39. Marriage (20/20)
٣٩۔ كِتَابُ النِّكَاحِ ص ٢٠
[Machine] She has the option as long as her property is not touched upon by her debtor in his narration, but if he touches upon it, she has no choice.
لَهَا الْخِيَارَ مَا لَمْ يَمَسَّهَا زَادَ مَالِكٌ فِي رِوَايَتِهِ فَإِنْ مَسَّهَا فَلَا خِيَارَ لَهَا
[Machine] So she sent a message to Hafsah, the Prophet's wife, and Hafsah called me and said, "I have some news to tell you, and I do not like that you do anything unless your husband agrees." I said, "So I left him." This hadith from Ibn Bukayr was also narrated by Abu Qilaba, who mentioned that Umar ibn al-Khattab said, "When a woman is called by her husband, she has no choice. And Allah knows best what is correct."
فَأَرْسَلَتْ إِلَى حَفْصَةَ زَوْجِ النَّبِيِّ ﷺ فَدَعَتْنِي فَقَالَتْ إِنِّي مُخْبِرَتُكِ خَبَرًا وَلَا أُحِبُّ أَنْ تَصْنَعِي شَيْئًا إِنَّ أَمْرَكِ بِيَدِكِ مَا لَمْ يَمَسَّكِ زَوْجُكِ قَالَتْ فَفَارَقْتُهُ ثَلَاثًا لَفْظُ حَدِيثِ ابْنِ بُكَيْرٍ وَيُذْكَرُ عَنْ أَبِي قِلَابَةَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَالَ إِذَا جَامَعَهَا فَلَا خِيَارَ لَهَا وَاللهُ أَعْلَمُ بِالصَّوَابِ
39.212 [Machine] The heading translates to: "Mu'taqah is afflicted by her husband, so she accused ignorance." "Do not include the prompt answer.
٣٩۔٢١٢ بَابُ الْمُعْتَقَةِ يُصِيبُهَا زَوْجُهَا فَادَّعَتِ الْجَهَالَةَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي الْقَدِيمِ: فِيهَا قَوْلَانِ أَحَدُهُمَا تَحْلِفُ وَيَكُونُ لَهَا الْخِيَارُ وَهُوَ أَحَبُّ إِلَيْنَا , وَالْقَوْلُ الْآخَرُ لَا خِيَارَ لَهَا
[Machine] She has the choice, as she is accused and not believed in what she claimed out of ignorance, and she has no choice after she is touched. And in the hadith of Ibn Jurayj from Ataa ibn Abi Rabah, if it happens to her and she does not know, then she has the choice when she finds out. And Al-Shafi'i narrated in Al-Qadim from Ismail ibn 'Ulayyah from Yunus from Al-Hasan that he said about the slave woman that she is freed and then her husband covers her before she is given the choice. He said she is asked if she did not know that she has the choice, then she is given the choice after that. And Allah knows best.
أَنَّ لَهَا الْخِيَارَ فَإِنَّهَا تُتَّهَمُ وَلَا تُصَدَّقُ بِمَا ادَّعَتْ مِنَ الْجَهَالَةِ وَلَا خِيَارَ لَهَا بَعْدَ أَنْ يَمَسَّهَا وَفِي حَدِيثِ ابْنِ جُرَيْجٍ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ إِذَا وَقَعَ عَلَيْهَا وَلَمْ تَعْلَمْ فَلَهَا الْخِيَارُ إِذَا عَلِمَتْ وَرَوَى الشَّافِعِيُّ فِي الْقَدِيمِ عَنْ إِسْمَاعِيلَ ابْنِ عُلَيَّةَ عَنْ يُونُسَ عَنِ الْحَسَنِ أَنَّهُ قَالَ فِي الْأَمَةِ تُعْتَقُ فَيَغْشَاهَا زَوْجُهَا قَبْلَ أَنْ تُخَيَّرَ قَالَ تُسْتَحْلَفُ أَنَّهَا لَمْ تَعْلَمْ أَنَّ لَهَا الْخِيَارَ ثُمَّ تُخَيَّرُ بَعْدَ ذَلِكَ وَاللهُ أَعْلَمُ
39.213 [Machine] Moaqqat is choosing divorce and has not been touched, so it has no friendship." Said Al-Shafi'i, may Allah have mercy on him: "Because divorce came from her side, not from the husband's side.
٣٩۔٢١٣ بَابُ الْمُعْتَقَةِ تَخْتَارُ الْفِرَاقَ وَلَمْ تُمَسَّ فَلَا صَدَاقَ لَهَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِأَنَّ الْفِرَاقَ جَاءَ مِنْ قِبَلِهَا لَا مِنْ قِبَلِ الزَّوْجِ
[Machine] He entered her choice, so there is nothing for her that cannot be met by her own self and her wealth, and Allah knows best, and with Him is success.
يُدْخَلَ بِهَا فَاخْتَارَتْ نَفْسَهَا فَلَا شَيْءَ لَهَا لَا يَجْتَمِعُ عَلَيْهِ أَنْ تَذْهَبَ نَفْسُهَا وَمَالُهُ وَاللهُ أَعْلَمُ وَبِهِ التَّوْفِيقُ
39.214 [Machine] The deadline of the eyes
٣٩۔٢١٤ بَابُ أَجَلِ الْعِنِّينِ
[Machine] He said that in 'in' it is delayed for a year. If he is capable of fulfilling it, then they stay together, and if not, they separate from each other. She receives the dowry and has the waiting period. The sheikh said, may Allah have mercy on him, this is in accordance with his saying that solitude determines the dowry and necessitates the waiting period. Ma'mar narrated it from Ibn al-Musayyib from 'Umar except for this addition, and Ibn Abi Layla narrated it from al-Sha'bi from 'Umar, stating that it was transmitted that he used to delay it for a year and he said about it, "I do not know it except from the day it is presented to the Sultan."
أَنَّهُ قَالَ فِي الْعِنِّينِ يُؤَجَّلُ سَنَةً فَإِنْ قَدِرَ عَلَيْهَا وَإِلَّا فُرِّقَ بَيْنَهُمَا وَلَهَا الْمَهْرُ وَعَلَيْهَا الْعِدَّةُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ هَذَا عَلَى قَوْلِهِ إِنَّ الْخَلْوَةَ تُقَرِّرُ الْمَهْرَ وَتُوجِبُ الْعِدَّةَ وَرَوَاهُ مَعْمَرٌ عَنِ ابْنِ الْمُسَيِّبِ عَنْ عُمَرَ دُونَ هَذِهِ الزِّيَادَةِ وَرَوَاهُ ابْنُ أَبِي لَيْلَى عَنِ الشَّعْبِيِّ عَنْ عُمَرَ ؓ مُرْسَلًا أَنَّهُ كَانَ يُؤَجِّلُ سَنَةً وَقَالَ فِيهِ لَا أَعْلَمُهُ إِلَّا مِنْ يَوْمِ يُرْفَعُ إِلَى السُّلْطَانِ
[Machine] It is postponed for a year, and if it comes to it, otherwise they will be separated.
يُؤَجَّلُ سَنَةً فَإِنْ أَتَاهَا وَإِلَّا فُرِّقَ بَيْنَهُمَا
يُؤَجَّلُ سَنَةً
الْعِنِّينُ يُؤَجَّلُ سَنَةً
سُفْيَانُ وَمَالِكٌ مِنْ يَوْمِ تُرَافِعُهُ
[Machine] That his wife comes and he postpones her for a year.
أَنْ يَأْتِيَ امْرَأَتَهُ فَأَجَّلَهُ سَنَةً
[Machine] In the eye, a year is postponed, and if he enters it, otherwise it is separated between them.
فِي الْعِنِّينِ يُؤَجَّلُ سَنَةً فَإِنْ دَخَلَ بِهَا وَإِلَّا فُرِّقَ بَيْنَهُمَا
[Machine] About Ruqayn, she said to you, "You are Abu Nu'man" and he said, "He is Abu Talq." Sufyan laughed and said, "I was with Shu'bah at Ruqayn's place when a man, who is called Abu Talq, son of Abu Nu'man, passed by. Ruqayn said, 'I heard Abu Abu Talq's father.' So he went to Shu'bah, Abu Abu Talq, and said, 'Abu Talq, narrate to us this view from Sa'id ibn al-Musayyib, 'Ata' ibn Abi Rabah, Al-Hasan al-Basri, and Ibrahim al-Nakha'i.'"
عَنِ الرُّكَيْنِ تَقُولُ أَنْتَ أَبُو النُّعْمَانِ وَهُوَ يَقُولُ هُوَ أَبُو طَلْقٍ فَضَحِكَ سُفْيَانُ وَقَالَ كُنْتُ أَنَا وَشُعْبَةُ عِنْدَ الرُّكَيْنِ فَمَرَّ ابْنٌ لِأَبِي النُّعْمَانِ يُقَالُ لَهُ أَبُو طَلْقٍ فَقَالَ الرُّكَيْنُ سَمِعْتُ أَبَا أَبِي طَلْقٍ فَذَهَبَ عَلَى شُعْبَةَ أَبَا أَبِي طَلْقٍ فَقَالَ أَبُو طَلْقٍ وَرُوِّينَا هَذَا الْمَذْهَبُ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَعَطَاءِ بْنِ أَبِي رَبَاحٍ وَالْحَسَنِ الْبَصْرِيِّ وَإِبْرَاهِيمَ النَّخَعِيِّ
[Machine] A beautiful woman came to Ali and said, "O Leader of the Believers, do you have a woman who is neither widowed nor married?" He understood what she was saying, so he brought her husband. It turned out that he was the leader of his people. Ali asked her husband, "What do you say about what she is saying?" He replied, "She is not telling the truth." Ali asked, "Is there anything else behind this?" He replied, "No." Ali asked, "Is there any magic involved?" He replied, "No, there is no magic involved." Ali said, "You are doomed if you are lying and causing harm. I hate to separate you two." Shu'bah narrated from Abu Ishaq, and he added, "Her husband came after her, an elderly man leaning on a cane and added, 'Fear Allah and be patient.'" Abu Abdullah Al-Hafiz narrated from Abu Bakr Muhammad bin Ahmad bin Balawayh, who informed him that Muhammad bin Yunus narrated from Rawh, who narrated from Shu'bah and mentioned the story. Al-Shafi'i, may Allah have mercy on him, mentioned this Hadith in the Sunan of Harmala. If this Hadith was proven to be from Ali, there would be no difference of opinion with Umar, because it could be that he had intimacy with her and then reached this age where he could not have intimacy anymore. He continued speaking until he said, "Even though he knows that Han'is bin Han'is is not known, and that this Hadith is among the Hadith that scholars do not consider authentic because of their ignorance of Han'is bin Han'is."
جَاءَتِ امْرَأَةٌ إِلَى عَلِيٍّ ؓ حَسْنَاءُ جَمِيلَةٌ فَقَالَتْ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي امْرَأَةٍ لَا أَيِّمٌ وَلَا ذَاتُ زَوْجٍ فَعَرَفَ مَا تَقُولُ فَأَتَى بِزَوْجِهَا فَإِذَا هُوَ سَيِّدُ قَوْمِهِ فَقَالَ مَا تَقُولُ فِيمَا تَقُولُ هَذِهِ قَالَ هُوَ مَا تَرَى عَلَيْهَا قَالَ شَيْءٌ غَيْرَ هَذَا قَالَ لَا قَالَ وَلَا مِنْ آخِرِ السَّحَرِ؟ قَالَ وَلَا مِنْ آخِرِ السَّحَرِ قَالَ هَلَكْتَ وَأَهْلَكْتَ وَإِنِّي لَأَكْرَهُ أَنْ أُفَرِّقَ بَيْنَكُمَا 14299 وَرَوَاهُ شُعْبَةُ عَنْ أَبِي إِسْحَاقَ بِمَعْنَاهُ قَالَ وَجَاءَ زَوْجُهَا يَتْلُوهَا مِنْ بَعْدِهَا شَيْخٌ عَلَى عَصًا وَزَادَ وَاتَّقِي اللهَ وَاصْبِرِي أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو بَكْرٍ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ بَالَوَيْهِ أنبأ مُحَمَّدُ بْنُ يُونُسَ ثنا رَوْحٌ ثنا شُعْبَةُ فَذَكَرَهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي سُنَنِ حَرْمَلَةَ هَذَا الْحَدِيثُ لَوْ كَانَ يَثْبُتُ عَنْ عَلِيٍّ ؓ لَمْ يَكُنْ فِيهِ خِلَافٌ لِعُمَرَ ؓ لِأَنَّهُ قَدْ يَكُونُ أَصَابَهَا ثُمَّ بَلَغَ هَذَا السِّنَّ فَصَارَ لَا يُصِيبُهَا ثُمَّ سَاقَ الْكَلَامَ إِلَى أَنْ قَالَ مَعَ أَنَّهُ يَعْلَمُ أَنَّ هَانِئَ بْنَ هَانِئٍ لَا يُعْرَفُ وَأَنَّ هَذَا الْحَدِيثَ عِنْدَ أَهْلِ الْعِلْمِ بِالْحَدِيثِ مِمَّا لَا يُثْبِتُونَهُ لِجَهَالَتِهِمْ بِهَانِئِ بْنِ هَانِئٍ
[Machine] "He (the teacher) postpones the lesson for a year. If he (the student) attends, then they continue, but if not, they separate. Abu Abdullah al-Hafiz informed me of this by granting permission. Abu al-Walid narrated to us, from al-Husayn ibn Sufyan, from Abu Bakr, from Abu Khalid, from Muhammad ibn Ishaq, and he mentioned it. With the help of Allah, and Allah knows best."
يُؤَجَّلُ الْعِنِّينُ سَنَةً فَإِنْ وَصَلَ وَإِلَّا فُرِّقَ بَيْنَهُمَا أَنْبَأَنِيهِ أَبُو عَبْدِ اللهِ الْحَافِظُ إِجَازَةً ثنا أَبُو الْوَلِيدِ ثنا الْحُسَيْنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرٍ ثنا أَبُو خَالِدٍ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ فَذَكَرَهُ وَبِاللهِ التَّوْفِيقُ وَاللهُ أَعْلَمُ
39.215 [Machine] The couple disagrees on the injury, so the saying becomes his saying if he is innocent. Imam Shafi'i, may Allah have mercy on him, said: because she wants to dissolve their marriage and he has the right to take an oath.
٣٩۔٢١٥ بَابُ الزَّوْجَانِ يَخْتَلِفَانِ فِي الْإِصَابَةِ فَيَكُونُ الْقَوْلُ قَوْلَهُ إِنْ كَانَ ثَيِّبًا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِأَنَّهَا تُرِيدُ فَسْخَ نِكَاحِهِ , وَعَلَيْهِ الْيَمِينُ
[Machine] 'Aisha had a green veil on her head. Her husband Ali saw it and struck her with his whip. Then the Messenger of Allah ﷺ entered, and 'Aisha told him about what had happened. She said, "The Muslim women do not undergo such treatment from their husbands." She also said to the one who had whipped her, "Your whip is greener than my veil." 'Ikrimah said, "Women support each other." Then the man came and 'Aisha asked, "What does he have with him that would make him more important to me than this?" She pointed to the edge of her garment. The man said, "By Allah, I only whip her lightly, just enough to show her who's in charge. But she is stubborn and wants to be respected. Her husband has already divorced her before." The Messenger of Allah ﷺ replied, "If what you say is true, then you are not lawful for him unless he tastes from your dowry and you taste from his."
عَلَى عَائِشَةَ ؓ وَعَلَيْهَا خِمَارٌ أَخْضَرُ فَشَكَتْ إِلَيْهَا زَوْجَهَا وَأَرَتْهَا ضَرْبًا بِجِلْدِهَا فَدَخَلَ رَسُولُ اللهِ ﷺ فَذَكَرَتْ لَهُ ذَلِكَ عَائِشَةُ ؓ وَقَالَتْ مَا تَلْقَاهُ نِسَاءُ الْمُسْلِمِينَ مِنْ أَزْوَاجِهِنَّ وَقَالَتْ لَلَّذِي يَجْلِدُهَا أَشَدُّ خُضْرَةً مِنْ خِمَارِهَا قَالَ عِكْرِمَةُ وَالنِّسَاءُ يَنْصُرُ بَعْضُهُنَّ بَعْضًا وَجَاءَ الرَّجُلُ فَقَالَتْ مَا الَّذِي عِنْدَهُ بِأَغْنَى عَنِّي مِنْ هَذَا وَقَالَتْ بِطَرَفِ ثَوْبِهَا فَقَالَ الرَّجُلُ يَا رَسُولَ اللهِ وَاللهِ إِنِّي لَأَنْفُضُهَا نَفْضَ الْأَدِيمِ وَلَكِنَّهَا نَاشِزٌ تُرِيدُ رِفَاعَةَ وَكَانَ رِفَاعَةُ زَوْجَهَا قَدْ طَلَّقَهَا قَبْلَ ذَلِكَ فَقَالَ إِنَّهُ إِنْ كَانَ كَمَا تَقُولِينَ لَمْ تَحِلِّي لَهُ حَتَّى يَذُوقَ مِنْ عُسَيْلَتِكِ وَتَذُوقِي مِنْ عُسَيْلَتِهِ
[Machine] That he should marry a woman from the treasury who has a share of beauty and religion. If she claims that he reaches her, then bring them together, and if she claims that he does not reach her, then separate between them. He said, "We will do so," and he brought them to him in the house. He said, "When the morning came, the people entered and she entered." So the man came with the trace of yellow on him, so he said to him, "What have you done?" He said, "I did, and by Allah, I even hit her on her garment from behind." He said, "And the woman came, pretending, so she stood beside him." He asked her, and his anger increased upon her, so she said, "Nothing." He said, "Doesn't it spread? Doesn't it come close?" She said, "Yes, but when he comes close, his evil comes." Samurah said, "Leave her alone, O Muhlukhdhdhah. This is the opinion of Mu'awiyah, and the man may be attached to one woman and not attached to another. Following the Sunnah is more important, and the Messenger of Allah ﷺ ruled by taking an oath on the one who denies, and the husband denies what he is accused of of infamy. We were narrated from 'Amr ibn Dinar that he said, "We still hear that if a woman suffers once, she has no speech or dispute." It was also narrated from Tawus, Al-Hasan, and Az-Zuhri.
أَنْ زَوِّجْهُ امْرَأَةً مِنْ بَيْتِ الْمَالِ لَهَا حَظٌّ مِنْ جَمَالٍ وَدِينٍ فَإِنْ زَعَمَتْ أَنَّهُ يَصِلُ إِلَيْهَا فَاجْمَعْ بَيْنَهُمَا وَإِنْ زَعَمَتْ أَنَّهُ لَا يَصِلُ إِلَيْهَا فَفَرِّقْ بَيْنَهُمَا قَالَ نَفْعَلُ وَأَتَى بِهِمَا عِنْدَهُ فِي الدَّارِ قَالَ فَلَمَّا أَصْبَحَ دَخَلَ النَّاسُ وَدَخَلَتْ قَالَ فَجَاءَ الرَّجُلُ عَلَيْهِ أَثَرُ صُفْرَةٍ فَقَالَ لَهُ مَا فَعَلْتَ قَالَ فَعَلْتُ وَاللهِ حَتَّى خَضْخَضْتُهُ فِي الثَّوْبِ مِنْ وَرَائِهَا قَالَ وَجَاءَتِ الْمَرْأَةُ مُتَقَنِّعَةً فَقَامَتْ عِنْدَ رِجْلِهِ قَالَ فَسَأَلَهَا وَعَظُمَ عَلَيْهَا فَقَالَتْ لَا شَيْءَ فَقَالَ أَمَا يَنْتَشِرُ أَمَا يَدْنُو قَالَتْ بَلَى وَلَكِنَّهُ إِذَا دَنَا جَاءَ شَرُّهُ فَقَالَ سَمُرَةُ خَلِّ سَبِيلَهَا يَا مُخَضْخَضُ هَذَا رَأْيٌ مِنْ مُعَاوِيَةَ ؓ وَقَدْ يَكُونُ الرَّجُلُ عِنِّينًا مِنِ امْرَأَةٍ وَلَا يَكُونُ عِنِّينًا مِنْ أُخْرَى وَمُتَابَعَةُ السُّنَّةِ أَوْلَى وَقَدْ قَضَى رَسُولُ اللهِ ﷺ بِالْيَمِينِ عَلَى مَنْ أَنْكَرَ وَالزَّوْجُ يُنْكِرُ مَا يُدَّعَى عَلَيْهِ مِنَ الْعُنَّةِ وَرُوِّينَا عَنْ عَمْرِو بْنِ دِينَارٍ أَنَّهُ قَالَ مَا زِلْنَا نَسْمَعُ أَنَّهُ إِذَا أَصَابَهَا مَرَّةً فَلَا كَلَامَ لَهَا وَلَا خُصُومَةَ وَرُوِيَ فِي ذَلِكَ عَنْ طَاوُسٍ وَالْحَسَنِ وَالزُّهْرِيِّ
39.216 [Machine] isolation
٣٩۔٢١٦ بَابُ الْعَزْلِ
[Machine] Narrated Jabir: We used to isolate ourselves and the Quran would be revealed.
عَنْ جَابِرٍ ؓ كُنَّا نَعْزِلُ وَالْقُرْآنُ يُنَزَّلُ
[Machine] We used to isolate ourselves during the time of the Messenger of Allah ﷺ. When the Messenger of Allah ﷺ learned about this, he did not prohibit us from doing so.
كُنَّا نَعْزِلُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَلَمْ يَنْهَنَا عَنْهُ
Jabir said “A man from the Ansar came to the Apostle of Allaah ﷺ and said “I have a slave girl and I have intercourse with her. But I dislike her to conceive. He replied “Withdraw your penis from her if you wish for what is decreed for her will come to her.” After a time the man came to him and said “The girl has become pregnant”. He said “I told you that what was decreed for her would come to her.” (Using translation from Abū Dāʾūd 2173)
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ لِي جَارِيَةً وَهِيَ خَادِمَتُنَا وَسَانِيَتُنَا وَأَنَا أَطُوفُ عَلَيْهَا وَأَنَا أَكْرَهُ أَنْ تَحْمِلَ فَقَالَ اعْزِلْ عَنْهَا إِنْ شِئْتَ فَإِنَّهُ سَيَأْتِيهَا مَا قُدِّرَ لَهَا فَلَبِثَ الرَّجُلُ ثُمَّ أَتَاهُ فَقَالَ إِنَّ الْجَارِيَةَ قَدْ حَمَلَتْ فَقَالَ أَخْبَرْتُكَ أَنَّهُ سَيَأْتِيهَا مَا قُدِّرَ لَهَا
[Machine] A man came to the Prophet ﷺ and said, "I have a wife and I am separating from her." The Prophet ﷺ said, "Surely, that is not to let go of the decree of Allah." The man left and only a short while passed before he came back to the Prophet ﷺ and said, "O Messenger of Allah, it seems that my wife is pregnant." The Messenger of Allah ﷺ said, "I am the slave of Allah and His Messenger."
أَنَّ رَجُلًا جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ لِي جَارِيَةً وَأَنَا أَعْزِلُ عَنْهَا فَقَالَ النَّبِيُّ ﷺ أَمَا إِنَّ ذَلِكَ لَا يَرُدُّ قَضَاءَ اللهِ فَذَهَبَ الرَّجُلُ فَلَمْ يَلْبَثْ إِلَّا يَسِيرًا ثُمَّ جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَشَعَرْتَ أَنَّ الْجَارِيَةَ حَمَلَتْ فَقَالَ رَسُولُ اللهِ ﷺ أَنَا عَبْدُ اللهِ وَرَسُولُهُ
[Machine] Narrated Abu Sa'id:
It was mentioned in the presence of the Prophet ﷺ regarding Al-Azl, and he said: "Why does anyone of you do that?" And he did not say: 'So one of you must not do it, as surely the Creator is the only one who creates a soul."
عَنْ أَبِي سَعِيدٍ ذُكِرَ عِنْدَ النَّبِيِّ ﷺ يَعْنِي الْعَزْلَ قَالَ وَلِمَ يَفْعَلُ ذَلِكَ أَحَدُكُمْ؟ وَلَمْ يَقُلْ فَلَا يَفْعَلْ أَحَدُكُمْ فَإِنَّهُ لَيْسَتْ مِنْ نَفْسٍ مَخْلُوقَةٍ إِلَّا اللهُ خَالِقُهَا
Muhairiz said “I entered the mosque and saw Abu Sa’id Al Khudri . I sat with him and asked about withdrawing the penis (while having intercourse). Abu Sa’id said We went out with the Apostle of Allaah ﷺ on the expedition to Banu Al Mustaliq and took some Arab women captive and we desired the women for we were suffering from the absence of our wives and we wanted ransom, so we intended to withdraw the penis (while having intercourse with the slave women). But we asked ourselves “can we draw the penis when the Apostle of Allaah ﷺ is among us before asking him about it? So we asked him about it. He said “it does not matter if you do not do it, for very soul that is to be born up to the Day of Resurrection will be born.” (Using translation from Abū Dāʾūd 2172)
أَنَّهُ قَالَ دَخَلْتُ الْمَسْجِدَ فَرَأَيْتُ أَبَا سَعِيدٍ الْخُدْرِيَّ ؓ فَجَلَسْتُ إِلَيْهِ فَسَأَلْتُهُ عَنِ الْعَزْلِ فَقَالَ أَبُو سَعِيدٍ خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ فِي غَزْوِ بَنِي الْمُصْطَلِقِ فَأَصَبْنَا سَبْيًا مِنْ سَبْيِ الْعَرَبِ فَاشْتَهَيْنَا النِّسَاءَ وَاشْتَدَّتْ عَلَيْنَا الْعُزْبَةُ وَأَحْبَبْنَا الْفِدَاءَ فَأَرَدْنَا أَنْ نَعْزِلَ فَقُلْنَا نَعْزِلُ وَرَسُولُ اللهِ ﷺ بَيْنَ أَظْهُرِنَا قَبْلَ أَنْ نَسْأَلَهُ عَنْ ذَلِكَ؟ فَسَأَلْنَاهُ عَنْ ذَلِكَ فَقَالَ مَا عَلَيْكُمْ أًلَّا تَفْعَلُوا ذَلِكَ مَا مِنْ نَسَمَةٍ كَائِنَةٍ إِلَى يَوْمِ الْقِيَامَةِ إِلَّا وَهِيَ كَائِنَةٌ
We took women captives, and we wanted to do 'azl with them. We then asked Allah's Messen- ger ﷺ about it, and he said to us: Verily you do it, verily you do it, verily you do it, but the soul which has to be born until the Day of judg- ment must be born. (Using translation from Muslim 1438c)
أَنَّهُ أَخْبَرَهُ أَنَّهُ قَالَ أَصَبْنَا سَبَايَا وَكُنَّا نَعْزِلُ فَسَأَلْنَا رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَقَالَ لَنَا وَإِنَّكُمْ لَتَفْعَلُونَ وَإِنَّكُمْ لَتَفْعَلُونَ وَإِنَّكُمْ لَتَفْعَلُونَ مَا مِنْ نَسَمَةٍ كَائِنَةٍ إِلَى يَوْمِ الْقِيَامَةِ إِلَّا وَهِيَ كَائِنَةٌ
[Machine] We asked the Messenger of Allah ﷺ about isolation, and he said, "There is no harm if you do not do it, as it is only a matter of fate."
سَأَلْنَا رَسُولَ اللهِ ﷺ عَنِ الْعَزْلِ فَقَالَ لَا عَلَيْكُمْ أَنْ لَا تَفْعَلُوا فَإِنَّمَا هُوَ الْقَدَرُ
The child does not come from all the liquid (sermen) and when Allah intends to create anything nothing can prevent it (from coming into existence). (Using translation from Muslim 1438k)
عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ؓ سَمِعْتُهُ يَقُولُ سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الْعَزْلِ فَقَالَ مَا مِنْ كُلِّ الْمَاءِ يَكُونُ الْوَلَدُ وَإِذَا أَرَادَ اللهُ خَلْقَ شَيْءٍ لَمْ يَمْنَعْهُ شَيْءٌ
[Machine] The concept of 'azl' (coitus interruptus) was mentioned in the presence of the Prophet ﷺ. He asked, "What is that?" They said, "It is when a man has a wife who breastfeeds and he dislikes that she becomes pregnant, or when he has a slave girl and he dislikes that she becomes pregnant from him." The Prophet ﷺ said, "It is not forbidden for you to do that, as it is a matter of fate."
ذُكِرَ الْعَزْلُ عِنْدَ النَّبِيِّ ﷺ قَالَ فَقَالَ وَمَا ذَاكُمْ؟ قَالُوا الرَّجُلُ تَكُونُ لَهُ الْمَرْأَةُ تُرْضِعُ فَيُصِيبُ مِنْهَا يَكْرَهُ أَنْ تَحْمِلَ أَوْ تَكُونَ لَهُ الْجَارِيَةُ فَيَكْرَهُ أَنْ تَحْمِلَ مِنْهُ فَقَالَ النَّبِيُّ ﷺ فَلَا عَلَيْكُمْ أَنْ لَا تَفْعَلُوا ذَاكُمْ فَإِنَّمَا هُوَ الْقَدَرُ
A man said: Messenger of Allah, I have a slave-girl and I withdraw the penis from her (while having intercourse), and I dislike that she becomes pregnant. I intend (by intercourse) what the men intend by it. The Jews say that withdrawing the penis (azl) is burying the living girls on a small scale. He (the Prophet) said: The Jews told a lie. If Allah intends to create it, you cannot turn it away. (Using translation from Abū Dāʾūd 2171)
يَا رَسُولَ اللهِ إِنَّ لِي جَارِيَةٌ وَأَنَا أَعْزِلُ عَنْهَا وَأَنَا أَكْرَهُ أَنْ تَحْمِلَ وَأَنَا أُرِيدُ مَا يُرِيدُ الرَّجُلُ وَإِنَّ الْيَهُودَ تَحَدَّثُ أَنَّ الْعَزْلَ الْمَوْؤُدَةُ الصُّغْرَى قَالَ كَذَبَتِ الْيَهُودُ لَوْ أَرَادَ اللهُ أَنْ يَخْلُقَهُ مَا اسْتَطَعْتَ أَنْ تَصْرِفَهُ
[Machine] The Messenger of Allah ﷺ said: "They claim that 'azl is the smallest form of contraception." He said, "The Jews have lied." It has been narrated that the permissibility of 'azl was reported from the common people among the companions.
رَسُولُ اللهِ ﷺ عَنِ الْعَزْلِ قَالُوا إِنَّ الْيَهُودَ تَزْعُمُ أَنَّ الْعَزْلَ هِيَ الْمَوْؤُدَةُ الصُّغْرَى قَالَ كَذَبَتِ الْيَهُودُ وَرُوِيَ فِي إِبَاحَةِ الْعَزْلِ عَنْ عَوَامِّ الصَّحَابَةِ ؓ
أَنَّ سَعْدًا كَانَ يَعْزِلُ عَنْهَا
أَنَّهُ كَانَ يَعْزِلُ
أَنَّهُ كَانَ يَعْزِلُ
[Machine] "Oh Abu Sa'id, I have neighbors who are not my wives. Some of them impress me more than my wives, and not all of them please me to the point of wanting to have relations with them. Shall I divorce them?" Zaid said, "You should ask Hajjaj for advice." I said, "May Allah forgive you, we only sit with you to learn from you." He said, "Then ask Hajjaj for advice." I said, "It is your field, if you wish, you can irrigate it, and if you wish, you can let it dry." He said, "I heard that from Zaid." So I said, "It is true."
يَا أَبَا سَعِيدٍ إِنَّ عِنْدِي جَوَارٍ لَيْسَ نِسَائِي اللَّاتِي أُكِنُّ بِأَعْجَبَ إِلِيَّ مِنْهُنَّ وَلَيْسَ كُلُّهُنَّ يُعْجِبُنِي أَنْ يَحْمِلْنَ مِنِّي أَفَأَعْزِلُ؟ فَقَالَ زَيْدٌ أَفْتِهِ يَا حَجَّاجُ قَالَ فَقُلْتُ غَفَرَ اللهُ لَكَ إِنَّمَا نَجْلِسُ إِلَيْكَ نَتَعَلَّمُ مِنْكَ قَالَ أَفْتِهِ قَالَ قُلْتُ هُوَ حَرْثُكَ إِنْ شِئْتَ سَقَيْتَهُ وَإِنْ شِئْتَ أَعْطَشْتَهُ قَالَ وَكُنْتُ أَسْمَعُ ذَلِكَ مِنْ زَيْدٍ فَقَالَ صَدَقَ
[Machine] The translation of the provided passage into English is as follows: "A human being shall not cause the death of another person. It is Allah who determines their creation. Your duty is to nurture them, whether you choose to quench their thirst or provide them with water."
مَا كَانَ ابْنُ آدَمَ لِيَقْتُلَ نَفْسًا قَضَى اللهُ خَلْقَهَا حَرْثُكَ إِنْ شِئْتَ عَطَّشْتَهُ وَإِنْ شِئْتَ سَقَيْتَهُ
[Machine] Go and ask the people, then come to me and inform me. They asked and informed him. Then he recited this verse: "And We certainly created man from an extract of clay. Then We made him a sperm-drop in a firm lodging" (Surah Al-Mu'minun, 13), until he finished the verse. Then he asked, "How can a person be created from something repulsive until he reaches this state of creation?"
اذْهَبُوا فَسَلُوا النَّاسَ ثُمَّ ائْتُونِي فَأَخْبِرُونِي فَسَأَلُوا فَأَخْبَرُوهُ فَتَلَا هَذِهِ الْآيَةَ {وَلَقَدْ خَلَقْنَا الْإِنْسَانَ مِنْ سُلَالَةٍ مِنْ طِينٍ ثُمَّ جَعَلْنَاهُ} [المؤمنون 13] حَتَّى فَرَغَ مِنَ الْآيَةِ ثُمَّ قَالَ كَيْفَ تَكُونُ مِنَ الْمَوْؤُدَةِ حَتَّى تَمُرَّ عَلَى هَذَا الْخَلْقِ
عَنْ جَارِيَةٍ لَهُ ثُمَّ يُرِيهَا
[Machine] The owner of this house used to hate him, meaning Ibn Mas'ud, and Allah knows best.
وَكَانَ صَاحِبُ هَذِهِ الدَّارِ يَكْرَهُهُ يَعْنِي ابْنَ مَسْعُودٍ وَاللهُ أَعْلَمُ
39.217 [Machine] Who said: "He isolates himself from the free woman with her consent, and from the slave woman without her consent, and what is narrated therein
٣٩۔٢١٧ بَابُ مَنْ قَالَ: يَعْزِلُ عَنِ الْحُرَّةِ بِإِذْنِهَا وَعَنِ الْجَارِيَةِ بِغَيْرِ إِذْنِهَا وَمَا رُوِيَ فِيهِ
It was narrated from ʼUmar bin al-Khattab that the Prophet ﷺ forbade 'azl (coitus interruptus) with a free woman, except with her permission. (Using translation from Aḥmad 212)
نَهَى رَسُولُ اللهِ ﷺ عَنْ عَزْلِ الْحُرَّةِ إِلَّا بِإِذْنِهَا
عَنِ ابْنِ عَبَّاسٍ مِثْلَهُ
الْأَمَةِ وَيَسْتَأْمِرُ الْحُرَّةَ
[Machine] Regarding the free woman, it is up to her discretion. As for the servant woman, that is for you.
عَنِ الْحُرَّةِ بِرِضَاهَا وَأَمَّا الْأَمَةُ فَذَاكَ إِلَيْكَ
39.218 [Machine] Who dislikes isolation and whose narrative differs from it, and what is narrated in his dislike?
٣٩۔٢١٨ بَابُ مَنْ كَرِهَ الْعَزْلَ وَمَنِ اخْتَلَفَتِ الرِّوَايَةُ عَنْهُ فِيهِ وَمَا رُوِيَ فِي كَرَاهِيَتِهِ
وَكَانَ سَعْدُ بْنُ أَبِي وَقَّاصٍ وَزَيْدُ بْنُ ثَابِتٍ ؓ يَعْزِلَانِ
[Machine] He punished his children by isolating them, meaning he forbid them from something. It was narrated to us by Ali ibn Abi Talib and Abdullah ibn Mas'ud that they disliked isolation. It was narrated to us by them that it is permissible.
يَضْرِبُ بَنِيهِ عَلَى الْعَزْلِ أَيْ يَنْهَى عَنْهُ وَرُوِّينَا عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ وَعَبْدِ اللهِ بْنِ مَسْعُودٍ ؓ أَنَّهُمَا كَرِهَا الْعَزْلَ وَرُوِّينَا عَنْهُمَا الْإِبَاحَةُ
[Machine] I attended the Messenger of Allah, ﷺ , among a group of people, and he was saying, "I have intended to prohibit Ghilah (a type of pre-Islamic trade) but then I looked at the Romans and the Persians, and they trade Ghilah and it does not harm their children." They asked him about "Al-'Azl" (coitus interruptus), so the Messenger of Allah, ﷺ , said, "The hidden secretion [i.e. sperm] is meant" (referring to the verse in the Quran that mentions "Maw'udah" - a term used before the revelation that made contraception through coitus interruptus forbidden).
حَضَرْتُ رَسُولَ اللهِ ﷺ فِي أُنَاسٍ وَهُوَ يَقُولُ لَقَدْ هَمَمْتُ أَنْ أَنْهَى عَنِ الْغِيلَةِ فَنَظَرْتُ فِي الرُّومِ وَفَارِسَ فَإِذَا هُمْ يُغِيلُونَ أَوْلَادَهُمْ فَلَا يَضُرُّ أَوْلَادَهُمْ شَيْئًا وَسَأَلُوهُ عَنِ الْعَزْلِ فَقَالَ رَسُولُ اللهِ ﷺ الْوَأْدُ الْخَفِيُّ {وَإِذَا الْمَوْءوُدَةُ} سُئِلَتْ
The Prophet of Allah ﷺ disliked ten things: Yellow colouring, meaning khaluq, dyeing grey hair, trailing the lower garment, wearing a gold signet-ring, a woman decking herself before people who are not within the prohibited degrees, throwing dice, using spells except with the Mu'awwidhatan, wearing amulets, withdrawing the penis before the semen is discharged, in the case of a woman who is wife or not a wife, and having intercourse with a woman who is suckling a child; but he did not declare them to be prohibited. Abu Dawud said: Only the transmitters of Basrah have transmitted this tradition. (Using translation from Abū Dāʾūd 4222)
كَانَ رَسُولُ اللهِ ﷺ يَكْرَهُ عَشْرَ خِلَالٍ؛ التَّخَتُّمَ بِالذَّهَبِ وَجَرَّ الْإِزَارِ وَالصُّفْرَةَ يَعْنِي الْخَلُوقَ وَتَغْيِيرَ الشَّيْبِ وَالرُّقَى إِلَّا بِالْمُعَوِّذَاتِ وَعَقْدَ التَّمَائِمِ وَالضَّرْبَ بِالْكِعَابِ وَالتَّبَرُّجَ بِالزِّينَةِ لِغَيْرِ مَحِلِّهَا وَعَزْلَ الْمَاءِ عَنْ مَحِلِّهِ وَإِفْسَادَ الصَّبِيِّ غَيْرَ مُحَرَّمَةٍ
