[Machine] On the authority of the Prophet ﷺ who said: "A divorced woman should not be married until she is asked for her permission, and a virgin should not be married until her permission is sought." It was said, "O Messenger of Allah, how is her permission given?" He said: "If she remains silent, her silence is her consent."

البيهقي:١٣٦٨٢ – وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا أَبُو مُسْلِمٍ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ أَبِي طَاهِرٍ الدَّقَّاقُ بِبَغْدَادَ ثنا أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ إِبْرَاهِيمَ بْنِ أَيُّوبَ الْبَزَّازُ ثنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ الْبَصْرِيُّ ثنا مُسْلِمُ بْنُ إِبْرَاهِيمَ ثنا هِشَامٌ ثنا يَحْيَى بْنُ أَبِي كَثِيرٍ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ ؓ

عَنِ النَّبِيِّ ﷺ قَالَ لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ وَلَا الْبِكْرُ حَتَّى تُسْتَأْذَنَ قِيلَ يَا رَسُولَ اللهِ كَيْفَ إِذْنُهَا؟ قَالَ إِنْ سَكَتَتْ فَهُوَ رِضَاهَا

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ مُسْلِمِ بْنِ إِبْرَاهِيمَ وَأَخْرَجَهُ مُسْلِمٌ مِنْ وَجْهٍ آخَرَ عَنْ هِشَامٍ الدَّسْتُوَائِيِّ

قَالَ رَسُولُ اللهِ ﷺ لَا تُنْكَحُ الْأَيِّمُ حَتَّى تُسْتَأْمَرَ وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ قَالُوا كَيْفَ إِذْنُهَا؟ قَالَ أَنْ تَسْكُتَ
