39. Marriage (16/20)
[Machine] He ﷺ returned his daughter to Abu al-'As with a new dowry and a new marriage. And Abu Bakr ibn al-Harith told us, he said: Abu al-Hasan al-Daraqutni al-Hafiz said, "This is not established, and Hajjaj is not relied upon." And the correct narration is the hadith of Ibn Abbas. And it was reported to me from Abu Isa al-Tirmidhi that he said, "I asked about it to al-Bukhari, may Allah have mercy on him, and he said, 'The hadith of Ibn Abbas is more authentic in this regard than the hadith of Amr ibn Shu'ayb.' And Abu 'Ubayd reported from Yahya ibn Sa'id al-Qattan that Hajjaj did not hear it from Amr, and that it is from the hadith of Muhammad ibn Abdullah al-Arzami from Amr. So this is a position that no one pays attention to, knowing what the hadith is."
[Machine] A woman embraced Islam during the time of the Prophet Muhammad ﷺ and got married. Her husband went to the Messenger of Allah ﷺ and said, "I have embraced Islam along with her, and she knows about my Islam. So the Messenger of Allah ﷺ took her away from her other husband and returned her to her first husband. And the Sheikh, Imam Abu Tayyib Sahl ibn Muhammad ibn Sulayman mentioned to us that Muhammad ibn Abdullah ibn Ali Ad-Daqqaq narrated to us, that Muhammad ibn Ibrahim ibn Saeed Al-Abdi narrated to us, who narrated from Abu Ja'far An-Nufayli, who narrated from Makhlad ibn Yazid, who narrated from Israil, who mentioned it in this way.
[Machine] That the aunt of Abdullah bin Al-Harith embraced Islam, migrated, and got married. Her husband had already embraced Islam before her. The Messenger of Allah ﷺ returned her to her former husband. Allah knows best.

[Machine] Aisha, the wife of the Prophet pbuh, informed him that in the time of ignorance (pre-Islamic period), marriage used to have four steps. One of these steps is when a man proposes to another man's wife and seeks her consent, then he marries her. The hadith mentioned this as previously stated.
[Machine] The Messenger of Allah, ﷺ , said, "Nothing from the practices of the ignorant era has affected me except for marriage, which is considered a marriage in Islam."
[Machine] His father mentioned regarding the saying of Allah, "There has certainly come to you a Messenger from among yourselves. Grievous to him is what you suffer; [he is] concerned over you and to the believers is kind and merciful." (Surah At-Tawbah, 9:128). He said, "He did not experience anything from the pre-Islamic ignorance (jahiliyyah) customs." The Prophet ﷺ also said, "I have come out of a marriage without adultery." The scholar (may Allah have mercy on him) said, "His parents were polytheists, as evident from the evidence."
[Machine] To the Messenger of Allah ﷺ , he said, "O Messenger of Allah, where is my father?" He ﷺ said, "He is in the Hellfire." He ﷺ called him again and said, "Indeed, my father and your father are in the Hellfire."
[Machine] The Messenger of Allah ﷺ said, "I sought permission from my Lord to seek forgiveness for my mother, but He did not grant me permission. And I sought permission from Him to visit her grave, so He granted me permission."

[Machine] To tighten his waist wrap around his lower garment and then approach her, if he so wishes. This narration is regarded as stopped, and it has been reported as both marfu' (attributed) and mawquf (stopped) from the Prophet ﷺ.
[Machine] A man asked the Messenger of Allah ﷺ , "What can I do with my wife when she is on her period?" The Messenger of Allah ﷺ replied, "Cover her with a cloth and have relations with her from behind." This hadith is reported in Sahih al-Bukhari.
[Machine] The Prophet ﷺ was asked what is permissible for a man when it comes to a woman, meaning a menstruating woman. He said, "Whatever is above the waist is connected (allowed), and we have narrated in the book of purification two other ways that confirm this narration."
[Machine] "Aisha, the wife of the Prophet Muhammad ﷺ , narrated that she was with the Messenger of Allah ﷺ in one blanket. Then, she sneakily left and the Prophet ﷺ asked her, 'What is wrong with you?' She replied, 'I needed to go to the restroom.' He told her, 'Tie your waist wrapper securely and then return.'"
[Machine] The Prophet Muhammad ﷺ used to instruct his wife, when she was menstruating, if he wished to have sexual relations with her, to wear an izar (a loose garment worn by women) to cover herself.
39.191 [Machine] The man goes around his women in one washing when he marries them or his maids.
[Machine] That the Messenger of Allah ﷺ used to visit his wives with a single washing.
[Machine] The Prophet, ﷺ , used to perform a ritual cleansing for his wives in one washing. Ma'mar said: "But we have no doubt that he, peace and blessings be upon him, would perform ablution between that, and Allah knows best about the correctness."
39.192 [Machine] The person who is in a state of sexual impurity performs ablution every time they want to engage in sexual intercourse or want to return [to their spouse]. Imam Shafi'i, may Allah have mercy on him, said: There is a narration concerning this, even though it is something that cannot be proven.
[Machine] The Messenger of Allah ﷺ said: "When one of you goes to his family and then wants to return, let him perform ablution."
[Machine] that the Prophet ﷺ said: "When one of you wants to return, let him perform ablution, for it will refresh him." If Al-Shafi'i (may Allah have mercy on him) wanted this hadith, this is its chain of narration, and it is authentic. Perhaps he did not stop at its chain of narration, and perhaps he intended...
[Machine] The Messenger of Allah ﷺ said, "When you come to your family and intend to return, then perform ablution for prayer like this."
[Machine] If he returns, he should wash his private parts. This is the most correct opinion according to Al-Layth ibn Abi Sulaim. However, it is not used as evidence. In the hadith of Abu Sa'eed, it is sufficient. And there is a hadith narrated in between them regarding washing which is not strong.
[Machine] That the Messenger of Allah ﷺ went around his wives and performed ablution (washing) at each one of them. So I said, "O Messenger of Allah, couldn't you have made it one washing?" He said, "This is purer, cleaner, and more pleasant. And Allah knows best."
39.193 [Machine] The man wants to sleep.
[Machine] Umar ibn Al-Khattab narrated that he used to experience seminal emission during the night, so the Messenger of Allah ﷺ advised him, "Perform ablution and wash your private parts, then sleep."
[Machine] O Messenger of Allah, what should I do if I experience sexual impurity during the night? The Prophet replied, "Wash your private parts, perform ablution, and then go to sleep."
[Machine] The Prophet Muhammad ﷺ used to perform ablution when he was in a state of major impurity (junub) before sleeping or eating.
39.194 [Machine] Concealment during sexual intercourse
[Machine] The Messenger of Allah ﷺ said, "When one of you comes to his family, he should cover himself and not undress like the undressing of two camels. It should not be too hard on him and he should not be too weak. Even if he cannot be firm, he should at least be praised in his character." Al-Shafi'i may Allah have mercy on him said, "I hate that he steps on it and the other looks on, because it is not a matter of covering and it is not praiseworthy in character. It does not resemble good companionship. He was commanded to maintain good companionship."
[Machine] Abu Ubaid said, may Allah have mercy on him, in the Hadith of Al-Hasan about a man who has intercourse with one wife while the other listens. He said that they disliked eavesdropping. Abbad ibn Al-Awwam narrated to us, from Ghalib Al-Qattan, from Al-Hasan that Abu Ubaid said, "Al-Wajs is the hidden voice, and it has been narrated in similar cases of dislike that it is even more severe than that. It applies to certain ways of speaking, even to an infant in the cradle." 14096 He said, "As for the Hadith of Ibn Abbas that he used to sleep between two slave girls, I heard Abbad ibn Al-Awwam narrating it from Abu Shaybah, saying, 'I heard Ikrimah narrating it from Ibn Abbas, that he used to sleep between two slave girls.' Abu Ubaid said, 'And this, in my opinion, is about sleeping, not intercourse.'"
39.195 [Machine] What is disliked about mentioning a man's family?
[Machine] The Messenger of Allah ﷺ said, "Verily, the greatest trust with Allah on the Day of Resurrection is a man who goes to a woman, and she goes to him, and then he exposes her secret."
[Machine] I came to Abu Hurairah in the city and I did not see a man from the companions of the Messenger of Allah who is more attentive or more generous to a guest than him. I heard him say, "I stood up with the Messenger of Allah until he came to the place where he prayed. And behind him were rows of men and rows of women, or rows of women and rows of men. He faced us and said, 'If the devil distracts me in my prayer, let the men say Subhan Allah and let the women clap.' The Messenger of Allah prayed and did not forget anything from his prayer. He said, 'Your gatherings, your gatherings. Among you is a man who hides behind the covering of Allah when he comes to his family, closing the door and throwing his cloak over them.' They said, 'We do that.' He then sat down and said, 'I did such and such to my wife.' Everyone became silent. He said, 'Is there any among you who does this?' They remained silent. A young girl had crouched on her knees and he said, 'This is an example of someone who does that.' The Messenger of Allah said, 'By Allah, they are talking to each other, and indeed, they are talking to each other.' He said, 'Do you know the example of someone who does that? The example of a male and a female devil meeting each other on a pathway. They satisfy their needs, and people are watching. He said, 'Behold, no man or woman approaches another except for a child or a parent.' The third said, 'I forgot it.' Then he said, 'The scent of a man is found in his fragrance, and his color is not exposed. Behold, the goodness of women is found in their appearance and their scent is not detected.'

[Machine] When a man came to his wife in a state of impurity, the child born as a result was brownish. This was mentioned to the Prophet ﷺ , and then the verse was revealed: "Your wives are a tilth for you, so go to your tilth when or how you will" (Quran 2:223).
When a man has intercourse with his wife through the vagina but being on her back. the child will have squint, so the verse came down:" Your wives are your tilth; go then unto your tilth as you may desire" (ii. 223) (Using translation from Muslim 1435a)
[Machine] The Jews only consider it a sexual act when a man approaches his wife from behind and Allah revealed the verse, "{Your wives are a place of sowing of seed for you, so come to your place of cultivation however you wish.}" [Al-Baqarah 2:223] whether it is from the front or from behind, and they only engage in it in the missionary position.
[Machine] The Jews said, "When a man approaches his wife from behind, the child is born more handsome." Then came down the verse, "Your wives are a tilth for you, so approach your tilth when or how you will" [Al-Baqarah 2:223]. If Allah wills, the child will be born more handsome, and if He wills, otherwise. However, this is only in regards to the choice for entering from the front or back. This is the wording of the Hadith of Abu Qudamah.
[Machine] About Umm Salamah, the Prophet's wife, she said: When the immigrants arrived in Madinah, they would marry among the Ansar (the residents of Madinah who welcomed and supported the Prophet). The Ansar women would agree to this, but one of them asked her husband for permission to ask the Prophet about it. She went to him but felt shy to speak, so he called her and recited to her the verse: "Your wives are a place of sowing of seed for you, so come to your place of cultivation however you wish"
[Machine] From Umm Salamah, the wife of the Prophet ﷺ , it is narrated that a woman entered upon her and asked the Prophet ﷺ about a man who approaches a woman, both of them facing each other, and the Prophet ﷺ entered and felt shy. Umm Salamah informed him about the woman, and he said, "Send her back to me. Your women are like a fertile land for you, so approach your land however you wish." Then he recited the verse, "Your women are a tilth for you, so go to your tilth as you will" [Qur'an 2:223], meaning they can approach from any direction through one passage.
[Machine] Indeed, Ibn 'Umar and Allah forgive him and his. This village belonged to the Ansar, who were polytheists along with the Jews, who were people of the book. They used to consider themselves superior and thus many would imitate their actions. It was the custom of the people of the book that they would not approach women except in a certain manner, as a means of concealing the woman. This village, being from the Ansar, adhered to this practice. They would explain and extensively enjoy the company of women, engaging with them face to face, from behind, and lying down. When the Muhajireen arrived in Medina, a man from among them married a woman from the Ansar and began to engage in these practices with her. She objected and said, "We were used to being approached in a certain way, so adhere to that or keep away from me until you seek the permission of their Prophet." This was conveyed to the Prophet ﷺ , and Allah revealed the following verse: "Your wives are a place of cultivation for you, so approach your cultivation however you wish." (Surah Al-Baqarah 2:223) This refers to the place of childbirth. This narration is also reported by 'Abdul Rahman ibn Muhammad Al-Muharibi from Muhammad ibn Ishaq, who heard it from Aban ibn Salih, who mentioned it in a similar manner, adding, "After it is in the womb."
[Machine] Regarding this verse {Your wives are a place of sowing of seed for you, so come to your place of sowing however you wish} [Surah Al-Baqarah 223], it was said, "Come to them from where they are forbidden to you" which means during menstruation and postpartum bleeding.
[Machine] In His saying, Almighty Allah says, "{Your women are a tilth for you, so go to your tilth when and how you will}" [Surah Al-Baqarah 2:223]. Abu Hurairah narrated that Abdullah bin Amr bin Al-As (May Allah be pleased with him) said: "The Prophet ﷺ said:
'Sex is permissible only in one of two places, namely the vagina and the anus.'
[Muslim]. In another narration it is added: 'So long as the semen is discharged by the husband in the womb and it has not been transmitted through a third orifice.'"
[Machine] In His saying, "Visit your tilth as you wish" [Al-Baqarah 2:223], it means by "tilth" the private parts. He says, "Approach it however you want, from the front or from behind, as long as you do not enter the private part from any other place." And His saying, "Wherever Allah has ordained for you" [Al-Baqarah 2:222].
[Machine] A man asked the Prophet ﷺ about having intercourse with women from behind or a man having intercourse with his wife from behind. The Prophet ﷺ said, "It is permissible." When the man left, he called him back or ordered someone to call him back, and he said, "How did you say it? In which of the two habitations? Or in which of the two cave-like structures? Or in which of the two orifices?" Meaning, from behind in the front orifice is fine, but from behind in the back orifice is not permissible. Indeed, Allah is not too shy to tell the truth. Do not have intercourse with women from behind." Al-Shafi'i said, "May Allah have mercy on my blind uncle, Thiqah, and 'Abdullah Ibn 'Ali, who is trustworthy. Muhammad informed me about it from Al-Ansari Al-Muaddith, who praised Khuzaymah, who is known to be a knowledgeable person. I don't dismiss it, rather I prohibit it." 14113 Al-Hafiz Abu Abdullah Abu Abdullah Ibn Muhammad Al-Saffar narrated to us that Hamad Ibn Muhammad Al-Shafi'i narrated to us that my blind uncle, Ibrahim Ibn Muhammad Ibn Al-Abbas, narrated to us that my grandfather, Muhammad Ibn 'Ali, said, "I was with Muhammad Ibn Ka'b Al-Quradhi when a man came to him and said, 'O Abu 'Amr, what do you say about having intercourse with a woman from behind?' He said, 'This is a Sheikh from the Quraysh, ask him.' He meant 'Abdullah Ibn 'Ali Ibn Al-Sahib. He said, 'I have never heard anything about it.' The man said, "O Allah, it is disgusting even if it is permissible." Then 'Abdullah Ibn 'Ali Ibn Al-Sahib met 'Amr Ibn Uhayhah Ibn Al-Julah and said to him, 'Have you heard anything about having intercourse with a woman from behind?' He said, 'I bear witness that I heard Khuzaymah Ibn Thabit Al-Ansari, whose testimony the Messenger of Allah valued as equivalent to the testimony of two men, say that a man came to the Prophet ﷺ and mentioned the rest of the Hadith similarly.' As for the chain of narrators of Abdullah Ibn 'Ali Ibn Al-Sahib, there is another chain of narrators."

That the Messenger of Allah ﷺ said: “Allah is not too shy to tell the truth,” three times. “Do not have intercourse with women in their buttocks.” (Using translation from Ibn Mājah 1924)

[Machine] That the Messenger of Allah, ﷺ , said: "Indeed, Allah does not shy away from the truth. Do not have sexual intercourse with women from behind." Ibn al-Haad shortened it, and Abdul Malik ibn Amr did not mention it in his narration. Ibn Uyaynah narrated it from Ibn al-Haad and made a mistake in its chain of narration.

(14118) Abu Tahir Al-Faqih informed us, Abu Al-Abbas Muhammad ibn Ya'qub narrated, "I heard Muhammad ibn Abdullah ibn Abd al-Hakam saying, 'I heard Ash-Shafi'i, may Allah have mercy on him, saying, 'Sufyan made a mistake in the hadith of Ibn Al-Had.
