٣٩۔ كِتَابُ النِّكَاحِ ص ١٢
[Machine] You have permitted her with the right of possession, which is an indication that he only commanded to return to her after two divorces, and there is no return for the servant after them, as if he believed that the divorce did not occur since permission was not granted in it. When he refused, he said, "She is permitted for you with the right of possession." The opinion of the majority is that his divorce is valid, and Allah knows best. Ash-Shafi'i (may Allah have mercy on him) said, "Allah only permitted the ownership of the Malikis, and the servant cannot be an owner by any means." Allah, may He be exalted, said, "Allah has given an example of a slave who is owned and is unable to do anything." Ibn 'Umar narrated in the book of transactions that the Prophet ﷺ said, "Whoever sells a slave and he has wealth, then his wealth belongs to the buyer, unless the buyer stipulates otherwise."
لَكَ اسْتَحِلَّهَا بِمِلْكِ الْيَمِينِ فِي هَذَا دَلَالَةٌ عَلَى أَنَّهُ إِنَّمَا أَمَرَ بِالرُّجُوعِ إِلَيْهَا بَعْدَ تَطْلِيقَتَيْنِ وَلَا رَجْعَةَ لِلْعَبْدِ بَعْدَهُمَا فَكَأَنَّهُ اعْتَقَدَ أَنَّ الطَّلَاقَ لَمْ يَقَعْ حَيْثُ لَمْ يَأْذَنْ فِيهِ فَحِينَ أَبَى قَالَ هِيَ لَكَ اسْتَحِلَّهَا بِمِلْكِ الْيَمِينِ وَمَذْهَبُ الْجَمَاعَةِ عَلَى صِحَّةِ طَلَاقِهِ وَاللهُ أَعْلَمُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ إِنَّمَا أَحَلَّ اللهُ التَّسَرِّيَ لِلْمَالِكِينَ وَلَا يَكُونُ الْعَبْدُ مَالِكًا بِحَالٍ قَالَ اللهُ تَعَالَى {ضَرَبَ اللهُ مَثَلًا عَبْدًا مَمْلُوكًا لَا يَقْدِرُ عَلَى شَيْءٍ} [النحل 75] وَذَكَرَ مَا رَوَيْنَا فِي كِتَابِ الْبُيُوعِ عَنِ ابْنِ عُمَرَ ؓ أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
39.151 [Machine] Marriage of the Innovators and what Allah says: "The fornicator does not marry except a [female] fornicator or polytheist, and none marries her except a fornicator or a polytheist, and that has been made unlawful to the believers." [Quran 24:3]
٣٩۔١٥١ بَابُ نِكَاحِ الْمُحْدِثِينَ وَمَا جَاءَ فِي قَوْلِ اللهِ ﷻ: {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ} [النور: 3]
[Machine] She had a mother named Mahzool, and she used to be wealthy and generous. Men would marry her on the condition that she would provide for them financially. A man asked the Prophet ﷺ about marrying her, so the Messenger of Allah ﷺ recited the verse, "The adulterer does not marry anyone except an adulteress or a polytheist." (Quran 24:3) Then As-Saffar informed us, on the authority of Muhammad bin Ghaleb, who reported from Ubaid bin Ubaidah, who reported from Mu'tamir that he mentioned it in his chain of narration that there was a woman named Umm Mahzool who used to marry men on the condition that she would have freedom in matters of sexual immorality and she would provide for their financial support. So some of them asked the Prophet ﷺ for permission to marry her. He then recited this verse to them until its end.
لَهَا أُمُّ مَهْزُولٍ وَكَانَتْ تَكُونُ بِأَجْيَادَ وَكَانَتْ مُسَافِحَةً كَانَ يَتَزَوَّجُهَا الرَّجُلُ وَتَشْتَرِطُ لَهُ أَنْ تَكْفِيَهُ النَّفَقَةَ فَسَأَلَ رَجُلٌ عَنْهَا النَّبِيَّ ﷺ أَيَتَزَوَّجُهَا؟ فَقَرَأَ نَبِيُّ اللهِ ﷺ أَوْ أُنْزِلَتْ عَلَيْهِ الْآيَةُ {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً} [النور 3] الْآيَةَ 13860 قَالَ وَأنبأ الصَّفَّارُ ثنا مُحَمَّدُ بْنُ غَالِبٍ حَدَّثَنِي عُبَيْدُ بْنُ عُبَيْدَةَ ثنا مُعْتَمِرٌ فَذَكَرَهُ بِإِسْنَادِهِ أَنَّ امْرَأَةً كَانَتْ تُسَمَّى أُمَّ مَهْزُولٍ وَأَنَّهَا كَانَتْ تَتَزَوَّجُ الرَّجُلَ عَلَى أَنْ يَأْذَنَ لَهَا فِي السِّفَاحِ وَتَكْفِيَهُ النَّفَقَةَ فَاسْتَأْذَنَ بَعْضُهُمُ النَّبِيَّ ﷺ أَنْ يَتَزَوَّجَهَا قَالَ فَقَرَأَ رَسُولُ اللهِ ﷺ هَذِهِ الْآيَةَ إِلَى آخِرِهَا
from his father, from his grandfather, who said "There was a man named Marthad bin Abi Marthad, and he was a man who would carry captives from Makkah to Al-Madinah." He said: "And there was a prostitute woman in Makkah called 'Anaq, who was a friend of his. He had promised a man from the captives of Makkah that he would transport him, and he said: 'So I came until I reached one of the walls of Makkah on a moon-lit night.' He said "'Anaq came along and she saw the darkness of my shadow next to the wall. When she reached me she recognized me and said: "Marthad?" So I replied: "(Yes it is) Marthad." She said: "Welcome, come and spend the night with us." I said: "O 'Anaq! Allah has made illicit sexual relations unlawful." So she said: "O people of the tents! That is the man who takes your captives away!" He said: "Eight people followed me, and I went through the passes of Al-Khandamah. I stopped at a cave and entered it. They came until they stood over my head, and they began urinating, their urine falling on my head. Yet Allah made them unable to see me. He said: 'Then I went back. I returned to my companion to transport him - and he was a heavy man - until I reached Al-Idhkir. There I removed his shackles to make him easier to carry, since he was exhausting me, until I arrived at Al-Madinah. I went to the Messenger of Allah ﷺ and I said "O Messenger of Allah! May I marry 'Anaq? [I said this, two times] but the Messenger of Allah ﷺ was silent, and he did not reply to me at all until (the following) was revealed: The Zani marries not but a Zaniyah or a Mushrikah; and the Zaniyah, none marries her except a Zani or a Mushrik (24:3). So do not marry her.'" (Using translation from Tirmidhī 3177)
يَا أَهْلَ الْخِيَامِ هَذَا الرَّجُلُ الَّذِي يَحْمِلُ أَسْرَاكُمْ فَاتَّبِعْنِي ثَمَانِيَةٌ وَسَلَكْتُ الْخَنْدَمَةَ فَانْتَهَيْتُ إِلَى كَهْفٍ أَوْ غَارٍ فَدَخَلْتُهُ فَجَاءُوا حَتَّى جَازُوا عَلَى رَأْسِي فَبَالُوا فَظَلَّ بَوْلُهُمْ عَلَى رَأْسِي وَأَعْمَاهُمُ اللهُ حَتَّى رَجَعُوا وَرَجَعْتُ إِلَى صَاحِبِي وَحَمَلْتُهُ وَكَانَ رَجُلًا ثَقِيلًا حَتَّى انْتَهَيْتُ إِلَى الْإِذْخِرِ فَفَكَكْتُ عَنْهُ كَبْلَهُ فَجَعَلْتُ أَحْمِلُهُ وَيُعْيِينِي حَتَّى قَدِمْتُ الْمَدِينَةَ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ أَنْكِحُ عَنَاقًا؟ فَأَمْسَكَ رَسُولُ اللهِ ﷺ فَلَمْ يَرُدَّ عَلَيَّ شَيْئًا حَتَّى نَزَلَتْ هَذِهِ السُّورَةُ وَهِيَ قَوْلُهُ تَعَالَى {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ} [النور 3] فَقَالَ رَسُولُ اللهِ ﷺ يَا مَرْثَدُ الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ
[Machine] He said, "Be promiscuous or advertise promiscuity during the time of Jahiliyyah (pre-Islamic ignorance), it is the wrongdoing of so-and-so's family and so-and-so's family." Then Allah, the Most High, said, "The adulterer does not marry except an adulteress or polytheist, and the adulteress does not marry except an adulterer or polytheist. And that has been made forbidden to the believers." [Quran 24:3] He said, "So Allah judged from that the affairs of Jahiliyyah with Islam." Ibn Jurayj said, "It was said to Ata', 'Did Ibn Abbas inform you of this?' He said, 'Yes.'"
أَنَّهُ قَالَ كُنَّ بَغَايَا مُتَعَلِّنَاتٍ أَوْ مُعْلِنَاتٍ فِي الْجَاهِلِيَّةِ بَغِيُّ آلِ فُلَانٍ وَبَغِيُّ آلِ فُلَانٍ فَقَالَ اللهُ تَعَالَى {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ} [النور 3] قَالَ فَأَحْكَمَ اللهُ مِنْ ذَلِكَ أَمْرَ الْجَاهِلِيَّةِ بِالْإِسْلَامِ قَالَ ابْنُ جُرَيْجٍ فَقِيلَ لِعَطَاءٍ أَبَلَغَكَ ذَلِكَ عَنِ ابْنِ عَبَّاسٍ؟ قَالَ نَعَمْ
[Machine] He said about this verse {The adulterer does not marry except an adulteress or polytheist, and none marries her except an adulterer or a polytheist} [An-Nur 3], he said: There were known prostitutes in the city, so Allah made their marriage forbidden for the believers, and this is the statement of Qatadah.
أَنَّهُ قَالَ فِي هَذِهِ الْآيَةِ {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ} [النور 3] قَالَ كُنَّ بَغَايَا فِي الْمَدِينَةِ مَعْلُومٌ شَأْنُهُنَّ فَحَرَّمَ اللهُ نِكَاحَهُنَّ عَلَى الْمُؤْمِنِينَ وَهُوَ قَوْلُ قَتَادَةَ
[Machine] They were men who wanted to marry women who were sinners, seeking forbidden pleasures, just as it was during the time of ignorance. It was said to them, "This is forbidden." Then, this verse was revealed to them, and Allah forbade them from marrying such women.
هُمْ رِجَالٌ كَانُوا يُرِيدُونَ نِكَاحَ نِسَاءٍ زَوَانٍ بَغَايَا مُتَعَالِنَاتٍ كُنَّ كَذَلِكَ فِي الْجَاهِلِيَّةِ فَقِيلَ لَهُمْ هَذَا حَرَامٌ فَنَزَلَتْ فِيهِمْ هَذِهِ الْآيَةُ فَحَرَّمَ اللهُ نِكَاحَهُنَّ
[Machine] "The saying of Allah SWT: 'The adulterer does not marry except an adulteress or polytheist.' (Surah An-Nur, verse 3). It was stated that this is a judgment between them. Ash-Shafi'i, may Allah have mercy on him, said that it was narrated from Ikrimah that he said: 'The adulterer does not commit adultery except with an adulteress or a polytheist, and the adulteress does not commit adultery except with an adulterer or a polytheist.' It is understood from this that his statement 'marry' is correct."
قَوْلِ اللهِ تَعَالَى {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً} [النور 3] قَالَ ذَلِكَ حُكْمٌ بَيْنَهُمَا فَذَكَرَهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَرُوِيَ عَنْ عِكْرِمَةَ أَنَّهُ قَالَ الزَّانِي لَا يَزْنِي إِلَّا بِزَانِيَةٍ أَوْ مُشْرِكَةٍ وَالزَّانِيَةُ لَا يَزْنِي بِهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ يَذْهَبُ إِلَى أَنَّ قَوْلَهُ يَنْكِحُ يُصِيبُ
[Machine] On the authority of Ikrimah regarding His saying, "The fornicator does not marry except a [female] fornicator or polytheist" [Surah An-Nur 3], he said, "He does not commit adultery except with an adulteress." The sheikh, may Allah have mercy on him, said, and it has been narrated this meaning from another perspective from Ibn Abbas.
عَنْ عِكْرِمَةَ فِي قَوْلِهِ تَعَالَى {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً} [النور 3] قَالَ لَا يَزْنِي إِلَّا بِزَانِيَةٍ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ رُوِيَ هَذَا الْمَعْنَى مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ عَبَّاسٍ
[Machine] "And that was made forbidden upon the believers" [An-Nur 3]. Meaning, fornication was made forbidden upon the believers. It is narrated from Sa'id ibn Jubayr, Mujahid, and Ad-Dahhak that Ash-Shafi'i, may Allah have mercy on him, said: "By Allah, Ibn Musayyib knows best what he said."
{وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ} [النور 3] أَيْ وَحُرِّمَ الزِّنَا عَلَى الْمُؤْمِنِينَ وَبِمَعْنَاهُ رُوِيَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ وَمُجَاهِدٍ وَالضَّحَّاكِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَالَّذِي يُشْبِهُ وَاللهُ أَعْلَمُ مَا قَالَ ابْنُ الْمُسَيِّبِ
[Machine] In His saying {The adulterer marries not but an adulteress or a Mushrikah (idolatress).} [An-Nur 3], the verse said that it is abrogated by the verse {And marry the unmarried among you} [An-Nur 32]. He said: So it is among the unmarried ones among the Muslims.
فِي قَوْلِهِ تَعَالَى {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً} [النور 3] الْآيَةَ قَالَ هِيَ مَنْسُوخَةٌ نَسَخَتْهَا آيَةُ {وَأَنْكِحُوا الْأَيَامَى} [النور 32] مِنْكُمْ قَالَ فَهِيَ مِنْ أَيَامَى الْمُسْلِمِينَ
[Machine] In His saying, "Indeed, He is ever forgiving to those who repent," He said, "One commits a sin, then he repents, then he commits a sin, then he repents." He also said, "The adulteress cannot marry except an adulterer or a polytheist." I heard Him say, "It has been abrogated by the verse 'And marry the unmarried among you' from you and from the righteous among your servants and your female servants."
فِي قَوْلِهِ تَعَالَى {إِنَّهُ كَانَ لِلْأَوَّابِينَ غَفُورًا} قَالَ يُذْنِبُ ثُمَّ يَتُوبُ ثُمَّ يُذْنِبُ ثُمَّ يَتُوبُ قَالَ وَسَمِعْتُهُ يَقُولُ {الزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ} [النور 3] قَالَ نَسَخَتْهَا آيَةُ {وَأَنْكِحُوا الْأَيَامَى} [النور 32] مِنْكُمْ وَالصَّالِحِينَ مِنْ عِبَادِكُمْ وَإِمَائِكُمْ
39.152 [Machine] What can be inferred from the shortening of the verse, either due to its revelation or its abrogation?
٣٩۔١٥٢ بَابُ مَا يُسْتَدَلُّ بِهِ عَلَى قَصْرِ الْآيَةِ عَلَى مَا نَزَلَتْ فِيهِ أَوْ نَسْخِهَا
[Machine] "O Messenger of Allah, I have a cousin who is very beautiful, and she does not refuse the hand of a suitor." He (the Prophet) said, "Divorce her." He replied, "I cannot bear to do that." He (the Prophet) said, "Then keep her." And Ibn 'Uyaynah narrated it on the authority of Harun bin Ri'ab in a Mursal form."
يَا رَسُولَ اللهِ إِنَّ عِنْدِي بِنْتَ عَمٍّ لِي جَمِيلَةً وَأَنَّهَا لَا تَرُدُّ يَدَ لَامِسٍ قَالَ طَلِّقْهَا قَالَ لَا أَصْبِرُ عَنْهَا قَالَ فَأَمْسِكْهَا إِذًا وَرَوَاهُ ابْنُ عُيَيْنَةَ عَنْ هَارُونَ بْنِ رِئَابٍ مُرْسَلًا
A man came to the Prophet ﷺ, and said: My wife does not prevent the hand of a man who touches her. He said: Divorce her. He then said: I am afraid my inner self may covet her. He said: Then enjoy her. (Using translation from Abū Dāʾūd 2049)
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ امْرَأَتِي لَا تَمْنَعُ يَدَ لَامِسٍ قَالَ غَرِّبْهَا قَالَ أَخَافُ أَنْ تَتْبَعَهَا نَفْسِي قَالَ فَاسْتَمْتِعْ بِهَا إِذًا لَيْسَ فِي رِوَايَةِ أَبِي دَاوُدَ إِذًا
[Machine] A man came to the Prophet ﷺ and said, "Indeed, my wife does not prevent the hand of a man from touching her." He said, "Divorce her." The man replied, "But I am pleased with her." The Prophet ﷺ said, "Then enjoy her."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ امْرَأَتِي لَا تَمْنَعُ يَدَ لَامِسٍ قَالَ طَلِّقْهَا قَالَ إِنَّهَا تُعْجِبُنِي قَالَ تَمَتَّعْ بِهَا
[Machine] The Prophet ﷺ came and said, "O Messenger of Allah, I have a wife who does not reject the hand of a toucher." He said, "Divorce her." He said, "But I love her and she is beautiful." He said, "Then enjoy her." This was narrated by Ma'qil ibn Yasaar from Abu Zubair from Jabir.
أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ لِيَ امْرَأَةً وَهِيَ لَا تَدْفَعُ يَدَ لَامِسٍ قَالَ طَلِّقْهَا قَالَ إِنِّي أُحِبُّهَا وَهِيَ جَمِيلَةٌ قَالَ فَاسْتَمْتِعْ بِهَا وَهَكَذَا رُوِيَ عَنْ مَعْقِلِ بْنِ عُبَيْدِ اللهِ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ ؓ
[Machine] Narrated by the Prophet ﷺ that a man came to him and said, "I have a wife who does not prevent the hand of a toucher." He said, "Separate from her." He said, "I cannot bear to be apart from her." He said, "Enjoy her, and this is how it should be."
عَنِ النَّبِيِّ ﷺ أَنَّ رَجُلًا جَاءَهُ فَقَالَ إِنَّ لِي امْرَأَةً لَا تَمْنَعُ يَدَ لَامِسٍ قَالَ فَارِقْهَا قَالَ إِنِّي لَا أَصْبِرُ عَنْهَا قَالَ فَاسْتَمْتِعْ بِهَا وَكَذَلِكَ
[Machine] The passage translates to: "The boy refused to reconcile between them."
أَنْ يَجْمَعَ بَيْنَهُمَا فَأَبَى الْغُلَامُ
[Machine] A maid committed adultery, so she was punished and then they accepted her as a migrant. The maid repented and her condition improved. She started proposing to her paternal cousin, but he refused to marry her until she confesses her affair. He hated to expose her, so he mentioned her situation to Umar ibn al-Khattab. Umar said to him, "Marry her as you would marry your righteous daughters." He narrated this incident from Abu Bakr as-Siddiq about a man who committed adultery with a married woman and they confessed. They were both whipped a hundred times, then one of them was married to the other's place and they were both exiled for a year.
أَنَّ جَارِيَةً فَجَرَتْ فَأُقِيمَ عَلَيْهَا الْحَدُّ ثُمَّ إِنَّهُمْ أَقْبَلُوا مُهَاجِرِينَ فَتَابَتِ الْجَارِيَةُ فَحَسُنَتْ تَوْبَتُهَا وَحَالُهَا فَكَانَتْ تُخْطَبُ إِلَى عَمِّهَا فَيَكْرَهُ أَنْ يُزَوِّجَهَا حَتَّى يُخْبِرَ مَا كَانَ مِنْ أَمْرِهَا وَجَعَلَ يَكْرَهُ أَنْ يُفْشِيَ عَلَيْهَا ذَلِكَ فَذَكَرَ أَمْرَهَا لِعُمَرَ بْنِ الْخَطَّابِ ؓ فَقَالَ لَهُ زَوِّجْهَا كَمَا تُزَوِّجُوا صَالِحِي فَتَيَاتِكُمْ وَرُوِّينَا عَنْ أَبِي بَكْرٍ الصِّدِّيقِ ؓ فِي رَجُلٍ بِكْرٍ افْتَضَّ امْرَأَةً وَاعْتَرَفَا فَجَلَدَهُمَا مِائَةً ثُمَّ زَوَّجَ أَحَدَهُمَا مِنَ الآخَرِ مَكَانَهُ وَنَفَاهُمَا سَنَةً
نَعَمْ ذَلِكَ حِينَ أَصَابَ الْحَلَالَ
[Machine] "He began by killing and ended by marrying. He started with something forbidden and ended with something permissible. Sa'id reported from Qatadah, from Jabir ibn Abdullah, and from Sa'id ibn Musayyib, and from Sa'id ibn Jubair regarding a man who commits adultery with a woman and then marries her. They said, there is no harm in that if they repent and reform, and dislike what they have done."
كَانَ أَوَّلَهُ سِفَاحٌ وَآخِرَهُ نِكَاحٌ وَأَوَّلَهُ حَرَامٌ وَآخِرَهُ حَلَالٌ وَعَنْ سَعِيدٍ عَنْ قَتَادَةَ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ وَسَعِيدِ بْنِ الْمُسَيِّبِ وَسَعِيدِ بْنِ جُبَيْرٍ فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا فَقَالُوا لَا بَأْسَ بِذَلِكَ إِذَا تَابَا وَأَصْلَحَا وَكَرِهَا مَا كَانَ
[Machine] Its beginning is bloodshed and its end is a marriage that is permissible.
أَوَّلُهُ سِفَاحٌ وَآخِرُهُ نِكَاحٌ لَا بَأْسَ بِهِ
[Machine] "It was a good thing that I had planned and intended to do, and I saw a girl who impressed me, so I married her. I will tell you that she was suspicious, so I wanted to protect her. It is narrated from Abu Majlaz, from Ibn Abbas, that he said, 'Know that Allah accepts the repentance of both of them as He accepts it from them while they are separated.' And it is narrated from Abu Hurayrah that he said, 'If their repentance does not benefit both of them, it will not benefit them while they are separated.' He recited, 'Indeed, it is Allah who accepts repentance from his servants.'"
إِنَّهَا كَانَتْ حَسَنَةً هَمَمْتُ بِهَا وَأَنَا قَاضِيهَا يَوْمًا آخَرَ وَرَأَيْتُ جَارِيَةً لِي فَأَعْجَبَتْنِي فَغَشِيتُهَا أَمَا إِنِّي أَزِيدُكُمْ أَنَّهَا كَانَتْ بَغَتْ فَأَرَدْتُ أَنْ أُحَصِّنَهَا وَرُوِيَ عَنْ أَبِي مِجْلَزٍ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ قَالَ اعْلَمْ أَنَّ اللهَ يَقْبَلُ التَّوْبَةَ مِنْهُمَا جَمِيعًا كَمَا يَقْبَلُ مِنْهُمَا وَهُمَا مُتَفَرِّقَانِ وَرُوِيَ عَنْ أَبِي هُرَيْرَةَ ؓ أَنَّهُ قَالَ إِنْ لَمْ تَنْفَعْهُمَا تَوْبَتُهُمَا جَمِيعًا لَمْ تَنْفَعْهُمَا وَهُمَا مُتَفَرِّقَانِ قَالَ وَقَرَأَ {إِنَّ اللهَ هُوَ يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ}
[Machine] "The Prophet ﷺ said that the adulterer marries only a woman who is also an adulterer. Amr questioned him and asked, 'What do you find strange about this?' Sa'eed al-Maqburi narrated to us, from Abu Huraira, that the Prophet ﷺ specifically called Abdullah bin Amr with this statement."
أَنَّ الْحَسَنَ يَقُولُ إِنَّ الزَّانِيَ الْمَجْلُودَ لَا يَنْكِحُ إِلَّا مَجْلُودَةً مِثْلَهُ فَقَالَ عَمْرٌو وَمَا يُعْجِبُكَ؟ حَدَّثَنَاهُ سَعِيدٌ الْمَقْبُرِيُّ عَنْ أَبِي هُرَيْرَةَ ؓ أَنَّ النَّبِيَّ ﷺ وَكَانَ عَبْدُ اللهِ بْنُ عَمْرٍو ؓ يُنَادِي بِهَا نِدَاءً فَهَكَذَا
[Machine] A man married a woman, and he committed a grave sin. He was punished and brought to Ali, who then separated him from his wife. Ali said to the man, "Do not marry anyone other than a woman who has been whipped, like you. This man is cut off." It was narrated from Hanash ibn Al-Mu'tamir that a group of people disputed with Ali regarding a man who had married a woman and committed adultery with her before consummating the marriage. Ali separated them, and Hanash, who was not strong, narrated this.
أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً فَأَصَابَ فَاحِشَةً وَضُرِبَ الْحَدَّ ثُمَّ جِيءَ بِهِ إِلَى عَلِيٍّ ؓ فَفَرَّقَ عَلِيٌّ ؓ بَيْنَهُ وَبَيْنَ امْرَأَتِهِ ثُمَّ قَالَ لِلرَّجُلِ لَا تَتَزَوَّجْ إِلَّا مَجْلُودَةً مِثْلَكَ فَهَذَا مُنْقَطِعٌ وَرُوِيَ عَنْ حَنَشِ بْنِ الْمُعْتَمِرِ أَنَّ قَوْمًا اخْتَصَمُوا إِلَى عَلِيٍّ ؓ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَزَنَى أَحَدُهُمَا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ فَفَرَّقَ بَيْنَهُمَا وَحَنَشٌ غَيْرُ قَوِيٍّ
[Machine] Both of them committed adultery when they got together.
هُمَا زَانِيَانِ مَا اجْتَمَعَا
[Machine] Regarding Ibn Mas'ud, what indicated the permissibility?
عَنِ ابْنِ مَسْعُودٍ مَا دَلَّ عَلَى الرُّخْصَةِ
[Machine] "That he may marry her? So he recited this verse, 'Then indeed your Lord, to those who have done evil out of ignorance and then repent after that and correct themselves - indeed, your Lord, thereafter, is Forgiving and Merciful.' [Surah An-Nahl: 119] He repeated it to him multiple times until he thought that he had given him permission in it."
أَنْ يَتَزَوَّجَهَا؟ فَتَلَا هَذِهِ الْآيَةَ {ثُمَّ إِنَّ رَبَّكَ لِلَّذِينَ عَمِلُوا السُّوءَ بِجَهَالَةٍ ثُمَّ تَابُوا مِنْ بَعْدِ ذَلِكَ وَأَصْلَحُوا إِنَّ رَبَّكَ مِنْ بَعْدِهَا لَغَفُورٌ رَحِيمٌ} [النحل 119] قَالَ فَرَدَّدَهَا عَلَيْهِ مِرَارًا حَتَّى ظَنَّ أَنَّهُ قَدْ رَخَّصَ فِيهَا
[Machine] That I asked him how to read it, while I was sitting with him. Then a man came to him and asked him about the man who commits adultery with a woman and then marries her. So he recited to him, "{And it is He who accepts repentance from His servants and pardons misdeeds, and He knows what you do}" [Ash-Shura: 25]. Abu Hazim Al-Hafiz informed us that Abu Al-Fadl ibn Khumayrawayh narrated to us, on the authority of Ahmad ibn Najdah, on the authority of Sa'id ibn Mansur, on the authority of Khalaf ibn Khalifah, on the authority of Abu Janab Yahya ibn Abi Hayyah Al-Kalbi, with this story. And he said, "Does he marry her?" So Abdullah recited the verse to him and said, "Then marry her." And Ibrahim ibn Mujahid narrated from Al-Nakha'i, from Hammad ibn Al-Harith, from Abdullah ibn Mas'ud regarding the man who commits adultery with a woman and then desires to marry her. He said, "There is no harm in that."
أَنْ أَسْأَلَهُ كَيْفَ أَقْرَؤُهَا فَبَيْنَا أَنَا جَالِسٌ عِنْدَهُ إِذْ أَتَاهُ رَجُلٌ فَسَأَلَهُ عَنِ الرَّجُلِ يَزْنِي بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا فَقَرَأَ عَلَيْهِ {وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ} [الشورى 25] 13887 وَأَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ خُمَيْرَوَيْهِ ثنا أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا خَلَفُ بْنُ خَلِيفَةَ ثنا أَبُو جَنَابٍ يَحْيَى بْنُ أَبِي حَيَّةَ الْكَلْبِيُّ بِهَذِهِ الْقِصَّةِ وَقَالَ أَيَتَزَوَّجُهَا؟ فَتَلَا عَبْدُ اللهِ الْآيَةَ وَقَالَ لِيَتَزَوَّجْهَا وَرَوَى إِبْرَاهِيمُ بْنُ مُهَاجِرٍ عَنِ النَّخَعِيِّ عَنْ هَمَّامِ بْنِ الْحَارِثِ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يُرِيدُ أَنْ يَتَزَوَّجَهَا قَالَ لَا بَأْسَ بِذَلِكَ
[Machine] "A man has sexual relations with a woman and then marries her, they both continue to commit adultery. Ibn Abbas was asked about this and he said, "This is fornication and this is marriage." It is also mentioned that Bara ibn Azib spoke similarly to Aisha's statement. The evidence from the Quran and Sunnah is with those who permit it, and with Allah is the guidance."
رَجُلٍ يَفْجُرُ بِامْرَأَةٍ ثُمَّ يَتَزَوَّجُهَا لَا يَزَالِانِ زَانِيَيْنِ قَالَ وَسُئِلَ عَنْ ذَلِكَ ابْنُ عَبَّاسٍ فَقَالَ هَذَا سِفَاحٌ وَهَذَا نِكَاحٌ وَيُذْكَرُ عَنِ الْبَرَاءِ بْنِ عَازِبٍ نَحْوُ قَوْلِ عَائِشَةَ ؓ وَقَدْ عُورِضَ بِقَوْلِ ابْنِ عَبَّاسٍ كَمَا عُورِضَ بِقَوْلِهِ قَوْلُ عَائِشَةَ ؓ وَمَعَ مَنْ رَخَّصَ فِيهِ دَلَائِلُ الْكِتَابِ وَالسُّنَّةِ وَبِاللهِ التَّوْفِيقُ
39.153 [Machine] No punishment for fornication (adultery) on the woman, and whoever marries a woman who was previously engaged in fornication, their marriage is not annulled, as evidence by what we have narrated in the established Hadith from Aisha and Abu Hurairah, that the Prophet ﷺ said: "The child belongs to the bed, and the stone is for the adulterer." Therefore, there is no prohibition on the water of the adulterous person.
٣٩۔١٥٣ بَابُ لَا عِدَّةَ عَلَى الزَّانِيَةِ وَمَنْ تَزَوَّجَ امْرَأَةً حُبْلَى مِنْ زِنًا لَمْ يُفْسَخِ النِّكَاحُ اسْتِدْلَالًا بِمَا رَوَيْنَا فِي الْحَدِيثِ الثَّابِتِ عَنْ عَائِشَةَ وَأَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ: " الْوَلَدُ لِلْفِرَاشِ، وَلِلْعَاهِرِ الْحَجَرُ "، فَلَمْ يَجْعَلْ لِمَاءِ الْعَاهِرِ حُرْمَةً
[Machine] About a man from the companions of the Messenger of Allah ﷺ from the Ansar named Basrah. He said, "I married a virgin woman in her privacy (without the consent of her guardian). I entered upon her and found her to be pregnant. The Prophet ﷺ said to me, 'She has the right to the dowry for what you enjoyed from her private part, and the child belongs to you. But if she gives birth, then flog her.' The sheikh, may Allah have mercy on him, said, 'This hadith was only narrated by Ibn Jurayj from Ibrahim ibn Abi Yahya from Safwan bin Sulaim, and Ibrahim's reliability is disputed. And Abu Bakr bin Al-Harith Al-Faqih informed us that Ali bin Umar Al-Hafith narrated to him that Ismail bin Yunus bin Yassin narrated to him that Ishaq bin Abi Israil narrated to him that Abdul Razzaq narrated to him from Ibn Jurayj from Safwan bin Sulaim. He mentioned it in a similar way but did not say it was said by Basrah.' Abdul Razzaq said, 'And the hadith of Ibn Jurayj from Safwan bin Sulaim is Ibn Jurayj's narration from Ibrahim bin Abi Yahya from Safwan bin Sulaim."
عَنْ رَجُلٍ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ مِنَ الْأَنْصَارِ يُقَالُ لَهُ بَصْرَةُ قَالَ تَزَوَّجْتُ امْرَأَةً بِكْرًا فِي سِتْرِهَا فَدَخَلْتُ عَلَيْهَا فَإِذَا هِيَ حُبْلَى فَقَالَ لِيَ النَّبِيُّ ﷺ لَهَا الصَّدَاقُ بِمَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا وَالْوَلَدُ عَبْدٌ لَكَ فَإِذَا وَلَدَتْ فَاجْلِدُوهَا قَالَ الشَّيْخُ رَحِمَهُ اللهُ فَهَذَا الْحَدِيثُ إِنَّمَا أَخَذَهُ ابْنُ جُرَيْجٍ عَنْ إِبْرَاهِيمَ بْنِ أَبِي يَحْيَى عَنْ صَفْوَانَ بْنِ سُلَيْمٍ وَإِبْرَاهِيمُ مُخْتَلَفٌ فِي عَدَالَتِهِ 13890 وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أَنْبَأَ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا إِسْمَاعِيلُ بْنُ يُونُسَ بْنِ يَاسِينَ ثنا إِسْحَاقُ بْنُ أَبِي إِسْرَائِيلَ ثنا عَبْدُ الرَّزَّاقِ عَنِ ابْنِ جُرَيْجٍ عَنْ صَفْوَانَ بْنِ سُلَيْمٍ فَذَكَرَهُ بِنَحْوِهِ لَمْ يَقُلْ يُقَالُ لَهُ بَصْرَةُ قَالَ عَبْدُ الرَّزَّاقِ وَحَدِيثُ ابْنِ جُرَيْجٍ عَنْ صَفْوَانَ بْنِ سُلَيْمٍ هُوَ ابْنُ جُرَيْجٍ عَنْ إِبْرَاهِيمَ بْنِ أَبِي يَحْيَى عَنْ صَفْوَانَ بْنِ سُلَيْمٍ
[Machine] He married a virgin woman, then he had sexual intercourse with her and found her lacking in sexual experience. He mentioned this to the Prophet ﷺ , and the Prophet separated them. Then, he said that if she becomes pregnant, then flog her with the prescribed punishment and let her have her bridal gift for what he has enjoyed from her vagina, and likewise.
أَنَّهُ تَزَوَّجَ امْرَأَةً بِكْرًا فَدَخَلَ بِهَا فَوَجَدَهَا حُبْلَى فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَفَرَّقَ بَيْنَهُمَا ثُمَّ قَالَ إِذَا وَضَعَتْ فَاجْلِدُوهَا الْحَدَّ وَجَعَلَ لَهَا صَدَاقَهَا بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَكَذَلِكَ
[Machine] A man married a woman, and when she became pregnant, he accused her of adultery. The matter was brought to the Prophet, who ordered that they be separated. He assigned her a dowry and flogged her one hundred times. This is a Mursal Hadith, and the evidence indicates that it is permissible for a Muslim adulterous woman to get married and that marriage is not annulled by adultery. God has only established the waiting period (iddah) in marriage. The Prophet also prohibited inheritance from non-Muslim rulers, and it is agreed upon by the scholars that a child born from an adulterous free woman is considered free. It is possible that this Hadith, if authentic, has been abrogated, and Allah knows best.
أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً فَلَمَّا أَصَابَهَا وَجَدَهَا حُبْلَى فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَفَرَّقَ بَيْنَهُمَا وَجَعَلَ لَهَا الصَّدَاقَ وَجَلَدَهَا مِائَةً هَذَا حَدِيثٌ مُرْسَلٌ وَقَدْ مَضَتِ الدَّلَالَةُ عَلَى جَوَازِ نِكَاحِ الزَّانِيَةِ الْمُسْلِمَةِ وَأَنَّهُ لَا يُفْسَخُ بِالزِّنَا وَإِنَّمَا جَعَلَ اللهُ تَعَالَى الْعِدَّةَ فِي النِّكَاحِ وَجَعَلَ النَّبِيُّ ﷺ الِاسْتِبْرَاءَ مِنَ الْمِلْكِ وَأَجْمَعَ أَهْلُ الْعِلْمِ عَلَى أَنَّ وَلَدَ الزِّنَا مِنَ الْحُرَّةِ يَكُونُ حُرًّا فَيُشْبِهُ أَنْ يَكُونَ هَذَا الْحَدِيثُ إِنْ كَانَ صَحِيحًا مَنْسُوخًا وَاللهُ أَعْلَمُ
39.154 [Machine] Marriage and Divorce of the Slave.
٣٩۔١٥٤ بَابُ نِكَاحِ الْعَبْدِ وَطَلَاقِهِ
[Machine] He (Prophet Muhammad) said: "A slave (man) may marry two women, and divorce two times. And a female slave (servant) shall observe the waiting period (of divorce) for two menstrual cycles. And if she does not menstruate, then for two months or a month and a half." Sufyan said: "And he (Prophet Muhammad) was trustworthy."
أَنَّهُ قَالَ يَنْكِحُ الْعَبْدُ امْرَأَتَيْنِ وَيُطَلِّقُ تَطْلِيقَتَيْنِ وَتَعْتَدُّ الْأَمَةُ حَيْضَتَيْنِ وَإِنْ لَمْ تَكُنْ تَحِيضُ فَشَهْرَيْنِ أَوْ شَهْرٌ وَنِصْفٌ قَالَ سُفْيَانُ وَكَانَ ثِقَةً
[Machine] Umar said from the pulpit, "Do you know how many times a slave gets married?" A man stood up and said, "I do." Umar asked, "How many times?" The man replied, "Two." Others added more to it, but Umar fell silent and said, then another man from the Ansar stood up...
قَالَ عُمَرُ ؓ عَلَى الْمِنْبَرِ أَتَدْرُونَ كَمْ يَنْكِحُ الْعَبْدُ؟ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنَا قَالَ كَمْ؟ قَالَ اثْنَتَيْنِ زَادَ فِيهِ غَيْرُهُ فَسَكَتَ عُمَرُ وَقَالَ فَقَامَ رَجُلٌ مِنَ الْأَنْصَارِ
[Machine] The servant marries two women, not exceeding them, and likewise...
يَنْكِحُ الْعَبْدُ اثْنَتَيْنِ لَا يَزِيدُ عَلَيْهِمَا وَكَذَلِكَ
[Machine] The companions of the Messenger of Allah ﷺ gathered and agreed that a man cannot marry more than two women at the same time.
اجْتَمَعَ أَصْحَابُ رَسُولِ اللهِ ﷺ عَلَى أَنَّ الْمَمْلُوكَ لَا يَجْمَعُ مِنَ النِّسَاءِ فَوْقَ اثْنَتَيْنِ

٣٩۔١٥٥ جُمَّاعُ أَبْوَابِ مَا يَحْرُمُ مِنْ نِكَاحِ الْحَرَائِرِ وَمَا يَحِلُّ مِنْهُ وَمِنَ الْإِمَاءِ وَالْجَمْعِ بَيْنَهُنَّ وَغَيْرِ ذَلِكَ
39.156 [Machine] What is prohibited in terms of marriage from kinship and breastfeeding and others. Said Allah Almighty: "Forbidden to you [for marriage] are your mothers, your daughters, your sisters, your paternal aunts, your maternal aunts, daughters of brothers, daughters of sisters, your nursing mothers, your sisters through nursing, mothers of your wives, your stepdaughters under your guardianship [born] of your wives unto whom you have gone in. But if you have not gone in unto them, there is no sin upon you. And [also prohibited are] the wives of your sons who are from your [own] loins, and that you take [in marriage] two sisters simultaneously, except for what has already occurred. Indeed, Allah is ever Forgiving and Merciful." [Quran 4:23] And He said, exalted be He: "And do not marry those [women] whom your fathers married, except what has already occurred. Indeed, it was an immorality and hateful [to Allah] and was evil as a way." [Quran 4:22]
٣٩۔١٥٦ بَابُ مَا يَحْرُمُ مِنْ نِكَاحِ الْقَرَابَةِ وَالرَّضَاعِ وَغَيْرِهِمَا قَالَ اللهُ تَعَالَى: {حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ وَأَخَوَاتُكُمْ وَعَمَّاتُكُمْ وَخَالِاتُكُمْ وَبَنَاتُ الْأَخِ وَبَنَاتُ الْأُخْتِ وَأُمَّهَاتُكُمُ اللَّاتِي أَرْضَعْنَكُمْ وَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِ وَأُمَّهَاتُ نِسَائِكُمْ وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلَا جُنَاحَ عَلَيْكُمْ وَحَلَائِلُ أَبْنَائِكُمُ الَّذِينَ مِنْ أَصْلَابِكُمْ وَأَنْ تَجْمَعُوا بَيْنَ الْأُخْتَيْنِ إِلَّا مَا قَدْ سَلَفَ إِنَّ اللهَ كَانَ غَفُورًا رَحِيمًا} [النساء: 23] وَقَالَ تَعَالَى: {وَلَا تَنْكِحُوا مَا نَكَحَ آبَاؤُكُمْ مِنَ النِّسَاءِ} [النساء: 22]
[Machine] He has forbidden you seven forbiddances regarding lineage and seven regarding marriage. Forbidden to you are your mothers, daughters, until the end of the verse.
حَرَّمَ عَلَيْكُمْ سَبْعًا نَسَبًا وَسَبْعًا صِهْرًا حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ إِلَى آخِرِ الْآيَةِ
[Machine] Ibn Abbas said, "Seven (marriages) through marriage and seven through lineage, and what is prohibited by lineage is also prohibited by breastfeeding."
قَالَ ابْنُ عَبَّاسٍ سَبْعٌ صِهْرٌ وَسَبْعٌ نَسَبٌ وَيَحْرُمُ مِنَ الرَّضَاعِ مَا يَحْرُمُ مِنَ النَّسَبِ
The Prophet ﷺ said: What is unlawful by reason of consanguinity is unlawful by reason of fosterage. (Using translation from Abū Dāʾūd 2055)
رَسُولَ اللهِ ﷺ قَالَ يَحْرُمُ مِنَ الرَّضَاعَةِ مَا يَحْرُمُ مِنَ الْوِلَادَةِ
[Machine] Aisha, the wife of the Prophet ﷺ , informed him that the Messenger of Allah ﷺ was with her and that she heard the sound of a man seeking permission to enter Hafsa's house. Aisha said to him, "O Messenger of Allah, a man seeking permission to enter your house." The Messenger of Allah ﷺ said, "I think it is so-and-so, who is brother in nursing to Hafsa." Aisha said, "O Messenger of Allah, if he were alive, would he have entered upon me?" The Messenger of Allah ﷺ said, "Yes, for breastfeeding prohibits what birth prohibits."
أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ أَخْبَرَتْهَا أَنَّ رَسُولَ اللهِ ﷺ كَانَ عِنْدَهَا وَأَنَّهَا سَمِعَتْ صَوْتَ رَجُلٍ يَسْتَأْذِنُ فِي بَيْتِ حَفْصَةَ قَالَتْ عَائِشَةُ فَقُلْتُ يَا رَسُولَ اللهِ رَجُلٌ يَسْتَأْذِنُ فِي بَيْتِكَ قَالَتْ فَقَالَ رَسُولُ اللهِ ﷺ أَرَاهُ فُلَانًا لِعَمِّ حَفْصَةَ مِنَ الرَّضَاعَةِ فَقَالَتْ عَائِشَةُ يَا رَسُولَ اللهِ لَوْ كَانَ فُلَانٌ حَيًّا لِعَمِّهَا مِنَ الرَّضَاعَةِ دَخَلَ عَلَيَّ؟ فَقَالَ رَسُولُ اللهِ ﷺ نَعَمْ إِنَّ الرَّضَاعَةَ تُحَرِّمُ مَا تُحَرِّمُ الْوِلَادَةُ
39.157 [Machine] What is stated in the saying of Allah: {And [also prohibited to you are all] married women except those your right hands possess. [This is] the decree of Allah upon you.} [Surah An-Nisa: 23]. Imam Ash-Shafi'i (may Allah have mercy on him) said: The mother is unclear in the prohibition mentioned in the Book of Allah. There is no condition in it. The condition is only regarding the concubines. This is also the opinion of the majority of scholars. It is narrated from Umar and others that he was close to it.
٣٩۔١٥٧ بَابُ مَا جَاءَ فِي قَوْلِ اللهِ تَعَالَى: {وَأُمَّهَاتُ نِسَائِكُمْ وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ} [النساء: 23] الْآيَةَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: الْأُمُّ مُبْهَمَةُ التَّحْرِيمِ فِي كِتَابِ اللهِ تَعَالَى لَيْسَ فِيهَا شَرْطٌ إِنَّمَا الشَّرْطُ فِي الرَّبَائِبِ وَهَكَذَا قَوْلُ الْأَكْثَرِ مِنَ الْمُفْتِينَ قَالَ: وَهُوَ يُرْوَى عَنْ عُمَرَ وَغَيْرِهِ قَرِيبٌ مِنْهُ
[Machine] "For the man, truly it is forbidden for you, it is not suitable for you, so leave it."
لِلرَّجُلِ إِنَّهَا عَلَيْكَ حَرَامٌ إِنَّهَا لَا تَنْبَغِي لَكَ فَفَارِقْهَا
[Machine] I got married to a woman whom I did not consummate the marriage with, then her mother impressed me, so I divorced the woman and married her mother. Abdullah came to Al-Madina and asked the Prophet's companions ﷺ , and they said it is not permissible. Then he went to the Banu Shamkh and asked, "Where is the man who married the mother of the woman who was under him?" They said, "He is here." He said, "Let him divorce her." They said, "But she is pregnant with his child." He said, "Let him divorce her, for it is forbidden by Allah." And that is the meaning.
إِنِّي تَزَوَّجْتُ امْرَأَةً لَمْ أَدْخُلْ بِهَا ثُمَّ أَعْجَبَتْنِي أُمُّهَا فَأُطَلِّقُ الْمَرْأَةَ وَأَتَزَوَّجُ أُمَّهَا؟ قَالَ نَعَمْ فَطَلَّقَهَا فَتَزَوَّجَ أُمَّهَا فَأَتَى عَبْدُ اللهِ الْمَدِينَةَ فَسَأَلَ أَصْحَابَ النَّبِيِّ ﷺ فَقَالُوا لَا تَصْلُحُ ثُمَّ قَدِمَ فَأَتَى بَنِي شَمْخٍ فَقَالَ أَيْنَ الرَّجُلُ الَّذِي تَزَوَّجَ أُمَّ الْمَرْأَةِ الَّتِي كَانَتْ تَحْتَهُ؟ قَالُوا هَاهُنَا قَالَ فَلْيُفَارِقْهَا قَالُوا وَقَدْ نَثَرَتْ لَهُ بَطْنُهَا؟ قَالَ فَلْيُفَارِقْهَا فَإِنَّهَا حَرَامٌ مِنَ اللهِ ﷻ وَبِهَذَا الْمَعْنَى
[Machine] Yes, he married her and she gave birth to a child for him. He then presented the child to Umar and asked him to make a decision. Umar said, "Separate between them." He said, "But she has already given birth." Umar asked, "What if she gives birth to ten?" So he separated between them.
نَعَمْ فَتَزَوَّجَهَا فَوَلَدَتْ لَهُ فَقَدِمَ عَلَى عُمَرَ ؓ فَسَأَلَهُ فَقَالَ فَرِّقْ بَيْنَهُمَا قَالَ إِنَّهَا قَدْ وَلَدَتْ قَالَ وَإِنْ وَلَدَتْ عَشْرًا فَفَرَّقَ بَيْنَهُمَا
[Machine] About Abu Furwah in regards to divorce, and when there is a disagreement between Sufyan and Shu'bah, the ruling should be according to the narration of Sufyan because he is more knowledgeable and understanding. And with the narration of Sufyan, there is also the narration of Abu Ishaq from Abu 'Amr.
عَنْ أَبِي فَرْوَةَ فِي الطَّلَاقِ وَإِذَا اخْتَلَفَ سُفْيَانُ وَشُعْبَةُ فَالْحُكْمُ لِرِوَايَةِ سُفْيَانَ لِأَنَّهُ أَحْفَظُ وَأَفْقَهُ وَمَعَ رِوَايَةِ سُفْيَانَ رِوَايَةُ أَبِي إِسْحَاقَ عَنْ أَبِي عَمْرٍو
[Machine] If she died, her mother cannot inherit from her, and if he divorces her, he may marry her again if he wishes, and the opinion of the majority is the most appropriate.
إِنْ كَانَتْ مَاتَتْ فَوَرِثَهَا فَلَا تَحِلُّ لَهُ أُمُّهَا وَإِنْ طَلَّقَهَا فَإِنَّهُ يَتَزَوَّجُهَا إِنْ شَاءَ وَقَوْلُ الْجَمَاعَةِ أَوْلَى
[Machine] That he enters her or dies from her. This does not make her unlawful for him, unless his mother dies from her or divorces her. And this is the saying of Al-Hasan and Qatadah.
أَنْ يَدْخُلَ بِهَا أَوْ مَاتَ عَنْهَا إِنَّهَا لَا تَحِلُّ لَهُ أُمُّهَا مَاتَ عَنْهَا أَوْ طَلَّقَهَا وَهُوَ قَوْلُ الْحَسَنِ وَقَتَادَةَ
[Machine] About the saying of Allah ﷻ, "And your mothers are like your wives" [4:23], he said, "Allah did not send [this verse] so you send it, and what He made clear, so follow it," and he recited, "And your mothers are like your wives, and your stepdaughters who are in your guardianship, born of your wives to whom you have entered. But if you have not entered them, there is no blame upon you," [4:23]. He said, "So He sent this and made it clear." The Sheikh, may Allah have mercy on him, said, and this is the saying of Ata' and 'Ikrimah and others, and it has been narrated in a mutawatir hadith.
عَنْ مَسْرُوقٍ فِي قَوْلِ اللهِ ﷻ {وَأُمَّهَاتُ نِسَائِكُمْ} [النساء 23] قَالَ مَا أَرْسَلَ اللهُ فَأَرْسِلُوهُ وَمَا بَيَّنَ فَاتَّبِعُوهُ ثُمَّ قَرَأَ {وَأُمَّهَاتُ نِسَائِكُمْ وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلَا جُنَاحَ عَلَيْكُمْ} [النساء 23] قَالَ فَأَرْسَلَ هَذِهِ وَبَيَّنَ هَذِهِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَهُوَ قَوْلُ عَطَاءٍ وَعِكْرِمَةَ وَغَيْرِهِمْ وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مُسْنَدٌ
[Machine] The Prophet ﷺ said, "If a man marries a woman and then divorces her before consummating the marriage, he has the right to marry her daughter. However, he does not have the right to marry her mother." This narration has been confirmed by Abdullah bin Lahia from Amr.
النَّبِيِّ ﷺ قَالَ إِذَا نَكَحَ الرَّجُلُ الْمَرْأَةَ ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَلَهُ أَنْ يَتَزَوَّجَ ابْنَتَهَا وَلَيْسَ لَهُ أَنْ يَتَزَوَّجَ أُمَّهَا مُثَنَّى بْنُ الصَّبَّاحِ غَيْرُ قَوِيٍّ وَقَدْ تَابَعَهُ عَلَى هَذِهِ الرِّوَايَةِ عَبْدُ اللهِ بْنُ لَهِيعَةَ عَنْ عَمْرٍو
The Prophet said: "Whichever man married a woman and entered into her, then it is not lawful for him to marry her daughter. If he did not enter into her then he may marry her daughter. And whichever man married a woman and he entered into her, or he did not enter into her, then it is not lawful for him to marry her mother." (Using translation from Tirmidhī 1117)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ نَكَحَ امْرَأَةً فَدَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا فَلَا يَحِلُّ لَهُ نِكَاحُ أُمِّهَا وَأَيُّمَا رَجُلٍ نَكَحَ امْرَأَةً فَدَخَلَ بِهَا فَلَا يَحِلُّ لَهُ نِكَاحُ ابْنَتِهَا وَإِنْ لَمْ يَدْخُلْ بِهَا فَلْيَنْكِحِ ابْنَتَهَا إِنْ شَاءَ وَاللهُ أَعْلَمُ بِالصَّوَابِ
39.158 [Machine] What came in the saying of Allah: "And lawful for you are your stepchildren who are from your [own] lineage"? [An-Nisa: 23]
٣٩۔١٥٨ بَابُ مَا جَاءَ فِي قَوْلِ اللهِ ﷻ: {وَحَلَائِلُ أَبْنَائِكُمُ الَّذِينَ مِنْ أَصْلَابِكُمْ} [النساء: 23]
[Machine] From Ibn Abbas regarding the saying of Allah the Exalted, "And do not marry those [women] whom your fathers married..." [An-Nisa 22] and His saying, "And [also prohibited to you are all] married women except those your right hands possess..." [An-Nisa 23]. Every woman whom your father or your son has married, whether he had sexual intercourse with her or not, it is forbidden for you.
عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِ اللهِ تَعَالَى {وَلَا تَنْكِحُوا مَا نَكَحَ آبَاؤُكُمْ مِنَ النِّسَاءِ} [النساء 22] وَقَوْلِهِ {وَحَلَائِلُ أَبْنَائِكُمْ} [النساء 23] يَقُولُ كُلُّ امْرَأَةٍ تَزَوَّجَهَا أَبُوكَ أَوِ ابْنُكَ دَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا فَهِيَ حَرَامٌ عَلَيْكَ
