39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] A narrated incident in which the Prophet Muhammad, ﷺ , found a young she-camel. It was said to him, "O Messenger of Allah, a beautiful young she-camel has been found." He then bought it for nine dirhams and gave it to Umm Sulaim to take care of and prepare. It is estimated that she was maid in her house and her name was Safiyyah, daughter of Huwayy. The Prophet, ﷺ , provided the dates, meat, and ghee for her. The land was plowed and then the sheep were brought and slaughtered. Dates and ghee were added, and the people were satisfied. The people then asked, "We do not know if he married her or took her as a concubine." He replied, "If he covered her, then she is his wife, and if he did not cover her, then she is a concubine." When he intended to mount her on the camel, he covered her until she sat on the camel's saddle. They knew then that he had married her.
وَقَعَ فِي سَهْمِ دِحْيَةَ جَارِيَةٌ فَقِيلَ يَا رَسُولَ اللهِ إِنَّهُ وَقَعَتْ فِي سَهْمِ دِحْيَةَ جَارِيَةٌ جَمِيلَةٌ قَالَ فَاشْتَرَاهَا رَسُولُ اللهِ ﷺ بِتِسْعَةِ أَرْؤُسٍ ثُمَّ دَفَعَهَا إِلَى أُمِّ سُلَيْمٍ تَصْنَعُهَا وَتُهَيِّئُهَا قَالَ وَأَحْسَبُهُ قَالَ تَعْتَدُّ فِي بَيْتِهَا وَهِيَ صَفِيَّةُ بِنْتُ حُيَيٍّ فَجَعَلَ رَسُولُ اللهِ ﷺ وَلِيمَتَهَا التَّمْرَ وَالْأَقِطَ وَالسَّمْنَ قَالَ فُحِصَتِ الْأَرْضُ أَفَاحِيصَ وَجِيءَ بِالْأَنْطَاعِ فَوُضِعَتْ فِيهَا ثُمَّ جِيءَ بِالْأَقِطِ وَالسَّمْنِ فَشَبِعَ النَّاسُ قَالَ وَقَدْ قَالَ النَّاسُ لَا نَدْرِي أَتَزَوَّجَهَا أَمِ اتَّخَذَهَا أُمَّ وَلَدٍ قَالَ فَقَالُوا إِنْ حَجَبَهَا فَهِيَ امْرَأَتُهُ وَإِنْ لَمْ يَحْجُبْهَا فَهِيَ أُمُّ وَلَدٍ فَلَمَّا أَرَادَ أَنْ يُرْكِبَهَا حَجَبَهَا حَتَّى قَعَدَتْ عَلَى عَجُزِ الْبَعِيرِ فَعَرَفُوا أَنَّهُ قَدْ تَزَوَّجَهَا
Conditions for a valid Nikāḥ except in the case of the Prophet ﷺ with Zaynab b. Jaḥsh
There is no marriage except by a guardian (walī) and witnesses and a mahr ˹payment˺, except for what was for the Prophet ﷺ.
لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَشُهُودٍ وَمَهْرٍ إِلَّا مَا كَانَ مِنَ النَّبِيِّ ﷺ
