39. Marriage

٣٩۔ كِتَابُ النِّكَاحِ

39.82 [Machine] What came in its beginning is its adornment by what its right hand possesses, Allah the Almighty says: "Or those whom their right hands possess" [Quran 24:31]

٣٩۔٨٢ بَابُ مَا جَاءَ فِي إِبْدَائِهَا زِينَتَهَا لِمَا مَلَكَتْ يَمِينُهَا قَالَ اللهُ تَعَالَى: {أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ} [النور: 31]

The Prophet ﷺ brought Fatimah a slave which he donated to her. Fatimah wore a garment which, when she covered her head, did not reach her feet, and when she covered her feet by it, that garment did not reach her head. When the Prophet ﷺ saw her struggle, he said: There is no harm to you: Here is only your father and slave. (Using translation from Abū Dāʾūd 4106)   

البيهقي:١٣٥٤٥أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ عِيسَى ثنا أَبُو جُمَيْعٍ سَالِمُ بْنُ دِينَارٍ عَنْ ثَابِتٍ عَنْ أَنَسٍ ؓ أَنَّ النَّبِيَّ

ﷺ أَتَى فَاطِمَةَ بِعَبْدٍ قَدْ وَهَبَهُ لَهَا قَالَ وَعَلَى فَاطِمَةَ ؓ ثَوْبٌ إِذَا قَنَّعَتْ بِهِ رَأْسَهَا لَمْ يَبْلُغْ رِجْلَيْهَا وَإِذَا غَطَّتْ بِهِ رِجْلَيْهَا لَمْ يَبْلُغْ رَأْسَهَا فَلَمَّا رَأَى النَّبِيُّ ﷺ مَا تَلْقَى قَالَ إِنَّهُ لَيْسَ عَلَيْكِ بَأْسٌ إِنَّمَا هُوَ أَبُوكِ وَغُلَامُكِ تَابَعَهُ سَلَّامُ بْنُ أَبِي الصَّهْبَاءِ عَنْ ثَابِتٍ

[Machine] The mothers of the believers used to borrow from each other and they would disclose their hair for one another. When the debt was paid, they would cast their hair over their faces again. Al-Hasan, Ash-Sha'bi, Tawus, and Mujahid disliked for a woman's servant to look at her hair, as if they considered it part of the adornment that should not be displayed to a servant, just as Ibn Abbas considered it part of the adornment that should not be displayed in front of non-mahrams. We also narrated from Ibrahim as-Sa'di who said, "I asked Nafi', 'Can a woman's servant comb her hair?'" He said, 'No, because they consider the servant to be a lost slave (i.e. they do not trust them) and the apparent meaning of the book (i.e. the Quran) takes precedence in following, along with what is mentioned in the Sunnah."  

البيهقي:١٣٥٤٦وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ بِبَغْدَادَ أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ ثنا سَعْدَانُ بْنُ نَصْرٍ ثنا أَبُو مُعَاوِيَةَ مُحَمَّدُ بْنُ خَازِمٍ الضَّرِيرُ عَنْ عَمْرِو بْنِ مَيْمُونِ بْنِ مِهْرَانَ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ عَائِشَةَ ؓ قَالَ اسْتَأْذَنْتُ عَلَيْهَا فَقَالَتْ مَنْ هَذَا؟ فَقُلْتُ سُلَيْمَانُ قَالَتْ كَمْ بَقِيَ عَلَيْكَ مِنْ مُكَاتَبَتِكَ؟ قَالَ قُلْتُ عَشْرُ أَوَاقٍ قَالَتْ ادْخُلْ فَإِنَّكَ عَبْدٌ مَا بَقِيَ عَلَيْكَ دِرْهَمٌ وَرُوِّينَا عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ أَنَّهُ قَالَ إِنْ

كَانَتْ أُمَّهَاتُ الْمُؤْمِنِينَ يَكُونُ لِبَعْضِهِنَّ الْمُكَاتَبُ فَتَكْشِفُ لَهُ الْحِجَابَ مَا بَقِيَ عَلَيْهِ دِرْهَمٌ فَإِذَا قُضِيَ أَرْخَتْهُ دُونَهُ وَكَانَ الْحَسَنُ وَالشَّعْبِيُّ وَطَاوُسٌ وَمُجَاهِدٌ يَكْرَهُونَ أَنْ يَنْظُرَ الْعَبْدُ إِلَى شَعْرِ سَيِّدَتِهِ وَكَأَّنَهُمْ عَدُّوا الشَّعْرَ مِنَ الزِّينَةِ الَّتِي لَا تُبْدِيهَا لِعَبْدِهَا كَمَا عَدَّهُ ابْنُ عَبَّاسٍ ؓ فِيمَا رَوَيْنَاهُ مِنَ الزِّينَةِ الَّتِي لَا تُبْدِيهَا لِمَحَارِمِهَا وَرُوِّينَا عَنْ إِبْرَاهِيمَ الصَّائِغِ قَالَ قُلْتُ لِنَافِعٍ يُخْرِجُهَا عَبْدُهَا قَالَ لَا لِأَنَّهُمْ يَرَوْنَ الْعَبْدَ ضَيْعَةً وَظَاهِرُ الْكِتَابِ أَوْلَى بِالِاتِّبَاعِ مَعَ مَا فِيهِ مِنَ السُّنَّةِ
