1. Purification
١۔ كِتَابُ الطَّهَارَة
[Machine] The Messenger of Allah ﷺ said, "Whoever reaches with his hand towards his private parts, there is no veil between his hand and the private parts. Therefore, it becomes obligatory for him to perform ablution for prayer, and so on."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَفْضَى بِيَدِهِ إِلَى فَرْجِهِ لَيْسَ دُونَهَا حِجَابٌ فَقَدْ وَجَبَ عَلَيْهِ وُضُوءُ الصَّلَاةِ وَهَكَذَا
[Machine] "From Abu Huraira, whoever puts his hand on his private parts, then let him perform ablution."
عَنْ أَبِي هُرَيْرَةَ مَنْ أَفْضَى بِيَدِهِ إِلَى فَرْجِهِ فَلْيَتَوَضَّأْ هَكَذَا مَوْقُوفٌ وَقِيلَ عَنْ جَمِيلٍ عَنْ أَبِي وَهْبٍ عَنْ أَبِي هُرَيْرَةَ
[Machine] Whoever touches their private parts should perform ablution, and if they only touch them from the outside of their clothing, then wudu is not required for them.
مَنْ مَسَّ فَرْجَهُ فَلْيَتَوَضَّأْ وَمَنْ مَسَّهُ يَعْنِي مِنْ وَرَاءِ الثَّوْبِ فَلَيْسَ عَلَيْهِ وُضُوءٌ
[Machine] The Messenger of Allah ﷺ said, "When one of you finishes relieving himself, he should perform ablution." Ibn Naafi' added that Muhammad ibn Abdul Rahman ibn Thawban narrated this from Jaabir, who heard it from the Prophet ﷺ . Ash-Shafi'i, may Allah have mercy on him, said, "I have heard more than one of the scholars mention this narration without mentioning Jaabir's name." Abu Saeed also added in his narration, "Ash-Shafi'i said that relieving oneself with the hand refers to wiping it on the stomach, just as it is said to relieve oneself with the hand in terms of pledging allegiance, or to relieve oneself with the hand to prostrate to the ground, or to relieve oneself with the hand while kneeling on the knees."
قَالَ رَسُولُ اللهِ ﷺ إِذَا أَفْضَى أَحَدُكُمْ بِيَدِهِ إِلَى ذَكَرِهِ فَلْيَتَوَضَّأْ وَزَادَ ابْنُ نَافِعٍ فَقَالَ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ عَنْ جَابِرٍ عَنِ النَّبِيِّ ﷺ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ تَعَالَى وَسَمِعْتُ غَيْرَ وَاحِدٍ مِنَ الْحُفَّاظِ يَرْوُونَهُ لَا يَذْكُرُونَ فِيهِ جَابِرًا وَزَادَ أَبُو سَعِيدٍ فِي حَدِيثِهِ قَالَ الشَّافِعِيُّ وَالْإِفْضَاءُ بِالْيَدِ إِنَّمَا هُوَ بِبَطْنِهَا كَمَا يُقَالُ أَفْضَى بِيَدِهِ مَبَايِعًا وَأَفْضَى بِيَدِهِ إِلَى الْأَرْضِ سَاجِدًا وَإِلَى رُكْبَتَيْهِ رَاكِعًا
[Machine] We went out to the Prophet ﷺ with a delegation until we reached him, so we pledged allegiance to him and prayed with him. Then a man came who appeared to be a Bedouin and said, "O Messenger of Allah, what do you think about the man's hair in his body after he performs ablution?" He replied, "Is it not just a few hairs or a morsel from you? This is a hadith."
خَرَجْنَا إِلَى نَبِيِّ اللهِ ﷺ وَفْدًا حَتَّى قَدِمْنَا عَلَيْهِ فَبَايَعْنَاهُ وَصَلَّيْنَا مَعَهُ فَجَاءَ رَجُلٌ كَأَنَّهُ بَدَوِيٌّ فَقَالَ يَا رَسُولَ اللهِ مَا تَرَى فِي مَسِّ الرَّجُلِ ذَكَرَهُ بَعْدَمَا يَتَوَضَّأُ؟ فَقَالَ وَهَلْ هُوَ إِلَّا بَضْعَةٌ أَوْ مُضْغَةٌ مِنْكَ فَهَذَا حَدِيثٌ
[Machine] I arrived at the Prophet while he was building the mosque. He told me to mix the clay, for I was more knowledgeable in its mixture. So, I asked him, or a man asked him, "Do you see a man who performs ablution and then touches his private parts?" He said, "It is from you, and some of our companions have carried it on his hand to his private parts."
قَدِمْتُ عَلَى النَّبِيِّ ﷺ وَهُوَ يَبْنِي الْمَسْجِدَ فَقَالَ اخْلِطِ الطِّينَ فَإِنَّكَ أَعْلَمُ بِخَلْطِهِ فَسَأَلْتُهُ أَوْ سَأَلَهُ رَجُلٌ فَقَالَ أَرَأَيْتَ الرَّجُلَ يَتَوَضَّأُ ثُمَّ يَمَسُّ ذَكَرَهُ؟ فَقَالَ إِنَّمَا هُوَ مِنْكَ ثُمَّ قَدْ حَمَلَهُ بَعْضُ أَصْحَابِنَا عَلَى مَسِّهِ إِيَّاهُ بِظَهْرِ كَفِّهِ
[Machine] He asked the Prophet ﷺ or heard a man asking him. He said, "While I was praying, I scratched my thigh and my finger touched my private part." The Prophet ﷺ said, "It is only a part of you and what is apparent is the condition of the one who scratches his thigh, and his hand touched his private part that only the back of his hand would be affected. And Allah knows best."
أَنَّهُ سَأَلَ النَّبِيَّ ﷺ أَوْ سَمِعَ رَجُلًا يَسْأَلُهُ فَقَالَ بَيْنَمَا أَنَا أُصَلِّي فَذَهَبْتُ أَحُكُّ فَخِذِي فَأَصَابَتْ يَدِي ذَكَرِي فَقَالَ النَّبِيُّ ﷺ إِنَّمَا هُوَ مِنْكَ وَالظَّاهِرُ مِنْ حَالِ مَنْ يَحُكُّ فَخِذَهُ وَأَصَابَتْ يَدُهُ ذَكَرَهُ أَنَّهُ إِنَّمَا يُصِيبُهُ بِظَهْرِ كَفِّهِ وَاللهُ أَعْلَمُ
[Machine] Yahya then did not convince Uruwah of that until he came to Busrah, so he asked her and she narrated to him the story. Then Yahya said, "Indeed, people have differed regarding Qais ibn Talq and it is not sufficient to rely on his narration." Ahmad ibn Hanbal said, "Both of you are correct in what you have said." Yahya asked, "Who narrated this?" He said, "It is narrated by Sufyan from Abu Qais from Huzayl from Abdullah." And when Ibn Mas'ood and Ibn Umar gathered and differed, Ibn Mas'ood was more deserving to be followed. Ahmad ibn Hanbal said to him, "Yes, but Abu Qais al-Awdi cannot be relied upon in his narration." Ali said, "Abu Nuaim narrated to me from Mesar from Umair bin Said from Ammar, he said, 'I do not care if it touched my hand or my nose.'" Yahya said, "Between Umair bin Said and Ammar bin Yasir is a serious contradiction." Abu Bakr ibn al-Harith al-Faqih informed us, Ali ibn Omar al-Hafiz informed us, Muhammad ibn al-Hasan al-Naqqash informed us, Abdullah ibn Yahya al-Qadi al-Sarakhsi mentioned it with its chain and some of its meanings. And he said in the end, in the narration of Umair bin Said from Ammar, Ahmed said, "Ammar and Ibn Umar are equal, so whoever wishes can take this, and whoever wishes can take that." The Sheikh said, "We have narrated from Ali ibn al-Madini that he said about the narration of Busrah, the hearing of Uruwah from it, as Yahya bin Ma'een said, and it seems that he returned in that to the statement of Yahya and the adoption of the narration of Busrah."
يَحْيَى ثُمَّ لَمْ يُقْنِعْ ذَلِكَ عُرْوَةَ حَتَّى أَتَى بُسْرَةَ فَسَأَلَهَا وَشَافَهَتْهُ بِالْحَدِيثِ ثُمَّ قَالَ يَحْيَى وَلَقَدْ أَكْثَرَ النَّاسُ فِي قَيْسِ بْنِ طَلْقٍ وَأَنَّهُ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ أَحْمَدُ بْنُ حَنْبَلٍ كِلَا الْأَمْرَيْنِ عَلَى مَا قُلْتُمَا فَقَالَ يَحْيَى عَنْ مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ يُتَوَضَّأُ مِنْ مَسِّ الذَّكَرِ فَقَالَ عَلِيٌّ كَانَ ابْنُ مَسْعُودٍ يَقُولُ لَا يُتَوَضَّأُ مِنْهُ وَإِنَّمَا هُوَ بَضْعَةٌ مِنْ جَسَدِكَ قَالَ فَقَالَ يَحْيَى هَذَا عَمَّنْ؟ فَقَالَ عَنْ سُفْيَانَ عَنْ أَبِي قَيْسٍ عَنْ هُزَيْلٍ عَنْ عَبْدِ اللهِ وَإِذَا اجْتَمَعَ ابْنُ مَسْعُودٍ وَابْنُ عُمَرَ وَاخْتَلَفَا فَابْنُ مَسْعُودٍ أَوْلَى أَنْ يُتَّبَعَ فَقَالَ لَهُ أَحْمَدُ بْنُ حَنْبَلٍ نَعَمْ وَلَكِنَّ أَبَا قَيْسٍ الْأَوْدِيَّ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ عَلِيٌّ حَدَّثَنِي أَبُو نُعَيْمٍ ثنا مِسْعَرٌ عَنْ عُمَيْرِ بْنِ سَعِيدٍ عَنْ عَمَّارٍ قَالَ لَا أُبَالِي مَسَسْتُهُ أَوْ أَنْفِي فَقَالَ يَحْيَى بَيْنَ عُمَيْرِ بْنِ سَعِيدٍ وَعَمَّارِ بْنِ يَاسِرٍ مَفَازَةٌ 649 أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ ثنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا مُحَمَّدُ بْنُ الْحَسَنِ النَّقَّاشُ ثنا عَبْدُ اللهِ بْنُ يَحْيَى الْقَاضِي السَّرَخْسِيُّ فَذَكَرَهُ بِإِسْنَادِهِ وَبَعْضِ مَعْنَاهُ وَقَالَ فِي آخِرِهِ فِي حَدِيثِ عُمَيْرِ بْنِ سَعِيدٍ عَنْ عَمَّارٍ فَقَالَ أَحْمَدُ عَمَّارٌ وَابْنُ عُمَرَ اسْتَوَيَا فَمَنْ شَاءَ أَخَذَ بِهَذَا وَمَنْ شَاءَ أَخَذَ بِهَذَا قَالَ الشَّيْخُ قَدْ رُوِّينَا عَنْ عَلِيِّ بْنِ الْمَدِينِيِّ أَنَّهُ قَالَ فِي حَدِيثِ بُسْرَةَ سَمَاعُ عُرْوَةَ مِنْهَا كَمَا قَالَ يَحْيَى بْنُ مَعِينٍ وَكَأَنَّهُ رَجَعَ فِي ذَلِكَ إِلَى قَوْلِ يَحْيَى وَتَقْلِيدِ حَدِيثِ بُسْرَةَ
[Machine] Indeed, the Sunnah does not contradict with analogy. Al-Shafi'i mentioned in the narration of al-Za'farani about him, that the statement he made from the companions that there is no need for ablution (wudu) in it, he said it based on personal opinion. And whoever considers ablution obligatory in it, should consider it obligatory only by adhering to (following) it.
أَنَّ السُّنَّةَ لَا تُعَارَضُ بِالْقِيَاسِ وَذَكَرَ الشَّافِعِيُّ فِي رِوَايَةِ الزَّعْفَرَانِيِّ عَنْهُ أَنَّ الَّذِي قَالَهُ مِنَ الصَّحَابَةِ لَا وُضُوءَ فِيهِ فَإِنَّمَا قَالَهُ بِالرَّأْيِ وَمَنْ أَوْجَبَ الْوُضُوءَ فِيهِ فَلَا يُوجِبُهُ إِلَّا بِالِاتِّبَاعِ
[Machine] We were with the Prophet ﷺ when Al-Hasan came and he started to play with him. The Prophet ﷺ lifted his shirt and kissed his belly button. This chain of narration is not strong and it does not indicate whether he touched him with his hand or not, and then he prayed without performing ablution.
كُنَّا عِنْدَ النَّبِيِّ ﷺ فَجَاءَ الْحَسَنُ فَأَقْبَلَ يَتَمَرَّغُ عَلَيْهِ فَرَفَعَ عَنْ قَمِيصِهِ وَقَبَّلَ زَبِيبَتَهُ فَهَذَا إِسْنَادُهُ غَيْرُ قَوِيٍّ وَلَيْسَ فِيهِ أَنَّهُ مَسَّهُ بِيَدِهِ ثُمَّ صَلَّى وَلَمْ يَتَوَضَّأْ
