39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] The Messenger of Allah ﷺ said, "When the guardians arrange a marriage, the first has more right (to give consent)."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا أَنْكَحَ الْوَلِيَّانِ فَالْأَوَّلُ أَحَقُّ هَكَذَا
[Machine] The Prophet ﷺ said, "Whichever woman a wali (guardian) marries her, she belongs to the first of them."
قَالَ النَّبِيُّ ﷺ أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ مِنْهُمَا
The Prophet ﷺ said: Any woman who is married by two guardians (to two different men) belongs to the first woman who is married by two guardians (to two different men) belongs to the first of them and anything sold by a man to two persons belongs to the first of them. أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ بَاعَ مِنْ رَجُلَيْنِ بَيْعًا فَهُوَ لِلْأَوَّلِ مِنْهُمَا وَأَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ
[Machine] The Messenger of Allah ﷺ said: "Whichever woman is married by two guardians, she belongs to the first one of them."
قَالَ رَسُولُ اللهِ ﷺ أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ مِنْهُمَا
[Machine] The Prophet ﷺ said: "When the two guardians marry, the first one has more right. And when the two buyers dispute, the first one has more right." This difference was narrated by Ibn Abi 'Aroobah in the chain of this hadith, and it was followed by Aban Al-Attar from Qatadah in his statement about 'Uqbah bin 'Amir, and the correct narration is the one transmitted by who...
أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا أَنْكَحَ الْوَلِيَّانِ فَالْأَوَّلُ أَحَقُّ وَإِذَا بَاعَ الْمُجِيزَانِ فَالْأَوَّلُ أَحَقُّ هَذَا الِاخْتِلَافُ وَقَعَ مِنَ ابْنِ أَبِي عَرُوبَةَ فِي إِسْنَادِ هَذَا الْحَدِيثِ وَقَدْ تَابَعَهُ أَبَانُ الْعَطَّارُ عَنْ قَتَادَةَ فِي قَوْلِهِ عَنْ عُقْبَةَ بْنِ عَامِرٍ وَالصَّحِيحُ رِوَايَةُ مَنْ
[Machine] The Messenger of Allah ﷺ said: "Whatever woman is married by two guardians, she belongs to the first one. And whatever two men make a transaction, it belongs to the first one of them." This is the wording of the hadith of Hisham, and the narration of the others conveys the same meaning.
قَالَ رَسُولُ اللهِ ﷺ أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ وَأَيُّمَا رَجُلَيْنِ ابْتَاعَا بَيْعًا فَهُوَ لِلْأَوَّلِ مِنْهُمَا لَفْظُ حَدِيثِ هِشَامٍ وَرِوَايَةُ الْبَاقِينَ بِمَعْنَاهُ وَكَذَلِكَ
[Machine] "From the Prophet, ﷺ , he said: When the two qualified individuals marry, the first has more right."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا أَنْكَحَ الْمُجِيزَانِ فَالْأَوَّلُ أَحَقُّ
[Machine] That he should not approach her until her waiting period is over.
أَنْ لَا يَقْرَبَهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا
