[Machine] Al-Qa'nabi reported from Malik that Abu Yazid al-Qaratisi reported from Abdullah bin Abdul-Hakam who reported from Bakr bin Sahl who reported from Abdullah bin Yusuf who reported from Yusuf al-Qadi who reported from Amr bin Marzouq who said: "I am Malik, from Ibn Shihab, from Uthman bin Ishaq bin Kharsha who reported that Qubaysah bin Dhu'ayb said: 'My grandmother came to Abu Bakr As-Siddiq asking about her inheritance according to the Book of Allah. Abu Bakr said to her: 'You have nothing in the Book of Allah, and I do not know of anything for you in the Sunnah of the Messenger of Allah ﷺ , so go back until I ask the people.' So he asked the people and Al-Mughirah bin Shu'bah said: 'The Messenger of Allah ﷺ gave her one-sixth.' Abu Bakr said: 'Do you have anyone else?' Muhammad bin Muslimah Al-Ansari stood and said the same thing as Al-Mughirah. So Abu Bakr approved that for her. Then another grandmother came to Umar bin Al-Khattab asking about her inheritance. He said: 'You have nothing in the Book of Allah and the judgment that has been decreed is not for other than you. And I will not increase anything in the shares, but it is that one-sixth. So if you both agree, it is between you two, and whoever is absent, it belongs to her.' And the wording is according to the narration of Ibn Abdul-Hakam.

ثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ ح وَحَدَّثَنَا أَبُو يَزِيدَ القَرَاطِيسِيُّ ثَنَا عَبْدُ اللهِ بْنُ عَبْدِ الْحَكَمِ ح وَحَدَّثَنَا بَكْرُ بْنُ سَهْلٍ ثَنَا عَبْدُ اللهِ بْنُ يُوسُفَ ح وَحَدَّثَنَا يُوسُفُ الْقَاضِي ثَنَا عَمْرُو بْنُ مَرْزُوقٍ قَالُوا أَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عُثْمَانَ بْنِ إِسْحَاقَ بْنِ خَرَشَةَ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ تَسْأَلُهُ مِيرَاثَهَا فِي كِتَابِ اللهِ فَقَالَ لَهَا أَبُو بَكْرٍ مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ رَسُولِ اللهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ «حَضَرَتُ رَسُولَ اللهِ ﷺ فَأَعْطَاهَا السُّدُسَ» فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الْأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ثُمّ جَاءَتِ الْجَدَّةُ الْأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللهِ مِنْ شَيْءٍ وَمَا كَانَ الْقَضَاءُ الَّذِي قُضِيَ بِهِ إِلَّا لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَلِكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا وَاللَّفْظُ لِحَدِيثِ ابْنِ عَبْدِ الْحَكَمِ

[Machine] "Mughira reported that the Messenger of Allah ﷺ pronounced judgment in favor of the plaintiff. 'Umar said: "If you speak the truth, bring forth someone who can bear witness to that." Muhammad ibn Maslamah testified that he heard the Messenger of Allah ﷺ pronounce judgment in favor of the plaintiff."  

الطبراني:١٨٢٦٧حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ عَنْ عَبْدِ الرَّزَّاقِ عَنِ ابْنِ جُرَيْجٍ أَخْبَرَنِي هِشَامُ بْنُ عُرْوَةَ عَنْ عُرْوَةَ أَنَّهُ حَدَّثَ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ أَنَّ عُمَرَ اسْتَشَارَهُمْ فِي إِمْلَاصِ الْمَرْأَةِ فَقَالَ

الْمُغِيرَةُ «قَضَى فِيهِ رَسُولُ اللهِ ﷺ بِغُرَّةٍ» فَقَالَ عُمَرُ إِنْ كُنْتَ صَادِقًا فَائْتِ بِأَحَدٍ يَعْلَمُ ذَلِكَ فَشَهِدَ مُحَمَّدُ بْنُ مَسْلَمَةَ أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ قَضَى فِيهِ بِغُرَّةٍ

[Machine] "Al-Mughira, the Messenger of Allah (peace and blessings be upon him) ruled in favor of a slave or a servant." So, Umar said, "Who will testify to your statement?" So, Muhammad ibn Muslimah testified for him.  

الطبراني:١٨٢٦٨حَدَّثَنَا مُطَّلِبُ بْنُ شُعَيْبٍ الْأَزْدِيُّ ثَنَا عَبْدُ اللهِ بْنُ صَالِحٍ حَدَّثَنِي اللَّيْثُ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ قَالَ سَمِعْتُ الْمُغِيرَةَ بْنَ شُعْبَةَ أَنَّ عُمَرَ سَأَلَهُمْ عَنْ إِمْلَاصِ الْمَرْأَةِ فَقَالَ

الْمُغِيرَةُ «قَضَى فِيهِ رَسُولُ اللهِ ﷺ بِغُرَّةِ عَبْدٍ أَوْ أَمَةٍ» فَقَالَ عُمَرُ مَنْ يُصَدِّقُكَ؟ فَشَهِدَ لَهُ مُحَمَّدُ بْنُ مَسْلَمَةَ

[Machine] Al-Mughira bin Shu'bah reported, "The Messenger of Allah ﷺ ruled in his favor on a certain matter." Muhammad bin Muslima Al-Ansari testified for him that the Messenger of Allah ﷺ had ruled in his favor.  

الطبراني:١٨٢٦٩حَدَّثَنَا عَبْدُ اللهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ وَالْحُسَيْنُ بْنُ إِسْحَاقَ التُّسْتَرِيُّ قَالَا ثَنَا شَيْبَانُ بْنُ فَرُّوخٍ ثَنَا عَبْدُ الْعَزِيزِ بْنُ مُسْلِمٍ ثَنَا هِشَامُ بْنُ عُرْوَةَ عَنْ أَبِيهِ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ اسْتَفْتَاهُمْ فِي إِمْلَاصِ الْمَرْأَةِ فَقَالَ

الْمُغِيرَةُ بْنُ شُعْبَةَ «قَضَى فِيهِ رَسُولُ اللهِ ﷺ بِغُرَّةٍ» فَشَهِدَ لَهُ مُحَمَّدُ بْنُ مَسْلَمَةَ الْأَنْصَارِيُّ أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِهِ

[Machine] When the Prophet ﷺ wanted something, he would distance himself.  

الطبراني:١٨٢٧٠حَدَّثَنَا مُحَمَّدُ بْنُ عَلِيٍّ الصَّائِغُ الْمَكِّيُّ ثَنَا مُوسَى بْنُ مُحَمَّدِ بْنِ حَيَّانَ الْبَصْرِيُّ ثَنَا أَبُو بَحْرٍ الْبَكْرَاوِيُّ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ

«أَنَّ النَّبِيَّ ﷺ كَانَ إِذَا أَرَادَ حَاجَةً أَبْعَدَ»

[Machine] "He was with two disbelievers from his people, so he killed them and took their belongings. Then he went to the Prophet ﷺ , but the Prophet ﷺ disliked what he had done and did not accept the belongings he had taken from them."  

الطبراني:١٨٢٧١حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى بْنِ الْمُنْذِرِ الْقَزَّازُ ثَنَا حَفْصُ بْنُ عُمَرَ الْحَوْضِيُّ ثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ

«أَنَّهُ كَانَ مَعَ رَجُلَيْنِ مِنْ قَوْمِهِ كُفَّارٍ فَقَتَلَهُمَا وَسَلَبَهُمَا فَجَاءَ إِلَى النَّبِيِّ ﷺ فَكَرِهَ لَهُ النَّبِيُّ ﷺ الَّذِي صَنَعَ وَأَهْدَى لَهُ سَلَبَهُمَا فَلَمْ يَقْبَلْهُ»

[Machine] "He accompanied a group of polytheists and found them negligent, so he killed them and took their wealth. Then he brought it to the Messenger of Allah ﷺ , who disapproved of his actions and refused to accept it."  

الطبراني:١٨٢٧٢حَدَّثَنَا أَسْلَمُ بْنُ سَهْلٍ الْوَاسِطِيُّ ثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ مَاهَانَ بْنِ أَبِي حَنِيفَةَ ثَنَا أَبِي ثَنَا الْعَلَاءُ بْنُ رَاشِدٍ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ

«أَنَّهُ صَحِبَ قَوْمًا مِنَ الْمُشْرِكِينَ فَوَجَدَ مِنْهُمْ غَفْلَةً فَقَتَلَهُمْ وَأَخَذَ أَمْوَالَهُمْ فَجَاءَ بِهَا إِلَى رَسُولِ اللهِ ﷺ فَكَرِهَ مَا صَنَعَ وَأَبَى أَنْ يَقْبَلَهَا»  

tabarani:18273al-Ḥusayn b. Isḥāq al-Tustarī > Yaḥyá al-Ḥimmānī > Ibn Abū al-Zinād from his father > ʿUrwah b. al-Zubayr > al-Mughīrah b. Shuʿbah > ʿUmar

[Machine] Al-Mughira said, "I said to Umar, 'The Messenger of Allah ﷺ ruled in favor of the plaintiff at the earliest stage of a dispute.' Umar replied, 'If you are truthful, bring someone who witnessed this with you.' Muhammad ibn Muslima then said, 'I bear witness that the Prophet ﷺ ruled in favor of a woman in the earliest stage of a dispute.' Umar ruled accordingly."  

الطبراني:١٨٢٧٣حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْحَاقَ التُّسْتَرِيُّ ثَنَا يَحْيَى الْحِمَّانِيُّ ثَنَا ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ أَنَّ عُمَرَ اسْتَشَارَهُمْ فِي إِمْلَاصِ الْمَرْأَةِ قَالَ

الْمُغِيرَةُ فَقُلْتُ لِعُمَرَ «قَضَى فِيهِ رَسُولُ اللهِ ﷺ بِالْغُرَّةِ» قَالَ عُمَرُ إِنْ كُنْتَ صَادِقًا فَائْتِنِي بِمَنْ يَعْلَمُ هَذَا مَعَكَ فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ «شَهِدْتُ النَّبِيَّ ﷺ قَضَى فِي إِمْلَاصِ الْمَرْأَةِ بِالْغُرَّةِ» فَقَضَى بِهِ عُمَرُ ؓ
