٣٩۔ كِتَابُ النِّكَاحِ ص ٦
[Machine] "By Allah, I have indeed seen the Messenger of Allah ﷺ standing at the door of my room while the Abyssinians were playing with spears in the Mosque. The Messenger of Allah ﷺ would cover me with his cloak so that I could watch their play between his ears and eyes. Then he would stand up for me until I leave. Estimate the value of a young servant girl eager for play."
وَاللهِ لَقَدْ رَأَيْتُ رَسُولَ اللهِ ﷺ يَقُومُ عَلَى بَابِ حُجْرَتِي وَالْحَبَشَةُ يَلْعَبُونَ بِالْحِرَابِ فِي الْمَسْجِدِ وَرَسُولُ اللهِ ﷺ يَسْتُرُنِي بِرِدَائِهِ لِأَنْظُرَ إِلَى لَعِبِهِمْ بَيْنَ أُذُنَيْهِ وَعَيْنَيْهِ ثُمَّ يَقُومُ مِنْ أَجْلِي حَتَّى أَكُونَ أَنَا الَّتِي أَنْصَرِفُ فَاقْدُرُوا قَدْرَ الْجَارِيَةِ الْحَدِيثَةِ السِّنِّ الْحَرِيصَةِ عَلَى اللهْوِ
[Machine] Abu Bakr As-Siddiq entered (to Aisha) and she had two slave girls with her. They were singing, playing the tambourine, and clapping their hands. The Messenger of Allah ﷺ came in, wrapped in his garment (to hide himself). Abu Bakr rebuked them, but the Messenger of Allah ﷺ uncovered his face and said: "Leave them alone, O Abu Bakr, for these are the days of 'Eid and the days of Mina." The Messenger of Allah ﷺ was in Madinah at that time. 'A'isha said: "I saw the Messenger of Allah ﷺ covering me with his garment, while I was watching the Abyssinians playing in the mosque, and I was a young girl."
أَبَا بَكْرٍ الصِّدِّيقَ ؓ دَخَلَ عَلَيْهَا وَعِنْدَهَا جَارِيَتَانِ فِي أَيَّامِ مِنًى تُغَنِّيَانِ وَتُدَفِّفَانِ وَتَضْرِبَانِ وَرَسُولُ اللهِ ﷺ مُتَغَشٍّ بِثَوْبِهِ فَانْتَهَرَهُنَّ أَبُو بَكْرٍ ؓ فَكَشَفَ رَسُولُ اللهِ ﷺ عَنْ وَجْهِهِ وَقَالَ دَعْهُمَا يَا أَبَا بَكْرٍ فَإِنَّهَا أَيَّامُ عِيدٍ وَتِلْكَ أَيَّامُ مِنًى وَرَسُولُ اللهِ ﷺ بِالْمَدِينَةِ فَقَالَتْ عَائِشَةُ رَأَيْتُ رَسُولَ اللهِ ﷺ يَسْتُرُنِي بِثَوْبِهِ وَأَنَا أَنْظُرُ إِلَى الْحَبَشَةِ وَهُمْ يَلْعَبُونَ فِي الْمَسْجِدِ وَأَنَا جَارِيَةٌ
[Machine] When the Messenger of Allah ﷺ arrived in Medina, the Abyssinians played with their spears in joy of his coming. If this story, as narrated by Aisha, is true, then it indicates that she was not mature at that time. The Messenger of Allah ﷺ built it (a mosque) when he arrived in Medina, and she was nine years old at the time. It is possible that this was before the hijab was obligated for them.
لَمَّا قَدِمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ لَعِبَتِ الْحَبَشَةُ بِحِرَابِهِمْ فَرَحًا بِقُدُومِهِ فَإِنْ كَانَتْ هَذِهِ الْقِصَّةُ وَمَا رَوَتْهُ عَائِشَةُ وَاحِدَةً فَفِيهَا مَا دَلَّ عَلَى أَنَّهَا كَانَتْ غَيْرَ بَالِغَةٍ فِي ذَلِكَ الْوَقْتِ فَرَسُولُ اللهِ ﷺ بَنَى بِهَا حِينَ قَدِمَ الْمَدِينَةَ وَهِيَ ابْنَةُ تِسْعِ سِنِينَ وَيُحْتَمَلُ أَنَّ ذَلِكَ كَانَ قَبْلَ أَنْ يُضْرَبَ عَلَيْهِنَّ الْحِجَابُ
[Machine] "Salama, should I not give him good news, O Messenger of Allah?" He said, "Yes, if you wish." She said, "So I stood at the door of my room and said, 'And this was before the veil was imposed on us, O Abu Lubaba, rejoice for Allah has forgiven you.' The sheikh Allah have mercy upon him said, 'And the Battle of Banu Qurayza was the aftermath of the Battle of the Trench, in the fifth year. The revelation of the veil came after it, and Allah knows best."
سَلَمَةَ ؓ أَفَلَا أُبَشِّرُهُ يَا رَسُولَ اللهِ بِذَلِكَ؟ قَالَ بَلَى إِنْ شِئْتِ قَالَتْ فَقُمْتُ عَلَى بَابِ حُجْرَتِي فَقُلْتُ وَذَلِكَ قَبْلَ أَنْ يُضْرَبَ عَلَيْنَا الْحِجَابُ يَا أَبَا لُبَابَةَ أَبْشِرْ فَقَدْ تَابَ اللهُ عَلَيْكَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَغَزْوَةُ بَنِي قُرَيْظَةَ كَانَتْ عُقَيْبَ الْخَنْدَقِ سَنَةَ خَمْسٍ فَنُزُولُ الْحِجَابِ كَانَ بَعْدَهُ وَاللهُ أَعْلَمُ
39.79 [Machine] What was mentioned in the rules regarding women?
٣٩۔٧٩ بَابُ مَا جَاءَ فِي الْقَوَاعِدِ مِنَ النِّسَاءِ
The verse: "And say to the believing women that they should lower gaze was partly abrogated by the verse: "Such elderly women as are past the prospect of marriage." (Using translation from Abū Dāʾūd 4111)
{وَقُلْ لِلْمُؤْمِنَاتِ يَغْضُضْنَ مِنْ أَبْصَارِهِنَّ} [النور 31] الْآيَةَ فَنُسِخَ وَاسْتَثْنَى مِنْ ذَلِكَ {وَالْقَوَاعِدُ مِنَ النِّسَاءِ اللَّاتِي لَا يَرْجُونَ نِكَاحًا} [النور 60] الْآيَةَ
[Machine] In His saying {And for women who do not expect marriage, it is not sinful for them to remove their outer garments, provided they do not revealingly display their adornment.} [An-Nur 60], it means that it is permissible for a woman to stay in her house wearing a dress and a headcover, while not wearing the cloak, unless she fears displaying something that Allah dislikes. And His saying {So there is no blame upon them if they put aside their outer garments, provided they do not reveal their adornment} [An-Nur 60]. Then He said {And let them modestly refrain from displaying their adornment} [An-Nur 60].
فِي قَوْلِهِ تَعَالَى {وَالْقَوَاعِدُ مِنَ النِّسَاءِ اللَّاتِي لَا يَرْجُونَ نِكَاحًا} [النور 60] قَالَ هِيَ الْمَرْأَةُ لَا جُنَاحَ عَلَيْهَا أَنْ تَجْلِسَ فِي بَيْتِهَا بِدِرْعٍ وَخِمَارٍ وَتَضَعُ عَنْهَا الْجِلْبَابَ مَا لَمْ تَتَبَرَّجْ لِمَا يَكْرَهُهُ اللهُ وَهُوَ قَوْلُهُ {فَلَيْسَ عَلَيْهِنَّ جُنَاحٌ أَنْ يَضَعْنَ ثِيَابَهُنَّ غَيْرَ مُتَبَرِّجَاتٍ بِزِينَةٍ} [النور 60] ثُمَّ قَالَ {وَأَنْ يَسْتَعْفِفْنَ خَيْرٌ لَهُنَّ} [النور 60]
الْجِلْبَابُ
[Machine] They wear their jilbabs, which is better for them.
يَلْبَسْنَ جَلَابِيبَهُنَّ خَيْرٌ لَهُنَّ
[Machine] We used to visit Hafsah bint Sireen, and she would wear the jilbab in this manner and cover herself with it. We would say to her, "May Allah have mercy on you." Allah, the Most High, said, "And as for women past childbearing who do not expect wedlock, it is no sin on them if they discard their (outer) clothing in such a way as not to show their adornment." (Quran, 24: 60) Jilbab is this. She would then say to us, "Is there anything else?" We would say, "And that they should be modest is better for them." (Quran, 24: 60) She would say, "This is the confirmation of the jilbab."
كُنَّا نَدْخُلُ عَلَى حَفْصَةَ بِنْتِ سِيرِينَ وَقَدْ جَعَلَتِ الْجِلْبَابَ هَكَذَا وَتَنَقَّبَتْ بِهِ فَنَقُولُ لَهَا رَحِمَكِ اللهُ قَالَ اللهُ تَعَالَى {وَالْقَوَاعِدُ مِنَ النِّسَاءِ اللَّاتِي لَا يَرْجُونَ نِكَاحًا فَلَيْسَ عَلَيْهِنَّ جُنَاحٌ أَنْ يَضَعْنَ ثِيَابَهُنَّ غَيْرَ مُتَبَرِّجَاتٍ بِزِينَةٍ} [النور 60] هُوَ الْجِلْبَابُ قَالَ فَتَقُولُ لَنَا أِيُّ شَيْءٍ بَعْدَ ذَلِكَ؟ فَنَقُولُ {وَأَنْ يَسْتَعْفِفْنَ خَيْرٌ لَهُنَّ} [النور 60] فَتَقُولُ هُوَ إِثْبَاتُ الْجِلْبَابِ
[Machine] We have an old woman who sends us goods so we take them from the root of the dock, then throw them in a pot and grind grains of barley. Whenever we pray, we go to her and greet her and she presents it to us. We used to be happy on Fridays because of that and we would not move or have lunch until after Friday.
لَنَا عَجُوزٌ تَبْعَثُ إِلَى بُضَاعَةَ فَتَأْخُذُ مِنْ أُصُولِ السِّلْقِ فَتَطْرَحُهُ فِي قِدْرٍ وَتُكَرْكِرُ حَبَّاتٍ مِنْ شَعِيرٍ فَكُنَّا إِذَا صَلَّيْنَا انْصَرَفْنَا إِلَيْهَا فَنُسَلِّمُ عَلَيْهَا فَتُقَدِّمُهُ إِلَيْنَا وَكُنَّا نَفْرَحُ بِيَوْمِ الْجُمُعَةِ مِنْ أَجْلِ ذَلِكَ وَمَا كُنَّا نَقِيلُ وَلَا نَتَغَدَّى إِلَّا بَعْدَ الْجُمُعَةِ
[Machine] The Messenger of Allah ﷺ went to visit Umm Ayman, and I went with him. She brought him a drink, and if he was fasting, he would refuse it, and if he did not want it, he would return it. Then Abu Bakr said to Umar after the death of the Messenger of Allah ﷺ , "Go with us to Umm Ayman to visit her." When we arrived at her house, she cried. They asked her, "What makes you cry? Whatever is with Allah is better for the Messenger of Allah ﷺ ." She said, "By Allah, I do not cry because I do not know that whatever is with Allah is better for the Messenger of Allah ﷺ , but I cry because the revelation from the sky has stopped, and this has saddened both of them to tears."
ذَهَبَ رَسُولُ اللهِ ﷺ إِلَى أُمِّ أَيْمَنَ زَائِرًا وَذَهَبْتُ مَعَهُ فَقَرَّبَتْ إِلَيْهِ شَرَابًا فَإِمَّا كَانَ صَائِمًا وَإِمَّا كَانَ لَا يُرِيدُهُ فَرَدَّهُ فَأَقْبَلَتْ عَلَى رَسُولِ اللهِ ﷺ تُصَاخِبُهُ فَقَالَ أَبُو بَكْرٍ ؓ بَعْدَ وَفَاةِ رَسُولِ اللهِ ﷺ لِعُمَرَ ؓ انْطَلِقْ بِنَا إِلَى أُمِّ أَيْمَنَ نَزُورُهَا فَلَمَّا انْتَهَيْنَا إِلَيْهَا بَكَتْ قَالَا لَهَا مَا يُبْكِيكِ مَا عِنْدَ اللهِ خَيْرٌ لِرَسُولِ اللهِ ﷺ قَالَتْ وَاللهِ مَا أَبْكِي أَلَّا أَكُونَ أَعْلَمُ مَا عِنْدَ اللهِ خَيْرٌ لِرَسُولِ اللهِ ﷺ وَلَكِنْ أَبْكِي أَنَّ الْوَحْيَ انْقَطَعَ مِنَ السَّمَاءِ فَهَيَّجَتْهُمَا عَلَى الْبُكَاءِ فَجَعَلَا يَبْكِيَانِ
39.80 [Machine] What a woman reveals of her adornment to men mentioned in the verse from her lawful limits.
٣٩۔٨٠ بَابُ مَا تُبْدِي الْمَرْأَةُ مِنْ زِينَتِهَا لِلْمَذْكُورِينَ فِي الْآيَةِ مِنْ مَحَارِمِهَا
[Machine] In his statement, Allah says, "And they should not expose their adornment except that which appears thereof." (Quran 24:31) The apparent adornment refers to the face, kohl in the eyes, henna on the hands, and the ring. These can be shown to those who enter her house. Then it is further stated, "And they should not expose their adornment except to their husbands, or their fathers, or their husbands' fathers, or their sons, or their husbands' sons, or their brothers, or their brothers' sons, or their sisters' sons, or their women, or those whom their right hands possess, or male attendants having no physical desire, or children who are not yet aware of the private aspects of women." (Quran 24:31) The adornment that can be shown to these people includes the earrings, necklaces, and bracelets. As for the anklets, arm bangles, and hair, they should not be shown except to the husband. It was narrated by Mujahid that he said, "This refers to the earrings, bracelets, and arm bangles, as well as the feet and hair." This is the preferable opinion that no inner adornment should be shown to anyone other than the husband, except for what is visible in her profession. If something above the navel and below the knee is visible to non-Mahram relatives, it is permissible. This is supported by what we have narrated in the book of Prayer from 'Amr bin Shu'aib, from his father, from his grandfather, from the Prophet ﷺ , who said, "When any one of you marries his male or female slave, let him not look at their 'Awrah." In another narration, "Let him not look at what is below the navel and above the knee." The last narration clarifies that the intended meaning of the Hadith is to prohibit the master from looking at the 'Awrah between the navel and the knee, and this prohibition is extended to non-Mahram relatives when they marry her. However, it is mentioned that Nadar bin Shumayl
فِي قَوْلِهِ جَلَّ ثَنَاؤُهُ {وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا مَا ظَهَرَ مِنْهَا} [النور 31] وَالزِّينَةُ الظَّاهِرَةُ الْوَجْهُ وَكُحْلُ الْعَيْنِ وَخِضَابُ الْكَفِّ وَالْخَاتَمُ فَهَذَا تُظْهِرُهُ فِي بَيْتِهَا لِمَنْ دَخَلَ عَلَيْهَا ثُمَّ قَالَ {وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ أَوِ التَّابِعِينَ غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ} [النور 31] وَالزِّينَةُ الَّتِي تُبْدِيهَا لِهَؤُلَاءِ النَّاسِ قُرْطَاهَا وَقِلَادَتُهَا وَسِوَارَاهَا فَأَمَّا خَلْخَالَهَا وَمُعْضَدَتُهَا وَنَحْرُهَا وَشَعْرُهَا فَلَا تُبْدِيهِ إِلَّا لِزَوْجِهَا وَرُوِّينَا عَنْ مُجَاهِدٍ أَنَّهُ قَالَ يَعْنِي بِهِ الْقُرْطَيْنِ وَالسَّالِفَةَ وَالسَّاعِدَيْنِ وَالْقَدَمَيْنِ وَهَذَا هُوَ الْأَفْضَلُ أَلَّا تُبْدِي مِنْ زِينَتِهَا الْبَاطِنَةِ شَيْئًا لِغَيْرِ زَوْجِهَا إِلَّا مَا يَظْهَرُ مِنْهَا فِي مِهْنَتِهَا فَإِنْ ظَهَرَ مِنْهَا لِذَوِي الْمَحَارِمِ شَيْءٌ فَوْقَ سُرَّتِهَا وَدُونَ رُكْبَتِهَا فَقَدْ قِيلَ لَا بَأْسَ اسْتِدْلَالًا بِمَا رَوَيْنَا فِي كِتَابِ الصَّلَاةِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ قَالَ إِذَا زَوَّجَ أَحَدُكُمْ عَبْدَهُ أَمَتَهُ أَوْ أَجِيرَهُ فَلَا يَنْظُرَنَّ إِلَى عَوْرَتِهَا وَفِي رِوَايَةٍ أُخْرَى فَلَا يَنْظُرْ إِلَى مَا دُونَ السُّرَّةِ وَفَوْقَ الرُّكْبَةِ وَالرِّوَايَةُ الْأَخِيرَةُ إِذَا قُرِنَتْ بِالْأُولَى دَلَّتَا عَلَى أَنَّ الْمُرَادَ بِالْحَدِيثِ نَهْيُ السَّيِّدِ عَنِ النَّظَرِ إِلَى عَوْرَتِهَا إِذَا زَوَّجَهَا وَهِيَ مَا بَيْنَ السُّرَّةِ إِلَى الرُّكْبَةِ وَالسَّيِّدُ مَعَهَا إِذَا زَوَّجَهَا كَذَوِي مَحَارِمِهَا إِلَّا أَنَّ النَّضْرَ بْنَ شُمَيْلٍ
I said: Messenger of Allah, from whom should we conceal our private parts and to whom can we show? He replied: conceal your private parts except from your wife and from whom your right hands possess (slave-girls). I then asked: Messenger of Allah, (what should we do), if the people are assembled together? He replied: If it is within your power that no one looks at it, then no one should look at it. I then asked: Messenger of Allah if one of us is alone, (what should he do)? He replied: Allah is more entitled than people that bashfulness should be shown to him. (Using translation from Abū Dāʾūd 4017)
قُلْتُ يَا رَسُولَ اللهِ أَرَأَيْتَ عَوْرَاتَنَا مَا نَأْتِي مِنْهَا وَمَا نَذَرُ؟ قَالَ احْفَظْ عَوْرَتَكَ إِلَّا مِنْ زَوْجَتِكَ أَوْ مَا مَلَكَتْ يَمِينُكَ قَالَ أَفَرَأَيْتَ إِنْ كُنَّا بَعْضُنَا فِي بَعْضٍ؟ قَالَ إِنِ اسْتَطَعْتَ أَنْ لَا يَرَاهَا أَحَدٌ فَلَا يَرَيَنَّهَا قُلْتُ أَرَأَيْتَ إِذَا كَانَ أَحَدُنَا خَالِيًا؟ قَالَ فَاللهُ أَحَقُّ أَنْ يُسْتَحَى مِنَ النَّاسِ
[Machine] I have never seen the private parts of the Messenger of Allah ﷺ.
مَا رَأَيْتُ فَرْجَ رَسُولِ اللهِ ﷺ قَطُّ
[Machine] The Prophet ﷺ said, "None of you should look at the private parts of his wife or the private parts of his slave woman when he has sexual intercourse with her, for that will cause blindness." Abu Sa'd al-Malini informed us, and Abu Ahmad ibn 'Adi al-Hafiz narrated to us, who said, "It is similar to being between the rest and Ibn Juraij, meaning in this hadith, some of the unknown or some of the weak (narrators), except that Hisham ibn Khalid said, 'Regarding the rest, Ibn Juraij narrated to me 13541'."
النَّبِيَّ ﷺ قَالَ لَا يَنْظُرَنَّ أَحَدٌ مِنْكُمْ إِلَى فَرْجِ زَوْجَتِهِ وَلَا فَرْجِ جَارِيَتِهِ إِذَا جَامَعَهَا فَإِنَّ ذَلِكَ يُورِثُ الْعَمَى أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أَنْبَأَ أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ قَالَ يُشْبِهُ أَنْ يَكُونَ بَيْنَ بَقِيَّةَ وَبَيْنَ ابْنِ جُرَيْجٍ يَعْنِي فِي هَذَا الْحَدِيثِ بَعْضُ الْمَجْهُولِينَ أَوْ بَعْضُ الضُّعَفَاءِ إِلَّا أَنَّ هِشَامَ بْنَ خَالِدٍ قَالَ عَنْ بَقِيَّةَ حَدَّثَنِي ابْنُ جُرَيْجٍ 13541 أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ ثنا ابْنُ قُتَيْبَةَ ثنا هِشَامُ بْنُ خَالِدٍ عَنْ بَقِيَّةَ حَدَّثَنِي ابْنُ جُرَيْجٍ فَذَكَرَهُ بِمَعْنَاهُ
39.81 [Machine] What is mentioned in the Muslim woman expressing her beauty to her female companions, excluding the disbelievers. Allah, may His praise be exalted, mentioned: "Or their women" [Surah An-Nur: 31]
٣٩۔٨١ بَابُ مَا جَاءَ فِي إِبْدَاءِ الْمُسْلِمَةِ زِينَتَهَا لِنِسَائِهَا دُونَ الْكَافِرَاتِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {أَوْ نِسَائِهِنَّ} [النور: 31]
[Machine] That women from among the Muslim women enter the restrooms and with them are women from the People of the Book, so prevent that and forbid it.
أَنَّ نِسَاءً مِنْ نِسَاءِ الْمُسْلِمِينَ يَدْخُلْنَ الْحَمَّامَاتِ وَمَعَهُنَّ نِسَاءُ أَهْلِ الْكِتَابِ فَامْنَعْ ذَلِكَ وَحُلْ دُونَهُ
[Machine] There are women among the Muslim women who enter the bathrooms with the women of the polytheists, and this is viewed unfavorably by you. It is not permissible for a woman who believes in Allah and the Last Day to expose her nakedness except to the people of her own religion.
أَنَّ نِسَاءً مِنْ نِسَاءِ الْمُسْلِمِينَ يَدْخُلْنَ الْحَمَّامَاتِ مَعَ نِسَاءِ أَهْلِ الشِّرْكِ فَإِنَّهُ مِنْ قِبَلِكَ عَنْ ذَلِكَ فَإِنَّهُ لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ أَنْ يَنْظُرَ إِلَى عَوْرَتِهَا إِلَّا أَهْلُ مِلَّتِهَا
لِأَنَّ اللهَ تَعَالَى يَقُولُ {أَوْ نِسَائِهِنَّ} [النور 31] فَلَيْسَ مِنْ نِسَائِهِنَّ
39.82 [Machine] What came in its beginning is its adornment by what its right hand possesses, Allah the Almighty says: "Or those whom their right hands possess" [Quran 24:31]
٣٩۔٨٢ بَابُ مَا جَاءَ فِي إِبْدَائِهَا زِينَتَهَا لِمَا مَلَكَتْ يَمِينُهَا قَالَ اللهُ تَعَالَى: {أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ} [النور: 31]
The Prophet ﷺ brought Fatimah a slave which he donated to her. Fatimah wore a garment which, when she covered her head, did not reach her feet, and when she covered her feet by it, that garment did not reach her head. When the Prophet ﷺ saw her struggle, he said: There is no harm to you: Here is only your father and slave. (Using translation from Abū Dāʾūd 4106)
ﷺ أَتَى فَاطِمَةَ بِعَبْدٍ قَدْ وَهَبَهُ لَهَا قَالَ وَعَلَى فَاطِمَةَ ؓ ثَوْبٌ إِذَا قَنَّعَتْ بِهِ رَأْسَهَا لَمْ يَبْلُغْ رِجْلَيْهَا وَإِذَا غَطَّتْ بِهِ رِجْلَيْهَا لَمْ يَبْلُغْ رَأْسَهَا فَلَمَّا رَأَى النَّبِيُّ ﷺ مَا تَلْقَى قَالَ إِنَّهُ لَيْسَ عَلَيْكِ بَأْسٌ إِنَّمَا هُوَ أَبُوكِ وَغُلَامُكِ تَابَعَهُ سَلَّامُ بْنُ أَبِي الصَّهْبَاءِ عَنْ ثَابِتٍ
[Machine] The mothers of the believers used to borrow from each other and they would disclose their hair for one another. When the debt was paid, they would cast their hair over their faces again. Al-Hasan, Ash-Sha'bi, Tawus, and Mujahid disliked for a woman's servant to look at her hair, as if they considered it part of the adornment that should not be displayed to a servant, just as Ibn Abbas considered it part of the adornment that should not be displayed in front of non-mahrams. We also narrated from Ibrahim as-Sa'di who said, "I asked Nafi', 'Can a woman's servant comb her hair?'" He said, 'No, because they consider the servant to be a lost slave (i.e. they do not trust them) and the apparent meaning of the book (i.e. the Quran) takes precedence in following, along with what is mentioned in the Sunnah."
كَانَتْ أُمَّهَاتُ الْمُؤْمِنِينَ يَكُونُ لِبَعْضِهِنَّ الْمُكَاتَبُ فَتَكْشِفُ لَهُ الْحِجَابَ مَا بَقِيَ عَلَيْهِ دِرْهَمٌ فَإِذَا قُضِيَ أَرْخَتْهُ دُونَهُ وَكَانَ الْحَسَنُ وَالشَّعْبِيُّ وَطَاوُسٌ وَمُجَاهِدٌ يَكْرَهُونَ أَنْ يَنْظُرَ الْعَبْدُ إِلَى شَعْرِ سَيِّدَتِهِ وَكَأَّنَهُمْ عَدُّوا الشَّعْرَ مِنَ الزِّينَةِ الَّتِي لَا تُبْدِيهَا لِعَبْدِهَا كَمَا عَدَّهُ ابْنُ عَبَّاسٍ ؓ فِيمَا رَوَيْنَاهُ مِنَ الزِّينَةِ الَّتِي لَا تُبْدِيهَا لِمَحَارِمِهَا وَرُوِّينَا عَنْ إِبْرَاهِيمَ الصَّائِغِ قَالَ قُلْتُ لِنَافِعٍ يُخْرِجُهَا عَبْدُهَا قَالَ لَا لِأَنَّهُمْ يَرَوْنَ الْعَبْدَ ضَيْعَةً وَظَاهِرُ الْكِتَابِ أَوْلَى بِالِاتِّبَاعِ مَعَ مَا فِيهِ مِنَ السُّنَّةِ
39.83 [Machine] What came out in its beginning is its adornment for anyone other than the close relatives (mahrams) of men." God Almighty said: "or those who follow other than the people of authority from among men" [An-Nur: 31]
٣٩۔٨٣ بَابُ مَا جَاءَ فِي إِبْدَائِهَا زِينَتَهَا لِغَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ قَالَ اللهُ تَعَالَى: {أَوِ التَّابِعِينَ غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ} [النور: 31]
[Machine] He is the man who follows the crowd and is ignorant in his mind, he does not care about women nor desires them.
هُوَ الرَّجُلُ يَتْبَعُ الْقَوْمَ وَهُوَ مُغَفَّلٌ فِي عَقْلِهِ لَا يَكْتَرِثُ النِّسَاءَ وَلَا يَشْتَهِيهِنَّ
[Machine] About Al-Sha'bi's statement, "not having any need for women," [An-Nur:31], the one who does not have any need or desire for women.
عَنِ الشَّعْبِيِّ فِي قَوْلِهِ {غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ} [النور 31] قَالَ الَّذِي لَيْسَ لَهُ إِرْبٌ أَيْ حَاجَةٌ فِي النِّسَاءِ
[Machine] From Mujahid, regarding the saying of Allah, "Or the followings of others than the unlettered from among the men" (Quran 24:31), he said, "He is the one who only cares about his stomach and does not fear for women." And it was narrated from Tawus that he said, "He is the foolish one who has no need for women." And Al-Hasan said, "He is the one who has no intellect and does not desire women, and women do not desire him."
عَنْ مُجَاهِدٍ فِي قَوْلِهِ تَعَالَى {أَوِ التَّابِعِينَ غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ} [النور 31] قَالَ هُوَ الَّذِي لَا يُهِمُّهُ إِلَّا بَطْنُهُ وَلَا يَخَافُ عَلَى النِّسَاءِ وَرُوِّينَا عَنْ طَاوُسٍ أَنَّهُ قَالَ هُوَ الْأَحْمَقُ الَّذِي لَيْسَ لَهُ فِي النِّسَاءِ إِرْبٌ أَيْ حَاجَةٌ وَعَنِ الْحَسَنِ قَالَ هُوَ الَّذِي لَا عَقْلَ لَهُ وَلَا يَشْتَهِي النِّسَاءَ وَلَا تَشْتَهِيهِ النِّسَاءُ
A mukhannath (eunuch) used to enter upon the wives of Prophet ﷺ. They (the people) counted him among those who were free of physical needs. One day the Prophet ﷺ entered upon us when he was with one of his wives, and was describing the qualities of a woman, saying: When she comes forward, she comes forward with four (folds in her stomach), and when she goes backward, she goes backward with eight (folds in her stomach). The Prophet ﷺ said: Do I not see that this (man) knows what here lies. Then they (the wives) observed veil from him. (Using translation from Abū Dāʾūd 4107)
كَانَ رَجُلٌ يَدْخُلُ عَلَى أَزْوَاجِ النَّبِيِّ ﷺ مُخَنَّثٌ وَكَانُوا يَعُدُّونَهُ مِنْ غَيْرِ أُولِي الْإِرْبَةِ فَدَخَلَ النَّبِيُّ ﷺ يَوْمًا وَهُوَ عِنْدَ بَعْضِ نِسَائِهِ وَهُوَ يَنْعَتُ امْرَأَةً فَقَالَ إِنَّهَا إِذَا أَقْبَلَتْ أَقْبَلَتْ بِأَرْبَعٍ وَإِذَا أَدْبَرَتْ أَدْبَرَتْ بِثَمَانٍ فَقَالَ النَّبِيُّ ﷺ أَلَا أَرَى هَذَا يَعْلَمُ مَا هَهُنَا لَا يَدْخُلَنَّ عَلَيْكُنَّ هَذَا فَحَجَبُوهُ
39.84 [Machine] What is mentioned about presenting their adornment to children who have not yet appeared on women's private parts. Allah, the Most High, said, and He is the most truthful of speakers: "Or to young children who have not yet appeared on women's private parts." [Quran 24:31]
٣٩۔٨٤ بَابُ مَا جَاءَ فِي إِبْدَاءِ زِينَتِهَا لِلطِّفْلِ الَّذِينَ لَمْ يَظْهَرُوا عَلَى عَوْرَاتِ النِّسَاءِ قَالَ اللهُ تَعَالَى وَهُوَ أَصْدَقُ الْقَائِلِينَ: {أَوِ الطِّفْلِ الَّذِينَ لَمْ يَظْهَرُوا عَلَى عَوْرَاتِ النِّسَاءِ} [النور: 31]
[Machine] They are the ones who do not know what women are like when they are young.
هُمُ الَّذِينَ لَا يَدْرُونَ مَا النِّسَاءُ مِنَ الصِّغَرِ
Umm Salamah asked the Messenger of Allah ﷺ permission for getting herself cupped. He commanded Abu Tibah to cup her. The transmitter said: I think he was her foster-brother or a boy not yet of age. (Using translation from Abū Dāʾūd 4105)
سَلَمَةَ ؓ اسْتَأْذَنَتْ رَسُولَ اللهِ ﷺ فِي الْحِجَامَةِ فَأَمَرَ النَّبِيُّ ﷺ أَبَا طَيْبَةَ أَنْ يَحْجُمَهَا قَالَ حَسِبْتُ أَنَّهُ كَانَ أَخَاهَا مِنَ الرَّضَاعَةِ أَوْ كَانَ غُلَامًا لَمْ يَحْتَلِمْ وَاللهُ سُبْحَانَهُ أَعْلَمُ
39.85 [Machine] The permission to excuse the slave and the child in the three situations, and the permission of those who have reached puberty among them in all cases.
٣٩۔٨٥ بَابُ اسْتِئْذَانِ الْمَمْلُوكِ وَالطِّفْلِ فِي الْعَوْرَاتِ الثَّلَاثِ، وَاسْتِئْذَانِ مَنْ بَلَغَ الْحُلُمَ مِنْهُمْ فِي جَمِيعِ الْحَالِاتِ
[Machine] In His saying, "Let those of you who possess affluence and ample wealth ever keep firmly in mind the orphans and those indigents who, for the sake of pursuing studies and seeking knowledge, are not able to afford a livelihood, and thus, remain unable to present themselves for marriage to free believing women. Therefore, with the conscious objective of ensuring their chastity and protection from vice, it has been given permission that guardian of such orphans should, after assessing their suitability and guaranteeing their credibility, enter into their marriage with a mutual understanding among themselves. They should be celibate prior to marriage, considerate and prudent in determining their terms of contract and conditions and should not marry them forcefully; in fact, it is best if their marriage is conducted with their consent. The marriage of all Muslim women should be contracted with mutual consent. But for those who do not have the means to put forth such marriage contracts and remain unmarried, they are advised to maintain chastity in a manner defined by religion until such time that God bestows upon them out of His bounty. Nor will it be termed sinful for the pauper if he wedding is directed by his own natural urge for companionship and intimacy, instead of waiting for any other signs from heaven or earth. Indeed, He is All-Knowing and All-Wise."
فِي قَوْلِهِ تَعَالَى {لِيَسْتَأْذِنْكُمُ الَّذِينَ مَلَكَتْ أَيْمَانُكُمْ وَالَّذِينَ لَمْ يَبْلُغُوا الْحُلُمَ مِنْكُمْ ثَلَاثَ مَرَّاتٍ مِنْ قَبْلِ صَلَاةِ الْفَجْرِ وَحِينَ تَضَعُونَ ثِيَابَكُمْ مِنَ الظَّهِيرَةِ وَمِنْ بَعْدِ صَلَاةِ الْعِشَاءِ ثَلَاثُ عَوْرَاتٍ لَكُمْ} [النور 58] قَالَ إِذَا خَلَا الرَّجُلُ بِأَهْلِهِ بَعْدَ صَلَاةِ الْعِشَاءِ لَا يَدْخُلْ عَلَيْهِ خَادِمٌ وَلَا صَبِيٌّ إِلَّا بِإِذْنٍ حَتَّى يُصَلِّيَ الْغَدَاةَ وَإِذَا خَلَا بِأَهْلِهِ عِنْدَ الظَّهِيرَةِ فَمِثْلُ ذَلِكَ ثُمَّ رُخِّصَ لَهُمْ فِيمَا بَيْنَ ذَلِكَ بِغَيْرِ إِذْنٍ وَهُوَ قَوْلُهُ تَعَالَى {لَيْسَ عَلَيْكُمْ وَلَا عَلَيْهِمْ جُنَاحٌ بَعْدَهُنَّ} [النور 58] فَأَمَّا مَنْ بَلَغَ الْحُلُمَ فَإِنَّهُ لَا يَدْخُلُ عَلَى الرَّجُلِ وَأَهْلِهِ إِلَّا بِإِذْنٍ عَلَى حَالٍ وَهُوَ قَوْلُهُ {وَإِذَا بَلَغَ الْأَطْفَالُ مِنْكُمُ الْحُلُمَ فَلْيَسْتَأْذِنُوا كَمَا اسْتَأْذَنَ الَّذِينَ مِنْ قَبْلِهِمْ} [النور 59]
[Machine] I asked Ibn Abbas regarding my two foster sisters who are under my care, and I spend on them. Should I seek their permission? He replied, "Yes." I repeatedly said, "This would be difficult for me." He said, "Verily, Allah, the Exalted, has said: O you who have believed, let those whom your right hands possess and those who have not [yet] reached puberty among you ask permission of you [before entering] at three times: before the dawn prayer and when you put aside your clothing [for rest] at noon and after the night prayer. [These are] three times of privacy for you." [Al-Nur 58] until the end of the verse. Ibn Abbas said, "These people are only commanded to seek permission in the three times of privacy." He said, "And when the children among you reach puberty, let them ask permission [at all times] as those before them have done." [Al-Nur 59]
قُلْتُ لِابْنِ عَبَّاسٍ فِي حِجْرِي أُخْتَانِ أُمَوِّنُهُمَا وَأُنْفِقُ عَلَيْهِمَا فَأَسْتَأْذِنُ عَلَيْهِمَا؟ قَالَ نَعَمْ فَرَادَدْتُهُ قُلْتُ إِنَّ ذَا يَشُقُّ عَلَيَّ قَالَ إِنَّ اللهَ تَعَالَى يَقُولُ {يَا أَيُّهَا الَّذِينَ آمَنُوا لِيَسْتَأْذِنْكُمُ الَّذِينَ مَلَكَتْ أَيْمَانُكُمْ وَالَّذِينَ لَمْ يَبْلُغُوا الْحُلُمَ مِنْكُمْ ثَلَاثَ مَرَّاتٍ مِنْ قَبْلِ صَلَاةِ الْفَجْرِ وَحِينَ تَضَعُونَ ثِيَابَكُمْ مِنَ الظَّهِيرَةِ وَمِنْ بَعْدِ صَلَاةِ الْعِشَاءِ ثَلَاثُ عَوْرَاتٍ لَكُمْ} [النور 58] إِلَى آخِرِ الْآيَةِ قَالَ ابْنُ عَبَّاسٍ فَلَمْ يَأْمُرْ هَؤُلَاءِ بِالْإِذْنِ إِلَّا فِي الْعَوْرَاتِ الثَّلَاثِ قَالَ {وَإِذَا بَلَغَ الْأَطْفَالُ مِنْكُمُ الْحُلُمَ فَلْيَسْتَأْذِنُوا كَمَا اسْتَأْذَنَ الَّذِينَ مِنْ قَبْلِهِمْ} [النور 59]
تَسْتَأْذِنَ عَلَيَّ
[Machine] I heard Ibn Mas'ood saying, "You should show respect to your mothers."
سَمِعْتُ ابْنَ مَسْعُودٍ يَقُولُ عَلَيْكُمْ إِذْنٌ عَلَى أُمَّهَاتِكُمْ
[Machine] Hudhaifah was asked if a man should seek permission from his mother. He said yes, and if he doesn't, you may see something from her that you dislike, and a hadith narrated by him was mentioned in it.
أَنَّ حُذَيْفَةَ ؓ سُئِلَ أَيَسْتَأْذِنُ الرَّجُلُ عَلَى وَالِدَتِهِ؟ قَالَ نَعَمْ إِنْ لَمْ تَفْعَلْ رَأَيْتَ مِنْهَا مَا تَكْرَهُ وَرُوِيَ فِيهِ حَدِيثٌ مُرْسَلٌ
[Machine] That the Messenger of Allah ﷺ was asked by a man, and he said, "May I seek permission, O Messenger of Allah, for my mother?" He said, "Yes." So the man said, "I am with her in the house." He said, "Seek permission from her." The man said, "I am her servant." He said, "Do you like to see her naked?" He said, "No." He said, "Then seek permission from her."
أَنَّ رَسُولَ اللهِ ﷺ سَأَلَهُ رَجُلٌ فَقَالَ أَسْتَأْذِنُ يَا رَسُولَ اللهِ عَلَى أُمِّي؟ فَقَالَ نَعَمْ فَقَالَ إِنِّي مَعَهَا فِي الْبَيْتِ فَقَالَ اسْتَأْذِنْ عَلَيْهَا فَقَالَ الرَّجُلُ إِنِّي خَادِمُهَا فَقَالَ أَتُحِبُّ أَنْ تَرَاهَا عُرْيَانَةً؟ قَالَ لَا قَالَ فَاسْتَأْذِنْ عَلَيْهَا
[Machine] Regarding seeking permission for the three private matters that Allah ordered in the Quran, Ibn Abbas said to them, "Indeed, Allah is the One who conceals and He loves concealment. The people did not have any barriers on their doors or curtains in their houses, so a man may suddenly come upon his servant or his child or his orphan in his private chamber while with his family. So Allah commanded them to seek permission for those private matters that Allah has specified. Then Allah revealed the veil and extended provision for them, so they took the veil and took curtain. The people saw that this was sufficient for them regarding seeking permission, as commanded by Allah." The sheikh (may Allah have mercy on him) said: "This is the narration of Ubaidullah ibn Abi Yazid and Ata, who weakened this narration. And Allah knows best."
عَنِ الِاسْتِئْذَانِ فِي الثَّلَاثِ عَوْرَاتٍ الَّتِي أَمَرَ اللهُ بِهَا فِي الْقُرْآنِ فَقَالَ لَهُمَا ابْنُ عَبَّاسٍ إِنَّ اللهَ سِتِّيرٌ يُحِبُّ السَّتْرَ كَانَ النَّاسُ لَيْسَ لَهُمْ سُتُورٌ عَلَى أَبْوَابِهِمْ وَلَا حِجَالٌ فِي بُيُوتِهِمْ فَرُبَّمَا فَاجَأَ الرَّجُلَ خَادِمُهُ أَوْ وَلَدُهُ أَوْ يَتِيمُهُ فِي حِجْرِهِ وَهُوَ عَلَى أَهْلِهِ فَأَمَرَهُمُ اللهُ ﷻ أَنْ يَسْتَأْذِنُوا فِي تِلْكَ الْعَوْرَاتِ الَّتِي سَمَّى الله ﷻ ثُمَّ جَاءَ اللهُ ﷻ بَعْدُ بِالسُّتُورِ وَبَسَطَ عَلَيْهِمْ فِي الرِّزْقِ فَاتَّخَذُوا السُّتُورَ وَاتَّخَذُوا الْحِجَالَ فَرَأَى النَّاسُ أَنَّ ذَلِكَ قَدْ كَفَاهُمْ مِنَ الِاسْتِئْذَانِ الَّذِي أَمَرَ اللهُ بِهِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ حَدِيثُ عُبَيْدِ اللهِ بْنِ أَبِي يَزِيدَ وَعَطَاءٍ يُضَعِّفُ هَذِهِ الرِّوَايَةَ وَاللهُ أَعْلَمُ
39.86 [Machine] How to request permission
٣٩۔٨٦ بَابُ كَيْفَ الِاسْتِئْذَانُ
[Machine] I heard the Messenger of Allah ﷺ saying, "If one of you gives the greeting of peace three times and is not answered, then let him go back, and I said, 'It is up to you to come to me with evidence of what you say, or I will do such and such to you, except that he had already promised him.'"
So Abu Musa came with a downcast face while I was sitting in a circle, and we said, "What is the matter with you?" He said, "I gave the greeting of peace to Umar and he informed me about his news. Did any of you hear from the Messenger of Allah ﷺ ?" They said, "Yes, all of us heard it from him." He said, "Then send someone with me until I come to Umar and inform him of that."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا سَلَّمَ أَحَدُكُمْ ثَلَاثَ مَرَّاتٍ فَلَمْ يُجَبْ فَلْيَرْجِعْ فَقَالَ لَتَأْتِيَنِّي عَلَى مَا تَقُولُ بَيِّنَةً أَوْ لَأَفْعَلَنَّ بِكَ كَذَا غَيْرَ أَنَّهُ قَدْ أَوْعَدَهُ قَالَ فَجَاءَ أَبُو مُوسَى مُنْتَقِعًا لَوْنُهُ وَأَنَا فِي حَلْقَةٍ جَالِسٌ فَقُلْنَا مَا شَأْنُكَ؟ فَقَالَ سَلَّمْتُ عَلَى عُمَرَ فَأَخْبَرَنَا خَبَرَهُ فَهَلْ سَمِعَ أَحَدٌ مِنْكُمْ مِنْ رَسُولِ اللهِ ﷺ؟ قَالُوا نَعَمْ كُلُّنَا قَدْ سَمِعَهُ قَالَ فَأَرْسَلُوا مَعَهُ رَجُلًا مِنْهُمْ حَتَّى أَتَى عُمَرَ ؓ فَأَخْبَرَهُ بِذَلِكَ
39.87 [Machine] The man travels alone with his spouse.
٣٩۔٨٧ بَابُ الرَّجُلِ يَخْلُو بِذَاتِ مَحْرَمِهِ يُسَافِرُ بِهَا
[Machine] The Messenger of Allah ﷺ said, "Verily, a man should not spend the night with a woman except if he is her husband or a close relative." Yahya ibn Yahya added in his narration, "He said this three times." And it was also narrated from Abu Zubair.
قَالَ رَسُولُ اللهِ ﷺ أَلَا لَا يَبِيتَنَّ رَجُلٌ عِنْدَ امْرَأَةٍ إِلَّا أَنْ يَكُونَ نَاكِحًا أَوْ ذَا مَحْرَمٍ زَادَ يَحْيَى بْنُ يَحْيَى فِي رِوَايَتِهِ ثَلَاثًا وَقَالَ عَنْ أَبِي الزُّبَيْرِ
[Machine] The Messenger of Allah ﷺ said, "A woman should not travel for three days or more without a Mahram (a close male relative or spouse)."
قَالَ رَسُولُ اللهِ ﷺ لَا تُسَافِرِ امْرَأَةٌ ثَلَاثَةَ أَيَّامٍ فَصَاعِدًا إِلَّا مَعَ أَبِيهَا أَوِ ابْنِهَا أَوْ أَخِيهَا أَوْ زَوْجِهَا أَوْ ذِي مَحْرَمٍ
39.88 [Machine] What the man looks at and what the woman looks at and each leads to its owner.
٣٩۔٨٨ بَابُ مَا جَاءَ فِي الرَّجُلِ يَنْظُرُ إِلَى عَوْرَةِ الرَّجُلِ وَالْمَرْأَةِ تَنْظُرُ إِلَى عَوْرَةِ الْمَرْأَةِ وَيُفْضِي كُلُّ وَاحِدٍ مِنْهُمَا إِلَى صَاحِبِهِ
[Machine] The Messenger of Allah ﷺ forbade a woman to have intimate relations with another woman while wearing one garment, in order to describe her to her husband as if he is looking at her. And he forbade us, when we are three, for two to have a private conversation excluding the third, in order not to make them sad until the people mix together.
نَهَى رَسُولُ اللهِ ﷺ أَنْ تُبَاشِرَ الْمَرْأَةُ الْمَرْأَةَ فِي ثَوْبٍ وَاحِدٍ أَجْلَ أَنْ تَصِفَهَا لِزَوْجِهَا حَتَّى كَأَنَّهُ يَنْظُرُ إِلَيْهَا وَنَهَانَا إِذَا كُنَّا ثَلَاثًا أَنْ يُنَاجِيَ اثْنَانِ دُونَ وَاحِدٍ مِنْ أَجْلِ أَنْ يُحْزِنَهُ حَتَّى يَخْتَلِطَ النَّاسُ
The Prophet ﷺ said: A man should not look at the private parts of another man, and a woman should not look at the private parts of another woman. A man should not lie with another man without wearing lower garment under one cover; and a woman should not be lie with another woman without wearing lower garment under one cover. أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَنْظُرُ الرَّجُلُ إِلَى عَوْرَةِ الرَّجُلِ وَلَا تَنْظُرُ الْمَرْأَةُ إِلَى عَوْرَةِ الْمَرْأَةِ وَلَا يُفْضِي الرَّجُلُ إِلَى الرَّجُلِ فِي الثَّوْبِ وَلَا تُفْضِي الْمَرْأَةُ إِلَى الْمَرْأَةِ فِي الثَّوْبِ
The Prophet ﷺ said: A man should not lie with another man and a woman should not lie with another woman without covering their private parts except a child or a father. He also mentioned a third thing which I forgot. (Using translation from Abū Dāʾūd 4019)
قَالَ رَسُولُ اللهِ ﷺ لَا يُفْضِيَنَّ رَجُلٌ إِلَى رَجُلٍ وَلَا امْرَأَةٌ إِلَى امْرَأَةٍ إِلَّا وَلَدٌ أَوْ وَالِدٌ قَالَ فَذَكَرَ الثَّالِثَةَ فَنَسِيتُهَا
[Machine] That the Messenger of Allah ﷺ said, "May Allah curse the one who looks at and the one who is looked at. Indeed, this is a form of adultery, and Allah, exalted be He, knows best."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَعَنَ اللهُ النَّاظِرَ وَالْمَنْظُورَ إِلَيْهِ هَذَا مُرْسَلٌ وَاللهُ سُبْحَانَهُ أَعْلَمُ
39.89 [Machine] What is mentioned regarding the gaze towards the young boy with desire?
٣٩۔٨٩ بَابُ مَا جَاءَ فِي النَّظَرِ إِلَى الْغُلَامِ الْأَمْرَدِ بِالشَّهْوَةِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {قُلْ لِلْمُؤْمِنِينَ يَغُضُّوا مِنْ أَبْصَارِهِمْ وَيَحْفَظُوا فُرُوجَهُمْ} [النور: 30]
[Machine] To limit looking at the beautiful face of the green-eyed boy, which has been narrated from Bakka bin Nafe' and he is weak, from Abu Salama, from Abu Hurayrah as marfu' with some of its meaning. The well-known narration is from Bakka bin Nafe' as we mentioned. Abu Hafs Umar al-Tahan narrated it in its meaning as a fabricated hadith from Thawri, from Al-A'mash, from Abu Salih, from Abu Hurayrah, marfu'. And in what we mentioned from the verse, it is sufficient without the need for further clarification, and its temptation is evident. And with Allah is the success, and Allah knows best.
أَنْ يُحَدَّ النَّظَرُ إِلَى الْغُلَامِ الْأَمْرَدِ الْجَمِيلِ الْوَجْهِ وَقَدْ رُوِيَ هَذَا عَنْ بَقِيَّةَ عَنِ الْوَزَّاعِ بْنِ نَافِعٍ وَهُوَ ضَعِيفٌ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ ؓ مَرْفُوعًا بِبَعْضِ مَعْنَاهُ وَالْمَشْهُورُ عَنْ بَقِيَّةَ مَا ذَكَرْنَاهُ وَرَوَى أَبُو حَفْصٍ عُمَرُ الطَّحَّانُ فِي مَعْنَاهُ حَدِيثًا مَوْضُوعًا عَنِ الثَّوْرِيِّ عَنِ الْأَعْمَشِ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ ؓ مَرْفُوعًا وَفِيمَا ذَكَرْنَا مِنَ الْآيَةِ غُنْيَةٌ عَنْ غَيْرِهَا وَفِتْنَتُهُ ظَاهِرَةٌ لَا تَحْتَاجُ إِلَى خَبَرٍ يُبَيِّنُهَا وَبِاللهِ تَعَالَى التَّوْفِيقُ وَاللهُ سُبْحَانَهُ أَعْلَمُ
39.90 [Machine] What was said during the handshake between the man and the man.
٣٩۔٩٠ بَابُ مَا جَاءَ فِي مُصَافَحَةِ الرَّجُلِ الرَّجُلَ
[Machine] I asked Anas ibn Malik, "Was shaking hands a common practice among the companions of the Messenger of Allah?" He replied, "Yes."
سَأَلْتُ أَنَسَ بْنَ مَالِكٍ ؓ قُلْتُ أَكَانَتِ الْمُصَافَحَةُ فِي أَصْحَابِ رَسُولِ اللهِ ﷺ؟ قَالَ نَعَمْ
[Machine] The Messenger of Allah, ﷺ , said, "When two Muslims meet and shake hands, they should praise and seek forgiveness from Allah, and their sins will be forgiven." This was narrated by Abu Dawood in Sunan from Amr ibn Awf, from Hushaym, except that he said it was from Zaid, the father of Hakam al-Utaibi. Abu Ali al-Ruwaybari told us, who informed us that Abu Bakr ibn Dasah narrated to us, who learned it from Abu Dawood, who learned it from Amr ibn Awf, and he mentioned it.
قَالَ رَسُولُ اللهِ ﷺ إِذَا الْتَقَى الْمُسْلِمَانِ فَتَصَافَحَا فَحَمِدَا اللهَ وَاسْتَغْفَرَاهُ غُفِرَ لَهُمَا 13570 وَرَوَاهُ أَبُو دَاوُدَ فِي السُّنَنِ عَنْ عَمْرِو بْنِ عَوْنٍ عَنْ هُشَيْمٍ إِلَّا أَنَّهُ قَالَ عَنْ زَيْدٍ أَبِي الْحَكَمِ الْعَنَزِيِّ أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أَنْبَأَ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا عَمْرُو بْنُ عَوْنٍ فَذَكَرَهُ
The Prophet ﷺ said: Two Muslims will not meet and shake hands having their sins forgiven them before they separate. (Using translation from Abū Dāʾūd 5212)
قَالَ رَسُولُ اللهِ ﷺ مَا مِنْ مُسْلِمَيْنِ يَلْتَقِيَانِ فَيَتَصَافَحَانِ إِلَّا غُفِرَ لَهُمَا قَبْلَ أَنْ يَتَفَارَقَا
39.91 [Machine] What is involved in the embrace between a man and a man, if it does not lead to arousing desire?
٣٩۔٩١ بَابُ مَا جَاءَ فِي مُعَانَقَةِ الرَّجُلِ الرَّجُلَ، إِذَا لَمْ تَكُنْ مُؤَدِّيَةً إِلَى تَحْرِيكِ شَهْوَةٍ
Ayyub ibn Bushayr ibn Ka'b al-Adawi quoted a man of Anazah who said that he asked AbuDharr when he left Syria: I wish to ask you about a tradition of the Messenger of Allah ﷺ. He said: I shall tell you except that it is something secret. Did the Messenger of Allah ﷺ shake hands with you when you met him? He replied: I never met him without his shaking hands with me. One day he sent for me when I was not at home. When I came I was informed that he had sent for me. I came to him and found him on a couch. He embraced me and that was better and better. (Using translation from Abū Dāʾūd 5214)
أَنَّهُ قَالَ لِأَبِي ذَرٍّ ؓ حَيْثُ سُيِّرَ مِنَ الشَّامِ إِنِّي أُرِيدُ أَنْ أَسْأَلَكَ عَنْ حَدِيثٍ مِنْ حَدِيثِ رَسُولِ اللهِ ﷺ قَالَ إِذًا أُخْبِرُكَ بِهِ إِلَّا أَنْ يَكُونَ سِرًّا قُلْتُ إِنَّهُ لَيْسَ بِسِرٍّ هَلْ كَانَ رَسُولُ اللهِ ﷺ يُصَافِحُكُمْ إِذْ لَقِيتُمُوهُ؟ قَالَ مَا لَقِيتُهُ قَطُّ إِلَّا صَافَحَنِي وَبَعَثَ إِلِيَّ ذَاتَ يَوْمٍ وَلَمْ أَكُنْ فِي أَهْلِي فَلَمَّا جِئْتُ أُخْبِرْتُ أَنَّهُ أَرْسَلَ إِلِيَّ فَأَتَيْتُهُ وَهُوَ عَلَى سَرِيرِهِ فَالْتَزَمَنِي فَكَانَتْ تِلْكَ الْحَالَةُ أَجْوَدَ وَأَجْوَدَ
[Machine] It was said, "O Messenger of Allah, should we greet each other when we meet?" He said, "No." He said, "Should we hold each other's hands?" He said, "No." He said, "Should we shake hands?" He said, "Yes, and this is something that Hanzhala As-Sudai used to do exclusively, and it was left by Yahya Al-Qattan to imitate him. And Allah knows best."
قِيلَ يَا رَسُولَ اللهِ أَيَنْحَنِي بَعْضُنَا لِبَعْضٍ إِذَا الْتَقَيْنَا؟ قَالَ لَا قَالَ فَيَلْتَزِمُ بَعْضُنَا بَعْضًا؟ قَالَ لَا قَالَ فَيُصَافِحُ بَعْضُنَا بَعْضًا؟ قَالَ نَعَمْ وَهَذَا يَتَفَرَّدُ بِهِ حَنْظَلَةُ السَّدُوسِيُّ وَقَدْ كَانَ اخْتَلَطَ تَرَكَهُ يَحْيَى الْقَطَّانُ لِاخْتِلَاطِهِ وَاللهُ أَعْلَمُ
الشَّعْبِيِّ
[Machine] The companions of Muhammad ﷺ used to shake hands when they met, and when they returned from a journey, they would embrace each other. And Allah knows best.
كَانَ أَصْحَابُ مُحَمَّدٍ ﷺ إِذَا الْتَقَوْا صَافَحُوا فَإِذَا قَدِمُوا مِنْ سَفَرٍ عَانَقَ بَعْضُهُمْ بَعْضًا وَاللهُ أَعْلَمُ
39.92 [Machine] What came in the man's kiss?
٣٩۔٩٢ بَابُ مَا جَاءَ فِي قُبْلَةِ الرَّجُلِ وَلَدَهُ
[Machine] Allah's Peace and blessings be upon him, the Prophet ﷺ kissed al-Hasan bin Ali and al-Aqra' bin Habis al-Tamimi was sitting with him. Al-Aqra' bin Habis said, "O Messenger of Allah, I have ten children and I have never kissed any of them." So the Messenger of Allah ﷺ looked at him and said, "Whoever does not show mercy will not be shown mercy."
اللهِ ﷺ قَبَّلَ الْحَسَنَ بْنَ عَلِيٍّ ؓ وَالْأَقْرَعُ بْنُ حَابِسٍ التَّمِيمِيُّ جَالِسٌ عِنْدَهُ فَقَالَ الْأَقْرَعُ بْنُ حَابِسٍ يَا رَسُولَ اللهِ إِنَّ لِي عَشَرَةً مِنَ الْوَلَدِ مَا قَبَّلْتُ مِنْهُمْ إِنْسَانًا قَطُّ قَالَ فَنَظَرَ إِلَيْهِ رَسُولُ اللهِ ﷺ فَقَالَ إِنَّ مَنْ لَا يَرْحَمُ لَا يُرْحَمُ
[Machine] An Arab man came to the Prophet ﷺ and said, "Do you accept young children?" The Messenger of Allah ﷺ replied, "Would I have power over Allah to remove mercy from your heart?"
جَاءَ أَعْرَابِيٌّ إِلَى النَّبِيِّ ﷺ فَقَالَ أَتُقَبِّلُونَ الصِّبْيَانَ فَمَا نُقَبِّلُهُمْ فَقَالَ رَسُولُ اللهِ ﷺ أَوَأَمْلِكُ لَكَ أَنْ نَزَعَ اللهُ الرَّحْمَةَ مِنْ قَلْبِكَ
