39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
Ibn ‘Abbas reported the Apostle of Allaah ﷺ as saying “A woman without a husband has more right to her person than her guardian and a virgin’s permission must be asked, her permission being her silence. These are the words of Al Qa’nabi. (Using translation from Abū Dāʾūd 2098)
رَسُولَ اللهِ ﷺ قَالَ الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا
[Machine] "From Abdullah bin Al-Fadl, and indeed time has passed."
عَنْ عَبْدِ اللهِ بْنِ الْفَضْلِ وَقَدْ مَضَى
[Machine] "And Al-Thaib said, 'He is more entitled to her own self.'"
وَقَالَ الثَّيِّبُ أَحَقُّ بِنَفْسِهَا
[Machine] The Messenger of Allah ﷺ said: The guardian does not need permission to marry off a mature woman, and the silence of the virgin is considered as her consent. Ali said: I heard Al-Naysaburi say that the one I have is that there was a mistake made by Ma'mar. Ali also supported this with the narration of Ibn Ishaq and Saeed ibn Salama on the authority of Salih ibn Kaysan on the authority of Abdullah ibn Al-Fadl on the authority of Nafi' ibn Jubayr, in a similar manner to the first text, except that they also mentioned it regarding the virgin. And Allah knows best.
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ وَصَمْتُهَا إِقْرَارُهَا قَالَ عَلِيٌّ سَمِعْتُ النَّيْسَابُورِيَّ يَقُولُ الَّذِي عِنْدِي أَنَّ مَعْمَرًا أَخْطَأَ فِيهِ وَكَذَا قَالَ عَلِيٌّ وَاسْتَدَلَّ عَلَى ذَلِكَ بِرِوَايَةِ ابْنِ إِسْحَاقَ وَسَعِيدِ بْنِ سَلَمَةَ الْحَدِيثَ عَنْ صَالِحِ بْنِ كَيْسَانَ عَنْ عَبْدِ اللهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ ؓ بِنَحْوٍ مِنَ الْمَتْنِ الْأَوَّلِ فِي أَوَّلِهِ إِلَّا أَنَّهُمَا قَالَا أَيْضًا عَنْهُ وَالْيَتِيمَةُ تُسْتَأْمَرُ وَيُحْتَمَلُ أَنْ يَكُونَ الْمُرَادُ بِقَوْلِهِ فِي هَذِهِ الْأَخْبَارِ وَالْبِكْرُ تُسْتَأْمَرُ الْبِكْرَ الْيَتِيمَةَ وَاللهُ أَعْلَمُ
[Machine] The Messenger of Allah ﷺ said, "Women are to be commanded regarding their clothing." I said, "O Messenger of Allah, indeed they feel shy." He said, "The adult woman knows best about herself, and the virgin is to be commanded, and her silence is her consent."
قَالَ رَسُولُ اللهِ ﷺ تُسْتَأْمَرُ النِّسَاءُ فِي أَبْضَاعِهِنَّ قَالَتْ قُلْتُ يَا رَسُولَ اللهِ إِنَّهُنَّ يَسْتَحْيِينَ قَالَ الْأَيِّمُ أَحَقُّ بِنَفْسِهَا وَالْبِكْرُ تُسْتَأْمَرُ وَسُكَاتُهَا إِقْرَارُهَا
[Machine] On the authority of the Prophet ﷺ who said: "A divorced woman should not be married until she is asked for her permission, and a virgin should not be married until her permission is sought." It was said, "O Messenger of Allah, how is her permission given?" He said: "If she remains silent, her silence is her consent."
عَنِ النَّبِيِّ ﷺ قَالَ لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ وَلَا الْبِكْرُ حَتَّى تُسْتَأْذَنَ قِيلَ يَا رَسُولَ اللهِ كَيْفَ إِذْنُهَا؟ قَالَ إِنْ سَكَتَتْ فَهُوَ رِضَاهَا
[Machine] "That her father married her while she was single, and she disliked that. So she went to the Messenger of Allah ﷺ and he annulled the marriage. This is the narration of Abu Abdullah."
أَنَّ أَبَاهَا زَوَّجَهَا وَهِيَ ثَيِّبٌ فَكَرِهَتْ ذَلِكَ فَأَتَتْ رَسُولَ اللهِ ﷺ فَرَدَّ نِكَاحَهَا لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ
[Machine] A man among them, named Khidam, married his daughter to a man. But she disliked her marriage and went to the Messenger of Allah ﷺ and told him about it. So he annulled her marriage to her father and she married Abu Lubabah ibn Abdul-Mundhir. Abu Bakr narrated to me (Muhammad ibn al-Husayn) from Ammar ibn Raja from Yazid ibn Harun, something similar, and Yahya mentioned that he heard that it happened during the period of Thayyibah.
أَنَّ رَجُلًا مِنْهُمْ يُدْعَى خِدَامًا أَنْكَحَ ابْنَةً لَهُ رَجُلًا فَكَرِهَتْ نِكَاحَهُ فَأَتَتْ رَسُولَ اللهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَرَدَّ عَنْهَا نِكَاحَ أَبِيهَا فَتَزَوَّجَتْ أَبَا لُبَابَةَ بْنَ عَبْدِ الْمُنْذِرِ قَالَ أَبُو بَكْرٍ أَخْبَرَنِيهِ مُحَمَّدُ بْنُ الْحُسَيْنِ ثنا عَمَّارُ بْنُ رَجَاءٍ ثنا يَزِيدُ بْنُ هَارُونَ مِثْلَهُ وَزَادَ فَذَكَرَ يَحْيَى أَنَّهُ بَلَغَهُ أَنَّهَا كَانَتْ ثَيِّبًا
[Machine] Her affair was brought to the attention of the Messenger of Allah ﷺ , so the Messenger of Allah ﷺ ordered her father to marry her to the one she desired, so she married Aba Lubabah.
شَأْنُهَا إِلَى رَسُولِ اللهِ ﷺ فَأَمَرَ رَسُولُ اللهِ ﷺ أَبَاهَا أَنْ يُلْحِقَهَا بِهَوَاهَا فَتَزَوَّجَتْ أَبَا لُبَابَةَ
[Machine] Khanasaa, the daughter of Khidam, was forced to marry by her father while she was unwilling. She went to the Prophet ﷺ and said, "My father married me off against my will, and I have control over my own affairs but he did not ask for my consent." The Prophet ﷺ said, "There is no marriage for him, marry anyone you wish." So she married Abu Lubabah ibn Abdul-Mundhir. This is the message, and he is a witness to what has transpired.
آمَتْ خَنْسَاءُ بِنْتُ خِدَامٍ فَزَوَّجَهَا أَبُوهَا وَهِيَ كَارِهَةٌ فَأَتَتِ النَّبِيَّ ﷺ فَقَالَتْ زَوَّجَنِي أَبِي وَأَنَا كَارِهَةٌ وَقَدْ مَلَكْتُ أَمْرِي وَلَمْ يُشْعِرْنِي فَقَالَ لَا نِكَاحَ لَهُ انْكِحِي مَنْ شِئْتِ فَنَكَحَتْ أَبَا لُبَابَةَ بْنَ عَبْدِ الْمُنْذِرِ هَذَا مُرْسَلٌ وَهُوَ شَاهِدٌ لِمَا تَقَدَّمَ
[Machine] A man during the time of the Messenger of Allah ﷺ married his daughter to Thaib, who was with another man. She disliked this, so she went to the Prophet ﷺ and mentioned it to him. He annulled the marriage. Umar ibn Abi Salamah narrated this from his father, and the woman was named Khansa bint Khidam. It is mentioned that she was married to him by proxy, and the marriage by proxy is more authentic. And what has been mentioned earlier regarding the marriage by proxy is sufficient.
أَنَّ رَجُلًا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ أَنْكَحَ ابْنَةً لَهُ ثَيِّبًا كَانَتْ عِنْدَ رَجُلٍ فَكَرِهَتْ ذَلِكَ فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَرَدَّ نِكَاحَهَا وَرَوَاهُ عُمَرُ بْنُ أَبِي سَلَمَةَ عَنْ أَبِيهِ وَسَمَّى الْمَرْأَةَ خَنْسَاءَ بِنْتَ خِدَامٍ فَذَكَرَهُ مُرْسَلًا وَقَدْ قِيلَ عَنْهُ مَوْصُولًا وَالْمُرْسَلُ لَهُ أَصَحُّ وَفِيمَا مَضَى مِنَ الْمَوْصُولِ كِفَايَةٌ
[Machine] A woman's husband died and she had a son from him. Her uncle proposed to her and offered her to his son, so he said to him "Marry her to me". But he refused, so he married her to someone else without her consent. She then went to the Prophet ﷺ and told him about this. The Prophet ﷺ sent for him and asked him, "Did you marry her to someone other than her uncle's son?" He said, "Yes, I married her to someone who is better for her than her uncle's son." So the Prophet ﷺ separated them and married her to her uncle's son.
امْرَأَةً تُوُفِّيَ زَوْجُهَا وَلَهَا مِنْهُ وَلَدٌ فَخَطَبَهَا عَمُّ وَلَدِهَا إِلَى وَالِدِهَا فَقَالَ لَهُ زَوِّجْنِيهَا فَأَبَى فَزَوَّجَهَا غَيْرَهُ بِغَيْرِ رَضًا مِنْهَا فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَأَرْسَلَ إِلَيْهِ النَّبِيُّ ﷺ فَقَالَ أَزَوَّجْتَهَا غَيْرَ عَمِّ وَلَدِهَا؟ قَالَ نَعَمْ زَوَّجْتُهَا مَنْ هُوَ خَيْرٌ لَهَا مِنْ عَمِّ وَلَدِهَا فَفَرَّقَ بَيْنَهُمَا وَزَوَّجَهَا عَمَّ وَلَدِهَا كَذَا قَالَ
[Machine] A woman came to the Prophet ﷺ and said, "Indeed, my father married me off while I dislike him, and I want to marry my cousin instead." The Prophet ﷺ replied, "This marriage is valid." This narration is transmitted from Abu Salama.
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنَّ أَبِي زَوَّجَنِي وَأَنَا كَارِهَةٌ وَأَنَا أُرِيدُ أَنْ أَتَزَوَّجَ عَمَّ وَلَدِي قَالَ فَرَدَّ النَّبِيُّ ﷺ نِكَاحَهُ هَذَا هُوَ الصَّحِيحُ مُرْسَلٌ عَنْ أَبِي سَلَمَةَ
