١٢۔ كِتَابُ الْحَجِّ ص ٢٥
[Machine] Abu Al-Abbas Al-Asamm narrated from Ar-Rabi' that Ash-Shafi'i narrated from Sufyan, who narrated from Abdul Karim Al-Jazri, who narrated from Abu Ubaidah ibn Abdullah ibn Masood, who narrated from his father ibn Masood, that he ruled in al-Yarbu' with Jafar or Jafra in the year 9888. With this chain of narration, Ash-Shafi'i informed us that Ibn Uyaynah narrated from Ibn Abi Najih, who narrated from Mujahid, who narrated that Ibn Masood judged in al-Yarbu' with Jafar or Jafra. The Sheikh said, "These two narrations from Ibn Masood are connected, with each one confirming the other."

[Machine] Abu al-Abbas al-Asamm reported to al-Rabi'i, who reported to al-Shafi'i, who reported from Abdul Wahhab, who reported from Ayyub, who reported from Ibn Sirin, who reported from Shuraih, that he said: "If I had the authority, I would judge the fox with seriousness." And it was narrated from Ata that he said about the fox, "It is a sheep."
وَثَنَا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ عَبْدُ الْوَهَّابِ عَنْ أَيُّوبَ عَنِ ابْنِ سِيرِينَ عَنْ شُرَيْحٍ أَنَّهُ قَالَ لَوْ كَانَ مَعِي حُكْمٌ حَكَمْتُ فِي الثَّعْلَبِ بِجَدْيٍ وَرُوِيَ عَنْ عَطَاءٍ أَنَّهُ قَالَ فِي الثَّعْلَبِ شَاةٌ

١٢۔٢٨٣ بَابُ فِدْيَةِ الضِّبِّ
[Machine] Abu Al-Abbas Al-Asamm narrated that Ar-Rabi' said that Ash-Shafi'i narrated that Sufyan reported from Muhariq, who reported from Tariq that Arbad stepped on a lizard, and its back broke. So he went to Umar and asked him, so Umar said to him, "What do you see?" So he said with effort, "He excessively gathered water and trees." So Umar said to him, "That is in it."
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ عَنْ مُخَارِقٍ عَنْ طَارِقٍ أَنَّ أَرْبَدَ أَوْطَأَ ضَبًّا فَفَزَرَ ظَهْرَهُ فَأَتَى عُمَرَ ؓ فَسَأَلَهُ فَقَالَ عُمَرُ ؓ مَا تَرَى؟ فَقَالَ جَدْيًا قَدْ جَمَعَ الْمَاءَ وَالشَّجَرَ فَقَالَ عُمَرُ ؓ فَذَلِكَ فِيهِ

١٢۔٢٨٤ بَابُ فِدْيَةِ أُمِّ حُبَيْنٍ
[Machine] Abu al-Abbas Al-Asamm narrated from Ar-Rabi' ibn Anas, who narrated from Ash-Shafi'i, who narrated from Sufyan, who narrated from Mutarrif, who narrated from Abu As-Saffar, that Uthman ibn Affan settled a dispute in Umm Hubain concerning a portion of sheep.
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ عَنْ مُطَرِّفٍ عَنْ أَبِي السَّفَرِ أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ قَضَى فِي أُمِّ حُبَيْنٍ بِحُلَّانٍ مِنَ الْغَنَمِ
12.285 [Machine] The prohibited one kills small prey, the deficient, and males
١٢۔٢٨٥ بَابُ الْمُحْرِمِ يَقْتُلُ الصَّيْدَ الصَّغِيرَ , وَالنَّاقِصَ وَالذَّكَرَ قَالَ اللهُ تَعَالَى {فَجَزَاءٌ مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ} [المائدة: 95] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَالْمِثْلُ مِثْلُ صِفَةِ مَا قَتَلَ
[Machine] He said, "If he kills a hunted animal that is blind or defective, then he should compensate with a similar animal that is blind or defective, and complete compensation is more beloved to me. And if he kills the young offspring of the hunted animal, then he should compensate with the young offspring of the sheep."
أَنَّهُ قَالَ إِنْ قَتَلَ صَيْدًا أَعْوَرَ أَوْ مَنْقُوصًا فَدَاهُ بِأَعْوَرَ مِثْلِهِ أَوْ مَنْقُوصٍ وَوَافٍ أَحَبُّ إِلِيَّ وَإِنْ قَتَلَ صِغَارَ أَوْلَادِ الصَّيْدِ فَدَاهُ بِصِغَارِ أَوْلَادِ الْغَنَمِ
[Machine] The Messenger of Allah ﷺ presented a camel to Abu Jahl as a gift, with a silver nose ring, in order to provoke the polytheists.
أَهْدَى رَسُولُ اللهِ ﷺ فِي هَدْيِهِ جَمَلًا لِأَبِي جَهْلٍ فِي أَنْفِهِ بُرَةُ فِضَّةٍ؛ لِيَغِيظَ بِهِ الْمُشْرِكِينَ
12.286 [Machine] Is it permissible for the one who catches prey to give it as a ransom without any blessings? God, may He be glorified, said concerning the reward of hunting: "A suitable offering [of animals] brought (to the Ka'bah) or an expiation [by feeding] needy persons or the equivalent of that in fasting" [Surah Al-Ma'idah: 95]. Ata said: "All of these are (mentioned) in the Quran, or, or, so let the person who catches the prey choose from them whatever he wants.
١٢۔٢٨٦ بَابٌ: هَلْ لِمَنْ أَصَابَ الصَّيْدَ أَنْ يَفْدِيَهُ بِغَيْرِ النَّعَمِ؟ قَالَ اللهُ جَلَّ ثَنَاؤُهُ فِي جَزَاءِ الصَّيْدِ {هَدْيًا بَالِغَ الْكَعْبَةِ أَوْ كَفَّارَةٌ طَعَامُ مَسَاكِينَ أَوْ عَدْلُ ذَلِكَ صِيَامًا} [المائدة: 95] قَالَ: عَطَاءٌ: " أَيَّتَهُنَّ شَاءَ وَكُلُّ شَيْءٍ فِي الْقُرْآنِ , أَوْ , أَوْ , فَلْيَخْتَرْ مِنْهُ صَاحِبُهُ مَا شَاءَ "
[Machine] Everything in the Quran is either a command or an allowance. Ibn Jurayj said: Except for the statement of Allah, "Indeed, the penalty for those who wage war against Allah and His Messenger" [Surah Al-Ma'idah 33]. There is no choice in it. Ash-Shafi'i said, as Ibn Jurayj and others said in regards to the one who wages war and others in the matter, I say...
كُلُّ شَيْءٍ فِي الْقُرْآنِ أَوْ أَوْ لَهُ أَيُّهُ شَاءَ قَالَ ابْنُ جُرَيْجٍ إِلَّا قَوْلَ اللهِ ﷻ {إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللهَ وَرَسُولَهُ} [المائدة 33] فَلَيْسَ بِمُخِيِّرٍ فِيهَا قَالَ الشَّافِعِيُّ كَمَا قَالَ ابْنُ جُرَيْجٍ وَغَيْرُهُ فِي الْمُحَارِبِ وَغَيْرِهِ فِي الْمَسْأَلَةِ أَقُولُ
Ka’ab bin ‘Ujrah said that the Apostle of Allaah ﷺ said to him, If you like sacrifice an animal or if you like fast three days or if you like give three sa’s of dates to six poor people. (Using translation from Abū Dāʾūd 1857)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَهُ إِنْ شِئْتَ فَانْسُكْ نَسِيكَةً وَإِنْ شِئْتَ فَصُمْ ثَلَاثَةَ أَيَّامٍ وَإِنْ شِئْتَ فَأَطْعِمْ ثَلَاثَةَ آصُعٍ سِتَّةَ مَسَاكِينَ

١٢۔٢٨٧ بَابُ تَعْدِيلِ صِيَامِ يَوْمٍ بِإِطْعَامِ مِسْكِينَ وَذَلِكَ مُدٌّ بِمُدِّ النَّبِيِّ ﷺ وَهُوَ قَوْلُ عَطَاءِ بْنِ أَبِي رَبَاحٍ اسْتِدْلَالًا بِمَا:
[Machine] A man said, "O Messenger of Allah, I have perished." He asked, "What is the matter?" The man replied, "I accidentally had relations with my wife during the day in Ramadan." The Prophet replied, "Free a slave." The man said, "I cannot find one." The Prophet then said, "Fast for two consecutive months." The man said, "I am not able to do that." The Prophet then said, "Feed sixty poor people." The man said, "I cannot find that either." Then, a container of dates was brought to the Prophet, containing fifteen wasqs (a measure of capacity). The Prophet said, "Take it and give it in charity." The man said, "Should I give it to someone poorer than my family? By Allah, there is no family in Medina poorer than mine." The Prophet laughed until his molars were visible and said, "Take it and seek forgiveness from Allah, and feed your family with it." And so on.
قَالَ رَجُلٌ يَا رَسُولَ اللهِ هَلَكْتُ قَالَ وَيْحَكَ وَمَا ذَاكَ؟ قَالَ وَقَعْتُ عَلَى أَهْلِي فِي يَوْمٍ مِنْ شَهْرِ رَمَضَانَ قَالَ أَعْتِقْ رَقَبَةً قَالَ مَا أَجِدُهَا قَالَ فَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَ مَا أَسْتَطِيعُ قَالَ أَطْعِمْ سِتِّينَ مِسْكِينًا قَالَ مَا أَجِدُ قَالَ فَأُتِيَ رَسُولُ اللهِ ﷺ بِعَرَقٍ فِيهِ تَمْرٌ خَمْسَةَ عَشَرَ صَاعًا قَالَ خُذْهُ فَتَصَدَّقْ بِهِ قَالَ عَلَى أَفْقَرَ مِنْ أَهْلِي فَوَاللهِ مَا بَيْنَ لَابَتَيِ الْمَدِينَةِ أَحْوَجُ مِنْ أَهْلِي قَالَ فَضَحِكَ رَسُولُ اللهِ ﷺ حَتَّى بَدَتْ أَنْيَابُهُ فَقَالَ خُذْهُ وَاسْتَغْفِرِ اللهَ وَأَطْعِمْ أَهْلَكَ وَكَذَلِكَ
[Machine] A man came to the Prophet Muhammad ﷺ and said, "O Messenger of Allah, I have committed a grave sin." The Prophet responded, "What have you done?! May Allah have mercy on you!" The man said, "I had sexual intercourse with my wife during Ramadan." The Prophet advised him, "Free a slave, but if you cannot find one, then fast for two consecutive months." The man replied, "I am not capable of doing so." The Prophet then instructed him, "Feed sixty poor people." The man said, "I cannot find them." At that moment, someone brought a container filled with dates to the Prophet and he said, "Take it and give it in charity." The man then said, "O Messenger of Allah, is there anyone in greater need than my family? By the One in whose hand is my soul, there is no one between the two mountain slopes of Madinah more in need than me." The Prophet smiled until his teeth became visible and he said, "Take it and seek forgiveness from Allah, your Lord." Amr ibn Shu'ayb reported that they brought a large container holding fifteen measures [of dates] to the Prophet. Al-Isma'ili did not mention anyone among them except Amr ibn Shu'ayb ibn al-Mubarak. Al-Haql said, "Someone brought five measures [of dates] in a container." Duhaym said, "Woe to you! What is the matter?" The man replied, "I had sexual intercourse with my wife during a day in Ramadan." The man then brought to the Prophet a container filled with fifteen measures [of dates]. The sheikh [narrator] stopped here.
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ هَلَكْتُ قَالَ وَيْحَكَ مَا صَنَعْتَ؟ قَالَ وَقَعْتُ عَلَى أَهْلِي فِي رَمَضَانَ قَالَ أَعْتِقْ رَقَبَةً قَالَ مَا أَجِدُهَا قَالَ صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَ لَا أَسْتَطِيعُ قَالَ فَأَطْعِمْ سِتِّينَ مِسْكِينًا قَالَ مَا أَجِدُ فَأُتِيَ رَسُولُ اللهِ ﷺ بِعَرَقٍ قَالَ خُذْهُ فَتَصَدَّقْ بِهِ فَقَالَ يَا رَسُولَ اللهِ أَعَلَى غَيْرِ أَهْلِي فَوَالَّذِي نَفْسِي بِيَدِهِ مَا بَيْنَ طُنْبَيِ الْمَدِينَةِ وَقَالَ عَمْرُو بْنُ شُعَيْبٍ مَا بَيْنَ لَابَتَيِ الْمَدِينَةِ أَحَدٌ أَحْوَجُ مِنِّي فَضَحِكَ رَسُولُ اللهِ ﷺ حَتَّى بَدَتْ أَسْنَانُهُ ثُمَّ قَالَ خُذْهُ وَاسْتَغْفِرِ اللهَ رَبَّكَ وَقَالَ عَمْرُو بْنُ شُعَيْبٍ فَأُتِيَ بِمِكْتَلٍ فِيهِ خَمْسَةَ عَشَرَ صَاعًا قَالَ الْإِسْمَاعِيلِيُّ لَمْ يَذْكُرْ أَحَدٌ مِنْهُمْ عَمْرَو بْنَ شُعَيْبٍ غَيْرُ ابْنِ الْمُبَارَكِ وَقَالَ الْهِقْلُ بِعَرَقٍ فِيهِ خَمْسَةَ عَشَرَ صَاعًا قَالَ دُحَيْمٌ وَيْحَكَ وَمَا ذَاكَ؟ قَالَ وَقَعْتُ عَلَى أَهْلِي فِي يَوْمٍ مِنْ شَهْرِ رَمَضَانَ فَأُتِيَ رَسُولُ اللهِ ﷺ بِعَرَقٍ فِيهِ خَمْسَةَ عَشَرَ صَاعًا قَالَ الشَّيْخُ
12.288 [Machine] Who fasts a day with two meals' worth of food?
١٢۔٢٨٨ بَابُ مَنْ عَدَلَ صِيَامَ يَوْمٍ بِمُدَّيْنِ مِنْ طَعَامٍ
[Machine] In his saying, "So for whoever kills[by mistake] a believer - then the penalty is to free a believing slave and blood money to the victim's family, unless they give it as charity. But if the deceased was from a people at war with you and he was a believer - then [only] the freeing of a believing slave; and if he was from a people with whom you have a treaty - then a compensation payment presented to his family and the freeing of a believing slave. And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah . And Allah is ever Knowing and Wise." (Quran 4:92) He said, "When the forbidden prey is caught, its punishment is decided, and the punishment is to slaughter it, and he should give charity with its meat. If he doesn't have the punishment with him, his punishment is to give [a certain amount of] money, then [instead of money], that money should be used to buy food, and he should fast for the same number of half measures it would feed, and the purpose of fasting with food is to say that if food was found, the punishment would be fulfilled."
فِي قَوْلِهِ {فَجَزَاءٌ مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ} [المائدة 95] قَالَ إِذَا أَصَابَ الْمُحْرِمُ الصَّيْدَ يُحْكَمُ عَلَيْهِ جَزَاؤُهُ فَإِنْ كَانَ عِنْدَهُ جَزَاؤُهُ ذَبَحَهُ وَتَصَدَّقَ بِلَحْمِهِ فَإِنْ لَمْ يَكُنْ عِنْدَهُ جَزَاؤُهُ قُوِّمَ جَزَاؤُهُ دَرَاهِمَ ثُمَّ قُوِّمَتِ الدَّرَاهِمُ طَعَامًا فَصَامَ مَكَانَ كُلِّ نِصْفِ صَاعٍ يَوْمًا وَإِنَّمَا أُرِيدَ بِالطَّعَامِ الصِّيَامُ أَنَّهُ إِذَا وَجَدَ الطَّعَامَ وَجَدَ جَزَاءَهُ
[Machine] I heard a division regarding the one who catches prey but does not have its reward. He said, "The prey is valued in dirhams, and dirhams are valued in food. So, for every half sa' (measurement) he fasts for a day." Shu'bah said, and Abu Ma'ram said to me, "Indeed, it is narrated from Ibn Abbas, meaning Aban ibn Taghlib, in Shu'bah's narration, that the reward is valued, and in Mansur's narration, the division is valued. And Mansur is more appropriate in the context of the hadith. It is also narrated from Ibn Abbas that if it is a sheep, then fasting for a day is accompanied by feeding two needy people, and if it is a camel or a cow, then fasting for a day is accompanied by feeding one needy person."
سَمِعْتُ مِقْسَمًا فِي الَّذِي يُصِيبُ الصَّيْدَ لَا يَكُونُ عِنْدَهُ جَزَاؤُهُ قَالَ يُقَوَّمُ الصَّيْدُ دَرَاهِمَ وَتُقَوَّمُ الدَّرَاهِمُ طَعَامًا فَيَصُومُ لِكُلِّ نِصْفِ صَاعٍ يَوْمًا قَالَ شُعْبَةُ وَقَالَ لِي أَبَانُ وَأَبُو مَرْيَمَ إِنَّهُ عَنِ ابْنِ عَبَّاسٍ يَعْنِي أَبَانَ بْنَ تَغْلِبَ كَذَا فِي رِوَايَةِ شُعْبَةَ يُقَوَّمُ الصَّيْدُ وَفِي رِوَايَةِ مَنْصُورٍ يُقَوَّمُ الْجَزَاءُ وَمَنْصُورٌ أَحْسَنُهُمَا سِيَاقَةً لِلْحَدِيثِ وَقَدْ رُوِيَ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ عَدَلَ فِي الْجَزَاءِ إِذَا كَانَتْ شَاةً صِيَامَ يَوْمٍ بِإِطْعَامِ مِسْكِينَيْنِ فَإِذَا كَانَتْ بَدَنَةً أَوْ بَقَرَةً صِيَامَ يَوْمٍ بِإِطْعَامِ مِسْكِينٍ وَاحِدٍ وَقَالَ مُدٌّ مُدٌّ
[Machine] If the prohibited person kills something from hunting, he will be punished accordingly. If he kills a deer or the like, then he must sacrifice a sheep in Mecca. If he cannot find one, then he must feed six poor people. If he cannot find them, then he must fast for three days. If he kills a buck or the like, then he must sacrifice a cow. If he cannot find one, then he must feed twenty poor people. If he cannot find them, then he must fast for twenty days. If he kills a female camel, a wild donkey, or the like, then he must sacrifice a part of a camel. If he cannot find one, then he must feed thirty poor people. If he cannot find them, then he must fast for thirty days. The food should be substantial enough to satisfy them, and this narration, along with the previous one, indicates that this is to be done in order. And Allah knows best.
إِذَا قَتَلَ الْمُحْرِمُ شَيْئًا مِنَ الصَّيْدِ حُكِمَ عَلَيْهِ فِيهِ فَإِنْ قَتَلَ ظَبْيًا أَوْ نَحْوَهُ فَعَلَيْهِ شَاةٌ تُذْبَحُ بِمَكَّةَ فَإِنْ لَمْ يَجِدْ فَإِطْعَامُ سِتَّةِ مَسَاكِينَ فَإِنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ وَإِنْ قَتَلَ أَيْلًا أَوْ نَحْوَهُ فَعَلَيْهِ بَقَرَةٌ فَإِنْ لَمْ يَجِدْ أَطْعَمَ عِشْرِينَ مِسْكِينًا فَإِنْ لَمْ يَجِدْ صَامَ عِشْرِينَ يَوْمًا وَإِنْ قَتَلَ نَعَامَةً أَوْ حِمَارَ وَحْشٍ أَوْ نَحْوَهُ فَعَلَيْهِ بَدَنَةٌ مِنَ الْإِبِلِ فَإِنْ لَمْ يَجِدْهُ أَطْعَمَ ثَلَاثِينَ مِسْكِينًا فَإِنْ لَمْ يَجِدْ صَامَ ثَلَاثِينَ يَوْمًا وَالطَّعَامُ مُدٌّ مُدٌّ شِبَعَهُمْ وَهَذِهِ الرِّوَايَةُ وَمَا قَبْلَهَا تَدُلُّ عَلَى أَنَّ ذَلِكَ عِنْدَهُ عَلَى التَّرْتِيبِ وَاللهُ أَعْلَمُ
12.289 [Machine] Where is the guidance in hunting and others? God, may He be praised, said: "A complete guidance to the Ka'bah" [Al-Ma'idah: 95]
١٢۔٢٨٩ بَابٌ: أَيْنَ هَدْيُ الصَّيْدِ وَغَيْرِهِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ {هَدْيًا بَالِغَ الْكَعْبَةِ} [المائدة: 95]
[Machine] The Messenger of Allah ﷺ saw a lice falling on his face, so he asked, "Does your lice bother you?" He (the person) replied, "Yes." So the Prophet ordered him to shave (his head), while they were still in Hudaybiyah and he did not inform them that they would perform Umrah with it (the shaved hair), and they still had hopes to enter Makkah. Then Allah revealed the verse, "Fidya (ransom) is either fasting or charity" (Quran 2:196), a difference between feeding six poor persons or sacrificing a sheep, and the sacrifices are to be done at Makkah.
أَنَّ رَسُولَ اللهِ ﷺ رَأَى قَمْلَةً سَقَطَتْ عَلَى وَجْهِهِ فَقَالَ أَيُؤْذِيكَ هَوَامُّكَ؟ قَالَ نَعَمْ فَأَمَرَهُ أَنْ يَحْلِقَ وَهُوَ بِالْحُدَيْبِيَةِ وَلَمْ يُبَيِّنْ لَهُمْ أَنَّهُمْ يَحِلُّونَ بِهَا وَهُمْ عَلَى طَمَعٍ أَنْ يَدْخُلُوا مَكَّةَ فَأَنْزَلَ اللهُ {فِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ} فَرَقٌ بَيْنَ سِتَّةِ مَسَاكِينَ أَوْ نُسُكُ شَاةٍ وَالنُّسُكُ بِمَكَّةَ
[Machine] Look at its price, then give charity with it to the needy people of Mecca.
تَنْظُرُ مَا ثَمَنُهُ فَتَصَدَّقْ بِهِ عَلَى مَسَاكِينِ أَهْلِ مَكَّةَ
[Machine] Abu Al-Abbas Al-Asamm narrated from Al-Rabi' that Al-Shafi'i narrated from Sa'id who said: I asked Ibn Juraij about the verse "So for him is its equivalent in jizyah" [Surah Al-Ma'idah: 95] until "a sacrificial animal reaching the Ka'bah or an expiation of feeding needy people" [Surah Al-Ma'idah: 95]. He said, "This is because he entered into a sacred precinct wanting to reach the Ka'bah, so the expiation for that is near the Ka'bah."
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ سَعِيدٌ عَنِ ابْنِ جُرَيْجٍ قَالَ قُلْتُ لِعَطَاءٍ {فَجَزَاءٌ مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ} [المائدة 95] إِلَى {هَدْيًا بَالِغَ الْكَعْبَةِ أَوْ كَفَّارَةٌ طَعَامُ مَسَاكِينَ} [المائدة 95] قَالَ مِنْ أَجْلِ أَنَّهُ أَصَابَهُ فِي حَرَمٍ يُرِيدُ الْبَيْتَ كَفَّارَةُ ذَلِكَ عِنْدَ الْبَيْتِ
12.290 [Machine] What the prohibited person does not eat of the game.
١٢۔٢٩٠ بَابُ مَا يَأْكُلُ الْمُحْرِمُ مِنَ الصَّيْدِ
[Machine] He (the narrator) was with the Prophet ﷺ until they were on a road to Makkah, and he fell behind with some of his companions who were in the state of Ihram (ritual consecration) while he was not in the state of Ihram. He saw a wild donkey, so he rode on his horse and asked his companions to give him his whip, but they refused. He then asked them for his spear, but they refused. So he took his spear and struck the donkey, killing it. Some of the Prophet's companions ate from it and some refused. When they joined the Prophet ﷺ, they asked him about it, and he said, "It is only food that Allah has fed you." Then Abu Abdullah Al-Hafiz narrated to us, reporting from Abu An-Nadr Al-Faqih, reporting from Abu Musa Harun ibn Musa Az-Zahid, reporting from Yahya ibn Yahya, who said, "I read this with Malik, and he mentioned it."
أَنَّهُ كَانَ مَعَ النَّبِيِّ ﷺ حَتَّى إِذَا كَانَ بِبَعْضُ طَرِيقِ مَكَّةَ تَخَلَّفَ مَعَ أَصْحَابٍ لَهُ مُحْرِمِينَ وَهُوَ غَيْرُ مُحْرِمٍ فَرَأَى حِمَارًا وَحْشِيًّا فَاسْتَوَى عَلَى فَرَسِهِ فَسَأَلَ أَصْحَابَهُ أَنْ يُنَاوِلُوهُ سَوْطَهُ فَأَبَوْا فَسَأَلَهُمْ رُمْحَهُ فَأَبَوْا فَأَخَذَ رُمْحَهُ فَشَدَّ عَلَى الْحِمَارِ فَقَتَلَهُ فَأَكَلَ مِنْهُ بَعْضُ أَصْحَابِ النَّبِيِّ ﷺ وَأَبَى بَعْضُهُمْ فَلَمَّا أَدْرَكُوا النَّبِيَّ ﷺ سَأَلُوهُ عَنْ ذَلِكَ فَقَالَ إِنَّمَا هِيَ طُعْمَةٌ أَطْعَمَكُمُوهَا اللهُ 9905 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو النَّضْرِ الْفَقِيهُ ثنا أَبُو مُوسَى هَارُونُ بْنُ مُوسَى الزَّاهِدُ ثنا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ فَذَكَرَهُ
[Machine] From Abu Qatada about the wild donkey, a narration similar to the hadith of Abu al-Nadr, except that in the hadith of Zaid, the Prophet Muhammad ﷺ said, "Do you have any of its meat?" They mentioned it in the authentic narration from the hadith of Malik.
عَنْ أَبِي قَتَادَةَ فِي الْحِمَارِ الْوَحْشِيِّ مِثْلَ حَدِيثِ أَبِي النَّضْرِ إِلَّا أَنَّ فِي حَدِيثِ زَيْدٍ أَنَّ رَسُولَ اللهِ ﷺ قَالَ هَلْ مَعَكُمْ مِنْ لَحْمِهِ شَيْءٌ؟ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ
We went with the Messenger of Allah ﷺ till we reached al-Qaha (a place three stages away from Medina). Some of us were in the state of Ihram and some of us were not. I saw my companions looking towards something, and as I saw I found It to be a wild ass. I saddled my horse and took up my spear and then mounted upon (the horse) and my whip, fell down. I said to my companions as they were in the state of Ihram to pick up the whip for me but they said: By Allah, we cannot help you in any (such) thing (i. e. hunting). So i dismounted (the horse) and picked it (whip) up and mounted again and caught the wild ass after chasing it. It was behind a hillock and I attacked it with my spear and killed it. Then I brought it to my companions. Some of them said: Eat it, while others said: Do not eat it. The Apostle of Allah ﷺ was in front of us. I moved my horse and came to him (and asked him), whereupon he said: It is permissible, so eat it. (Using translation from Muslim 1196a)
سَمِعْتُ أَبَا قَتَادَةَ يَقُولُ خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ حَتَّى إِذَا كُنَّا بِالْقَاحَةِ وَمِنَّا الْمُحْرِمُ وَغَيْرُ الْمُحْرِمِ إِذْ بَصُرْتُ بِأَصْحَابِي يَتَرَاءَوْنَ شَيْئًا فَنَظَرْتُ فَإِذَا أَنَا بِحِمَارِ وَحْشٍ فَأَسْرَجْتُ فَرَسِي وَرَكِبْتُ فَأَخَذْتُ رُمْحِي فَسَقَطَتْ سَوْطِي فَقُلْتُ لِأَصْحَابِي نَاوِلُونِي وَكَانُوا مُحْرِمِينَ فَقَالُوا لَا وَاللهِ لَا نُعِينُكَ عَلَيْهِ بِشَيْءٍ فَتَنَاوَلْتُ سَوْطِي ثُمَّ أَتَيْتُ الْحِمَارَ مِنْ خَلْفِهِ وَهُوَ وَرَاءَ أَكَمَةٍ فَطَعَنْتُهُ بِرُمْحِي فَعَقَرْتُهُ فَأَتَيْتُ بِهِ أَصْحَابِي فَقَالَ بَعْضُهُمْ كُلُوهُ وَقَالَ بَعْضُهُمْ لَا تَأْكُلُوهُ قَالَ وَكَانَ رَسُولُ اللهِ ﷺ أَمَامَنَا فَحَرَّكْتُ فَرَسِي فَأَدْرَكْتُهُ فَسَأَلْتُهُ فَقَالَ هُوَ حَلَالٌ فَكُلُوهُ
My father set out (for Mecca) in the year of Al-Hudaibiya, and his companions assumed Ihram, but he did not. At that time the Prophet ﷺ was informed that an enemy wanted to attack him, so the Prophet ﷺ proceeded onwards. While my father was among his companions, some of them laughed among themselves. (My father said), "I looked up and saw an onager. I attacked, stabbed and caught it. I then sought my companions' help but they refused to help me. (Later) we all ate its meat. We were afraid that we might be left behind (separated) from the Prophet ﷺ so I went in search of the Prophet ﷺ and made my horse to run at a galloping speed at times and let it go slow at an ordinary speed at other times till I met a man from the tribe of Bani Ghifar at midnight. I asked him, "Where did you leave the Prophet ﷺ ?" He replied, "I left him at Ta'hun and he had the intention of having the midday rest at As-Suqya. I followed the trace and joined the Prophet ﷺ and said, 'O Messenger of Allah ﷺ! Your people (companions) send you their compliments, and (ask for) Allah's Blessings upon you. They are afraid lest they may be left behind; so please wait for them.' I added, 'O Messenger of Allah ﷺ! I hunted an onager and some of its meat is with me. The Prophet ﷺ told the people to eat it though all of them were in the state of Ihram." (Using translation from Bukhārī 1821)
أَنَّهُ انْطَلَقَ مَعَ رَسُولِ اللهِ ﷺ عَامَ الْحُدَيْبِيَةِ فَأَحْرَمَ أَصْحَابِي وَلَمْ أُحْرِمْ فَانْطَلَقَ النَّبِيُّ ﷺ وَكُنْتُ مَعَ أَصْحَابِي فَجَعَلَ بَعْضُهُمْ يَضْحَكُ إِلَى بَعْضٍ فَنَظَرْتُ فَإِذَا حِمَارُ وَحْشٍ فَحَمَلْتُ عَلَيْهِ فَطَعَنْتُهُ فَأَثْبَتُّهُ فَاسْتَعَنْتُ بِهِمْ فَأَبَوْا أَنْ يُعِينُونِي فَأَكَلْنَا مِنْهُ وَخَشِينَا أَنْ نُقْتَطَعَ يَعْنِي فَانْطَلَقْتُ أَرْفَعُ فَرَسِي فَأَطْلُبُ النَّبِيَّ ﷺ فَلَقِيتُ رَجُلًا مِنْ جَوْفِ اللَّيْلِ مِنْ غِفَارٍ فَقُلْتُ أَيْنَ تَرَكْتَ النَّبِيَّ ﷺ؟ قَالَ بِالسُّقْيَا يَعْنِي فَلَحِقْتُ بِهِ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ أَصْحَابَكَ يَقْرَءُونَ عَلَيْكَ السَّلَامَ وَرَحْمَةَ اللهِ وَقَدْ خَشُوا أَنْ يُقْتَطَعُوا دُونَكَ فَانْتَظِرْهُمْ يَا رَسُولَ اللهِ وَقُلْتُ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ حِمَارَ وَحْشٍ وَمَعِي مِنْهُ فَاضِلَةٌ فَقَالَ النَّبِيُّ ﷺ لِلْقَوْمِ كُلُوا وَهُمْ مُحْرِمُونَ
That his father said, "One day I was sitting with some of the Prophet's companions on the way to Mecca. Messenger of Allah ﷺ was ahead of us. All of my companions were in the state of Ihram while I was a non-Muhrim. They saw an onager while I was busy repairing my shoes, so they did not tell me about it but they wished I had seen it. By chance I looked up and saw it. So, I turned to the horse, saddled it and rode on it, forgetting to take the spear and the whip. I asked them if they could hand over to me the whip and the spear but they said, 'No, by Allah, we shall not help you in that in any way.' I became angry and got down from the horse, picked up both the things and rode the horse again. I attacked the onager and slaughtered it, and brought it (after it had been dead). They took it (cooked some of it) and started eating it, but they doubted whether it was allowed for them to eat it or not, as they were in the state of Ihram. So, we proceeded and I hid with me one of its fore-legs. When we met Messenger of Allah ﷺ and asked him about the case, he asked, 'Do you have a portion of it with you?' I replied in the affirmative and gave him that fleshy foreleg which he ate completely while he was in the state of Ihram . (Using translation from Bukhārī 2570)
كُنْتُ يَوْمًا جَالِسًا مَعَ رَهْطٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ فِي مَنْزِلٍ فِي طَرِيقِ مَكَّةَ وَرَسُولُ اللهِ ﷺ نَازِلٌ أَمَامَنَا وَالْقَوْمُ مُحْرِمُونَ وَأَنَا غَيْرُ مُحْرِمٍ قَالَ فَأَبْصَرَ الْقَوْمُ حِمَارًا وَحْشِيًّا وَأَنَا مَشْغُولٌ أَخْصِفُ نَعْلِي فَلَمْ يُؤْذِنُونِي بِهِ فَالْتَفَتُّ فَأَبْصَرْتُهُ فَقُمْتُ إِلَى فَرَسِي فَأَسْرَجْتُهُ ثُمَّ رَكِبْتُهُ وَنَسِيتُ السَّوْطَ وَالرُّمْحَ فَقُلْتُ لَهُمْ نَاوِلُونِي السَّوْطَ وَالرُّمْحَ فَقَالُوا لَا نُعِينُكَ عَلَيْهِ بِشَيْءٍ فَنَزَلْتُ فَأَخَذْتُهُمَا وَرَكِبْتُ فَشَدَدْتُ عَلَيْهِ فَقَتَلْتُهُ ثُمَّ جِئْتُ بِهِ أَجُرُّهُ قَدْ مَاتَ فَوَقَعُوا فِيهِ يَأْكُلُونَهُ ثُمَّ إِنَّهُمْ شَكُّوا فِي أَكْلِهِمْ إِيَّاهُ وَهُمْ حُرُمٌ فَرُحْنَا وَخَبَّأْتُ الْعَضُدَ مَعِي فَأَدْرَكَنَا رَسُولَ اللهِ ﷺ فَسَأَلْنَاهُ عَنْ ذَلِكَ فَقَالَ مَعَكُمْ مِنْهُ شَيْءٌ؟ قُلْتُ نَعَمْ فَنَاوَلْتُهُ الْعَضُدَ فَأَكَلَهَا وَهُوَ مُحْرِمٌ حَتَّى تَعَرَّقَهَا
[Machine] And he said to those who did not eat, "You have made a mistake. Indeed, we have eaten with the Messenger of Allah ﷺ while we were in a state of ihram."
وَقَالَ لِلَّذِينَ لَمْ يَأْكُلُوا أَخْطَأْتُمْ فَإِنَّا قَدْ أَكَلْنَا مَعَ رَسُولِ اللهِ ﷺ وَنَحْنُ حُرُمٌ
[Machine] That the Messenger of Allah ﷺ set out intending to go to Mecca, and when he was in a valley called Rawha, the people found a wild donkey tied up. They informed the Messenger of Allah ﷺ about it, and he said, "Leave it until its owner comes." Then Al-Bahziyy came and his donkey was with him. He said, "O Messenger of Allah, what is the matter with this donkey?" So the Messenger of Allah ﷺ ordered Abu Bakr and he divided it among the companions, and they were in a state of Ihram (ritual consecration). The Prophet ﷺ then continued until they reached Al-Abwa, where they found a female deer standing under a tree, and there was an arrow in it. The Prophet ﷺ ordered a man to stay with it until the people passed by it.
أَنَّ رَسُولَ اللهِ ﷺ خَرَجَ وَهُوَ يُرِيدُ مَكَّةَ حَتَّى إِذَا كَانَ فِي بَعْضِ وَادِي الرَّوْحَاءِ وَجَدَ النَّاسُ حِمَارَ وَحْشٍ عَقِيرًا فَذَكَرُوا ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ ذَرُوهُ حَتَّى يَأْتِيَ صَاحِبُهُ فَأَتَى الْبَهْزِيُّ وَكَانَ صَاحِبَهُ فَقَالَ يَا رَسُولَ اللهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ رَسُولُ اللهِ ﷺ أَبَا بَكْرٍ ؓ فَقَسَمَهُ بَيْنَ الرِّفَاقِ وَهُمْ مُحْرِمُونَ قَالَ ثُمَّ سِرْنَا حَتَّى إِذَا كُنَّا بِالْأَبْوَاءِ فَإِذَا ظَبْيٌ حَاقِفٌ فِي ظِلِّ شَجَرَةٍ وَفِيهِ سَهْمٌ فَأَمَرَ النَّبِيُّ ﷺ رَجُلًا يُقِيمُ عِنْدَهُ حَتَّى يُجِيزَ النَّاسَ عَنْهُ
أَنْ تَصْطَادَهُ
[Machine] Umar used to eat it. I said, "I am only asking you about yourself. Do you eat it?" He said, "Umar used to eat it." I said, "Umar was better than me."
كَانَ عُمَرُ ؓ يَأْكُلُهُ قُلْتُ إِنَّمَا أَسْأَلُكَ عَنْ نَفْسِكَ أَتَأْكُلُهُ؟ قَالَ كَانَ عُمَرُ ؓ يَأْكُلُهُ قُلْتُ إِنَّمَا أَسْأَلُكَ عَنْ نَفْسِكَ أَتَأْكُلُهُ؟ قَالَ كَانَ عُمَرُ ؓ خَيْرًا مِنِّي
[Machine] He came across a group who were prohibited from wearing garments made of sheep's wool, so they asked him about eating game meat. He found people who permitted it, so he issued a ruling allowing them to eat it. Then, I approached Umar ibn al-Khattab and asked him about that. He said, "With what did you issue the ruling?" I said, "I issued the ruling based on their eating of it." Umar said, "If you had issued the ruling without that, I would have punished you." Malik narrated this hadith from Zaid ibn Aslam from Ata' ibn Yasar, who reported that Ka'b al-Ahbar came from Sham with a group who were prohibited, until they found game meat. Ka'b issued a ruling allowing them to eat it. When they came to Umar ibn al-Khattab, they mentioned this to him, and he said, "Who issued this ruling to you?" They said, "Ka'b." Umar said, "I have already instructed him regarding all of you until you return."
أَنَّهُ مَرَّ بِهِ قَوْمٌ مُحْرِمُونَ بِالرَّبَذَةِ فَاسْتَفْتَوْهُ فِي لَحْمِ صَيْدٍ وَجَدَهُ أُنَاسٌ أَحِلَّةٌ أَيَأْكُلُونَهُ؟ فَأَفْتَاهُمْ بِأَكْلِهِ قَالَ ثُمَّ قَدِمْتُ عَلَى عُمَرَ بْنِ الْخَطَّابِ ؓ فَسَأَلْتُهُ عَنْ ذَلِكَ فَقَالَ بِمَ أَفْتَيْتَهُمْ؟ قَالَ قُلْتُ أَفْتَيْتُهُمْ بِأَكْلِهِ قَالَ عُمَرُ ؓ لَوْ أَفْتَيْتَهُمْ بِغَيْرِ ذَلِكَ لَأَوْجَعْتُكَ 9914 وَبِإِسْنَادِهِ ثنا مَالِكٌ عَنْ زَيْدِ بْنِ أَسْلَمَ عَنْ عَطَاءِ بْنِ يَسَارٍ أَنَّ كَعْبَ الْأَحْبَارِ أَقْبَلَ مِنَ الشَّامِ فِي رَكْبٍ مُحْرِمِينَ حَتَّى إِذَا كَانُوا بِبَعْضِ الطَّرِيقِ وَجَدُوا لَحْمَ صَيْدٍ فَأَفْتَاهُمْ كَعْبٌ بِأَكْلِهِ فَلَمَّا قَدِمُوا عَلَى عُمَرَ بْنِ الْخَطَّابِ ؓ ذَكَرُوا ذَلِكَ لَهُ فَقَالَ مَنْ أَفْتَاكُمْ بِهَذَا؟ قَالُوا كَعْبٌ قَالَ فَإِنِّي قَدْ أَمَّرْتُهُ عَلَيْكُمْ حَتَّى تَرْجِعُوا
[Machine] That Zubair ibn Al-Awwam used to provide provisions for the soldiers in ihram.
أَنَّ الزُّبَيْرَ بْنَ الْعَوَّامِّ ؓ كَانَ يَتَزَوَّدُ صَفِيفَ الظِّبَاءِ فِي الْإِحْرَامِ
[Machine] "We used to eat the meat of the hunted animals, provide it, and eat it while being in the company of the Messenger of Allah ﷺ and likewise."
كُنَّا نَأْكُلُ لَحْمَ الصَّيْدِ وَنَتَزَوَّدُهُ وَنَأْكُلُهُ وَنَحْنُ مُحْرِمُونَ مَعَ رَسُولِ اللهِ ﷺ وَكَذَلِكَ
12.291 [Machine] What the forbidden ones do not eat from hunting.
١٢۔٢٩١ بَابُ مَا لَا يَأْكُلُ الْمُحْرِمُ مِنَ الصَّيْدِ
That his father had told him that Messenger of Allah ﷺ set out for Hajj and so did his companions. He sent a batch of his companions by another route and Abu Qatada was one of them. The Prophet ﷺ said to them, "Proceed along the seashore till we meet all together." So, they took the route of the seashore, and when they started all of them assumed Ihram except Abu Qatada. While they were proceeding on, his companions saw a group of onagers. Abu Qatada chased the onagers and attacked and wounded a sheonager. They got down and ate some of its meat and said to each other: "How do we eat the meat of the game while we are in a state of Ihram?" So, we (they) carried the rest of the she-onager's meat, and when they met Messenger of Allah ﷺ they asked, saying, "O Messenger of Allah ﷺ! We assumed Ihram with the exception of Abu Qatada and we saw (a group) of onagers. Abu Qatada attacked them and wounded a she-onager from them. Then we got down and ate from its meat. Later, we said, (to each other), 'How do we eat the meat of the game and we are in a state of Ihram?' So, we carried the rest of its meat. The Prophet asked, "Did anyone of you order Abu Qatada to attack it or point at it?" They replied in the negative. He said, "Then eat what is left of its meat." (Using translation from Bukhārī 1824)
خَرَجَ رَسُولُ اللهِ ﷺ حَاجًّا أَوْ مُعْتَمِرًا وَخَرَجْنَا مَعَهُ فَصَرَفَ طَائِفَةً مِنْهُمْ وَأَنَا مَعَهُمْ قَالَ خُذُوا سَاحِلَ الْبَحْرِ حَتَّى تَلْقَوْنِي فَأَخَذْنَا سَاحِلَ الْبَحْرِ فَلَمَّا انْصَرَفْنَا قَبْلَ رَسُولِ اللهِ ﷺ أَحْرَمُوا كُلُّهُمْ غَيْرَ أَبِي قَتَادَةَ فَبَيْنَمَا نَحْنُ نَسِيرُ إِذْ رَأَيْنَا حُمْرَ وَحْشٍ فَعَقَرْتُ مِنْهَا أَتَانًا فَنَزَلُوا فَأَكَلُوا مِنْ لَحْمِهَا فَقَالُوا نَأْكُلُ لَحْمَ صَيْدٍ وَنَحْنُ مُحْرِمُونَ فَحَمَلُوا مَا بَقِيَ مِنْ لَحْمِهَا حَتَّى أَتَوَا النَّبِيَّ ﷺ فَقَالُوا إِنَّا كُنَّا قَدْ أَحْرَمْنَا وَكَانَ أَبُو قَتَادَةَ لَمْ يُحْرِمْ فَرَأَيْنَا حُمْرَ وَحْشٍ فَعَقَرَ مِنْهَا أَتَانًا فَنَزَلْنَا فَأَكَلْنَا مِنْ لَحْمِهَا ثُمَّ حَمَلْنَا مَا بَقِيَ مِنْ لَحْمِهَا فَقَالَ رَسُولُ اللهِ ﷺ هَلْ مِنْكُمْ أَحَدٌ أَمَرَهُ أَنْ يَحْمِلَ عَلَيْهَا أَوْ أَشَارَ إِلَيْهَا؟ فَقَالُوا لَا قَالَ فَكُلُوا مَا بَقِيَ مِنْ لَحْمِهَا لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ وَلَيْسَ فِي حَدِيثِ الْمُقْرِئِ أَوْ مُعْتَمِرًا
[Machine] Abu Qatadah was among a group of people who were prohibited from eating certain types of food, while Abu Qatadah was not bound by such restriction. The people saw a wild donkey, but they did not give permission to anyone until Abu Qatadah saw it. He secretly took a whip from one of them, then rode on the donkey and killed it. He brought it to them and they ate and carried it. They then met the Prophet ﷺ and asked him about it. He said, "Did anyone among you point to it or provide it to you?" They replied, "No, O Messenger of Allah." He said, "Then eat."
كَانَ أَبُو قَتَادَةَ فِي نَفَرٍ مُحْرِمِينَ وَأَبُو قَتَادَةَ مُحِلٌّ فَأَبْصَرَ الْقَوْمُ حِمَارَ وَحْشٍ فَلَمْ يُؤْذِنُوهُ حَتَّى أَبْصَرَهُ أَبُو قَتَادَةَ فَاخْتَلَسَ مِنْ بَعْضِهِمْ سَوْطًا ثُمَّ حَمَلَ عَلَى الْحِمَارِ فَصَرَعَهُ فَأَتَاهُمْ بِهِ فَأَكَلُوا وَحَمَلُوا فَلَقُوا النَّبِيَّ ﷺ فَسَأَلُوهُ فَقَالَ هَلْ أَشَارَ إِلَيْهِ إِنْسَانٌ مِنْكُمْ أَوْ أَمَدَّهُ بِشَيْءٍ؟ قَالُوا لَا يَا رَسُولَ اللهِ قَالَ فَكُلُوا
[Machine] He said, "I went out with the Messenger of Allah ﷺ during the time of Hudaybiyah. My companions entered the state of ihram, but I did not. I saw a donkey and I mounted it, so I was blamed for it. I mentioned this to the Messenger of Allah ﷺ and I also mentioned that I did not enter the state of ihram and that I rode the donkey for you. The Prophet ﷺ commanded his companions to eat and they did so, except for me. When I informed him that I had ridden the donkey for him, he said, 'Ali said to us, Abu Bakr said to us, no one has mentioned in this hadith what Ma'mar mentioned, and it is in agreement with what was narrated from Uthman 9920.' Abu Bakr ibn al-Harith informed us, Abu al-Sheikh al-Asbahani narrated to us, Abdan narrated to us, Hussein ibn Mahdi narrated to us, Abd al-Razzaq mentioned it in this manner: The Sheikh said, 'This is a strange word that we did not write except for this reason. We have also narrated from Abu Hazim ibn Dinar from Abdullah ibn Abi Qatadah in this hadith that the Prophet ﷺ ate from it,' and these two chains of narration are authentic, and Allah knows best.
أَنَّهُ قَالَ خَرَجْتُ مَعَ رَسُولِ اللهِ ﷺ زَمَنَ الْحُدَيْبِيَةِ فَأَحْرَمَ أَصْحَابِي وَلَمْ أُحْرِمْ فَرَأَيْتُ حِمَارًا فَحَمَلْتُ عَلَيْهِ فَاصْطَدْتُهُ فَذَكَرْتُ شَأْنَهُ لِرَسُولِ اللهِ ﷺ وَذَكَرْتُ أَنِّي لَمْ أَكُنْ أَحْرَمْتُ وَأَنِّي إِنَّمَا اصْطَدْتُهُ لَكَ فَأَمَرَ النَّبِيُّ ﷺ أَصْحَابَهُ فَأَكَلُوا وَلَمْ يَأْكُلْ مِنْهُ حِينَ أَخْبَرْتُهُ أَنِّي اصْطَدْتُهُ لَهُ قَالَ عَلِيٌّ قَالَ لَنَا أَبُو بَكْرٍ قَوْلُهُ اصْطَدْتُهُ لَكَ وَقَوْلُهُ وَلَمْ يَأْكُلْ مِنْهُ لَا أَعْلَمُ أَحَدًا ذَكَرَ فِي هَذَا الْحَدِيثِ عَنْ مَعْمَرٍ وَهُوَ مُوَافِقٌ لِمَا رُوِيَ عَنْ عُثْمَانَ 9920 وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ أنبأ أَبُو الشَّيْخِ الْأَصْبَهَانِيُّ ثنا عَبْدَانُ ثنا حُسَيْنُ بْنُ مَهْدِيٍّ ثنا عَبْدُ الرَّزَّاقِ فَذَكَرَهُ بِنَحْوِهِ قَالَ الشَّيْخُ هَذِهِ لَفْظَةٌ غَرِيبَةٌ لَمْ نَكْتُبْهَا إِلَّا مِنْ هَذَا الْوَجْهِ وَقَدْ رُوِّينَا عَنْ أَبِي حَازِمِ بْنِ دِينَارٍ عَنْ عَبْدِ اللهِ بْنِ أَبِي قَتَادَةَ فِي هَذَا الْحَدِيثِ أَنَّ النَّبِيَّ ﷺ أَكَلَ مِنْهَا وَتِلْكَ الرِّوَايَةُ أَوْدَعَهَا صَاحِبَا الصَّحِيحِ كِتَابَيْهِمَا دُونَ رِوَايَةِ مَعْمَرٍ وَإِنْ كَانَ الْإِسْنَادَانِ صَحِيحَيْنِ وَاللهُ أَعْلَمُ
[Machine] From the narration of the Prophet Muhammad ﷺ, he said: "The meat of hunted game is lawful for you, while you are in a state of prohibition, until you have hunted it or it has been hunted for you."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لَحْمُ صَيْدِ الْبَرِّ لَكُمْ حَلَالٌ وَأَنْتُمْ حُرُمٌ مَا لَمْ تَصِيدُوهُ أَوْ يُصَدْ لَكُمْ
[Machine] The Messenger of Allah ﷺ said, "Hunting on land is lawful for you as long as you do not catch it or someone else catches it for you. These three trustworthy individuals have established their chain of narration from 'Amr and likewise."
قَالَ رَسُولُ اللهِ ﷺ صَيْدُ الْبَرِّ لَكُمْ حَلَالٌ مَا لَمْ تَصِيدُوهُ أَوْ يُصَدْ لَكُمْ فَهَؤُلَاءِ ثَلَاثَةٌ مِنَ الثِّقَاتِ أَقَامُوا إِسْنَادَهُ عَنْ عَمْرٍو وَكَذَلِكَ
إِنِّي لَسْتُ كَهَيْئَتِكُمْ إِنَّمَا صِيدَ مِنْ أَجْلِي
[Machine] "He performed Umrah with Uthman and was given a bird as a gift. He commanded them to eat it but he refused to eat. Amr bin Al-Aas said to him, 'Do you eat from what you are not going to eat?' He replied, 'I am not like you in that matter. I only hunt for myself and kill it with my name.'"
أَنَّهُ اعْتَمَرَ مَعَ عُثْمَانَ ؓ فِي رَكْبٍ فَأُهْدِيَ لَهُ طَائِرٌ فَأَمَرَهُمْ بِأَكْلِهِ وَأَبَى أَنْ يَأْكُلَ فَقَالَ لَهُ عَمْرُو بْنُ الْعَاصِ أَنَأْكُلُ مِمَّا لَسْتَ مِنْهُ آكِلًا؟ فَقَالَ إِنِّي لَسْتُ فِي ذَاكُمْ مِثْلَكُمْ إِنَّمَا اصْطِيدَ لِي وَأُمِيتَ بِاسْمِي
12.292 [Machine] The forbidden (one) does not accept what is given to him as a living prey.
١٢۔٢٩٢ بَابٌ: الْمُحْرِمُ لَا يَقْبَلُ مَا يُهْدَى لَهُ مِنَ الصَّيْدِ حَيًّا
[Machine] He gave the Messenger of Allah ﷺ a wild donkey, which was in Abuwa or Waddan. The Messenger of Allah ﷺ returned it to him. When the Messenger of Allah ﷺ saw what was on his face, he said, "We only returned it to you because I am prohibited."
أَنَّهُ أَهْدَى لِرَسُولِ اللهِ ﷺ حِمَارًا وَحْشِيًّا وَهُوَ بِالْأَبْوَاءِ أَوْ بِوَدَّانَ فَرَدَّهُ عَلَيْهِ رَسُولُ اللهِ ﷺ فَلَمَّا رَأَى رَسُولُ اللهِ ﷺ مَا فِي وَجْهِي قَالَ إِنَّا لَمْ نَرُدَّهُ عَلَيْكَ إِلَّا أَنَا حُرُمٌ
That he heard As-Sa'b bin Jath-thama Al-Laithi, who was one of the companions of the Prophet, saying that he gave the meat of an onager to Messenger of Allah ﷺ while he was at a place called Al-Abwa' or Waddan, and was in a state of Ihram. The Prophet ﷺ did not accept it. When the Prophet ﷺ saw the signs of sorrow on As-Sa'b's face because of not accepting his present, he said (to him), "We are not returning your present, but we are in the state of Ihram." أَخْبَرَهُ أَنَّهُ سَمِعَ الصَّعْبَ بْنَ جَثَّامَةَ اللَّيْثِيَّ وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ يُخْبِرُ أَنَّهُ أَهْدَى لِرَسُولِ اللهِ ﷺ حِمَارَ وَحْشٍ بِالْأَبْوَاءِ أَوْ بِوَدَّانَ وَرَسُولُ اللهِ ﷺ مُحْرِمٌ فَرَدَّهُ رَسُولُ اللهِ ﷺ قَالَ الصَّعْبُ فَلَمَّا عَرَفَ رَسُولُ اللهِ ﷺ رَدَّهُ هَدِيَّتِي فِي وَجْهِي قَالَ لَيْسَ بِنَا رَدٌّ عَلَيْكَ وَلَكِنَّا حُرُمٌ
[Machine] He informed him that the Messenger of Allah ﷺ passed by him in Al-Abwaa or Waddaan, and he gifted him a wild donkey. He returned it to him, and when the Messenger of Allah ﷺ saw dislike on his face, he said, "It is not a refusal from us to you, but I am in a state of ihram."
أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ مَرَّ بِهِ بِالْأَبْوَاءِ أَوْ بِوَدَّانَ فَأَهْدَى لَهُ حِمَارًا وَحْشِيًّا فَرَدَّهُ عَلَيْهِ فَلَمَّا رَأَى رَسُولُ اللهِ ﷺ فِي وَجْهِهِ الْكَرَاهِيَةَ قَالَ إِنَّهُ لَيْسَ بِنَا رَدٌّ عَلَيْكَ وَلَكِنِّي مُحْرِمٌ
[Machine] The Messenger of Allah passed by me while I was in Abuwa or Budhan, so I gifted him a wild donkey. He returned it to me when he saw dislike in my face and said, "Indeed, we do not return anything to you, but we are haram (forbidden)." I found this in my book, and it is a narration from Sufyan from Sufyan. Then he became confused about it later. He told us Abu al-Husayn ibn al-Fadl al-Qattan that Abdullah ibn Ja'far informed us that Ya'qub ibn Sufyan said, "Abu Bakr al-Humaydi used to say, 'I gifted the Messenger of Allah a donkey's meat, and Sufyan might have said that it dripped blood, or he might not have said that.' Sufyan used to say in his previous narrations, 'a wild donkey's meat,' then it became 'meat' until he died."
مَرَّ بِي رَسُولُ اللهِ ﷺ وَأَنَا بِالْأَبْوَاءِ أَوْ بِوَدَّانَ فَأَهْدَيْتُ لَهُ حِمَارَ وَحْشٍ فَرَدَّهُ عَلَيَّ فَلَمَّا رَأَى فِي وَجْهِي الْكَرَاهِيَةَ قَالَ إِنَّهُ لَيْسَ بِنَا رَدٌّ عَلَيْكَ وَلَكِنَّا حُرُمٌ كَذَا وَجَدْتُهُ فِي كِتَابِي وَهُوَ سَمَاعُ الْحُمَيْدِيِّ مِنْ سُفْيَانَ فِيمَا خَلَا ثُمَّ اضْطَرَبَ فِيهِ بَعْدُ 9930 أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يَعْقُوبُ بْنُ سُفْيَانَ قَالَ قَالَ أَبُو بَكْرٍ الْحُمَيْدِيُّ وَكَانَ سُفْيَانُ يَقُولُ فِي الْحَدِيثِ أَهْدَيْتُ لِرَسُولِ اللهِ ﷺ لَحْمَ حِمَارِ وَحْشٍ وَرُبَّمَا قَالَ سُفْيَانُ يَقْطُرُ دَمًا وَرُبَّمَا لَمْ يَقُلْ وَكَانَ سُفْيَانُ فِيمَا خَلَا رُبَّمَا قَالَ حِمَارَ وَحْشٍ ثُمَّ صَارَ إِلَى لَحْمٍ حَتَّى مَاتَ
[Machine] The difficult Ibn Jathama gave the Prophet ﷺ a wild donkey as a gift, while it is prohibited to accept. The Prophet ﷺ returned it and said, "If it were not for the fact that we are prohibited, we would have accepted it from you."
أَهْدَى الصَّعْبُ بْنُ جَثَّامَةَ إِلَى النَّبِيِّ ﷺ حِمَارَ وَحْشٍ وَهُوَ مُحْرِمٌ فَرَدَّهُ عَلَيْهِ وَقَالَ لَوْلَا أَنَّا مُحْرِمُونَ لَقَبِلْنَاهُ مِنْكَ
[Machine] A wild donkey foal was gifted to the Prophet ﷺ, but he returned it as it was forbidden.
أُهْدِيَ لِلنَّبِيِّ ﷺ شِقُّ حِمَارِ وَحْشٍ وَهُوَ مُحْرِمٌ فَرَدَّهُ
That As-Sab bin Jaththamah gave the Prophet some onager (meat) when he was in Ihram and he returned it to him. (Using translation from Nasāʾī 2823)
أَنَّ الصَّعْبَ بْنَ جَثَّامَةَ أَهْدَى إِلَى رَسُولِ اللهِ ﷺ حِمَارَ وَحْشٍ وَهُوَ مُحْرِمٌ فَرَدَّهُ
[Machine] That the son of Jaththamah, Sa'b, offered a gift to the Prophet ﷺ while he was in Qudayd, and it was a forbidden 'ajuzah that was unable to bear a load. So the Messenger of Allah ﷺ returned it dripping with blood.
أَنَّ الصَّعْبَ بْنَ جَثَّامَةَ أَهْدَى إِلَى النَّبِيِّ ﷺ وَهُوَ بِقُدَيْدٍ وَهُوَ مُحْرِمٌ عَجُزَ حِمَارٍ فَرَدَّهُ رَسُولُ اللهِ ﷺ يَقْطُرُ دَمًا
[Machine] Sa'ab ibn Jaththama presented a wild donkey to the Messenger of Allah ﷺ while it was in Qudayd, so he returned it.
أَهْدَى الصَّعْبُ بْنُ جَثَّامَةَ إِلَى رَسُولِ اللهِ ﷺ رِجْلَ حِمَارِ وَحْشٍ وَهُوَ بِقُدَيْدٍ فَرَدَّهُ
[Machine] Al-Shafi'i said, "If Saba' bin Jaththamah offered the Prophet ﷺ a live donkey as a gift, it is not permissible for someone in a state of Ihram to slaughter a live wild donkey. However, if he offered him its meat, it is possible that he knew it was hunted for him, so he returned it to him as indicated in the narration of Jabir bin Abdullah. Al-Shafi'i also mentioned the narration of Malik that the Prophet ﷺ was offered a donkey by Saba', which is more reliable than the narration of someone who said he offered him donkey meat. Allah knows best." The Sheikh said, "It has been reported in the narration of Saba' that the Prophet ﷺ ate from it."
قَالَ الشَّافِعِيُّ فَإِنْ كَانَ الصَّعْبُ بْنُ جَثَّامَةَ أَهْدَى إِلَى النَّبِيِّ ﷺ الْحِمَارَ حَيًّا فَلَيْسَ لِمُحْرِمٍ ذَبْحُ حِمَارِ وَحْشٍ حَيٍّ وَإِنْ كَانَ أَهْدَى لَهُ لَحْمًا فَقَدْ يُحْتَمَلُ أَنْ يَكُونَ عَلِمَ أَنَّهُ صِيدَ لَهُ فَرَدَّهُ عَلَيْهِ وَإِيضَاحُهُ فِي حَدِيثِ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ الشَّافِعِيُّ وَحَدِيثُ مَالِكٍ أَنَّ الصَّعْبَ أَهْدِيَ للنَّبِيِّ ﷺ حِمَارًا أَثْبَتُ مِنْ حَدِيثِ مَنْ حَدَّثَ أَنَّهُ أَهْدَى لَهُ مِنْ لَحْمِ حِمَارٍ وَاللهُ أَعْلَمُ قَالَ الشَّيْخُ وَقَدْ رُوِيَ فِي حَدِيثِ الصَّعْبِ أَنَّهُ أَكَلَ مِنْهُ
[Machine] So it was as if he (or it) restored life to the dead, and it was said: "He brought back the flesh." And Allah knows best.
فَكَأَنَّهُ رَدَّ الْحِيَّ وَقِيلَ اللَّحْمَ وَاللهُ أَعْلَمُ
[Machine] About a hunted meat that was given to the Messenger of Allah ﷺ while it was forbidden, he said, "He was given a piece of meat from a hunted animal and he rejected it, saying, 'We do not eat it. We consider it forbidden.'" In the narration of Yahya, it is mentioned that Zaid bin Arqam came and Ibn Abbas asked him about the hunted meat. Zaid said, "The Messenger of Allah ﷺ was given hunted meat, but he rejected it."
عَنْ لَحْمِ صَيْدٍ أُهْدِيَ إِلَى رَسُولِ اللهِ ﷺ وَهُوَ حَرَامٌ؟ قَالَ فَقَالَ أُهْدِيَ لَهُ عُضْوٌ مِنْ لَحْمِ صَيْدٍ فَرَدَّهُ فَقَالَ إِنَّا لَا نَأْكُلُهُ إِنَّا حُرُمٌ لَفْظُ حَدِيثِ يَحْيَى وَفِي رِوَايَةِ أَبِي عَاصِمٍ أَنَّ زَيْدَ بْنَ أَرْقَمَ قَدِمَ فَأَتَاهُ ابْنُ عَبَّاسٍ ؓ فَاسْتَفْتَاهُ فِي لَحْمِ الصَّيْدِ فَقَالَ أُتِيَ رَسُولُ اللهِ ﷺ بِلَحْمِ صَيْدٍ وَهُوَ مُحْرِمٌ فَرَدَّهُ
[Machine] The passage is about the caliph Uthman's provision of food for him, made from rocks, wild animals' meats, and game. Ali bin Abi Talib was sent to Uthman, and the messenger went to him while he was grinding for his livestock. They told him to stop, but he told them to feed him a group. Then Ali said, "I witness that whoever was here is the bravest. Do you know that the Messenger of Allah, ﷺ , once gave him a wild donkey, which is forbidden, but he refused to eat it?" They said, "Yes." The interpretation of these two narrations is what Al-Shafi'i mentioned in his interpretation of the story of Sa'd bin Jathama, that he was given the meat of a donkey. As for Ali and Ibn Abbas, they went to prohibit it for him completely. Omar, Uthman, Talha, Zubair, and others disagreed with them. Along with them is the narration of Abu Qatada and Jabir, and Allah knows best.
خَلِيفَةَ عُثْمَانَ ؓ عَلَى الطَّائِفِ فَصَنَعَ لِعُثْمَانَ ؓ طَعَامًا وَصَنَعَ فِيهِ مِنَ الْحَجَلِ وَالْيَعَاقِيبِ وَلُحُومِ الْوَحْشِ قَالَ فَبَعَثَ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ فَجَاءَهُ الرَّسُولُ وَهُوَ يَخْبِطُ لِأَبَاعِرَ لَهُ فَجَاءَهُ وَهُوَ يَنْقُضُ الْخَبْطَ مِنْ يَدِهِ فَقَالُوا لَهُ كُلْ فَقَالَ أَطْعِمُوهُ قَوْمًا حَلَالًا فَإِنَّا قَوْمٌ حُرُمٌ ثُمَّ قَالَ عَلِيٌّ ؓ أَنْشُدُ اللهَ مَنْ كَانَ هَا هُنَا مِنْ أَشْجَعَ أَتَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ أَهْدَى إِلَيْهِ رَجُلٌ حِمَارَ وَحْشٍ وَهُوَ مُحْرِمٌ فَأَبَى أَنْ يَأْكُلَهُ؟ قَالُوا نَعَمْ وَتَأْوِيلُ هَذَيْنِ الْمُسْنَدَيْنِ مَا ذَكَرَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي تَأْوِيلِ حَدِيثِ مَنْ رَوَى فِي قِصَّةِ الصَّعْبِ بْنِ جَثَّامَةَ أَنَّهُ أَهْدَى إِلَيْهِ مِنْ لَحْمِ حِمَارٍ وَأَمَّا عَلِيٌّ وَابْنُ عَبَّاسٍ ؓ فَإِنَّهُمَا ذَهَبَا إِلَى تَحْرِيمِ أَكْلِهِ عَلَى الْمُحْرِمِ مُطْلَقًا وَقَدْ خَالَفَهُمَا عُمَرُ وَعُثْمَانُ وَطَلْحَةُ وَالزُّبَيْرُ ؓ وَغَيْرُهُمْ وَمَعَهُمْ حَدِيثُ أَبِي قَتَادَةَ وَجَابِرٍ وَاللهُ أَعْلَمُ
[Machine] "Aisha, the wife of the Prophet (PBUH), said to him, 'O nephew of mine, it is only a ten-day period. So if you feel any discomfort within yourself, leave it, I mean eating game meat.'"
عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ لَهُ يَا ابْنَ أُخْتِي إِنَّمَا هِيَ عَشْرُ لَيَالٍ فَإِنْ يَخْتَلِجْ فِي نَفْسِكَ شَيْءٌ فَدَعْهُ يَعْنِي أَكْلَ لَحْمِ الصَّيْدِ
[Machine] The companions of the Messenger of Allah ﷺ had differences regarding this matter. Some of them disliked it, while others did not see any harm in it.
اخْتَلَفَ فِيهَا أَصْحَابُ رَسُولِ اللهِ ﷺ فَكَرِهَه بَعْضُهُمْ وَلَمْ يَرَ بَعْضُهُمْ بَأْسًا وَلَيْسَ بِهِ بَأْسٌ
