[Machine] The Messenger of Allah ﷺ said: The guardian does not need permission to marry off a mature woman, and the silence of the virgin is considered as her consent. Ali said: I heard Al-Naysaburi say that the one I have is that there was a mistake made by Ma'mar. Ali also supported this with the narration of Ibn Ishaq and Saeed ibn Salama on the authority of Salih ibn Kaysan on the authority of Abdullah ibn Al-Fadl on the authority of Nafi' ibn Jubayr, in a similar manner to the first text, except that they also mentioned it regarding the virgin. قَالَ رَسُولُ اللهِ ﷺ لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ وَصَمْتُهَا إِقْرَارُهَا قَالَ عَلِيٌّ سَمِعْتُ النَّيْسَابُورِيَّ يَقُولُ الَّذِي عِنْدِي أَنَّ مَعْمَرًا أَخْطَأَ فِيهِ وَكَذَا قَالَ عَلِيٌّ وَاسْتَدَلَّ عَلَى ذَلِكَ بِرِوَايَةِ ابْنِ إِسْحَاقَ وَسَعِيدِ بْنِ سَلَمَةَ الْحَدِيثَ عَنْ صَالِحِ بْنِ كَيْسَانَ عَنْ عَبْدِ اللهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ ؓ بِنَحْوٍ مِنَ الْمَتْنِ الْأَوَّلِ فِي أَوَّلِهِ إِلَّا أَنَّهُمَا قَالَا أَيْضًا عَنْهُ وَالْيَتِيمَةُ تُسْتَأْمَرُ وَيُحْتَمَلُ أَنْ يَكُونَ الْمُرَادُ بِقَوْلِهِ فِي هَذِهِ الْأَخْبَارِ وَالْبِكْرُ تُسْتَأْمَرُ الْبِكْرَ الْيَتِيمَةَ وَاللهُ أَعْلَمُ
