39. Marriage (18/20)
٣٩۔ كِتَابُ النِّكَاحِ ص ١٨
[Machine] "It was only permitted for us, the companions of the Messenger of Allah ﷺ , to engage in temporary marriage with women for three days, but then the Messenger of Allah ﷺ prohibited it."
إِنَّمَا أُحِلَّتْ لَنَا أَصْحَابِ رَسُولِ اللهِ ﷺ مُتْعَةُ النِّسَاءِ ثَلَاثَةَ أَيَّامٍ ثُمَّ نَهَى عَنْهَا رَسُولُ اللهِ ﷺ
إِنْ كَانَتِ الْمُتْعَةُ لِخَوْفِنَا وَلِحَرْبِنَا
[Machine] "We accompanied the Messenger of Allah, ﷺ , in the expedition of Tabuk, and he camped at Thaniyyat al-Wadaa'. He saw women crying, so he asked, 'What is this?' It was said, 'They are women who were enjoying themselves with their husbands, but then their husbands left them.' The Messenger of Allah, ﷺ , said, 'He has forbidden or destroyed the pleasure of temporary marriage (mut'ah), divorce, waiting period after divorce, and inheritance. And likewise...'"
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوَةِ تَبُوكَ فَنَزَلَ بِثَنِيَّةِ الْوَدَاعِ فَرَأَى نِسَاءً يَبْكِينَ فَقَالَ مَا هَذَا؟ قِيلَ نِسَاءٌ تَمَتَّعَ بِهِنَّ أَزْوَاجُهُنَّ ثُمَّ فَارَقُوهُنَّ فَقَالَ رَسُولُ اللهِ ﷺ حَرَّمَ أَوْ هَدَمَ الْمُتْعَةَ النِّكَاحُ وَالطَّلَاقُ وَالْعِدَّةُ وَالْمِيرَاثُ وَكَذَلِكَ
نَسَخَ الْمُتْعَةَ الْمِيرَاثُ
[Machine] Abu Amr al-Adibi informed us that Abu Bakr al-Isma'ili narrated the hadith with his chain of narration from Abdullah bin Mas'ud regarding mut'ah. Uqbah narrated it, and Abu Mu'awiyah narrated it from Isma'il bin Abi Khalid, from Qays, from Abdullah. This is the hadith, and he said at the end, "Then that was abandoned." And in the hadith of Ibn al-Musaffa from Ibn 'Uyaynah, from Isma'il at the end, "Then its prohibition came after." And in the hadith of Abdur Razzaq from Ma'mar, from Isma'il, from Qays regarding the abrogation of that, meaning mut'ah.
أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ فَذَكَرَ الْحَدِيثَ بِإِسْنَادِهِ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ فِي الْمُتْعَةِ قَالَ عُقْبَةُ وَرَوَى أَبُو مُعَاوِيَةَ عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ عَنْ قَيْسٍ عَنْ عَبْدِ اللهِ هَذَا الْحَدِيثَ وَقَالَ فِي آخِرِهِ ثُمَّ تُرِكَ ذَاكَ قَالَ وَفِي حَدِيثِ ابْنِ الْمُصَفَّى عَنِ ابْنِ عُيَيْنَةَ عَنْ إِسْمَاعِيلَ فِي آخِرِهِ ثُمَّ جَاءَ تَحْرِيمُهَا بَعْدُ وَفِي حَدِيثِ عَبْدِ الرَّزَّاقِ عَنْ مَعْمَرٍ عَنْ إِسْمَاعِيلَ عَنْ قَيْسٍ بِنَسْخِ ذَلِكَ يَعْنِي الْمُتْعَةَ
[Machine] The Messenger of Allah ﷺ forbade temporary marriage, He said: "It was only allowed for those who could not find (permanent marriage). But when the rules of marriage, divorce, waiting period, and inheritance were revealed, temporary marriage was abrogated."
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُتْعَةِ قَالَ وَإِنَّمَا كَانَتْ لِمَنْ لَمْ يَجِدْ فَلَمَّا أُنْزِلَ النِّكَاحُ وَالطَّلَاقُ وَالْعِدَّةُ وَالْمِيرَاثُ بَيْنَ الزَّوْجِ وَالْمَرْأَةِ نُسِخَتْ

39.201 [Machine] What is mentioned in the marriage of the permissible?
٣٩۔٢٠١ بَابُ مَا جَاءَ فِي نِكَاحِ الْمُحَلِّلِ
“The Messenger of Allah cursed the Muhallil and the Muhallal lahu.” (Using translation from Ibn Mājah 1934)
لَعَنَ رَسُولُ اللهِ ﷺ الْمُحَلِّلَ وَالْمُحَلَّلَ لَهُ
(The narrator Isma'il said: I think ash-Sha'bi attributed this tradition to the Prophet) The Prophet ﷺ said: Curse be upon the one who marries a divorced woman with the intention of making her lawful for her former husband and upon the one for whom she is made lawful. (Using translation from Abū Dāʾūd 2076)
إِسْمَاعِيلُ وَأُرَاهُ قَدْ رَفَعَهُ إِلَى النَّبِيِّ ﷺ قَالَ لُعِنَ الْمُحَلِّلُ وَالْمُحَلَّلُ لَهُ
[Machine] The Messenger of Allah ﷺ cursed the one who practices "Wasilah" (seeking intercession through a person or object) and the one who practices "Mutasilah" (offering intercession), the tattooer and the one who is tattooed, the eater of interest (usury) and the one who feeds it to others, the one who makes a forbidden thing lawful and the one who does it for him. This is the narration of Abu Nuaym, and in the narration of Al-Zubayri, he added (cursed) the one who has been marked, and he said "the one who marks" and "the one who feeds it".
لَعَنَ رَسُولُ اللهِ ﷺ الْوَاصِلَةَ وَالْمُوْتَصِلَةَ وَالْوَاشِمَةَ وَالْمُوتَشِمَةَ وَآكِلَ الرِّبَا وَمُؤْكِلَهُ وَالْمُحَلِّلَ وَالْمُحَلَّلَ لَهُ لَفْظُ حَدِيثِ أَبِي نُعَيْمٍ وَفِي رِوَايَةِ الزُّبَيْرِيِّ الْمَوْشُومَةَ وَقَالَ الْمَوْصُولَةَ وَقَالَ مُطْعِمَهُ
[Machine] The Messenger of Allah ﷺ said, "May Allah curse the one who consumes interest and the one who gives it."
قَالَ رَسُولُ اللهِ ﷺ لَعَنَ اللهُ الْمُحَلِّلَ وَالْمُحَلَّلَ لَهُ
[Machine] The Messenger of Allah ﷺ said, "Shall I inform you about the borrowed she-camel?" They said, "Yes, O Messenger of Allah, who is it?" He said, "The one who performs divination curses the one who performs divination, and the one who seeks to know his fate through divination is also cursed." And Abu Abdullah al-Hafiz informed us, and Abu Bakr Muhammad ibn al-Muammar narrated to me, and Fadl ibn Muhammad narrated to us, and Abu Salih narrated to us, and Layth ibn Sa'd said, "I heard Mushrah ibn Ha'an talking about 'Uqbah ibn 'Amir, so he mentioned him."
قَالَ رَسُولُ اللهِ ﷺ أَلَا أُخْبِرُكُمْ بِالتَّيْسِ الْمُسْتَعَارِ؟ قَالُوا بَلَى يَا رَسُولَ اللهِ مَنْ هُوَ؟ قَالَ الْمُحَلِّلُ لَعَنَ اللهُ الْمُحَلِّلُ وَالْمُحَلَّلَ لَهُ 14188 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْمُؤَمَّلِ ثنا الْفَضْلُ بْنُ مُحَمَّدٍ ثنا أَبُو صَالِحٍ ثنا اللَّيْثُ بْنُ سَعْدٍ قَالَ سَمِعْتُ مِشْرَحَ بْنَ هَاعَانَ يُحَدِّثُ عَنْ عُقْبَةَ بْنِ عَامِرٍ فَذَكَرَهُ
[Machine] There is no marriage except through desire, we used to consider this as promiscuity during the time of the Messenger of Allah ﷺ .
لَا إِلَّا نِكَاحَ رَغْبَةٍ كُنَّا نَعُدُّ هَذَا سِفَاحًا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ
ذَاكَ السِّفَاحُ
[Machine] 'Umar said, "I am not in favor of either a person being unlawfully permitted or a person being unlawfully prohibited; rather, I would stone both of them."
قَالَ عُمَرُ ؓ لَا أُوتَى بِمُحَلِّلٍ وَلَا مُحَلَّلٍ لَهُ إِلَّا رَجَمْتُهُمَا
[Machine] Indeed, a neighbor of mine divorced his wife in his anger and faced difficulty. So, I intended to marry her so that I could protect her and my possessions. Then, she refused me and I divorced her so that she could return to her first husband. Uthman said to him, "Do not marry her except willingly."
إِنَّ جَارًا لِي طَلَّقَ امْرَأَتَهُ فِي غَضَبِهِ وَلَقِيَ شِدَّةً فَأَرَدْتُ أَنْ أَحْتَسِبَ بِنَفْسِي وَمَالِي فَأَتَزَوَّجُهَا ثُمَّ أَبْتَنِي بِهَا ثُمَّ أُطَلِّقُهَا فَتَرْجِعُ إِلَى زَوْجِهَا الْأَوَّلِ فَقَالَ لَهُ عُثْمَانُ لَا تَنْكِحْهَا إِلَّا نِكَاحَ رَغْبَةٍ
[Machine] Abu Abdullah Al-Hafiz and Abu Bakr reported to us that Abu al-Abbas narrated to us on the authority of Muhammad who narrated on the authority of Abu al-Aswad and Mu'alla, they said: Ibn Lahi'ah informed us, on the authority of Bukayr bin al-Ashajj, on the authority of Sulayman bin Yasir, that Uthman bin Affan was approached regarding a man who had married a woman to make her permissible for her husband, but then he separated them and said to her, "You cannot return to him unless it is through a valid marriage, not by trickery."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ قَالَا نا أَبُو الْعَبَّاسِ ثنا مُحَمَّدٌ ثنا أَبُو الْأَسْوَدِ وَمُعَلَّى قَالَا أنبأ ابْنُ لَهِيعَةَ عَنْ بُكَيْرِ بْنِ الْأَشَجِّ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ رُفِعَ إِلَيْهِ أَمْرُ رَجُلٍ تَزَوَّجَ امْرَأَةً لِيُحِلَّهَا لِزَوْجِهَا فَفَرَّقَ بَيْنَهُمَا وَقَالَ لَا تَرْجِعُ إِلَيْهِ إِلَّا بِنِكَاحِ رَغْبَةٍ غَيْرِ دَلِسَةٍ
[Machine] If he marries her to make her permissible for himself, then this is the one who makes her permissible and he should not do so. And Allah knows best.
إِذَا كَانَ يَتَزَوَّجُهَا لِيُحِلَّهَا لَهُ فَهَذَا الْمُحَلِّلُ وَالْمُحَلَّلُ لَهُ فَلَا يَنْبَغِي وَاللهُ أَعْلَمُ
39.202 [Machine] Whoever enters into marriage unconditionally, then the marriage is valid, even if their intention or one of their intentions is dissolution. Al-Shafi'i, may Allah have mercy on him, said: Because intention is a matter of the heart and what people have talked about themselves has been set aside.
٣٩۔٢٠٢ بَابُ مَنْ عَقَدَ النِّكَاحَ مُطْلَقًا لَا بِشَرْطٍ فِيهِ فَالنِّكَاحُ ثَابِتٌ وَإِنْ كَانَتْ نِيَّتُهُمَا أَوْ نِيَّةُ أَحَدِهِمَا التَّحْلِيلَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِأَنَّ النِّيَّةَ حَدِيثُ النَّفْسِ وَقَدْ وُضِعَ عَنِ النَّاسِ مَا حَدَّثُوا بِهِ أَنْفُسَهُمْ
[Machine] Narrated by the Messenger of Allah ﷺ , "Allah forgives my ummah for the thoughts and whispers that they have not spoken or acted upon. This is in reference to the saying of Abu Awana, and according to the narration of Hisham, who said that the Prophet ﷺ said, 'Indeed, Allah, may He be glorified, forgives my ummah.'"
قَالَ رَسُولُ اللهِ ﷺ تَجَاوَزَ اللهُ لِأُمَّتِي مَا حَدَّثَتْ بِهِ أَنْفُسَهَا مَا لَمْ تَكَلَّمْ بِهِ أَوْ تَعْمَلْ بِهِ لَفْظُ حَدِيثِ أَبِي عَوَانَةَ وَفِي رِوَايَةِ هِشَامٍ قَالَ عَنِ النَّبِيِّ ﷺ قَالَ إِنَّ اللهَ جَلَّ ثَنَاؤُهُ تَجَاوَزَ لِأُمَّتِي
[Machine] A man from the Quraysh divorced his wife, and then married her back. He passed by an elderly man and his son from the Bedouins in the market, who had come for trade. He asked the young man, "Do you have any goods?" Then he left him alone, but he came back to him and asked the same question again. He repeated this process multiple times. The young man replied, "Yes." The man then asked to see his hand and took him along with him. He informed him of the news and arranged for his marriage to the divorced woman. He spent the night with her, and in the morning, he sought permission to leave. When he left, he turned her back towards him. She swore by Allah that if he divorced her, she would never marry him again. That incident was mentioned to Umar, so he called him and said, "If you marry her, you should do this and that to him, and establish a mutual agreement." He then called her husband and ordered him to keep her and added more instructions in another place. He said, "And if anyone offers you anything, inform me about it."
طَلَّقَ رَجُلٌ مِنْ قُرَيْشٍ امْرَأَةً لَهُ فَبَتَّهَا فَمَرَّ بِشَيْخٍ وَابْنٍ لَهُ مِنَ الْأَعْرَابِ فِي السُّوقِ قَدِمَا لِتِجَارَةٍ لَهُمَا فَقَالَ لِلْفَتَى هَلْ فِيكَ مِنْ خَيْرٍ؟ ثُمَّ مَضَى عَنْهُ ثُمَّ كَرَّ عَلَيْهِ فَكَمِثْلِهَا ثُمَّ مَضَى عَنْهُ ثُمَّ كَرَّ عَلَيْهِ فَكَمِثْلِهَا قَالَ نَعَمْ قَالَ فَأَرِنِي يَدَكَ فَانْطَلَقَ بِهِ فَأَخْبَرَهُ الْخَبَرَ وَأَمَرَهُ بِنِكَاحِهَا فَنَكَحَهَا فَبَاتَ مَعَهَا فَلَمَّا أَصْبَحَ اسْتَأْذَنَ فَأَذِنَ لَهُ فَإِذَا هُوَ قَدْ وَلَّاهَا الدُّبُرَ فَقَالَتْ وَاللهِ لَئِنْ طَلَّقَنِي لَا أَنْكِحُكَ أَبَدًا فَذُكِرَ ذَلِكَ لِعُمَرَ ؓ فَدَعَاهُ فَقَالَ لَوْ نَكَحْتَهَا لَفَعَلْتَ بِكَ كَذَا وَكَذَا وَتَوَاعَدَهُ وَدَعَا زَوْجَهَا فَقَالَ الزَمْهَا وَزَادَ فِيهِ فِي مَوْضِعٍ آخَرَ فَقَالَ وَقَالَ وَإِنْ عَرَضَ لَكَ أَحَدٌ بِشَيْءٍ فَأَخْبِرْنِي بِهِ
[Machine] A poor Bedouin man who had divorced his wife three times was sitting at the door of the mosque when a woman approached him and asked if he had a wife whom she could marry for just one night and then separate from in the morning. He agreed and the woman told him not to listen to anyone who tells him to leave her in the morning. She said she would take care of him and that he should go to 'Umar, the caliph. When morning came, they went to 'Umar and the woman said, "Speak to him, for you brought him here." The man refused and went to 'Umar himself. 'Umar told him to stay with his wife, and if people bothered him about it, to come to 'Umar and he would deal with them. Then 'Umar sent for the woman who had instigated the situation, and punished her. After that, the Bedouin man used to visit 'Umar in nice clothes in the morning, saying, "All praise is due to Allah who clothed you, O possessor of the two patches of cloth, with clothes in which you go out and come in." Al-Shafi'i said, "I have heard this hadith from numerous narrators connected directly to Ibn Sirin, with slight variation in wording."
أَنَّ امْرَأَةً طَلَّقَهَا زَوْجُهَا ثَلَاثًا وَكَانَ مِسْكِينٌ أَعْرَابِيٌّ يَقْعُدُ بِبَابِ الْمَسْجِدِ فَجَاءَتْهُ امْرَأَةٌ فَقَالَتْ هَلْ لَكَ فِي امْرَأَةٍ تَنْكِحُهَا فَتَبِيتُ مَعَهَا اللَّيْلَةَ وَتُصْبِحُ فَتُفَارِقُهَا؟ فَقَالَ نَعَمْ فَكَانَ ذَلِكَ فَقَالَتْ لَهُ امْرَأَتُهُ إِنَّكَ إِذَا أَصْبَحْتَ فَإِنَّهُمْ سَيَقُولُونَ لَكَ فَارِقْهَا فَلَا تَفْعَلْ ذَلِكَ فَإِنِّي مُقِيمَةٌ لَكَ مَا تَرَى وَاذْهَبْ إِلَى عُمَرَ ؓ فَلَمَّا أَصْبَحَتْ أَتَوْهُ وَأَتَوْهَا فَقَالَتْ كَلِّمُوهُ فَأَنْتُمْ جِئْتُمْ بِهِ فَكَلِّمُوهُ فَأَبَى فَانْطَلَقَ إِلَى عُمَرَ ؓ فَقَالَ الزَمِ امْرَأَتَكَ فَإِنْ رَابُوكَ بِرِيبَةٍ فَأْتِنِي وَأَرْسَلَ إِلَى الْمَرْأَةِ الَّتِي مَشَتْ لِذَلِكَ فَنَكَّلَ بِهَا ثُمَّ كَانَ يَغْدُو عَلَى عُمَرَ وَيَرُوحُ فِي حُلَّةٍ فَيَقُولُ الْحَمْدُ لِلَّهِ الَّذِي كَسَاكَ يَا ذَا الرُّقْعَتَيْنِ حُلَّةً تَغْدُو فِيهَا وَتَرُوحُ قَالَ الشَّافِعِيُّ ؓ وَسَمِعْتُ هَذَا الْحَدِيثَ مُسْنَدًا شَاذًّا مُتَّصِلًا عَنِ ابْنِ سِيرِينَ يُوصِلُهُ عَنْ عُمَرَ مِثْلَ هَذَا الْمَعْنَى
39.203 [Machine] The translation of the heading "نِكَاحِ الْمُحْرِمِ" into English is: Forbidden marriage.
٣٩۔٢٠٣ بَابُ نِكَاحِ الْمُحْرِمِ
[Machine] Abu Abdullah Al-Hafiz informed us that Abu Al-Nasr Al-Faqih and Abu Al-Hasan Al-Anazi said: Othman Ibn Sa'id Al-Darmi narrated to us that Al-Qa'nabi recited to Malik and said: Abu Ali Al-Hussein Ibn Ali Al-Hafiz informed me that Ali Ibn Al-Hussein Al-Saffar narrated to me that Yahya Ibn Yahya said: I recited to Malik from Nafi', the freed slave of Abdullah Ibn Umar, from his father, Wahb Ibn Huzb, that Umar Ibn Ubaidullah wanted to marry Talha Ibn Umar Ibn Shaybah Ibn Jubeir's daughter, so he sent for Aban Ibn Uthman to attend to it, while he was the Amir of Hajj. Aban said: I heard Uthman Ibn Affan saying: I heard the Messenger of Allah ﷺ saying: "The forbidden person should not marry, nor should he be married, nor should he be sought in marriage."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو النَّصْرِ الْفَقِيهُ وَأَبُو الْحَسَنِ الْعَنَزِيُّ قَالَ ثنا عُثْمَانُ بْنُ سَعِيدٍ الدَّارِمِيُّ ثنا الْقَعْنَبِيُّ فِيمَا قَرَأَهُ عَلَى مَالِكٍ ح قَالَ وَأَخْبَرَنِي أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ عَلِيٍّ الْحَافِظُ أنبأ عَلِيُّ بْنُ الْحُسَيْنِ الصَّفَّارُ ثنا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ مَوْلَى عَبْدِ اللهِ بْنِ عُمَرَ عَنْ نَبِيهِ بْنِ وَهْبٍ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللهِ أَرَادَ أَنْ يُزَوِّجَ طَلْحَةَ بْنَ عُمَرَ بِنْتَ شَيْبَةَ بْنِ جُبَيْرٍ فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ لِيَحْضُرَ لِذَلِكَ وَهُوَ أَمِيرُ الْحَاجِّ فَقَالَ أَبَانُ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ ؓ يَقُولُ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكَحُ وَلَا يَخْطُبُ
[Machine] Do I not see him as an Arab? Verily, the one in a state of ihram does not marry nor is he married. Uthman informed us about that from the Messenger of Allah ﷺ. The wording of their hadith is similar.
أَلَا أُرَاهُ أَعْرَابِيًّا إِنَّ الْمُحْرِمَ لَا يَنْكِحُ وَلَا يُنْكَحُ أَخْبَرَنَا بِذَلِكَ عُثْمَانُ ؓ عَنْ رَسُولِ اللهِ ﷺ لَفْظُ حَدِيثِهِمَا سَوَاءٌ
[Machine] "The Prophet ﷺ said, 'The prohibited person should not marry, nor should he be married or engaged.' Sa'id narrated from Matr and Ya'la bin Hakim, from Nafi', from Ibn 'Umar the same hadith except that he did not attribute it to the Prophet of Allah ﷺ."
أَنَّ النَّبِيَّ ﷺ قَالَ لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكَحُ وَلَا يَخْطُبُ قَالَ وَحَدَّثَنَا سَعِيدٌ عَنْهُمَا مَطَرٍ وَيَعْلَى بْنِ حَكِيمٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ مِثْلَهُ غَيْرَ أَنَّهُ لَمْ يَرْفَعْهُ إِلَى نَبِيِّ اللهِ ﷺ
[Machine] The Messenger of Allah ﷺ married Maymuna while he was in a state of ihram.
تَزَوَّجَ رَسُولُ اللهِ ﷺ مَيْمُونَةَ وَهُوَ مُحْرِمٌ
[Machine] That the Messenger of Allah ﷺ married Maymuna while it was permissible.
أَنَّ رَسُولَ اللهِ ﷺ نَكَحَ مَيْمُونَةَ وَهُوَ حَلَالٌ
[Machine] That the Prophet ﷺ married while being in ihram. Amr said, "I asked Jabir bin Zaid, 'Who do you see her as, O Abu Shaatha?' He said, 'I believe she is Maymunah bint al-Harith.' And he said once, 'They say Maymunah bint al-Harith.' So I said to him, 'Indeed Ibn Shihab informed me about Yazid bin al-Asamm, that the Messenger of Allah ﷺ married Maymunah while he was in a state of legality.'
أَنَّ النَّبِيَّ ﷺ تَزَوَّجَ وَهُوَ مُحْرِمٌ قَالَ عَمْرٌو فَقُلْتُ لِجَابِرِ بْنِ زَيْدٍ مَنْ تَرَاهَا يَا أَبَا الشَّعْثَاءِ؟ قَالَ أَظُنُّهَا مَيْمُونَةَ بِنْتَ الْحَارِثِ وَقَالَ مَرَّةً يَقُولُونَ مَيْمُونَةُ بِنْتُ الْحَارِثِ فَقُلْتُ لَهُ إِنَّ ابْنَ شِهَابٍ أَخْبَرَنِي عَنْ يَزِيدَ بْنِ الْأَصَمِّ أَنَّ رَسُولَ اللهِ ﷺ تَزَوَّجَ مَيْمُونَةَ وَهُوَ حَلَالٌ
[Machine] The Messenger of Allah ﷺ married me while we were financially capable.
تَزَوَّجَنِي رَسُولُ اللهِ ﷺ وَنَحْنُ حَلَالِانِ بِسَرِفَ
[Machine] The Messenger of Allah ﷺ married her lawfully and built a lawful relationship with her.
رَسُولَ اللهِ ﷺ تَزَوَّجَهَا حَلَالًا وَبَنَى بِهَا حَلَالًا
[Machine] About the marriage of the Messenger of Allah ﷺ to Maymuna, it is said that he married her and it was lawful.
عَنْ تَزْوِيجِ رَسُولِ اللهِ ﷺ مَيْمُونَةَ فَقَالَ تَزَوَّجَهَا وَهُوَ حَلَالٌ
[Machine] That the Messenger of Allah ﷺ married Maymuna lawfully and consummated the marriage lawfully, and I was the messenger between them, their words were equal.
أَنَّ رَسُولَ اللهِ ﷺ تَزَوَّجَ مَيْمُونَةَ حَلَالًا وَبَنَى بِهَا حَلَالًا وَكُنْتُ الرَّسُولَ بَيْنَهُمَا لَفْظُهُمَا سَوَاءٌ
[Machine] I asked Safiyyah bint Shaybah if the Prophet ﷺ married Maymunah while he was in a state of ihram. She said, "No, he married her while he was in a state of halal (permissibility)."
سَأَلْتُ صَفِيَّةَ بِنْتَ شَيْبَةَ أَتَزَوَّجَ النَّبِيُّ ﷺ مَيْمُونَةَ وَهُوَ مُحْرِمٌ؟ قَالَتْ بَلْ تَزَوَّجَهَا وَهُوَ حَلَالٌ
Sa’id bin Al Musayyib said There is a misunderstanding on the part of Ibn ‘Abbas about the marriage (of the Prophet) with Maimunah while he was in the sacred state. (Using translation from Abū Dāʾūd 1845)
وَهِمَ ابْنُ عَبَّاسٍ فِي تَزْوِيجِ مَيْمُونَةَ وَهُوَ مُحْرِمٌ
[Machine] And Abu Abdullah Al-Hafiz and Abu Abdullah Al-Susi informed us, they said: Abu Al-Abbas Muhammad ibn Ya'qub narrated to us, he said: Muhammad ibn Awf narrated to us, he said: Abdul Qudus narrated to us, he said: Al-Awza'i narrated from Ata' from Ibn Abbas that the Messenger of Allah ﷺ married Maymuna while he was in a state of ihram. Sa'id said: Did Ibn Abbas not marry her even though she was his paternal aunt? The Messenger of Allah ﷺ did not marry her except after it was made permissible.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو عَبْدِ اللهِ السُّوسِيُّ قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ عَوْفٍ ثنا عَبْدُ الْقُدُّوسِ ثنا الْأَوْزَاعِيُّ عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللهِ ﷺ تَزَوَّجَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ قَالَ فَقَالَ سَعِيدٌ وَهَلِ ابْنُ عَبَّاسٍ وَإِنْ كَانَتْ خَالَتُهُ مَا تَزَوَّجَهَا رَسُولُ اللهِ ﷺ إِلَّا بَعْدَ مَا أَحَلَّ
[Machine] He got married while in a state of ihram, so this is how it happened.
ﷺ تَزَوَّجَ وَهُوَ مُحْرِمٌ فَهَكَذَا
[Machine] The Messenger of Allah ﷺ married some of his wives and performed it as a forbidden act, and he also performed it while in a state of ihram. It has been narrated by Musaddad, from Abu Awanah, from Mughirah, from Ibrahim, from Al-Aswad, from Aisha, that Abu Abdullah said, Abu Ali al-Hafiz said, "Both of them (Musaddad and Abu Awanah) made a mistake, and the preserved narration is from Mughirah, from Shibak, from Abu Duhah, from Masruq, from the Messenger of Allah ﷺ ."
تَزَوَّجَ رَسُولُ اللهِ ﷺ بَعْضَ نِسَائِهِ وَهُوَ مُحْرِمٌ وَاحْتَجَمَ وَهُوَ مُحْرِمٌ وَرُوِيَ عَنْ مُسَدَّدٍ عَنْ أَبِي عَوَانَةَ عَنْ مُغِيرَةَ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ قَالَ أَبُو عَبْدِ اللهِ قَالَ أَبُو عَلِيٍّ الْحَافِظُ كِلَاهُمَا خَطَأٌ وَالْمَحْفُوظُ عَنْ مُغِيرَةَ عَنْ شِبَاكٍ عَنْ أَبِي الضُّحَى عَنْ مَسْرُوقٍ عَنْ رَسُولِ اللهِ ﷺ مُرْسَلًا هَكَذَا
[Machine] "That he informed him that his father married a woman while he was in a state of ihram, so Umar ibn al-Khattab annulled his marriage."
أَنَّهُ أَخْبَرَهُ أَنَّ أَبَاهُ تَزَوَّجَ امْرَأَةً وَهُوَ مُحْرِمٌ فَرَدَّ عُمَرُ بْنُ الْخَطَّابِ ؓ نِكَاحَهُ
[Machine] The prohibited person cannot marry, nor can they be married or engaged to themselves or any other person.
لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكَحُ وَلَا يَخْطُبُ عَلَى نَفْسِهِ وَلَا عَلَى غَيْرِهِ
[Machine] Whoever marries while prohibited, we will separate his wife from him and we will not fulfill their marriage contract. This is the statement of Al-Hasan and Qatadah.
مَنْ تَزَوَّجَ وَهُوَ مُحْرِمٌ نَزَعْنَا مِنْهُ امْرَأَتَهُ وَلَمْ نُجِزْ نِكَاحَهُ وَهُوَ قَوْلُ الْحَسَنِ وَقَتَادَةَ
[Machine] "He (Zayd ibn Thabit) rejected the marriage of a prohibited person, and likewise..."
وَهُوَ فِيمَا أَجَازَ لِي أَبُو عَبْدِ اللهِ الْحَافِظُ رِوَايَتَهُ عَنْهُ عَنْ أَبِي الْعَبَّاسِ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ إِبْرَاهِيمُ بْنُ مُحَمَّدٍ عَنْ قُدَامَةَ بْنِ مُوسَى عَنْ شَوْذَبٍ أَنَّ زَيْدَ بْنَ ثَابِتٍ رَدَّ نِكَاحَ مُحْرِمٍ وَكَذَلِكَ
[Machine] Regarding the prohibited marriage, they said, "The prohibited shall not marry, nor be married."
عَنْ نِكَاحِ الْمُحْرِمِ فَقَالُوا لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكَحُ

39.205 [Machine] What are the flaws that are overlooked in marriage?
٣٩۔٢٠٥ بَابُ مَا يُرَدُّ بِهِ النِّكَاحُ مِنَ الْعُيُوبِ
[Machine] The Messenger of Allah ﷺ married a woman from the Banu Ghifar tribe. When she was brought to him, he noticed her thinness and sent her back to her family, saying, "You have deceived me." He said, "And Abu Ahmad informed us, Muhammad ibn Musa al-Hulwani informed us, Abu Sa'id al-Ashajj Abdullah ibn Sa'id informed us, and Abu Bukayr al-Nakha'i informed us, and the name of Abu Bukayr al-Walid ibn Bakr is Kufiyyun, through Jamil ibn Zaid, from Ibn Umar, who said: The Messenger of Allah ﷺ married a woman from the Banu Ghifar tribe, and he mentioned her."
تَزَوَّجَ رَسُولُ اللهِ ﷺ امْرَأَةً مِنْ بَنِي غِفَارٍ فَلَمَّا أُدْخِلَتْ رَأَى بِكَشْحِهَا وَضَحًا فَرَدَّهَا إِلَى أَهْلِهَا وَقَالَ دَلَّسْتُمْ عَلَيَّ 14220 قَالَ وَأَخْبَرَنَا أَبُو أَحْمَدَ ثنا مُحَمَّدُ بْنُ مُوسَى الْحُلْوَانِيُّ ثنا أَبُو سَعِيدٍ الْأَشَجُّ عَبْدُ اللهِ بْنُ سَعِيدٍ ثنا أَبُو بُكَيْرٍ النَّخَعِيُّ وَاسْمُ أَبِي بُكَيْرٍ الْوَلِيدُ بْنُ بَكْرٍ كُوفِيٌّ عَنْ جَمِيلِ بْنِ زَيْدٍ عَنِ ابْنِ عُمَرَ قَالَ تَزَوَّجَ رَسُولُ اللهِ ﷺ امْرَأَةً مِنْ بَنِي غِفَارٍ فَذَكَرَهُ
[Machine] The Prophet ﷺ married a woman from the Banu Ghifar tribe. When she was brought to him, he saw her pallor and expressed his disinterest in her. He said to her, "You are free to go." He allowed her to leave without taking anything from her. Abu Ahmad and Jameel ibn Zaid distinguished themselves by narrating this hadith, causing the narrators to become uncertain about it. The Sheikh, may Allah have mercy on him, said it was also said that Isma'il ibn Zakariya narrated from Jameel ibn Zaid, who narrated from Ibn Umar with the same meaning. It was also said that Saeed ibn Zaid narrated from Jameel ibn Zaid and said that he was among the companions of the Prophet ﷺ . It was also said that Abdullah ibn Ka'b narrated from him, and it was also said that Ka'b ibn Zaid or Zaid ibn Ka'b narrated from him. Al-Bukhari said his narration is not authentic.
النَّبِيَّ ﷺ تَزَوَّجَ امْرَأَةً مِنْ بَنِي غِفَارٍ فَلَمَّا أُدْخِلَتْ عَلَيْهِ رَأَى بِكَشْحِهَا بَيَاضًا فَنَاءَ عَنْهَا وَقَالَ أَرْخِي عَلَيْكِ فَخَلَّى سَبِيلَهَا وَلَمْ يَأْخُذْ مِنْهَا شَيْئًا قَالَ أَبُو أَحْمَدَ وَجَمِيلُ بْنُ زَيْدٍ تَفَرَّدَ بِهَذَا الْحَدِيثِ وَاضْطَرَبَ الرُّوَاةُ عَنْهُ لِهَذَا الْحَدِيثِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقِيلَ عَنْهُ هَكَذَا وَكَذَلِكَ قَالَ إِسْمَاعِيلُ بْنُ زَكَرِيَّا عَنْ جَمِيلِ بْنِ زَيْدٍ عَنِ ابْنِ عُمَرَ بِمَعْنَاهُ وَقِيلَ عَنْهُ عَنْ سَعِيدِ بْنِ زَيْدٍ قَالَ وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ وَقِيلَ عَنْهُ عَنْ عَبْدِ اللهِ بْنِ كَعْبٍ وَقِيلَ عَنْهُ عَنْ كَعْبٍ وَقِيلَ عَنْهُ عَنْ كَعْبِ بْنِ زَيْدٍ أَوْ زَيْدِ بْنِ كَعْبٍ قَالَ الْبُخَارِيُّ لَمْ يَصِحَّ حَدِيثُهُ
[Machine] "He (the Prophet) said: Omar ibn Al-Khattab said, 'Any man who marries a woman with madness, leprosy, or leprosy, and then has sexual intercourse with her, she is entitled to her dower, and that is a fine for her guardian.'"
أَنَّهُ قَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ أَيُّمَا رَجُلٍ تَزَوَّجَ امْرَأَةً وَبِهَا جُنُونٌ أَوْ جُذَامٌ أَوْ بَرَصٌ فَمَسَّهَا فَلَهَا صَدَاقُهَا وَذَلِكَ لِزَوْجِهَا غُرْمٌ عَلَى وَلِيِّهَا
[Machine] That Umar ibn Khattab decided that any woman who was married and had contracted this disease, he would not know until he touched her. And she will receive her dowry from what he lawfully earned from her private part, and her guardian will be fined the same amount as her dowry.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَضَى أَيُّمَا امْرَأَةٍ نُكِحَتْ وَبِهَا شَيْءٌ مِنْ هَذَا الدَّاءِ فَلَمْ يَعْلَمْ حَتَّى مَسَّهَا فَلَهَا مَهْرُهَا بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَيَغْرُمُ وَلِيُّهَا لِزَوْجِهَا مِثْلَ مَهْرِهَا
[Machine] The meaning of the passage in English is: If a man marries a woman who has insanity, leprosy, smallpox, or a hernia, and he consummates the marriage, then she is entitled to her dowry from him, and he has authority over her.
عُمَرُ ؓ إِذَا تَزَوَّجَ الرَّجُلُ الْمَرْأَةَ وَبِهَا جُنُونٌ أَوْ جُذَامٌ أَوْ بَرَصٌ أَوْ قَرْنٌ فَإِنْ كَانَ دَخَلَ بِهَا فَلَهَا الصَّدَاقُ بِمَسِّهِ إِيَّاهَا وَهُوَ لَهُ عَلَى الْوَلِيِّ
ثنا سُفْيَانُ فَذَكَرَهُ
أَنْ يَمَسَّهُنَّ
عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ
[Machine] Ali said, "Whichever man marries a woman who has leprosy, insanity, leprosy, or a horn, her husband has the choice to keep her if he wants or divorce her if he wants. If he has intercourse with her, she is entitled to receive the dowry for what he enjoyed from her body."
قَالَ عَلِيٌّ ؓ أَيُّمَا رَجُلٍ نَكَحَ امْرَأَةً وَبِهَا بَرَصٌ أَوْ جُنُونٌ أَوْ جُذَامٌ أَوْ قَرْنٌ فَزَوْجُهَا بِالْخِيَارِ مَا لَمْ يَمَسَّهَا إِنْ شَاءَ أَمْسَكَ وَإِنْ شَاءَ طَلَّقَ فَإِنْ مَسَّهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا
