[Machine] The Prophet ﷺ said, "When a guardian marries off a couple, the marriage is for the first of them. And when a man sells a possession between two men, it belongs to the first of them. This is the narration of the majority, and it is the preserved one." Al-Shafi'i, may Allah have mercy on him, said, "The marriage of two equal guardians cannot occur unless it is with the consent of both of them and with the delegation of authority from them, along with the delegation of authority from the Prophet ﷺ , such as the delegation of authority from 'Amr ibn 'Umayyah al-Damri who married Umm Habibah bint Abi Sufyan."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا أَنْكَحَ وَلِيَّانِ فَالنِّكَاحُ لِلْأَوَّلِ مِنْهُمَا وَإِذَا بَاعَ رَجُلٌ مَتَاعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا هَكَذَا رِوَايَةُ الْجَمَاعَةِ وَهُوَ الْمَحْفُوظُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ لَا يَكُونُ نِكَاحُ وَلِيَّيْنِ مُتَكَافِئًا حَتَّى يَكُونَ لِلْأَوَّلِ مِنْهُمَا إِلَّا بِوَكَالَةٍ مِنْهُمَا مَعَ تَوْكِيلِ النَّبِيِّ ﷺ عَمْرَو بْنَ أُمَيَّةَ الضَّمْرِيَّ فَزَوَّجَهُ أُمَّ حَبِيبَةَ بِنْتَ أَبِي سُفْيَانَ
