٣٩۔ كِتَابُ النِّكَاحِ ص ١٠
[Machine] I heard Abu Nasr Al-Kalabadi Al-Hafiz, may Allah have mercy on him, saying: Umar ibn Abi Salama passed away while the Prophet ﷺ was nine years old, and he died during the caliphate of Abd al-Malik ibn Marwan.
سَمِعْتُ أَبَا نَصْرٍ الْكَلَابَاذِيَّ الْحَافِظَ رَحِمَهُ اللهُ يَقُولُ عُمَرُ بْنُ أَبِي سَلَمَةَ تُوُفِّيَ النَّبِيُّ ﷺ وَهُوَ ابْنُ تِسْعِ سِنِينَ وَمَاتَ فِي خِلَافَةِ عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ
[Machine] That the Prophet ﷺ addressed Umm Salamah and said, "Tell your son to marry you" or he said, "Marry her son to her," and he was young at that time and had not reached the age of puberty. The sheikh (may Allah have mercy on him) said, "The Prophet ﷺ had something unique in the matter of marriage that others did not have."
أَنَّ النَّبِيَّ ﷺ خَطَبَ أُمَّ سَلَمَةَ قَالَ مُرِي ابْنَكِ أَنْ يُزَوِّجَكِ أَوْ قَالَ زَوَّجَهَا ابْنُهَا وَهُوَ يَوْمَئِذٍ صَغِيرٌ لَمْ يَبْلُغْ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَكَانَ لِلنَّبِيِّ ﷺ فِي بَابِ النِّكَاحِ مَا لَمْ يَكُنْ لِغَيْرِهِ
[Machine] "That your god whom you worship is a wooden idol that grows from the earth, a block of wood carved by a Habashi from the tribe of Bani Fulan? If you convert to Islam, I do not want anything from you except this friendship." He said, "Until I consider your proposal." He then left and came back and said, "I bear witness that there is no god but Allah, and that Muhammad is the messenger of Allah." Anas said, "O Anas, marry Abu Talha." The Shaykh, may Allah have mercy on him, said, "And Anas ibn Malik is her son and her extended family. He is Anas ibn Malik ibn Nadar ibn Dammam ibn Zaid ibn Haram from the tribe of Bani Adi ibn Al-Najjar, and her mother is Umm Sulaim, the daughter of Milhan ibn Khalid ibn Yazid. And Allah knows best."
أَنَّ إِلَهَكَ الَّذِي تَعْبُدُ خَشَبَةٌ تَنْبُتُ مِنَ الْأَرْضِ نَجَرَهَا حَبَشِيُّ بَنِي فُلَانٍ؟ إِنْ أَنْتَ أَسْلَمْتَ لَمْ أُرِدْ مِنْكَ مِنَ الصَّدَاقِ غَيْرَهُ قَالَ حَتَّى أَنْظُرَ فِي أَمْرِي قَالَ فَذَهَبَ ثُمَّ جَاءَ فَقَالَ أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللهِ قَالَتْ يَا أَنَسُ زَوِّجْ أَبَا طَلْحَةَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَأَنَسُ بْنُ مَالِكٍ ابْنُهَا وَعَصَبَتُهَا فَإِنَّهُ أَنَسُ بْنُ مَالِكِ بْنِ النَّضْرِ بْنِ ضَمْضَمِ بْنِ زَيْدِ بْنِ حَرَامٍ مِنْ بَنِي عَدِيِّ بْنِ النَّجَّارِ وَأُمُّ سُلَيْمٍ هِيَ ابْنَةُ مِلْحَانَ بْنِ خَالِدِ بْنِ يَزِيدَ وَاللهُ تَعَالَى أَعْلَمُ
39.119 [Machine] Consideration of Competence - Imam Shafi'i, may Allah have mercy on him, said in the narration of Al-Buwaytiyy: The basis of competence is derived from the hadith of Barirah. Her husband was not suitable for her, so the Messenger of Allah ﷺ gave her the choice.
٣٩۔١١٩ بَابُ اعْتِبَارِ الْكَفَاءَةِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي رِوَايَةِ الْبُوَيْطِيِّ: أَصْلُ الْكَفَاءَةِ مُسْتَنْبَطٌ مِنْ حَدِيثِ بَرِيرَةَ كَانَ زَوْجُهَا غَيْرُ كُفُوٍ لَهَا، فَخَيَّرَهَا رَسُولُ اللهِ ﷺ
"Barirah made a contract that she would be freed in return for nine Awaq, one Uqiyyah to be paid each year." She came to 'Aishah asking for help and she said: "No, not unless they agree to accept the sum in one payment, and that the Wala' will go to me." Barirah went and spoke to her masters but they insisted that the Wala' should be for them. She came to 'Aishah and the Messenger of Allah came, and she told her what her masters had said. She said: "No, by Allah, not unless Wala' is to me." The Messenger of Allah said: "What is this?" She said: "O Messenger of Allah, Barirah came to me and asked me to help her with her contract of manumission, and I said no, not unless they agree to accept the sum in one payment, and that the Wala' will be for me. She mentioned that to her masters and they insisted that the Wala' should be for them." The Messenger of Allah said: "Buy her, and stipulate that the Wala' is for the one who sets the slave free." Then he stood up and addressed the people and said: "What is the matter with people who stipulate conditions that are not in the Book of Allah, the Mighty and Sublime? They say: 'I set so-and-so free but the Wala' will be to me.' Every condition that is not in the Book of Allah, the Mighty and Sublime, is a false condition, even if there are a hundred conditions." And the Messenger of Allah gave her the choice with regard to her husband who was still a slave, and she chose herself. 'Urwah said: "If he had been free the Messenger of Allah would not have given her the choice." (Using translation from Nasāʾī 3451)
بَرِيرَةُ عَلَى نَفْسِهَا تِسْعَةَ أَوَاقٍ فِي كُلِّ سَنَةٍ أُوقِيَّةٌ فَأَتَتْ عَائِشَةَ تَسْتَعِينُهَا فَقَالَتْ لَا إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونَ الْوَلَاءُ لِي فَذَهَبَتْ بَرِيرَةُ فَكَلَّمَتْ فِي ذَلِكَ أَهْلَهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَجَاءَتْ إِلَى عَائِشَةَ ؓ أَوْ جَاءَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ فَقَالَتْ لَهَا مَا قَالَ أَهْلُهَا فَقَالَتْ لَاهَا اللهُ إِذًا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لِي فَقَالَ رَسُولُ اللهِ ﷺ ابْتَاعِيهَا وَاشْتَرِطِي لَهُمُ الْوَلَاءَ وَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ ثُمَّ قَامَ فَخَطَبَ النَّاسَ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ يَقُولُونَ أَعْتِقْ يَا فُلَانُ الْوَلَاءُ لِي كِتَابُ اللهِ أَحَقُّ وَشَرْطُ اللهِ أَوْثَقُ وَكُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ قَالَتْ وَخَيَّرَهَا رَسُولُ اللهِ ﷺ مِنْ زَوْجِهَا وَكَانَ عَبْدًا وَاخْتَارَتْ نَفْسَهَا قَالَ عُرْوَةُ وَلَوْ كَانَ حُرًّا مَا خَيَّرَهَا رَسُولُ اللهِ ﷺ
the Prophet said to him: 'Ali! Three are not to be delayed: Salat when its time comes, a funeral whet it (a prepared body) is present, and the (marriage of a) single woman when there is an equal for her." (Using translation from Tirmidhī 171)
أَنَّ رَسُولَ ﷺ قَالَ لَهُ يَا عَلِيُّ ثَلَاثَةٌ لَا تُؤَخِّرْهَا الصَّلَاةُ إِذَا أَتَتْ وَالْجِنَازَةُ إِذَا حَضَرَتْ وَالْأَيِّمُ إِذَا وَجَدَتْ كُفُؤًا
[Machine] The Messenger of Allah ﷺ said: "Choose the best partners for your offspring and marry them to the suitable ones." 13759 And Abu Abdullah informed us that Ali ibn Isa narrated to us, who narrated to us Ibrahim ibn Abi Talib, who narrated to us Ziyad ibn Ayyub, who narrated to us Ikrimah ibn Ibrahim from Hisham ibn Urwah, who mentioned it with a similar chain of narration. And likewise.
قَالَ رَسُولُ اللهِ ﷺ تَخَيَّرُوا لِنُطَفِكُمْ وَانْكِحُوا الْأَكْفَاءَ وَأَنْكِحُوا إِلَيْهِمْ 13759 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا عَلِيُّ بْنُ عِيسَى ثنا إِبْرَاهِيمُ بْنُ أَبِي طَالِبٍ ثنا زِيَادُ بْنُ أَيُّوبَ ثنا عِكْرِمَةُ بْنُ إِبْرَاهِيمَ عَنْ هِشَامِ بْنِ عُرْوَةَ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said: "Do not marry women except the capable ones, and do not marry them except with the permission of their guardians, and the dowry should not be less than ten dirhams. This is a weak hadith reported to us by Abu Bakr ibn al-Harith al-Faqih, who informed us Ali ibn Umar al-Hafidh, who narrated from Ahmad ibn Isa ibn As-Sukayni al-Baladi, who narrated from Zakariya ibn Al-Hasan Ar-Ras'ani, who narrated from Abu Al-Mughira Abd Al-Qudos ibn Al-Hajjaj, who narrated from Mubashir ibn Ubaid. Ali (may Allah have mercy on him) said that Mubashir ibn Ubaid is a narrator of abandoned hadiths, his hadiths cannot be relied upon. Imam Ahmad (may Allah have mercy on him) said, and it has been
قَالَ رَسُولُ اللهِ ﷺ لَا تَنْكِحُوا النِّسَاءَ إِلَّا الْأَكْفَاءَ وَلَا يُزَوِّجُهُنَّ إِلَّا الْأَوْلِيَاءُ وَلَا مَهْرَ دُونَ عَشَرَةِ دَرَاهِمَ فَهَذَا حَدِيثٌ ضَعِيفٌ بِمَرَّةٍ أَخْبَرَنَاهُ أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا أَحْمَدُ بْنُ عِيسَى بْنِ السُّكَيْنِ الْبَلَدِيُّ ثنا زَكَرِيَّا بْنُ الْحَسَنِ الرَّسْعَنِيُّ ثنا أَبُو الْمُغِيرَةِ عَبْدُ الْقُدُّوسِ بْنُ الْحَجَّاجِ ثنا مُبَشِّرُ بْنُ عُبَيْدٍ حَدَّثَنِي الْحَجَّاجُ بْنُ أَرْطَاةَ فَذَكَرَهُ قَالَ عَلِيٌّ رَحِمَهُ اللهُ مُبَشِّرُ بْنُ عُبَيْدٍ مَتْرُوكُ الْحَدِيثِ أَحَادِيثُهُ لَا يُتَابَعُ عَلَيْهَا قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ وَقَدْ
[Machine] The Messenger of Allah ﷺ said, "Women should not be married except by guardians (wali) and they should not be married except to qualified suitors. The dowry should not be less than ten dirhams." He also said, "I disassociate myself from the testimony of Ibn Khuzaymah."
قَالَ رَسُولُ اللهِ ﷺ لَا يُزَوِّجُ النِّسَاءَ إِلَّا الْأَوْلِيَاءُ وَلَا يُزَوَّجُهُنَّ إِلَّا الْأَكْفَاءُ وَلَا مَهْرَ دُونَ عَشَرَةِ دَرَاهِمَ قَائِلُ قَوْلِهِ وَأَنَا أَبْرَأُ مِنْ عُهْدَتِهِ ابْنُ خُزَيْمَةَ
[Machine] Umar said, "It is not suitable for those who are responsible for their own affairs to marry except those who are competent." The Sheikh, may Allah have mercy on him, said that Al-Shafi'i, may Allah have mercy on him, made the meaning conditional on the consent of the guardians in marriage so that the woman does not harm herself. He said it has no meaning other than that it is preferable for her to only marry a suitable partner. Rather, I do not think it is possible that a matter is established for them with the woman herself except in order for her to marry only a suitable partner. Abu Sa'id ibn Abi 'Amr informed us, Abu al-Abbas reported to us, and Rabi' reported to us that Al-Shafi'i, may Allah have mercy on him, mentioned it.
قَالَ عُمَرُ ؓ لَا يَنْبَغِي لِذَوَاتِ الْأَحْسَابِ تَزَوُّجُهُنَّ إِلَّا مِنَ الْأَكْفَاءِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ جَعَلَ الشَّافِعِيُّ رَحِمَهُ اللهُ الْمَعْنَى فِي اشْتِرَاطِ الْوُلَاةِ فِي النِّكَاحِ كَيْلَا تُضَيِّعَ الْمَرْأَةُ نَفْسَهَا فَقَالَ لَا مَعْنَى لَهُ أَوْلَى بِهِ مِنْ أَنْ لَا تَزَوَّجَ إِلَّا كُفُؤًا بَلْ لَا أَحْسَبُهُ يَحْتَمِلُ أَنْ يَكُونَ جُعِلَ لَهُمْ أَمْرٌ مَعَ الْمَرْأَةِ فِي نَفْسِهَا إِلَّا لِئَلَّا تَنْكِحَ إِلَّا كُفُوًا أَخْبَرَنَا بِذَلِكَ أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ أَنْبَأَ الرَّبِيعُ أَنْبَأَ الشَّافِعِيُّ رَحِمَهُ اللهُ فَذَكَرَهُ
39.120 [Machine] The religious requirement for competence
٣٩۔١٢٠ بَابُ اشْتِرَاطِ الدِّينِ فِي الْكَفَاءَةِ قَالَ اللهُ تَعَالَى: {وَلَا تَنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا} [البقرة: 221]، وَقَالَ: {وَلَا تَنْكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ} [البقرة: 221] , ثُمَّ اسْتَثْنَى فَقَالَ: {وَالْمُحْصَنَاتُ مِنَ الذِّينَ أُوتُوا الْكِتَابَ مِنْ قَبْلِكُمْ} [المائدة: 5] دَلَّ بِذَلِكَ عَلَى أَنَّ الْمُرَادَ بِالْمُشْرِكَاتِ الْوَثَنِيَّاتُ وَالْمَجُوسِيَّاتُ، وَاللهُ أَعْلَمُ
[Machine] I went with Al-Ash'ari to Ali ibn Abi Talib and we said to him, "Did the Messenger of Allah ﷺ entrust you with something that he did not entrust to others?" He said, "No, except what is in my book, where it says that the believers are equal in their blood money and they have authority over anyone else besides them." And he mentioned the narration.
انْطَلَقْتُ أَنَا وَالْأَشْتَرُ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ فَقُلْنَا لَهُ هَلْ عَهِدَ إِلَيْكَ رَسُولُ اللهِ ﷺ شَيْئًا لَمْ يَعْهَدْهُ إِلَى النَّاسِ؟ فَقَالَ لَا إِلَّا مَا فِي كِتَابِي وَإِذَا فِيهِ الْمُؤْمِنُونَ تَكَافَأُ دِمَاؤُهُمْ وَهُمْ يَدٌ عَلَى مَنْ سِوَاهُمْ وَذَكَرَ الْحَدِيثَ
39.121 [Machine] Consideration of lineage in competence
٣٩۔١٢١ بَابُ اعْتِبَارِ النَّسَبِ فِي الْكَفَاءَةِ
[Machine] The Messenger of Allah ﷺ said, "Indeed, Allah chose the descendants of Kinanah from the descendants of Ismail. And He chose from the descendants of Kinanah the Quraysh. And He chose from the Quraysh the Banu Hashim. And He chose me from the Banu Hashim." And Ar-Rabi' said, "The Messenger of Allah ﷺ said, 'Indeed, Allah chose from the Quraysh the Banu Hashim. And He chose me from the Banu Hashim.'"
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ اصْطَفَى بَنِي كِنَانَةَ مِنْ بَنِي إِسْمَاعِيلَ وَاصْطَفَى مِنْ بَنِي كِنَانَةَ قُرَيْشًا وَاصْطَفَى مِنْ قُرَيْشٍ بَنِي هَاشِمٍ وَاصْطَفَانِي مِنْ بَنِي هَاشِمٍ وَقَالَ الرَّبِيعُ قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ اصْطَفَى مِنْ قُرَيْشٍ بَنِي هَاشِمٍ وَاصْطَفَانِي مِنْ بَنِي هَاشِمٍ
[Machine] The Messenger of Allah ﷺ said, "Indeed, Allah has chosen the Arabs, and He chose from among them Kinana or he said Nadhr bin Kinana. Then He chose from among them Quraish, and then He chose from among them Banu Hashim. And then He chose me from among Banu Hashim. So, I am a good choice."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ اخْتَارَ الْعَرَبَ فَاخْتَارَ مِنْهُمْ كِنَانَةَ أَوْ قَالَ النَّضْرَ بْنَ كِنَانَةَ شَكَّ حَمَّادٌ ثُمَّ اخْتَارَ مِنْهُمْ قُرَيْشًا ثُمَّ اخْتَارَ مِنْهُمْ بَنِي هَاشِمٍ ثُمَّ اخْتَارَنِي مِنْ بَنِي هَاشِمٍ هَذَا مُرْسَلٌ حَسَنٌ
[Machine] Two favors you have bestowed upon us, O people of Arabia: your women are not to be married to us, nor are we to marry yours. This is the preserved tradition.
ثِنْتَانِ فَضَلْتُمُونَا بِهَا يَا مَعْشَرَ الْعَرَبِ لَا تُنْكَحُ نِسَاؤُكُمْ وَلَا نَؤُمُّكُمْ هَذَا هُوَ الْمَحْفُوظُ مَوْقُوفٌ
[Machine] The Messenger of Allah ﷺ prohibited us from stepping ahead of you or marrying your women, and this was narrated from another weak source apart from Salman.
نَهَانَا رَسُولُ اللهِ ﷺ أَنْ نَتَقَدَّمَ أَمَامَكُمْ أَوْ نَنْكِحَ نِسَاءَكُمْ وَرُوِيَ ذَلِكَ مِنْ وَجْهٍ آخَرَ ضَعِيفٍ عَنْ سَلْمَانَ
39.122 [Machine] The Consideration of Freedom in Competence.
٣٩۔١٢٢ بَابُ اعْتِبَارِ الْحُرِّيَّةِ فِي الْكَفَاءَةِ
[Machine] The Messenger of Allah, ﷺ , said, "Loyalty is to be given to the one who granted the favor." She said, and the Messenger of Allah, ﷺ , chose her and her husband was a servant.
رَسُولُ اللهِ ﷺ الْوَلَاءُ لِمَنْ وَلِيَ النِّعْمَةَ قَالَتْ وَخَيَّرَهَا رَسُولُ اللهِ ﷺ وَكَانَ زَوْجُهَا عَبْدًا
39.123 [Machine] Considering Craftsmanship in Competence
٣٩۔١٢٣ بَابُ اعْتِبَارِ الصَّنْعَةِ فِي الْكَفَاءَةِ
[Machine] The Messenger of Allah ﷺ said, "The Arabs are competent for one another, tribe for tribe, and man for man. The mawali (non-Arab Muslims) are also competent for one another, tribe for tribe, and man for man, except for tailors or cobblers. This is disconnected from a brave person and Ibn Jurayj, where a brave person is not named among his companions. It was narrated by Uthman ibn Abdur Rahman from Ali ibn Urawah al-Damashqi from Ibn Jurayj from Nafi from Ibn Umar, who is weak. And it was narrated from another source from Nafi, who is also weak, with a slight variation."
قَالَ رَسُولُ اللهِ ﷺ الْعَرَبُ بَعْضُهُمْ أَكْفَاءٌ لِبَعْضٍ قَبِيلَةٌ بِقَبِيلَةٍ وَرَجُلٌ بِرَجُلٍ وَالْمَوَالِي بَعْضُهُمْ أَكْفَاءٌ لِبَعْضٍ قَبِيلَةٌ بِقَبِيلَةٍ وَرَجُلٌ بِرَجُلٍ إِلَّا حَائِكٌ أَوْ حَجَّامٌ هَذَا مُنْقَطِعٌ بَيْنَ شُجَاعٍ وَابْنِ جُرَيْجٍ حَيْثُ لَمْ يُسَمِّ شُجَاعٌ بَعْضَ أَصْحَابِهِ وَرَوَاهُ عُثْمَانُ بْنُ عَبْدِ الرَّحْمَنِ عَنْ عَلِيِّ بْنِ عُرْوَةَ الدِّمَشْقِيِّ عَنِ ابْنِ جُرَيْجٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ وَهُوَ ضَعِيفٌ وَرُوِيَ مِنْ وَجْهٍ آخَرَ عَنْ نَافِعٍ وَهُوَ أَيْضًا ضَعِيفٌ بِمَرَّةٍ
[Machine] Allah's peace and blessings be upon them. Arabs are capable of supporting each other, tribe with tribe, and man with man. The allies are also capable of supporting each other, tribe with tribe, and man with man, except for tailors or barbers. This is also narrated from another perspective, other than that of Aisha, and it is also weak.
اللهِ ﷺ الْعَرَبُ أَكْفَاءٌ بَعْضُهَا بَعْضًا قَبِيلٌ بِقَبِيلٍ وَرَجُلٌ بِرَجُلٍ وَالْمَوَالِي أَكْفَاءٌ بَعْضُهَا بَعْضًا قَبِيلٌ بِقَبِيلٍ وَرَجُلٌ بِرَجُلٍ إِلَّا حَائِكٌ أَوْ حَجَّامٌ وَرُوِيَ ذَلِكَ مِنْ وَجْهٍ آخَرَ عَنْ عَائِشَةَ ؓ وَهُوَ أَيْضًا ضَعِيفٌ
[Machine] The Messenger of Allah ﷺ said, "Arabs are competent for Arabs, and non-Arabs are competent for non-Arabs, except for (exceptions like) a tailor or a barber."
قَالَ رَسُولُ اللهِ ﷺ الْعَرَبُ لِلْعَرَبِ أَكْفَاءٌ وَالْمَوَالِي أَكْفَاءٌ لِلْمَوَالِي إِلَّا حَائِكٌ أَوْ حَجَّامٌ
39.124 [Machine] Considering safety in efficiency
٣٩۔١٢٤ بَابُ اعْتِبَارِ السَّلَامَةِ فِي الْكَفَاءَةِ
[Machine] The Messenger of Allah ﷺ said, "There is no contagion (infectious disease), no evil omen, and no serpent (snake bite). Take precautions and flee from the plague (leper), just as you would flee from a lion or say from wild beasts."
قَالَ رَسُولُ اللهِ ﷺ لَا عَدْوَى وَلَا هَامَةَ وَلَا صَفَرَ وَفِرَّ مِنَ الْمَجْذُومِ فِرَارَكَ مِنَ الْأَسَدِ أَوْ قَالَ مِنَ الْأُسُودِ
[Machine] Umar said, "If a man marries a woman who has insanity, leprosy, smallpox, or a horn, and he has intercourse with her, she is entitled to her bride price from him, while he has authority over the guardian." And Allah knows best.
قَالَ عُمَرُ إِذَا تَزَوَّجَ الرَّجُلُ الْمَرْأَةَ وَبِهَا جُنُونٌ أَوْ جُذَامٌ أَوْ بَرَصٌ أَوْ قَرْنٌ فَإِنْ كَانَ دَخَلَ بِهَا فَلَهَا الصَّدَاقُ بِمَسِّهِ إِيَّاهَا وَهُوَ لَهُ عَلَى الْوَلِيِّ وَاللهُ أَعْلَمُ
39.125 [Machine] Considering the left in efficiency
٣٩۔١٢٥ بَابُ اعْتِبَارِ الْيَسَارِ فِي الْكَفَاءَةِ
[Machine] She said, "When I became lawful for him," meaning the Prophet Muhammad ﷺ , "Muawiyah and Abu Jahl proposed to me. So the Messenger of Allah ﷺ said, 'As for Abu Jahl, he will not remove his stick from his shoulder, and as for Muawiyah, he is stingy and has no wealth. Marry Osama bin Zaid.' I disliked him at first, but then the Prophet said, 'Marry Osama,' so I married him. And Allah made good in him, and I was content with him."
أَنْ قَالَتْ فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ يَعْنِي النَّبِيَّ ﷺ أَنَّ مُعَاوِيَةَ وَأَبَا جَهْمٍ خَطَبَانِي فَقَالَ رَسُولُ اللهِ ﷺ أَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالَ لَهُ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ قَالَتْ فَكَرِهْتُهُ ثُمَّ قَالَ انْكِحِي أُسَامَةَ فَنَكَحْتُهُ فَجَعَلَ اللهُ فِيهِ خَيْرًا وَاغْتَبَطْتُ بِهِ
[Machine] "I heard the Messenger of Allah ﷺ say, 'Verily, the calculation of the people of this world is based on wealth and similar matters.'"
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِنَّ أَحْسَابَ أَهْلِ الدُّنْيَا هَذَا الْمَالُ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "Sufficiency is wealth, and generosity is righteousness."
قَالَ رَسُولُ اللهِ ﷺ الْحَسَبُ الْمَالُ وَالْكَرَمُ التَّقْوَى
[Machine] The Messenger of Allah ﷺ said, "The nobility of a person lies in their religion, their integrity lies in their intellect, and their estimation lies in their character." This narration is ascribed to Imam Abu Abdullah and is not found in the narration of Ibn Yousuf, but a similar narration regarding the integrity lying in the intellect is reported from Umar ibn Khattab. And Allah knows best.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ كَرَمُ الْمَرْءِ دِينُهُ وَمُرُوءَتُهُ عَقْلُهُ وَحَسَبُهُ خُلُقُهُ لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ وَلَيْسَ فِي رِوَايَةِ ابْنِ يُوسُفَ وَمُرُوءَتُهُ عَقْلُهُ وَرُوِيَ مِثْلُ ذَلِكَ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ مِنْ قَوْلِهِ وَاللهُ أَعْلَمُ
39.126 [Machine] The marriage of an unsuitable person cannot be refused if the wife is pleased with it, and the one who has authority over her and is a Muslim.
٣٩۔١٢٦ بَابُ لَا يُرَدُّ نِكَاحُ غَيْرِ الْكُفْؤِ إِذَا رَضِيَتْ بِهِ الزَّوْجَةُ، وَمَنْ لَهُ الْأَمْرُ مَعَهَا وَكَانَ مُسْلِمًا
[Machine] "The Messenger of Allah ﷺ said, 'O Bani Bayadah, marry Aba Hind and let her marry you.' He said, 'And he was a barber with a fee of 13,779.' Abu Sa'ad al-Maliniyy narrated to us, Abu Ahmad ibn 'Adi informed me, Ahmad ibn Ali ibn al-Muthanna narrated to me, Ibrahim ibn al-Hajjaj narrated to me, Hammad ibn Salamah mentioned it similarly."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ يَا بَنِي بَيَاضَةَ أَنْكِحُوا أَبَا هِنْدٍ وَأَنْكِحُوا إِلَيْهِ قَالَ وَكَانَ حَجَّامًا 13779 وَأَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ حَدَّثَنِي أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى ثنا إِبْرَاهِيمُ بْنُ الْحَجَّاجِ ثنا حَمَّادُ بْنُ سَلَمَةَ فَذَكَرَهُ بِمِثْلِهِ
[Machine] Al-Zuhri told me about this story that they said, "O Messenger of Allah, can we marry our slave girls?" So Allah revealed, "Indeed, We created you from a male and a female and made you peoples and tribes that you may know one another." [Surah Al-Hujurat 13]
حَدَّثَنِي الزُّهْرِيُّ فِي هَذِهِ الْقِصَّةِ أَنَّهُمْ قَالُوا يَا رَسُولَ اللهِ تُزَوِّجُ بَنَاتِنَا مَوَالِيَنَا؟ فَأَنْزَلَ اللهُ ﷻ {إِنَّا خَلَقْنَاكُمْ مِنْ ذَكَرٍ وَأُنْثَى وَجَعَلْنَاكُمْ شُعُوبًا وَقَبَائِلَ لِتَعَارَفُوا} [الحجرات 13] الْآيَةَ
[Machine] Bint Qais says that her husband divorced her three times and the Messenger of Allah ﷺ did not grant her a place to stay or provide for her. She said, the Messenger of Allah ﷺ said to me, "If you want, I can give you permission to remarry." So Muawiyah, Abu Jahlm, and Usamah bin Zaid proposed to her. The Messenger of Allah ﷺ said, "As for Muawiyah, he is a poor man who has no wealth. And as for Abu Jahlm, he is a man who beats women. But as for Usamah, she said, extending her hand this way and that, "this is Usamah, this is Usamah." So the Messenger of Allah ﷺ said to her, "Obedience to Allah and obedience to His Messenger is better for you." She said, "So I married him and I was delighted with him."
بِنْتَ قَيْسٍ تَقُولُ إِنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَلَمْ يَجْعَلْ لَهَا رَسُولُ اللهِ ﷺ سُكْنَى وَلَا نَفَقَةَ قَالَتْ قَالَ لِي رَسُولُ اللهِ ﷺ إِذَا حَلَلْتِ فَآذِنِينِي فَآذَنَتْهُ فَخَطَبَهَا مُعَاوِيَةُ وَأَبُو جَهْمٍ وَأُسَامَةُ بْنُ زَيْدٍ ؓ فَقَالَ رَسُولُ اللهِ ﷺ أَمَّا مُعَاوِيَةُ فَرَجُلٌ تَرِبٌ لَا مَالَ لَهُ وَأَمَّا أَبُو جَهْمٍ فَرَجُلٌ ضَرَّابٌ لِلنِّسَاءِ وَلَكِنْ أُسَامَةُ فَقَالَتْ بِيَدِهَا هَكَذَا أُسَامَةُ أُسَامَةُ قَالَ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ طَاعَةُ اللهِ وَطَاعَةُ رَسُولِهِ خَيْرٌ لَكِ قَالَتْ فَتَزَوَّجْتُهُ فَاغْتَبَطْتُ بِهِ
[Machine] Several companions of the Prophet Muhammad ﷺ proposed marriage to me, so I sent my sister to consult with him on the matter. The Prophet ﷺ asked my sister, "Where is the one who will teach her the Book of her Lord and the Sunnah of her Prophet?" My sister asked, "Who?" He said, "Zaid ibn Harithah." I became angry when she informed me of this and said, "I will marry your cousin instead." Then I went to the Prophet ﷺ and told him what had happened. Allah then revealed the verse, "It is not for a believing man or a believing woman, when Allah and His Messenger have decided a matter, that they should [thereafter] have any choice about their affair" (Quran 33:36). I sent a message to him saying, "Marry me to whomever you wish." He married me to Zaid, but I held negative feelings towards him. I complained to the Prophet ﷺ, who told Zaid to keep me as his wife and advised me to fear Allah. However, I continued to complain and eventually Zaid divorced me. When my waiting period ended, I felt that the Prophet ﷺ and I were being watched, as my hair was uncovered. I thought that this matter was a decree from the heavens. I said to the Messenger of Allah, "There was no proposal or witnesses." He replied, "Allah is the matchmaker and Gabriel is the witness." Even though the chain of narration of this hadith may not be strong, it is widely known that Zainab bint Jahsh, who belonged to the Banu Asad bin Khuzaymah tribe and was the niece of the Prophet ﷺ's wife Umm Habiba bint Abi Sufyan, was with Zaid ibn Harithah until he divorced her. Then the Prophet ﷺ married her, as is also mentioned in the hadith about the daughter of your cousin, and the correct opinion is that she is actually the daughter of your aunt.
خَطَبَنِي عِدَّةٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ فَأَرْسَلْتُ إِلَيْهِ أُخْتِي أُشَاوِرُهُ فِي ذَلِكَ قَالَ فَأَيْنَ هِيَ مِمَّنْ يُعَلِّمُهَا كِتَابَ رَبِّهَا وَسُنَّةَ نَبِيِّهَا؟ قَالَتْ مَنْ؟ قَالَ زَيْدُ بْنُ حَارِثَةَ فَغَضِبَتْ وَقَالَتْ تُزَوِّجُ ابْنَةَ عَمِّكَ مَوْلَاكَ ثُمَّ أَتَتْنِي فَأَخْبَرَتْنِي بِذَلِكَ فَقُلْتُ أَشَدَّ مِنْ قَوْلِهَا وَغَضِبْتُ أَشَدَّ مِنْ غَضَبِهَا قَالَ فَأَنْزَلَ اللهُ ﷻ {وَمَا كَانَ لِمُؤْمِنٍ وَلَا مُؤْمِنَةٍ إِذَا قَضَى اللهُ وَرَسُولُهُ أَمْرًا أَنْ يَكُونَ لَهُمُ الْخِيَرَةُ مِنْ أَمْرِهِمْ} [الأحزاب 36] قَالَتْ فَأَرْسَلْتُ إِلَيْهِ زَوِّجْنِي مَنْ شِئْتَ قَالَتْ فَزَوَّجَنِي مِنْهُ فَأَخَذْتُهُ بِلِسَانِي فَشَكَانِي إِلَى النَّبِيِّ ﷺ فَقَالَ لَهُ النَّبِيُّ ﷺ أَمْسِكْ عَلَيْكَ زَوْجَكَ وَاتَّقِ اللهَ ثُمَّ أَخَذْتُهُ بِلِسَانِي فَشَكَانِي إِلَى النَّبِيِّ ﷺ وَقَالَ أَنَا أُطَلِّقُهَا فَطَلَّقَنِي فَبَتَّ طَلَاقِي فَلَمَّا انْقَضَتْ عِدَّتِي لَمْ أَشْعُرْ إِلَّا وَالنَّبِيُّ ﷺ وَأَنَا مَكْشُوفَةُ الشَّعْرِ فَقُلْتُ هَذَا أَمْرٌ مِنَ السَّمَاءِ وَقُلْتُ يَا رَسُولَ اللهِ بِلَا خِطْبَةٍ وَلَا شَهَادَةٍ قَالَ اللهُ الْمُزَوِّجُ وَجِبْرِيلُ الشَّاهِدُ وَهَذَا وَإِنْ كَانَ إِسْنَادُهُ لَا تَقُومُ بِمِثْلِهِ حُجَّةٌ فَمَشْهُورٌ أَنَّ زَيْنَبَ بِنْتَ جَحْشٍ وَهِيَ مِنْ بَنِي أَسَدِ بْنِ خُزَيْمَةَ وَأُمُّهَا أُمَيْمَةُ بِنْتُ عَبْدِ الْمُطَّلِبِ بْنِ هَاشِمٍ عَمَّةُ رَسُولِ اللهِ ﷺ كَانَتْ عِنْدَ زَيْدِ بْنِ حَارِثَةَ حَتَّى طَلَّقَهَا ثُمَّ تَزَوَّجَ رَسُولُ اللهِ ﷺ بِهَا وَكَذَا فِي الْحَدِيثِ ابْنَةُ عَمِّكَ وَالصَّوَابُ ابْنَةُ عَمَّتِكَ
[Machine] The Messenger of Allah, ﷺ , entered the house of Zubayra bint al-Zubayr ibn Abdul-Muttalib and said to her, "It seems like you want to perform Hajj (pilgrimage)." She replied, "I find myself in a difficult situation." He said to her, "Perform Hajj, but make a condition that my place of stay is where you have confined me." She was staying under the guardianship of Mikdad ibn al-Aswad.
دَخَلَ رَسُولُ اللهِ ﷺ عَلَى ضُبَاعَةَ بِنْتِ الزُّبَيْرِ بْنِ عَبْدِ الْمُطَّلِبِ فَقَالَ لَهَا كَأَنَّكِ تُرِيدِينَ الْحَجَّ قَالَتْ أَجِدُنِي شَاكِيَةً قَالَ لَهَا حُجِّي وَاشْتَرِطِي أَنَّ مَحِلِّي حَيْثُ حَبَسْتَنِي وَكَانَتْ تَحْتَ الْمِقْدَادِ بْنِ الْأَسْوَدِ
[Machine] The Messenger of Allah ﷺ said, "I married Miqdad and Zayd so that there could be the most noble and best of you in character before Allah. This is a connection that is cut off and before that there was kinship. Miqdad is the son of Amr ibn Tha'labah ibn Malik, the confederate of Aswad, a man from the Banu Zuhrah tribe. He was attributed to them, but he was not from their lineage. He was married to Duba'ah, the daughter of Zubayr ibn Abdul-Muttalib ibn Hashim."
قَالَ رَسُولُ اللهِ ﷺ زَوَّجْتُ الْمِقْدَادَ وَزَيْدًا لِيَكُونَ أَشْرَفُكُمْ عِنْدَ اللهِ أَحْسَنَكُمْ خُلُقًا هَذَا مُنْقَطِعٌ وَفِيمَا قَبْلَهُ كِفَايَةٌ وَالْمِقْدَادُ هُوَ ابْنُ عَمْرِو بْنِ ثَعْلَبَةَ بْنِ مَالِكٍ حَلِيفُ الْأَسْوَدِ رَجُلٌ مِنْ بَنِي زُهْرَةَ فَنُسِبَ إِلَيْهِ وَلَمْ يَكُنْ مِنْ صُلْبِهِمْ وَقَدْ زُوِّجَتْ مِنْهُ ضُبَاعَةُ بِنْتُ الزُّبَيْرِ بْنِ عَبْدِ الْمُطَّلِبِ بْنِ هَاشِمٍ
[Machine] Abu Hudhayfah ibn Utbah ibn Rabiah ibn Abd Shams was one of those who witnessed the Battle of Badr with the Messenger of Allah ﷺ . He adopted and married the daughter of his brother, Hind bint Al-Walid ibn Utbah. He was a freed slave of a woman from the Ansar, just as the Prophet ﷺ adopted Zaid. The hadith mentioned him at length.
أَبَا حُذَيْفَةَ بْنَ عُتْبَةَ بْنِ رَبِيعَةَ بْنِ عَبْدِ شَمْسٍ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللهِ ﷺ تَبَنَّى سَالِمًا وَزَوَّجَهُ ابْنَةَ أَخِيهِ هِنْدَ بِنْتَ الْوَلِيدِ بْنِ عُتْبَةَ وَهُوَ مَوْلًى لِامْرَأَةٍ مِنَ الْأَنْصَارِ كَمَا تَبَنَّى النَّبِيُّ ﷺ زَيْدًا وَذَكَرَ الْحَدِيثَ بِطُولِهِ
[Machine] I saw the sister of Abdur Rahman ibn Awf beneath Bilal.
رَأَيْتُ أُخْتَ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ تَحْتَ بِلَالٍ
[Machine] The Bani Bukair came to the Messenger of Allah ﷺ and said, "Get our sister married to so-and-so." He asked, "What about Bilal? Where are you in regards to Bilal?" So they went back and asked three times, and then got her married to Bilal. The Bani Bukair were among the emigrants from the Banu Layth. Abu Bakr Muhammad ibn Muhammad informed us, who heard from Abu al-Husain al-Fasawi, who heard from Abu Ali al-Lului, who narrated from Abu Dawud, who mentioned it.
أَنَّ بَنِي بُكَيْرٍ أَتَوْا رَسُولَ اللهِ ﷺ فَقَالُوا زَوِّجْ أُخْتَنَا مِنْ فُلَانٍ فَقَالَ أَيْنَ أَنْتُمْ عَنْ بِلَالٍ فَعَادُوا فَأَعَادَ ثَلَاثًا فَزَوَّجُوهُ قَالَ وَكَانَ بَنُو بُكَيْرٍ مِنَ الْمُهَاجِرِينَ مِنْ بَنِي لَيْثٍ أَخْبَرَنَاهُ أَبُو بَكْرٍ مُحَمَّدُ بْنُ مُحَمَّدٍ أنبأ أَبُو الْحُسَيْنِ الْفَسَوِيُّ أنبأ أَبُو عَلِيٍّ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ فَذَكَرَهُ
[Machine] He is one of them, so he proposed to a woman from the Arabs, and they said, "If Bilal comes, we will marry you to him." He said, "Bilal has arrived." He said, "I am Bilal ibn Rabah, and this is my brother, and he is a man of bad character and religion. If you want to marry him, then marry him, and if you want to leave him, then leave him." They said, "Whoever is his brother, marry him to him." So, they married him to him.
أَنَّهُ مِنْهُمْ فَخَطَبَ امْرَأَةً مِنَ الْعَرَبِ فَقَالُوا إِنْ حَضَرَ بِلَالٌ زَوَّجْنَاكَ قَالَ فَحَضَرَ بِلَالٌ فَقَالَ أَنَا بِلَالُ بْنُ رَبَاحٍ وَهَذَا أَخِي وَهُوَ امْرُؤُ سُوءٍ سِيِّئُ الْخُلُقِ وَالدِّينِ فَإِنْ شِئْتُمْ أَنْ تُزَوِّجُوهُ فَزَوِّجُوهُ وَإِنْ شِئْتُمْ أَنْ تَدَعُوهُ فَدَعُوهُ فَقَالُوا مَنْ تَكُنْ أَخَاهُ نُزَوِّجْهُ فَزَوَّجُوهُ
39.127 [Machine] Marriage is not invalidated by a decrease in the dowry if the woman agrees to it and has control over her own affairs, because the dowry belongs to her and not to the guardians.
٣٩۔١٢٧ بَابُ لَا يُرَدُّ النِّكَاحُ بِنَقْصِ الْمَهْرِ، إِذَا رَضِيَتِ الْمَرْأَةُ بِهِ، وَكَانَتْ مَالِكَةً لِأَمْرِهَا لِأَنَّ الْمَهْرَ لَهَا دُونَ الْأَوْلِيَاءِ
[Machine] "That a woman who got married wearing two shoes was brought to the Prophet ﷺ , and he asked her if she was satisfied with herself and her wealth with the two shoes. She replied, 'Yes.' So the Prophet ﷺ approved it, and in this there are other narrations mentioned in the book of Al-Sadaq. And with Allah is success."
أَنَّ امْرَأَةً تَزَوَّجَتْ عَلَى نَعْلَيْنِ فَجِيءَ بِهَا إِلَى النَّبِيِّ ﷺ فَقَالَ لَهَا أَرَضِيتِ مِنْ نَفْسِكِ وَمَالِكِ بِنَعْلَيْنِ؟ فَقَالَتْ نَعَمْ فَأَجَازَهُ النَّبِيُّ ﷺ وَفِيهِ أَخْبَارٌ أُخَرُ مَوْضِعُهَا كِتَابُ الصَّدَاقِ وَبِاللهِ التَّوْفِيقُ
39.128 [Machine] What the Guardian and the Woman Calling for Competence Must Do Allah Almighty says, "So do not prevent them from remarrying their [former] husbands" [Surah Al-Baqarah: 232]
٣٩۔١٢٨ بَابُ مَا جَاءَ فِي عَضْلِ الْوَلِيِّ وَالْمَرْأَةُ تَدْعُو إِلَى كَفَاءَةٍ قَالَ اللهُ تَعَالَى وَهُوَ أَصْدَقُ الْقَائِلِينَ: {فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ} [البقرة: 232]
concerning the Verse: 'Do not prevent them' (2.232) Ma'qil bin Yasar told me that it was revealed in his connection. He said, "I married my sister to a man and he divorced her, and when her days of 'Idda (three menstrual periods) were over, the man came again and asked for her hand, but I said to him, 'I married her to you and made her your bed (your wife) and favored you with her, but you divorced her. Now you come to ask for her hand again? No, by Allah, she will never go back to you (again)!' That man was not a bad man and his wife wanted to go back to him. So Allah revealed this Verse: 'Do not prevent them.' (2.232) So I said, 'Now I will do it (let her go back to him), O Messenger of Allah ﷺ."So he married her to him again. كُنْتُ زَوَّجْتُ أُخْتًا لِي مِنْ رَجُلٍ فَطَلَّقَهَا حَتَّى إِذَا انْقَضَتْ عِدَّتُهَا جَاءَ فَخَطَبَهَا فَقُلْتُ لَهُ زَوَّجْتُكَ وَأَفْرَشْتُكَ وَأَكْرَمْتُكَ فَطَلَّقْتَهَا ثُمَّ جِئْتَ تَخْطُبُهَا لَا وَاللهِ لَا تَعُودُ إِلَيْهَا أَبَدًا قَالَ وَكَانَ رَجُلًا لَا بَأْسَ بِهِ وَكَانَتِ امْرَأَتُهُ تُرِيدُ أَنْ تَرْجِعَ إِلَيْهِ قَالَ فَأَنْزَلَ اللهُ ﷻ هَذِهِ الْآيَةَ فَقُلْتُ الْآنَ أَفْعَلُ يَا رَسُولَ اللهِ فَزَوَّجْتُهَا إِيَّاهُ
[Machine] The Messenger of Allah ﷺ said: Any woman who is married without the permission of her guardians, her marriage is invalid, her marriage is invalid, her marriage is invalid. If a man has intercourse with her, she is entitled to her dowry for what he has done to her. And if they dispute, then the ruler is the guardian of one who has no guardian. And it is narrated from Mujalid from Al-Sha'bi from Ali and Abdullah and Shurayh, they said: There is no marriage without a guardian, except for a woman whose guardian hinders her, so she goes to the ruler or to the judge. And it is also narrated from Ziyad bin Al-Aqqa that Uthman bin Affan wrote: If the father is competent, then tell him to marry her. If he refuses, then marry her and ask for Allah's guidance. And Allah knows best.
رَسُولَ اللهِ ﷺ يَقُولُ أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ مَوَالِيهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنْ أَصَابَهَا فَلَهَا مَهْرُهَا بِمَا أَصَابَهَا وَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ وَرُوِّينَا عَنْ مُجَالِدٍ عَنِ الشَّعْبِيِّ عَنْ عَلِيٍّ وَعَبْدِ اللهِ وَشُرَيْحٍ قَالُوا لَا نِكَاحَ إِلَّا بِوَلِيٍّ إِلَّا امْرَأَةً يَعْضِلُهَا الْوَلِيُّ فَتَأْتِي السُّلْطَانَ أَوِ الْقَاضِيَ وَعَنْ زِيَادِ بْنِ عِلَاقَةَ قَالَ كَتَبَ عُثْمَانُ بْنُ عَفَّانَ ؓ إِنْ كَانَ كُفُؤًا فَقُولُوا لِأَبِيهَا يُزَوِّجُهَا فَإِنْ أَبَى فَزَوِّجُوهَا وَبِاللهِ التَّوْفِيقُ وَاللهُ أَعْلَمُ
39.129 [Machine] What is mentioned in the interpretation of the other muscle that Allah has forbidden?
٣٩۔١٢٩ بَابُ مَا جَاءَ فِي تَفْسِيرِ الْعَضْلِ الْآخَرِ الَّذِي نَهَى اللهُ سُبْحَانَهُ وَتَعَالَى عَنْهُ
[Machine] "And when a man dies, his relatives have more right to his wife than any other person, if they wish to marry her. If they do not wish to marry her, they can allow someone else to marry her, or they can choose not to marry her. This verse was revealed regarding this matter."
وَكَانَ الرَّجُلُ إِذَا مَاتَ كَانَ أَوْلِيَاؤُهُ أَحَقَّ بِامْرَأَتِهِ مِنْ وَلِيِّ نَفْسِهَا إِنْ شَاءَ بَعْضُهُمْ تَزَوَّجَهَا وَإِنْ شَاءُوا زَوَّجُوهَا وَإِنْ شَاءُوا لَمْ يُزَوِّجُوهَا فَنَزَلَتْ هَذِهِ الْآيَةُ فِي ذَلِكَ
[Machine] In His saying {O you who have believed, it is not lawful for you to inherit women by compulsion} [An-Nisa 19], it is mentioned that in the era of ignorance, when a man died, his close relative would approach his wife and throw a garment on her, thereby inheriting her. Hence, he had more right to her than anyone else. Then Allah revealed this verse and His saying {And do not prevent them from remarrying their [former] husbands} [An-Nisa 19], which means that the man would prevent his wife from leaving the house without any reason, with the intention of obtaining ransom from her. So Allah said {And do not prevent them} [An-Nisa 19], meaning do not detain or confine them, {so that you may take [back] part of what you gave them} [An-Nisa 19], meaning part of the dowry you gave them. Unless they commit a clear immorality, meaning an evident act of disobedience or rebellion, Allah has made permissible striking or banishing them. If they refuse, the ransom becomes permissible for him. The complete explanation of this matter is mentioned, Allah willing, in the book of Al-Qasam wherein we have reported the speech of Ash-Shafi'i, may Allah have mercy on him, regarding this verse.
فِي قَوْلِهِ تَعَالَى {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا يَحِلُّ لَكُمْ أَنْ تَرِثُوا النِّسَاءَ كَرْهًا} [النساء 19] قَالَ كَانَ إِذَا تُوُفِّيَ الرَّجُلُ فِي الْجَاهِلِيَّةِ عَمَدَ حَمِيمُ الْمَيِّتِ إِلَى امْرَأَتِهِ فَأَلْقَى عَلَيْهَا ثَوْبًا فَيَرِثُ نِكَاحَهَا فَيَكُونُ هُوَ أَحَقُّ بِهَا مِنْ غَيْرِهِ فَأَنْزَلَ اللهُ هَذِهِ الْآيَةَ وَقَوْلُهُ {وَلَا تَعْضُلُوهُنَّ لِتَذْهَبُوا بِبَعْضِ مَا آتَيْتُمُوهُنَّ} [النساء 19] مِنَ الْمَهْرِ فَهُوَ الرَّجُلُ يَعْضِلُ امْرَأَتَهُ فَيَحْبِسُهَا وَلَا حَاجَةَ لَهُ فِيهَا إِرَادَةَ أَنْ تَفْتَدِيَ مِنْهُ فَذَلِكَ قَوْلُهُ {وَلَا تَعْضُلُوهُنَّ} [النساء 19] يَقُولُ وَلَا تَحْبِسُوهُنَّ {لِتَذْهَبُوا بِبَعْضِ مَا آتَيْتُمُوهُنَّ} [النساء 19] يَعْنِي مَا أَعْطَيْتُمُوهُنَّ {إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} [النساء 19] يَعْنِي الْعِصْيَانَ الْبَيِّنَ وَهُوَ النُّشُوزُ فَقَدْ أَحَلَّ اللهُ الضَّرْبَ وَالْهُجْرَانَ فَإِنْ أَبَتْ حَلَّتْ لَهُ الْفِدْيَةُ وَتَمَامُ هَذَا الْبَابِ يَرِدُ إِنْ شَاءَ اللهُ تَعَالَى فِي كِتَابِ الْقَسَمِ حَيْثُ نَقَلْنَا كَلَامَ الشَّافِعِيِّ رَحِمَهُ اللهُ فِي هَذِهِ الْآيَةِ
39.130 [Machine] Agency in marriage
٣٩۔١٣٠ بَابُ الْوَكَالَةِ فِي النِّكَاحِ
[Machine] The Messenger of Allah ﷺ said, "When the guardian marries them, then the first of them has the right, and when a man enters into a transaction with another man, the right belongs to the first of them."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا أَنْكَحَ الْوَلِيَّانِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا وَإِذَا بَايَعَ الرَّجُلُ بَيْعًا مِنَ الرَّجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا
[Machine] The Prophet ﷺ said, "When a guardian marries off a couple, the marriage is for the first of them. And when a man sells a possession between two men, it belongs to the first of them. This is the narration of the majority, and it is the preserved one." Al-Shafi'i, may Allah have mercy on him, said, "The marriage of two equal guardians cannot occur unless it is with the consent of both of them and with the delegation of authority from them, along with the delegation of authority from the Prophet ﷺ , such as the delegation of authority from 'Amr ibn 'Umayyah al-Damri who married Umm Habibah bint Abi Sufyan."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا أَنْكَحَ وَلِيَّانِ فَالنِّكَاحُ لِلْأَوَّلِ مِنْهُمَا وَإِذَا بَاعَ رَجُلٌ مَتَاعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا هَكَذَا رِوَايَةُ الْجَمَاعَةِ وَهُوَ الْمَحْفُوظُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ لَا يَكُونُ نِكَاحُ وَلِيَّيْنِ مُتَكَافِئًا حَتَّى يَكُونَ لِلْأَوَّلِ مِنْهُمَا إِلَّا بِوَكَالَةٍ مِنْهُمَا مَعَ تَوْكِيلِ النَّبِيِّ ﷺ عَمْرَو بْنَ أُمَيَّةَ الضَّمْرِيَّ فَزَوَّجَهُ أُمَّ حَبِيبَةَ بِنْتَ أَبِي سُفْيَانَ
[Machine] Amr ibn Umayyah al-Damri went to the Negus and married him to Umm Habiba bint Abu Sufyan, and he paid him four hundred dinars. It was narrated that he married Umm Kulthum bint Ali, the daughter of Umar ibn al-Khattab, and Ali said to Hasan and Husayn, "Marry your cousin." So they married her to him.
اللهِ ﷺ عَمْرَو بْنَ أُمَيَّةَ الضَّمْرِيَّ إِلَى النَّجَاشِيِّ فَزَوَّجَهُ أُمَّ حَبِيبَةَ بِنْتَ أَبِي سُفْيَانَ وَسَاقَ عَنْهُ أَرْبَعَمِائَةِ دِينَارٍ وَرُوِّينَا فِي تَزْوِيجِ أُمِّ كُلْثُومٍ بِنْتِ عَلِيٍّ مِنْ عُمَرَ بْنِ الْخَطَّابِ ؓ قَالَ فَقَالَ عَلِيٌّ لِحَسَنٍ وَحُسَيْنٍ ؓ زَوِّجَا عَمَّكُمَا فَزَوَّجَاهُ
39.131 [Machine] The unbeliever cannot be the guardian of a Muslim woman. Imam Al-Shafi'i, may Allah have mercy on him, said, "The Prophet ﷺ married the son of Sa'id bin al-'As to Umm Habibah bint Abi Sufyan, and Abu Sufyan was alive. This is because she was a Muslim and Sa'id bin al-'As was a Muslim. Abu Sufyan did not have guardianship over her, because Allah Almighty has severed guardianship between the Muslims and the polytheists.
٣٩۔١٣١ بَابُ لَا يَكُونُ الْكَافِرُ وَلِيًّا لِمُسْلِمَةٍ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ، وَقَدْ زَوَّجَ ابْنُ سَعِيدِ بْنِ الْعَاصِ النَّبِيَّ ﷺ أُمَّ حَبِيبَةَ بِنْتَ أَبِي سُفْيَانَ، وَأَبُو سُفْيَانَ حَيٌّ، لِأَنَّهَا كَانَتْ مُسْلِمَةً وَابْنُ سَعِيدٍ مُسْلِمٌ، وَلَمْ يَكُنْ لِأَبِي سُفْيَانَ فِيهَا وِلَايَةٌ، لِأَنَّ اللهَ تَعَالَى قَطَعَ الْوِلَايَةَ بَيْنَ الْمُسْلِمِينَ وَالْمُشْرِكِينَ
Hasanah is his mother. (Using translation from Abū Dāʾūd 2107)
أَنَّهَا كَانَتْ تَحْتَ عُبَيْدِ اللهِ بْنِ جَحْشٍ فَمَاتَ بِأَرْضِ الْحَبَشَةِ فَزَوَّجَهَا النَّجَاشِيُّ النَّبِيَّ ﷺ وَأَمْهَرَهَا عَنْهُ أَرْبَعَةَ آلَافٍ وَبَعَثَ بِهَا إِلَى رَسُولِ اللهِ ﷺ مَعَ شُرَحْبِيلَ ابْنِ حَسَنَةَ
[Machine] The sheikh, may Allah have mercy on him, is the son of her paternal cousin. Indeed, she is Umm Habiba bint Abi Sufyan ibn Harb ibn Umayyah. And Al-As is the son of Umayyah. It is said that Uthman ibn Affan, may Allah be pleased with him, is the one who married her.
الشَّيْخُ رَحِمَهُ اللهُ وَهُوَ ابْنُ ابْنِ عَمِّ أَبِيهَا فَإِنَّهَا أُمُّ حَبِيبَةَ بِنْتُ أَبِي سُفْيَانَ بْنِ حَرْبِ بْنِ أُمَيَّةَ وَالْعَاصُ هُوَ ابْنُ أُمَيَّةَ وَقَدْ قِيلَ إِنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ هُوَ الَّذِي وَلِيَ نِكَاحَهَا
أَنَّ فِيهِ اخْتِلَافًا ثَالِثًا
[Machine] "Allah is the guardian. Abu Abdullah al-Saffar narrated to us that Ahmad ibn Muhammad al-Birti narrated to us that Musa ibn Masud narrated to us that Ikrimah ibn Ammar narrated to us that Abu Abdullah narrated to us that Abu Abdullah ibn Ya'qub and Abu Amr al-Faqih said that Abdullah ibn Muhammad narrated to us that Al-Abbas ibn Abdil Azim al-Anbari and Ahmad ibn Yusuf said that Nadhr ibn Muhammad narrated to us that Ikrimah ibn Ammar narrated to us that Abu Zumayl narrated to me that Ibn Abbas said: 'The Muslims would not look at Abu Sufyan nor sit him down. So he said to the Prophet, ﷺ , 'O Prophet of Allah, I have three favors to ask from you.' He said, 'Yes?' He said, 'I have the best of the Arabs and the most beautiful of them, Umm Habiba bint Abi Sufyan. I want to marry her to you.' He said, 'Yes?' He said, 'And will you appoint Muawiyah as your scribe?' He said, 'Yes?' He said, 'And will you command me to fight against the disbelievers as I used to fight against the Muslims?' He said, 'Yes?' Abu Zumayl said, 'If he did not ask the Prophet for that, he would not have been granted it, because he would not ask for anything unless the Prophet would say yes.'"
اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ الصَّفَّارُّ ثنا أَحْمَدُ بْنُ مُحَمَّدٍ الْبِرْتِيُّ ثنا مُوسَى بْنُ مَسْعُودٍ ثنا عِكْرِمَةُ بْنُ عَمَّارٍ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ أنبأ أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ وَأَبُو عَمْرٍو الْفَقِيهُ قَالَا ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ ثنا الْعَبَّاسُ بْنُ عَبْدِ الْعَظِيمِ الْعَنْبَرِيُّ وَأَحْمَدُ بْنُ يُوسُفَ قَالَا ثنا النَّضْرُ بْنُ مُحَمَّدٍ ثنا عِكْرِمَةُ بْنُ عَمَّارٍ ثنا أَبُو زُمَيْلٍ حَدَّثَنِي ابْنُ عَبَّاسٍ ؓ قَالَ كَانَ الْمُسْلِمُونَ لَا يَنْظُرُونَ إِلَى أَبِي سُفْيَانَ وَلَا يُقَاعِدُونَهُ فَقَالَ لِلنَّبِيِّ ﷺ يَا نَبِيَّ اللهِ ثَلَاثٌ أُعْطِيتُهُنَّ قَالَ نَعَمْ قَالَ عِنْدِي أَحْسَنُ الْعَرَبِ وَأَجْمَلُهُنَّ أُمُّ حَبِيبَةَ بِنْتُ أَبِي سُفْيَانَ أُزَوِّجُكَهَا قَالَ نَعَمْ قَالَ وَمُعَاوِيَةُ تَجْعَلُهُ كَاتِبًا بَيْنَ يَدَيْكَ؟ قَالَ نَعَمْ قَالَ وَتُؤَمِّرُنِي حَتَّى أُقَاتِلَ الْكُفَّارَ كَمَا كُنْتُ أُقَاتِلُ الْمُسْلِمِينَ قَالَ نَعَمْ قَالَ أَبُو زُمَيْلٍ وَلَوْلَا أَنَّهُ طَلَبَ ذَلِكَ مِنَ النَّبِيِّ ﷺ مَا أَعْطَاهُ ذَلِكَ؛ لِأَنَّهُ لَمْ يَكُنْ يُسْأَلُ شَيْئًا إِلَّا قَالَ نَعَمْ
39.132 [Machine] The marriage of the two guardians
٣٩۔١٣٢ بَابُ إِنْكَاحِ الْوَلِيَّيْنِ
[Machine] The Messenger of Allah ﷺ said, "When the guardians arrange a marriage, the first has more right (to give consent)."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا أَنْكَحَ الْوَلِيَّانِ فَالْأَوَّلُ أَحَقُّ هَكَذَا
[Machine] The Prophet ﷺ said, "Whichever woman a wali (guardian) marries her, she belongs to the first of them."
قَالَ النَّبِيُّ ﷺ أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ مِنْهُمَا
The Prophet ﷺ said: Any woman who is married by two guardians (to two different men) belongs to the first woman who is married by two guardians (to two different men) belongs to the first of them and anything sold by a man to two persons belongs to the first of them. [Machine] The Messenger of Allah ﷺ said: "Whichever woman is married by two guardians, she belongs to the first one of them."
قَالَ رَسُولُ اللهِ ﷺ أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ مِنْهُمَا
