٣٩۔ كِتَابُ النِّكَاحِ
[Machine] Ghaylan bin Salamah embraced Islam, and he had ten women under his guardianship. The Prophet ﷺ commanded him to choose four of them and leave the rest. According to the narration of Ash-Shafi'i, Ghaylan bin Salamah ath-Thaqafi embraced Islam while having ten women with him, so the Prophet ﷺ told him to keep four and separate from the others.
أَسْلَمَ غَيْلَانُ بْنُ سَلَمَةَ وَتَحْتَهُ عَشْرُ نِسْوَةٍ فَأَمَرَ النَّبِيُّ ﷺ أَنْ يَخْتَارَ مِنْهُنَّ أَرْبَعًا وَيَتْرُكَ سَائِرَهُنَّ لَفْظُ حَدِيثِ إِسْحَاقَ 14041 وَفِي رِوَايَةِ الشَّافِعِيِّ أَنَّ غَيْلَانَ بْنَ سَلَمَةَ الثَّقَفِيَّ أَسْلَمَ وَعِنْدَهُ عَشْرُ نِسْوَةٍ فَقَالَ لَهُ النَّبِيُّ ﷺ أَمْسِكْ أَرْبَعًا وَفَارِقْ سَائِرَهُنَّ
[Machine] His name is Ghaylan bin Salamah Al-Thaqafi. During the pre-Islamic era, he had ten wives under his authority. He and his wives all embraced Islam. The Prophet Muhammad ﷺ instructed him to choose four of them, and he did so.
يُقَالُ لَهُ غَيْلَانُ بْنُ سَلَمَةَ الثَّقَفِيُّ كَانَ تَحْتَهُ فِي الْجَاهِلِيَّةِ عَشْرُ نِسْوَةٍ فَأَسْلَمَ وَأَسْلَمْنَ مَعَهُ فَأَمَرَهُ النَّبِيُّ ﷺ أَنْ يَتَخَيَّرَ مِنْهُنَّ أَرْبَعًا وَكَذَلِكَ
[Machine] The narrator Abu Abdullah Al-Hafiz and Abu Abdul Rahman Al-Sulami told us that Yahya ibn Mansur Al-Qadi narrated a hadith from Ali ibn Abdul Aziz, from Abu Ubaid, from Yahya ibn Saeed, from Sufyan, from Ma'mar, from Al-Zuhri, from Salim, from his father, that Ghaylan ibn Salamah Al-Thaqafi converted to Islam and he had ten wives. The Messenger of Allah ﷺ commanded him to choose four of them. This narration was also reported by Abdul Rahman ibn Muhammad Al-Muharibi and Isa ibn Yunus, both of whom from Ma'mar, and these three narrators are from Kufa. Abu Al-Fadl ibn Musa Al-Sinani, who is from Khorasan, also narrated it from Ma'mar. Abdur Razzaq also narrated it from Ma'mar and sent it.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ قَالَا ثنا يَحْيَى بْنُ مَنْصُورٍ الْقَاضِي ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ثنا أَبُو عُبَيْدٍ ثنا يَحْيَى بْنُ سَعِيدٍ عَنْ سُفْيَانَ عَنْ مَعْمَرٍ عَنِ الزُّهْرِيِّ عَنْ سَالِمٍ عَنْ أَبِيهِ أَنَّ غَيْلَانَ بْنَ سَلَمَةَ الثَّقَفِيَّ أَسْلَمَ وَعِنْدَهُ عَشْرُ نِسْوَةٍ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يَخْتَارَ مِنْهُنَّ أَرْبَعًا وَهَكَذَا رَوَى عَنْ عَبْدِ الرَّحْمَنِ بْنِ مُحَمَّدٍ الْمُحَارِبِيِّ وَعِيسَى بْنِ يُونُسَ عَنْ مَعْمَرٍ وَهَؤُلَاءِ الثَّلَاثَةُ كُوفِيُّونَ وَأَبُو الْفَضْلِ بْنُ مُوسَى السِّينَانِيُّ وَهُوَ خُرَاسَانِيٌّ عَنْ مَعْمَرٍ هَكَذَا مَوْصُولًا وَرَوَاهُ عَبْدُ الرَّزَّاقِ عَنْ مَعْمَرٍ فَأَرْسَلَهُ
[Machine] That Ghaylan bin Salamah converted to Islam and he had ten wives. So the Messenger of Allah ﷺ ordered him to choose four of them, and he did so.
أَنَّ غَيْلَانَ بْنَ سَلَمَةَ أَسْلَمَ وَعِنْدَهُ عَشْرُ نِسْوَةٍ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يَخْتَارَ مِنْهُنَّ أَرْبَعًا وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said to a man from Thaqif, who had embraced Islam and had ten wives, "Keep four of them and separate from the rest, and do likewise."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِرَجُلٍ مِنْ ثَقِيفٍ أَسْلَمَ وَعِنْدَهُ عَشْرُ نِسْوَةٍ أَمْسِكْ أَرْبَعًا وَفَارِقْ سَائِرَهُنَّ وَكَذَلِكَ
[Machine] That the Messenger of Allah ﷺ said to Ghaillan ibn Salamah, when he became Muslim and he had ten women under him, "Choose four of them and separate from the others." Abu Abdullah al-Hafiz narrated to us, Abu al-Abbas Muhammad ibn Ya'qub narrated to us, Al-Hasan ibn Mukram al-Bazzaz narrated to us, Uthman ibn Umar informed us, Yunus narrated to us from al-Zuhri, from Muhammad ibn Abu Suwaid, and he mentioned it.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِغَيْلَانَ بْنِ سَلَمَةَ حِينَ أَسْلَمَ وَتَحْتَهُ عَشْرُ نِسْوَةٍ اخْتَرْ مِنْهُنَّ أَرْبَعًا وَفَارِقْ سَائِرَهُنَّ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْحَسَنُ بْنُ مُكْرَمٍ الْبَزَّازُ ثنا عُثْمَانُ بْنُ عُمَرَ أنبأ يُونُسُ عَنِ الزُّهْرِيِّ عَنْ مُحَمَّدِ بْنِ أَبِي سُوَيْدَ فَذَكَرَهُ
[Machine] Allah said to Ghaylan ibn Salamah, when he embraced Islam and had ten wives, "Choose four of them and divorce the rest." This information was narrated to us by Muhammad ibn Abdullah al-Hafiz, who was informed by Abu al-Hasan Ahmad ibn Muhammad ibn Abdus, who was informed by Uthman ibn Sa'id al-Darimi, who was informed by Abdullah ibn Salih, who was informed by Layth, who mentioned it in the same way.
اللهِ ﷺ قَالَ لِغَيْلَانَ بْنِ سَلَمَةَ لَمَّا أَسْلَمَ وَتَحْتَهُ عَشْرُ نِسْوَةٍ اخْتَرْ مِنْهُنَّ أَرْبَعًا وَطَلِّقْ سَائِرَهُنَّ أَخْبَرَنَاهُ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْحَسَنِ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ عَبْدُوسٍ ثنا عُثْمَانُ بْنُ سَعِيدٍ الدَّارِمِيُّ ثنا عَبْدُ اللهِ بْنُ صَالِحٍ أنبأ اللَّيْثُ عَنْ عُقَيْلٍ فَذَكَرَهُ وَكَذَلِكَ
[Machine] Ghaylan ibn Salamah al-Thaqafi embraced Islam and he had nine wives. The Messenger of Allah ﷺ ordered him to choose four of them to transmit the narration of Ibn Najiyah. In another narration of al-Nasa' I, Siraar ibn Mujashshir is mentioned instead. He said, "Ghaylan ibn Salamah had ten wives and they embraced Islam with him." Ibn Najiyah added in his narration, "When the time of 'Umar came, he divorced his wives and distributed his wealth. 'Umar said to him, 'Either you take back your wives and your wealth, or I will stone you to death like the grave of Abu Righal was stoned.' Abu 'Ali (may Allah have mercy on him), a reliable person from Basrah, said that Siraar ibn Mujashshir narrated this incident exclusively and he was a trustworthy person."
أَنَّ غَيْلَانَ بْنَ سَلَمَةَ الثَّقَفِيَّ أَسْلَمَ وَعِنْدَهُ تِسْعُ نِسْوَةٍ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يَخْتَارَ مِنْهُنَّ أَرْبَعًا لَفْظُ حَدِيثِ ابْنِ نَاجِيَةَ وَفِي رِوَايَةِ النَّسَائِيِّ سِرَارُ بْنُ مُجَشِّرٍ وَقَالَ إِنَّ غَيْلَانَ بْنَ سَلَمَةَ كَانَ عِنْدَهُ عَشْرُ نِسْوَةٍ فَأَسْلَمَ وَأَسْلَمْنَ مَعَهُ زَادَ ابْنُ نَاجِيَةَ فِي رِوَايَتِهِ قَالَ فَلَمَّا كَانَ زَمَانُ عُمَرَ طَلَّقَ نِسَاءَهُ وَقَسَمَ مَالَهُ فَقَالَ لَهُ عُمَرُ ؓ لَتَرْجِعَنَّ فِي مَالِكَ وَفِي نِسَائِكَ أَوْ لَأَرْجُمَنَّ قَبْرَكَ كَمَا رُجِمَ قَبْرُ أَبِي رِغَالٍ قَالَ أَبُو عَلِيٍّ رَحِمَهُ اللهُ تَفَرَّدَ بِهِ سِرَارُ بْنُ مُجَشِّرٍ وَهُوَ بَصْرِيٌّ ثِقَةٌ
[Machine] Ghaylan bin Salamah embraced Islam, and he had ten women with him. The Messenger of Allah ﷺ ordered him to keep four of them and separate from the rest. Safwan bin Umayyah also embraced Islam, and he had eight women with him. The Messenger of Allah ﷺ ordered him to keep four of them and separate from the rest.
أَسْلَمَ غَيْلَانُ بْنُ سَلَمَةَ وَتَحْتَهُ عَشْرُ نِسْوَةٍ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُمْسِكَ أَرْبَعًا وَيُفَارِقَ سَائِرَهُنَّ قَالَ وَأَسْلَمَ صَفْوَانُ بْنُ أُمَيَّةَ وَعِنْدَهُ ثَمَانِ نِسْوَةٍ فَأَمَرَهُ رَسُولُ اللهِ ﷺ أَنْ يُمْسِكَ أَرْبَعًا وَيُفَارِقَ سَائِرَهُنَّ
[Machine] The son of Abu Layla was commanded by the Prophet ﷺ to select four of them, and Al-Kalbi said: Al-Harith said, "O Messenger of Allah, I have embraced Islam and I have eight women who have embraced Islam with me and migrated with me." So the Messenger of Allah ﷺ said, "Choose four of them." So I started saying to the ones I wanted to keep, "Accept it" and to the ones I wanted to separate from, "Turn away." He said, "Then she would say, 'I ask you by the womb, I ask you by the child.'" Al-Kalbi said: Abu Salih narrated from Al-Harith bin Qais similar to that.
ابْنُ أَبِي لَيْلَى فَأَمَرَهُ النَّبِيُّ ﷺ أَنْ يَخْتَارَ مِنْهُنَّ أَرْبَعًا وَقَالَ الْكَلْبِيُّ قَالَ الْحَارِثُ يَا رَسُولَ اللهِ قَدْ أَسْلَمْتُ وَعِنْدِي ثَمَانِ نِسْوَةٍ أَسْلَمْنَ مَعِي وَهَاجَرْنَ مَعِي فَقَالَ رَسُولُ اللهِ ﷺ اخْتَرْ مِنْهُنَّ أَرْبَعًا فَجَعَلْتُ أَقُولُ لِلَّتِي أُرِيدُ إِمْسَاكَهَا أَقْبِلِي وَلِلَّتِي أُرِيدُ فِرَاقَهَا أَدْبِرِي قَالَ فَتَقُولُ أَنْشُدُكَ الرَّحِمَ أَنْشُدُكَ الْوَلَدَ قَالَ الْكَلْبِيُّ وَثَنَا أَبُو صَالِحٍ عَنِ الْحَارِثِ بْنِ قَيْسٍ مِثْلَ ذَلِكَ
[Machine] The Prophet ﷺ chose four of them. Abu Dawud reported that Ahmed ibn Ibrahim reported from Hushaim about this hadith, and Qais bin Al-Harith replaced Harith bin Qais. Ahmed ibn Ibrahim said, "This is correct," which means Qais bin Al-Harith. Abu Dawud reported that Ahmed ibn Ibrahim reported from Bakr bin Abdul Rahman, the judge of Kufa, who reported from Isa bin Al-Mukhtar, who reported from Ibn Abi Layla, who reported from Humaydah bin Ash-Shamardal, who reported from Qais bin Al-Harith, with the same meaning.
النَّبِيُّ ﷺ اخْتَرْ مِنْهُنَّ أَرْبَعًا قَالَ أَبُو دَاوُدَ ثنا بِهِ أَحْمَدُ بْنُ إِبْرَاهِيمَ ثنا هُشَيْمٌ بِهَذَا الْحَدِيثِ فَقَالَ قَيْسُ بْنُ الْحَارِثِ مَكَانَ الْحَارِثِ بْنِ قَيْسٍ قَالَ أَحْمَدُ بْنُ إِبْرَاهِيمَ هَذَا هُوَ الصَّوَابُ يَعْنِي قَيْسَ بْنَ الْحَارِثِ قَالَ أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ إِبْرَاهِيمَ ثنا بَكْرُ بْنُ عَبْدِ الرَّحْمَنِ قَاضِي الْكُوفَةِ عَنْ عِيسَى بْنِ الْمُخْتَارِ عَنِ ابْنِ أَبِي لَيْلَى عَنْ حُمَيْضَةَ بْنِ الشَّمَرْدَلِ عَنْ قَيْسِ بْنِ الْحَارِثِ بِمَعْنَاهُ
[Machine] It is mentioned that Al-Harith embraced Islam and he had eight wives. This was mentioned to the Prophet Muhammad ﷺ , who said to Al-Harith to choose four of them. This narration was reported by Mu'alla bin Mansur from Hushaim from Mugheera from Ar-Rabi' bin Qais, who said that his grandfather, Al-Harith bin Qais, embraced Islam. Musa bin Isma'il also reported it from Abu Awana from Mugheera from Qais from Abdullah bin Al-Harith, who said, "My grandfather embraced Islam." This confirms the narration of the majority, as reported by Hushaim, where they mentioned Al-Harith bin Qais. And Allah knows best.
أَنَّ الْحَارِثَ أَسْلَمَ وَعِنْدَهُ ثَمَانِ نِسْوَةٍ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ اخْتَرْ مِنْهُنَّ أَرْبَعًا وَرَوَاهُ مُعَلَّى بْنُ مَنْصُورٍ عَنْ هُشَيْمٍ عَنْ مُغِيرَةَ عَنِ الرَّبِيعِ بْنِ قَيْسٍ أَنَّ جَدَّهُ الْحَارِثَ بْنَ قَيْسٍ أَسْلَمَ وَرَوَاهُ مُوسَى بْنُ إِسْمَاعِيلَ عَنْ أَبِي عَوَانَةَ عَنْ مُغِيرَةَ عَنْ قَيْسٍ عَنْ عَبْدِ اللهِ بْنِ الْحَارِثِ قَالَ أَسْلَمَ جَدِّي وَهَذَا يُؤَكِّدُ رِوَايَةَ الْجُمْهُورِ عَنْ هُشَيْمٍ حَيْثُ قَالُوا الْحَارِثُ بْنُ قَيْسٍ وَيُؤَكِّدُ رِوَايَةَ ابْنِ أَبِي لَيْلَى وَاللهُ أَعْلَمُ
I embraced Islam while I had eight wives. So I mentioned it to the Prophet ﷺ. The Prophet (said) said: Select four of them. Abu Dawud said: This tradition has also been narrated to us by Ahmad b. Ibrahim from Hushaim. He said: Qais b. al-Harith instead of al-Harith b. Qais. Ahmad b. Ibrahim said: This is correct, i.e. Qais b. al-Harith. (Using translation from Abū Dāʾūd 2241)
أَسْلَمَ جَدِّي وَعِنْدَهُ ثَمَانِ نِسْوَةٍ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ اخْتَرْ مِنْهُنَّ أَرْبَعًا أَيَّتَهُنَّ شِئْتَ
[Machine] I embraced Islam and under my protection were ten women, four of whom were from the Quraysh, one of them being the daughter of Abu Sufyan. The Messenger of Allah ﷺ told me to choose four of them and release the rest. So I chose four of them, including the daughter of Abu Sufyan. Abu Bakr ibn al-Harith al-Faqih informed us that Abu al-Sheikh al-Asbahani narrated to us, who was informed by Hajib ibn Abu Bakr, who was informed by Ibrahim ibn al-Muhallab, who was informed by Adam, and he mentioned it in a similar way.
أَسْلَمْتُ وَتَحْتِي عَشْرُ نِسْوَةٍ أَرْبَعٌ مِنْهُنَّ مِنْ قُرَيْشٍ إِحْدَاهُنَّ بِنْتُ أَبِي سُفْيَانَ فَقَالَ لِي رَسُولُ اللهِ ﷺ اخْتَرْ مِنْهُنَّ أَرْبَعًا وَخَلِّ سَائِرَهُنَّ فَاخْتَرْتُ مِنْهُنَّ أَرْبَعًا مِنْهُنَّ ابْنَةُ أَبِي سُفْيَانَ 14056 أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ أَبُو الشَّيْخِ الْأَصْبَهَانِيُّ ثنا حَاجِبُ بْنُ أَبِي بَكْرٍ ثنا إِبْرَاهِيمُ بْنُ الْمُهَلَّبِ ثنا آدَمُ فَذَكَرَهُ بِمِثْلِهِ
[Machine] I converted to Islam, and I had five wives. So, I asked the Prophet ﷺ, and he said, "Divorce one and keep four." So, I divorced the eldest one who had been infertile for sixty years, and I left her.
أَسْلَمْتُ وَتَحْتِي خَمْسُ نِسْوَةٍ فَسَأَلْتُ النَّبِيَّ ﷺ فَقَالَ فَارِقْ وَاحِدَةً وَأَمْسِكْ أَرْبَعًا فَعَمَدْتُ إِلَى أَقْدَمِهِنَّ عِنْدِي عَاقِرٍ مُنْذُ سِتِّينَ سَنَةً فَفَارَقْتُهَا
[Machine] I said, "O Messenger of Allah, I have embraced Islam and I have two sisters under my care." He said, "Divorce one of them as you wish." And it was narrated by Abu 'Isa At-Tirmidhi from Bundar from Wahb ibn Jarir and he said in the hadith, "Choose whichever of them you wish."
قُلْتُ يَا رَسُولَ اللهِ إِنِّي أَسْلَمْتُ وَتَحْتِي أُخْتَانِ قَالَ طَلِّقْ أَيَّتَهُمَا شِئْتَ وَرَوَاهُ أَبُو عِيسَى التِّرْمِذِيُّ عَنْ بُنْدَارٍ عَنْ وَهْبِ بْنِ جَرِيرٍ وَقَالَ فِي الْحَدِيثِ اخْتَرْ أَيَّتَهُمَا شِئْتَ
[Machine] That his father became a Muslim and he had two sisters as wives, so the Prophet ﷺ instructed him to choose one of them.
أَنَّ أَبَاهُ أَسْلَمَ وَعِنْدَهُ امْرَأَتَانِ أُخْتَانِ فَأَمَرَهُ النَّبِيُّ ﷺ أَنْ يَخْتَارَ إِحْدَاهُمَا
[Machine] I embraced Islam and I had two sisters under my guardianship. So, I asked the Prophet ﷺ about it, and he instructed me to keep whichever I wanted and leave the other. This is mentioned in the isnad (chain of narration) by Isḥāq ibn ʿAbdullah ibn Abi Farwah, which Aba Kharash has also reported. However, Isḥāq's narration is not considered reliable. The narration by Yazid ibn Abi Habib is more authentic. And Allah knows best.
أَسْلَمْتُ وَتَحْتِي أُخْتَانِ فَسَأَلْتُ النَّبِيَّ ﷺ فَأَمَرَنِي أَنْ أُمْسِكَ أَيَّتَهُمَا شِئْتُ وَأُفَارِقَ الْأُخْرَى زَادَ إِسْحَاقُ بْنُ عَبْدِ اللهِ بْنِ أَبِي فَرْوَةَ فِي إِسْنَادِهِ أَبَا خِرَاشٍ وَإِسْحَاقُ لَا يُحْتَجُّ بِهِ وَرِوَايَةُ يَزِيدَ بْنِ أَبِي حَبِيبٍ أَصَحُّ وَاللهُ أَعْلَمُ
