39. Marriage
٣٩۔ كِتَابُ النِّكَاحِ
[Machine] "He ﷺ bought her and emancipated her, for verily the reward goes to the one who emancipates. She said: Bring forth meat. He said: What is this? They replied: Burayrah gave us this as a sadaqah (charitable gift), so the Messenger of Allah ﷺ said: Both of us have a gift. She said: I have been given a choice, and her husband was a free man. Shu'bah said: Then I asked him afterwards, and he said: I do not know whether he was a free man or a slave. Shu'bah said: So I said to Simak bin Harb: I am afraid to ask him about the chain of narration, so you ask him. He said: When I mentioned this to him, he said: Your father narrated this from Aisha? He said: Abdul Rahman replied: Yes. Then when he left, Simak said to me: O Shu'bah, I am certain about him for you."
اللهِ ﷺ اشْتَرِيهَا وَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ قَالَتْ وَأُتِيَ بِلَحْمٍ فَقَالَ مَا هَذَا؟ فَقَالُوا هَذَا أَهْدَتْهُ إِلَيْنَا بَرِيرَةُ تُصُدِّقَ بِهَا عَلَيْهَا فَقَالَ رَسُولُ اللهِ ﷺ هُوَ عَلَيْهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ قَالَتْ وَخُيِّرَتْ وَكَانَ زَوْجُهَا حُرًّا قَالَ شُعْبَةُ ثُمَّ سَأَلْتُهُ بَعْدُ فَقَالَ مَا أَدْرِي أَحُرٌّ هُوَ أَمْ عَبْدٌ؟ قَالَ شُعْبَةُ فَقُلْتُ لِسِمَاكِ بْنِ حَرْبٍ إِنِّي أَتَّقِي أَنْ أَسْأَلَهُ عَنِ الْإِسْنَادِ فَسَلْهُ أَنْتَ قَالَ وَكَانَ فِي خَلْقِهِ فَقَالَ لَهُ سِمَاكٌ بَعْدَمَا حَدَّثَ أَحَدَّثَكَ هَذَا أَبُوكَ عَنْ عَائِشَةَ ؓ ؟ فَقَالَ عَبْدُ الرَّحْمَنِ نَعَمْ فَلَمَّا خَرَجَ قَالَ لِي سِمَاكٌ يَا شُعْبَةُ اسْتَوْثَقْتُهُ لَكَ مِنْهُ
[Machine] The Messenger of Allah ﷺ said, "The person who has authority over a blessing should give it to someone who deserves it." She (the narrator) said, "The Messenger of Allah ﷺ chose her (referring to herself) and her husband was a servant. She then gave some meat to Aisha. The Messenger of Allah ﷺ said, "If you prepare a meal for us from this meat." Aisha said that she would give it as charity to Barirah. He (the Messenger of Allah) said, "It is a charity for her and a gift for us." The narrator is Abu Abdullah Al-Hafiz, who was informed by Abu Amr ibn Abi Ja'far, who was informed by Hassan ibn Sufyan, who was informed by Abu Bakr ibn Abi Shaybah, who was informed by Husayn ibn Ali, who was informed by Zaidah, who cited a similar narration.
رَسُولُ اللهِ ﷺ الْوَلَاءُ لِمَنْ وَلِيَ النِّعْمَةَ قَالَتْ وَخَيَّرَهَا رَسُولُ اللهِ ﷺ وَكَانَ زَوْجُهَا عَبْدًا وَأَهْدَتْ لِعَائِشَةَ لَحْمًا فَقَالَ رَسُولُ اللهِ ﷺ لَوْ صَنَعْتُمْ لَنَا مِنْ هَذَا اللَّحْمِ فَقَالَتْ عَائِشَةُ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَقَالَ هُوَ عَلَيْهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ 14257 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ أنبأ الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا حُسَيْنُ بْنُ عَلِيٍّ عَنْ زَائِدَةَ فَذَكَرَهُ نَحْوَهُ
[Machine] Bureira was corresponding with people from the Ansar (helpers). She mentioned a conversation about loyalty and giving gifts. She said that she used to be under the ownership of a person, but when she was freed, the Messenger of Allah ﷺ said to her, "If you wish, you can remain under this person's care, and if you wish, you can separate from him." This confirms the narration of Simak bin Harb, and it has also been said that Usama narrated it from Az-Zuhri, from Al-Qasim bin Muhammad, from Aisha, in a summarized form. And likewise.
بَرِيرَةُ مُكَاتِبَةً لِأُنَاسٍ مِنَ الْأَنْصَارِ فَذَكَرَ الْحَدِيثَ فِي الْوَلَاءِ وَفِي الْهَدِيَّةِ قَالَتْ كَانَتْ تَحْتَ عَبْدٍ فَلَمَّا عَتَقَتْ قَالَ لَهَا رَسُولُ اللهِ ﷺ إِنْ شِئْتِ تَقَرَّينَ تَحْتَ هَذَا الْعَبْدِ وَإِنْ شِئْتِ تُفَارِقِينَهُ هَذَا يُؤَكِّدُ رِوَايَةَ سِمَاكِ بْنِ حَرْبٍ وَقَدْ قِيلَ عَنْ أُسَامَةَ عَنِ الزُّهْرِيِّ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ عَنْ عَائِشَةَ مُخْتَصَرًا وَكَذَلِكَ
[Machine] Her husband was a servant, so the Messenger of Allah ﷺ gave her the choice, and she chose herself. Even if he had been a free man, she wouldn't have chosen him.
كَانَ زَوْجُهَا عَبْدًا فَخَيَّرَهَا رَسُولُ اللهِ ﷺ فَاخْتَارَتْ نَفْسَهَا وَلَوْ كَانَ حُرًّا لَمْ يُخَيِّرْهَا
[Machine] Muhammad ibn al-Muthanna and Muhammad ibn Bashshar
مُحَمَّدِ بْنِ الْمُثَنَّى وَمُحَمَّدِ بْنِ بَشَّارٍ
[Machine] The passage in English is as follows: "Bureirah was with a slave who was liberated. The Messenger of Allah ﷺ entrusted her matter to her, and Muhammad ibn Ishaq narrated it from Aban ibn Salih from Mujahid from Aisha."
بَرِيرَةُ عِنْدَ عَبْدٍ فَعَتَقَتْ فَجَعَلَ رَسُولُ اللهِ ﷺ أَمْرَهَا بِيَدِهَا وَرَوَاهُ أَيْضًا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ أَبَانَ بْنِ صَالِحٍ عَنْ مُجَاهِدٍ عَنْ عَائِشَةَ ؓ
[Machine] The Messenger of Allah ﷺ freed her and she became his wife and she was a slave.
رَسُولَ اللهِ ﷺ خَيَّرَهَا وَكَانَ زَوْجُهَا مَمْلُوكًا
[Machine] Bareerah's husband was a black slave named Mughith. It is as if I can see him hurriedly walking in the streets of the city.
كَانَ زَوْجُ بَرِيرَةَ عَبْدًا أَسْوَدَ يُسَمَّى مُغِيثًا كَأَنِّي أَنْظُرُ إِلَيْهِ يَسْعَى فِي طُرُقِ الْمَدِينَةِ
[Machine] "As if I see him following her in the streets of the city, he focused his eyes on her. The Messenger of Allah ﷺ made four judgments concerning her and said, 'Indeed, the loyalty is for the one who sets her free, chooses her, and commands her to observe modesty.' He said, 'And she should give charity to prove her sincerity.' So she gave some of it to Aisha and mentioned that to the Prophet ﷺ . He said, 'It is a charity for her and a gift for us.'"
فَكَأَنِّي أُرَاهُ يَتْبَعُهَا فِي سِكَكِ الْمَدِينَةِ يَعْصِرُ عَيْنَيْهِ عَلَيْهَا قَالَ وَقَضَى رَسُولُ اللهِ ﷺ فِيهَا أَرْبَعَ قَضِيَّاتٍ فَقَالَ إِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ وَخَيَّرَهَا وَأَمَرَهَا أَنْ تَعْتَدَّ قَالَ وَتُصُدِّقَ عَلَيْهَا بِصَدَقَةٍ فَأَهْدَتْ مِنْهَا لِعَائِشَةَ فَذَكَرَتْ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ
[Machine] That is a helper, a servant, for the people of such-and-such a tribe, as if I am looking at him, he follows her in the streets of the city, crying over her, meaning Barira.
ذَاكَ مُغِيثٌ عَبْدٌ لِبَنِي فُلَانٍ كَأَنِّي أَنْظُرُ إِلَيْهِ يَتْبَعُهَا فِي سِكَكِ الْمَدِينَةِ يَبْكِي عَلَيْهَا يَعْنِي بَرِيرَةَ
[Machine] He has a helper, a servant for the people of so and so. It is as if I am seeing him, walking behind her in the streets of the city, crying.
لَهُ مُغِيثٌ عَبْدٌ لِبَنِي فُلَانٍ كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا فِي سِكَكِ الْمَدِينَةِ يَبْكِي
Barira's husband was a slave called Mughith, as if I am seeing him now, going behind Barira and weeping with his tears flowing down his beard. The Prophet ﷺ said to ʿAbbas, "O ʿAbbas ! are you not astonished at the love of Mughith for Barira and the hatred of Barira for Mughith?" The Prophet ﷺ then said to Barira, "Why don't you return to him?" She said, "O Messenger of Allah ﷺ! Do you order me to do so?" He said, "No, I only intercede for him." She said, "I am not in need of him." (Using translation from Bukhārī 5283)
كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ فَقَالَ النَّبِيُّ ﷺ لِلْعَبَّاسِ ؓ أَلَا تَعْجَبُ مِنْ حُبِّ مُغِيثٍ بَرِيرَةَ وَمِنْ بُغْضِ بَرِيرَةَ مُغِيثًا؟ فَقَالَ لَهَا النَّبِيُّ ﷺ لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ قَالَتْ يَا رَسُولَ اللهِ تَأْمُرُنِي؟ قَالَ لَا إِنَّمَا أَنَا أَشْفَعُ قَالَتْ فَلَا حَاجَةَ لِي فِيهِ
'A'isha reported that the husband of Barira was a slave. (Using translation from Muslim 1504j)
كَانَ زَوْجُ بَرِيرَةَ عَبْدًا
ثنا سُفْيَانُ فَذَكَرَهُ
[Machine] That the husband of Barirah was a slave, this is a reliable chain of narration.
أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا هَذَا إِسْنَادٌ صَحِيحٌ
[Machine] "Do not choose when she is freed unless her husband is a slave."
لَا تُخَيَّرُ إِذَا عَتَقَتْ إِلَّا أَنْ يَكُونَ زَوْجُهَا عَبْدًا
[Machine] Aisha, O Messenger of Allah, I want to set them free. The Messenger of Allah ﷺ said: "If you set them free, start with the man before the woman. Ibn Mahb is Ubaydullah ibn Abdur Rahman ibn Mahb. He has been distinguished in this regard and it is likely that the order to start with the man is because the woman does not have the option when she is set free. And Allah knows best."
عَائِشَةُ يَا رَسُولَ اللهِ إِنِّي أُرِيدُ أَنْ أُعْتِقَهُمَا قَالَ رَسُولُ اللهِ ﷺ إِنْ أَعْتَقْتِهِمَا فَابْدَئِي بِالرَّجُلِ قَبْلَ الْمَرْأَةِ ابْنُ مَوْهَبٍ هُوَ عُبَيْدُ اللهِ بْنُ عَبْدِ الرَّحْمَنِ بْنِ مَوْهَبٍ تَفَرَّدَ بِهِ وَيُشْبِهُ أَنْ يَكُونَ إِنَّمَا أَمَرَ بِالْبِدَايَةِ بِالرَّجُلِ لِأَنْ لَا يَكُونَ لَهَا الْخِيَارُ إِذَا أُعْتِقَتْ وَاللهُ أَعْلَمُ
[Machine] About the jurists who concluded with their saying from the people of Medina, they used to say: If the nation is under a slave, and he frees all of them, then it has no choice. And if it frees before him and remains silent until her husband frees her, then it also has no choice. And Allah knows best.
عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ إِذَا كَانَتِ الْأَمَةُ تَحْتَ الْعَبْدِ فَعَتَقَا جَمِيعًا فَلَا خِيَارَ لَهَا وَإِنْ عَتَقَتْ قَبْلَهُ وَسَكَتَتْ حَتَّى عَتَقَ زَوْجُهَا فَلَا خِيَارَ لَهَا أَيْضًا وَاللهُ أَعْلَمُ
