39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] From Ibn Abbas regarding the saying of Allah the Exalted, "And do not marry those [women] whom your fathers married..." [An-Nisa 22] and His saying, "And [also prohibited to you are all] married women except those your right hands possess..." [An-Nisa 23]. Every woman whom your father or your son has married, whether he had sexual intercourse with her or not, it is forbidden for you.
عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِ اللهِ تَعَالَى {وَلَا تَنْكِحُوا مَا نَكَحَ آبَاؤُكُمْ مِنَ النِّسَاءِ} [النساء 22] وَقَوْلِهِ {وَحَلَائِلُ أَبْنَائِكُمْ} [النساء 23] يَقُولُ كُلُّ امْرَأَةٍ تَزَوَّجَهَا أَبُوكَ أَوِ ابْنُكَ دَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا فَهِيَ حَرَامٌ عَلَيْكَ
[Machine] And Allah knows best about your lineage, so that the spouses of the declared ones do not enter into it. This is similar to His saying, exalted be He, to His Prophet ﷺ , "When Zayd divorced her, We married her to you so that there would not be upon the believers any discomfort concerning the wives of their adopted sons." So the halila of the son of a child, even if he is lowly, and the halila of the son through breastfeeding, are both considered forbidden relationships. And this is the meaning of the statement of Imam Shafi'i, may Allah have mercy on him, in his book on breastfeeding.
وَاللهُ أَعْلَمُ مِنْ أَصْلَابِكُمْ لِئَلَّا يَدْخُلَ فِيهِ أَزْوَاجُ الْأَدْعِيَاءِ وَهُوَ مِثْلُ قَوْلِهِ تَعَالَى لِنَبِيِّهِ ﷺ {فَلَمَّا قَضَى زَيْدٌ مِنْهَا وَطَرًا زَوَّجْنَاكَهَا لِكَيْلَا يَكُونَ عَلَى الْمُؤْمِنِينَ حَرَجٌ فِي أَزْوَاجِ أَدْعِيَائِهِمْ} فَحَلِيلَةُ ابْنِ الْوَلَدِ وَإِنْ سَفَلَ وَحَلِيلَةُ الِابْنِ مِنَ الرَّضَاعِ دَاخِلَتَانِ فِي التَّحْرِيمِ وَهَذَا مَعْنَى قَوْلِ الشَّافِعِيِّ رَحِمَهُ اللهُ فِي كِتَابِ الرَّضَاعِ
