39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] The writer Al-Bisṭāmī reported from Anba Abū Bakr Al-Ismāʿīlī, who reported from Abū Al-Qāsim Al-Baghawī, who narrated from Mansur ibn Abī Muzāḥim, who narrated from Abū Saʿīd Al-Muaddib, who narrated from Hishām ibn ʿUrwah, who narrated from his father, who narrated from ʿĀ'ishah. She said, "The woman who gifted herself to the Prophet, ﷺ , was Khawlah bint Ḥakīm." Imam Al-Bukhārī, may Allah have mercy on him, referred to this narration and included it in his narration from Muhammad ibn Fuḍayl, who narrated from Hishām, who narrated from his father, who said, "Khawlah was one of the women who gifted themselves to the Messenger of Allah, ﷺ ."
الْأَدِيبُ الْبِسْطَامِيُّ أنبا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أنبأ أَبُو الْقَاسِمِ الْبَغَوِيُّ ثنا مَنْصُورُ بْنُ أَبِي مُزَاحِمٍ ثنا أَبُو سَعِيدٍ الْمُؤَدِّبُ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ ؓ قَالَتْ الَّتِي وَهَبَتْ نَفْسَهَا لِلنَّبِيِّ ﷺ خَوْلَةُ بِنْتُ حَكِيمٍ أَشَارَ الْبُخَارِيُّ رَحِمَهُ اللهُ إِلَى هَذِهِ الرِّوَايَةِ وَأَخْرَجَهُ مِنْ حَدِيثِ مُحَمَّدِ بْنِ فُضَيْلٍ عَنْ هِشَامٍ عَنْ أَبِيهِ قَالَ كَانَتْ خَوْلَةُ ؓ مِنَ اللَّاتِي وَهَبْنَ أَنْفُسَهُنَّ لِرَسُولِ اللهِ ﷺ فَذَكَرَ هَذِهِ اللَّفْظَةَ مِنْ قَوْلِ عُرْوَةَ
[Machine] I used to envy those who offered themselves to the Messenger of Allah ﷺ, and I would say, "Does a woman give herself willingly?" But when Allah ﷻ revealed, "You may defer any of them you wish and take to yourself any you wish" [Quran 33:51], I said, "By Allah, I see that your Lord hurries to fulfill your desires."
كُنْتُ أَغَارُ عَلَى اللَّاتِي وَهَبْنَ أَنْفُسَهُنَّ لِرَسُولِ اللهِ ﷺ وَأَقُولُ أَتَهَبُ الْمَرْأَةُ نَفْسَهَا؟ فَلَمَّا أَنْزَلَ اللهُ ﷻ {تُرْجِي مَنْ تَشَاءُ مِنْهُنَّ وَتُؤْوِي إِلَيْكَ مَنْ تَشَاءُ} [الأحزاب 51] فَقُلْتُ وَاللهِ مَا أَرَى رَبَّكَ إِلَّا يُسَارِعُ لَكَ فِي هَوَاكَ
[Machine] And he gifted some of his wives to the Messenger of Allah ﷺ. He entered upon some of them and divorced others, but he did not approach them until he passed away. After him, none of them married except Umm Sharik. This is what Allah the Exalted said, "You may put off whom you please of them, and you may take to you whom you please, and whom you desire of those whom you had separated provisionally, no blame attaches to you." [Surah Al-Ahzab 51] Thus spoke Ash-Sha'bi.
وَهَبْنَ لِرَسُولِ اللهِ ﷺ نِسَاءٌ أَنْفُسَهُنَّ فَدَخَلَ بِبَعْضِهِنَّ وَأَرْجَى بَعْضَهُنَّ وَلَمْ يَقْرَبْهُنَّ حَتَّى تُوُفِّيَ وَلَمْ يَنْكِحْنَ بَعْدَهُ مِنْهُنَّ أُمُّ شَرِيكٍ فَذَلِكَ قَوْلُهُ تَعَالَى {تُرْجِي مَنْ تَشَاءُ مِنْهُنَّ وَتُؤْوِي إِلَيْكَ مَنْ تَشَاءُ وَمَنِ ابْتَغَيْتَ مِمَّنْ عَزَلْتَ فَلَا جُنَاحَ عَلَيْكَ} [الأحزاب 51] كَذَا قَالَ الشَّعْبِيُّ
[Machine] There was no woman with the Messenger of Allah ﷺ who offered herself to him, and if the chain of narrators of this hadith is authentic, it seems as if he ﷺ rejected them, even if it was lawful for him, and Allah knows best.
لَمْ يَكُنْ عِنْدَ رَسُولِ اللهِ ﷺ امْرَأَةٌ وَهَبَتْ نَفْسَهَا لَهُ فَعَلَى هَذَا إِنْ صَحَّ إِسْنَادُهُ كَأَنَّهُ ﷺ أَرْجَاهُنَّ وَلَمْ يَقْبَلْهُنَّ وَإِنْ كَانَتْ حَلَالًا لَهُ وَاللهُ أَعْلَمُ
[Machine] Gifts cannot be accepted after the death of the Messenger of Allah, even if it is given sincerely, it is not permissible.
لَا تَحِلُّ الْهِبَةُ بَعْدَ رَسُولِ اللهِ ﷺ وَلَوْ أَصْدَقَهَا سَوْطًا أُحِلَّتْ
