39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] We used to fight alongside the Messenger of Allah ﷺ and there were no women with us. So we said, "Shouldn't we have our own share?" Then the Messenger of Allah ﷺ prohibited us from doing that and allowed us to marry women temporarily using a piece of cloth, as mentioned in the hadith of Abu Uthman. And in the hadith of Abu Abdullah, he further permitted us to marry women temporarily using a piece of cloth for a designated period. Then Abdullah recited the verse, "O you who have believed, do not prohibit the good things which Allah has made lawful to you" [Surah Al-Ma'idah 5:87].
كُنَّا نَغْزُو مَعَ رَسُولِ اللهِ ﷺ وَلَيْسَ مَعَنَا نِسَاءٌ فَقُلْنَا أَلَا نَخْتَصِي؟ فَنَهَانَا رَسُولُ اللهِ ﷺ عَنْ ذَلِكَ وَرَخَّصَ لَنَا أَنْ نَنْكِحَ الْمَرْأَةَ بِالثَّوْبِ إِلَى أَجَلٍ لَفْظُ حَدِيثِ أَبِي عُثْمَانَ وَفِي حَدِيثِ أَبِي عَبْدِ اللهِ ثُمَّ رَخَّصَ لَنَا فِي أَنْ نَتَزَوَّجَ الْمَرْأَةَ بِالثَّوْبِ إِلَى أَجَلٍ ثُمَّ قَرَأَ عَبْدُ اللهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ} [المائدة 87] الْآيَةَ
[Machine] I heard Abdullah ibn Mas'ud say, "We used to go on raids with the Messenger of Allah ﷺ and there were no women among us. We wanted to have our own women with us, so the Messenger of Allah ﷺ forbade us from doing so. Then he allowed us to have temporary marriages with women for a specified period." Abu Abdullah added in his narration, with his chain of narrators, that Ash-Shafi'i said, "Ibn Mas'ud mentioned Al-Irkhas (temporary marriage) in relation to Mut'ah (pleasure marriage), but he did not specify a time frame, whether it was before or after the Battle of Khaybar." The similar narration is from Ali ibn Abi Talib, in which the Prophet ﷺ forbade Mut'ah, and Allah knows best whether it was abrogated or not. Sheikh (Al-Albani) may Allah have mercy on him said that it was also narrated in a hadith of Ibn Mas'ud that he said, "We were young men..."
سَمِعْتُ عَبْدَ اللهِ بْنَ مَسْعُودٍ ؓ يَقُولُ كُنَّا نَغْزُو مَعَ رَسُولِ اللهِ ﷺ وَلَيْسَ مَعَنَا نِسَاءٌ فَأَرَدْنَا أَنْ نَخْتَصِيَ فَنَهَانَا عَنْ ذَلِكَ رَسُولُ اللهِ ﷺ ثُمَّ رَخَّصَ لَنَا أَنْ نَنْكِحَ الْمَرْأَةَ إِلَى أَجَلٍ بِالشَّيْءِ زَادَ أَبُو عَبْدِ اللهِ فِي رِوَايَتِهِ بِإِسْنَادِهِ قَالَ قَالَ الشَّافِعِيُّ ذَكَرَ ابْنُ مَسْعُودٍ الْإِرْخَاصَ فِي نِكَاحِ الْمُتْعَةِ وَلَمْ يُوَقِّتْ شَيْئًا يَدُلُّ أَهُوَ قَبْلَ خَيْبَرَ أَوْ بَعْدَهَا وَأَشْبَهَ حَدِيثُ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ فِي نَهْيِ النَّبِيِّ ﷺ عَنِ الْمُتْعَةِ أَنْ يَكُونَ وَاللهُ أَعْلَمُ نَاسِخًا لَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ رُوِيَ فِي حَدِيثِ ابْنِ مَسْعُودٍ أَنَّهُ قَالَ كُنَّا وَنَحْنُ شَبَابٌ
[Machine] We were young and we said, "O Messenger of Allah, should we not get married?" He said, "No." Then he allowed us to marry women by giving them clothes for an appointed period. Then Abdullah recited the verse, "O you who have believed, do not prohibit the good things which Allah has made lawful to you" [Surah Al-Maida, 5:87].
كُنَّا وَنَحْنُ شَبَابٌ فَقُلْنَا يَا رَسُولَ اللهِ أَلَا نَخْتَصِي؟ قَالَ لَا ثُمَّ رَخَّصَ لَنَا أَنْ نَنْكِحَ الْمَرْأَةَ بِالثَّوْبِ إِلَى أَجَلٍ ثُمَّ قَرَأَ عَبْدُ اللهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ} [المائدة 87]
[Machine] The Messenger of Allah ﷺ forbade the pleasure of women on the day of Khaybar, and eating the meat of domesticated donkeys. This is mentioned in the narration of Al-Shafi'i and Yahya ibn Yahya, and in the narration of Ibn Wahb, he forbade the pleasure of women and the meat of wild donkeys on the day of Khaybar.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ مُتْعَةِ النِّسَاءِ يَوْمَ خَيْبَرَ وَعَنْ أَكْلِ لُحُومِ الْحُمُرِ الْإِنْسِيَّةِ لَفْظُ حَدِيثِ الشَّافِعِيِّ وَيَحْيَى بْنِ يَحْيَى وَفِي رِوَايَةِ ابْنِ وَهْبٍ نَهَى يَوْمَ خَيْبَرَ عَنْ مُتْعَةِ النِّسَاءِ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ
[Machine] The Messenger of Allah ﷺ prohibited it on the day of Khaybar and also prohibited the consumption of donkey meat.
إِنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْهَا يَوْمَ خَيْبَرَ وَعَنْ لُحُومِ الْحُمُرِ الْإِنْسِيَّةِ
[Machine] The Prophet ﷺ forbade pleasure and the consumption of domesticated donkey meat.
رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُتْعَةِ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ؟
[Machine] You are a lost person. Indeed, the Prophet ﷺ has prohibited temporary marriage and the consumption of domesticated donkey meat during the time of Khaybar.
إِنَّكَ امْرُؤٌ تَائِهٌ إِنَّ النَّبِيَّ ﷺ نَهَى عَنْ نِكَاحِ الْمُتْعَةِ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ زَمَنَ خَيْبَرَ
[Machine] "The Messenger of Allah ﷺ prohibited it on the day of Khaybar, and we were not travelers. The sheikh said, then indeed the Messenger of Allah ﷺ permitted temporary marriage during the time of the conquest of Mecca, then he prohibited it until the Day of Judgment."
رَسُولَ اللهِ ﷺ حَرَّمَهَا يَوْمَ خَيْبَرَ وَمَا كُنَّا مُسَافِحِينَ قَالَ الشَّيْخُ ثُمَّ إِنَّ رَسُولَ اللهِ ﷺ أَذِنَ فِي نِكَاحِ الْمُتْعَةِ زَمَنَ الْفَتْحِ فَتْحِ مَكَّةَ ثُمَّ حَرَّمَهَا إِلَى يَوْمِ الْقِيَامَةِ
Messenger of Allah ﷺ permitted temporary marriage for us. So I and another person went out and saw a woman of Bana 'Amir, who was like a young long-necked she-camel. We presented ourselves to her (for contracting temporary marriage), whereupon she said: What dower would you give me? I said: My cloak. And my companion also said: My cloak. And the cloak of-my companion was superior to my cloak, but I was younger than he. So when she looked at the cloak of my companion she liked it, and when she cast a glance at me I looked more attractive to her. She then said: Well, you and your cloak are sufficient for me. I remained with her for three nights, and then Messenger of Allah ﷺ said: He who has any such woman with whom he had contracted temporary marriage, he should let her off. أَنَّهُ قَالَ أَذِنَ رَسُولُ اللهِ ﷺ بِالْمُتْعَةِ فَانْطَلَقْتُ أَنَا وَرَجُلٌ إِلَى امْرَأَةٍ مِنْ بَنِي عَامِرٍ كَأَنَّهَا بَكْرَةٌ عَيْطَاءُ فَعَرَضْنَا عَلَيْهَا أَنْفُسَنَا فَقَالَتْ مَا تُعْطِينِي؟ فَقُلْتُ رِدَائِي وَقَالَ صَاحِبِي رِدَائِي وَكَانَ رِدَاءُ صَاحِبِي أَجْوَدُ مِنْ رِدَائِي وَكُنْتُ أَشَبَّ مِنْهُ فَإِذَا نَظَرَتْ إِلَى رِدَاءِ صَاحِبِي أَعْجَبَهَا وَإِذَا نَظَرَتْ إِلِيَّ أَعْجَبْتُهَا ثُمَّ قَالَتْ أَنْتَ وَرِدَاؤُكَ تَكْفِينِي فَكُنْتُ مَعَهَا ثَلَاثًا ثُمَّ إِنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ كَانَ عِنْدَهُ شَيْءٌ مِنْ هَذِهِ النِّسَاءِ الَّتِي يَتَمَتَّعُ بِهِنَّ فَلْيُخَلِّ سَبِيلَهَا
Is it possible that one of us may contract temporary marriage with you? She said: What will you give me as a dower? Each one of us spread his cloak. She began to cast a glance on both the persons. My companion also looked at her when she was casting a glance at her side and he said: This cloak of his is worn out, whereas my cloak is quite new. She, however, said twice or thrice: There is no harm in (accepting) this cloak (the old one). So I contracted temporary marriage with her, and I did not come out (of this) until Messenger of Allah ﷺ declared it forbidden. (Using translation from Muslim 1406b)
أَنَّ أَبَاهُ غَزَا مَعَ رَسُولِ اللهِ ﷺ عَامَ فَتْحِ مَكَّةَ فَأَقَامَ بِهَا خَمْسًا وَثَلَاثِينَ بَيْنَ لَيْلَةٍ وَيَوْمٍ قَالَ فَأَذِنَ لَنَا رَسُولُ اللهِ ﷺ فِي مُتْعَةِ النِّسَاءِ فَخَرَجْتُ أَنَا وَرَجُلٌ مِنْ قَوْمِي وَلِي عَلَيْهِ فَضْلٌ فِي الْجَمَالِ وَهُوَ قَرِيبٌ مِنَ الدَّمَامَةِ مَعَ كُلِّ وَاحِدٍ مِنَّا بُرْدٌ أَمَّا بُرْدِي فَخَلَقٌ وَأَمَّا بُرْدُ ابْنِ عَمِّي فَبُرْدٌ جَدِيدٌ غَضٌّ حَتَّى إِذَا كُنَّا بِأَسْفَلِ مَكَّةَ أَوْ بِأَعْلَاهَا فَتَلَقَّتْنَا فَتَاةٌ مِثْلُ الْبَكْرَةِ الْعَنَطْنَطَةِ فَقُلْنَا هَلْ لَكِ أَنْ يَسْتَمْتِعَ مِنْكِ أَحَدُنَا؟ قَالَتْ وَمَا تَبْذُلَانِ؟ قَالَ فَنَشَرَ كُلٌّ مِنَّا بُرْدَهُ فَجَعَلَتْ تَنْظُرُ إِلَى الرَّجُلَيْنِ فَإِذَا رَآهَا صَاحِبِي تَنْظُرُ إِلَى عِطْفِهَا وَقَالَ إِنَّ بُرْدَ هَذَا خَلَقٌ مَحٌّ وَبُرْدِي هَذَا جَدِيدٌ غَضٌّ فَتَقُولُ وَبُرْدُ هَذَا لَا بَأْسَ بِهِ ثَلَاثَ مَرَّاتٍ أَوْ مَرَّتَيْنِ ثُمَّ اسْتَمْتَعْتُ مِنْهَا فَلَمْ نَخْرُجْ حَتَّى حَرَّمَهَا رَسُولُ اللهِ ﷺ لَفْظُ حَدِيثِ مُسَدَّدٍ
[Machine] The Messenger of Allah ﷺ commanded us to practice Mut'ah during the year of the Conquest when we entered Makkah, and we did not refrain from it until he prohibited it, as mentioned in the Hadith of Ibrahim.
أَمَرَنَا رَسُولُ اللهِ ﷺ بِالْمُتْعَةِ عَامَ الْفَتْحِ حِينَ دَخَلْنَا مَكَّةَ ثُمَّ لَمْ نَخْرُجْ مِنْهَا حَتَّى نَهَى عَنْهُ لَفْظُ حَدِيثِ إِبْرَاهِيمَ
Sabra b. Ma'bad reported that Allah's Apostle ﷺ permitted his Companions to contract temporary marriage with women in the Year of Victory. So I and a friend of mine from Banu Sulaim went out, until we found a young woman of Banu Amir who was like a young she-camel having a long neck. We proposed to her for contracting temporary marriage with us, and presented to her our cloaks (as dower). She began to look and found me more handsome than my friend, but found the cloak of my friend more beautiful than my cloak. She thought in her mind for a while, but then preferred me to my friend. So I remained with her for three (nights), and then Messenger of Allah ﷺ commanded us to part with them (such women). (Using translation from Muslim 1406g)
أَنَّ نَبِيَّ اللهِ ﷺ عَامَ فَتْحِ مَكَّةَ أَمَرَ أَصْحَابَهُ بِالتَّمَتُّعِ مِنَ النِّسَاءِ فَخَرَجْتُ أَنَا وَصَاحِبٌ لِي مِنْ بَنِي سُلَيْمٍ حَتَّى وَجَدْنَا جَارِيَةً مِنْ بَنِي عَامِرٍ كَأَنَّهَا بَكْرَةٌ عَيْطَاءُ فَخَطَبْنَاهَا إِلَى نَفْسِهَا وَعَرَضْنَا عَلَيْهَا بُرْدَيْنَا فَجَعَلَتْ تَنْظُرُ فَتَرَانِي أَجْمَلَ مِنْ صَاحِبِي وَتَرَى بُرْدَ صَاحِبِي أَحْسَنَ مِنْ بُرْدِي فَآمَرَتْ نَفْسَهَا سَاعَةً ثُمَّ اخْتَارَتْنِي عَلَى صَاحِبِي فَكُنَّ مَعَنَا ثَلَاثًا ثُمَّ أَمَرَنَا رَسُولُ اللهِ ﷺ بِفِرَاقِهِنَّ لَفْظُ حَدِيثِ يَحْيَى بْنِ يَحْيَى
[Machine] "That the Messenger of Allah ﷺ prohibited Mut'ah (temporary marriage), saying that it is Haram (unlawful) from this day of yours until the Day of Resurrection. And whoever gives something, let him not take it back. This is the saying of Abu Abdullah, and Ibn Abadan did not mention it, that whoever gives to the end."
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُتْعَةِ قَالَ إِنَّهَا حَرَامٌ مِنْ يَوْمِكُمْ هَذَا إِلَى يَوْمِ الْقِيَامَةِ وَمَنْ كَانَ أَعْطَى شَيْئًا فَلَا يَأْخُذْهُ لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ وَلَمْ يَذْكُرِ ابْنُ عَبْدَانَ قَوْلَهُ وَمَنْ كَانَ أَعْطَى إِلَى آخِرِهِ
[Machine] I saw the Messenger of Allah ﷺ standing between the pillar and the door, saying, "O people, I had permitted you to enjoy certain things. Know that Allah has forbidden them until the Day of Resurrection. So, whoever possessed any of them, he should nullify its way, and do not take anything back from what you have given them."
رَأَيْتُ رَسُولَ اللهِ ﷺ قَائِمًا بَيْنَ الرُّكْنِ وَالْبَابِ وَهُوَ يَقُولُ يَا أَيُّهَا النَّاسُ إِنِّي كُنْتُ أَذِنْتُ لَكُمْ فِي الِاسْتِمْتَاعِ أَلَا وَإِنَّ اللهَ حَرَّمَهَا إِلَى يَوْمِ الْقِيَامَةِ فَمَنْ كَانَ عِنْدَهُ مِنْهُنَّ شَيْءٌ فَلْيُخَلِّ سَبِيلَهَا وَلَا تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا
[Machine] He informed them that they went out with the Messenger of Allah ﷺ during the Farewell Pilgrimage until they reached Usfan. A man from the Banu Mudlij, called Suraqah ibn Malik or Malik ibn Suraqah, stood up and said, "O Messenger of Allah, fulfill your promise as if we were born today." The Prophet ﷺ said, "Indeed, Allah has made performing 'Umrah during this Hajj obligatory upon you. So when you have arrived, whoever performs Tawaf around the Ka'bah and between Safa and Marwah (the hills) may remove the ihram, except those who have a sacrificial animal." When we were released, we enjoyed ourselves with these women, and marriage was something we could do. So we presented that to the women, and they agreed except that they wanted a waiting period between us and them. We mentioned that to the Prophet ﷺ , and he said, 'Do it.' So I went out, along with a cousin of mine, each of us having a cloak. His cloak was better than mine, although I was stronger and had more hair. We approached a woman, and she liked his cloak and was attracted to my youthfulness. She said, 'A cloak like this is equal to a man.' The waiting period between us was ten days. I stayed with her for a night and then left. When I left, behold, the Messenger of Allah ﷺ was standing between the Rukn and the Station, saying, 'O people, I had given you permission concerning enjoyment with these women. Indeed, I have forbidden it until the Day of Judgment. So whoever has anything belonging to them, let them return it, and do not take anything back from what you have given them'" (14156). Abu Zakariyya ibn Abi Ishaq narrated to us from Abu Abdullah ibn Ya'qub, who narrated to us from Muhammad ibn Abd al-Wahhab, who narrated to us from Ja'far ibn Awn, who narrated to us from Abdul Aziz ibn Umar, who narrated to us from Ar-Rabi ibn Sabrah, who narrated to him from his father, who narrated to him that they traveled with the Messenger of Allah ﷺ until they reached Usfan. A man from the Banu Mudlij spoke to him, and he mentioned the hadith in a similar manner, and likewise.
أَخْبَرَهُ أَنَّهُمْ خَرَجُوا مَعَ رَسُولِ اللهِ ﷺ فِي حَجَّةِ الْوَدَاعِ حَتَّى نَزَلُوا بِعُسْفَانَ فَقَامَ إِلَى رَسُولِ اللهِ ﷺ رَجُلٌ مِنْ بَنِي مُدْلِجٍ يُقَالُ لَهُ سُرَاقَةُ بْنُ مَالِكٍ أَوْ مَالِكُ بْنُ سُرَاقَةَ فَقَالَ يَا رَسُولَ اللهِ اقْضِ قَضَاءً كَأَنَّمَا وُلِدُوا الْيَوْمَ قَالَ إِنَّ اللهَ أَدْخَلَ عَلَيْكُمْ فِي حَجَّتِكُمْ هَذِهِ عَمْرَةً فَإِذَا أَنْتُمْ قَدِمْتُمْ فَمَنْ تَطَوَّفَ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ يَحِلُّ إِلَّا مَنْ كَانَ مَعَهُ مِنَ الْهَدْيِ فَلَمَّا أَحْلَلْنَا قَدِ اسْتَمْتَعُوا مِنْ هَذِهِ النِّسَاءِ وَالِاسْتِمْتَاعُ عِنْدَنَا التَّزْوِيجُ فَعَرَضْنَا ذَلِكَ عَلَى النِّسَاءِ فَأَبَيْنَ إِلَّا أَنْ يَضْرِبْنَ بَيْنَنَا وَبَيْنَهُنَّ أَجَلًا فَذَكَرْنَا ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ افْعَلُوا فَخَرَجْتُ أَنَا وَابْنُ عَمٍّ لِي مَعِي بُرْدٌ وَمَعَهُ بُرْدٌ وَبُرْدُهُ أَجْوَدُ مِنْ بُرْدِي وَأَنَا أَشَبُّ مِنْهُ فَأَتَيْنَا امْرَأَةً فَأَعْجَبَهَا بُرْدُهُ وَأَعْجَبَهَا شَبَابِي قَالَتْ بُرْدٌ كَبُرْدٍ فَكَانَ الْأَجَلُ بَيْنِي وَبَيْنَهَا عَشْرًا فَبِتُّ عِنْدَهَا لَيْلَةً فَأَصْبَحْتُ فَخَرَجْتُ فَإِذَا رَسُولُ اللهِ ﷺ قَائِمٌ بَيْنَ الرُّكْنِ وَالْمَقَامِ وَهُوَ يَقُولُ يَا أَيُّهَا النَّاسُ كُنْتُ أَذِنْتُ لَكُمْ فِي الِاسْتِمْتَاعِ مِنْ هَذِهِ النِّسَاءِ أَلَا وَإِنِّي قَدْ حَرَّمْتُ ذَلِكَ إِلَى يَوْمِ الْقِيَامَةِ فَمَنْ بَقِيَ عِنْدَهُ مِنْهُنَّ شَيْءٌ فَلْيُخَلِّ سَبِيلَهَا وَلَا تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا 14156 وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ أنبأ أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ أنبأ جَعْفَرُ بْنُ عَوْنٍ أنبأ عَبْدُ الْعَزِيزِ بْنُ عُمَرَ حَدَّثَنِي الرَّبِيعُ بْنُ سَبْرَةَ أَنَّ أَبَاهُ حَدَّثَهُ أَنَّهُمْ سَارُوا مَعَ رَسُولِ اللهِ ﷺ حَتَّى بَلَغُوا عُسْفَانَ فَكَلَّمَهُ رَجُلٌ مِنْ بَنِي مُدْلِجٍ فَذَكَرَ الْحَدِيثَ بِنَحْوِهِ وَكَذَلِكَ
[Machine] That the Messenger of Allah ﷺ forbade the pleasure of women on the day of victory.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى يَوْمَ الْفَتْحِ عَنْ مُتْعَةِ النِّسَاءِ
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ نِكَاحِ الْمُتْعَةِ
Mutʿah marriage was prohibited the year of the Conquest or the Farewell Ḥajj
the Messenger of Allah ﷺ prohibited mutʿah (temporary/pleasure) marriage in the year of the conquest ˹of Makkah.˺
نَهَى رَسُولُ اللهِ ﷺ عَنْ نِكَاحِ الْمُتْعَةِ عَامَ الْفَتْحِ
[Machine] The Messenger of Allah, ﷺ , prohibited it in the Farewell Hajj. This is what he said, and the narration of the majority from Az-Zuhri is more authentic. The narration of Salamah ibn Al-Akwa' regarding the permission in it, then the prohibition is in agreement with the narration of Sabrah ibn Ma'bad.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْهَا فِي حَجَّةِ الْوَدَاعِ كَذَا قَالَ وَرِوَايَةُ الْجَمَاعَةِ عَنِ الزُّهْرِيِّ أَوْلَى وَحَدِيثُ سَلَمَةَ بْنِ الْأَكْوَعِ ؓ فِي الْإِذْنِ فِيهِ ثُمَّ النَّهْيِ عَنْهُ مُوَافِقٌ لِحَدِيثِ سَبْرَةَ بْنِ مَعْبَدٍ
[Machine] The Messenger of Allah ﷺ allowed temporary marriage with women for a period of three days, then he prohibited it afterwards.
رَخَّصَ رَسُولُ اللهِ ﷺ فِي مُتْعَةِ النِّسَاءِ عَامَ أَوْطَاسٍ ثَلَاثَةَ أَيَّامٍ ثُمَّ نَهَى عَنْهَا بَعْدُ
[Machine] "He said, 'Indeed, that was only in the context of jihad, and women were few.' Ibn Abbas then said, 'He spoke the truth.'"
لَهُ إِنَّمَا كَانَ ذَلِكَ فِي الْجِهَادِ وَالنِّسَاءُ قَلِيلٌ قَالَ فَقَالَ ابْنُ عَبَّاسٍ ؓ صَدَقَ
[Machine] He has a loyal follower. Indeed, this is rare among women. And the situation is critical. So Ibn Abbas said, "Yes."
لَهُ مَوْلًى لَهُ إِنَّمَا كَانَ ذَلِكَ وَفِي النِّسَاءِ قِلَّةٌ وَالْحَالُ شَدِيدٌ فَقَالَ ابْنُ عَبَّاسٍ نَعَمْ
Allah has made blind the hearts of some people as He has deprived them of eyesight that they give religious verdict in favour of temporary marriage, while he was alluding to a person (Ibn 'Abbas). Ibn Abbas called him and said: You are an uncouth person, devoid of sense. By my life, Mut'a was practised during the lifetime of the leader of the pious (he meant Messenger of Allah, may peace be upon him), and Ibn Zubair said to him: just do it yourselves, and by Allah, if you do that I will stone you with your stones. Ibn Shihab said. Khalid b. Muhajir b. Saifullah informed me: While I was sitting in the company of a person, a person came to him and he asked for a religious verdict about Mut'a and he permitted him to do it. Ibn Abu 'Amrah al-Ansari (Allah be pleased with him) said to him: Be gentle. It was permitted in- the early days of Islam, (for one) who was driven to it under the stress of necessity just as (the eating of) carrion and the blood and flesh of swine and then Allah intensified (the commands of) His religion and prohibited it (altogether). Ibn Shihab reported: Rabi' b. Sabra told me that his father (Sabra) said: I contracted temporary marriage with a woman of Banu 'Amir for two cloaks during the lifetime of Messenger of Allah ﷺ ; then he forbade us to do Mut'a. Ibn Shihab said: I heard Rabi' b. Sabra narrating it to Umar b. 'Abd al-'Aziz and I was sitting there. (Using translation from Muslim 1406k)
إِنَّ نَاسًا أَعْمَى اللهُ قُلُوبَهُمْ كَمَا أَعْمَى أَبْصَارَهُمْ يُفْتُونَ بِالْمُتْعَةِ وَيُعَرِّضُ بِالرَّجُلِ فَنَادَاهُ فَقَالَ إنك جِلْفٌ جَافٍ فَلَعَمْرِي لَقَدْ كَانَتِ الْمُتْعَةُ تُفْعَلُ فِي عَهْدِ إِمَامِ الْمُتَّقِينَ يُرِيدُ رَسُولَ اللهِ ﷺ فَقَالَ ابْنُ الزُّبَيْرِ فَجَرِّبْ بِنَفْسِكَ فَوَاللهِ لَئِنْ فَعَلْتَهَا لَأَرْجُمَنَّكَ بِأَحْجَارِكَ قَالَ ابْنُ شِهَابٍ فَأَخْبَرَنِي خَالِدُ بْنُ الْمُهَاجِرِ بْنِ سَيْفِ اللهِ أَنَّهُ بَيْنَمَا هُوَ جَالِسٌ عِنْدَ رَجُلٍ جَاءَهُ رَجُلٌ فَاسْتَفْتَاهُ فِي الْمُتْعَةِ فَقَالَ لَهُ ابْنُ أَبِي عَمْرَةَ الْأَنْصَارِيُّ مَهْلًا مَا هِيَ وَاللهِ لَقَدْ فُعِلَتْ فِي عَهْدِ إِمَامِ الْمُتَّقِينَ قَالَ ابْنُ أَبِي عَمْرَةَ إِنَّهَا كَانَتْ رُخْصَةً فِي أَوَّلِ الْإِسْلَامِ لِمَنْ يُضْطَرُّ إِلَيْهَا كَالْمَيْتَةِ وَالدَّمِ وَلَحْمِ الْخِنْزِيرِ ثُمَّ أَحْكَمَ اللهُ الدِّينَ وَنَهَى عَنْهَا قَالَ ابْنُ شِهَابٍ وَأَخْبَرَنِي الرَّبِيعُ بْنُ سَبْرَةَ الْجُهَنِيُّ أَنَّ أَبَاهُ قَالَ قَدْ كُنْتُ اسْتَمْتَعْتُ فِي عَهْدِ رَسُولِ اللهِ ﷺ مِنِ امْرَأَةٍ مِنْ بَنِي عَامِرٍ بِبُرْدَيْنِ أَحْمَرَيْنِ ثُمَّ نَهَانَا رَسُولُ اللهِ ﷺ عَنِ الْمُتْعَةِ قَالَ ابْنُ شِهَابٍ وَسَمِعْتُ الرَّبِيعَ بْنَ سَبْرَةَ يُحَدِّثُ ذَلِكَ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ وَأَنَا جَالِسٌ
[Machine] And he said in the other house, "Do you have a single woman in your permission to prosthetic limbs?" So Ibn Abbas said, "What is this? I did not intend and I did not give a fatwa in pleasure. Indeed, pleasure is only allowed for the one who is in dire need. Indeed, it is like dead meat, blood, and pork."
وَقَالَ فِي الْبَيْتِ الْآخَرِ هَلْ لَكَ فِي رَخْصَةِ الْأَطْرَافِ آنِسَةٍ؟ فَقَالَ ابْنُ عَبَّاسٍ مَا هَذَا أَرَدْتُ وَمَا بِهَذَا أَفْتَيْتُ فِي الْمُتْعَةِ إِنَّ الْمُتْعَةَ لَا تَحِلُّ إِلَّا لِمُضْطَرٍّ أَلَا إِنَّمَا هِيَ كَالْمَيْتَةِ وَالدَّمِ وَلَحْمِ الْخِنْزِيرِ
[Machine] "He said regarding pleasure, it is forbidden like carrion, blood, pork, and this was narrated from Qasim ibn Walid from Ibn Abbas."
أَنَّهُ قَالَ فِي الْمُتْعَةِ هِيَ حَرَامٌ كَالْمَيْتَةِ وَالدَّمِ وَلَحْمِ الْخِنْزِيرِ وَرُوِيَ ذَلِكَ عَنِ الْقَاسِمِ بْنِ الْوَلِيدِ عَنِ ابْنِ عَبَّاسٍ
[Machine] The pleasure (mut'ah) existed in the early days of Islam, and they used to recite this verse {So whatever you enjoy [of marriage] from them} [Quran 4:24] to give them their dowries. A man would propose to a woman without having any knowledge of her, and he would marry her as much as he deemed necessary to satisfy his needs, protect his belongings, and improve his situation. Until this verse was revealed {Forbidden to you [for marriage] are your mothers} [Quran 4:23] until the end of the verse. Allah replaced the previous ruling, thus making mut'ah (temporary marriage) forbidden and abrogating its mention in the Quran, except for their wives or those their right hands possess. Anything other than this is considered Haram (forbidden).
كَانَتِ الْمُتْعَةُ فِي أَوَّلِ الْإِسْلَامِ وَكَانُوا يَقْرَءُونَ هَذِهِ الْآيَةَ {فَمَا اسْتَمْتَعْتُمْ} [النساء 24] بِهِ مِنْهُنَّ فَآتُوهُنَّ أُجُورَهُنَّ الْآيَةَ فَكَانَ الرَّجُلُ يَقْدَمُ الْبَلْدَةَ لَيْسَ لَهُ بِهَا مَعْرِفَةٌ فَيَزَّوَّجُ بِقَدْرِ مَا يَرَى أَنَّهُ يَفْرُغُ مِنْ حَاجَتِهِ لِتَحْفَظَ مَتَاعَهُ وَتُصْلِحُ لَهُ شَأْنَهُ حَتَّى نَزَلَتْ هَذِهِ الْآيَةُ {حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ} [النساء 23] إِلَى آخِرِ الْآيَةِ فَنَسَخَ اللهُ ﷻ الْأُولَى فَحُرِّمَتِ الْمُتْعَةُ وَتَصْدِيقُهَا مِنَ الْقُرْآنِ {إِلَّا عَلَى أَزْوَاجِهِمْ أَوْ مَا مَلَكَتْ أَيْمَانُهُمْ} [المؤمنون 6] وَمَا سِوَى هَذَا الْفَرْجِ فَهُوَ حَرَامٌ
[Machine] Jabir, we did both of them (referring to actions) with the Messenger of Allah ﷺ , then Umar prohibited us from them, and we did not return to them.
جَابِرٌ فَعَلْنَاهُمَا مَعَ رَسُولِ اللهِ ﷺ ثُمَّ نَهَانَا عَنْهُمَا عُمَرُ ؓ فَلَمْ نَعُدْ لَهُمَا
[Machine] On my hands, the conversation flowed; we enjoyed the company of the Messenger of Allah, ﷺ , and Abu Bakr. When Umar assumed authority, he addressed the people and said, "Indeed, the Messenger of Allah, ﷺ , is this Messenger and indeed, this is the Quran, this Quran. And verily, they were both sources of enjoyment during the time of the Messenger of Allah, ﷺ , but I prohibit them and will punish anyone who engages in them. One of them is the enjoyment of women, and I will stone the man who marries a woman for a certain period. The other is the enjoyment of performing Hajj. Separate your Hajj from your Umrah, for it is more complete for your Hajj and more complete for your Umrah."
عَلَى يَدِيَّ جَرَى الْحَدِيثُ تَمَتَّعْنَا مَعَ رَسُولِ اللهِ ﷺ وَمَعَ أَبِي بَكْرٍ ؓ فَلَمَّا وُلِّيَ عُمَرُ خَطَبَ النَّاسَ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ هَذَا الرَّسُولُ وَإِنَّ هَذَا الْقُرْآنَ هَذَا الْقُرْآنُ وَإِنَّهُمَا كَانَتَا مُتْعَتَانِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَأَنَا أَنْهَى عَنْهُمَا وَأُعَاقِبُ عَلَيْهِمَا إِحْدَاهُمَا مُتْعَةُ النِّسَاءِ وَلَا أَقْدِرُ عَلَى رَجُلٍ تَزَوَّجَ امْرَأَةً إِلَى أَجَلٍ إِلَّا غَيَّبْتُهُ بِالْحِجَارَةِ وَالْأُخْرَى مُتْعَةُ الْحَجِّ افْصِلُوا حَجَّكُمْ مِنْ عُمْرَتِكُمْ فَإِنَّهُ أَتَمُّ لِحَجِّكُمْ وَأَتَمُّ لِعُمْرَتِكُمْ
[Machine] Umar ascended the pulpit and praised Allah and glorified Him, then he said, "What is with these men who engage in temporary marriage (mut'ah) even though the Messenger of Allah ﷺ has forbidden it? Indeed, I do not punish anyone who engages in it except by stoning." If this narration is authentic, it would indicate that Umar (may Allah be pleased with him) only forbade mut'ah because he knew about the prohibition of the Prophet ﷺ on it.
صَعِدَ عُمَرُ عَلَى الْمِنْبَرِ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ مَا بَالُ رِجَالٍ يَنْكِحُونَ هَذِهِ الْمُتْعَةَ وَقَدْ نَهَى رَسُولُ اللهِ ﷺ عَنْهَا أَلَا وَإِنِّي لَا أُوتَى بِأَحَدٍ نَكَحَهَا إِلَّا رَجَمْتُهُ فَهَذَا إِنْ صَحَّ يُبَيِّنُ أَنَّ عُمَرَ ؓ إِنَّمَا نَهَى عَنْ نِكَاحِ الْمُتْعَةِ لِأَنَّهُ عَلِمَ نَهْيَ النَّبِيِّ ﷺ عَنْهُ
[Machine] This pleasure, even if I advance in it, I would still reject it.
هَذِهِ الْمُتْعَةُ وَلَوْ كُنْتُ تَقَدَّمْتُ فِيهِ لَرَجَمْتُهُ
[Machine] It is forbidden. If anyone had done that to her, Umar ibn al-Khattab would have stoned him with rocks.
حَرَامٌ أَمَا إِنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ لَوْ أَخَذَ فِيهَا أَحَدٌ لَرَجَمَهُ بِالْحِجَارَةِ
[Machine] "And between them is the Book of God, and I recited this verse: 'And those who guard their private parts, except from their wives or those their right hands possess, for indeed, they are not to be blamed. But whoever seeks after that, then they are the transgressors.' [Al-Mu'minun: 6] So whoever seeks after what Allah has forbidden in marriage or ownership, then he has transgressed." وَبَيْنَهُمْ كِتَابُ اللهِ ﷻ وَقَرَأَتْ هَذِهِ الْآيَةَ {وَالَّذِينَ هُمْ لِفُرُوجِهِمْ حَافِظُونَ إِلَّا عَلَى أَزْوَاجِهِمْ أَوْ مَا مَلَكَتْ أَيْمَانُهُمْ فَإِنَّهُمْ غَيْرُ مَلُومِينَ فَمَنِ ابْتَغَى وَرَاءَ ذَلِكَ فَأُولَئِكَ هُمُ الْعَادُونَ} [المؤمنون 6] فَمَنِ ابْتَغَى وَرَاءَ مَا زَوَّجَهُ اللهُ أَوْ مَلَّكَهُ فَقَدْ عَدَا وَرُوِيَ فِي ذَلِكَ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ عَنْ عَائِشَةَ ؓ
[Machine] To marry a woman, the only valid marriage in Islam, he must pay her dowry, inherit from her, and be inherited by her. He cannot divorce her for a fixed period of time, as she is his wife. If one of them dies, they do not inherit from each other.
أَنْ يَنْكِحَ امْرَأَةً إِلَّا نِكَاحَ الْإِسْلَامِ يُمْهِرُهَا وَيَرِثُهَا وَتَرِثُهُ وَلَا يُقَاضِيهَا عَلَى أَجَلٍ مَعْلُومٍ إِنَّهَا امْرَأَتُهُ فَإِنْ مَاتَ أَحَدُهُمَا لَمْ يَتَوَارَثَا
[Machine] "It was only permitted for us, the companions of the Messenger of Allah ﷺ , to engage in temporary marriage with women for three days, but then the Messenger of Allah ﷺ prohibited it."
إِنَّمَا أُحِلَّتْ لَنَا أَصْحَابِ رَسُولِ اللهِ ﷺ مُتْعَةُ النِّسَاءِ ثَلَاثَةَ أَيَّامٍ ثُمَّ نَهَى عَنْهَا رَسُولُ اللهِ ﷺ
إِنْ كَانَتِ الْمُتْعَةُ لِخَوْفِنَا وَلِحَرْبِنَا
[Machine] "We accompanied the Messenger of Allah, ﷺ , in the expedition of Tabuk, and he camped at Thaniyyat al-Wadaa'. He saw women crying, so he asked, 'What is this?' It was said, 'They are women who were enjoying themselves with their husbands, but then their husbands left them.' The Messenger of Allah, ﷺ , said, 'He has forbidden or destroyed the pleasure of temporary marriage (mut'ah), divorce, waiting period after divorce, and inheritance. And likewise...'"
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ تَبُوكَ فَنَزَلَ بِثَنِيَّةِ الْوَدَاعِ فَرَأَى نِسَاءً يَبْكِينَ فَقَالَ مَا هَذَا؟ قِيلَ نِسَاءٌ تَمَتَّعَ بِهِنَّ أَزْوَاجُهُنَّ ثُمَّ فَارَقُوهُنَّ فَقَالَ رَسُولُ اللهِ ﷺ حَرَّمَ أَوْ هَدَمَ الْمُتْعَةَ النِّكَاحُ وَالطَّلَاقُ وَالْعِدَّةُ وَالْمِيرَاثُ وَكَذَلِكَ
نَسَخَ الْمُتْعَةَ الْمِيرَاثُ
[Machine] Abu Amr al-Adibi informed us that Abu Bakr al-Isma'ili narrated the hadith with his chain of narration from Abdullah bin Mas'ud regarding mut'ah. Uqbah narrated it, and Abu Mu'awiyah narrated it from Isma'il bin Abi Khalid, from Qays, from Abdullah. This is the hadith, and he said at the end, "Then that was abandoned." And in the hadith of Ibn al-Musaffa from Ibn 'Uyaynah, from Isma'il at the end, "Then its prohibition came after." And in the hadith of Abdur Razzaq from Ma'mar, from Isma'il, from Qays regarding the abrogation of that, meaning mut'ah.
أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ فَذَكَرَ الْحَدِيثَ بِإِسْنَادِهِ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ فِي الْمُتْعَةِ قَالَ عُقْبَةُ وَرَوَى أَبُو مُعَاوِيَةَ عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ عَنْ قَيْسٍ عَنْ عَبْدِ اللهِ هَذَا الْحَدِيثَ وَقَالَ فِي آخِرِهِ ثُمَّ تُرِكَ ذَاكَ قَالَ وَفِي حَدِيثِ ابْنِ الْمُصَفَّى عَنِ ابْنِ عُيَيْنَةَ عَنْ إِسْمَاعِيلَ فِي آخِرِهِ ثُمَّ جَاءَ تَحْرِيمُهَا بَعْدُ وَفِي حَدِيثِ عَبْدِ الرَّزَّاقِ عَنْ مَعْمَرٍ عَنْ إِسْمَاعِيلَ عَنْ قَيْسٍ بِنَسْخِ ذَلِكَ يَعْنِي الْمُتْعَةَ
[Machine] The Messenger of Allah ﷺ forbade temporary marriage, He said: "It was only allowed for those who could not find (permanent marriage). But when the rules of marriage, divorce, waiting period, and inheritance were revealed, temporary marriage was abrogated."
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُتْعَةِ قَالَ وَإِنَّمَا كَانَتْ لِمَنْ لَمْ يَجِدْ فَلَمَّا أُنْزِلَ النِّكَاحُ وَالطَّلَاقُ وَالْعِدَّةُ وَالْمِيرَاثُ بَيْنَ الزَّوْجِ وَالْمَرْأَةِ نُسِخَتْ
