١۔ كِتَابُ الطَّهَارَة ص ١٢
[Machine] "That the Messenger of Allah ﷺ slept in prostration until he snored and breathed heavily. I said, 'O Messenger of Allah, have you slept?' He replied, 'Indeed, it is obligatory to perform ablution for the one who lies down on his side, for when he lies down on his side, his joints loosen like this.'"
أَنَّ رَسُولَ اللهِ ﷺ نَامَ فِي سُجُودِهِ حَتَّى غَطَّ وَنَفَخَ قُلْتُ يَا رَسُولَ اللهِ قَدْ نِمْتَ؟ فَقَالَ إِنَّمَا يَجِبُ الْوُضُوءُ عَلَى مَنْ وَضَعَ جَنْبَهُ فَإِنَّهُ إِذَا وَضَعَ جَنْبَهُ اسْتَرْخَتْ مَفَاصِلُهُ هَكَذَا
[Machine] Allah ﷺ does not require ablution for those who sleep while sitting, standing, or in prostration until they place their side, for when they place their side, their joints relax. This hadith is narrated by Yazid bin Abdur-Rahman Abu Khalid Ad-Dalani, who said that Abu Isa At-Tirmidhi asked Muhammad bin Ismail Al-Bukhari about this hadith, and he said, “This is nothing.” Sa'id bin Abi Arubah narrated it from Qatadah, who narrated it from Ibn Abbas, but he did not mention Abu Al-Ala, and I do not know if Abu Khalid Ad-Dalani heard it from Qatadah or not. Abu Ali Ar-Rudhbani reported to us that Abu Bakr ibn Dasa said, “Abu Dawud As-Sijistani said, ‘The narration about ablution for someone who sleeps lying down is a rejected hadith, and only Yazid Ad-Dalani narrated it from Qatadah. And Abu Dawud said that Shu'bah heard Qatadah mention the hadith of Yunus bin Matta, the hadith of Ibn Umar regarding prayer, the hadith of the judges, and the hadith of Ibn Abbas. He said, ‘I heard from reliable men among them, including Umar and others.’ Umar meant by this, ‘No prayer after Asr.’ The Sheikh also heard the hadith of Ibn Abbas regarding what you say in times of distress and his hadith about the Prophet ﷺ seeing him in his night journey, along with others.’ Abu Dawud said, ‘I mentioned the hadith of Yazid Ad-Dalani to Ahmad bin Hanbal, and he said, ‘Yazid Ad-Dalani should not be considered among the companions of Qatadah.’’’’ Abu Dawud said, ‘The first group of narrators from Ibn Abbas did not mention anything from this.’ Ikrimah said, ‘The Prophet ﷺ was preserved.’ Aisha said, ‘The Prophet ﷺ would sleep with his eyes closed, but his heart would not sleep.’
اللهِ ﷺ لَا يَجِبُ الْوضُوءُ عَلَى مَنْ نَامَ جَالِسًا أَوْ قَائِمًا أَوْ سَاجِدًا حَتَّى يَضَعَ جَنْبَهُ فَإِنَّهُ إِذَا وَضَعَ جَنْبَهُ اسْتَرْخَتْ مَفَاصِلُهُ تَفَرَّدَ بِهَذَا الْحَدِيثِ عَلَى هَذَا الْوَجْهِ يَزِيدُ بْنُ عَبْدِ الرَّحْمَنِ أَبُو خَالِدٍ الدَّالَانِيُّ قَالَ أَبُو عِيسَى التِّرْمِذِيُّ سَأَلْتُ مُحَمَّدَ بْنَ إِسْمَاعِيلَ الْبُخَارِيَّ عَنْ هَذَا الْحَدِيثِ فَقَالَ هَذَا لَا شَيْءٌ وَرَوَاهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ وَلَمْ يَذْكُرْ فِيهِ أَبَا الْعَالِيَةَ وَلَا أَعْرِفُ لِأَبِي خَالِدٍ الدَّالَانِيِّ سَمَاعًا مِنْ قَتَادَةَ أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أَنَا أَبُو بَكْرِ بْنُ دَاسَةَ قَالَ قَالَ أَبُو دَاودَ السِّجِسْتَانِيُّ قَوْلُهُ الْوُضُوءُ عَلَى مَنْ نَامَ مُضْطَجِعًا هُوَ حَدِيثٌ مُنْكَرٌ لَمْ يَرْوِهِ إِلَّا يَزِيدُ الدَّالَانِيُّ عَنْ قَتَادَةَ وَقَالَ أَبُو دَاودَ قَالَ شُعْبَةُ إِنَّمَا سَمِعَ قَتَادَةُ مِنْ أَبِي الْعَالِيَةِ أَرْبَعَةَ أَحَادِيثَ حَدِيثَ يُونُسَ بْنِ مَتَى وَحَدِيثَ ابْنِ عُمَرَ فِي الصَّلَاةِ وَحَدِيثَ الْقُضَاةُ ثَلَاثَةٌ وَحَدِيثَ ابْنِ عَبَّاسٍ حَدَّثَنِي رِجَالٌ مَرْضِيُّونَ مِنْهُمْ عُمَرُ وَأَرْضَاهُمْ عِنْدِي عُمَرُ يَعْنِي فِي لَا صَلَاةَ بَعْدَ الْعَصْرِ قَالَ الشَّيْخُ وَسَمِعَ أَيْضًا حَدِيثَ ابْنَ عَبَّاسٍ فِيمَا يَقُولُ عِنْدَ الْكَرْبِ وَحَدِيثُهُ فِي رُؤْيَةِ النَّبِيِّ ﷺ لَيْلَةَ أُسْرِيَ بِهِ مُوسَى وَغَيْرَهُ قَالَ أَبُو دَاودَ وَذَكَرْتُ حَدِيثَ يَزِيدَ الدَّالَانِيِّ لِأَحْمَدَ بْنِ حَنْبَلٍ فَقَالَ مَا لِيَزِيدَ الدَّالَانِيِّ يَدْخُلُ عَلَى أَصْحَابِ قَتَادَةَ قَالَ الشَّيْخُ يَعْنِي بِهِ أَحْمَدُ مَا ذَكَرَهُ الْبُخَارِيُّ مِنْ أَنَّهُ لَا يُعْرَفُ لِأَبِي خَالِدٍ الدَّالَانِيِّ سَمَاعٌ مِنْ قَتَادَةَ قَالَ أَبُو دَاودَ وَرَوَى أَوَّلَهُ جَمَاعَةٌ عَنِ ابْنِ عَبَّاسٍ لَمْ يذْكُرُوا شَيْئًا مِنْ هَذَا وَقَالَ عِكْرِمَةُ كَانَ النَّبِيُّ ﷺ مَحْفُوظًا وَقَالَتْ عَائِشَةُ ؓ قَالَ النَّبِيُّ ﷺ تَنَامُ عَيْنَايَ وَلَا يَنَامُ قَلْبِي
[Machine] That the Messenger of Allah ﷺ slept until he emitted a snore, then he got up and prayed without performing ablution. Ikrimah said: "Indeed, the Prophet ﷺ was protected."
أَنَّ رَسُولَ اللهِ ﷺ نَامَ حَتَّى سُمِعَ لَهُ غَطِيطٌ فَقَامَ فَصَلَّى وَلَمْ يتَوَضَّأْ قَالَ عِكْرِمَةُ إِنَّ النَّبِيَّ ﷺ كَانَ مَحْفُوظًا
[Machine] The Prophet ﷺ slept until he snored, then he got up and prayed without performing ablution. This is mentioned in the authentic hadiths of Thawri, except for the addition that Abu Khaled Ad-Dalani mentioned, and likewise...
أَنَّ النَّبِيَّ ﷺ نَامَ حَتَّى نَفَخَ ثُمَّ قَامَ فَصَلَّى وَلَمْ يتَوَضَّأْ مُخَرَّجٌ فِي الصَّحِيحَيْنِ مِنْ حَدِيثِ الثَّوْرِيِّ دُونَ الزِّيَادَةِ الَّتِي تَفَرَّدَ بِهَا أَبُو خَالِدٍ الدَّالَانِيُّ وَكَذَلِكَ
Ibn ʿAbbas said, "The Prophet ﷺ slept till he snored and then prayed (or probably lay till his breath sounds were heard and then got up and prayed)." Ibn ʿAbbas added: "I stayed overnight in the house of my aunt, Maimuna, the Prophet ﷺ slept for a part of the night, (See Fath-al-Bari page 249, Vol. 1), and late in the night, he got up and performed ablution from a hanging water skin, a light (perfect) ablution and stood up for the prayer. I, too, performed a similar ablution, then I went and stood on his left. He drew me to his right and prayed as much as Allah wished, and again lay and slept till his breath sounds were heard. Later on the Mu'adh-dhin (call maker for the prayer) came to him and informed him that it was time for Prayer. The Prophet ﷺ went with him for the prayer without performing a new ablution." (Sufyan said to ʿAmr that some people said, "The eyes of Messenger of Allah ﷺ sleep but his heart does not sleep." ʿAmr replied, "I heard ʿUbaid bin ʿUmar saying that the dreams of Prophets were Divine Inspiration, and then he recited the verse: 'I (Abraham) see in a dream, (O my son) that I offer you in sacrifice (to Allah)." بِتُّ عِنْدَ خَالَتِي مَيْمُونَةَ ذَاتَ لَيْلَةٍ فَلَمَّا كَانَ فِي بَعْضِ اللَّيْلِ قَامَ النَّبِيُّ ﷺ فَتَوَضَّأَ مِنْ شَنٍّ مُعَلَّقٍ وُضُوءًا خَفِيفًا يُخَفِّفُهُ عَمْرٌو وَيُقَلِّلُهُ جِدًّا ثُمَّ قَامَ يُصَلِّي فَقُمْتُ فَتَوَضَّأْتُ نَحْوَ مَا تَوَضَّأَ ثُمَّ قُمْتُ عَنْ يَسَارِهِ فَحَوَّلَنِي فَجَعَلَنِي عَنْ يَمِينِهِ ثُمَّ صَلَّى مَا شَاءَ اللهُ ثُمَّ اضْطَجَعَ فَنَامَ حَتَّى نَفَخَ ثُمَّ جَاءَهُ الْمُنَادِي فَآذَنَهُ بِالصَّلَاةِ وَقَالَ سُفْيَانُ مَرَّةً أُخْرَى ثُمَّ قَامَ إِلَى الصَّلَاةِ فَصَلَّى بِنَا وَلَمْ يتَوَضَّأْ وَقَالَ سُفْيَانُ قُلْنَا لِعَمْرٍو إِنَّ أُنَاسًا يَقُولُونَ إِنَّ رَسُولَ اللهِ ﷺ تَنَامُ عَيْنَاهُ وَلَا يَنَامُ قَلْبُهُ؟ قَالَ عُمَرُ وَسَمِعْتُ عُبَيْدَ بْنَ عُمَيْرٍ يَقُولُ رُؤْيَا الْأَنْبِيَاءِ وَحْيٌ وَقَرَأَ {إِنِّي أَرَى فِي الْمَنَامِ أَنِّي أَذْبَحُكَ} [الصافات 102]
[Machine] So I said, "O Messenger of Allah, do you sleep before you perform the Witr prayer?" He replied, "O Aisha, indeed my eyes sleep, but my heart does not sleep."
فَقُلْتُ يَا رَسُولَ اللهِ تَنَامُ قَبْلَ أَنْ تُوتِرَ؟ فَقَالَ يَا عَائِشَةُ إِنَّ عَيْنِيَّ تَنَامَانِ وَلَا يَنَامُ قَلْبِي
[Machine] Abu Hurayrah said: "A person who intends to sleep does not need to perform ablution (wudu), nor does a person who prays while sitting, nor does a person who prays while lying down. Ablution is only required when one lies down to sleep, and when one lies down, they perform ablution. This was a narrated statement."
سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ لَيْسَ عَلَى الْمُحْتَبِي النَّائِمِ وَلَا عَلَى الْقَائِمِ النَّائِمِ وَلَا عَلَى السَّاجِدِ النَّائِمِ وُضُوءٌ حَتَّى يَضْطَجِعَ فَإِذَا اضْطَجَعَ تَوَضَّأَ وَهَذَا مَوْقُوفٌ
1.144 [Machine] The purification ritual using fainting.
١۔١٤٤ بَابُ انْتِقَاضِ الطُّهْرِ بِالْإِغْمَاءِ
[Machine] Did the Prophet ﷺ fall ill? They said, "Yes, the Messenger of Allah ﷺ became heavy." He ﷺ said, "Should I lead the people in prayer?" We said, "No, O Messenger of Allah, they are waiting for you." He said, "Give me water in the Mashadah (a wooden vessel for ablution)." So, we gave him water and he performed ablution, then he went to urinate but he fainted. Then he regained consciousness and asked, "Should I lead the people in prayer?" We said, "No, they are waiting for you, O Messenger of Allah." He said, "Give me water in the Mashadah." So, we gave him water and he performed ablution, then he went to urinate but he fainted. Then he regained consciousness and asked, "Should I lead the people in prayer?" We said, "No," while they were waiting for him, O Messenger of Allah. She (Aisha) said, "The people were standing inside the Masjid, waiting for the Messenger of Allah ﷺ for the last prayer of the night." She said, "So the Messenger of Allah ﷺ sent for Abu Bakr to lead the people in prayer." And the wording of their hadiths is the same, and the rest of the hadith is in the book of prayers.
مَرِضِ رَسُولِ اللهِ ﷺ؟ فَقَالَتْ بَلَى ثَقُلَ رَسُولُ اللهِ ﷺ فَقَالَ أصَلَّى النَّاسُ؟ قُلْنَا لَا يَا رَسُولَ اللهِ هُمْ يَنْتَظِرُونَكَ قَالَ ضَعُوا لِي مَاءً فِي الْمِخْضَبِ فَفَعَلْنَا فَاغْتَسَلَ ثُمَّ ذَهَبَ لِيَنُوءَ فَأُغْمِيَ عَلَيْهِ ثُمَّ أَفَاقَ فَقَالَ أَصَلَّى النَّاسُ فَقُلْنَا لَا هُمْ يَنْتَظِرُونَكَ يَا رَسُولَ اللهِ قَالَ ضَعُوا لِي مَاءً فِي الْمِخْضَبِ فَفَعَلْنَا فَاغْتَسَلَ ثُمَّ ذَهَبَ لِيَنُوءَ فَأُغْمِيَ عَلَيْهِ ثُمَّ أَفَاقَ فَقَالَ أَصَلَّى النَّاسُ؟ فَقُلْنَا لَا هُمْ يَنْتَظِرُونَكَ يَا رَسُولَ اللهِ فَقَالَ ضَعُوا لِي مَاءً فِي الْمِخْضَبِ فَفَعَلْنَا فَاغْتَسَلَ ثُمَّ ذَهَبَ لِيَنُوءَ فَأُغْمِيَ عَلَيْهِ ثُمَّ أَفَاقَ فَقَالَ أَصَلَّى النَّاسُ؟ فَقُلْنَا لَا وَهُمْ يَنْتَظِرُونَكَ يَا رَسُولَ اللهِ قَالَتْ وَالنَّاسُ عُكُوفٌ فِي الْمَسْجِدِ يَنْتَظِرُونَ رَسُولَ اللهِ ﷺ لِصَلَاةِ الْعِشَاءِ الْآخِرَةِ قَالَتْ فَأَرْسَلَ رَسُولُ اللهِ ﷺ إِلَى أَبِي بَكْرٍ أَنْ يُصَلِّيَ بِالنَّاسِ وَذَكَرَ الْحَدِيثَ لَفْظُهُمَا سَوَاءٌ وَبَاقِي الْحَدِيثِ فِي كِتَابِ الصَّلَاةِ
1.145 [Machine] Purification from Touching" Allah the Almighty said: "Or you have touched women" [An-Nisa: 43]. And the term "touch" refers to what is lesser than sexual intercourse, as mentioned by the Messenger of Allah ﷺ to Ma'iz ibn Malik: "Perhaps you kissed or touched." He prohibited selling touch, and he mentioned in a hadith narrated by Abu Hurayrah in some narrations: "And the hand's fornication is touch." Aisha said: "There was not a day that passed without the Messenger of Allah ﷺ coming to us all and kissing or touching what is below the waist." And these hadiths are mentioned with their chains of narration in their relevant places.
١۔١٤٥ بَابُ الْوضُوءِ مِنَ الْمُلَامَسَةِ قَالَ اللهُ تَعَالَى: {أَوْ لَامَسْتُمُ النِّسَاءَ} [النساء: 43] وَاسْمُ اللَّمْسِ يَقَعُ عَلَى مَا دُونَ الْجِمَاعِ لِقَوْلِهِ ﷺ لِمَاعِزِ بْنِ مَالِكٍ: " لَعَلَّكَ قَبَّلْتَ أَوْ لَمَسْتَ، وَنَهْيُهُ عَنْ بَيْعِ الْمُلَامَسَةِ، وَقَوْلُهُ فِي حَدِيثِ أَبِي هُرَيْرَةَ فِي بَعْضِ الرِّوَايَاتِ عَنْهُ: " وَالْيَدُ زِنَاهَا اللَّمْسُ ". وَقَوْلُ عَائِشَةَ: قَلَّ يَوْمًا أَوْ مَا كَانَ مَنْ يوْمٍ إِلَّا وَرَسُولُ اللهِ ﷺ يَطُوفُ عَلَيْنَا جَمِيعًا، فَيُقَبِّلُ وَيَلْمِسُ مَا دُونَ الْوِقَاعِ. وَهَذِهِ الْأَحَادِيثِ بِأَسَانِيدِهِنَّ مُخَرَّجَةٌ فِي مَوَاضِعِهِنَّ
[Machine] Indeed, the direction of prayer is from touch, so purify yourself from it.
إِنَّ الْقُبْلَةَ مِنَ اللَّمْسِ فَتَوَضَّئُوا مِنْهَا
[Machine] In His saying, exalted be He, "{or you have touched women}" [Women 4:43], the meaning is that which is less than sexual intercourse.
فِي قَوْلِهِ تَعَالَى {أَوْ لَامَسْتُمُ النِّسَاءَ} [النساء 43] قَوْلًا مَعْنَاهُ مَا دُونَ الْجِمَاعِ
[Machine] The Qibla includes touching (with the hands or body) for ablution, except for touching that happens during sexual intercourse.
الْقُبْلَةُ مِنَ اللَّمْسِ وَمِنْهَا الْوُضُوءُ وَاللَّمْسُ مَا دُونَ الْجِمَاعِ هَكَذَا
[Machine] The kiss of a man to his wife and touching her with his hand without any barrier requires a person to perform ablution (wudu). This is the statement of Shaafi'ee. In the narration of Ibn Bukayr, it is stated that performing ablution is obligatory in this case. This is also the opinion of Umar, Abdullah bin Masood, and Abdullah bin Umar. However, Ibn Abbas disagreed with them and held the view that the mentioned touching in the Noble Quran does not require ablution, unlike the kiss.
قُبْلَةُ الرَّجُلِ امْرَأَتَهُ وَجَسُّهَا بِيَدِهِ مِنَ الْمُلَامَسَةِ فَمَنْ قَبَّلَ امْرَأَتَهُ أَوْ جَسَّهَا بِيَدِهِ فَعَلَيْهِ الْوُضُوءُ لَفْظُ حَدِيثِ الشَّافِعِيِّ ؓ وَفِي رِوَايَةِ ابْنِ بُكَيْرٍ فَقَدْ وَجَبَ عَلَيْهِ الْوُضُوءُ فَهَذَا قَوْلُ عُمَرَ وَعَبْدِ اللهِ بْنِ مَسْعُودٍ وَعَبْدِ اللهِ بْنِ عُمَرَ وَخَالَفَهُمْ ابْنُ عَبَّاسٍ فَحَمَلَ الْمُلَامَسَةَ الْمَذْكُورَةَ فِي الْكِتَابِ الْعَزِيزِ عَلَى الْجِمَاعِ وَلَمْ يرَ فِي الْقُبْلَةِ وُضُوءًا
[Machine] "And some people from the Arabs said, 'She is from the Jima (a tribe).' So, I mentioned that to Ibn Abbas, and he said, 'With which group were you?' I said, 'With the Mawali (another tribe).' He said, 'The Mawali were defeated. Indeed, touching and direct contact are from the Jima, but Allah honors whom He wills with whom He wills. And the saying of whoever agrees with his saying is closest to the apparent meaning of the book.'"
وَقَالَ أُنَاسٌ مِنَ الْعَرَبِ هِيَ مِنَ الْجِمَاعِ فَذَكَرْتُ ذَلِكَ لِابْنِ عَبَّاسٍ فَقَالَ مَعَ أَيِّهِمْ كُنْتَ؟ قُلْتُ مَعَ الْمَوَالِي قَالَ غُلِبَتِ الْمَوَالِي إِنَّ اللَّمْسَ وَالْمُبَاشَرَةَ مِنَ الْجِمَاعِ وَلَكِنَّ اللهَ ﷻ يُكَنِّي مَا شَاءَ بِمَا شَاءَ وَقَوْلُ مَنْ يُوَافِقُ قَوْلُهُ ظَاهِرُ الْكِتَابِ أَوْلَى
[Machine] He was sitting with the Prophet ﷺ when a man came to him and said, "O Messenger of Allah, may Allah bless you and grant you peace, what do you say about a man who has been afflicted by a woman who is not lawful for him, and he does not leave anything that the woman does not afflict him with, except that he does not have sexual intercourse with her?" The Prophet ﷺ said, "Perform ablution well, then stand and pray." Allah the Exalted then revealed this verse: "Establish prayer at the two ends of the day and at the approach of the night." The man asked, "Is this specific to him or is it for all Muslims in general?" The Prophet ﷺ replied, "Rather, it is for all Muslims in general, and similarly."
أَنَّهُ كَانَ قَاعِدًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَهُ رَجُلٌ وَقَالَ يَا رَسُولَ اللهِ صَلَّى الله عَلَيْكَ وَسَلَّمَ مَا تَقُولُ فِي رَجُلٍ أَصَابَ مِنِ امْرَأَةٍ لَا تَحِلُّ لَهُ فَلَمْ يَدَعْ شَيْئًا يُصِيبُهُ الرَّجُلُ مِنَ امْرَأَتِهِ إِلَّا وَقَدْ أَصَابَهُ مِنْهَا إِلَّا أَنَّهُ لَمْ يُجَامِعْهَا؟ فَقَالَ تَوَضَّأْ وُضُوءًا حَسَنًا ثُمَّ قُمْ فَصَلِّ قَالَ فَأَنْزَلَ اللهُ تَعَالَى هَذِهِ الْآيَةَ {أَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ} [هود 114] الْآيَةَ فَقَالَ أَهِيَ لَهُ خَاصَّةً أَمْ لِلْمُسْلِمِينَ عَامَّةً؟ فَقَالَ بَلْ هِيَ لِلْمُسْلِمِينَ عَامَّةً وَهَكَذَا
[Machine] The Prophet ﷺ kissed some of his wives, then he went out to prayer without performing ablution. Abu Bakr ibn al-Harith al-Faqih narrated to us, Ali ibn Umar al-Hafiz narrated to us, Abu Bakr al-Naysaburi narrated to us, Abdul Rahman ibn Bishr said: I heard Yahya ibn Sa'id mention the hadith of Al-A'mash from Habib from Urwah, he said: "As for Sufyan al-Thawri, he was the most knowledgeable of people regarding this matter. He claimed that Habib did not hear anything from Urwah." And Abu Bakr said: I am Ali, Muhammad ibn Makhled narrated to us, Saleh ibn Ahmad narrated to us, Ali ibn al-Madinah said: I heard Yahya mention the hadith of Al-A'mash from Habib from Urwah from Aisha, she prayed even if blood dropped on the mat and on the prayer direction. Yahya said: Take caution from me, as these two matters are similar. And Abu Ali al-Rudhbary narrated the hadith to us. I am Abu Bakr ibn Dasa, narrated to us Abu Dawood, narrated to us Ibrahim ibn Makhled al-Taalqani, narrated to us Abdul Rahman ibn Maghra, Al-A'mash narrated to us. Our companions informed us from Urwah al-Muzani, from Aisha, regarding this hadith. Abu Dawood said: It was reported from al-Thawri that he said, "Habib did not narrate from Urwah al-Zubair anything." The sheikh (narrator) said: So the hadith goes back to the narration of Urwah al-Muzani, and he is unknown.
أَنَّ النَّبِيَّ ﷺ قَبَّلَ بَعْضَ نِسَائِهِ ثُمَّ خَرَجَ إِلَى الصَّلَاةِ وَلَمْ يَتَوَضَّأْ وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ نا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ نا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ثنا عَبْدُ الرَّحْمَنِ بْنُ بِشْرٍ قَالَ سَمِعْتُ يَحْيَى بْنَ سَعِيدٍ وَذَكَرَ لَهُ حَدِيثَ الْأَعْمَشِ عَنْ حَبِيبٍ عَنْ عُرْوَةَ قَالَ أَمَا إِنَّ سُفْيَانَ الثَّوْرِيَّ كَانَ أَعْلَمَ النَّاسِ بِهَذَا زَعَمَ أَنَّ حَبِيبًا لَمْ يَسْمَعْ مِنْ عُرْوَةَ شَيْئًا 611 وَأَخْبَرَنَا أَبُو بَكْرٍ أَنَا عَلِيٌّ نا مُحَمَّدُ بْنُ مَخْلَدٍ نا صَالِحُ بْنُ أَحْمَدَ نا عَلِيُّ بْنُ الْمَدِينِيِّ قَالَ سَمِعْتُ يَحْيَى وَذَكَرَ عِنْدَهُ حَدِيثَا الْأَعْمَشِ عَنْ حَبِيبٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ تُصَلِّي وَإِنْ قَطَرَ الدَّمُ عَلَى الْحَصِيرِ وَفِي الْقُبْلَةِ قَالَ يَحْيَى احْكِ عَنِّي أَنَّهُمَا شِبْهُ لَا شَيْءَ وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ الْحَدِيثَ أنا أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا إِبْرَاهِيمُ بْنُ مَخْلَدٍ الطَّالْقَانِيُّ ثنا عَبْدُ الرَّحْمَنِ بْنُ مَغْرَاءَ نا الْأَعْمَشُ أَخْبَرَنَا أَصْحَابٌ لَنَا عَنْ عُرْوَةَ الْمُزَنِيِّ عَنْ عَائِشَةَ بِهَذَا الْحَدِيثِ قَالَ أَبُو دَاودَ رُوِيَ عَنِ الثَّوْرِيِّ أَنَّهُ قَالَ مَا حَدَّثَنَا حَبِيبٌ إِلَّا عَنْ عُرْوَةَ الْمُزَنِيِّ يَعْنِي لَمْ يُحَدِّثْهُمْ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ بِشَيْءٍ قَالَ الشَّيْخُ فَعَادَ الْحَدِيثُ إِلَى رِوَايَةِ عُرْوَةَ الْمُزَنِيِّ وَهُوَ مَجْهُولٌ
[Machine] The Prophet ﷺ used to perform ablution (wudu) and then he would not repeat the ablution. It is narrated that Ibrahim al-Taymi said that he did not hear this from Aisha. Abu Dawood al-Sijistani and others said that this hadith is weak, weakened by Yahya ibn Ma'in and others. Abu Hanifa narrated it from Abu Rawq from Ibrahim from Hafsah, but Ibrahim did not hear it from Aisha or Hafsah. Al-Daraqutni and others narrated it, and we have also narrated all that has been narrated on this topic and explained its weakness in Khilafiyat and authentic Hadith about the kissing of the fasting person. If its chain of narration is correct, then we would say, "If Allah wills.""

1.146 Section
١۔١٤٦ بَابُ مَا جَاءَ فِي لَمْسِ الصِّغَارِ وَذَوَاتِ الْمَحَارِمِ
We were sitting in the mosque when the Messenger of Allah ﷺ came upon us carrying Umamah daughter of Abul'As ibn ar-Rabi'. Her mother was Zaynab daughter of the Messenger of Allah ﷺ. She (Umamah) was a child and he (the Prophet) was carrying her on his shoulder. The Messenger of Allah ﷺ led (the people) in prayer while she was on his shoulder. When he bowed he put her down and took her up when he got up. He kept on doing so until he finished his prayer. (Using translation from Abū Dāʾūd 918)
أَنَّهُ سَمِعَ أَبَا قَتَادَةَ يَقُولُ بَيْنَا نَحْنُ فِي الْمَسْجِدِ جُلُوسٌ خَرَجَ عَلَيْنَا رَسُولُ اللهِ ﷺ يَحْمِلُ أُمَامَةَ بِنْتَ أَبِي الْعَاصِ بْنِ الرَّبِيعِ وَأُمُّهَا زَيْنَبُ بِنْتُ رَسُولِ اللهِ ﷺ وَهِيَ صَبِيَّةٌ يَحْمِلُهَا عَلَى عَاتِقِهِ فَصَلَّى رَسُولُ اللهِ ﷺ وَهِيَ عَلَى عَاتِقِهِ يَضَعُهَا إِذَا رَكَعَ وَيُعِيدُهَا إِذَا قَامَ حَتَّى قَضَى صَلَاتَهُ يَفْعَلُ ذَلِكَ بِهَا

١۔١٤٧ بَابُ مَا جَاءَ فِي الْمَلْمُوسِ
[Machine] I lost the Messenger of Allah ﷺ one night, so I tried to find him with my hands. My hand fell on his feet while he was in prostration and he was saying, "O Allah, I seek refuge in Your forgiveness from Your punishment and I seek refuge in Your pleasure from Your wrath. I seek refuge in You from You, I cannot praise You enough. You are as You have praised Yourself."
فَقَدْتُ رَسُولَ اللهِ ﷺ ذَاتَ لَيْلَةٍ فَالْتَمَسْتُهُ بِيَدِي فَوَقَعَتْ يَدِي عَلَى قَدَمَيْهِ وَهُمَا مَنْصُوبَتَانِ وَهُوَ سَاجِدٌ وَهُوَ يَقُولُ اللهُمَّ إِنِّي أَعُوذُ بِمُعَافَاتِكَ مِنْ عُقُوبَتِكَ وَأَعُوذُ بِرِضَاكَ مِنْ سَخَطِكَ وَأَعُوذُ بِكَ مِنْكَ لَا أُحْصِي ثَنَاءً عَلَيْكَ أَنْتَ كَمَا أَثْنَيْتَ عَلَى نَفْسِكَ
1.148 [Machine] What a man communicates to his wife through an implied message without desire or hidden barrier
١۔١٤٨ بَابُ مَا جَاءَ فِي غَمْزِ الرَّجُلِ امْرَأَتَهُ مِنْ غَيْرِ شَهْوَةٍ أَوْ مِنْ وَرَاءِ حَائِلٍ
[Machine] "How horrible is what you have done to us with the dog and the donkey. I saw myself and the Messenger of Allah ﷺ praying while I was lying between him and the Qibla. Then when he wanted to prostrate, he nudged my legs and I folded them. This is the narration of 'Amr. And in the narration of Al-Muqaddami, I saw the Messenger of Allah ﷺ praying while I was sitting, and when he wanted to prostrate, he nudged me and I folded my legs."
بِئْسَ مَا عَدَلْتُمُونَا بِالْكَلْبِ وَالْحِمَارِ لَقَدْ رَأَيْتُنِي وَرَسُولُ اللهِ ﷺ يُصَلِّي وَأَنَا مُضْطَجِعَةٌ بَيْنَهُ وَبَيْنَ الْقِبْلَةِ فَإِذَا أَرَادَ أَنْ يَسْجُدَ غَمَزَ رِجْلِيَّ فَقَبَضْتُهُمَا لَفْظُ حَدِيثِ عَمْرٍو وَفِي حَدِيثِ الْمُقَدَّمِيِّ لَقَدْ رَأَيْتُ رَسُولَ اللهِ ﷺ يُصَلِّي وَأَنَا مُعْتَرِضَةٌ فَإِذَا أَرَادَ أَنْ يَسْجُدَ غَمَزَنِي فَقَبَضْتُ رِجْلِيَّ
1.149 [Machine] Wudu from touching the private parts
١۔١٤٩ بَابُ الْوُضُوءِ مِنْ مَسِّ الذِّكْرِ
[Machine] She mentioned hearing the Messenger of Allah, may ﷺ , say: "When one of you wakes up, he should perform ablution." Yahya bin Bukayr narrated it from Malik and added: "And he should perform ablution for prayer." Abu Ahmad al-Miharjani informed us, Abu Bakr bin Ja'far al-Muzakki told us, Muhammad bin Ibrahim al-Abdi told us, Ibn Bukayr narrated it from Malik, and mentioned it.
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا مَسَّ أَحَدُكُمْ ذَكَرَهُ فَلْيَتَوَضَّأْ 617 وَرَوَاهُ يَحْيَى بْنُ بُكَيْرٍ عَنْ مَالِكٍ وَزَادَ فِيهِ فَلْيَتَوَضَّأْ وُضُوءَهُ لِلصَّلَاةِ أَخْبَرَنَاهُ أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنا أَبُو بَكْرِ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْعَبْدِيُّ ثنا ابْنُ بُكَيْرٍ ثَنَاهُ مَالِكٌ فَذَكَرَهُ
[Machine] The Prophet's ﷺ company was such that the Messenger of Allah ﷺ said, "If any of you touches his private parts, he should not pray until he performs ablution, and likewise."
وَقَدْ كَانَتْ صَحِبَتِ النَّبِيَّ ﷺ أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا مَسَّ أَحَدُكُمْ ذَكَرَهُ فَلَا يُصَلِّيَنَّ حَتَّى يَتَوَضَّأَ وَهَكَذَا
"When he was the governor of Al-Madinah, Marwan mentioned that a man should perform Wudu' after touching his penis, if he touches it iwth his hand. I did not like that and I said: 'The one who touches it does not have to perform Wudu'.' Marwan said: 'Busrah bint Safwan told me that she heard the Messenger of Allah ﷺ mention the things for which Wudu' should be performed, and the Messenger of Allah ﷺ said: 'Wudu' should be performed after touching the penis.' 'Urwah said: 'I continued to argue with Marwan until he called one of his guards and sent him to Busrah to ask her about what Marwan had narrated, and Busrah sent word saying something like that which Marwan had narrated to me from her." أَنَّهُ يَتَوَضَّأُ مِنْ مَسِّ الذَّكَرِ إِذَا أَفْضَى إِلَيْهِ الرَّجُلُ بِيَدِهِ فَأَنْكَرْتُ ذَلِكَ وَقُلْتُ لَا وُضُوءَ عَلَى مَنْ مَسَّهُ فَقَالَ مَرْوَانُ أَخْبَرَتْنِي بُسْرَةُ بِنْتُ صَفْوَانَ أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَذْكُرُ مَا يُتَوَضَّأُ مِنْهُ فَقَالَ رَسُولُ اللهِ ﷺ وَيُتَوَضَّأُ مِنْ مَسِّ الذَّكَرِ فَقَالَ عُرْوَةُ فَلَمْ أَزَلْ أُمَارِي مَرْوَانَ حَتَّى دَعَا رَجُلًا مِنْ حَرَسِهِ فَأَرْسَلَهُ إِلَى بُسْرَةَ لِيَسْأَلَهَا عَمَّا حَدَّثَتْ مِنْ ذَلِكَ فَأَرْسَلَتْ إِلَيْهِ بُسْرَةُ بِمِثْلِ الَّذِي حَدَّثَنِي عَنْهَا مَرْوَانُ
[Machine] From Busrah bint Safwan, who was the companion of the Prophet ﷺ, it was narrated that the Prophet ﷺ said: "If one of you touches his private part, he should not pray until he performs ablution." Yahya bin Sa'id Al-Qattan narrated it from Hisham, from his father, from Busrah. Hisham also mentioned hearing it from his father. As for his father hearing it from Busrah and narrating it to him, it happened after Marwan had heard it.
عَنْ بُسْرَةَ بِنْتِ صَفْوَانَ وَكَانَتْ صَحِبَتِ النَّبِيَّ ﷺ أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا مَسَّ أَحَدُكُمْ ذَكَرَهُ فَلَا يُصَلِّيَنَّ حَتَّى يَتَوَضَّأَ وَرَوَاهُ يَحْيَى بْنُ سَعِيدٍ الْقَطَّانُ عَنْ هِشَامٍ عَنْ أَبِيهِ عَنْ بُسْرَةَ وَذَكَرَ سَمَاعَ هِشَامٍ عَنْ أَبِيهِ وَأَمَّا سَمَاعُ أَبِيهِ عَنْ بُسْرَةَ وَمُشَافَهَتُهَا إِيَّاهُ بِالْحَدِيثِ بَعْدَ سَمَاعِهِ مِنْ مَرْوَانَ
[Machine] The Messenger of Allah ﷺ said, "Whoever touches his private parts should perform ablution." Urwah narrated, "So I asked Busrah, and she confirmed it."
قَالَ رَسُولُ اللهِ ﷺ مَنْ مَسَّ ذَكَرَهُ فَلْيَتَوَضَّأْ قَالَ عُرْوَةُ فَسَأَلْتُ بُسْرَةَ فَصَدَّقَتْهُ
[Machine] She said: The Messenger of Allah ﷺ said, "Whoever touches his private parts should not pray until he performs ablution." I went to Busrah and she narrated to me the same hadith that Marwan narrated to me from her, that she heard the Prophet ﷺ saying so.
أَنَّهَا قَالَتْ قَالَ رَسُولُ اللهِ ﷺ مَنْ مَسَّ فَرْجَهُ فَلَا يُصَلِّيَنَّ حَتَّى يَتَوَضَّأَ قَالَ فَأَتَيْتُ بُسْرَةَ فَحَدَّثَتْنِي كَمَا حَدَّثَنِي مَرْوَانُ عَنْهَا أَنَّهَا سَمِعَتِ النَّبِيَّ ﷺ يَقُولُ ذَلِكَ
[Machine] On the authority of Busrah bint Safwan, who had accompanied the Prophet ﷺ, that the Prophet ﷺ said: "When one of you touches his private part, he should not pray until he performs ablution." Urwah objected to this and asked Busrah about it, and she confirmed what he said. Abu Bakr ibn al-Harith al-Faqih and Abu Abdur Rahman as-Sulami informed us that they are Abu al-Hasan Ali ibn Umar al-Hafiz. Abdullah ibn Muhammad ibn Abdul Aziz narrated to us that al-Hakam ibn Musa narrated to us from Shuayb ibn Ishaq, who mentioned the hadith with a similar chain of narration. Ali ibn Umar al-Hafiz followed it by narrating from Rabee'ah ibn Othman and Mundhir ibn Abdullah, and Anbasah ibn Abdul Wahid, and Humeid ibn al-Aswad, who all narrated it from Hisham, from his father, from Marwan, from Busrah, who said: "Urwah objected to this, so I asked Busrah about it again, and she confirmed what he said."
عَنْ بُسْرَةَ بِنْتَ صَفْوَانَ وَكَانَتْ قَدْ صَحِبَتِ النَّبِيَّ ﷺ أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا مَسَّ أَحَدُكُمْ ذَكَرَهُ فَلَا يُصَلِّيَنَّ حَتَّى يَتَوَضَّأَ قَالَ فَأَنْكَرَ ذَلِكَ عُرْوَةُ فَسَأَلَ بُسْرَةَ فَصَدَّقَتْهُ بِمَا قَالَ 624 وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ وَأَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ قَالَا أنا أَبُو الْحَسَنِ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ثنا الْحَكَمُ بْنُ مُوسَى ثنا شُعَيْبُ بْنُ إِسْحَاقَ فَذَكَرَ الْحَدِيثَ بِإِسْنَادِهِ نَحْوَهُ قَالَ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ تَابَعَهُ رَبِيعَةُ بْنُ عُثْمَانَ وَالْمُنْذِرُ بْنُ عَبْدِ اللهِ وَعَنْبَسَةُ بْنُ عَبْدِ الْوَاحِدِ وَحُمَيْدُ بْنُ الْأَسْوَدِ فَرَوَوْهُ عَنْ هِشَامٍ عَنْ أَبِيهِ عَنْ مَرْوَانَ عَنْ بُسْرَةَ قَالَ عُرْوَةُ فَسَأَلْتُ بُسْرَةَ بَعْدَ ذَلِكَ فَصَدَّقَتْهُ
[Machine] Narrated Busrah bint Safwan, who was a companion of the Prophet Muhammad ﷺ : The Prophet ﷺ said, "If one of you touches their private parts, then they should not perform prayer until they perform ablution." Urwah denounced this and asked Busrah about it, and she confirmed it. Abu Abdullah al-Hafiz informed us that my father, Muhammad ibn Ishaq ibn Khuzaymah, said, "Al-Shafi'i regarded ablution as obligatory after touching one's private parts, based on the narration of Busrah bint Safwan, without any analogy. And I say the same as al-Shafi'i, because Urwah heard the hadith of Busrah from her." The Shaykh (Muhammad ibn Idris al-Shafi'i) also mentioned that she was Busrah bint Safwan ibn Nawfal ibn Asad from the Mubayi'at tribe, and Waraqah ibn Nawfal was her maternal uncle. She was the wife of Mu'awiyah ibn Al-Mugheerah ibn Abi al-As. This was narrated by Mus'ab al-Zubairi, and she was the grandmother of Abd al-Malik ibn Marwan, the mother of his mother. This was narrated by Malik ibn Anas.
عَنْ بُسْرَةَ بِنْتِ صَفْوَانَ وَقَدْ كَانَتْ صَحِبَتِ النَّبِيَّ ﷺ أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا مَسَّ أَحَدُكُمْ ذَكَرَهُ فَلَا يُصَلِّيَنَّ حَتَّى يَتَوَضَّأَ فَأَنْكَرَ ذَلِكَ عُرْوَةُ وَسَأَلَ بُسْرَةَ فَصَدَّقَتْهُ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبِي نا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ قَالَ كَانَ الشَّافِعِيُّ يُوجِبُ الْوُضُوءَ مِنْ مَسِّ الذَّكَرِ اتِّبَاعًا لِخَبَرِ بُسْرَةَ بِنْتِ صَفْوَانَ لَا قِيَاسًا وَبِقَوْلِ الشَّافِعِيِّ أَقُولُ؛ لِأَنَّ عُرْوَةَ قَدْ سَمِعَ حَدِيثَ بُسْرَةَ مِنْهَا قَالَ الشَّيْخُ وَبُسْرَةُ بِنْتُ صَفْوَانَ بْنِ نَوْفَلِ بْنِ أَسَدٍ مِنَ الْمُبَايِعَاتِ وَوَرَقَةُ بْنُ نَوْفَلٍ عَمُّهَا وَهِيَ زَوْجَةُ مُعَاوِيَةَ بْنِ الْمُغِيرَةِ بْنِ أَبِي الْعَاصِ قَالَهُ مُصْعَبٌ الزُّبَيْرِيُّ وَهِيَ جَدَّةُ عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ أُمُّ أُمِّهِ قَالَهُ مَالِكُ بْنُ أَنَسٍ
[Machine] Um Habiba, the wife of the Prophet ﷺ , narrated: "I heard the Messenger of Allah ﷺ saying, 'Whoever touches his private parts, let him perform ablution.' " Abu Abdullah Al-Hafiz informed us, and he said: Abu Muhammad Abdur Rahman ibn Hamdan Al-Jallab informed us, quoting Abu Hatim Ar-Razi, quoting Abu Mus'hir Abd Al-A'la ibn Mus'hir, who said: Al-Haytham ibn Humaid mentioned it to me in a similar manner. It was also relayed to me by Abu Isa At-Tirmidhi who said: "I asked Abu Zur'ah about the hadith of Um Habiba, and he approved of it, and I saw him regarding it as authentic."
عَنْ أُمِّ حَبِيبَةَ زَوْجِ النَّبِيِّ ﷺ قَالَتْ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ مَسَّ فَرْجَهُ فَلْيَتَوَضَّأْ وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو مُحَمَّدٍ عَبْدُ الرَّحْمَنِ بْنُ حَمْدَانَ الْجَلَّابُ ثنا أَبُو حَاتِمٍ الرَّازِيُّ ثنا أَبُو مُسْهِرٍ عَبْدُ الْأَعْلَى بْنُ مُسْهِرٍ نا الْهَيْثَمُ بْنُ حُمَيْدٍ فَذَكَرَهُ بِنَحْوِهِ وَبَلَغَنِي عَنْ أَبِي عِيسَى التِّرْمِذِيِّ قَالَ سَأَلْتُ أَبَا زُرْعَةَ عَنْ حَدِيثِ أُمِّ حَبِيبَةَ فَاسْتَحْسَنَهُ وَرَأَيْتُهُ كَانَ يَعُدُّهُ مَحْفُوظًا
[Machine] That the Messenger of Allah ﷺ said: "Whoever touches his private parts, then he must perform ablution."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ مَسَّ ذَكَرَهُ فَعَلَيْهِ الْوُضُوءُ
[Machine] He used to say: "If a man touches his private parts, then it is obligatory for him to perform ablution."
أَنَّهُ كَانَ يَقُولُ إِذَا مَسَّ الرَّجُلُ ذَكَرَهُ فَقَدْ وَجَبَ عَلَيْهِ الْوُضُوءُ
[Machine] Yes, but sometimes I remember yesterday so I perform ablution.
بَلَى وَلَكِنِّي أَحْيَانًا أَمَسُّ ذَكَرِي فَأَتَوَضَّأُ
[Machine] When the sun rose, he performed ablution and prayed. I said to him, "This is a prayer that you didn't used to pray before." He replied, "After I performed ablution for the morning prayer, I touched my private parts and then forgot to perform ablution, so I performed ablution again and then returned to my prayer."
أَنْ طَلَعَتِ الشَّمْسُ تَوَضَّأَ ثُمَّ صَلَّى فَقُلْتُ لَهُ إِنَّ هَذِهِ صَلَاةٌ مَا كُنْتَ تُصَلِّيهَا فَقَالَ أَبِي بَعْدَ أَنْ تَوَضَّأْتُ لِصَلَاةِ الصُّبْحِ مَسَسْتُ ذَكَرِي ثُمَّ نَسِيتُ أَنْ أَتَوَضَّأَ فَتَوَضَّأْتُ ثُمَّ عُدْتُ لِصَلَاتِي
[Machine] He used to say, "Whoever touches his private parts, then it is obligatory for him to perform ablution." We were informed about that from Aisha and Abu Hurairah, and Al-Shafi'i reported it in his book Al-Qadim from Muslim and Sa'eed from Ibn Juraij from Ibn Abi Mulaykah that Umar ibn Al-Khattab, while leading the people in prayer, made a mistake and touched his private parts. He then signaled to the people to stay and left. He performed ablution and then returned to complete the remaining prayer with them.
أَنَّهُ كَانَ يَقُولُ مَنْ مَسَّ ذَكَرَهُ فَقَدْ وَجَبَ عَلَيْهِ الْوُضُوءُ وَرُوِّينَا فِي ذَلِكَ عَنْ عَائِشَةَ وَأَبِي هُرَيْرَةَ وَرَوَى الشَّافِعِيُّ فِي كِتَابِ الْقَدِيمِ عَنْ مُسْلِمٍ وَسَعِيدٍ عَنِ ابْنِ جُرَيْجٍ عَنِ ابْنِ أَبِي مُلَيْكَةَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ بَيْنَا هُوَ يَؤُمُّ النَّاسَ إِذْ زَلَّتْ يَدُهُ عَلَى ذَكَرِهِ فَأَشَارَ إِلَى النَّاسِ أَنِ امْكُثُوا ثُمَّ خَرَجَ فَتَوَضَّأَ ثُمَّ رَجَعَ فَأَتَمَّ بِهِمْ مَا بَقِيَ مِنَ الصَّلَاةِ

1.150 [Machine] Performing ablution from a woman's vaginal discharge
١۔١٥٠ بَابُ الْوُضُوءِ مِنْ مَسِّ الْمَرْأَةِ فَرْجَهَا
[Machine] I heard the Messenger of Allah ﷺ ordering the performance of ablution from touching the private parts and likewise for women. Abu Ahmad ibn 'Adiy said: "And this hadith with this addition in its text, 'and likewise for women', is not narrated by anyone from Az-Zuhri except Ibn Namir." This is what the sheikh said, and likewise.
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَأْمُرُ بِالْوُضُوءِ مِنْ مَسِّ الذِّكْرِ وَالْمَرْأَةُ مِثْلُ ذَلِكَ قَالَ أَبُو أَحْمَدَ بْنُ عَدِيٍّ وَهَذَا الْحَدِيثُ بِهَذِهِ الزِّيَادَةِ فِي مَتْنِهِ وَالْمَرْأَةُ مِثْلُ ذَلِكَ لَا يَرْوِيهِ عَنِ الزُّهْرِيِّ غَيْرَ ابْنِ نَمِرٍ هَذَا قَالَ الشَّيْخُ وَكَذَلِكَ
"When he was the governor of Al-Madinah, Marwan mentioned that a man should perform Wudu' after touching his penis, if he touches it iwth his hand. I did not like that and I said: 'The one who touches it does not have to perform Wudu'.' Marwan said: 'Busrah bint Safwan told me that she heard the Messenger of Allah ﷺ mention the things for which Wudu' should be performed, and the Messenger of Allah ﷺ said: 'Wudu' should be performed after touching the penis.' 'Urwah said: 'I continued to argue with Marwan until he called one of his guards and sent him to Busrah to ask her about what Marwan had narrated, and Busrah sent word saying something like that which Marwan had narrated to me from her." أَنَّهُ يَتَوَضَّأُ مَنْ مَسِّ الذِّكْرِ إِذَا أَفْضَى إِلَيْهِ بِيَدِهِ فَأَنْكَرْتُ ذَلِكَ وَقُلْتُ لَا وُضُوءَ عَلَى مَنْ مَسَّهُ فَقَالَ مَرْوَانُ بَلَى أَخْبَرَتْنِي بُسْرَةُ بِنْتُ صَفْوَانَ أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَذْكُرُ مَا يُتَوَضَّأُ مِنْهُ فَقَالَ رَسُولُ اللهِ ﷺ وَيُتَوَضَّأُ مَنْ مَسَّ الذِّكْرِ فَقَالَ عُرْوَةُ فَلَمْ أَزَلْ أُمَارِي مَرْوَانَ حَتَّى دَعَا رَجُلًا مِنْ حَرَسِهِ فَأَرْسَلَهُ إِلَى بُسْرَةَ يَسْأَلُهَا عَمَّا حَدَّثَتْهُ مِنْ ذَلِكَ فَأَرْسَلَتِ إِلَيْهِ بُسْرَةُ بِمِثْلِ مَا حَدَّثَنِي عَنْهَا مَرْوَانُ هَذَا هُوَ الصَّحِيحُ مِنْ حَدِيثِ الزُّهْرِيِّ
[Machine] That the Messenger of Allah ﷺ said: "When one of you wants to satisfy his desire with his hand, then let him perform wudu." He said: "And the same applies to women." This statement indicates that his saying "he said: and the women like likewise" is part of the statement of Az-Zuhri. And one of the things that indicates this is that all other narrators reported it from Az-Zuhri except for this addition. And it has been narrated in the hadith of Isma'il ibn 'Ayyash from Hisham ibn 'Urwah from his father, but it is not preserved.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا أَفْضَى أَحَدُكُمْ بِيَدِهِ إِلَى فَرْجِهِ فَلْيَتَوَضَّأْ قَالَ وَالْمَرْأَةُ كَذَلِكَ ظَاهَرُ هَذَا يَدُلُّ عَلَى أَنَّ قَوْلَهُ قَالَ وَالْمَرْأَةُ مِثْلُ ذَلِكَ مِنْ قَوْلِ الزُّهْرِيِّ وَمِمَّا يَدُلُّ عَلَيْهِ أَنَّ سَائِرَ الرُّوَاةِ رَوَوْهُ عَنِ الزُّهْرِيِّ دُونَ هَذِهِ الزِّيَادَةِ وَرُوِيَ ذَلِكَ فِي حَدِيثِ إِسْمَاعِيلَ بْنِ عَيَّاشٍ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ وَلَيْسَ بِمَحْفُوظٍ
[Machine] The Messenger of Allah ﷺ said: "Whoever touches his private parts, let him perform ablution, and whoever touches her private parts, let her perform ablution." It was narrated by Ishaq al-Hanzhali from Baqiyah from Al-Zubaidi and Muhammad ibn Al-Walid Al-Zubaidi, who are trustworthy. And it is narrated in this way.
قَالَ رَسُولُ اللهِ ﷺ أَيُّمَا رَجُلٍ مَسَّ فَرْجَهُ فَلْيَتَوَضَّأْ وَأَيُّمَا امْرَأَةٍ مَسَّتْ فَرْجَهَا فَلْتَتَوَضَّأْ وَرَوَاهُ إِسْحَاقُ الْحَنْظَلِيُّ عَنْ بَقِيَّةَ عَنْ الزُّبَيْدِيِّ وَمُحَمَّدُ بْنُ الْوَلِيدِ الزُّبَيْدِيُّ ثِقَةٌ وَهَكَذَا
[Machine] She said: "O Messenger of Allah, what do you think about one of us touching her private part while a man touches his penis after performing ablution?" The Messenger of Allah ﷺ said to her: "Perform ablution, O Busrah bint Safwan." 'Amr narrated to me that Sa'id ibn al-Musayyib said that Marwan sent for her to ask her about this matter, and she said: "Let me ask the Messenger of Allah ﷺ about it. He was present with Fulan and Fulan and Abdullah ibn 'Umar, and he commanded me to perform ablution."
أَنَّهَا قَالَتْ يَا رَسُولَ اللهِ كَيْفَ تَرَى فِي أَحَدِنَا تَمَسُّ فَرْجَهَا وَالرَّجُلُ يَمَسُّ ذَكَرَهُ بَعْدَمَا يَتَوَضَّأُ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ تَتَوَضَّأُ يَا بُسْرَةُ بِنْتُ صَفْوَانَ قَالَ عَمْرٌو وَحَدَّثَنِي سَعِيدُ بْنُ الْمُسَيِّبِ أَنَّ مَرْوَانَ أَرْسَلَ إِلَيْهَا لِيَسْأَلَهَا فَقَالَتْ دَعْنِي سَأَلْتُ رَسُولَ اللهِ ﷺ وَعِنْدَهُ فُلَانٌ وَفُلَانٌ وَعَبْدُ اللهِ بْنُ عُمَرَ فَأَمَرَنِي بِالْوُضُوءِ
[Machine] If a woman touches her private part, she should perform ablution. And so on.
إِذَا مَسَّتِ الْمَرْأَةُ فَرْجَهَا تَوَضَّأَتْ وَهَكَذَا
1.151 [Machine] Leaving ablution from touching the genital area on the back of the hand
١۔١٥١ بَابُ تَرَكِ الْوُضُوءِ مِنْ مَسِّ الْفَرَجِ بِظَهْرِ الْكَفِّ
[Machine] The Messenger of Allah ﷺ said, "Whoever reaches with his hand towards his private parts, there is no veil between his hand and the private parts. Therefore, it becomes obligatory for him to perform ablution for prayer, and so on."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَفْضَى بِيَدِهِ إِلَى فَرْجِهِ لَيْسَ دُونَهَا حِجَابٌ فَقَدْ وَجَبَ عَلَيْهِ وُضُوءُ الصَّلَاةِ وَهَكَذَا
[Machine] "From Abu Huraira, whoever puts his hand on his private parts, then let him perform ablution."
عَنْ أَبِي هُرَيْرَةَ مَنْ أَفْضَى بِيَدِهِ إِلَى فَرْجِهِ فَلْيَتَوَضَّأْ هَكَذَا مَوْقُوفٌ وَقِيلَ عَنْ جَمِيلٍ عَنْ أَبِي وَهْبٍ عَنْ أَبِي هُرَيْرَةَ
[Machine] Whoever touches their private parts should perform ablution, and if they only touch them from the outside of their clothing, then wudu is not required for them.
مَنْ مَسَّ فَرْجَهُ فَلْيَتَوَضَّأْ وَمَنْ مَسَّهُ يَعْنِي مِنْ وَرَاءِ الثَّوْبِ فَلَيْسَ عَلَيْهِ وُضُوءٌ
[Machine] The Messenger of Allah ﷺ said, "When one of you finishes relieving himself, he should perform ablution." Ibn Naafi' added that Muhammad ibn Abdul Rahman ibn Thawban narrated this from Jaabir, who heard it from the Prophet ﷺ . Ash-Shafi'i, may Allah have mercy on him, said, "I have heard more than one of the scholars mention this narration without mentioning Jaabir's name." Abu Saeed also added in his narration, "Ash-Shafi'i said that relieving oneself with the hand refers to wiping it on the stomach, just as it is said to relieve oneself with the hand in terms of pledging allegiance, or to relieve oneself with the hand to prostrate to the ground, or to relieve oneself with the hand while kneeling on the knees."
قَالَ رَسُولُ اللهِ ﷺ إِذَا أَفْضَى أَحَدُكُمْ بِيَدِهِ إِلَى ذَكَرِهِ فَلْيَتَوَضَّأْ وَزَادَ ابْنُ نَافِعٍ فَقَالَ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ عَنْ جَابِرٍ عَنِ النَّبِيِّ ﷺ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ تَعَالَى وَسَمِعْتُ غَيْرَ وَاحِدٍ مِنَ الْحُفَّاظِ يَرْوُونَهُ لَا يَذْكُرُونَ فِيهِ جَابِرًا وَزَادَ أَبُو سَعِيدٍ فِي حَدِيثِهِ قَالَ الشَّافِعِيُّ وَالْإِفْضَاءُ بِالْيَدِ إِنَّمَا هُوَ بِبَطْنِهَا كَمَا يُقَالُ أَفْضَى بِيَدِهِ مَبَايِعًا وَأَفْضَى بِيَدِهِ إِلَى الْأَرْضِ سَاجِدًا وَإِلَى رُكْبَتَيْهِ رَاكِعًا
[Machine] We went out to the Prophet ﷺ with a delegation until we reached him, so we pledged allegiance to him and prayed with him. Then a man came who appeared to be a Bedouin and said, "O Messenger of Allah, what do you think about the man's hair in his body after he performs ablution?" He replied, "Is it not just a few hairs or a morsel from you? This is a hadith."
خَرَجْنَا إِلَى نَبِيِّ اللهِ ﷺ وَفْدًا حَتَّى قَدِمْنَا عَلَيْهِ فَبَايَعْنَاهُ وَصَلَّيْنَا مَعَهُ فَجَاءَ رَجُلٌ كَأَنَّهُ بَدَوِيٌّ فَقَالَ يَا رَسُولَ اللهِ مَا تَرَى فِي مَسِّ الرَّجُلِ ذَكَرَهُ بَعْدَمَا يَتَوَضَّأُ؟ فَقَالَ وَهَلْ هُوَ إِلَّا بَضْعَةٌ أَوْ مُضْغَةٌ مِنْكَ فَهَذَا حَدِيثٌ
[Machine] I arrived at the Prophet while he was building the mosque. He told me to mix the clay, for I was more knowledgeable in its mixture. So, I asked him, or a man asked him, "Do you see a man who performs ablution and then touches his private parts?" He said, "It is from you, and some of our companions have carried it on his hand to his private parts."
قَدِمْتُ عَلَى النَّبِيِّ ﷺ وَهُوَ يَبْنِي الْمَسْجِدَ فَقَالَ اخْلِطِ الطِّينَ فَإِنَّكَ أَعْلَمُ بِخَلْطِهِ فَسَأَلْتُهُ أَوْ سَأَلَهُ رَجُلٌ فَقَالَ أَرَأَيْتَ الرَّجُلَ يَتَوَضَّأُ ثُمَّ يَمَسُّ ذَكَرَهُ؟ فَقَالَ إِنَّمَا هُوَ مِنْكَ ثُمَّ قَدْ حَمَلَهُ بَعْضُ أَصْحَابِنَا عَلَى مَسِّهِ إِيَّاهُ بِظَهْرِ كَفِّهِ
[Machine] He asked the Prophet ﷺ or heard a man asking him. He said, "While I was praying, I scratched my thigh and my finger touched my private part." The Prophet ﷺ said, "It is only a part of you and what is apparent is the condition of the one who scratches his thigh, and his hand touched his private part that only the back of his hand would be affected. And Allah knows best."
أَنَّهُ سَأَلَ النَّبِيَّ ﷺ أَوْ سَمِعَ رَجُلًا يَسْأَلُهُ فَقَالَ بَيْنَمَا أَنَا أُصَلِّي فَذَهَبْتُ أَحُكُّ فَخِذِي فَأَصَابَتْ يَدِي ذَكَرِي فَقَالَ النَّبِيُّ ﷺ إِنَّمَا هُوَ مِنْكَ وَالظَّاهِرُ مِنْ حَالِ مَنْ يَحُكُّ فَخِذَهُ وَأَصَابَتْ يَدُهُ ذَكَرَهُ أَنَّهُ إِنَّمَا يُصِيبُهُ بِظَهْرِ كَفِّهِ وَاللهُ أَعْلَمُ
[Machine] Yahya then did not convince Uruwah of that until he came to Busrah, so he asked her and she narrated to him the story. Then Yahya said, "Indeed, people have differed regarding Qais ibn Talq and it is not sufficient to rely on his narration." Ahmad ibn Hanbal said, "Both of you are correct in what you have said." Yahya asked, "Who narrated this?" He said, "It is narrated by Sufyan from Abu Qais from Huzayl from Abdullah." And when Ibn Mas'ood and Ibn Umar gathered and differed, Ibn Mas'ood was more deserving to be followed. Ahmad ibn Hanbal said to him, "Yes, but Abu Qais al-Awdi cannot be relied upon in his narration." Ali said, "Abu Nuaim narrated to me from Mesar from Umair bin Said from Ammar, he said, 'I do not care if it touched my hand or my nose.'" Yahya said, "Between Umair bin Said and Ammar bin Yasir is a serious contradiction." Abu Bakr ibn al-Harith al-Faqih informed us, Ali ibn Omar al-Hafiz informed us, Muhammad ibn al-Hasan al-Naqqash informed us, Abdullah ibn Yahya al-Qadi al-Sarakhsi mentioned it with its chain and some of its meanings. And he said in the end, in the narration of Umair bin Said from Ammar, Ahmed said, "Ammar and Ibn Umar are equal, so whoever wishes can take this, and whoever wishes can take that." The Sheikh said, "We have narrated from Ali ibn al-Madini that he said about the narration of Busrah, the hearing of Uruwah from it, as Yahya bin Ma'een said, and it seems that he returned in that to the statement of Yahya and the adoption of the narration of Busrah."
يَحْيَى ثُمَّ لَمْ يُقْنِعْ ذَلِكَ عُرْوَةَ حَتَّى أَتَى بُسْرَةَ فَسَأَلَهَا وَشَافَهَتْهُ بِالْحَدِيثِ ثُمَّ قَالَ يَحْيَى وَلَقَدْ أَكْثَرَ النَّاسُ فِي قَيْسِ بْنِ طَلْقٍ وَأَنَّهُ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ أَحْمَدُ بْنُ حَنْبَلٍ كِلَا الْأَمْرَيْنِ عَلَى مَا قُلْتُمَا فَقَالَ يَحْيَى عَنْ مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ يُتَوَضَّأُ مِنْ مَسِّ الذَّكَرِ فَقَالَ عَلِيٌّ كَانَ ابْنُ مَسْعُودٍ يَقُولُ لَا يُتَوَضَّأُ مِنْهُ وَإِنَّمَا هُوَ بَضْعَةٌ مِنْ جَسَدِكَ قَالَ فَقَالَ يَحْيَى هَذَا عَمَّنْ؟ فَقَالَ عَنْ سُفْيَانَ عَنْ أَبِي قَيْسٍ عَنْ هُزَيْلٍ عَنْ عَبْدِ اللهِ وَإِذَا اجْتَمَعَ ابْنُ مَسْعُودٍ وَابْنُ عُمَرَ وَاخْتَلَفَا فَابْنُ مَسْعُودٍ أَوْلَى أَنْ يُتَّبَعَ فَقَالَ لَهُ أَحْمَدُ بْنُ حَنْبَلٍ نَعَمْ وَلَكِنَّ أَبَا قَيْسٍ الْأَوْدِيَّ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ عَلِيٌّ حَدَّثَنِي أَبُو نُعَيْمٍ ثنا مِسْعَرٌ عَنْ عُمَيْرِ بْنِ سَعِيدٍ عَنْ عَمَّارٍ قَالَ لَا أُبَالِي مَسَسْتُهُ أَوْ أَنْفِي فَقَالَ يَحْيَى بَيْنَ عُمَيْرِ بْنِ سَعِيدٍ وَعَمَّارِ بْنِ يَاسِرٍ مَفَازَةٌ 649 أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ ثنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا مُحَمَّدُ بْنُ الْحَسَنِ النَّقَّاشُ ثنا عَبْدُ اللهِ بْنُ يَحْيَى الْقَاضِي السَّرَخْسِيُّ فَذَكَرَهُ بِإِسْنَادِهِ وَبَعْضِ مَعْنَاهُ وَقَالَ فِي آخِرِهِ فِي حَدِيثِ عُمَيْرِ بْنِ سَعِيدٍ عَنْ عَمَّارٍ فَقَالَ أَحْمَدُ عَمَّارٌ وَابْنُ عُمَرَ اسْتَوَيَا فَمَنْ شَاءَ أَخَذَ بِهَذَا وَمَنْ شَاءَ أَخَذَ بِهَذَا قَالَ الشَّيْخُ قَدْ رُوِّينَا عَنْ عَلِيِّ بْنِ الْمَدِينِيِّ أَنَّهُ قَالَ فِي حَدِيثِ بُسْرَةَ سَمَاعُ عُرْوَةَ مِنْهَا كَمَا قَالَ يَحْيَى بْنُ مَعِينٍ وَكَأَنَّهُ رَجَعَ فِي ذَلِكَ إِلَى قَوْلِ يَحْيَى وَتَقْلِيدِ حَدِيثِ بُسْرَةَ
[Machine] Indeed, the Sunnah does not contradict with analogy. Al-Shafi'i mentioned in the narration of al-Za'farani about him, that the statement he made from the companions that there is no need for ablution (wudu) in it, he said it based on personal opinion. And whoever considers ablution obligatory in it, should consider it obligatory only by adhering to (following) it.
أَنَّ السُّنَّةَ لَا تُعَارَضُ بِالْقِيَاسِ وَذَكَرَ الشَّافِعِيُّ فِي رِوَايَةِ الزَّعْفَرَانِيِّ عَنْهُ أَنَّ الَّذِي قَالَهُ مِنَ الصَّحَابَةِ لَا وُضُوءَ فِيهِ فَإِنَّمَا قَالَهُ بِالرَّأْيِ وَمَنْ أَوْجَبَ الْوُضُوءَ فِيهِ فَلَا يُوجِبُهُ إِلَّا بِالِاتِّبَاعِ
[Machine] We were with the Prophet ﷺ when Al-Hasan came and he started to play with him. The Prophet ﷺ lifted his shirt and kissed his belly button. This chain of narration is not strong and it does not indicate whether he touched him with his hand or not, and then he prayed without performing ablution.
كُنَّا عِنْدَ النَّبِيِّ ﷺ فَجَاءَ الْحَسَنُ فَأَقْبَلَ يَتَمَرَّغُ عَلَيْهِ فَرَفَعَ عَنْ قَمِيصِهِ وَقَبَّلَ زَبِيبَتَهُ فَهَذَا إِسْنَادُهُ غَيْرُ قَوِيٍّ وَلَيْسَ فِيهِ أَنَّهُ مَسَّهُ بِيَدِهِ ثُمَّ صَلَّى وَلَمْ يَتَوَضَّأْ
