِ فَلْيَحْلِقْ أَوْ يُقَصِّرْ ثُمَّ لِيَرْجِعْ إِلَى أَهْلِهِ فَإِنْ أَدْرَكَهُ الْحَجُّ مِنْ قَابِلٍ فَلْيَحُجَّ إِنِ اسْتَطَاعَ وَلْيُهْدِ فِي حَجِّهِ فَإِنْ لَمْ يَجِدْ هَدْيًا فَلْيَصُمْ عَنْهُ ثَلَاثَةَ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةً إِذَا رَجَعَ إِلَى أَهْلِهِ
[Machine] Abu al-Abbas narrated from al-Rabi` from al-Shafi`i from Malik that 'Umar bin al-Khattab asked Abu Ayyub al-Ansari about his journey for Hajj. He said, "I traveled until I reached the wilderness on the way to Makkah and lost my way. Then I arrived at 'Umar bin al-Khattab on the day of sacrifice and told him about it. 'Umar said to him, 'Do as the Mu'tamir (one who is performing 'Umrah) does. Then, when the Hajj season approaches you, join the Hajj and offer whatever sacrificial animal is easy for you.'"
ثنا أَبُو الْعَبَّاسِ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ مَالِكٌ ح وَأَخْبَرَنَا أَبُو أَحْمَدَ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ الْعَدْلُ أنبأ أَبُو بَكْرٍ مُحَمَّدُ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْعَبْدِيُّ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ أَنَّهُ قَالَ أَخْبَرَنِي سُلَيْمَانُ بْنُ يَسَارٍ أَنَّ أَبَا أَيُّوبَ الْأَنْصَارِيَّ ؓ خَرَجَ حَاجًّا حَتَّى إِذَا كَانَ بِالْبَادِيَةِ مِنْ طَرِيقِ مَكَّةَ أَضَلَّ رَوَاحِلَهُ ثُمَّ إِنَّهُ قَدِمَ عَلَى عُمَرَ بْنِ الْخَطَّابِ ؓ يَوْمَ النَّحْرِ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لَهُ عُمَرُ اصْنَعْ كَمَا يَصْنَعُ الْمُعْتَمِرُ ثُمَّ قَدْ حَلَلْتَ فَإِذَا أَدْرَكَكَ الْحَجُّ مِنْ قَابِلٍ فَاحْجُجْ وَأَهْدِ مَا اسْتَيْسَرَ مِنَ الْهَدْيِ
This hadith has been reported on the authority of Ibn 'Umar through another chain of transmitters. (Using translation from Muslim 1501b)
عَنْ نَافِعٍ
[Machine] He is performing Umrah and upon him is the obligation of Hajj from Qabil.
يُهِلُّ بِعُمْرَةٍ وَعَلَيْهِ الْحَجُّ مِنْ قَابِلٍ كَذَا
[Machine] A man came to Umar, who had missed the opportunity to perform the pilgrimage. Umar told him to make it an Umrah (lesser pilgrimage) and that he should perform the Hajj in the following year. Al-Aswad said, "I stayed for twenty years, then I asked Zaid ibn Thabit about it and he said the same thing as Umar."
جَاءَ رَجُلٌ إِلَى عُمَرَ ؓ قَدْ فَاتَهُ الْحَجُّ قَالَ عُمَرُ اجْعَلْهَا عُمْرَةً وَعَلَيْكَ الْحَجُّ مِنْ قَابِلٍ قَالَ الْأَسْوَدُ مَكَثْتُ عِشْرِينَ سَنَةً ثُمَّ سَأَلْتُ زَيْدَ بْنَ ثَابِتٍ عَنْ ذَلِكَ فَقَالَ مِثْلَ قَوْلِ عُمَرَ
[Machine] I heard that Umar, may Allah be pleased with him, was approached by a man during the middle days of At-Tashriq, after the time for Hajj had passed. Umar said to him, "Perform tawaf between Safa and Marwa, and the obligation of Hajj will be upon you from Qabil." This narration does not mention the gift. This narration and what comes before it from As-Sawad from Umar are connected narrations, attributed to Sulayman ibn Yasar. Al-Shafi'i, may Allah have mercy on him, said: "The connected hadith from Umar is in agreement with our narration from Umar, and our narration includes the gift. And what includes an addition is more deserving of preservation than what does not bring an addition." We also narrated from Ibn Umar as we mentioned earlier, in a connected manner. In the narration of Idris Al-Awdi, if it is authentic, it adds the shedding of blood as evidence for the authenticity of the narration of Sulayman ibn Yasar. Ibrahim ibn Tahman also narrated that Musa ibn Uqbah narrated from Nafi' from Sulayman ibn Yasar from Hubbab ibn Aswad, who mentioned it in a connected manner. We also narrated in the story of Huzabah from Ibn Umar and Ibn Zubayr what indicates the obligation of the gift. And we also narrated from Ibn Abbas that he said: "Whoever forgets or leaves something from his rites, let him shed blood."
سَمِعْتُ عُمَرَ ؓ وَجَاءَهُ رَجُلٌ فِي وَسَطِ أَيَّامِ التَّشْرِيقِ وَقَدْ فَاتَهُ الْحَجُّ فَقَالَ لَهُ عُمَرُ ؓ طُفْ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ وَعَلَيْكَ الْحَجُّ مِنْ قَابِلٍ وَلَمْ يَذْكُرْ هَدْيًا هَذِهِ الرِّوَايَةُ وَمَا قَبْلَهَا عَنِ الْأَسْوَدِ عَنْ عُمَرَ ؓ مُتَّصِلَتَانِ رِوَايَةُ سُلَيْمَانَ بْنِ يَسَارٍ عَنْهُ مُنْقَطِعَةٌ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ الْحَدِيثُ الْمُتَّصِلُ عَنْ عُمَرَ يُوَافِقُ حَدِيثَنَا عَنْ عُمَرَ وَيَزِيدُ حَدِيثُنَا عَلَيْهِ الْهَدْيُ وَالَّذِي يَزِيدُ فِي الْحَدِيثِ أَوْلَى بِالْحِفْظِ مِنَ الَّذِي لَمْ يَأْتِ بِالزِّيَادَةِ وَرَوَيْنَا عَنِ ابْنِ عُمَرَ كَمَا قُلْنَا مُتَّصِلًا وَفِي رِوَايَةِ إِدْرِيسَ الْأَوْدِيِّ إِنْ صَحَّتْ وَيُهَرِيقُ دَمًا وَهِيَ تَشْهَدُ لِرِوَايَةِ سُلَيْمَانَ بْنِ يَسَارٍ بِالصِّحَّةِ وَرَوَى إِبْرَاهِيمُ بْنُ طَهْمَانَ عَنْ مُوسَى بْنِ عُقْبَةَ عَنْ نَافِعٍ عَنْ سُلَيْمَانَ بْنَ يَسَارٍ عَنْ هَبَّارِ بْنِ الْأَسْوَدِ أَنَّهُ حَدَّثَهُ أَنَّهُ فَاتَهُ الْحَجُّ فَذَكَرَهُ مَوْصُولًا وَرُوِّينَا فِي قِصَّةِ حُزَابَةَ عَنِ ابْنِ عُمَرَ وَابْنِ الزُّبَيْرِ مَا دَلَّ عَلَى وُجُوبِ الْهَدْيِ وَرُوِّينَا عَنِ ابْنِ عَبَّاسٍ أَنَّهُ قَالَ مَنْ نَسِيَ شَيْئًا مِنْ نُسُكِهِ أَوْ تَرَكَهُ فَلْيُهْرِقْ دَمًا
12.267 [Machine] The mistake of people on the Day of Arafah.
١٢۔٢٦٧ بَابُ خَطَأِ النَّاسِ يَوْمَ عَرَفَةَ
[Machine] Narrated by Huzaifah, he said: "The Messenger of Allah ﷺ was raised on a pulpit and said: 'Your Fitrah (natural disposition) is on the day you break your fast, and your Adha (sacrifice) is on the day of sacrifice. Every Arafa is a place of standing, and every gathering is a place of standing. Every Mina is a place of slaughter, and every Fijjah of Makkah is a place of slaughter. And thus it is.'"
هُرَيْرَةَ رَفَعَهُ إِلَى النَّبِيِّ ﷺ قَالَ فِطْرُكُمْ يَوْمَ تُفْطِرُونَ وَأَضْحَاكُمْ يَوْمَ تُضَحُّونَ كُلُّ عَرَفَةَ مَوْقِفٌ وَكُلُّ جَمْعٍ مَوْقِفٌ وَكُلُّ مِنًى مَنْحَرٌ وَكُلُّ فِجَاجِ مَكَّةَ مَنْحَرٌ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "Arafah is the day on which the Imam (leader) is recognized, and the day of sacrifice is the day on which the Imam offers the sacrifice, and the day of breaking the fast is the day on which the Imam breaks his fast." Muhammad, this (name), is known as "Al-Farisi" and he is from Kufa, a judge from Fars, who has distinguished himself from Sufyan.
قَالَ رَسُولُ اللهِ ﷺ عَرَفَةُ يَوْمَ يُعَرِّفُ الْإِمَامُ وَالْأَضْحَى يَوْمَ يُضَحِّي الْإِمَامُ وَالْفِطْرُ يَوْمَ يُفْطِرُ الْإِمَامُ مُحَمَّدٌ هَذَا يُعْرَفُ بِالْفَارِسِيِّ وَهُوَ كُوفِيٌّ قَاضِي فَارِسَ تَفَرَّدَ بِهِ عَنْ سُفْيَانَ
[Machine] The Messenger of Allah ﷺ said on the Day of Arafah, "Today is the day on which people are acquainted, this is a good message."
قَالَ رَسُولُ اللهِ ﷺ يَوْمُ عَرَفَةَ الْيَوْمُ الَّذِي يُعَرِّفُ النَّاسُ فِيهِ هَذَا مُرْسَلٌ جَيِّدٌ
[Machine] I asked 'Ata', a man who performed Hajj for the first time, if people made a mistake on the Day of Sacrifice, would it count for him? He said yes, by my life, it would count for him. I said, and I consider it to be (exempt for him). He said, the Prophet ﷺ said, "Your Fitrah is on the day you break your fast, your sacrifice is on the day you sacrifice, and your Arafah is on the day you stand at Arafah."
قُلْتُ لِعَطَاءٍ رَجُلٌ حَجَّ أَوَّلَ مَا حَجَّ فَأَخْطَأَ النَّاسَ بِيَوْمِ النَّحْرِ أَيُجْزِئُ عَنْهُ؟ قَالَ نَعَمْ أَيْ لَعَمْرِي إِنَّهَا لَتُجْزِيءُ عَنْهُ قَالَ وَأَحْسَبُهُ قَالَ قَالَ النَّبِيُّ ﷺ فِطْرُكُمْ يَوْمَ تُفْطِرُونَ وَأَضْحَاكُمْ يَوْمَ تُضَحُّونَ وَأُرَاهُ قَالَ وَعَرَفَةُ يَوْمَ تُعَرِّفُونَ
12.268 [Machine] Entering Mecca without the intention of Hajj or Umrah
١٢۔٢٦٨ بَابُ دُخُولِ مَكَّةَ بِغَيْرِ إِرَادَةِ حَجٍّ وَلَا عُمْرَةٍ قَالَ اللهُ ﷻ: {وَإِذْ جَعَلْنَا الْبَيْتَ مَثَابَةً لِلنَّاسِ وَأَمْنًا} [البقرة: 125] الْآيَةَ , قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: الْمَثَابَةُ فِي كَلَامِ الْعَرَبِ الْمَوْضِعُ يَثُوبُ النَّاسُ إِلَيْهِ وَيَؤُبُونَ يَعُودُونَ إِلَيْهِ بَعْدَ الذَّهَابِ عَنْهُ , وَقَدْ يُقَالُ: ثَابَ إِلَيْهِ اجْتَمَعَ إِلَيْهِ
[Machine] In His saying, "And [mention] when We made the House a place of return for the people and [a place of] security." [Quran 2:125], it was said that people come to it and leave it, and they keep coming back, never ceasing from it, willingly.
فِي قَوْلِهِ تَعَالَى {وَإِذْ جَعَلْنَا الْبَيْتَ مَثَابَةً لِلنَّاسِ وَأَمْنًا} [البقرة 125] قَالَ يَثُوبُونَ إِلَيْهِ وَيَذْهَبُونَ وَيَرْجِعُونَ لَا يَقْضُونَ مِنْهُ وَطَرًا
[Machine] About Mujahid in his saying "as a place of refuge for the people" [Al-Baqarah 125], he says they will never run out of it completely "and security" [Al-Baqarah 125], he says no one who enters it will fear.
عَنْ مُجَاهِدٍ فِي قَوْلِهِ {مَثَابَةً لِلنَّاسِ} [البقرة 125] يَقُولُ لَا يَقْضُونَ مِنْهُ وَطَرًا أَبَدًا {وَأَمْنًا} [البقرة 125] يَقُولُ لَا يَخَافُ مَنْ دَخَلَهُ
[Machine] In His saying, "And proclaim to the people the Hajj [pilgrimage]" [Quran 22:27], when Allah commanded Ibrahim ﷺ to proclaim the Hajj to the people, he said, "O people, indeed your Lord has taken a house and commanded you to perform Hajj to it." So he responded to what he heard from a stone, tree, ant hill, dust, or anything, and they said, "Labbaik Allahuma Labbaik."
فِي قَوْلِهِ {وَأَذِّنْ فِي النَّاسِ بِالْحَجِّ} [الحج 27] قَالَ لَمَّا أَمَرَ اللهُ ﷻ إِبْرَاهِيمَ ﷺ أَنْ يُؤَذِّنَ فِي النَّاسِ بِالْحَجِّ قَالَ يَا أَيُّهَا النَّاسُ إِنَّ رَبَّكُمُ اتَّخَذَ بَيْتًا وَأَمَرَكُمْ أَنْ تَحُجُّوهُ فَاسْتَجَابَ لَهُ مَا سَمِعَهُ مِنْ حَجَرٍ أَوْ شَجَرٍ أَوْ أَكَمَةٍ أَوْ تُرَابٍ أَوْ شَيْءٍ فَقَالُوا لَبَّيْكَ اللهُمَّ لَبَّيْكَ
[Machine] O people, the pilgrimage to the ancient House (the Kaaba) has been prescribed upon you, so let the one who is within reach of its hearing (the call to Hajj) announce it to those far away. Don't you see that they come from the distant corners of the Earth, answering the call?
يَا أَيُّهَا النَّاسُ كُتِبَ عَلَيْكُمُ الْحَجُّ حَجُّ الْبَيْتِ الْعَتِيقِ فَسَمِعَهُ مَنْ بَيْنَ السَّمَاءِ وَالْأَرْضِ أَلَا تَرَى أَنَّهُمْ يَجِيئُونَ مِنْ أَقْصَى الْأَرْضِ يُلَبُّونَ؟
We were with Ibn ʿAbbas and the people mentioned Ad-Dajjal. Someone said, "The word 'Kafir' (unbeliever) is written in between his (Ad-Dajjal's) eyes." Ibn ʿAbbas said, "I have not heard the Prophet saying this, but he said, 'As regards Abraham, he looks like your companion (i.e. the Prophet, Muhammad), and as regards Moses, he is a brown curly haired man riding a camel and reigned with a strong jute rope, as if I am now looking at him getting down in the valley and saying, "Labbaik".'" أَمَّا إِبْرَاهِيمُ فَانْظُرُوا إِلَى صَاحِبِكُمْ وَأَمَّا مُوسَى فَرَجُلٌ آدَمُ جَعْدٌ عَلَى جَمَلٍ أَحْمَرَ مَخْطُومٍ بِخُلْبَةٍ كَأَنِّي أَنْظُرُ إِلَيْهِ قَدِ انْحَدَرَ مِنَ الْوَادِي يُلَبِّي
[Machine] The Messenger of Allah, ﷺ , said: "The location of the House (Kaaba) during the time of Adam was a span or more in knowledge, so the angels would make Hajj (pilgrimage) to it before Adam. Then Adam made Hajj and the angels welcomed him, and they said, 'O Adam, where did you come from?' He said, 'I made Hajj to the House.' They said, 'The angels had already made Hajj to it before you.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ كَانَ مَوْضِعُ الْبَيْتِ فِي زَمَنِ آدَمَ شِبْرًا أَوْ أَكْثَرَ عِلْمًا فَكَانَتِ الْمَلَائِكَةُ تَحُجُّهُ قَبْلَ آدَمَ ثُمَّ حَجَّ آدَمُ فَاسْتَقْبَلَتْهُ الْمَلَائِكَةُ فَقَالُوا يَا آدَمُ مِنْ أَيْنَ جِئْتَ؟ قَالَ حَجَجْتُ الْبَيْتَ فَقَالُوا قَدْ حَجَّتْهُ الْمَلَائِكَةُ قَبْلَكَ
[Machine] Adam, ﷺ , performed pilgrimage and met the angels. They said, "Your pilgrimage is accepted, O Adam. We have performed pilgrimage before you by two thousand years."
حَجَّ آدَمُ عَلَيْهِ السَّلَامُ فَلَقِيَتْهُ الْمَلَائِكَةُ فَقَالُوا بَرَّ نُسُكُكَ آدَمُ لَقَدْ حَجَجْنَا قَبْلَكَ بِأَلْفَيْ عَامٍ
