١٣۔ كِتَابُ الْبُيُوعِ ص ٣
Dates are to be paid for by dates, wheat by wheat, barley by barley, salt by salt, like for like, payment being made on the spot. He who made an addition or demanded an addition, in fact, dealt in usury except in case where their classes differ. (Using translation from Muslim 1588a)
قَالَ رَسُولُ اللهِ ﷺ التَّمْرُ بِالتَّمْرِ وَالْحِنْطَةُ بِالْحِنْطَةِ وَالشَّعِيرُ بِالشَّعِيرِ وَالْمِلْحُ بِالْمِلْحِ مِثْلًا بِمِثْلٍ يَدًا بِيَدٍ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أَرْبَى إِلَّا مَا اخْتَلَفَتْ أَلْوَانُهُ
[Machine] I heard the Messenger of Allah ﷺ saying, "Exchange gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates, and salt for salt, like for like, equal for equal, hand to hand. If the types differ, then sell as you wish, as long as it is hand to hand. Gold may be exchanged for silver however you please, wheat may be exchanged for barley however you please, and salt may be exchanged for dates however you please."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ بِيعُوا الذَّهَبَ بِالذَّهَبِ وَالْفِضَّةَ بِالْفِضَّةِ وَالْبُرَّ بِالْبُرِّ وَالشَّعِيرَ بِالشَّعِيرِ وَالتَّمْرَ بِالتَّمْرِ وَالْمِلْحَ بِالْمِلْحِ سَوَاءً بِسَوَاءٍ مِثْلًا بِمِثْلٍ فَمَنْ زَادَ وَاسْتَزَادَ فَقَدْ أَرْبَى فَإِذَا اخْتَلَفَ هَذِهِ الْأَصْنَافُ فَبِيعُوهَا يَدًا بِيَدٍ كَيْفَ شِئْتُمْ لَا بَأْسَ بِهِ الذَّهَبُ بِالْفِضَّةِ يَدًا بِيَدٍ كَيْفَ شِئْتُمْ وَالْبُرُّ بِالشَّعِيرِ يَدًا بِيَدٍ كَيْفَ شِئْتُمْ وَالْمِلْحُ بِالتَّمْرِ يَدًا بِيَدٍ كَيْفَ شِئْتُمْ
[Machine] Buy some barley with it and he went to take a Sa' (a measure of weight) and an additional amount of some Sa', so when Ma'mar came to know about this, he said to him, "Why did you do that?" "Go and return it, and only take a like for a like, for I used to hear the Messenger of Allah ﷺ say: 'Food is by a like for a like,' and our food at that time was barley. It was said to him: 'But there is nothing like it.' He said: 'I fear that it may be competed with.'"
بِعْ ثُمَّ اشْتَرِ بِهِ شَعِيرًا فَذَهَبَ يَأْخُذُ صَاعًا وَزِيَادَةَ بَعْضِ صَاعٍ فَلَمَّا جَاءَ مَعْمَرٌ أَخْبَرَهُ بِذَلِكَ فَقَالَ لَهُ مَعْمَرٌ لِمَ فَعَلْتَ ذَلِكَ؟ انْطَلِقْ فَرُدَّهُ وَلَا تَأْخُذَنَّ إِلَّا مِثْلًا بِمِثْلٍ فَإِنِّي كُنْتُ أَسْمَعُ مِنْ رَسُولِ اللهِ ﷺ يَقُولُ الطَّعَامُ بِالطَّعَامِ مِثْلًا بِمِثْلٍ وَكَانَ طَعَامُنَا يَوْمَئِذٍ شَعِيرًا قِيلَ فَإِنَّهُ لَيْسَ مِثْلَهُ قَالَ فَإِنِّي أَخَافُ أَنْ يُضَارِعَ
13.19 [Machine] The Contraction in Exchange in the Council, and its Meaning of Selling Food to Each Other
١٣۔١٩ بَابُ التَّقَابُضِ فِي الْمَجْلِسِ فِي الصَّرْفِ , وَمَا فِي مَعْنَاهُ مِنْ بَيْعِ الطَّعَامِ بَعْضِهِ بِبَعْضٍ
[Machine] Show us the gold until the treasurer comes, then come and take your paper. Umar ibn Al-Khattab said, "No, by the One in Whose hand is my soul, you will either return his gold to him or cut off his paper. For I heard the Messenger of Allah ﷺ saying, 'Gold with gold is usury, except for this and this, barley with barley is usury, except for this and this, dates with dates is usury, except for this and this.' Qutaibah said, "Talhah ibn 'Ubaidullah said while he was with Umar ibn Al-Khattab, 'The Messenger of Allah ﷺ said it.'"
أَرِنَا الذَّهَبَ حَتَّى يَأْتِيَ الْخَازِنُ ثُمَّ تَعَالَ فَخُذْ وَرِقَكَ فَقَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ كَلَّا وَالَّذِي نَفْسِي بِيَدِهِ لَتَرُدَّنَّ إِلَيْهِ ذَهَبَهُ أَوْ لَتَنْقُدَنَّهُ وَرِقَهُ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الذَّهَبُ بِالْوَرِقِ رِبًا إِلَّا هَا وَهَا وَالْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَا وَهَا وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَا وَهَا وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَا وَهَا وَقَالَ قُتَيْبَةُ فَقَالَ طَلْحَةُ بْنُ عُبَيْدِ اللهِ وَهُوَ عِنْدَ عُمَرَ بْنِ الْخَطَّابِ ؓ وَقَالَ فَإِنَّ رَسُولَ اللهِ ﷺ قَالَهُ
[Machine] I heard the Messenger of Allah ﷺ say, "Gold taken in exchange for gold is usury, except for this and this." And barley taken in exchange for barley is usury, except for this and this. And dates taken in exchange for dates is usury, except for this and this." Sufyan said, "When Al-Zuhri came to us, I asked him about this narration, but he did not mention it. And I heard Al-Zuhri say, 'I heard Malik ibn Aws ibn Hadathan Al-Nasri say, "I heard Umar ibn Al-Khattab say, 'I heard the Messenger of Allah ﷺ say, "Gold taken in exchange for gold is usury," and he repeated the statement twice. Sufyan said, 'This is the most authentic narration reported from the Prophet ﷺ regarding this issue, meaning regarding the ruling of usury in exchange transactions. And Sufyan may have said, 'Al-Zuhri informed us, saying, 'Malik narrated to me, and he included it in the authentic collection from the narration of Sufyan in a summarized form."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الذَّهَبُ بِالْوَرِقِ رِبًا إِلَّا هَا وَهَا وَالْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَا وَهَا وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَا وَهَا وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَا وَهَا وَقَالَ سُفْيَانُ فَلَمَّا جَاءنا الزُّهْرِيُّ تَفَقَّدْتُهُ فَلَمْ يَذْكُرْ هَذَا الْكَلَامَ وَقَالَ سَمِعْتُ الزُّهْرِيَّ يَقُولُ سَمِعْتُ مَالِكَ بْنَ أَوْسِ بْنِ الْحَدَثَانِ النَّصْرِيَّ يَقُولُ سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ ؓ يَقُولُ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الذَّهَبُ بِالْوَرِقِ رِبًا فَذَكَرَهُ مِثْلَهُ سَوَاءً قَالَ سُفْيَانُ وَهَذَا أَصَحُّ حَدِيثٍ رُوِيَ عَنِ النَّبِيِّ ﷺ فِي هَذَا يَعْنِي فِي الصَّرْفِ وَرُبَّمَا قَالَ سُفْيَانُ فِيهِ حَدَّثَنَا الزُّهْرِيُّ قَالَ أَخْبَرَنِي مَالِكٌ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ سُفْيَانَ مُخْتَصَرًا
[Machine] I heard the Messenger of Allah ﷺ say that exchanging like for like is not usury, except in the case of paper for paper, gold for gold, wheat for wheat, and barley for barley. This is mentioned in this narration: "Exchanging like for like" and the narration of the group in the raised hadith, as mentioned before.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الْوَرِقُ بِالْوَرِقِ رِبًا إِلَّا هَا وَهَا وَالذَّهَبُ بِالذَّهَبِ رِبًا إِلَّا هَا وَهَا وَالْحِنْطَةُ بِالْحِنْطَةِ رِبًا إِلَّا هَا وَهَا وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَا وَهَا كَذَا فِي هَذِهِ الرِّوَايَةِ الْوَرِقُ بِالْوَرِقِ وَالذَّهَبُ بِالذَّهَبِ وَرِوَايَةُ الْجَمَاعَةِ فِي الْحَدِيثِ الْمَرْفُوعِ كَمَا مَضَى
[Machine] He said, "Umar ibn al-Khattab said, 'Do not sell gold for gold except equal to equal, and do not sell paper for paper except equal to equal, and do not sell paper for gold, one of which is absent and the other is present. And if he asks you to wait until he enters his house, do not wait for him except hand in hand.' And this, I fear for you the sin of usury."
أَنَّهُ قَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تَبِيعُوا الْوَرِقَ بِالذَّهَبِ أَحَدُهُمَا غَائِبٌ وَالْآخَرُ نَاجِزٌ وَإنِ اسْتَنْظَرَكَ حَتَّى يَلِجَ بَيْتَهُ فَلَا تُنْظِرْهُ إِلَّا يَدًا بِيَدٍ هَاتِ وَهَذَا إِنِّي أَخْشَى عَلَيْكُمُ الرِّبَا
Gold is to be paid for by gold, silver by silver, wheat by wheat, barley by barley, dates by dates, and salt by salt, like for like and equal for equal, payment being made hand to hand. عَنِ النَّبِيِّ ﷺ قَالَ الذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ مِثْلًا بِمِثْلٍ فَإِذَا اخْتَلَفَتْ هَذِهِ الْأَصْنَافُ فَبِيعُوا كَيْفَ شِئْتُمْ إِذَا كَانَ يَدًا بِيَدٍ
13.20 [Machine] The extraction of gold from paper.
١٣۔٢٠ بَابُ اقْتِضَاءِ الذَّهَبِ مِنَ الْوَرِقِ
I used to sell camels at al-Baqi for dinars and take dirhams for them, and sell for dirhams and take dinars for them. I would take these for these and give these for these. I went to the Messenger of Allah ﷺ who was in the house of Hafsah. I said: Messenger of Allah , take it easy, I shall ask you (a question): I sell camels at al-Baqi'. I sell (them) for dinars and take dirhams and I sell for dirhams and take dinars. I take these for these, and give these for these. The Messenger of Allah ﷺ then said: There is no harm in taking them at the current rate so long as you do not separate leaving something to be settled. (Using translation from Abū Dāʾūd 3354)
كُنْتُ أَبِيعُ الْإِبِلَ فِي الْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ وَأَبِيعُ بِالدَّرَاهِمِ وَآخُذُ الدَّنَانِيرَ فَوَقَعَ فِي نَفْسِي مِنْ ذَلِكَ فَأَتَيْتُ رَسُولَ اللهِ ﷺ وَهُوَ فِي بَيْتِ حَفْصَةَ أَوْ قَالَ حِينَ خَرَجَ مِنْ بَيْتِ حَفْصَةَ فَقُلْتُ يَا رَسُولَ اللهِ رُوَيْدَكَ أَسْأَلُكَ إِنِّي أَبِيعُ الْإِبِلَ بِالْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ وَأَبِيعُ بِالدَّرَاهِمِ وَآخُذُ الدَّنَانِيرَ فَقَالَ لَا بَأْسَ أَنْ تَأْخُذَهَا بِسِعْرِ يَوْمِهَا مَا لَمْ تَفَرَّقَا وَبَيْنَكُمَا شَيْءٌ وَبِهَذَا الْمَعْنَى
[Machine] I used to sell camels in al-Baqi' and people would bring me dirhams and I would sell them to a man for dinars, and he would give them to me tomorrow. So, I went to the Messenger of Allah ﷺ and asked him about this. He said, "If you sell something to a man for gold or silver, do not separate from him until the transaction is completed, and there is some kind of clothing between you." It is narrated in one of the two narrations from Isra'il from Simak and from Abu Al-Ahwas from Simak, and the hadith is unique in its elevation of Simak bin Harb [as the transmitter] from Sa'id bin Jubair among the companions of Ibn 'Umar.
كُنْتُ أَبِيعُ الْإِبِلَ بِالْبَقِيعِ فَيَجْتَمِعُ عِنْدِي مِنَ الدَّرَاهِمِ فَأَبِيعُهَا مِنَ الرَّجُلِ بِالدَّنَانِيرِ وَيُعْطِينِيهَا لِلْغَدِ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَسَأَلْتُهُ عَنْ ذَلِكَ فَقَالَ إِذَا بَايَعْتَ الرَّجُلَ بِالذَّهَبِ وَالْفِضَّةِ فَلَا تُفَارِقْهُ وَبَيْنَكُمَا لُبْسٌ وَبِقَرِيبٍ مِنْ مَعْنَاهُ رُوِيَ فِي إِحْدَى الرِّوَايَتَيْنِ عَنْ إِسْرَائِيلَ عَنْ سِمَاكٍ وَعَنْ أَبِي الْأَحْوَصِ عَنْ سِمَاكٍ وَالْحَدِيثُ يَنْفَرِدُ بِرَفْعِهِ سِمَاكُ بْنُ حَرْبٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ مِنْ بَيْنِ أَصْحَابِ ابْنِ عُمَرَ
13.21 [Machine] The flow of usury in everything that is given as proof by what
١٣۔٢١ بَابُ جَرَيَانِ الرِّبَا فِي كُلِّ مَا يَكُونُ مَطْعُومًا اسْتِدْلَالًا بِمَا:
[Machine] I hear the Messenger of Allah ﷺ saying, "Food is like food, equal to each other."
أَسْمَعُ رَسُولَ اللهِ ﷺ يَقُولُ الطَّعَامُ بِالطَّعَامِ مِثْلًا بِمِثْلٍ
[Machine] The Messenger of Allah ﷺ cursed the one who consumes interest and the one who feeds it to others. He said, "I asked about its witness and its writer, and it was said that we only narrate what we have heard."
لَعَنَ رَسُولُ اللهِ ﷺ آكِلَ الرِّبَا وَمُؤْكِلَهُ قَالَ قُلْتُ وَشَاهِدَيْهِ وَكَاتِبَهُ قَالَ إِنَّمَا نُحَدِّثُ بِمَا سَمِعْنَا
[Machine] The Prophet ﷺ forbade measuring dates with dates, raisins with grapes, and crops with wheat.
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ ثَمَرِ النَّخْلِ بِالتَّمْرِ كَيْلًا وَالزَّبِيبِ بِالْعِنَبِ كَيْلًا وَالزَّرْعِ بِالْحِنْطَةِ كَيْلًا
13.22 [Machine] Whoever said that riba is involved in everything that is measured and weighed
١٣۔٢٢ بَابُ مَنْ قَالَ بِجَرَيَانِ الرِّبَا فِي كُلِّ مَا يُكَالُ وَيُوزَنُ
[Machine] That the Messenger of Allah ﷺ sent a brother from the Ansar to lead them to Khaibar, so he brought dates in a bag. The Messenger of Allah ﷺ said to him, "Is it the case that the people of Khaibar eat such dates?" He said, "No, By Allah, O Messenger of Allah, we buy a Sa'a with two Sa'a from Al-Jam'." The Messenger of Allah ﷺ said, "Do not do that, but sell this and buy with its price from that." And that is how the scale works.
أَنَّ رَسُولَ اللهِ ﷺ بَعَثَ أَخَا بَنِي عَدِيٍّ الْأَنْصَارِيِّ فَاسْتَعْمَلَهُ عَلَى خَيْبَرَ فَقَدِمَ بِتَمْرٍ جَنِيبٍ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ أَكُلُّ تَمْرِ خَيْبَرَ هَكَذَا؟ قَالَ لَا وَاللهِ يَا رَسُولَ اللهِ إِنَّمَا نَشْتَرِي الصَّاعَ بِالصَّاعَيْنِ مِنَ الْجَمْعِ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَفْعَلُوا وَلَكِنْ مِثْلًا بِمِثْلٍ أَوْ تَبِيعُوا هَذَا وَاشْتَرُوا بِثَمَنِهِ مِنْ هَذَا وَكَذَلِكَ الْمِيزَانُ
[Machine] One day, while he was with his wife Umm Salama, the Messenger of Allah ﷺ said, "I am craving for a date called 'Ajwah.' Someone has sent two sa' (a measurement) of old dates to the house of a man from the Ansar. So I have been brought a substitute of one sa' of 'Ajwah' dates." Umm Salama presented it to the Messenger of Allah ﷺ , and he liked it. He ate one date and then held it in his hand, saying, "Where did you get this from?" She replied, "I sent two sa' of old dates to the house of so-and-so, and we exchanged them for this one sa' of 'Ajwah' dates." Then the Messenger of Allah ﷺ threw the date from his hand and said, "Return it, return it. I have no need for it. Dates are to be exchanged for dates, wheat for wheat, barley for barley, gold for gold, and silver for silver, in equal amounts and hand to hand. There should be no increase or decrease, so whoever gives or takes more has engaged in riba. And whatever is measured or weighed, Ibn 'Abbas said, "O Abu Sa'id, you reminded me of something I had forgotten. I seek Allah's forgiveness and repent to Him." Afterward, he strongly prohibited engaging in riba.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ ذَاتَ يَوْمٍ وَهُوَ عِنْدَ زَوْجَتِهِ أُمِّ سَلَمَةَ إِنِّي أَشْتَهِي تَمْرَ عَجْوَةٍ وَإِنَّهَا بَعَثَتْ بِصَاعَيْنِ مِنْ تَمْرٍ عَتِيقٍ إِلَى مَنْزِلِ رَجُلٍ مِنَ الْأَنْصَارِ فَأُتِيَتْ بَدَلَهُمَا بِصَاعٍ مِنْ عَجْوَةٍ فَقَدَّمَتْهُ إِلَى رَسُولِ اللهِ ﷺ فَأَعْجَبَهُ فَتَنَاوَلَ تَمْرَةً ثُمَّ أَمْسَكَ فَقَالَ مِنْ أَيْنَ لَكُمْ هَذَا؟ قَالَتْ بَعَثْتُ بِصَاعَيْنِ مِنْ تَمْرٍ عَتِيقٍ إِلَى مَنْزِلِ فُلَانٍ فَأَتَيْنَا بَدَلَهُمَا مِنْ هَذَا الصَّاعِ الْوَاحِدِ فَأَلْقَى التَّمْرَةَ مِنْ يَدِهِ وَقَالَ رُدُّوهُ رُدُّوهُ لَا حَاجَةَ لِي فِيهِ التَّمْرُ بِالتَّمْرِ وَالْحِنْطَةُ بِالْحِنْطَةِ وَالشَّعِيرُ بِالشَّعِيرِ وَالذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ يَدًا بِيَدٍ مِثْلًا بِمِثْلٍ لَيْسَ فِيهِ زِيَادَةٌ وَلَا نُقْصَانٌ فَمَنْ زَادَ أَوْ نَقَصَ فَقَدْ أَرْبَى وَكُلُّ مَا يُكَالُ أَوْ يُوزَنُ فَقَالَ ابْنُ عَبَّاسٍ ذَكَّرْتَنِي يَا أَبَا سَعِيدٍ أَمْرًا أُنْسِيتُهُ أَسْتَغْفِرُ اللهَ وَأَتُوبُ إِلَيْهِ وَكَانَ يَنْهَى بَعْدَ ذَلِكَ أَشَدَّ النَّهْيِ
[Machine] Abu Ahmad (father of Ahmad) this hadith is from the narration of Abu Majlaz who was distinguished by Hayyan. I said: Hayyan, did you speak about it? It is said about his saying and likewise, Al-Mizan in the first hadith is from Abu Sa'id al-Khudri. And likewise, this word, if it is correct, is deduced by the narration of Dawud bin Abi Hind from Abu Nadrah from Abu Sa'id al-Khudri in his argument against Ibn 'Abbas with the story of dates. He said: The Messenger of Allah, ﷺ , said: "If you wish to do that, then sell your dates for goods, then buy with your goods any dates you want." Abu Sa'id said: "So, are dates with dates more rightful to be a riba (usury) or silver with silver?" So, this was a qiyas (analogy) from Abu Sa'id for silver on dates, on which a story was narrated, except that some of..
أَبُو أَحْمَدَ هَذَا الْحَدِيثُ مِنْ حَدِيثِ أَبِي مِجْلَزٍ تَفَرَّدَ بِهِ حَيَّانُ قُلْتُ حَيَّانُ تَكَلَّمُوا فِيهِ وَيُقَالُ فِي قَوْلِهِ وَكَذَلِكَ الْمِيزَانُ فِي الْحَدِيثِ الْأَوَّلِ أَنَّهُ مِنْ جِهَةِ أَبِي سَعِيدٍ الْخُدْرِيِّ وَكَذَلِكَ هَذِهِ اللَّفْظَةُ إِنْ صَحَّتْ وَيُسْتَدَلُّ عَلَيْهِ بِرِوَايَةِ دَاوُدَ بْنِ أَبِي هِنْدَ عَنْ أَبِي نَضْرَةَ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ فِي احْتِجَاجِهِ عَلَى ابْنِ عَبَّاسٍ بِقِصَّةِ التَّمْرِ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ أَرْبَيْتَ إِذَا أَرَدْتَ ذَلِكَ فَبِعْ تَمْرَكَ بِسِلْعَةٍ ثُمَّ اشْتَرِ بِسِلْعَتِكَ أِيَّ تَمْرٍ شِئْتَ قَالَ أَبُو سَعِيدٍ فَالتَّمْرُ بِالتَّمْرِ أَحَقُّ أَنْ يَكُونَ رِبًا أَمِ الْفِضَّةُ بِالْفِضَّةِ؟ فَكَانَ هَذَا قِيَاسًا مِنْ أَبِي سَعِيدٍ لِلْفِضَّةِ عَلَى التَّمْرِ الَّذِي رُوِيَ فِيهِ قِصَّةٌ إِلَّا أَنَّ بَعْضَ الرُّوَاةِ
[Machine] Sa'id ibn al-Musayyib said: "Indeed, usury is only found in gold, silver, and in what can be measured and weighed of what is consumed and drunk."
قَالَ سَعِيدُ بْنُ الْمُسَيِّبِ إِنَّ الرِّبَا إِنَّمَا هُوَ فِي الذَّهَبِ وَالْفِضَّةِ وَفِيمَا يُكَالُ وَيُوزَنُ مِمَّا يُؤْكَلُ وَيُشْرَبُ
13.23 [Machine] No interest in what is spent on food, drinks, gold, and silver
١٣۔٢٣ بَابُ: لَا رِبَا فِيمَا خَرَجَ مِنَ الْمَأْكُولِ وَالْمَشْرُوبِ وَالذَّهَبِ وَالْفِضَّةِ
“A slave came and gave his pledge to the Prophet ﷺ, pledging to emigrate, and the Prophet ﷺ did not realize that he was a slave. Then his master came looking for him, and the Prophet ﷺ said: ‘Sell him to me,’ and he brought him in exchange for two black slaves. Then after that he did not accept the pledge from anyone until he had asked whether he was a slave.” (Using translation from Ibn Mājah 2869)
جَاءَ عَبْدٌ فَبَايَعَ النَّبِيَّ ﷺ عَلَى الْهِجْرَةِ وَلَمْ يَشْعُرْ أَنَّهُ عَبْدٌ فَجَاءَ سَيِّدُهُ يُرِيدُهُ فَقَالَ لَهُ النَّبِيُّ ﷺ بِعْنِيهِ فَاشْتَرَاهُ بِعَبْدَيْنِ أَسْوَدَيْنِ ثُمَّ لَمْ يُبَايِعْ أَحَدًا بَعْدُ حَتَّى يَسْأَلَهُ أَعَبْدٌ هُوَ؟
[Machine] That the Prophet ﷺ bought a yellow camel from the tribe of Kalbi for seven dirhams.
أَنَّ النَّبِيَّ ﷺ اشْتَرَى صَفِيَّةَ مِنْ دِحْيَةَ الْكَلْبِيِّ بِسَبْعَةِ أَرْؤُسٍ
[Machine] "And he said, 'I will bring you the other one tomorrow, relaxed, God willing.'"
وَقَالَ آتِيكَ بِالْآخَرِ غَدًا رَهْوًا إِنْ شَاءَ اللهُ تَعَالَى
[Machine] About the contents, mixtures, and rope of the rope.
عَنِ الْمَضَامِينِ وَالْمَلَاقِيحِ وَحَبَلِ الْحَبَلَةِ
[Machine] Allah knows best, but it seems they were trading shields with one another.
اللهُ أَعْلَمُ أَمَّا هُمْ فَكَانُوا يَتَبَايَعُونَ الدِّرْعَ بِالْأَدْرُعِ
[Machine] Saeed Al-Qaddah, there is no harm in borrowing money.
سَعِيدٌ الْقَدَّاحُ لَا بَأْسَ بِالسَّلَفِ فِي الْفُلُوسِ
13.24 [Machine] The Sale of Animals and Other Goods That Contain Usury Amongst Each Other Is Unlawful
١٣۔٢٤ بَابُ بَيْعِ الْحَيَوَانِ وَغَيْرِهِ مِمَّا لَا رِبَا فِيهِ بَعْضُهُ بِبَعْضٍ نَسِيئَةً
[Machine] The Messenger of Allah ﷺ commanded me to prepare an army, and the camels ran short. So, I said, "O Messenger of Allah, the camels have run short." He said, "Take from the sadaqah (charity) animals fit for transport." He said, "I took two camels and went with them to the sadaqah animals." The scholar (narrator) differed regarding Muhammad bin Ishaq in his chain of narration, and Hammad bin Salamah is considered the most trustworthy among them, and he has an authentic witness.
أَمَرَنِي رَسُولُ اللهِ ﷺ أَنْ أُجَهِّزَ جَيْشًا فَنَفِدَتِ الْإِبِلُ فَقُلْتُ يَا رَسُولَ نَفِدَتِ الْإِبِلُ فَقَالَ خُذْ فِي قِلَاصِ الصَّدَقَةِ قَالَ فَجَعَلْتُ آخُذُ الْبَعِيرَ بِالْبَعِيرَيْنِ إِلَى إِبِلِ الصَّدَقَةِ قَالَ الشَّيْخُ اخْتَلَفُوا عَلَى مُحَمَّدِ بْنِ إِسْحَاقَ فِي إِسْنَادِهِ وَحَمَّادُ بْنُ سَلَمَةَ أَحْسَنُهُمْ سِيَاقَةً لَهُ وَلَهُ شَاهِدٌ صَحِيحٌ
[Machine] The Messenger of Allah ﷺ commanded him to prepare an army. Abdullah bin Amr said, "We don't have enough wealth." So the Prophet ﷺ commanded him to sell his saddle until the arrival of Al-Musaddiq. Abdullah bin Amr sold the camel for two camels and a female camel until the arrival of Al-Musaddiq by the order of the Messenger of Allah ﷺ .
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَهُ أَنْ يُجَهِّزَ جَيْشًا قَالَ عَبْدُ اللهِ بْنُ عَمْرٍو وَلَيْسَ عِنْدَنَا ظَهْرٌ قَالَ فَأَمَرَهُ النَّبِيُّ ﷺ أَنْ يَبْتَاعَ ظَهْرًا إِلَى خُرُوجِ الْمُصَدِّقِ فَابْتَاعَ عَبْدُ اللهِ بْنُ عَمْرٍو الْبَعِيرَ بِالْبَعِيرَيْنِ وَبِأَبْعِرَةٍ إِلَى خُرُوجِ الْمُصَدِّقِ بِأَمْرِ رَسُولِ اللهِ ﷺ
[Machine] That he sold his camel named Usayfir for twenty camels with a term.
أَنَّهُ بَاعَ جَمَلًا لَهُ يُدْعَى عُصَيْفِيرًا بِعِشْرِينَ بَعِيرًا إِلَى أَجَلٍ
أَنَّهُ اشْتَرَى رَاحِلَةً بِأَرْبَعَةِ أَبْعِرَةٍ مَضْمُونَةٍ عَلَيْهِ يُوفِيهَا صَاحِبَهَا بِالرَّبَذَةِ
13.25 [Machine] What is mentioned in the prohibition of selling an animal for another animal as a derogatory act.
١٣۔٢٥ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً
[Machine] Narrated by the Prophet Muhammad ﷺ that he forbade the sale of an animal in exchange for another animal of lesser value.
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً وَكَذَلِكَ
[Machine] "He said that the Messenger of Allah ﷺ forbade the selling of animals for animals, considering it as a form of riba (usury)."
أَنَّهُ قَالَ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً وَكَذَلِكَ
13.26 [Machine] What is prohibited in regards to selling debt for debt?
١٣۔٢٦ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ بَيْعِ الدَّيْنِ بِالدَّيْنِ
[Machine] The Prophet ﷺ prohibited the sale of imperfect dates with imperfect dates. This is the son of 'Ubaydah Ar-Rabadhi and our sheikh Abu Abdullah said in his narration from Musa ibn 'Uqbah, which is a mistake. What is astonishing is that Abu Al-Hasan Ad-Daraqutni, the scholar of his time, narrated this hadith in his book "Sunan" from Abu Al-Hasan Ali ibn Muhammad Al-Misri. This is what he said about Musa ibn 'Uqbah, and our sheikh Abu Al-Husayn said.
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ الْكَالِئِ بِالْكَالِئِ مُوسَى هَذَا هُوَ ابْنُ عُبَيْدَةَ الرَّبَذِيُّ وَشَيْخُنَا أَبُو عَبْدِ اللهِ قَالَ فِي رِوَايَتِهِ عَنْ مُوسَى بْنِ عُقْبَةَ وَهُوَ خَطَأٌ وَالْعَجَبُ مِنْ أَبِي الْحَسَنِ الدَّارَقُطْنِيِّ شَيْخِ عَصْرِهِ رَوَى هَذَا الْحَدِيثَ فِي كِتَابِ السُّنَنِ عَنْ أَبِي الْحَسَنِ عَلِيِّ بْنِ مُحَمَّدٍ الْمِصْرِيِّ هَذَا فَقَالَ عَنْ مُوسَى بْنِ عُقْبَةَ وَشَيْخُنَا أَبُو الْحُسَيْنِ
[Machine] The Messenger of Allah ﷺ forbade the sale of a debt for another debt. Abu Abd al-Aziz al-Rabadhi, who is Musa ibn Ubaydah, narrated this. And Abu Saad al-Malini informed us, I am Abu Ahmad ibn Adiy al-Hafiz, and al-Qasim ibn Mahdi narrated to us, and Abu Musab narrated from Abdulaziz al-Darawardi, from Musa ibn Ubaydah, who mentioned it in a similar way. Musa said, Nafe' said, and that is the sale of a debt for another debt. Abu Ahmad said, and this is known from Musa ibn Ubaydah from Nafe'. May Allah have mercy on the sheikh. And
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْكَالِئِ بِالْكَالِئِ أَبُو عَبْدِ الْعَزِيزِ الرَّبَذِيُّ هُوَ مُوسَى بْنُ عُبَيْدَةَ 10538 وَأَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنا أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ ثنا الْقَاسِمُ بْنُ مَهْدِيٍّ ثنا أَبُو مُصْعَبٍ عَنْ عَبْدِ الْعَزِيزِ الدَّرَاوَرْدِيِّ عَنْ مُوسَى بْنِ عُبَيْدَةَ فَذَكَرَهُ بِمِثْلِهِ قَالَ مُوسَى قَالَ نَافِعٌ وَذَلِكَ بَيْعُ الدَّيْنِ بِالدَّيْنِ قَالَ أَبُو أَحْمَدَ وَهَذَا مَعْرُوفٌ بِمُوسَى بْنِ عُبَيْدَةَ عَنْ نَافِعٍ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ
[Machine] The Messenger of Allah ﷺ forbade exchanging debts against debts.
نَهَى رَسُولُ اللهِ ﷺ عَنْ كَالِئٍ بِكَالِئٍ الدَّيْنِ بِالدَّيْنِ
[Machine] Narrated from the Prophet ﷺ that he forbade the selling of a defected item for another defected item. Abu Ubayd said Abu Ubayda said it is called "an-Nassi'ah" with "an-Nassi'ah" is (an-nassi'atu bin-nassi'ati) with a hamzah on the n, the sheikh said, and it is not mentioned in the narration of Zaid. Our sheikh Abu al-Husayn did not attribute it to Abu al-Hasan al-Misri, so he said it is narrated from Musa, and he is the son of Ubayda, without a doubt, and he has confirmed it.
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعِ الْكَالِئِ بِالْكَالِئِ قَالَ أَبُو عُبَيْدٍ قَالَ أَبُو عُبَيْدَةَ يُقَالُ هُوَ النَّسِيئَةُ بِالنَّسِيئَةِ مَهْمُوزٌ قَالَ الشَّيْخُ وَلَيْسَ فِي رِوَايَةِ زَيْدٍ لَفْظُ الْبَيْعِ وَلَمْ يَنْسِبْ شَيْخُنَا أَبُو الْحُسَيْنِ عَنْ أَبِي الْحَسَنِ الْمِصْرِيِّ فَقَالَ عَنْ مُوسَى وَهُوَ ابْنُ عُبَيْدَةَ بِلَا شَكٍّ وَقَدْ
13.27 [Machine] Consideration of Equality in What Was Weighed during the time of the Prophet Muhammad (PBUH) by Weight, and What Was Measured during His time by the Kilogram when Selling the Same Type with Usury occurring between them.
١٣۔٢٧ بَابُ اعْتِبَارِ التَّمَاثُلِ فِيمَا كَانَ مَوْزُونًا عَلَى عَهْدِ النَّبِيِّ ﷺ بِالْوَزْنِ وَفِيمَا كَانَ مَكِيلًا عَلَى عَهْدِهِ بِالْكَيْلِ إِذَا بِيعَ الْجِنْسُ الْوَاحِدُ فِيمَا يَجْرِي فِيهِ الرِّبَا بَعْضُهُ بِبَعْضٍ
[Machine] Narrated by the Prophet ﷺ, he said that gold is measured by gold in weight, and silver is measured by silver in weight, and barley is measured by barley in measure, and dates are measured by dates, and salt is measured by salt. So whoever increases or seeks to increase, then he has committed usury.
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ وَالْفِضَّةُ بِالْفِضَّةِ وَزْنًا بِوَزْنٍ وَالْبُرُّ بِالْبُرِّ كَيْلًا بِكَيْلٍ وَالشَّعِيرُ بِالشَّعِيرِ كَيْلًا بِكَيْلٍ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أَرْبَى
[Machine] The Prophet ﷺ said, "Gold is purified by gold, its measure, and its weight. Silver is purified by silver, its measure, and its weight. Barley is purified by barley, its measure, and its weight. Dates are purified by dates, its measure, and its weight. Salt is purified by salt, its measure, and its weight. So, whoever adds or increases in it has engaged in usury." Abu Ali Al-Rudhbari informed us, "I am Muhammad ibn Bakr." Abu Dawood narrated to us. Al-Hassan ibn Ali narrated to us. Bishr ibn Umar mentioned it and said it was narrated by Ubada ibn As-Samit.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الذَّهَبُ بِالذَّهَبِ تِبْرُهَا وَعَيْنُهَا وَالْفِضَّةُ بِالْفِضَّةِ تِبْرُهَا وَعَيْنُهَا وَالْبُرُّ بِالْبُرِّ مُدْيٌ بِمُدْيٍ وَالشَّعِيرُ بِالشَّعِيرِ مُدْيٌ بِمُدْيٍ وَالتَّمْرُ بِالتَّمْرِ مُدْيٌ بِمُدْيٍ وَالْمِلْحُ بِالْمِلْحِ مُدْيٌ بِمُدْيٍ فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا الْحَسَنُ بْنُ عَلِيٍّ ثنا بِشْرُ بْنُ عُمَرَ فَذَكَرَهُ وَقَالَ عَنْ عُبَادَةَ بْنِ الصَّامِتِ
Messenger of Allah ﷺ appointed somebody as a governor of Khaibar. That governor brought to him an excellent kind of dates (from Khaibar). The Prophet ﷺ asked, "Are all the dates of Khaibar like this?" He replied, "By Allah, no, O Messenger of Allah ﷺ! But we barter one Sa of this (type of dates) for two Sas of dates of ours and two Sas of it for three of ours." Messenger of Allah ﷺ said, "Do not do so (as that is a kind of usury) but sell the mixed dates (of inferior quality) for money, and then buy good dates with that money." أَنَّ رَسُولَ اللهِ ﷺ اسْتَعْمَلَ رَجُلًا عَلَى خَيْبَرَ فَجَاءَهُ بِتَمْرٍ جَنِيبٍ فَقَالَ رَسُولُ اللهِ ﷺ أَكُلُّ تَمْرِ خَيْبَرَ هَكَذَا؟ قَالَ لَا وَاللهِ يَا رَسُولَ اللهِ إِنَّا لَنَأْخُذُ الصَّاعَ مِنْ هَذَا بِالصَّاعَيْنِ وَالصَّاعَيْنِ بِالثَّلَاثَةِ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَفْعَلْ بِعِ الْجَمْعَ بِالدَّرَاهِمِ ثُمَّ ابْتَعْ بِالدَّرَاهِمِ جَنِيبًا
We used to be given mixed dates (from the booty) and used to sell (barter) two Sas of those dates) for one Sa (of good dates). The Prophet ﷺ said (to us), "No (bartering of) two Sas for one Sa nor two Dirhams for one Dirham is permissible", (as that is a kind of usury). (See Hadith No. 405). كُنَّا نُرْزَقُ تَمْرَ الْجَمْعِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَهُوَ الْخِلْطُ مِنَ التَّمْرِ فَكُنَّا نَبِيعُ الصَّاعَيْنِ بِالصَّاعِ فَقَالَ يَعْنِي النَّبِيَّ ﷺ لَا وَلَا الدِّرْهَمَ بِالدِّرْهَمَيْنِ
[Machine] He said, "So the Messenger of Allah ﷺ said, "No measure of dates shall be exchanged for a measure of dates, nor a measure of wheat for a measure of wheat, nor two dirhams for one dirham."
أَنَّهُ قَالَ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ لَا صَاعَيْ تَمْرٍ بِصَاعٍ وَلَا صَاعَيْ حِنْطَةٍ بِصَاعٍ وَلَا دِرْهَمَيْنِ بِدِرْهَمٍ
13.28 [Machine] There is no good in examining what is in some aspects from one another in terms of usury
١٣۔٢٨ بَابٌ: لَا خَيْرَ فِي التَّحَرِّي فِيمَا فِي بَعْضِهِ بِبَعْضٍ رِبًا
Jabir b. Abdullah (Allah be pleased with them) is reported to have said that Messenger of Allah ﷺ forbade the sale of a heap of dates the weight of which is unknown in accordance with the known weight of dates. (Using translation from Muslim 1530a)
قَالَ سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الصُّبْرَةِ مِنَ التَّمْرِ لَا يُعْلَمُ مَكِيلُهَا بِالْكَيْلِ الْمُسَمَّى مِنَ التَّمْرِ
13.29 [Machine] The Gold and Silver Jewelry cannot be sold by weight more than its actual weight as evidence from established narrations in usury
١٣۔٢٩ بَابٌ: لَا يُبَاعُ الْمَصُوغُ مِنَ الذَّهَبِ وَالْفِضَّةِ بِجِنْسِهِ بِأَكْثَرَ مِنْ وَزْنِهِ اسْتِدْلَالًا بِمَا مَضَى مِنَ الْأَحَادِيثِ الثَّابِتَةِ فِي الرِّبَا
Gold is to be paid for by gold with equal weight, like for like, and silver is to be paid for by silver with equal weight, like for like. He who made an addition to it or demanded an addition dealt in usury. (Using translation from Muslim 1588c)
قَالَ رَسُولُ اللهِ ﷺ الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ مِثْلًا بِمِثْلٍ وَالْفِضَّةُ بِالْفِضَّةِ وَزْنًا بِوَزْنٍ مِثْلًا بِمِثْلٍ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أَرْبَى
This hadith has been narrated by Ibn Bishr with the same chain of transmitters (but with a slight variation) that he (the Holy Prophet) inquired of them (Jews) about it (fasting on the day of 'Ashura). (Using translation from Muslim 1130b)
عَنْ ذَلِكَ
[Machine] So I said to him, "I refine gold and sell it by its weight, and I take a fee for my work." He said, "Do not sell gold with gold except in equal weight, and do not sell silver with silver except in equal weight. And do not take anything extra."
فَقُلْتُ لَهُ إِنِّي أَصُوغُ الذَّهَبَ فَأَبِيعُهُ بِوَزْنِهِ وَآخُذُ لِعُمَالَةِ يَدِي أَجْرًا قَالَ لَا تَبِعِ الذَّهَبَ بِالذَّهَبِ إِلَّا وَزْنًا بِوَزْنٍ وَالْفِضَّةَ بِالْفِضَّةِ إِلَّا وَزْنًا بِوَزْنٍ وَلَا تَأْخُذْ فَضْلًا
13.30 [Machine] Gold is not exchanged for anything other than gold with either of the two golds.
١٣۔٣٠ بَابٌ: لَا يُبَاعُ ذَهَبٌ بِذَهَبٍ مَعَ أَحَدِ الذَّهَبَيْنِ شَيْءٌ غَيْرُ الذَّهَبِ
[Machine] The Messenger of Allah ﷺ came to Khaibar wearing necklaces with beads and gold that were from the spoils. So the Messenger of Allah ﷺ ordered to remove the gold from the necklace, then he said to them: "Gold is weighed by weight."
أُتِيَ رَسُولُ اللهِ ﷺ وَهُوَ بِخَيْبَرَ بِقَلَائِدَ فِيهَا خَرَزٌ وَذَهَبٌ وَهِيَ مِنَ الْمَغَانِمِ تُبَاعُ فَأَمَرَ رَسُولُ اللهِ ﷺ بِالذَّهَبِ الَّذِي فِي الْقِلَادَةِ فَنُزِعَ ثُمَّ قَالَ لَهُمْ رَسُولُ اللهِ ﷺ الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ
[Machine] Necklaces adorned with gold, silver, and jewels flew towards me and my companions. I desired to purchase them, so I asked Fadalah ibn 'Ubayd. He advised me to take off the gold and place it on one hand, while placing my own gold on the other hand. Then he told me to only take the equivalent in exchange. For I have heard the Messenger of Allah ﷺ say, "Whoever believes in Allah and the Last Day should only take the equivalent in exchange."
فَطَارَتْ لِي وَلِأَصْحَابِي قَلَائِدُ فِيهَا ذَهَبٌ وَوَرِقٌ وَجَوْهَرٌ فَأَرَدْتُ أَنْ أَشْتَرِيَهَا فَسَأَلْتُ فَضَالَةَ بْنَ عُبَيْدٍ فَقَالَ انْزِعْ ذَهَبَهَا فَاجْعَلْهُ فِي كِفَّةٍ وَاجْعَلْ ذَهَبَكَ فِي كِفَّةٍ ثُمَّ لَا تَأْخُذَنَّ إِلَّا مِثْلًا بِمِثْلٍ؛ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ كَانَ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ فَلَا يَأْخُذَنَّ إِلَّا مِثْلًا بِمِثْلٍ
[Machine] The Messenger of Allah ﷺ came to Khaybar with a necklace that had beads hanging from it made of gold. A man had bought it for seven or nine dinars. The Prophet ﷺ said, "No, until a distinction is made between him and it." He said, "I only intended the stones." He said, "No, until a distinction is made between them." So he returned it until a distinction was made between them.
أُتِيَ رَسُولُ اللهِ ﷺ عَامَ خَيْبَرَ بِقِلَادَةٍ فِيهَا خَرَزٌ مُعَلَّقَةٌ بِذَهَبٍ ابْتَاعَهَا رَجُلٌ بِسَبْعَةِ دَنَانِيرَ أَوْ بِتِسْعةٍ فَقَالَ النَّبِيُّ ﷺ لَا حَتَّى يُمَيَّزَ بَيْنَهُ وَبَيْنَهَا قَالَ إِنَّمَا أَرَدْتُ الْحِجَارَةَ قَالَ لَا حَتَّى يُمَيَّزَ بَيْنَهُمَا قَالَ فَرَدَّهُ حَتَّى مُيِّزَ بَيْنَهُمَا
[Machine] Twelve dinars containing gold and beads were separated by me, and I found more than twelve dinars in it. So, I mentioned that to the Prophet ﷺ and he said, "Do not sell it until it is separated." This is the wording of the hadith of Muhammad ibn Ayyub, and in the narration of Abu Dawud, it is a necklace worth twelve dinars containing gold and beads.
اثْنَا عَشَرَ دِينَارًا فِيهَا ذَهَبٌ وَخَرَزٌ فَفَصَلْتُهَا فَوَجَدْتُ فِيهَا أَكْثَرَ مِنِ اثْنَيْ عَشَرَ دِينَارًا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ لَا تُبَاعُ حَتَّى تُفَصَلَ هَذَا لَفْظُ حَدِيثِ مُحَمَّدِ بْنِ أَيُّوبَ وَفِي رِوَايَةِ أَبِي دَاوُدَ قِلَادَةً بِاثْنَيْ عَشَرَ دِينَارًا فِيهَا ذَهَبٌ وَخَرَزٌ
[Machine] We were with the Messenger of Allah ﷺ on the day of Khaybar, selling the gold ingots by weight for two dinars and three dirhams. The Messenger of Allah ﷺ said, "Do not sell gold for gold except if it is weighed like for like." The context of these narrations, along with the credibility of their narrators, indicate that these transactions were witnessed by many people. The Prophet ﷺ prohibited such transactions, so all of them were settled accordingly. Haneesh al-San'aani settled them separately. And Allah knows best.
كُنَّا مَعَ رَسُولِ اللهِ ﷺ يَوْمَ خَيْبَرَ نُبَايِعُ الْيَهُودَ الْوَقِيَّةَ الذَّهَبَ بِالدِّينَارَيْنِ وَالثَّلَاثَةِ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا وَزْنًا بِوَزْنٍ سِيَاقُ هَذِهِ الْأَحَادِيثِ مَعَ عَدَالَةِ رُوَاتِهَا تَدُلُّ عَلَى أَنَّهَا كَانَتْ بُيُوعًا شَهِدَهَا فَضَالَةُ كُلَّهَا وَالنَّبِيُّ ﷺ يَنْهَى عَنْهَا فَأَدَّاهَا كُلَّهَا وَحَنَشٌ الصَّنْعَانِيُّ أَدَّاهَا مُتَفَرِّقًا وَاللهُ أَعْلَمُ
13.31 [Machine] Who permitted the division of fruits by earthenware pots as evidence by the story of Abdullah bin Rawahah in the date palms of Khaybar.
١٣۔٣١ بَابُ مَنْ أَجَازَ قِسْمَةَ الثِّمَارِ بِالْخَرْصِ فِي رُءُوسِ الشَّجَرِ اسْتِدْلَالًا بِقِصَّةِ عَبْدِ اللهِ بْنِ رَوَاحَةَ فِي نَخِيلِ خَيْبَرَ
[Machine] About the scholars who strive to reach a conclusion, it has been stated that the people of Madinah used to say regarding fruits that if a palm tree is located between two individuals, it is permissible for them to divide it by cutting the stalk, and each of them is allowed to take a portion of the palm tree.
عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ فِي الثَّمَرِ يَكُونُ بَيْنَ الرَّجُلَيْنِ أَنَّهُ لَا بَأْسَ أَنْ يُقَسِّمَاهُ فِي رُءُوسِ النَّخْلِ بِالْخَرْصِ فَيَجُوزُ كُلُّ وَاحِدٍ مِنْهُمَا طَائِفَةً مِنَ النَّخْلِ
13.32 [Machine] What is prohibited in selling ripe dates with dates?
١٣۔٣٢ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ بَيْعِ الرُّطَبِ بِالتَّمْرِ
[Machine] And the Messenger of Allah ﷺ said: I heard the Messenger of Allah ﷺ being asked about buying dates with fresh dates. The Messenger of Allah ﷺ said: "Does the fresh date decrease if it becomes dry?" They said: Yes. So he forbade it. And it was narrated by Yahya ibn Sa'id al-Qattan from Malik who said: Abdullah ibn Yazid narrated to me.
وَقَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ اشْتِرَاءِ التَّمْرِ بِالرُّطَبِ فَقَالَ رَسُولُ اللهِ ﷺ أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ؟ قَالُوا نَعَمْ فَنَهَى عَنْ ذَلِكَ وَرَوَاهُ يَحْيَى بْنُ سَعِيدٍ الْقَطَّانُ عَنْ مَالِكٍ قَالَ حَدَّثَنِي عَبْدُ اللهِ بْنُ يَزِيدَ
[Machine] The Messenger of Allah ﷺ was asked about the purchase of fresh dates with dried dates or dried dates with fresh dates. He said to those around him, "Will it decrease if it dries?" They said, "Yes." So he forbade it. This is also what Obaidullah bin Abdul Majid narrated from Malik, who said that Abdul Malik bin Yazid narrated it from Dawud bin Al-Husayn, who narrated it from Abdullah bin Yazid. Abu Al-Hasan bin Abadan informed us, I am Ahmad bin Ubaid narrating from Ismail bin Ishaq, and I am Ali bin Abdullah narrating from my father, who said that Malik bin Anas narrated to him from Dawud bin Al-Husayn, who narrated from Abdullah bin Yazid, the freed slave of Aswad bin Sufyan. He mentioned it, lengthening it. Ali and my father had heard it from Malik a long time ago, before these people had heard it. So I think that Malik had learned it from Dawud bin Al-Husayn a long time ago, then he heard it from Abdullah bin Yazid and narrated it, accepting it from Dawud. Then he reviewed it, correcting it from Abdullah bin Yazid and leaving out Dawud bin Al-Husayn. And Allah knows best.
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اشْتِرَاءِ الرُّطَبِ بِالتَّمْرِ أَوِ التَّمْرِ بِالرُّطَبِ فَقَالَ لِمَنْ حَوْلَهُ هَلْ يَنْقُصُ إِذَا يَبِسَ؟ قَالُوا نَعَمْ فَنَهَى عَنْهُ وَكَذَلِكَ قَالَهُ عُبَيْدُ اللهِ بْنُ عَبْدِ الْمَجِيدِ عَنْ مَالِكٍ قَالَ حَدَّثَنِي عَبْدُ اللهِ بْنُ يَزِيدَ وَرَوَاهُ عَبْدُ اللهِ بْنُ جَعْفَرٍ الْمَدِينِيُّ عَنْ مَالِكٍ عَنْ دَاوُدَ بْنِ الْحُصَيْنِ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ 10558 أَخْبَرَنَاهُ أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ أنا عَلِيُّ بْنُ عَبْدِ اللهِ قَالَ حَدَّثَنَاهُ أَبِي عَنْ مَالِكِ بْنِ أَنَسٍ أَنَّهُ حَدَّثَهُ عَنْ دَاوُدَ بْنِ الْحُصَيْنِ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ مَوْلَى الْأَسْوَدِ بْنِ سُفْيَانَ فَذَكَرَهُ بِطُولِهِ قَالَ عَلِيٌّ وَسَمَاعُ أَبِي عَنْ مَالِكٍ قَدِيمٌ قَبْلَ أَنْ يَسْمَعَهُ هَؤُلَاءِ فَأَظُنُّ أَنَّ مَالِكًا كَانَ عَلَّقَهُ قَدِيمًا عَنْ دَاوُدَ بْنِ الْحُصَيْنِ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ ثُمَّ سَمِعَهُ مِنْ عَبْدِ اللهِ بْنِ يَزِيدَ فَحَدَّثَ بِهِ قَدِيمًا عَنْ دَاوُدَ ثُمَّ نَظَرَ فِيهِ فَصَحَّحَهُ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ وَتَرَكَ دَاوُدَ بْنَ الْحُصَيْنِ وَاللهُ أَعْلَمُ
