39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] In a man who commits adultery with his mother-in-law or his daughter-in-law, they both become unlawful for him to marry and their marriage is annulled. Yahya bin Ya'mar said, "Nothing is ever forbidden that was not permissible at some point." When the statement reached Sha'bi, he said, "If you were to take a cup of wine and pour it into a container of water, that water would become forbidden." It was the opinion of Sha'bi that such a combination was forbidden for him.
فِي رَجُلٍ زَنَى بِأُمِّ امْرَأَتِهِ أَوْ بِابْنَتِهَا فَإِنَّهُمَا حُرْمَتَانِ تَخَطَّاهُمَا وَلَا يُحَرِّمُهَا ذَلِكَ عَلَيْهِ قَالَ وَقَالَ يَحْيَى بْنُ يَعْمَرَ مَا حَرَّمَ حَرَامٌ حَلَالًا قَطُّ فَبَلَغَ ذَلِكَ الشَّعْبِيَّ فَقَالَ بَلْ لَوْ أَخَذْتَ كُوزًا مِنْ خَمْرٍ فَسَكَبْتَهُ فِي جُبٍّ مِنْ مَاءٍ لَكَانَ ذَلِكَ الْمَاءُ حَرَامًا وَكَانَ مِنْ رَأْيِ الشَّعْبِيِّ أَنَّهَا قَدْ حُرِّمَتْ عَلَيْهِ
تَخَطَّى حُرْمَتَيْنِ
[Machine] In a man who deceived his wife, he said, "He stepped over two taboos, but his wife is not forbidden to him."
فِي رَجُلٍ غَشِيَ أُمَّ امْرَأَتِهِ قَالَ تَخَطَّى حُرْمَتَيْنِ وَلَا تُحَرَّمُ عَلَيْهِ امْرَأَتُهُ
[Machine] Ali ibn Abi Talib said, "The unlawful does not make the permissible prohibited."
قَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ لَا يُحَرِّمُ الْحَرَامُ الْحَلَالَ
the Prophet, said: "What is Haram does not make what is Halal into what is Haram.” (Using translation from Ibn Mājah 2015)

قَالَ رَسُولُ اللهِ ﷺ لَا يُحَرِّمُ الْحَرَامُ الْحَلَالَ
[Machine] The Messenger of Allah ﷺ was asked about a man who unlawfully follows a woman: can he marry her daughter? Or does he unlawfully follow a daughter: can he marry her mother? The Messenger of Allah ﷺ said, "The unlawful does not make the lawful forbidden. Rather, what is made forbidden is what is joined through a lawful marriage." Ishaq said, "Abdullah bin Nafi' also said this, and we take his opinion."
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الرَّجُلِ يُتْبِعُ الْمَرْأَةَ حَرَامًا أَيَنْكِحُ ابْنَتَهَا أَوْ يُتْبِعُ الِابْنَةَ حَرَامًا أَيَنْكِحُ أُمَّهَا؟ قَالَتْ قَالَ رَسُولُ اللهِ ﷺ لَا يُحَرِّمُ الْحَرَامُ الْحَلَالَ إِنَّمَا يُحَرِّمُ مَا كَانَ بِنِكَاحٍ حَلَالٍ قَالَ إِسْحَاقُ قَالَ عَبْدُ اللهِ بْنُ نَافِعٍ وَبِهِ نَأْخُذُ
[Machine] The Messenger of Allah ﷺ said, "No lawful thing can be corrupted by something that is unlawful. And whoever approaches a woman with indecency, it is not permissible for him to marry her mother or her daughter. As for marriage, it is not specific to Uthman ibn Abi al-Rahman al-Waqqasi, who is weak according to Yahya ibn Ma'in and other scholars of hadith. It is authentically narrated from Ibn Shihab al-Zuhri on the authority of Ali, in a transmitted and attributed form. And according to some scholars, the hadith of Abdullah al-Umari is more reliable. Allah knows best."
قَالَ رَسُولُ اللهِ ﷺ لَا يَفْسُدُ حَلَالٌ بِحَرَامٍ وَمَنْ أَتَى امْرَأَةً فُجُورًا فَلَا عَلَيْهِ أن يتَزَوَّجَ أُمَّهَا أَوِ ابْنَتَهَا فَأَمَّا نِكَاحٌ فَلَا تَفَرَّدَ بِهِ عُثْمَانُ بْنُ عَبْدِ الرَّحْمَنِ الْوَقَّاصِيُّ هَذَا وَهُوَ ضَعِيفٌ قَالَهُ يَحْيَى بْنُ مَعِينٍ وَغَيْرُهُ مِنْ أَئِمَّةِ الْحَدِيثِ وَالصَّحِيحُ عَنِ ابْنِ شِهَابٍ الزُّهْرِيِّ عَنْ عَلِيٍّ ؓ مُرْسَلًا مَوْقُوفًا عَنْهُ وَعِنْدَ بَعْضِ الْعُلَمَاءِ حَدِيثُ عَبْدِ اللهِ الْعُمَرِيِّ أَمْثَلُ وَاللهُ أَعْلَمُ
[Machine] Some scholars consider it impermissible to use something that is permissible as a means to commit prohibited actions.
بَعْضُ الْعُلَمَاءِ لَا يُفْسِدُ اللهُ حَلَالًا بِحَرَامٍ
