39. Marriage

٣٩۔ كِتَابُ النِّكَاحِ

39.100 [Machine] Compulsory requirement for the adult guardians of young girls when they want to get married and seek the satisfaction of their spouses to marry them. Allah, the Almighty, said: "And when you divorce women and they have fulfilled their term, do not prevent them from remarrying their [former] husbands." [Quran 2:232]

٣٩۔١٠٠ بَابٌ حَتْمٌ لَازِمٌ لِأَوْلِيَاءِ الْأَيَامَى الْحَرَائِرِ الْبَوَالِغِ إِذَا أَرَدْنَ النِّكَاحَ وَدَعَوْنَ إِلَى رِضًى مِنَ الْأَزْوَاجِ أَنْ يُزَوِّجُوهُنَّ قَالَ اللهُ تَعَالَى: {وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ} [البقرة: 232]

concerning the Verse: 'Do not prevent them' (2.232) Ma'qil bin Yasar told me that it was revealed in his connection. He said, "I married my sister to a man and he divorced her, and when her days of 'Idda (three menstrual periods) were over, the man came again and asked for her hand, but I said to him, 'I married her to you and made her your bed (your wife) and favored you with her, but you divorced her. Now you come to ask for her hand again? No, by Allah, she will never go back to you (again)!' That man was not a bad man and his wife wanted to go back to him. So Allah revealed this Verse: 'Do not prevent them.' (2.232) So I said, 'Now I will do it (let her go back to him), O Messenger of Allah ﷺ."So he married her to him again. البيهقي:١٣٥٩٤أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي أَحْمَدُ بْنُ مُحَمَّدٍ الشَّرْقِيُّ ثنا أَحْمَدُ بْنُ حَفْصٍ وَالْفَرَّاءُ يعنِي عَبْدَ اللهِ بْنَ مُحَمَّدٍ وَقَطَنٌ قَالُوا ثنا حَفْصٌ حَدَّثَنِي إِبْرَاهِيمُ يَعْنِي ابْنَ طَهْمَانَ عَنْ يُونُسَ بْنِ عُبَيْدٍ عَنِ الْحَسَنِ أَنَّهُ قَالَ

فِي قَوْلِهِ تَعَالَى ﷻ {فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ} [البقرة 232] الْآيَةَ حَدَّثَنِي مَعْقِلُ بْنُ يَسَارٍ الْمُزَنِيُّ ؓ أَنَّهَا نَزَلَتْ فِيهِ قَالَ كُنْتُ زَوَّجْتُ أُخْتًا لِي مِنْ رَجُلٍ فَطَلَّقَهَا حَتَّى إِذَا انْقَضَتْ عِدَّتُهَا جَاءَ يَخْطُبُهَا فَقُلْتُ لَهُ زَوَّجْتُكَ وَفَرَشْتُكَ وَأَكْرَمْتُكَ فَطَلَّقْتَهَا ثُمَّ جِئْتَ تَخْطُبُهَا لَا وَاللهِ لَا تَعُودُ إِلَيْهَا أَبَدًا قَالَ وَكَانَ رَجُلًا لَا بَأْسَ بِهِ وَكَانَتِ الْمَرْأَةُ تُرِيدُ أَنْ تَرْجِعَ إِلَيْهِ فَأَنْزَلَ اللهُ هَذِهِ الْآيَةَ فَقُلْتُ الْآنَ أَفْعَلُ يَا رَسُولَ اللهِ فَزَوَّجْتُهَا إِيَّاهُ

[Machine] Leave her while he is capable, then approach her and propose to her. And there was a barrier between him and her, so Allah the Almighty revealed the verse: "And when you divorce women and they have nearly fulfilled their term, do not prevent them from remarrying their [former] husbands" [Quran 2:232]. The Messenger of Allah ﷺ called him and recited the verse to him, so he abandoned the jealousy and complied with the command of Allah.  

البيهقي:١٣٥٩٥أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْفَضْلِ الْحَسَنُ بْنُ يَعْقُوبَ الْعَدْلُ ثنا يَحْيَى بْنُ أَبِي طَالِبٍ ثنا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ ثنا سَعِيدٌ ح وَأَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْبِسْطَامِيُّ الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ ثنا الْقَاسِمُ بْنُ زَكَرِيَّا ثنا مُحَمَّدُ بْنُ الْمُثَنَّى وَبُنْدَارٌ قَالَا ثنا عَبْدُ الْأَعْلَى ثنا سَعِيدٌ عَنْ قَتَادَةَ ثنا الْحَسَنُ أَنَّ مَعْقِلَ بْنَ يَسَارٍ ؓ كَانَتْ أُخْتُهُ عِنْدَ رَجُلٍ فَطَلَّقَهَا ثُمَّ تَخَلَّى عَنْهَا حَتَّى إِذَا انْقَضَتْ عِدَّتُهَا ثُمَّ قَرُبَ يَخْطُبُهَا فَحَمَى مَعْقِلٌ مِنْ ذَلِكَ أَنْفًا قَالَ

خَلِّ عَنْهَا وَهُوَ يَقْدِرُ ثُمَّ قَرُبَ يَخْطُبُهَا فَحَالَ بَيْنَهُ وَبَيْنَهَا فَأَنْزَلَ اللهُ تَعَالَى {وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ} [البقرة 232] الْآيَةَ فَدَعَاهُ رَسُولُ اللهِ ﷺ فَقَرَأَهَا عَلَيْهِ فَتَرَكَ الْحَمِيَّةَ ثُمَّ اسْتَقَادَ لِأَمْرِ اللهِ ﷻ
