1. Purification
١۔ كِتَابُ الطَّهَارَة
[Machine] On the authority of the Prophet ﷺ, he said, "If a man sits in the middle of her four limbs (referring to his wife during intercourse) and the circumcision touches the circumcision, then ghusl (ritual bathing) becomes obligatory." This hadith is narrated by Muslim ibn Ibrahim. In another narration by Wahb ibn Jarir, it is mentioned that if a man sits in the middle of her four limbs and then experiences intense pleasure, then ghusl becomes obligatory. And in a hadith narrated by Abu Nuaim, it is mentioned that he (the man) exerted himself (during intercourse)
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا قَعَدَ بَيْنَ شُعَبِهَا الْأَرْبَعِ وَأَلْزَقَ الْخِتَانَ بِالْخِتَانِ فَقَدْ وَجَبَ الْغُسْلُ لَفْظُ حَدِيثِ مُسْلِمِ بْنِ إِبْرَاهِيمَ وَفِي حَدِيثِ وَهْبِ بْنِ جَرِيرٍ إِذَا قَعَدَ بَيْنَ شُعَبِهَا الْأَرْبَعِ ثُمَّ اجْتَهَدَ فَقَدْ وَجَبَ الْغُسْلُ وَفِي حَدِيثِ أَبِي نُعَيْمٍ ثُمَّ جَهَدَهَا
[Machine] From the Prophet ﷺ, he said: When a person sits between the four parts of their body and then exerts effort, then it becomes obligatory to perform ghusl. And in the narration of Matar, even if it does not rain.
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا جَلَسَ بَيْنَ شُعَبِهَا الْأَرْبَعِ ثُمَّ جَهَدَهَا فَقَدْ وَجَبَ الْغُسْلُ وَفِي حَدِيثِ مَطَرٍ وَإِنْ لَمْ يُنْزِلْ
[Machine] On the authority of the Prophet, ﷺ , he said: "When a person sits between the four limbs and then exerts himself, he must perform the ritual washing, whether he ejaculates or not."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا قَعَدَ بَيْنَ شُعَبِهَا الْأَرْبَعِ ثُمَّ أَجْهَدَ نَفْسَهُ فَقَدْ وَجَبَ الْغُسْلُ أَنْزَلَ أَوْ لَمْ يُنْزِلْ
[Machine] The Messenger of Allah ﷺ said, "When the circumcised parts meet, Ghusl (ritual bathing) becomes obligatory, whether ejaculation occurs or not."
قَالَ رَسُولُ اللهِ ﷺ إِذَا الْتَقَى الْخِتَانُ الْخِتَانَ وَجَبَ الْغُسْلُ أَنْزَلَ أَوْ لَمْ يُنْزِلْ
[Machine] Abu Musa narrated that they were sitting, and they mentioned what necessitates washing. Abu Musa added to his statement and said, "Whoever from the Mujahideen is touched by their circumcision, it is obligatory to wash. And whoever from the Ansar is touched by their circumcision, it is not obligatory to wash until flowing occurs." Then they agreed on the meaning. Abu Musa said, "I will bring the information," so he went to Aisha and greeted her, then he said, "I want to ask you about something, and I feel shy to ask you." She said, "Do not feel shy to ask me about something you used to ask your mother, who gave birth to you. Indeed, I am like your mother." He said, "I asked her, what necessitates washing?" She said, "You have fallen upon the well-informed one." The Messenger of Allah ﷺ said, "When he sits between her thighs with the four fingers and touches her circumcision, it is obligatory to wash." This is the wording of the Hadith of as-Sulami.
عَنْ أَبِي مُوسَى أَنَّهُمْ كَانُوا جُلُوسًا فَذَكَرُوا مَا يُوجِبُ الْغُسْلَ زَادَ أَبُو مُوسَى فِي حَدِيثِهِ فَقَالَ مَنْ حَضَرَهُ مِنَ الْمُهَاجِرِينَ إِذَا مَسَّ الْخَتَانُ الْخَتَانَ وَجَبَ الْغُسْلُ وَقَالَ مَنْ حَضَرَهُ مِنَ الْأَنْصَارِ لَا حَتَّى يَدْفُقَ ثُمَّ اتَّفَقَا فِي الْمَعْنَى فَقَالَ أَبُو مُوسَى أَنَا آتِي بِالْخَبَرِ فَقَامَ إِلَى عَائِشَةَ فَسَلَّمَ ثُمَّ قَالَ إِنِّي أُرِيدُ أَنْ أَسْأَلَكِ عَنْ شَيْءٍ وَأَنَا أَسْتَحْيِيكِ فَقَالَتْ لَا تَسْتَحِ أَنْ تَسْأَلَنِي عَنْ شَيْءٍ كُنْتَ سَائِلًا عَنْهُ أُمَّكَ الَّتِي وَلَدَتْكَ إِنَّمَا أَنَا أُمُّكَ قَالَ قُلْتُ مَا يُوجِبُ الْغُسْلَ؟ قَالَتْ عَلَى الْخَبِيرِ سَقَطْتَ قَالَ رَسُولُ اللهِ ﷺ إِذَا جَلَسَ بَيْنَ شُعَبِهَا الْأَرْبَعِ وَمَسَّ الْخَتَانُ الْخِتَانَ وَجَبَ الْغُسْلُ لَفْظُ حَدِيثِ السُّلَمِيِّ
I and she (the Mother of the Faithful) do it and then take a bath. (Using translation from Muslim 350)
عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ عَنِ الرَّجُلُ يُجَامِعُ أَهْلَهُ ثُمَّ يَكْسَلُ هَلْ عَلَيْهِمَا مِنْ غُسْلٍ وَعَائِشَةُ جَالِسَةٌ فَقَالَ رَسُولُ اللهِ ﷺ إِنِّي لَأَفْعَلُ ذَلِكَ أَنَا وَهَذِهِ ثُمَّ نَغْتَسِلُ
[Machine] I did it, me and the Messenger of Allah ﷺ , so we all washed from it.
فَعَلْتُهُ أَنَا وَرَسُولُ اللهِ ﷺ فَاغْتَسَلْنَا مِنْهُ جَمِيعًا
[Machine] He said, "O Messenger of Allah, if a man has sexual intercourse with a woman but does not ejaculate, he said: he should wash what has been touched by the woman, then he should perform ablution and offer prayer."
أَنَّهُ قَالَ يَا رَسُولَ اللهِ إِذَا جَامَعَ الرَّجُلُ الْمَرْأَةَ فَلَمْ يُنْزِلْ قَالَ يَغْسِلُ مَا مَسَّ الْمَرْأَةَ مِنْهُ ثُمَّ يَتَوَضَّأُ وَيُصَلِّي
[Machine] I heard it from the Messenger of Allah ﷺ saying, then I asked Ali ibn Abi Talib, Zubayr ibn al-Awwam, Talha ibn Ubayd Allah, and Ubayy ibn Ka'b. They all said the same as the Prophet ﷺ in the narration of Al-Bistami, and Abu Qilaba said in his narration that there is nothing in it except for purification, and he did not mention Ubayy or the narration of Urwah from Abu Ayyub.
سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ قَالَ فَسَأَلْتُ بَعْدَ ذَلِكَ عَلِيَّ بْنَ أَبِي طَالِبٍ وَالزُّبَيْرَ بْنَ الْعَوَّامِ وَطَلْحَةَ بْنَ عُبَيْدِ اللهِ وَأَبِيَّ بْنَ كَعْبٍ فقَالُوا مِثْلَ ذَلِكَ عَنِ النَّبِيِّ ﷺ لَفْظُ حَدِيثِ الْبِسْطَامِيِّ وَقَالَ أَبُو قِلَابَةَ فِي حَدِيثِهِ لَيْسَ مِنْهُ إِلَّا الطُّهُورُ وَلَمْ يَذْكُرْ أُبَيًّا وَلَا حَدِيثَ عُرْوَةَ عَنْ أَبِي أَيُّوبَ
[Machine] He heard it from the Messenger of Allah, so I asked Ali ibn Abi Talib, Zubair ibn Al-Awam, and Talha ibn Ubaidullah about it, and they instructed him to do so.
أَنَّهُ سَمِعَهُ مِنْ رَسُولِ اللهِ ﷺ فَسَأَلْتُ عَنْ ذَلِكَ عَلِيَّ بْنَ أَبِي طَالِبٍ وَالزُّبَيْرَ بْنَ الْعَوَّامِ وَطَلْحَةَ بْنَ عُبَيْدِ اللهِ فَأَمَرُوهُ بِذَلِكَ
[Machine] The Messenger of Allah ﷺ passed by a man from the Ansar. He sent someone to him, and he came out with his head dripping with water. The Messenger of Allah ﷺ said, "Perhaps we have hastened you?" He replied, "Yes, O Messenger of Allah." So the Messenger of Allah ﷺ said, "If you have hastened or broken your wudu, there is no need for ghusl (ritual bath), and wudu is sufficient for you."
أَنَّ رَسُولَ اللهِ ﷺ مَرَّ عَلَى رَجُلٍ مِنَ الْأَنْصَارِ فَأَرْسَلَ إِلَيْهِ فَخَرَجَ وَرَأْسُهُ يَقْطُرُ فَقَالَ لَعَلَّنَا أَعْجَلْنَاكَ؟ قَالَ نَعَمْ يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ إِذَا أُعْجِلْتَ أَوْ أَقْحَطْتَ فَلَا غُسْلَ عَلَيْكَ وَعَلَيْكَ الْوُضُوءُ
[Machine] That men from the Ansar, among them were Abu Ayyub and Abu Sa'id al-Khudri, used to judge regarding water from water, and that whoever had sexual intercourse with his wife but did not ejaculate, there is no obligation for him to perform ablution. When this was mentioned to Umar, Ibn Umar, and Aisha, they denied it and said that if the circumcision passed the circumcision, then the obligation of performing ablution arises. So Sahl bin Saad, who had met the Prophet ﷺ during his time when he was fifteen years old, said, Ubayy ibn Ka'b informed me that the fatwa that water from water is permissible is the most lenient fatwa that the Messenger of Allah ﷺ had issued at the beginning of Islam, and then he commanded to perform ablution.
أَنَّ رِجَالًا مِنَ الْأَنْصَارِ فِيهِمْ أَبُو أَيُّوبَ وَأَبُو سَعِيدٍ الْخُدْرِيُّ كَانُوا يُفْتُونَ الْمَاءُ مِنَ الْمَاءِ وَأَنَّهُ لَيْسَ عَلَى مَنْ أَتَى امْرَأَتَهُ فَلَمْ يُنْزِلْ غُسْلٌ فَلَمَّا ذُكِرَ ذَلِكَ لِعُمَرَ وَابْنِ عُمَرَ وَعَائِشَةَ أَنْكَرُوا ذَلِكَ وَقَالُوا إِذَا جَاوَزَ الْخِتَانُ الْخِتَانَ فَقَدْ وَجَبَ الْغُسْلُ فَقَالَ سَهْلُ بْنُ سَعْدٍ وَكَانَ قَدْ أَدْرَكَ النَّبِيَّ ﷺ فِي زَمَانِهِ وَهُوَ ابْنُ خَمْسَ عَشْرَةَ سَنَةً حَدَّثَنِي أُبَيُّ بْنُ كَعْبٍ أَنَّ الْفُتْيَا الَّتِي كَانَتِ الْمَاءُ مِنَ الْمَاءِ رُخْصَةٌ أَرْخَصَهَا رَسُولُ اللهِ ﷺ فِي أَوَّلِ الْإِسْلَامِ ثُمَّ أَمَرَ بِالْغُسْلِ
[Machine] The passage means: "The permissibility of performing fitya in water was only allowed at the beginning of Islam, then it was prohibited. Al-Zuhri did not hear this hadith directly from Sahl, he only heard it from some of his companions who heard it from Sahl."
إِنَّمَا كَانَتِ الْفُتْيَا فِي الْمَاءِ مِنَ الْمَاءِ رُخْصَةً فِي أَوَّلِ الْإِسْلَامِ ثُمَّ نُهِيَ عَنْهَا وَهَذَا الْحَدِيثُ لَمْ يَسْمَعْهُ الزُّهْرِيُّ مِنْ سَهْلٍ إِنَّمَا سَمِعَهُ عَنْ بَعْضِ أَصْحَابِهِ عَنْ سَهْلٍ
The Messenger of Allah (May peace be upon him) made a concession in the early days of Islam on account of the paucity of clothes that one should not take a bath if one has sexual intercourse (and has no seminal emission). But later on her commanded to take a bath in such a case and prohibited its omission. (Using translation from Abū Dāʾūd 214)
أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ إِنَّمَا جَعَلَ ذَلِكَ رُخْصَةً لِلنَّاسِ فِي أَوَّلِ الْإِسْلَامِ لِقِلَّةِ الثِّيَابِ ثُمَّ أَمَرَ بِالْغُسْلِ وَنَهَى عَنْ ذَلِكَ وَقَدْ رُوِّينَاهُ بِإِسْنَادٍ آخَرَ مَوْصُولًا صَحِيحًا عَنْ سَهْلِ بْنِ سَعْدٍ
[Machine] It was narrated that water was considered permissible at the beginning of Islam, and the Messenger of Allah ﷺ made it easy. Then he ordered us to perform ablution. And in the narration of Musa bin Harun, he ordered us to perform ablution afterwards.
أَنَّ الْمَاءَ مِنَ الْمَاءِ كَانَتْ رُخْصَةً رَخَّصَهَا رَسُولُ اللهِ ﷺ فِي بَدْءِ الْإِسْلَامِ ثُمَّ أَمَرَ بِالِاغْتِسَالِ بَعْدُ وَفِي حَدِيثِ مُوسَى بْنِ هَارُونَ ثُمَّ أَمَرَنَا بِالِاغْتِسَالِ بَعْدُ
[Machine] That the Messenger of Allah ﷺ said, after he abrogated it, and likewise Uthman ibn Affan and Ali ibn Abi Talib, and others.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ بَعْدَ مَا نَسَخَهُ وَكَذَلِكَ عُثْمَانُ بْنُ عَفَّانَ ؓ وَعَلِيُّ بْنُ أَبِي طَالِبٍ ؓ وَغَيْرُهُمَا
[Machine] "Umar ibn Al-Khattab, Uthman ibn Affan, and Aisha, the wife of the Prophet ﷺ, used to say, when circumcision is touched, washing becomes obligatory."
أَنَّ عُمَرَ بْنَ الْخَطَّابِ وَعُثْمَانَ بْنَ عَفَّانَ وَعَائِشَةَ زَوْجَ النَّبِيِّ ﷺ كَانُوا يَقُولُونَ إِذَا مَسَّ الْخِتَانُ الْخِتَانَ فَقَدْ وَجَبَ الْغُسْلُ
[Machine] Ali used to say that what makes something obligatory is what makes it necessary to perform a full ablution.
أَنَّ عَلِيًّا كَانَ يَقُولُ مَا أَوْجَبَ الْحَدَّ أَوْجَبَ الْغُسْلَ
I asked Aisha, the mother of the believers, "What necessitates performing the ritual bath (ghusl)?" She replied, "Do you not know? Your likeness is like that of a young rooster, you hear the hen coo and you respond by crowing along with her. If the circumcision has surpassed the circumcision (i.e., sexual intercourse has taken place), then the ritual bath becomes obligatory."
سَأَلْتُ عَائِشَةَ أُمَّ الْمُؤْمِنِينَ ؓ مَا يُوجِبُ الْغُسْلَ؟ فَقَالَتْ أَتَدْرِي مَا مَثَلُكَ يَا أَبَا سَلَمَةَ مَثَلُكَ مَثَلُ الْفُرُوخِ تَسْمَعُ الدِّيَكَةَ تَصِيحُ فَتَصْرُخُ مَعَهَا إِذَا جَاوَزَ الْخِتَانُ الْخِتَانَ فَقَدْ وَجَبَ الْغُسْلُ
[Machine] He used to say: "If the uncircumcised part differs, washing becomes mandatory."
كَانَ يَقُولُ إِذَا خَالَفَ الْخِتَانُ الْخِتَانَ وَجَبَ الْغُسْلُ
عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ مِثْلَهُ
[Machine] If circumcision exceeds the area of circumcision, then ghusl is required. 786. And this is narrated from Al-Sha'abi from Al-Harith Al-Awar from Ali, similar to it.
إِذَا جَاوَزَ الْخِتَانُ الْخِتَانَ فَقَدْ وَجَبَ الْغُسْلُ 786 وَبِهِ عَنِ الشَّعْبِيِّ عَنِ الْحَارِثِ الْأَعْوَرِ عَنْ عَلِيٍّ نَحْوَهُ
