١٢۔ كِتَابُ الْحَجِّ ص ٢٦
[Machine] He said that He will send him, so if he slaughters him, the penalty is upon him.
أَنَّهُ قَالَ يُرْسِلُهُ فَإِنْ ذَبَحَهُ فَعَلَيْهِ الْجَزَاءُ
[Machine] The slaughtered game that is hunted in the sanctuary and in another narration from Al-Hajjaj from Ata that Aisha, Ibn Abbas, and Hasan or Hussein disliked slaughtering the game in Mecca and did not see any harm in bringing it as a slaughtered animal. And it was narrated from Ata that he said: When halal game is caught in the sanctuary, a ruling is made upon it as it is made upon the haram. He said: And the haram, if it is caught in the sanctuary, it requires one expiation.
يُذْبَحَ الصَّيْدُ الَّذِي يُصَادُ فِي الْحِلِّ فِي الْحَرَمِ وَفِي رِوَايَةٍ أُخْرَى عَنِ الْحَجَّاجِ عَنْ عَطَاءٍ أَنَّ عَائِشَةَ وَابْنَ عَبَّاسٍ وَالْحَسَنَ أَوِ الْحُسَيْنَ كَرِهُوا ذَبْحَ الصَّيْدِ بِمَكَّةَ وَلَمْ يَرَوْا بَأْسًا أَنْ يُدْخَلَ بِهِ مَذْبُوحًا وَرُوِّينَا عَنْ عَطَاءٍ أَنَّهُ قَالَ إِذَا أَصَابَ الْحَلَالُ فِي الْحَرَمِ الصَّيْدَ حُكِمَ عَلَيْهِ كَمَا يُحْكَمُ عَلَى الْمُحْرِمِ قَالَ وَالْمُحْرِمُ إِذَا أَصَابَ فِي الْحَرَمِ فَعَلَيْهِ كَفَّارَةٌ وَاحِدَةٌ
12.294 [Machine] The hunting of the sacred land is not prohibited, nor is its tree supported, nor is its solitude disturbed except in exceptional cases.
١٢۔٢٩٤ بَابٌ: لَا يُنَفَّرُ صَيْدُ الْحَرَمِ وَلَا يُعْضَدُ شَجَرُهُ وَلَا يُخْتَلَى خَلَاهُ إِلَّا الْإِذْخِرَ
Messenger of Allah ﷺ said on the day of the conquest of Mecca, "There is no migration now, but there is Jihad (i.e.. holy battle) and good intentions. And when you are called for Jihad, you should come out at once" Messenger of Allah ﷺ also said, on the day of the conquest of Mecca, "Allah has made this town a sanctuary since the day He created the Heavens and the Earth. So, it is a sanctuary by Allah's Decree till the Day of Resurrection. Fighting in it was not legal for anyone before me, and it was made legal for me only for an hour by daytime. So, it (i.e. Mecca) is a sanctuary by Allah's Decree till the Day of Resurrection. Its thorny bushes should not be cut, and its game should not be chased, its fallen property (i.e. Luqata) should not be picked up except by one who will announce it publicly; and its grass should not be uprooted," On that Al-ʿAbbas said, "O Messenger of Allah ﷺ! Except the Idhkhir, because it is used by the goldsmiths and by the people for their houses." On that the Prophet ﷺ said, "Except the Idhkhir." (Using translation from Bukhārī 3189)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ يَوْمَ الْفَتْحِ فَتْحِ مَكَّةَ لَا هِجْرَةَ وَلَكِنْ جِهَادٌ وَنِيَّةٌ فَإِذَا اسْتُنْفِرْتُمْ فَانْفِرُوا وَقَالَ رَسُولُ اللهِ ﷺ يَوْمَ الْفَتْحِ فَتْحِ مَكَّةَ إِنَّ هَذَا الْبَلَدَ حَرَّمَهُ اللهُ يَوْمَ خَلَقَ السَّمَاوَاتِ وَالْأَرْضَ فَهُوَ حَرَامٌ بِحُرْمَةِ اللهِ إِلَى يَوْمِ الْقِيَامَةِ لَا يُخْتَلَى خَلَاهَا وَلَا يُعْضَدُ شَوْكُهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا يَلْتَقِطُ لُقَطَتَهَا إِلَّا مَنْ عَرَّفْهَا فَقَالَ الْعَبَّاسُ ؓ يَا رَسُولَ اللهِ إِلَّا الْإِذْخَرَ فَإِنَّهُ لِقَيْنِهِمْ وَلِبُيُوتِهِمْ فَقَالَ رَسُولُ اللهِ ﷺ إِلَّا الْإِذْخِرَ
[Machine] The Messenger of Allah ﷺ said: "Allah has forbidden Makkah, it is not allowed for anyone before me or after me, except for me for an hour during the day that cannot be violated, its trees cannot be cut, its game cannot be scared away, and its lost objects cannot be picked up except with identification." Al-Abbas said: "O Messenger of Allah, what about the aromatic shrubs for our perfumes and our homes?" He said: "Except for the aromatic shrubs." Abu Amr Al-Adibi reported to us, narrating from Abu Bakr Al-Isma'ili, from Al-Qasim bin Zakariyya, from Amr bin Ali and Al-Busri, who said: Abdul Wahab mentioned it through his chain of narration, except that he said: "And it has been permitted for our perfumes and the roofs of our homes." Ikrima added: "Do you know how its game is not scared away? It is that it moves it away from the shade and puts it in its place."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ ﷻ حَرَّمَ مَكَّةَ فَلَمْ تَحِلَّ لِأَحَدٍ كَانَ قَبْلِي وَلَا تَحِلُّ لِأَحَدٍ بَعْدِي وَإِنَّهَا أُحِلَّتْ لِي سَاعَةً مِنْ نَهَارٍ لَا يُخْتَلَى خَلَاهَا وَلَا يُعْضَدُ شَجَرُهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا يُلْتَقَطُ لُقَطَتُهَا إِلَّا لِمُعَرِّفٍ فَقَالَ الْعَبَّاسُ يَا رَسُولَ اللهِ إِلَّا الْإِذْخِرَ لِصَاغَتِنَا وَبُيُوتِنَا قَالَ إِلَّا الْإِذْخِرَ 9946 وَأَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ ثنا الْقَاسِمُ بْنُ زَكَرِيَّا ثنا عَمْرُو بْنُ عَلِيٍّ وَالْبُسْرِيُّ قَالَا ثنا عَبْدُ الْوَهَّابِ فَذَكَرَهُ بِإِسْنَادِهِ إِلَّا أَنَّهُ قَالَ وَإِنَّمَا أُحِلَّتْ وَقَالَ فَإِنَّهُ لِصَاغَتِنَا وَلِسُقُوفِ بُيُوتِنَا وَزَادَ قَالَ عِكْرِمَةُ هَلْ تَدْرِي مَا لَا يُنَفَّرُ صَيْدُهَا أَنْ يُنَحِّيَهُ مِنَ الظِّلِّ وَيَنْزِلَ مَكَانَهُ؟
[Machine] About the Prophet ﷺ , he said in the hadith, "It is not permissible for a person who believes in Allah and the Last Day to shed blood with it (referring to a tree) or support a tree with it." Ali ibn Ahmad ibn Abdan narrated to us that Ahmad ibn Ubaid narrated to us from Ahmad ibn Ibrahim ibn Milhan who narrated from Yahya who narrated from Al-Layth from Sa'id Al-Maqburi from Abu Shurayh. They mentioned it in the authentic hadith from Qutaybah from Al-Layth.
عَنِ النَّبِيِّ ﷺ فَقَالَ فِي الْحَدِيثِ فَلَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْفِكَ بِهَا دَمًا وَلَا يَعْضِدَ بِهَا شَجَرَةً أَخْبَرَنَاهُ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ ثنا أَحْمَدُ بْنُ إِبْرَاهِيمَ بْنِ مِلْحَانَ ثنا يَحْيَى ثنا اللَّيْثُ عَنْ سَعِيدٍ الْمَقْبُرِيِّ عَنِ أَبِي شُرَيْحٍ أَخْرَجَاهُ فِي الصَّحِيحِ عَنْ قُتَيْبَةَ عَنِ اللَّيْثِ
[Machine] Narrating from the Prophet ﷺ , he said in the Hadith: "It is forbidden to uproot its tree, or to pluck its thorns, or to pick its fallen leaves, except for a singer." Abu Abdullah al-Hafiz, Abu Abdullah as-Susi, and Abu Abdullah as-Sulami narrated this. They said: Abu Abbas bin al-Walid narrated to us, and my father narrated to us, that al-Awza'i narrated from Yahya bin Abi Kathir, who narrated from Abu Salamah bin Abdur Rahman, who narrated from Abu Hurairah who mentioned this and said: "O Messenger of Allah, what about if it is the thorny clusters, because we use them in our houses and graves?" The Messenger of Allah ﷺ said, "Except for the thorny clusters, except for the thorny clusters." This is what al-Walid bin Mazid narrated from al-Awza'i. And al-Walid bin Muslim narrated from al-Awza'i, adding to the Hadith: "Its game should not be driven away, its thorns should not be plucked, and its fallen leaves should not be allowed except for a singer." And Shiban narrated from Yahya, and he said in the Hadith: "Its thorns should not be tapped, its tree should not be uprooted, and its fallen leaves should not be picked except by a singer. All of this is mentioned in its appropriate places in the book, God willing."
عَنِ النَّبِيِّ ﷺ فَقَالَ فِي الْحَدِيثِ حَرَامٌ لَا يُعْضَدُ شَجَرُهَا وَلَا يُخْتَلَى شَوْكَتُهَا وَلَا يُلْتَقَطُ سَاقِطَتُهَا إِلَّا لِمُنْشِدٍ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو عَبْدِ اللهِ السُّوسِيُّ قَالُوا ثنا أَبُو الْعَبَّاسِ أنا الْعَبَّاسُ بْنُ الْوَلِيدِ أنا أَبِي ثنا الْأَوْزَاعِيُّ ثنا يَحْيَى بْنُ أَبِي كَثِيرٍ حَدَّثَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ حَدَّثَنِي أَبُو هُرَيْرَةَ فَذَكَرَهُ وَقَالَ فَقَالَ الْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ ؓ يَا رَسُولَ اللهِ إِلَّا الْإِذْخِرَ فَإِنَّا نَجْعَلُهُ فِي مَسَاكِنِنَا وَقُبُورِنَا فَقَالَ رَسُولُ اللهِ ﷺ إِلَّا الْإِذْخِرَ إِلَّا الْإِذْخِرَ كَذَا قَالَ الْوَلِيدُ بْنُ مَزْيَدٍ عَنِ الْأَوْزَاعِيِّ وَرَوَاهُ الْوَلِيدُ بْنُ مُسْلِمٍ عَنِ الْأَوْزَاعِيِّ فَقَالَ فِي الْحَدِيثِ فَلَا يُنَفَّرُ صَيْدُهَا وَلَا يُخْتَلَى شَوْكُهَا وَلَا تَحِلُّ سَاقِطَتُهَا إِلَّا لِمُنْشِدٍ وَفِي رِوَايَةٍ أُخْرَى عَنْهُ لَا يُعْضَدُ شَجَرُهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا تَحِلُّ لُقَطَتُهَا إِلَّا لِمُنْشِدٍ وَرَوَاهُ شَيْبَانُ عَنْ يَحْيَى فَقَالَ فِي الْحَدِيثِ لَا يُخْبَطُ شَوْكُهَا وَلَا يُعْضَدُ شَجَرُهَا وَلَا يَلْتَقِطُ سَاقِطَتَهَا إِلَّا الْمُنْشِدُ وَكُلُّ ذَلِكَ يَرِدُ فِي مَوَاضِعِهِ مِنَ الْكِتَابِ إِنْ شَاءَ اللهُ
[Machine] And he said to him, "Do not return, and he did not impose anything upon him."
وَقَالَ لَهُ لَا تَعُدْ وَلَمْ يَجْعَلْ عَلَيْهِ شَيْئًا
[Machine] Imam Al-Shafi'i said, "Whoever cuts anything from the sacred tree, whether it is lawful or forbidden, will be rewarded a sheep for the small tree and a cow for the large tree." This is narrated from Ibn Zubayr and Ata' together. And with this chain of narration, he said in the context of atonement and redemption in the previous report from Ibn Zubayr and Ata' that there is a cow in Al-Dawhah. Al-Dawhah is the great tree. Ata' said there is a sheep in the tree below it. Al-Shafi'i said, "The analogy is the first evidence that whoever damages it will pay its value." The Shaykh narrated from Ibn Jurayj, from Ata' regarding a person who cuts something from the sacred tree. Ata' said, "For the branch, it is worth a dirham, and for Al-Dawhah, it is a cow."
قَالَ الشَّافِعِيُّ مَنْ قَطَعَ مِنْ شَجَرِ الْحَرَمِ شَيْئًا جَزَاهُ حَلَالًا كَانَ أَوْ مُحْرِمًا فِي الشَّجَرَةِ الصَّغِيرَةِ شَاةٌ وَفِي الْكَبِيرَةِ بَقَرَةٌ يُرْوَى هَذَا عَنِ ابْنِ الزُّبَيْرِ وَعَطَاءٍ مُجْتَمِعَةً وَبِهَذَا الْإِسْنَادِ قَالَ فِي الْإِمْلَاءِ وَالْفِدْيَةُ فِي مُتَقَدِّمِ الْخَبَرِ عَنِ ابْنِ الزُّبَيْرِ وَعَطَاءٍ مُجْتَمِعَةٌ فِي أَنَّ فِي الدَّوْحَةِ بَقَرَةً وَالدَّوْحَةُ الشَّجَرَةُ الْعَظِيمَةُ وَقَالَ عَطَاءٌ فِي الشَّجَرَةِ دُونَهَا شَاةٌ قَالَ الشَّافِعِيُّ فَالْقِيَاسُ أَوَّلًا مَا وُصِفَ فِيهِ أَنَّهُ يَفْدِيهِ مَنْ أَصَابَهُ بِقِيمَتِهِ قَالَ الشَّيْخُ رُوِّينَا عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ فِي الرَّجُلِ يَقْطَعُ مِنْ شَجَرِ الْحَرَمِ قَالَ فِي الْقَضِيبِ دِرْهَمٌ وَفِي الدَّوْحَةِ بَقَرَةٌ
12.295 [Machine] What came in the sanctuary of Madinah
١٢۔٢٩٥ بَابُ مَا جَاءَ فِي حَرَمِ الْمَدِينَةِ
We have nothing except the Book of Allah, may He be exalted, and this document from the Prophet ﷺ. Madinah is a sanctuary from ʿAʿir to Thawr; whoever commits an offence in it or gives refuge to an offender, may the curse of Allah, the angels and all the people be upon him and no obligatory or nafl act of worship will be accepted from him.ʿ And he said: ʿProtection given by any Muslim is binding upon all of them. Whoever transgresses protection given by a Muslim, upon him be the curse of Allah, the angels and all the people, and Allah will not accept from him any nafl or obligatory act of worship. Whoever takes people as mawla without the permission of the ones who set him free, upon him be the curse of Allah, the angels and all the people, and Allah will not accept from him any nafl or obligatory act of worship.” (Using translation from Aḥmad 1037)
عَنْ رَسُولِ اللهِ ﷺ إِلَّا الْقُرْآنَ وَمَا فِي هَذِهِ الصَّحِيفَةِ قَالَ قَالَ رَسُولُ اللهِ ﷺ الْمَدِينَةُ حَرَامٌ مَا بَيْنَ عِيرٍ إِلَى ثَوْرٍ فَمَنْ أَحْدَثَ فِيهَا حَدَثًا أَوْ آوَى مُحْدِثًا فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يَقْبَلُ اللهُ مِنْهُ صَرْفًا وَلَا عَدْلًا ذِمَّةُ الْمُسْلِمِينَ وَاحِدَةٌ يَسْعَى بِهَا أَدْنَاهُمْ فَمَنْ أَخْفَرَ مُسْلِمًا فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يَقْبَلُ مِنْهُ عَدْلًا وَلَا صَرْفًا وَمَنْ وَالَى قَوْمًا بِغَيْرِ إِذْنِ مَوَالِيهِ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يَقْبَلُ مِنْهُ عَدْلًا وَلَا صَرْفًا
[Machine] "He used to say, 'If I saw a wolf roaming in the city, it would not frighten me.' The Messenger of Allah ﷺ said, 'It is not permissible to harm any living creature between its two eyes.'"
أَنَّهُ كَانَ يَقُولُ لَوْ رَأَيْتُ الظِّبَاءَ تَرْتَعُ بِالْمَدِينَةِ مَا ذَعَرْتُهَا قَالَ رَسُولُ اللهِ ﷺ مَا بَيْنَ لَابَتَيْهَا حَرَامٌ
[Machine] The Messenger of Allah ﷺ said, "The city of Madinah is sacred from the point between the two mountains until the point between the two mountains. Whoever innovates in it or provides shelter to an innovator, upon him is the curse of Allah, the angels, and all the people." Abu Abdullah Al-Hafiz and Abu Saeed bin Abi Amr reported to us, they said: Abu Al-Abbas Muhammad bin Ya'qub narrated to us, he said: Ahmad bin Abd Al-Jabbār narrated it to me, mentioning it with its chain of narration, and he added, "Neither rebellion nor injustice is accepted from him."
قَالَ رَسُولُ اللهِ ﷺ الْمَدِينَةُ حَرَمٌ مَا بَيْنَ عِيرٍ إِلَى ثَوْرٍ فَمَنْ أحْدَثَ فِيهَا حَدَثًا أَوْ آوَى مُحْدِثًا فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ 9954 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ وَزَادَ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ
The Prophet ﷺ said, "The Prophet ﷺ Abraham made Mecca a sanctuary, and asked for Allah's blessing in it. I made Medina a sanctuary as Abraham made Mecca a sanctuary and I asked for Allah's Blessing in its measures the Mudd and the Sa as Abraham did for Mecca. (Using translation from Bukhārī 2129)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ إِنَّ إِبْرَاهِيمَ حَرَّمَ مَكَّةَ وَدَعَا لَهَا وَحَرَّمْتُ الْمَدِينَةَ كَمَا حَرَّمَ إِبْرَاهِيمُ مَكَّةَ وَدَعَوْتُ لَهَا فِي مُدِّهَا وَصَاعِهَا مِثْلَ مَا دَعَا إِبْرَاهِيمُ لِمَكَّةَ
The Prophet ﷺ said, "The Prophet ﷺ Abraham made Mecca a sanctuary, and asked for Allah's blessing in it. I made Medina a sanctuary as Abraham made Mecca a sanctuary and I asked for Allah's Blessing in its measures the Mudd and the Sa as Abraham did for Mecca. (Using translation from Bukhārī 2129)
عَنِ النَّبِيِّ ﷺ قَالَ إِنَّ إِبْرَاهِيمَ عَلَيْهِ السَّلَامُ حَرَّمَ مَكَّةَ وَإِنِّي حَرَّمْتُ الْمَدِينَةَ كَمَا حَرَّمَ إِبْرَاهِيمُ مَكَّةَ وَدَعَوْتُ لَهَا فِي مُدِّهَا وَصَاعِهَا مِثْلَ مَا دَعَا إِبْرَاهِيمُ عَلَيْهِ السَّلَامُ لِمَكَّةَ
When the mountain of Uhud came in the sight of Messenger of Allah ﷺ he said. "This is a mountain that loves us and is loved by us. O Allah! Abraham made Mecca a sanctuary, and I make (the area) in between these two mountains (of Medina) a sanctuary." (Using translation from Bukhārī 3367)
أَنَّ النَّبِيَّ ﷺ طَلَعَ لَهُ أُحُدٌ فَقَالَ هَذَا جَبَلٌ يُحِبُّنَا وَنُحِبُّهُ اللهُمَّ إِنَّ إِبْرَاهِيمَ حَرَّمَ مَكَّةَ وَإِنِّي أُحَرِّمُ مَا بَيْنَ لَابَتَيْهَا
[Machine] The Messenger of Allah ﷺ said, so he mentioned the hadith in its entirety in the story of Khaybar. He said, "When Uhud appeared to us, the Messenger of Allah ﷺ said, 'This is a mountain that loves us and we love it. When it came close to the city, the Messenger of Allah ﷺ said, 'O Allah, I make unlawful what is between its two lava fields, just as Ibrahim made Makkah unlawful. O Allah, bless them in their measures and their quantities.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فَذَكَرَ الْحَدِيثَ بِطُولِهِ فِي قِصَّةِ خَيْبَرَ قَالَ فَلَمَّا بَدَا لَنَا أُحُدٌ قَالَ رَسُولُ اللهِ ﷺ جَبَلٌ يُحِبُّنَا وَنُحِبُّهُ فَلَمَّا أَشْرَفَ عَلَى الْمَدِينَةِ قَالَ اللهُمَّ إِنِّي أُحَرِّمُ مَا بَيْنَ لَابَتَيْهَا كَمَا حَرَّمَ إِبْرَاهِيمُ مَكَّةَ اللهُمَّ بَارِكْ لَهُمْ فِي صَاعِهِمْ وَمُدِّهِمْ
The Prophet ﷺ said, "Medina is a sanctuary from that place to that. Its trees should not be cut and no heresy should be innovated nor any sin should be committed in it, and whoever innovates in it an heresy or commits sins (bad deeds), then he will incur the curse of Allah, the angels, and all the people." (See Hadith No. 409, Vol 9). (Using translation from Bukhārī 1867)
أَنَّ النَّبِيَّ ﷺ قَالَ إِنَّ الْمَدِينَةَ حَرَمٌ آمِنٌ مِنْ كَذَا إِلَى كَذَا لَا يُقْطَعُ شَجَرُهَا وَلَا يُحْدَثُ فِيهَا حَدَثٌ فَمَنْ أَحْدَثَ فِيهَا حَدَثًا فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ
[Machine] I asked Anas ibn Malik, "Did the Messenger of Allah ﷺ declare Medina as a sacred place?" He replied, "Yes, it is forbidden. Allah and His Messenger declared it as such, and it should not be violated. Whoever does so will be condemned by Allah, the angels, and all people." This is the wording of the hadith of Muhammad, and in another narration, the wording is from Ibrahim. Whoever does this act, it is the same for everyone.
سَأَلْتُ أَنَسَ بْنَ مَالِكٍ أَحَرَّمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ؟ قَالَ نَعَمْ هِيَ حَرَامٌ حَرَّمَهَا اللهُ وَرَسُولُهُ لَا يُخْتَلَى خَلَاهَا فَمَنْ يَعْمَلْ بِذَلِكَ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَفْظُ حَدِيثِ مُحَمَّدٍ وَفِي رِوَايَةِ إِبْرَاهِيمَ فَمَنْ فَعَلَ ذَلِكَ وَالْبَاقِي سَوَاءٌ
I have declared sacred the territory between the two lava plains of Medina, so its trees should not be cut down, or its game killed; and he also said: Medina is best for them if they knew. No one leaves it through dislike of it without Allah putting in it someone better than he in place of him; and no one will stay there in spite of its hardships and distress without my being an intercessor or witness on behalf of him on the Day of Resurrection. قَالَ رَسُولُ اللهِ ﷺ إِنِّي أُحَرِّمُ مَا بَيْنَ لَابَتَيِ الْمَدِينَةِ أَنْ يُقْطَعَ عِضَاهُهَا أَوْ يُقْتَلَ صَيْدُهَا وَقَالَ الْمَدِينَةُ خَيْرٌ لَهُمْ لَوْ كَانُوا يَعْلَمُونَ لَا يَخْرُجُ عَنْهَا أَحَدٌ رَغْبَةً إِلَّا أَبْدَلَ اللهُ فِيهَا مَنْ هُوَ خَيْرٌ مِنْهُ وَلَا يَثْبُتُ أَحَدٌ عَلَى لَأْوَائِهَا وَجَهْدِهَا إِلَّا كُنْتُ لَهُ شَهِيدًا أَوْ شَفِيعًا يَوْمَ الْقِيَامَةِ
[Machine] The Messenger of Allah ﷺ said: "Indeed, Ibrahim has made Makkah a sacred place, and I am making everything between its two mountains sacred, intending to include Madinah."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ إِبْرَاهِيمَ حَرَّمَ مَكَّةَ وَإِنِّي أُحَرِّمُ مَا بَيْنَ لَابَتَيْهَا يُرِيدُ الْمَدِينَةَ
What is this that I hear you making mention of Mecca and its inhabitants and its sacredness, but you did not make mention of Medina and its inhabitants and its sacredness, while the Messenger of Allah ﷺ has also declared sacred (the area) between its two lava lands (Medina)? And (we have record of this) with us written on Khaulani parchment. If you like, I can read it out to you. Thereupon Marwan became silent, and then Said: I too have heard some part of it. مَا لِي أَسْمَعُكَ ذَكَرْتَ مَكَّةَ وَأَهْلَهَا وَحُرْمَتَهَا وَلَمْ تَذْكُرِ الْمَدِينَةَ وَأَهْلَهَا وَحُرْمَتَهَا ؟ وَقَدْ حَرَّمَ رَسُولُ اللهِ ﷺ مَا بَيْنَ لَابَتَيْهَا وَذَلِكَ عِنْدَنَا فِي أَدِيمٍ حَوْلَانِيٍّ إِنْ شِئْتَ أَقْرَأْتُكَهُ قَالَ فَسَكَتَ مَرْوَانُ ثُمَّ قَالَ قَدْ سَمِعْتُ بَعْضَ ذَلِكَ
[Machine] "He heard the Prophet ﷺ say, 'I have forbidden what is between my house and the mosque just as Ibrahim forbade Makkah.' Abu Sa'id Al-Khudri would find a bird in one of our hands and take it from our hand, then release it.'"
أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ إِنِّي حَرَّمْتُ مَا بَيْنَ لَابَتَيِ الْمَدِينَةِ كَمَا حَرَّمَ إِبْرَاهِيمُ مَكَّةَ قَالَ وَكَانَ أَبُو سَعِيدٍ الْخُدْرِيُّ يَجِدُ فِي يَدَيْ أَحَدِنَا الطَّيْرَ فَيَأْخُذُهُ فَيَفُكُّهُ مِنْ يَدِهِ ثُمَّ يُرْسِلُهُ
That is a sacred territory and a place of safety. (Using translation from Muslim 1375)
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ وَأَوْمَى بِيَدِهِ إِلَى الْمَدِينَةِ فَقَالَ إِنَّهَا حَرَمٌ آمِنٌ
[Machine] I love the Messenger of Allah ﷺ with his hand to the city and said, "Indeed, it is a sacred and peaceful place."
أَهْوَى رَسُولُ اللهِ ﷺ بِيَدِهِ إِلَى الْمَدِينَةِ فَقَالَ إِنَّهَا حَرَمٌ آمِنٌ
[Machine] The Prophet ﷺ said, "Indeed, Ibrahim ﷺ prohibited Makkah (from hunting) and indeed, I have prohibited the area between its two lava fields (from hunting). Its vegetation should not be cut, and its game should not be scared away."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ إِبْرَاهِيمَ عَلَيْهِ السَّلَامُ حَرَّمَ مَكَّةَ وَإِنِّي حَرَّمْتُ الْمَدِينَةَ مَا بَيْنَ لَابَتَيْهَا لَا يُقْطَعُ عِضَاهُهَا وَلَا يُنَفَّرُ صَيْدُهَا
[Machine] He informed him that he used to hunt birds in the well of Ihab, and they had a small bird for worship. I took a bird and he snatched it from me and sent it back, saying: "The Messenger of Allah ﷺ has prohibited what is between its two feet, just as Ibrahim ﷺ prohibited Makkah." And worship was one of the companions of the Messenger of Allah ﷺ .
أَخْبَرَهُ أَنَّهُ كَانَ يَصِيدُ الْعَصَافِيرَ فِي بِئْرِ إهَابٍ وَكَانَتْ لَهُمْ فَرَآنِي عُبَادَةُ وَقَدْ أَخَذْتُ عُصْفُورًا فَانْتَزَعَهُ مِنِّي فَأَرْسَلَهُ وَقَالَ إِنَّ رَسُولَ اللهِ ﷺ حَرَّمَ مَا بَيْنَ لَابَتَيْهَا كَمَا حَرَّمَ إِبْرَاهِيمُ عَلَيْهِ السَّلَامُ مَكَّةَ وَكَانَ عُبَادَةُ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ
[Machine] What is this in your hand? I said it is a bird that I shot with a bomb. So severe that it injured my ear and he snatched it from my hand and released it. He said, "The Messenger of Allah ﷺ prohibited hunting between its two edges." Abu Mus'ab said, "Meaning the boundaries of the city." This is the wording of the hadith of Ibn Abdan and in the narration of Al-Mu'mali, he said that his father narrated from Abdur Rahman ibn Auf that the Messenger of Allah ﷺ prohibited hunting between its two edges, meaning the city, and did not mention the story.
مَا هَذَا فِي يَدِكَ؟ قُلْتُ طَيْرٌ اصْطَدْتُهُ بِالْقُنْبُلَةِ فَعَرَكَ أُذُنِي عَرْكًا شَدِيدًا وَاسْتَنْزَعَهُ مِنْ يَدِي فَأَرْسَلَهُ فَقَالَ حَرَّمَ رَسُولُ اللهِ ﷺ صَيْدَ مَا بَيْنَ لَابَتَيْهَا قَالَ أَبُو مُصْعَبٍ يَعْنِي حَرَّتَيِ الْمَدِينَةِ لَفْظُ حَدِيثِ ابْنِ عَبْدَانَ وَفِي رِوَايَةِ الْمُؤَمَّلِيِّ قَالَ عَنْ أَبِيهِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ أَنَّ رَسُولَ اللهِ ﷺ حَرَّمَ مَا بَيْنَ لَابَتَيْهَا يَعْنِي الْمَدِينَةَ وَلَمْ يَذْكُرِ الْقِصَّةَ
[Machine] He found some boys who had taken refuge with a fox in a corner, so he drove them away from it. Malik said, "I only know that he said, 'Is this how it was made in the sanctuary of the Messenger of Allah ﷺ?'" Malik reported from a man who said, "Zaid ibn Thabit came to me while I was in the aswaf and I had been bitten by a snake. Zaid took it from my hand and sent it away." Abu Abdullah Al-Bushanjii said, "An-Nuhasa is a small bird above the sparrow that resembles a locust or grasshopper. The man whom Malik ibn Anas did not name, may Allah have mercy on us and him, is said to be Shurahbil ibn Abu Sa'd."
أَنَّهُ وَجَدَ غِلْمَانًا قَدْ أَلْجَئُوا ثَعْلَبًا إِلَى زَاوِيَةٍ فَطَرَدَهُمْ عَنْهُ قَالَ مَالِكٌ وَلَا أَعْلَمُ إِلَّا أَنَّهُ قَالَ فِي حَرَمِ رَسُولِ اللهِ ﷺ يُصْنَعُ هَذَا؟ قَالَ وَحَدَّثَنَا مَالِكٌ عَنْ رَجُلٍ قَالَ دَخَلَ عَلَيَّ زَيْدُ بْنُ ثَابِتٍ وَأَنَا بِالْأَسْوَافِ وَقَدِ اصْطَدْتُ نَهَسًا فَأَخَذَهُ زَيْدٌ مِنْ يَدِي فَأَرْسَلَهُ قَالَ أَبُو عَبْدِ اللهِ الْبُوشَنْجِيُّ النُّهَسَاءُ الطَّيْرُ الصَّغِيرُ فَوْقَ الْعُصْفُورِ شَبِيهٌ بِالْقُنْبَرَةِ الرَّجُلُ الَّذِي لَمْ يُسَمِّهِ مَالِكُ بْنُ أَنَسٍ رَحِمَنَا اللهُ وَإِيَّاهُ يُقَالُ هُوَ شُرَحْبِيلُ أَبُو سَعْدٍ
[Machine] "That the Messenger of Allah ﷺ prohibited hunting in the area between two landmarks, and it is also reported from Abdullah ibn Awf as a narrated statement."
أَنَّ رَسُولَ اللهِ ﷺ حَرَّمَ صَيْدَ مَا بَيْنَ لَابَتَيْهَا؟ وَيُرْوَى فِيهِ أَيْضًا عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ مَرْفُوعًا
12.296 [Machine] What has been mentioned about taking from the prohibited tree in the city or hunting within it
١٢۔٢٩٦ بَابُ مَا وَرَدَ فِي سَلْبِ مَنْ قَطَعَ مِنْ شَجَرِ حَرَمِ الْمَدِينَةِ أَوْ أَصَابَ فِيهِ صَيْدًا
[Machine] Sa'd went to his palace in Al-Aqiq and found a slave cutting a tree, so he took it from him. When he returned, the slave's people came to him and asked him to return what he took from their slave. He said, "I seek refuge in Allah from returning anything that the Messenger of Allah ﷺ left me as a charity, so he did not return anything to them." And Abu Abdullah informed us, and Abu Al-Fadl bin Ibrahim informed us, and Ahmad bin Salamah informed us, and Ishaq bin Ibrahim and Haroon bin Abdullah informed us, from Abu 'Aamir Al-'Aqadi, from Abdullah bin Ja'far, from the lineage of Al-Miswar bin Makhrama. He mentioned it in a similar manner except that he said, "He found a boy cutting or hitting a tree, so he took him and refused to return anything to them."
أَنَّ سَعْدًا ؓ رَكِبَ إِلَى قَصْرِهِ بِالْعَقِيقِ فَوَجَدَ عَبْدًا يَقْطَعُ شَجَرًا فَاسْتَلَبَهُ فَلَمَّا رَجَعَ جَاءَهُ أَهْلُ الْعَبْدِ يَسْأَلُونَهُ أَنْ يَرُدَّ عَلَيْهِمْ مَا أَخَذَ مِنْ عَبْدِهِمْ قَالَ مَعَاذَ اللهِ أَنْ أَرُدَّ شَيْئًا نَفَلَنِيهِ رَسُولُ اللهِ ﷺ فَلَمْ يَرُدَّ عَلَيْهِمْ شَيْئًا 9973 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ أنا أَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ وَهَارُونُ بْنُ عَبْدِ اللهِ عَنْ أَبِي عَامِرٍ الْعَقَدِيِّ ثنا عَبْدُ اللهِ بْنُ جَعْفَرٍ مِنْ وَلَدِ الْمِسْوَرِ بْنِ مَخْرَمَةَ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ فَوَجَدَ غُلَامًا يَقْطَعُ شَجَرًا أَوْ يَخْبِطُهُ فَسَلَبَهُ وَقَالَ فِي آخِرِهِ وَأَبَى أَنْ يَرُدَّ عَلَيْهِمْ
[Machine] The Messenger of Allah ﷺ said, "Whoever takes something from the trees of the sacred land of Al-Madinah, which means the trees of the Haram, then you have confiscated it. Its trees cannot be supported or cut down." Sa'd saw some young men cutting, so he took their belongings and went to their guardians to inform them that Sa'd did such and such. They came to him and said, "O Abu Ishaq, our youngsters have taken our belongings." He said, "No, I took them. I heard the Messenger of Allah ﷺ saying, 'Whoever takes something from the trees of the Haram, then you have confiscated it. But ask me for whatever share you want from my property.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَخَذْتُمُوهُ يَقْطَعُ مِنَ الشَّجَرِ شَيْئًا يَعْنِي شَجَرَ حَرَمِ الْمَدِينَةِ فَلَكُمْ سَلَبُهُ لَا يُعْضَدُ شَجَرُهَا وَلَا يُقْطَعُ قَالَ فَرَأَى سَعْدٌ غِلْمَانًا يَقْطَعُونَ فَأَخَذَ مَتَاعَهُمْ فَانْتَهُوا إِلَى مَوَالِيهِمْ فَأَخْبَرُوهُمْ أَنَّ سَعْدًا ؓ فَعَلَ كَذَا وَكَذَا فَأَتَوْهُ فَقَالُوا يَا أَبَا إِسْحَاقَ إِنَّ غِلْمَانَكَ أَوْ مَوَالِيَكَ أَخَذُوا مَتَاعَ غِلْمَانِنَا قَالَ بَلْ أَنَا أَخَذْتُهُ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَخَذْتُمُوهُ يَقْطَعُ مِنْ شَجَرِ الْحَرَمِ فَلَكُمْ سَلَبُهُ وَلَكِنْ سَلُونِي مِنْ مَالِي مَا شِئْتُمْ
[Machine] He used to exit the city and find firewood along with him a wet tree that he supported from some of the trees of the city, so he takes it as his booty and speaks about it, saying, "I do not leave behind a booty that the Messenger of Allah ﷺ has taken from me." He said, "And indeed, I am among the people who have the most wealth. My father is Is-haq ibn Al-Harith Al-Qurashi."
أَنَّهُ كَانَ يَخْرُجُ مِنَ الْمَدِينَةِ فَيَجِدُ الْحَاطِبَ مَعَهُ شَجَرٌ رَطْبٌ قَدْ عَضَدَهُ مِنْ بَعْضِ شَجَرِ الْمَدِينَةِ فَيَأْخُذُ سَلَبَهُ فَيُكَلَّمُ فِيهِ فَيَقُولُ لَا أَدَعُ غَنِيمَةً غَنَّمَنِيهَا رَسُولُ اللهِ ﷺ قَالَ وَإِنِّي لَمِنْ أَكْثَرِ النَّاسِ مَالًا أَبُوهُ إِسْحَاقُ بْنُ الْحَارِثِ الْقُرَشِيُّ
Sulayman ibn AbuAbdullah said: I saw Sa'd ibn AbuWaqqas seized a man hunting in the sacred territory of Medina which the Messenger of Allah ﷺ had declared to be sacred. He took away his clothes from him. His patrons came to him and spoke to him about it, but he replied: The Messenger of Allah ﷺ declared this territory to be sacred, saying: If anyone catches someone hunting in it he should take away from him his clothes. So I shall not return to you a provision which the Messenger of Allah ﷺ has given me, but if you wish I shall pay you its price. (Using translation from Abū Dāʾūd 2037)
رَأَيْتُ سَعْدَ بْنِ أَبِي وَقَّاصٍ أَخَذَ رَجُلًا يَصِيدُ فِي حَرَمِ الْمَدِينَةِ الَّذِي حَرَّمَهُ رَسُولُ اللهِ ﷺ فَسَلَبَهُ ثِيَابَهُ فَجَاءُوا مَوَالِيهِ فَكَلَّمُوهُ فِيهِ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ حَرَّمَ هَذَا الْحَرَمَ وَقَالَ مَنْ أَخَذَ أَحَدًا يَصِيدُ فِيهِ فَلْيَسْلُبْهُ فَلَا أَرُدُّ عَلَيْكُمْ طُعْمَةً أَطْعَمَنِيهَا رَسُولُ اللهِ ﷺ وَلَكِنْ إِنْ شِئْتُمْ دَفَعْتُ إِلَيْكُمْ ثَمَنَهُ
12.297 [Machine] Dislike of Hunting and Deforestation in Taif
١٢۔٢٩٧ بَابُ كَرَاهِيَةِ قَتْلِ الصَّيْدِ وَقَطْعِ الشَّجَرِ بِوَجٍّ مِنَ الطَّائِفِ
[Machine] We accompanied the Messenger of Allah, ﷺ , from Liyyah towards Makkah. When we reached As-Sidrah, on the outskirts of the black mountain, the Messenger of Allah, ﷺ , faced it with his eyesight, and then he stood still until the people gathered. Then he said, "Behold! The game (prey) and its blood which means this tree (Sidrah) is forbidden, sacred, and this was before he descended to Ta'if and was besieged in Thaqif." This narration was reported by Ahmad ibn Hanbal from Abdullah ibn Al-Harith, and he said about it, "And he faced it with his eyesight," meaning a valley.
أَقْبَلْنَا مَعَ رَسُولِ اللهِ ﷺ مِنْ لِيَّةَ نُرِيدُ مَكَّةَ حَتَّى إِذَا كُنَّا عِنْدَ السِّدْرَةِ طَرَفِ الْقَرْنِ الْأَسْوَدِ حَذْوَهَا اسْتَقْبَلَ رَسُولُ اللهِ ﷺ نَخْبًا بِبَصَرِهِ ثُمَّ وَقَفَ حَتَّى اتَّفَقَ النَّاسُ ثُمَّ قَالَ أَلَا إنَّ صَيْدَ وَجٍّ وَعِضَاهَهُ يَعْنِي شَجَرَهُ حَرَامٌ مُحَرَّمٌ وَذَلِكَ قَبْلَ نُزُولِهِ الطَّائِفَ وَحِصَارِهِ ثَقِيفًا وَرَوَاهُ أَحْمَدُ بْنُ حَنْبَلٍ عَنْ عَبْدِ اللهِ بْنِ الْحَارِثِ وَقَالَ فِيهِ وَاسْتَقْبَلَ نَخْبًا بِبَصَرِهِ يَعْنِي وَادِيًا
12.298 [Machine] The Dislike of Cutting Trees in Every Place as Protected by the Prophet ﷺ
١٢۔٢٩٨ بَابُ كَرَاهِيَةِ قَطْعِ الشَّجَرِ بِكُلِّ مَوْضِعٍ حَمَاهُ النَّبِيُّ ﷺ
The Prophet ﷺ said: The leaves should not be beaten off and the trees should not be cut in the protected land of the Messenger of Allah ﷺ, but the leaves can be beaten off softly. (Using translation from Abū Dāʾūd 2039)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يُخْبَطْ وَلَا يُعْضَدْ حِمَى رَسُولِ اللهِ ﷺ وَلَكِنْ يُهَشُّ هَشًّا رَفِيقًا كَذَا قَالَ
[Machine] He asked Jabir bin Abdullah Al-Salami, the companion of the Messenger of Allah ﷺ . He said, "We have sheep and young boys who hit their sheep with this fruit (dates) from a specific tree." He said, "It is a harmful fruit, which is the fruit of the thamarah tree." Jabir said, "No, no, they do not hit or harm the livestock of the Messenger of Allah ﷺ , but they scare them away lightly." Jabir said, "If it was the Messenger of Allah ﷺ , I think he said, 'Cut off the masad (a type of tree)'. Jabir said, "And the masad is a training tool for young camels." Ibn Abi Uways said, "The hima (protected grazing area) is around Al-Madinah".
أَنَّهُ سَأَلَ جَابِرَ بْنَ عَبْدِ اللهِ السُّلَمِيَّ صَاحِبَ رَسُولِ اللهِ ﷺ قَالَ إِنَّ لَنَا غَنَمًا وَغِلْمَانًا وَهُمْ يَخْبِطُونَ عَلَى غَنَمِهِمْ مِنْ هَذِهِ الثَّمَرَةِ الْحَبَلَةِ قَالَ خَارِجَةُ وَهِيَ ثَمَرَةُ السَّمُرَةِ قَالَ جَابِرٌ لَا ثُمَّ لَا لَا يُخْبَطْ وَلَا يُعْضَدْ حِمَى رَسُولِ اللهِ ﷺ وَلَكِنْ هُشُّوا هَشًّا قَالَ جَابِرٌ إِنْ كَانَ رَسُولُ اللهِ ﷺ أَظُنُّهُ قَالَ يَنْهَى أَنْ يُقْطَعَ الْمَسَدُ قَالَ جَابِرٌ وَالْمَسَدُ مِرْوَدٌ لِلْبَكْرَةِ قَالَ ابْنُ أَبِي أُوَيْسٍ الْحِمَى حَوْلَ الْمَدِينَةِ
[Machine] Abu al-Fath al-Faqih informed us, I am Abdul Rahman al-Shurayhi, I am Abu al-Qasim al-Baghawi narrating from Ali ibn al-Jaad, narrating from al-Qasim ibn al-Fadl al-Hudhani, from Muhammad ibn Ziyad who said: "My grandfather was a freed slave of Uthman ibn Mazh'un, and he used to cultivate a piece of land for Uthman in which there were vegetables and gourds. He said, 'Once, Umar ibn al-Khattab came to me in the middle of the day, with his garment on his head, taking precautions that no tree would damage his head, nor would he hit it. He sat down with me and spoke to me, and I served him gourd and vegetables.' He said to me on that day, 'I see that you do not come out of here.' I said, 'Indeed.' He said, 'I will employ you for what is here. So, if you see anyone supporting a tree or hitting it, take his axe and his rope.' I said, 'Should I take his cloak?' He said, 'No.'"
أَخْبَرَنَا أَبُو الْفَتْحِ الْفَقِيهُ أنا عَبْدُ الرَّحْمَنِ الشُّرَيْحِيُّ أنا أَبُو الْقَاسِمِ الْبَغَوِيُّ ثنا عَلِيُّ بْنُ الْجَعْدِ ثنا الْقَاسِمُ بْنُ الْفَضْلِ الْحُدَّانِيُّ عَنْ مُحَمَّدِ بْنِ زِيَادٍ قَالَ كَانَ جَدِّي مَوْلًى لِعُثْمَانَ بْنِ مَظْعُونٍ وَكَانَ يَلِي أَرْضًا لِعُثْمَانَ فِيهَا بَقْلٌ وَقِثَّاءٌ قَالَ فَرُبَّمَا أَتَانِي عُمَرُ بْنُ الْخَطَّابِ ؓ نِصْفَ النَّهَارِ وَاضِعًا ثَوْبَهُ عَلَى رَأْسِهِ يَتَعَاهَدُ الْحِمَى أَنْ لَا يُعْضَدَ شَجَرُهُ وَلَا يُخْبَطَ قَالَ فَيَجْلِسُ إِلِيَّ فَيُحَدِّثُنِي وَأُطْعِمُهُ مِنَ الْقِثَّاءِ وَالْبَقْلِ فَقَالَ لِي يَوْمًا أَرَاكَ لَا تَخْرُجُ مِنْ هَا هُنَا قَالَ قُلْتُ أَجَلْ قَالَ إِنِّي أَسْتَعْمِلُكَ عَلَى مَا هَا هُنَا فَمَنْ رَأَيْتَ يَعْضِدُ شَجَرًا أَوْ يَخْبِطُ فَخُذْ فَأْسَهُ وَحَبْلَهُ قَالَ قُلْتُ آخُذُ رِدَاءَهُ؟ قَالَ لَا
[Machine] That the Prophet ﷺ protected Al-Baqi' for the horses, and that was also narrated by Ibn Shihab Al-Zuhri.
أَنَّ النَّبِيَّ ﷺ حَمَى الْبَقِيعَ لِلْخَيْلِ وَرُوِّينَا ذَلِكَ أَيْضًا عَنِ ابْنِ شِهَابٍ الزُّهْرِيِّ
12.299 [Machine] Permission for Grazing in the Sanctuary
١٢۔٢٩٩ بَابُ جَوَازِ الرَّعْيِ فِي الْحَرَمِ
I have a large family (to support) and we are enduring hardships; I have, therefore, made up my mind to take my family to some fertile land. Thereupon Abu Sa'id said: Don't do that, stick to Medina, for we have come out with Allah's Apostle ﷺ, and (I think that he also said) until we reached 'Usfan, and he (the Prophet along with his Companions) stayed there for some nights. There the people said: By Allah, we are lying here idle, whereas our children are unprotected behind us, and we do not feel secure about them. This (apprehension of theirs) reached Allah's Apostle ﷺ, whereupon he said: What is this matter concerning you that has reached me? (I do not retain how he said it, whether he said like this: ) By Him (in the name of Whom) I take oath, (or he said like this: ) By Him in Whose Hand is my life, I made up my mind or if you like (I do not retain what word did he actually say), I should command my camel to proceed and not to let it halt until it comes to Medina and then said: Ibrahim declared Mecca as the sacred territory and it became sacred, and I declare Medina as the sacred territory-the area between the two mountains ('Air and Uhud). Thus no blood is to be shed within its (bounds) and no weapon is to be carried for fighting, and the leaves of the trees there should not be beaten off except for fodder. O Allah, bless us in our city; O Allah, bless us in our sil; O Allah, bless us in our mudd; O Allah, bless us in our sa; O Allah, bless us in our mudd. O Allah, bless us in our city. O Allah, bless with this blessing two more blessings. By Him in Whose Hand is my life, there is no ravine or mountain path of Medina which is not protected by two angels until you reach there. (He then said to the people: ) Proceed, and we, therefore, proceeded and we came to Medina By Him (in Whose name) we take oath and (in Whose name) oath is taken (Hammad is in doubt about it), we had hardly put down our camel saddles on arriving at Medina that we were attacked by the people of the tribe of 'Abdullah b. Ghatafan but none dared to do it before. (Using translation from Muslim 1374a)
أَبُو سَعِيدٍ لَا تَفْعَلْ الزَمِ الْمَدِينَةَ فَإِنَّا خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ أَظُنُّهُ قَالَ حَتَّى قَدِمْنَا عُسْفَانَ قَالَ فَأَقَامَ بِهَا لَيَالِيَ فَقَالَ النَّاسُ وَاللهِ مَا نَحْنُ هَا هُنَا فِي شَيْءٍ إِنَّ عِيَالَنَا لَخُلُوفٌ وَمَا نَأْمَنُ عَلَيْهِمْ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَقَالَ مَا هَذَا الَّذِي يَبْلُغُنِي مِنْ حَدِيثِكُمْ؟ مَا أَدْرِي كَيْفَ قَالَ قَالَ وَالَّذِي أَحْلِفُ بِهِ أَوْ وَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ هَمَمْتُ أَوْ إِنِّي سَأَهُمُّ لَا أَدْرِي أَيُّهُمَا قَالَ لَآمُرَنَّ بِنَاقَتِي تُرَحَّلُ ثُمَّ لَا أَحُلَّ لَهَا عُقْدَةً حَتَّى أَقْدَمَ الْمَدِينَةَ وَقَالَ اللهُمَّ إِنَّ إِبْرَاهِيمَ حَرَّمَ مَكَّةَ فَجَعَلَهَا حَرَمًا اللهُمَّ إِنِّي حَرَّمْتُ الْمَدِينَةَ حَرَامًا مَا بَيْنَ مَأْزِمَيْهَا أَنْ لَا يُهَرَاقَ فِيهَا دَمٌ وَلَا يُحْمَلَ فِيهَا سِلَاحٌ لِقِتَالٍ وَلَا تُخْبَطَ فِيهَا شَجَرَةٌ إِلَّا لِعَلْفٍ اللهُمَّ بَارِكْ لَنَا فِي مَدِينَتِنَا اللهُمَّ بَارِكْ لَنَا فِي صَاعِنَا اللهُمَّ بَارِكْ لَنَا فِي مُدِّنَا ثَلَاثًا اللهُمَّ اجْعَلْ مَعَ الْبَرَكَةِ بَرَكَتَيْنِ وَالَّذِي نَفْسِي بِيَدِهِ مَا بَيْنَ الْمَدِينَةِ مِنْ شِعْبٍ وَلَا نَقْبٍ إِلَّا عَلَيْهِ مَلَكَانِ يَحْرُسَانِهِ حَتَّى تَقْدَمُوا إِلَيْهَا ثُمَّ قَالَ لِلنَّاسِ ارْتَحِلُوا فَارْتَحَلْنَا فَأَقْبَلْنَا إِلَى الْمَدِينَةِ فَوَالَّذِي نَحْلِفُ بِهِ أَوْ يُحْلَفُ بِهِ شَكَّ حَمَّادٌ فِي هَذِهِ الْكَلِمَةِ وَحْدَهَا مَا وَضَعْنَا رِحَالَنَا حِينَ دَخَلْنَا الْمَدِينَةَ حَتَّى أَغَارَ عَلَيْهَا بَنُو عَبْدِ اللهِ بْنِ غَطَفَانَ وَمَا يُهَيِّجُهُمْ قَبْلَ ذَلِكَ شَيْءٌ
The Prophet ﷺ said: Its (Medina's) fresh grass is not to be cut, its game is not to be driven away, and things dropped in it are to be picked up by one who publicly announces it, and it is not permissible for any man to carry weapons in it for fighting, and it is not advisable that its trees are cut except what a man cuts for the fodder of his camel. عَنِ النَّبِيِّ ﷺ قَالَ لَا يُخْتَلَى خَلَاهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا يُلْتَقَطُ لُقَطَتُهَا إِلَّا لِمَنْ أَشَادَ بِهَا وَلَا يَصْلُحُ لِرَجُلٍ أَنْ يَحْمِلَ فِيهَا السِّلَاحَ لِقِتَالٍ وَلَا يَصْلُحُ لِرَجُلٍ أَنْ يَقْطَعَ مِنْهَا شَجَرَةً إِلَّا أَنْ يَعْلِفَ رَجُلٌ بَعِيرَهُ وَفِي رِوَايَةِ هُدْبَةَ بَعِيرًا
[Machine] "O Messenger of Allah, where is Abdullah? Where is Abdullah?"
رَسُولُ اللهِ ﷺ أَيْنَ عَبْدُ اللهِ؟ أَيْنَ عَبْدُ اللهِ؟
12.300 [Machine] Nothing is allowed to be taken out of the soil of the Haram of Mecca or its stones, except for a solution.
١٢۔٣٠٠ بَابٌ: لَا يُخْرَجُ مِنْ تُرَابِ حَرَمِ مَكَّةَ وَلَا حِجَارَتِهِ شَيْءٌ إِلَى الْحِلِّ
[Machine] "He brings out from the sanctified land and its stones to a worldly thing. 9985. Al-Shafi'i said, and Abdulrahman bin Al-Hasan bin Al-Qasim Al-Azraqi informed us on the authority of his father, who narrated from Abdul'ala bin Abdullah bin 'Amir, who said, "I came to Makkah with my mother or perhaps my grandmother. Safiyyah bint Shaybah came to her and honored her and did something for her. Safiyyah said, 'I don't know what to give her in return.' So, she sent her with a piece from the Rukn (Corner of the Kaaba), and we went out with it and stayed in the first lodging. She mentioned their illness and their conditions. Then my mother or my grandmother said, 'I don't see us getting anything except that we brought out this piece from the Haram (sacred land).' She said to me, and I was the most resembling them, 'Go with this piece to Safiyyah and return it to her and say to her that Allah has placed something in His Haram and it should not be taken out.' Abdul'ala said, "So they said, 'So what we should do is wait for your entry into the Haram (sanctuary) as if we were stimulated by our minds.'"
يُخْرَجَ مِنْ تُرَابِ الْحَرَمِ وَحِجَارَتِهِ إِلَى الْحِلِّ شَيْءٌ 9985 قَالَ الشَّافِعِيُّ وَقَدْ أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ الْحَسَنِ بْنِ الْقَاسِمِ الْأَزْرَقِيُّ عَنْ أَبِيهِ عَنْ عَبْدِ الْأَعْلَى بْنِ عَبْدِ اللهِ بْنِ عَامِرٍ قَالَ قَدِمْتُ مَعَ أُمِّي أَوْ قَالَ جَدَّتِي مَكَّةَ فَأَتَتْهَا صَفِيَّةُ بِنْتُ شَيْبَةَ فَأَكْرَمَتْهَا وَفَعَلَتْ بِهَا فَقَالَتْ صَفِيَّةُ مَا أَدْرِي مَا أُكَافِئُهَا بِهِ فَأَرْسَلَتْ إِلَيْهَا بِقِطْعَةٍ مِنَ الرُّكْنِ فَخَرَجْنَا بِهَا فَنَزَلْنَا أَوَّلَ مَنْزِلٍ فَذَكَرَ مِنْ مَرَضِهِمْ وَعِلَّتِهِمْ جَمِيعًا قَالَ فَقَالَتْ أُمِّي أَوْ جَدَّتِي مَا أُرَانَا أُتِينَا إِلَّا أَنَّا أَخْرَجْنَا هَذِهِ الْقِطْعَةَ مِنَ الْحَرَمِ فَقَالَتْ لِي وَكُنْتُ أَمْثَلَهُمْ انْطَلِقْ بِهَذِهِ الْقِطْعَةِ إِلَى صَفِيَّةَ فَرُدَّهَا وَقُلْ لَهَا إِنَّ اللهَ قَدْ وَضَعَ فِي حَرَمِهِ شَيْئًا فَلَا يَنْبَغِي أَنْ يُخْرَجَ مِنْهُ قَالَ عَبْدُ الْأَعْلَى فَقَالُوا فَمَا هُوَ إِلَّا أَنْ تَحَيَّنَّا دُخُولَكَ الْحَرَمَ فَكَأَنَّمَا أُنْشِطْنَا مِنْ عَقْلٍ
12.301 [Machine] The license to take Zamzam water out
١٢۔٣٠١ بَابُ الرُّخْصَةِ فِي الْخُرُوجِ بِمَاءِ زَمْزَمَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: بَلَغَنَا أَنَّ سُهَيْلَ بْنَ عَمْرٍو أَهْدَى لِلنَّبِيِّ ﷺ مِنْهُ، قَالَ الشَّافِعِيُّ: وَالْمَاءُ لَيْسَ بِشَيْءٍ يَزُولُ فَلَا يَعُودُ
[Machine] The Messenger of Allah ﷺ gifted Suhaib ibn Amr with Zamzam water and it was narrated from Ikrimah from Ibn Abbas about that.
اسْتَهْدَى رَسُولُ اللهِ ﷺ سُهَيْلَ بْنَ عَمْرٍو مِنْ مَاءِ زَمْزَمَ وَرُوِيَ فِي ذَلِكَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ
[Machine] So he spoke to us and then the prayer of Asr came, so he stood up and prayed with us in one garment that he had wrapped around him, and his garment was folded. Then water from Zamzam water was brought and he drank from it, then he drank. They said, "What is this?" He said, "This is Zamzam water, and the Messenger of Allah ﷺ said about it, 'Zamzam water is for whatever intention it is drunk for.'" He said, "Then the Prophet ﷺ sent to Suheil ibn Amr while he was in Madinah, before Makkah was conquered, to send us Zamzam water and not to leave any." So he sent him with two large water containers.
فَتَحَدَّثْنَا فَحَضَرَتْ صَلَاةُ الْعَصْرِ فَقَامَ فَصَلَّى بِنَا فِي ثَوْبٍ وَاحِدٍ قَدْ تَلَبَّبَ بِهِ وَرِدَاؤُهُ مَوْضُوعٌ ثُمَّ أُتِيَ بِمَاءٍ مِنْ مَاءِ زَمْزَمَ فَشَرِبَ ثُمَّ شَرِبَ فَقَالُوا مَا هَذَا؟ قَالَ هَذَا مَاءُ زَمْزَمَ وَقَالَ فِيهِ رَسُولُ اللهِ ﷺ مَاءُ زَمْزَمَ لِمَا شُرِبَ لَهُ قَالَ ثُمَّ أَرْسَلَ النَّبِيُّ ﷺ وَهُوَ بِالْمَدِينَةِ قَبْلَ أَنْ تُفْتَحَ مَكَّةُ إِلَى سُهَيْلِ بْنِ عَمْرٍو أَنِ اهْدِ لَنَا مِنْ مَاءِ زَمْزَمَ وَلَا يَتِرُكَ قَالَ فَبَعَثَ إِلَيْهِ بِمُزَادَتَيْنِ
[Machine] "That the Messenger of Allah ﷺ used to do it, and it was narrated from someone else about Abu Kurayb, and the Messenger of Allah ﷺ emphasized it regarding medicine and treatment, and he used to pour it on the sick and give them to drink. Al-Bukhari said: Khalad ibn Yazid did not report it."
أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَفْعَلُهُ وَرَوَاهُ غَيْرُهُ عَنْ أَبِي كُرَيْبٍ وَزَادَ فِيهِ حَمَلَهُ رَسُولُ اللهِ ﷺ فِي الْأَدَاوِي وَالْقِرَبِ وَكَانَ يَصُبُّ عَلَى الْمَرْضَى وَيَسْقِيهِمْ قَالَ الْبُخَارِيُّ وَلَا يُتَابَعُ خَلَّادُ بْنُ يَزِيدَ عَلَيْهِ
12.302 [Machine] The man throws an arrow at a target, hitting it or something else in the prohibited area, so he will be punished. Allah the Almighty says, "Your hands and your spears can reach it." [Surah Al-Maidah: 94] Imam Ash-Shafi'i, may Allah have mercy on him, said: "Some interpreters claim that it means reaching with your throwing.
١٢۔٣٠٢ بَابٌ: الرَّجُلُ يَرْمِي بِسَهْمٍ إِلَى صَيْدٍ فَأَصَابَهُ , أَوْ غَيْرَهُ فِي الْحَرَمِ فَيَكُونُ عَلَيْهِ جَزَاؤُهُ قَالَ اللهُ تَعَالَى {تَنَالُهُ أَيْدِيكُمْ وَرِمَاحُكُمْ} [المائدة: 94] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَزَعَمَ بَعْضُ أَهْلِ التَّفْسِيرِ أَنَّهُ تَنَالُهُ أَيْدِيكُمْ بِالرَّمْيِ
[Machine] From Mujahid, in his interpretation of the verse "Your hands and spears will reach it" [Al-Ma'idah 94], he said, "It means you will reach the Nile, and your hands will also reach small game, chicks, and eggs, and your spears will reach large game."
عَنْ مُجَاهِدٍ فِي قَوْلِهِ تَعَالَى {تَنَالُهُ أَيْدِيكُمْ وَرِمَاحُكُمْ} [المائدة 94] قَالَ يَعْنِي النَّيْلَ وَتَنَالُ أَيْدِيكُمْ أَيْضًا صِغَارَ الصَّيْدِ الْفِرَاخَ وَالْبَيْضَ وَرِمَاحُكُمْ يَقُولُ كِبَارُ الصَّيْدِ
[Machine] About a man who sent his dog to hunt in the sacred grounds, and the dog entered the sanctuary to pursue the prey. The dog brought the prey out of the sanctuary and killed it. The man said, "I have nothing in it. I dislike unnecessary burdens." I said, "O Abu 'Amr, say something about it." He said, "I do not like to eat it, nor do I see any harm in selling it." Abdus Salam said, "And the pilgrimage became easy for me from that year on. So I met Ibn Jurayj and asked him about it. He said, 'I heard Ata ibn Abi Rabah narrating from Ibn Abbas that he was asked about it, and he said, 'I did not like to eat it, nor did I see any harm in selling it.'" The Shaykh said, "Al-Shafi'i also said the same thing regarding what is sent on hunting from the sacred grounds in the sacred grounds. If the prey enters the sanctuary and the dog kills it, it is not permissible to eat it, but it is permissible to sell it. And there is a distinction between the dog and the arrow, as the arrow can be used to catch the prey or to harm it or others in the sanctuary."
عَنْ رَجُلٍ أَرْسَلَ كَلْبَهُ فِي الْحِلِّ عَلَى صَيْدٍ فَدَخَلَ الصَّيْدُ الْحَرَمَ فَطَلَبَهُ الْكَلْبُ فَأَخْرَجَهُ إِلَى الْحِلِّ فَقَتَلَهُ فَقَالَ مَا عِنْدِي فِيهَا شَيْءٌ أَنَا أَكْرَهُ التَّكَلُّفَ قُلْتُ يَا أَبَا عَمْرٍو قُلْ فِيهَا قَالَ مَا أُحِبُّ أَكْلَهُ وَلَا أَرَى عَلَيْهِ أَنْ يَدِيَهُ قَالَ عَبْدُ السَّلَامِ وَتَيَسَّرَ لِي الْحَجُّ مِنْ عَامِي ذَلِكَ فَلَقِيتُ ابْنَ جُرَيْجٍ فَسَأَلْتُهُ عَنْهَا فَقَالَ سَمِعْتُ عَطَاءَ بْنَ أَبِي رَبَاحٍ يُخْبِرُ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ سُئِلَ عَنْهَا فَقَالَ لَا أُحِبُّ أَكْلَهُ وَلَا أَرَى عَلَيْهِ أَنْ يَدِيَهُ قَالَ الشَّيْخُ وَكَذَلِكَ قَالَهُ الشَّافِعِيُّ فِي الَّذِي يُرْسِلُهُ عَلَى الصَّيْدِ مِنَ الْحِلِّ فِي الْحِلِّ فَتَحَامَلَ الصَّيْدُ فَدَخَلَ الْحَرَمَ فَقَتَلَهُ فِيهِ الْكَلْبُ فَلَا يُجْزِيهِ وَلَا يَأْكُلُهُ وَفَرَّقَ بَيْنَ الْكَلْبِ وَبَيْنَ السَّهْمِ يَجُوزُ فَيُصِيبُهُ أَوْ غَيْرَهُ فِي الْحَرَمِ
12.303 [Machine] Halal Hunting Catches Prey Legally, Then Enters the Sacred Place with It
١٢۔٣٠٣ بَابُ الْحَلَالِ يَصِيدُ صَيْدًا فِي الْحِلِّ ثُمَّ يَدْخُلُ بِهِ الْحَرَمَ
[Machine] I heard Anas bin Malik say that the Messenger of Allah ﷺ used to be in our company until he would say to a younger brother of mine, "O Abu 'Umayr, what happened to the little bird?"
سَمِعْتُ أَنَسَ بْنَ مَالِكٍ يَقُولُ كَانَ رَسُولُ اللهِ ﷺ يُخَالِطُنَا حَتَّى يَقُولَ لِأَخٍ لِي صَغِيرٍ يَا أَبَا عُمَيْرٍ مَا فَعَلَ النُّغَيْرُ؟ يَعْنِي طَائِرًا لَهُ
The Prophet ﷺ was the best of all the people in character. I had a brother called Abu ʿUmar, who, I think, had been newly weaned. Whenever he (that child) was brought to the Prophet ﷺ the Prophet ﷺ used to say, "O Abu ʿUmar! What did Al-Nughair (nightingale) (do)?" It was a nightingale with which he used to play. Sometimes the time of the Prayer became due while he (the Prophet) was in our house. He would order that the carpet underneath him be swept and sprayed with water, and then he would stand up (for the prayer) and we would line up behind him, and he would lead us in prayer. كَانَ رَسُولُ اللهِ ﷺ أَحْسَنَ النَّاسِ خُلُقًا وَكَانَ لِي أَخٌ يُقَالُ لَهُ أَبُو عُمَيْرٍ أَحْسَبُهُ قَالَ فَطِيمٌ فَكَانَ إِذَا جَاءَ قَالَ أَبَا عُمَيْرٍ مَا فَعَلَ النُّغَيْرُ؟ كَانَ يَلْعَبُ بِهِ وَرُبَّمَا حَضَرَتِ الصَّلَاةُ وَهُوَ فِي بَيْتِنَا فَيَأْمُرُ بِالْبِسَاطِ الَّذِي تَحْتَهُ فَيُكْنَسُ وَيُنْضَحُ ثُمَّ يَقُومُ وَنَقُومُ خَلْفَهُ فَيُصَلِّي بِنَا
[Machine] He is called Abu 'Umayr. The Prophet ﷺ used to play with him when he entered the house of Umm Sulaym. One day, he entered and found him sad, so he said, "Why is Abu 'Umayr sad?" They said, "O Messenger of Allah, his pet bird, which he used to play with, has died." The Prophet ﷺ said, "Abu 'Umayr, what happened to the little bird?"
يُقَالُ لَهُ أَبُو عُمَيْرٍ كَانَ النَّبِيُّ ﷺ رُبَّمَا مَازَحَهُ إِذَا دَخَلَ عَلَى أُمِّ سُلَيْمٍ فَدَخَلَ يَوْمًا فَوَجَدَهُ حَزِينًا فَقَالَ مَا لِأَبِي عُمَيْرٍ حَزِينًا؟ قَالُوا يَا رَسُولَ اللهِ مَاتَ نُغَيْرُهُ الَّذِي كَانَ يَلْعَبُ بِهِ جَعَلَ النَّبِيُّ ﷺ يَقُولُ أَبَا عُمَيْرٍ مَا فَعَلَ النُّغَيْرُ؟
[Machine] A bird or a deer was given to her in the sacred precinct, so she sent it. On that day, Hisham said, "The son of Abu Rabaah did not know that the Amir al-Mu'minin, meaning Abdullah bin Zubair, was in Mecca for nine years, and the companions of the Messenger of Allah ﷺ would bring them and show them in the large cages and enclosures."
ؓ أُهْدِيَ لَهَا طَيْرٌ أَوْ ظَبْيٌ فِي الْحَرَمِ فَأَرْسَلَتْهُ فَقَالَ يَوْمَئِذٍ هِشَامٌ مَا عَلِمَ ابْنُ أَبِي رَبَاحٍ كَانَ أَمِيرُ الْمُؤْمِنِينَ يَعْنِي عَبْدَ اللهِ بْنَ الزُّبَيْرِ بِمَكَّةَ تِسْعَ سِنِينَ وَأَصْحَابُ رَسُولِ اللهِ ﷺ يَقْدُمُونَ فَيَرَوْنَهَا فِي الْأَقْفَاصِ الْقُبَّارَى وَالْيَعَاقِيبَ
