13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] The Prophet ﷺ said, "Do not burden the camels or the sheep. Whoever buys them after that, he is the best of the two observers after milking them. If it pleases her, he keeps her, and if it angers her, he returns her and gives a measure of dates."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تُصَرُّوا الْإِبِلَ وَلَا الْغَنَمَ فَمَنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا فَإِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ
[Machine] The Messenger of Allah ﷺ said: "Whoever buys a pregnant sheep, he should keep it until it gives birth, then he should milk it. If the milk is sufficient, he should keep it, but if not, he should return it along with a measure of dates."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى شَاةً مُصَرَّاةً فَلْيَنْقَلِبْ بِهَا فَلْيَحْلُبْهَا فَإِنْ رَضِيَ حِلَابَهَا أَمْسَكَهَا وَإِلَّا رَدَّهَا وَمَعَهَا صَاعٌ مِنْ تَمْرٍ
Out of the ahadith which Abu Huraira (Allah be pleased with him) reported to us from Messenger of Allah ﷺ one is this that Messenger of Allah ﷺ said: If one among you buys a she-camel having its udder tied up he has the two options for him after milking it either (to retain it) or return it with a sa' of dates. (Using translation from Muslim 1524f)
وَقَالَ رَسُولُ اللهِ ﷺ إِذَا مَا أَحَدُكُمُ اشْتَرَى لِقْحَةً مُصَرَّاةً أَوْ شَاةً مُصَرَّاةً فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا إِمَّا هِيَ وَإِلَّا فَلْيَرُدَّهَا وَصَاعًا مِنْ تَمْرٍ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a fattened sheep, milks it, and is satisfied with it, then he should keep it. But if he is displeased with it, then there is a saa' of dates in its udder."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى غَنَمًا مُصَرَّاةً احْتَلَبَهَا فَإِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا فَفِي حَلْبَتِهَا صَاعٌ مِنْ تَمْرٍ
[Machine] The Prophet ﷺ said, "Whoever buys a pregnant ewe and then returns it, let him also return a saa' of dates, not Samraa' dates." And Abu Abdullah Al-Hafiz informed us, stating that Abu Abdullah Muhammad bin Ya'qub narrated to him, stating that Ibrahim bin Abdullah narrated to him, stating that Yazid bin Harun mentioned it in a similar manner, except that he said 'pregnant ewe' instead of 'pregnant sheep', but the meaning is the same.
عَنِ النَّبِيِّ ﷺ قَالَ مَنِ اشْتَرَى شَاةً مُصَرَّاةً فَرَدَّهَا فَلْيَرُدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ لَا سَمْرَاءَ 10718 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ ثنا يَزِيدُ بْنُ هَارُونَ فَذَكَرَهُ بِمِثْلِهِ إِلَّا أَنَّهُ قَالَ شَاةً مُصَرَّاةً فَهُوَ بِالْخِيَارِ إنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ لَا سَمْرَاءَ وَبِمَعْنَاهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a pregnant sheep or goat and milks it, he has the choice of one of two options: either to return the animal or to give a sa' of food as compensation." Al-Bukhari said, "And some of them said, according to Ibn Sirin, it is three sa' of food as compensation." Al-Bukhari said, "May Allah have mercy on him. And the most abundant food mentioned here is dates." The Sheikh said, "And the intended food in this narration is dates, as he said, 'No other equal value alternative (to dates) should be given.'"
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى لِقْحَةً مُصَرَّاةً أَوْ شَاةً مُصَرَّاةً فَحَلَبَهَا فَهُوَ بِأَحَدِ النَّظَرَيْنِ بِالْخِيَارِ إِنْ شَاءَ رَدَّهَا وَإِنَاءً مِنْ طَعَامٍ قَالَ الْبُخَارِيُّ وَقَالَ بَعْضُهُمْ عَنِ ابْنِ سِيرِينَ صَاعًا مِنْ طَعَامٍ وَهُوَ بِالْخِيَارِ ثَلَاثًا قَالَ الْبُخَارِيُّ رَحِمَهُ اللهُ وَالتَّمْرُ أَكْثَرُ قَالَ الشَّيْخُ وَالْمُرَادُ بِالطَّعَامِ فِي هَذَا الْخَبَرِ التَّمْرُ فَقَدْ قَالَ لَا سَمْرَاءَ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a fat sheep, he has the option of returning it within three days if he wishes, or (he can keep it) by giving a measure of food, not barley."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ اشْتَرَى شَاةً مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ إِنْ شَاءَ رَدَّهَا وَصَاعًا مِنْ طَعَامٍ لَا سَمْرَاءَ وَكَذَلِكَ
[Machine] I heard Abdullah bin Umar say, "We used to wait for the Messenger of Allah ﷺ at the gate, and when he came out, we would follow him until he reached a hill outside the city. He sat down on it and said, 'O people, no one among you should undertake a transaction (buying or selling) until the migrants have an opportunity to do so with the Bedouins. And whoever sells a piece of land, he has the right to take it back within three days, and if he wants to return it, he should return it with an additional payment of similar value or he can return it as it is. The price of its milk and wheat should be fair.' All of Ibn Umar's sons acquired individual ownership of land through this narration." Al-Bukhari commented on this narration, "It is a subject of scrutiny."
سَمِعْتُ عَبْدَ اللهِ بْنَ عُمَرَ يَقُولُ كُنَّا عَلَى بَابِ رَسُولِ اللهِ ﷺ نَنْتَظِرُهُ فَخَرَجَ فَاتَّبَعْنَاهُ حَتَّى أَتَى عَقَبَةً مِنْ عِقَابِ الْمَدِينَةِ فَقَعَدَ عَلَيْهَا فَقَالَ يَا أَيُّهَا النَّاسُ لَا يَتَلَقَّيَنَّ أَحَدٌ مِنْكُمْ سُوقًا وَلَا يَبِيعَنَّ مُهَاجِرِيٌّ لِأَعْرَابِيٍّ وَمَنْ بَاعَ مُحَفَّلَةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ فَإِنْ رَدَّهَا رَدَّ مَعَهَا مِثْلَ أَوْ قَالَ مِثْلَيْ لَبَنِهَا قَمْحًا تَفَرَّدَ بِهِ جُمَيْعُ بْنُ عُمَيْرٍ قَالَ الْبُخَارِيُّ فِيهِ نَظَرٌ
[Machine] The Prophet ﷺ said: "Whoever buys a defective animal or a pregnant animal, then he has one of two options: either return it and take back a container of food, or keep it. This is the preserved tradition, transmitted and documented."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنِ اشْتَرَى مُصَرَّاةً أَوْ لِقْحَةً مُصَرَّاةً فَهُوَ بِأَحَدِ النَّظَرَيْنِ بَيْنَ أَنْ يَرُدَّهَا وَإِنَاءً مِنْ طَعَامٍ أَوْ يَأْخُذَهَا هَذَا هُوَ الْمَحْفُوظُ مُرْسَلٌ وَقَدْ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a pregnant sheep, then its owner has the right to milk it. If he accepts, then he should keep it, but if not, then he should return it and a sa' of dates."
قَالَ رَسُولُ اللهِ ﷺ مَنِ اشْتَرَى شَاةً مُحَفَّلَةً فَإِنَّ لِصَاحِبِهَا أَنْ يَحْتَلِبَهَا فَإِنْ رَضِيَهَا فَلْيُمْسِكْهَا وَإِلَّا فَلْيَرُدَّهَا وَصَاعًا مِنْ تَمْرٍ
[Machine] From a man of the companions of the Prophet ﷺ , from the Prophet ﷺ , that he forbade the recitation of the Al-Jalab and selling a present for a bad one. And whoever buys a Musrra (female camel that has given birth and started producing milk), then it is better to look at both of its eyes. If he milks it and is pleased with it, he keeps it. If he returns it, he returns with a Sa'a (a specific measure of food) of grain or a Sa'a of dates. The sheikh said, "It is possible that this is a doubt from some of the narrators." Then he said, "A Sa'a of this or a Sa'a of that, it is not from the choice." It is to be in accordance with the established hadiths in this topic. And Allah knows best.
عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى أَنْ يُتَلَقَّى الْأَجْلَابُ وَأَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَمَنِ اشْتَرَى مُصَرَّاةً فَهُوَ بِخَيْرِ النَّظَرَيْنِ فَإِنْ حَلَبَهَا وَرَضِيَهَا أَمْسَكَهَا وَإِنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ طَعَامٍ أَوْ صَاعًا مِنْ تَمْرٍ قَالَ الشَّيْخُ يُحْتَمَلُ أَنْ يَكُونَ هَذَا شَكًّا مِنْ بَعْضِ الرُّوَاةِ فَقَالَ صَاعًا مِنْ هَذَا أَوْ مِنْ ذَلِكَ لَا أَنَّهُ مِنْ وَجْهِ التَّخْيِيرِ؛ لِيَكُونَ مُوَافِقًا لِلْأَحَادِيثِ الثَّابِتَةِ فِي هَذَا الْبَابِ وَاللهُ أَعْلَمُ
وَنَهَى النَّبِيُّ ﷺ عَنْ تَلَقِّي الْبُيُوعِ
[Machine] Whoever buys a pregnant ewe and then returns it, he should return with it a sa'a of dates. Abu 'Amr Al-Adibi informed us, Abu Bakr Al-Isma'ili informed me, Abu Yahya Al-Ruwayani narrated to me, from Ibrahim, he mentioned it, he said: Al-Isma'ili narrated the hadith of the pregnant ewe from the saying of Abdullah, and Abu Khalid narrated it from Al-Taymi, 10729 Abu 'Amr informed us, I am Abu Bakr, Al-Qasim narrated to me, Abu Kurayb narrated to me, Abu Khalid mentioned it, and he did not say "of dates." Al-Isma'ili said: It was also narrated by Ibn Al-Mubarak, Yahya Ibn Said, Ibn Abi 'Adi, Yazid Ibn Zuray', Hushaim, Jarir, and others, attributed to Ibn Mas'ud, the hadith of the pregnant ewe.
مَنِ اشْتَرَى شَاةً مُحَفَّلَةً فَرَدَّهَا فَلْيَرُدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ أَخْبَرَنَاهُ أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي أَبُو يَحْيَى الرُّويَانِيُّ ثنا إِبْرَاهِيمُ فَذَكَرَهُ قَالَ الْإِسْمَاعِيلِيُّ حَدِيثُ الْمُحَفَّلَةِ مِنْ قَوْلِ عَبْدِ اللهِ وَقَدْ رَفَعَهُ أَبُو خَالِدٍ عَنِ التَّيْمِيِّ 10729 أَخْبَرَنَا أَبُو عَمْرٍو أنا أَبُو بَكْرٍ ثنا الْقَاسِمُ ثنا أَبُو كُرَيْبٍ ثنا أَبُو خَالِدٍ فَذَكَرَهُ وَلَمْ يَقُلْ مِنْ تَمْرٍ قَالَ الْإِسْمَاعِيلِيُّ وَرَوَاهُ ابْنُ الْمُبَارَكِ وَيَحْيَى بْنُ سَعِيدٍ وَابْنُ أَبِي عَدِيٍّ وَيَزِيدُ بْنُ زُرَيْعٍ وَهُشَيْمٌ وَجَرِيرٌ وَغَيْرُهُمْ مَوْقُوفًا عَلَى ابْنِ مَسْعُودٍ حَدِيثَ الْمُحَفَّلَةِ
