39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] The Messenger of Allah ﷺ forbade "shighar", and "shighar" is when a man marries off his daughter on the condition that the other man will marry off his daughter in return, but there is no dowry between them. Yahya did not mention the other man.
رَسُولَ اللهِ ﷺ نَهَى عَنِ الشِّغَارِ وَالشِّغَارُ أَنْ يُزَوِّجَ الرَّجُلُ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ الرَّجُلُ الْآخَرُ ابْنَتَهُ وَلَيْسَ بَيْنَهُمَا صَدَاقٌ وَلَمْ يَذْكُرْ يَحْيَى الرَّجُلَ الْآخَرَ
[Machine] "The Messenger of Allah ﷺ forbade injustice. I said to Nafi', 'What is injustice?' He said, 'It is when a man marries the daughter of another man without paying a bride-price, and he marries his own daughter without paying a bride-price, and he marries the sister of another man without paying a bride-price, and he marries his own sister without paying a bride-price.'"
رَسُولَ اللهِ ﷺ نَهَى عَنِ الشِّغَارِ قُلْتُ لِنَافِعٍ مَا الشِّغَارُ؟ قَالَ يَنْكِحُ ابْنَةَ الرَّجُلِ وَيُنْكِحُهُ ابْنَتَهُ بِغَيْرِ صَدَاقٍ وَيَنْكِحُ أُخْتَ الرَّجُلِ وَيُنْكِحُهُ أُخْتَهُ بِغَيْرِ صَدَاقٍ
[Machine] The Messenger of Allah ﷺ prohibited from reciprocal matchmaking. Reciprocal matchmaking means when a man says to another man, "Marry my daughter and I will marry your daughter. Marry my sister and I will marry your sister."
نَهَى رَسُولُ اللهِ ﷺ عَنِ الشِّغَارِ زَادَ ابْنُ نُمَيْرٍ وَالشِّغَارُ أَنْ يَقُولَ الرَّجُلُ لِلرَّجُلِ زَوِّجْنِي ابْنَتَكَ وَأُزَوِّجُكَ ابْنَتِي وَزَوِّجْنِي أُخْتَكَ وَأُزَوِّجُكَ أُخْتِي
[Machine] He heard Jabir ibn Abdullah saying, "The Prophet ﷺ forbade wearing iron rings."
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ ؓ يَقُولُ نَهَى النَّبِيُّ ﷺ عَنِ الشِّغَارِ
[Machine] The Prophet ﷺ prohibited marrying a woman and marrying her sister without giving a dowry for one of them and exchanging the dowry for the other one.
نَهَى النَّبِيُّ ﷺ عَنِ الشِّغَارِ وَالشِّغَارُ أَنْ يَنْكِحَ هَذِهِ بِهَذِهِ بِغَيْرِ صَدَاقٍ بَضْعُ هَذِهِ صَدَاقَ هَذِهِ وَيَضَعُ هَذِهِ صَدَاقَ هَذِهِ
[Machine] The Prophet ﷺ said: "There is no shigar in Islam." This narration was also narrated by Amr ibn Shuayb from his father from his grandfather from the Prophet ﷺ, and the descendants of Wael ibn Hujr from their fathers from Wael ibn Hujr from the Prophet ﷺ.
أَنَّ النَّبِيَّ ﷺ قَالَ لَا شِغَارَ فِي الْإِسْلَامِ وَرَوَاهُ أَيْضًا عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ وَأَوْلَادُ وَائِلِ بْنِ حُجْرٍ عَنْ آبَائِهِمْ عَنْ وَائِلِ بْنِ حُجْرٍ عَنِ النَّبِيِّ ﷺ
Al-Abbas ibn Abdullah ibn al-Abbas married his daughter to Abdur Rahman ibn al-Hakam, and AbdurRahman married his daughter to him. And they made this (exchange) their dower. Mu'awiyah wrote to Marwan commanding him to separate them. He wrote in his letter: This is the shighar which the Messenger of Allah ﷺ has forbidden. (Using translation from Abū Dāʾūd 2075)
