٣٩۔ كِتَابُ النِّكَاحِ ص ١٣

He said, "Even if she were not my step-daughter, she would be unlawful for me to marry as she is my foster niece. I and Abu Salama were suckled by Thuwaiba. So you should not present to me your daughters or your sisters (in marriage)." Narrated 'Urwa: Thuwaiba was the freed slave girl of Abu Lahb whom he had manumitted, and then she suckled the Prophet. When Abu Lahb died, one of his relatives saw him in a dream in a very bad state and asked him, "What have you encountered?" Abu Lahb said, "I have not found any rest since I left you, except that I have been given water to drink in this (the space between his thumb and other fingers) and that is because of my manumitting Thuwaiba." I said, "O Messenger of Allah ﷺ! Marry my sister, the daughter of Abu Sufyan." He said, "Do you like that?" I said, "Yes, for even now I am not your only wife; and the most beloved person to share the good with me is my sister." The Prophet ﷺ said, "But that is not lawful for me (i.e., to be married to two sisters at a time.)" I said, "O Messenger of Allah ﷺ! By Allah, we have heard that you want to marry Durra, the daughter of Abu Salama." He said, "You mean the daughter of Um Salama?" I said, "Yes." He said, "By Allah ! Even if she were not my stepdaughter, she would not be lawful for me to marry, for she is my foster niece, for Thuwaiba has suckled me and Abu Salama; so you should neither present your daughters, nor your sisters to me." عُثْمَانُ ؓ أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ وَأَمَّا أَنَا فَلَا أُحِبُّ أَنْ أَصْنَعَ هَذَا قَالَ فَخَرَجَ مِنْ عِنْدِهِ فَلَقِيَ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ فَقَالَ لَوْ كَانَ لِي مِنَ الْأَمْرِ شَيْءٌ ثُمَّ وَجَدْتُ أَحَدًا فَعَلَ ذَلِكَ لَجَعَلْتُهُ نَكَالًا قَالَ مَالِكٌ رَحِمَهُ اللهُ قَالَ ابْنُ شِهَابٍ أَرَاهُ عَلِيَّ بْنَ أَبِي طَالِبٍ ؓ قَالَ مَالِكٌ وَبَلَغَنِي عَنِ الزُّبَيْرِ بْنِ الْعَوَّامِ مِثْلُ ذَلِكَ
[Machine] Niyar al-Aslami asked a man from the companions of the Messenger of Allah ﷺ about the two sisters in what the right hand possesses. The man said to him, "There is a verse that permits them and a verse that prohibits them, and I did not do that." Niyar then left that man and met another man from the companions of the Messenger of Allah ﷺ , and he said to him, "What did your companion whom you asked tell you?" Niyar informed him, so he said, "I forbid you from them, and even if you were to bring them together, I have authority over you, and I will punish you severely."
أَنَّ نِيَارًا الْأَسْلَمِيَّ سَأَلَ رَجُلًا مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ عَنِ الْأُخْتَيْنِ فِيمَا مَلَكَتِ الْيَمِينُ فَقَالَ لَهُ أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ وَلَمْ أَكُنْ لِأَفْعَلَ ذَلِكَ قَالَ فَخَرَجَ نِيَارٌ مِنْ عِنْدِ ذَاكَ الرَّجُلِ فَلَقِيَهُ رَجُلٌ آخَرُ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ فَقَالَ مَا أَفْتَاكَ بِهِ صَاحِبُكَ الَّذِي اسْتَفْتَيْتَهُ فَأَخْبَرَهُ فَقَالَ إِنِّي أَنْهَاكَ عَنْهُمَا وَلَوْ جَمَعْتَ بَيْنَهُمَا وَلِي عَلَيْكَ سُلْطَانٌ عَاقَبْتُكَ عُقُوبَةً مُنَكِّلَةً
[Machine] About the woman and her daughter from the king of the right hand, does one of them step on the other? Omar said, "I do not like to judge them both," and Abu Ahmad said, "I do."
عَنِ الْمَرْأَةِ وَابْنَتِهَا مِنْ مِلْكِ الْيَمِينِ هَلْ تُوطَأُ إِحْدَاهُمَا بَعْدَ الْأُخْرَى؟ فَقَالَ عُمَرُ ؓ مَا أُحِبُّ أَنْ أُجِيزَهُمَا جَمِيعًا وَقَالَ أَبُو أَحْمَدَ أَنْ أُجِيزَهُمَا
[Machine] 'Umar was asked about the mother and daughter from Milki al-Yameen, so he said, "I do not like to justify both of them." 'Ubaidullah said, "My father said, 'I wish 'Umar was stricter in this matter than he actually was.'" The scholar, may Allah have mercy on him, said, "Ibn 'Umar said, 'I wish, and indeed he is the son of 'Utbah, there is no doubt about it.'"
سُئِلَ عُمَرُ ؓ عَنِ الْأُمِّ وَابْنَتِهَا مِنْ مِلْكِ الْيَمِينِ فَقَالَ مَا أُحِبُّ أَنْ يُجِيزَهُمَا جَمِيعًا قَالَ عُبَيْدُ اللهِ قَالَ أَبِي فَوَدِدْتُ أَنَّ عُمَرَ ؓ كَانَ أَشَدَّ فِي ذَلِكَ مِمَّا هُوَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ غَلِطَ الْمُزَنِيُّ رَحِمَهُ اللهُ فِي ذَلِكَ فَقَالَ قَالَ ابْنُ عُمَرَ وَدِدْتُ وَإِنَّمَا هُوَ ابْنُ عُتْبَةَ لَا شَكَّ فِيهِ
[Machine] The Abbas informed Rabi' that Shafi'i informed Muslim and Abd al-Majid about Ibn Jurayj, who said: "I heard Ibn Abi Mulaikah informing that Mu'adh ibn Ubayd Allah ibn Ma'mar came to Aisha and said to her, 'I have a secret that I shared with her, and she has a young daughter. Should I ask for her (hand in marriage)?' She said, 'No.' He said, 'By Allah, I will not abandon her until she says, 'Allah has prohibited it.' She said, 'No one from my family would do that, nor would anyone obey me (in doing so).'"
الْعَبَّاسِ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ مُسْلِمٌ وَعَبْدُ الْمَجِيدِ عَنِ ابْنِ جُرَيْجٍ قَالَ سَمِعْتُ ابْنَ أَبِي مُلَيْكَةَ يُخْبِرُ أَنَّ مُعَاذَ بْنَ عُبَيْدِ اللهِ بْنِ مَعْمَرٍ جَاءَ عَائِشَةَ ؓ فَقَالَ لَهَا إِنَّ لِي سُرِّيَّةً أَصَبْتُهَا وَإِنَّهَا قَدْ بَلَغَتْ لَهَا ابْنَةٌ جَارِيَةٌ لِي أَفَأَسْتَسِرُّ ابْنَتَهَا؟ فَقَالَتْ لَا قَالَ فَإِنِّي وَاللهِ لَا أَدَعُهَا إِلَّا أَنْ تَقُولِي حَرَّمَهَا اللهُ فَقَالَتْ لَا يَفْعَلُهُ أَحَدٌ مِنْ أَهْلِي وَلَا أَحَدٌ أَطَاعَنِي
[Machine] "In the two enslaved sisters, one verse made them permissible and another verse made them forbidden. So, I do not command or prohibit, nor do I permit or forbid. I neither do it, nor does my household."
فِي الْأُخْتَيْنِ الْمَمْلُوكَتَيْنِ أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ فَلَا آمُرُ وَلَا أَنْهَى وَلَا أُحِلُّ وَلَا أُحَرِّمُ وَلَا أَفْعَلُهُ أَنَا وَلَا أَهْلُ بَيْتِي
[Machine] About the man who has two slave girls, does he have intercourse with one of them or the other? He said: One is permissible for him and the other is forbidden. I forbid myself and my children from them. And it was narrated from Ibn Abbas regarding the slave girl and her daughter the like of this.
عَنِ الرَّجُلِ تَكُونُ لَهُ جَارِيَتَانِ أُخْتَانِ فَيَطَأُ إِحْدَاهُمَا أَيَطَأُ الْأُخْرَى؟ فَقَالَ أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ وَأَنَا أَنْهَى عَنْهُمَا نَفْسِي وَوَلَدِي وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ فِي الْجَارِيَةِ وَابْنَتِهَا مِثْلُ هَذَا
[Machine] Ibn Abbas permits them at that time. They were made permissible by one verse and made forbidden by another verse. The prohibition is only upon my relatives from them, and it does not make them prohibited upon the relatives of others. This is according to the saying of Allah the Exalted: "And [also prohibited to you are] all married women except those your right hands possess." [Surah An-Nisa 24]
ابْنُ عَبَّاسٍ ؓ عِنْدَ ذَلِكَ أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ إِنَّمَا تُحَرِّمُهُنَّ عَلَى قَرَابَتِي مِنْهُنَّ وَلَا يُحَرِّمُهُنَّ عَلَى قَرَابَةِ بَعْضِهِمْ مِنْ بَعْضٍ لِقَوْلِ اللهِ تَعَالَى {وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ} [النساء 24]
[Machine] A man asked Ali: "I have two slave women, sisters. He has had relations with one of them and now wants to have relations with the other. Ali replied: "No, not until he frees her from his ownership."
عَنْ عَلِيٍّ ؓ سَأَلَهُ رَجُلٌ لَهُ أَمَتَانِ أُخْتَانِ وَطِئَ إِحْدَاهُمَا ثُمَّ أَرَادَ أَنْ يَطَأَ الْأُخْرَى قَالَ لَا حَتَّى يُخْرِجَهَا مِنْ مِلْكِهِ
[Machine] Ibn Umar had two sisters who he had sexual relations with. He then wanted to have relations with the other sister, so he expelled the sister he had previously engaged with from his ownership.
لِابْنِ عُمَرَ ؓ مَمْلُوكَتَانِ أُخْتَانِ فَوَطِئَ إِحْدَاهُمَا ثُمَّ أَرَادَ أَنْ يَطَأَ الْأُخْرَى فَأَخْرَجَ الَّتِي وَطِئَ مِنْ مِلْكِهِ
[Machine] If a man has two sisters, and he deceives one of them, he should not approach the other until he removes the one he deceived from his possession.
إِذَا كَانَ لِلرَّجُلِ جَارِيَتَانِ أُخْتَانِ فَغَشِيَ إِحْدَاهُمَا فَلَا يَقْرَبِ الْأُخْرَى حَتَّى يُخْرِجَ الَّتِي غَشِيَ مِنْ مِلْكِهِ
عَنِ الْحَسَنِ فَذَكَرَهُ
39.165 [Machine] What was in the gathering between the woman, her aunt, and between her and her paternal aunt?
٣٩۔١٦٥ بَابُ مَا جَاءَ فِي الْجَمْعِ بَيْنَ الْمَرْأَةِ، وَعَمَّتِهَا وَبَيْنَهَا وَبَيْنَ خَالَتِهَا
[Machine] Abu Al-Muwajjah narrated from Abdan, who reported from Abdullah, who reported from Yunus, who heard Az-Zuhri saying, on the authority of Qabisa ibn Dhuayb, that he heard Abu Hurairah saying: The Messenger of Allah ﷺ prohibited the marriage between a woman and her paternal aunt, as well as the marriage between a woman and her maternal aunt. This is the wording of the hadith narrated by Abdullah ibn Al-Mubarak.
ثنا أَبُو الْمُوَجِّهِ أنبأ عَبْدَانُ أنبأ عَبْدُ اللهِ أنبأ يُونُسُ عَنِ الزُّهْرِيِّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ أَنْ يُجْمَعَ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَبَيْنَ الْمَرْأَةِ وَخَالَتِهَا لَفْظُ حَدِيثِ عَبْدِ اللهِ بْنِ الْمُبَارَكِ
Messenger of Allah ﷺ said, "A woman and her paternal aunt should not be married to the same man; and similarly, a woman and her maternal aunt should not be married to the same man." (Using translation from Bukhārī 5109)
عَنِ النَّبِيِّ ﷺ قَالَ لَا يُجْمَعُ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَبَيْنَهَا وَبَيْنَ خَالَتِهَا
[Machine] The Messenger of Allah ﷺ said: "A woman cannot be married to her sister-in-law, nor can a woman be married to her aunt."
قَالَ رَسُولُ اللهِ ﷺ لَا تُنْكَحُ الْمَرْأَةُ وَخَالَتُهَا وَلَا الْمَرْأَةُ وَعَمَّتُهَا
[Machine] The Prophet Muhammad ﷺ said: "There should not be any gatherings between a woman and her paternal aunt or maternal aunt." (In another narration of Imam Shafi'i) the Prophet ﷺ said: "There should not be any gatherings between a woman and her paternal aunt or maternal aunt."
قَالَ رَسُولُ اللهِ ﷺ لَا يُجْمَعُ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَلَا بَيْنَ الْمَرْأَةِ وَخَالَتِهَا وَفِي رِوَايَةِ الشَّافِعِيِّ أَنَّ النَّبِيَّ ﷺ قَالَ
[Machine] The Messenger of Allah ﷺ prohibited marrying four types of women who are related to each other: a woman and her maternal aunt, a woman and her paternal aunt.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ أَرْبَعِ نِسْوَةٍ يُجْمَعُ بَيْنَهُنَّ عَنِ الْمَرْأَةِ وَعَمَّتِهَا وَالْمَرْأَةِ وَخَالَتِهَا
[Machine] "A woman cannot be married to her paternal aunt or her maternal aunt."
ﷺ لَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا
Abu Hurairah reported The Apostle of Allaah ﷺ as saying “ A woman should not be married to one who had married her paternal aunt or a paternal aunt to one who had married her brother’s daughter or a woman to one who had married her maternal aunt or maternal aunt to one who had married her sister’s daughter. A woman who is elder (in relation) must not be married to one who had married a woman who is younger (in relation) to her nor a woman who is younger (in relation) must be married to one who has married a woman who is elder (in relation) to her.” (Using translation from Abū Dāʾūd 2065)
قَالَ رَسُولُ اللهِ ﷺ لَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا وَلَا الْعَمَّةُ عَلَى ابْنَةِ أَخِيهَا وَلَا الْخَالَةُ عَلَى ابْنَةِ أُخْتِهَا لَا الصُّغْرَى عَلَى الْكُبْرَى وَلَا الْكُبْرَى عَلَى الصُّغْرَى
[Machine] "The phrase refers to a woman's right over her brother's daughter or her sister's daughter. Abu Sa'id bin Abi 'Amr informed us, Abu al-Abbas al-Asamm narrated to us, Rabee'ah narrated to us, Al-Shafi'i mentioned the Hadith of Al-A'raj from Abu Hurairah. Then he said, 'And by this, we take it as the statement of the scholars, there is no difference of opinion among them regarding what I know and what has not been proven from a reliable source by the people of Hadith except from Abu Hurairah, and it has been narrated from other sources that are not confirmed by the people of Hadith from other sources. And in this there is evidence against those who reject the Hadith, and against those who take one Hadith and leave another.' He spoke at length in this matter and did well. What has been mentioned about being narrated from other than Abu Hurairah, as he said, is that it is narrated from Ali, Abdullah bin Mas'ud, Abdullah bin Umar, Abdullah bin Abbas, Abdullah bin Amr bin Al-Aas, Abu Sa'id Al-Khudri, and Anas bin Malik, may Allah be pleased with them all. And among the women, it is narrated from Aisha. They are all narrations from the Prophet, except that all these narrations are not a condition for Sahih al-Bukhari and Sahih Muslim, but they agreed upon it, as did those before them and those after them among the imams of Hadith, in affirming the Hadith of Abu Hurairah in this matter only. As Al-Shafi'i may Allah have mercy on him said. Al-Bukhari also reported the narration of Aasim al-Ahwal from Al-Shaabi from Jabir bin Abdullah, except that they see it as an error and that the correct narration is from Dawood bin Abi Hind and Abdullah bin Awun from Al-Shaabi from Abu Hurairah. And Allah knows best."
يَعْنِي الْمَرْأَةَ عَلَى ابْنَةِ أَخِيهَا أَوِ ابْنَةِ أُخْتِهَا 13950 أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أَنْبَأَ الرَّبِيعُ أَنْبَأَ الشَّافِعِيُّ فَذَكَرَ حَدِيثَ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ ؓ كَمَا مَضَى ثُمَّ قَالَ وَبِهَذَا نَأْخُذُ وَهُوَ قَوْلُ مَنْ لَقِيتُ مِنَ الْمُفْتِينَ لَا اخْتِلَافَ بَيْنَهُمْ فِيمَا عَلِمْتُهُ وَلَمْ يُرْوَ مِنْ وَجْهٍ يُثْبِتُهُ أَهْلُ الْحَدِيثِ عَنِ النَّبِيِّ ﷺ إِلَّا عَنْ أَبِي هُرَيْرَةَ وَقَدْ رُوِيَ مِنْ وَجْهٍ لَا يُثْبِتُهُ أَهْلُ الْحَدِيثِ مِنْ وَجْهٍ آخَرَ وَفِي هَذَا حُجَّةٌ عَلَى مَنْ رَدَّ الْحَدِيثَ وَعَلَى مَنْ أَخَذَ بِالْحَدِيثِ مَرَّةً وَتَرَكَ أُخْرَى وَأَطَالَ الْكَلَامَ فِي هَذَا وَأَجَادَ ؓ وَالَّذِي ذُكِرَ مِنْ أَنَّهُ يُرْوَى مِنْ غَيْرِ جِهَةِ أَبِي هُرَيْرَةَ ؓ فَكَمَا قَالَ فَإِنَّهُ يُرْوَى عَنْ عَلِيٍّ وَعَبْدِ اللهِ بْنِ مَسْعُودٍ وَعَبْدِ اللهِ بْنِ عُمَرَ وَعَبْدِ اللهِ بْنِ عَبَّاسٍ وَعَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ وَأَبِي سَعِيدٍ الْخُدْرِيِّ وَأَنَسِ بْنِ مَالِكٍ رَضِيَ اللهُ تعالى عَنْهُمْ أَجْمَعِينَ وَمِنَ النِّسَاءِ عَنْ عَائِشَةَ ؓ كُلُّهُمْ عَنِ النَّبِيِّ ﷺ إِلَّا أَنَّ جَمِيعَ هَذِهِ الرِّوَايَاتِ لَيْسَتْ مِنْ شَرْطِ صَاحِبَيِ الصَّحِيحِ الْبُخَارِيِّ وَمُسْلِمٍ وَإِنَّمَا اتَّفَقَا وَمَنْ قَبْلَهُمَا وَمَنْ بَعْدَهُمَا مِنْ أَئِمَّةِ الْحَدِيثِ عَلَى إِثْبَاتِ حَدِيثِ أَبِي هُرَيْرَةَ فِي هَذَا الْبَابِ فَقَطْ كَمَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَقَدْ أَخْرَجَ الْبُخَارِيُّ رِوَايَةَ عَاصِمٍ الْأَحْوَلِ عَنِ الشَّعْبِيِّ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ ؓ إِلَّا أَنَّهُمْ يَرَوْنَ أَنَّهَا خَطَأٌ وَأَنَّ الصَّوَابَ رِوَايَةُ دَاوُدَ بْنِ أَبِي هِنْدٍ وَعَبْدِ اللهِ بْنِ عَوْنٍ عَنِ الشَّعْبِيِّ عَنْ أَبِي هُرَيْرَةَ ؓ وَاللهُ أَعْلَمُ
39.166 [Machine] Who allows the union between a man's wife and his daughter?
٣٩۔١٦٦ بَابُ مَنْ يُحِلُّ الْجَمْعَ بَيْنَ امْرَأَةِ الرَّجُلِ وَبِنْتِهِ
This hadith has been narrated on the authority of 'Abdullah through another chain of transmitters. (Using translation from Muslim 2775b)
عَنْ عَبْدِ اللهِ بْنِ جَعْفَرٍ بِنَحْوِهِ
[Machine] He (referring to Saad bin Qarha) married a woman to a man and married his daughter to someone else. And it was narrated from Ayyub that he said, "I was informed that Saad bin Qarha, a man from the companions of the Messenger of Allah ﷺ , married a woman to a man and married his daughter to someone else."
لَهُ جَبَلَةُ جَمَعَ بَيْنَ امْرَأَةِ رَجُلٍ وَابْنَتِهِ مِنْ غَيْرِهَا وَعَنْ أَيُّوبَ أَنَّهُ قَالَ نُبِّئْتُ أَنَّ سَعْدَ بْنَ قَرْحَا رَجُلٌ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ جَمَعَ بَيْنَ امْرَأَةِ رَجُلٍ وَابْنَتِهِ مِنْ غَيْرِهَا
[Machine] Ahmad, may Allah have mercy on him, means his two cousins, his paternal aunt's daughters.
أَحْمَدُ رَحِمَهُ اللهُ يَعْنِي ابْنَتَيْ عَمَّيْنِ لَهُ
39.167 [Machine] What is mentioned in His ﷻ saying: {And [also prohibited to you are all] married women except those your right hands possess} [An-Nisa: 24]
٣٩۔١٦٧ بَابُ مَا جَاءَ فِي قَوْلِهِ ﷻ: {وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ} [النساء: 24]
Abu Sa’id Al Khudri said “The Apostle of Allaah ﷺ sent a military expedition to Awtas on the occasion of the battle of Hunain. They met their enemy and fought with them. They defeated them and took them captives. Some of the Companions of Apostle of Allaah ﷺ were reluctant to have relations with the female captives because of their pagan husbands. So, Allaah the exalted sent down the Qur’anic verse “And all married women (are forbidden) unto you save those (captives) whom your right hand posses.” This is to say that they are lawful for them when they complete their waiting period. (Using translation from Abū Dāʾūd 2155)
أَنَّ رَسُولَ اللهِ ﷺ بَعَثَ يَوْمَ حُنَيْنٍ جَيْشًا إِلَى أَوْطَاسٍ فَلَقَوْا عَدُوًّا فَقَاتَلُوهُمْ فَظَهَرُوا عَلَيْهِمْ وَأَصَابُوا لَهُمْ سَبَايَا فَكَأَنَّ نَاسًا مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ تَحَرَّجُوا مِنْ غِشْيَانِهِنَّ مِنْ أَجْلِ أَزْوَاجِهِنَّ مِنَ الْمُشْرِكِينَ فَأَنْزَلَ اللهُ ﷻ فِي ذَلِكَ {وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ} [النساء 24] أَيْ فَهُنَّ لَكُمْ حَلَالٌ إِذَا انْقَضَتْ عِدَّتُهُنَّ
[Machine] In this verse and the married women, except those whom your right hand possesses. (It is permissible for you to have relations with) all women except for what you have captured.
فِي هَذِهِ الْآيَةِ وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ قَالَ كُلُّ ذَاتِ زَوْجٍ إِتْيَانُهَا زِنًا إِلَّا مَا سَبَيْتَ
[Machine] "In His saying, 'And [also prohibited to you are] the married women except those your right hands possess.' He said, 'Those are the captives whom you rightfully possess.' There is no harm in having sexual relations with them once they are purified. This was narrated by Shurayk from 'Ata' ibn al-Sa'ib from Sa'id ibn Jubayr from ibn 'Abbas, and similar to it was narrated by al-Shafi'i through his chain of narrators from Abdullah ibn Mas'ud."
فِي قَوْلِهِ تَعَالَى وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ قَالَ هُنَّ السَّبَايَا اللَّاتِي لَهُنَّ أَزْوَاجٌ لَا بَأْسَ بِمُجَامَعَتِهِنَّ إِذَا اسْتُبْرِئْنَ 13957 وَبِإِسْنَادِهِ ثنا شَرِيكٌ عَنْ عَطَاءِ بْنِ السَّائِبِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ ؓ مِثْلَهُ وَرَوَى الشَّافِعِيُّ رَحِمَهُ اللهُ بِإِسْنَادِهِ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ ؓ بِمَعْنَى قَوْلِ ابْنِ عَبَّاسٍ ؓ
[Machine] Among women, there are those who have husbands, and this is because Allah has prohibited adultery. Al-Shafi'i, may Allah have mercy on him, argued that women who have husbands are prohibited from intimacy with anyone other than their husbands. The exception, as mentioned in the verse "except from those [captives] that your right hands possess" [Quran 4:24], is limited to female slaves. This is because the Prophet, ﷺ , chose Birrah when she was freed, in the presence of her husband, and their separation did not occur through divorce. Birrah's ownership ended when she was sold and then freed, so this ending has two meanings, and it was not a divorce. He said, "If the husband's ownership does not end, then the vagina of a wife does not become permissible with the end of ownership, and if it is not sold, it does not become permissible with the right hand's ownership until her husband divorces her." In the past, those who said this were Umar ibn Al-Khattab, Uthman ibn Affan, Ali ibn Abi Talib, Abdul Rahman ibn Awf, and Ibn Umar, and they said that marriage after purchase is valid. Some who said that the sale of a female slave is divorce were Abdullah ibn Mas'ud, Ubay ibn Ka'b, Imran ibn Husayn, Jabir ibn Abdullah, Ibn Abbas, and Anas ibn Malik. The sheikh, may Allah have mercy on him, said that it seems that they have overgeneralized it to include the female slave, and the hadith of Birrah prohibits this analogy. Then there is consensus that whoever marries his female slave does not possess her in a sexual sense while he possesses her with his right hand. And this is the meaning of Al-Shafi'i's statement, may Allah have mercy on him.
مِنَ النِّسَاءِ هُنَّ ذَوَاتُ الْأَزْوَاجِ وَيَرْجِعُ ذَلِكَ إِلَى أَنَّ اللهَ حَرَّمَ الزِّنَا وَاسْتَدَلَّ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي أَنَّ ذَوَاتِ الْأَزْوَاجِ مِنَ الْإِمَاءِ يَحْرُمْنَ عَلَى غَيْرِ أَزْوَاجِهِنَّ وَأَنَّ الِاسْتِثْنَاءَ فِي قَوْلِهِ {إِلَّا مَا مَلَكَتْ أَيْمَانُكُمْ} [النساء 24] مَقْصُورٌ عَلَى السَّبَايَا بِأَنَّ السُّنَّةَ دَلَّتْ عَلَى أَنَّ الْمَمْلُوكَةَ غَيْرَ الْمَسْبِيَّةِ إِذَا بِيعَتْ أَوْ أُعْتِقَتْ لَمْ يَكُنْ بَيْعُهَا طَلَاقًا لِأَنَّ النَّبِيَّ ﷺ خَيَّرَ بَرِيرَةَ حِينَ عَتَقَتْ فِي الْمُقَامِ مَعَ زَوْجِهَا وَفِرَاقِهِ وَقَدْ زَالَ مِلْكُ بَرِيرَةَ بِأَنْ بِيعَتْ فَأُعْتِقَتْ فَكَانَ زَوَالُهُ لِمَعْنَيَيْنِ وَلَمْ يَكُنْ ذَلِكَ فُرْقَةً قَالَ فَإِذَا لَمْ يَحِلَّ فَرْجُ ذَوَاتِ الزَّوْجِ بِزَوَالِ الْمِلْكِ فَهِيَ إِذَا لَمْ تُبَعْ لَمْ تَحِلَّ بِمِلْكِ يَمِينٍ حَتَّى يُطَلِّقَهَا زَوْجُهَا قَالَ فِي الْقَدِيمِ وَمِمَّنْ قَالَ ذَلِكَ عُمَرُ بْنُ الْخَطَّابِ وَعُثْمَانُ بْنُ عَفَّانَ وَعَلِيُّ بْنُ أَبِي طَالِبٍ وَعَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ وَابْنُ عُمَرَ رَضِيَ اللهُ تعالى عَنْهُمْ قَالُوا نِكَاحُ الزَّوْجِ بَعْدَ الشِّرَاءِ ثَابِتٌ قَالَ وَمِمَّنْ قَالَ بَيْعُ الْأَمَةِ طَلَاقُهَا عَبْدُ اللهِ بْنُ مَسْعُودٍ وَأُبَيُّ بْنُ كَعْبٍ وَعِمْرَانُ بْنُ حُصَيْنٍ وَجَابِرُ بْنُ عَبْدِ اللهِ وَابْنُ عَبَّاسٍ وَأَنَسُ بْنُ مَالِكٍ ؓ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَكَأَّنَهُمْ قَاسُوهَا عَلَى الْمَسْبِيَّةِ وَحَدِيثُ بَرِيرَةَ يَمْنَعُ مِنْ هَذَا الْقِيَاسِ ثُمَّ الْإِجْمَاعُ أَنَّ مَنْ زَوَّجَ أَمَتَهُ لَمْ يَمْلِكْ وَطْئَهَا وَهِيَ مِمَّا مَلَكَتْ يَمِينُهُ وَهَذَا مَعْنَى قَوْلِ الشَّافِعِيِّ رَحِمَهُ اللهُ
[Machine] The wife of the Prophet ﷺ said that she used to have three traditions (sunnah) in Barirah. One of the traditions was that she was emancipated. She was given the choice by her husband to either remain with him or to divorce her. It was mentioned in the authentic Hadith.
ؓ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ كَانَتْ فِي بَرِيرَةَ ثَلَاثُ سُنَنٍ وَكَانَتْ إِحْدَى السُّنَنِ أَنَّهَا أُعْتِقَتْ فَخُيِّرَتْ مِنْ زَوْجِهَا أَخْرَجَاهُ فِي الصَّحِيحِ
39.168 [Machine] Zina Does Not Prohibit Halal, Al-Shafi'i, May Allah Have Mercy on Him, Said: "Allah ﷻ prohibited it because of the sanctity of the halal, and the haram is the opposite of the halal," and it has been narrated from Ibn Abbas that our statement..
٣٩۔١٦٨ بَابُ الزِّنَا لَا يُحَرِّمُ الْحَلَالَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " لِأَنَّ اللهَ ﷻ إِنَّمَا حَرَّمَهُ لِحُرْمَةِ الْحَلَالِ، وَالْحَرَامُ خِلَافُ الْحَلَالِ " قَالَ: وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ قَوْلُنَا
[Machine] In a man who commits adultery with his mother-in-law or his daughter-in-law, they both become unlawful for him to marry and their marriage is annulled. Yahya bin Ya'mar said, "Nothing is ever forbidden that was not permissible at some point." When the statement reached Sha'bi, he said, "If you were to take a cup of wine and pour it into a container of water, that water would become forbidden." It was the opinion of Sha'bi that such a combination was forbidden for him.
فِي رَجُلٍ زَنَى بِأُمِّ امْرَأَتِهِ أَوْ بِابْنَتِهَا فَإِنَّهُمَا حُرْمَتَانِ تَخَطَّاهُمَا وَلَا يُحَرِّمُهَا ذَلِكَ عَلَيْهِ قَالَ وَقَالَ يَحْيَى بْنُ يَعْمَرَ مَا حَرَّمَ حَرَامٌ حَلَالًا قَطُّ فَبَلَغَ ذَلِكَ الشَّعْبِيَّ فَقَالَ بَلْ لَوْ أَخَذْتَ كُوزًا مِنْ خَمْرٍ فَسَكَبْتَهُ فِي جُبٍّ مِنْ مَاءٍ لَكَانَ ذَلِكَ الْمَاءُ حَرَامًا وَكَانَ مِنْ رَأْيِ الشَّعْبِيِّ أَنَّهَا قَدْ حُرِّمَتْ عَلَيْهِ
تَخَطَّى حُرْمَتَيْنِ
[Machine] In a man who deceived his wife, he said, "He stepped over two taboos, but his wife is not forbidden to him."
فِي رَجُلٍ غَشِيَ أُمَّ امْرَأَتِهِ قَالَ تَخَطَّى حُرْمَتَيْنِ وَلَا تُحَرَّمُ عَلَيْهِ امْرَأَتُهُ
[Machine] Ali ibn Abi Talib said, "The unlawful does not make the permissible prohibited."
قَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ لَا يُحَرِّمُ الْحَرَامُ الْحَلَالَ
the Prophet, said: "What is Haram does not make what is Halal into what is Haram.” (Using translation from Ibn Mājah 2015)
