39. Marriage

٣٩۔ كِتَابُ النِّكَاحِ

39.215 [Machine] The couple disagrees on the injury, so the saying becomes his saying if he is innocent. Imam Shafi'i, may Allah have mercy on him, said: because she wants to dissolve their marriage and he has the right to take an oath.

٣٩۔٢١٥ بَابُ الزَّوْجَانِ يَخْتَلِفَانِ فِي الْإِصَابَةِ فَيَكُونُ الْقَوْلُ قَوْلَهُ إِنْ كَانَ ثَيِّبًا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِأَنَّهَا تُرِيدُ فَسْخَ نِكَاحِهِ , وَعَلَيْهِ الْيَمِينُ

[Machine] 'Aisha had a green veil on her head. Her husband Ali saw it and struck her with his whip. Then the Messenger of Allah ﷺ entered, and 'Aisha told him about what had happened. She said, "The Muslim women do not undergo such treatment from their husbands." She also said to the one who had whipped her, "Your whip is greener than my veil." 'Ikrimah said, "Women support each other." Then the man came and 'Aisha asked, "What does he have with him that would make him more important to me than this?" She pointed to the edge of her garment. The man said, "By Allah, I only whip her lightly, just enough to show her who's in charge. But she is stubborn and wants to be respected. Her husband has already divorced her before." The Messenger of Allah ﷺ replied, "If what you say is true, then you are not lawful for him unless he tastes from your dowry and you taste from his."  

البيهقي:١٤٣٠١أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ عَنْ عِكْرِمَةَ أَنَّ امْرَأَةً دَخَلَتْ

عَلَى عَائِشَةَ ؓ وَعَلَيْهَا خِمَارٌ أَخْضَرُ فَشَكَتْ إِلَيْهَا زَوْجَهَا وَأَرَتْهَا ضَرْبًا بِجِلْدِهَا فَدَخَلَ رَسُولُ اللهِ ﷺ فَذَكَرَتْ لَهُ ذَلِكَ عَائِشَةُ ؓ وَقَالَتْ مَا تَلْقَاهُ نِسَاءُ الْمُسْلِمِينَ مِنْ أَزْوَاجِهِنَّ وَقَالَتْ لَلَّذِي يَجْلِدُهَا أَشَدُّ خُضْرَةً مِنْ خِمَارِهَا قَالَ عِكْرِمَةُ وَالنِّسَاءُ يَنْصُرُ بَعْضُهُنَّ بَعْضًا وَجَاءَ الرَّجُلُ فَقَالَتْ مَا الَّذِي عِنْدَهُ بِأَغْنَى عَنِّي مِنْ هَذَا وَقَالَتْ بِطَرَفِ ثَوْبِهَا فَقَالَ الرَّجُلُ يَا رَسُولَ اللهِ وَاللهِ إِنِّي لَأَنْفُضُهَا نَفْضَ الْأَدِيمِ وَلَكِنَّهَا نَاشِزٌ تُرِيدُ رِفَاعَةَ وَكَانَ رِفَاعَةُ زَوْجَهَا قَدْ طَلَّقَهَا قَبْلَ ذَلِكَ فَقَالَ إِنَّهُ إِنْ كَانَ كَمَا تَقُولِينَ لَمْ تَحِلِّي لَهُ حَتَّى يَذُوقَ مِنْ عُسَيْلَتِكِ وَتَذُوقِي مِنْ عُسَيْلَتِهِ

[Machine] That he should marry a woman from the treasury who has a share of beauty and religion. If she claims that he reaches her, then bring them together, and if she claims that he does not reach her, then separate between them. He said, "We will do so," and he brought them to him in the house. He said, "When the morning came, the people entered and she entered." So the man came with the trace of yellow on him, so he said to him, "What have you done?" He said, "I did, and by Allah, I even hit her on her garment from behind." He said, "And the woman came, pretending, so she stood beside him." He asked her, and his anger increased upon her, so she said, "Nothing." He said, "Doesn't it spread? Doesn't it come close?" She said, "Yes, but when he comes close, his evil comes." Samurah said, "Leave her alone, O Muhlukhdhdhah. This is the opinion of Mu'awiyah, and the man may be attached to one woman and not attached to another. Following the Sunnah is more important, and the Messenger of Allah ﷺ ruled by taking an oath on the one who denies, and the husband denies what he is accused of of infamy. We were narrated from 'Amr ibn Dinar that he said, "We still hear that if a woman suffers once, she has no speech or dispute." It was also narrated from Tawus, Al-Hasan, and Az-Zuhri.  

البيهقي:١٤٣٠٢أَخْبَرَنَا أَبُو الطَّاهِرِ الْفَقِيهُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ ثنا أَشْهَلُ بْنُ حَاتِمٍ ثنا عُيَيْنَةُ بْنُ عَبْدِ الرَّحْمَنِ عَنْ أَبِيهِ قَالَ جَاءَتِ امْرَأَةٌ إِلَى سَمُرَةَ بْنِ جُنْدُبٍ فَذَكَرَتْ أَنَّ زَوْجَهَا لَا يَصِلُ إِلَيْهَا فَسَأَلَ الرَّجُلَ قَالَ فَأَنْكَرَ ذَلِكَ وَكَتَبَ فِيهِ إِلَى مُعَاوِيَةَ ؓ قَالَ فَكَتَبَ

أَنْ زَوِّجْهُ امْرَأَةً مِنْ بَيْتِ الْمَالِ لَهَا حَظٌّ مِنْ جَمَالٍ وَدِينٍ فَإِنْ زَعَمَتْ أَنَّهُ يَصِلُ إِلَيْهَا فَاجْمَعْ بَيْنَهُمَا وَإِنْ زَعَمَتْ أَنَّهُ لَا يَصِلُ إِلَيْهَا فَفَرِّقْ بَيْنَهُمَا قَالَ نَفْعَلُ وَأَتَى بِهِمَا عِنْدَهُ فِي الدَّارِ قَالَ فَلَمَّا أَصْبَحَ دَخَلَ النَّاسُ وَدَخَلَتْ قَالَ فَجَاءَ الرَّجُلُ عَلَيْهِ أَثَرُ صُفْرَةٍ فَقَالَ لَهُ مَا فَعَلْتَ قَالَ فَعَلْتُ وَاللهِ حَتَّى خَضْخَضْتُهُ فِي الثَّوْبِ مِنْ وَرَائِهَا قَالَ وَجَاءَتِ الْمَرْأَةُ مُتَقَنِّعَةً فَقَامَتْ عِنْدَ رِجْلِهِ قَالَ فَسَأَلَهَا وَعَظُمَ عَلَيْهَا فَقَالَتْ لَا شَيْءَ فَقَالَ أَمَا يَنْتَشِرُ أَمَا يَدْنُو قَالَتْ بَلَى وَلَكِنَّهُ إِذَا دَنَا جَاءَ شَرُّهُ فَقَالَ سَمُرَةُ خَلِّ سَبِيلَهَا يَا مُخَضْخَضُ هَذَا رَأْيٌ مِنْ مُعَاوِيَةَ ؓ وَقَدْ يَكُونُ الرَّجُلُ عِنِّينًا مِنِ امْرَأَةٍ وَلَا يَكُونُ عِنِّينًا مِنْ أُخْرَى وَمُتَابَعَةُ السُّنَّةِ أَوْلَى وَقَدْ قَضَى رَسُولُ اللهِ ﷺ بِالْيَمِينِ عَلَى مَنْ أَنْكَرَ وَالزَّوْجُ يُنْكِرُ مَا يُدَّعَى عَلَيْهِ مِنَ الْعُنَّةِ وَرُوِّينَا عَنْ عَمْرِو بْنِ دِينَارٍ أَنَّهُ قَالَ مَا زِلْنَا نَسْمَعُ أَنَّهُ إِذَا أَصَابَهَا مَرَّةً فَلَا كَلَامَ لَهَا وَلَا خُصُومَةَ وَرُوِيَ فِي ذَلِكَ عَنْ طَاوُسٍ وَالْحَسَنِ وَالزُّهْرِيِّ
