13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] The Messenger of Allah ﷺ said, "Whoever disgraces a Muslim, Allah will disgrace him. And in another narration from Al-Misri, "Whoever disgraces someone and then regrets it, Allah will disgrace him."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَقَالَ مُسْلَمًا أَقَالَهُ اللهُ عَثْرَتَهُ وَفِي رِوَايَةِ الْمِصْرِيِّ مَنْ أَقَالَ نَادِمًا أَقَالَهُ اللهُ
[Machine] The Messenger of Allah ﷺ said, "Whosoever causes remorse in someone, Allah will cause remorse in him on the Day of Resurrection." Narrated by Abu Al-Husayn Ibn Bishran, who narrated from Abu Al-Hasan Ali Ibn Muhammad Al-Misri, who narrated from Ali Ibn Abdul Aziz, who dictated it in Makkah, narrated by Ishaq Al-Farwi, who mentioned it in a similar manner.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَقَالَ نَادِمًا أَقَالَهُ اللهُ تَعَالَى يَوْمَ الْقِيَامَةِ 11130 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ إِمْلَاءً بِمَكَّةَ ثنا إِسْحَاقُ الْفَرْوِيُّ فَذَكَرَهُ بِنَحْوِهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever mentions a Muslim's shortcomings, Allah will mention his shortcomings on the Day of Judgment." Abu al-Abbas said, "Isaak used to narrate this hadith from Malik, from Sumayy, who narrated it from his original book, from Suhail. The sheikh said, 'This text is not the text of Sumayy's hadith, and Allah knows best.' It was also narrated from Muhammad ibn Wasi' from Abu Salih."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَقَالَ مُسْلِمًا عَثْرَتَهُ أَقَالَهُ اللهُ تَعَالَى يَوْمَ الْقِيَامَةِ قَالَ أَبُو الْعَبَّاسِ كَانَ إِسْحَاقُ يُحَدِّثُ بِهَذَا الْحَدِيثِ عَنْ مَالِكٍ عَنْ سُمَيٍّ فَحَدَّثَنَا بِهِ مِنْ أَصْلِ كِتَابِهِ عَنْ سُهَيْلٍ قَالَ الشَّيْخُ هَذَا الْمَتْنُ غَيْرُ مَتْنِ حَدِيثِ سُمَيٍّ وَاللهُ أَعْلَمُ وَرُوِيَ عَنْ مُحَمَّدِ بْنِ وَاسِعٍ عَنْ أَبِي صَالِحٍ
[Machine] The Messenger of Allah ﷺ said, "Whoever causes someone regret, Allah will cause him regret on the Day of Resurrection, and he mentioned the narration."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَقَالَ نَادِمًا أَقَالَهُ اللهُ نَفْسَهُ يَوْمَ الْقِيَامَةِ وَذَكَرَ الْحَدِيثَ
[Machine] Some of your wealth is charity, and some is capital. This is known. Jabir al-Ju'fi narrated from Nafi' from Ibn 'Umar the meaning of Ibn 'Abbas' statement, which is well known from Ibn 'Umar, that he disliked that. And we were narrated from 'Ata' ibn Abi Rabah and 'Amr ibn Dinar the meaning of Ibn 'Abbas' statement.
بَعْضَ سَلَمِكَ وَبَعْضَ رَأْسِ مَالِكَ فَذَلِكَ الْمَعْرُوفُ وَرَوَى جَابِرٌ الْجُعْفِيُّ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ مَعْنَى قَوْلِ ابْنِ عَبَّاسٍ وَالْمَشْهُورُ عَنِ ابْنِ عُمَرَ ؓ أَنَّهُ كَرِهَ ذَلِكَ وَرُوِّينَا عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ وَعَمْرِو بْنِ دِينَارٍ مَعْنَى قَوْلِ ابْنِ عَبَّاسٍ
[Machine] To buy a sale and then return it, and to return with its dirhams, indicates that aikalah is invalid except with capital. As for tawliyah, it is a sale, as mentioned by Al-Hasan, Muhammad bin Sireen, and Ata' bin Abi Rabah. Similarly, partnership is not permissible among us before the commodity is acquired, due to what has been mentioned about the prohibition of selling food before acquisition.
أَنْ يَبْتَاعَ الْبَيْعَ ثُمَّ يَرُدَّهُ وَيَرُدَّ مَعَهُ دَرَاهِمَ وَفِي هَذَا دَلَالَةٌ عَلَى أَنَّ الْإِقَالَةَ فَسْخٌ فَلَا تَجُوزُ إِلَّا بِرَأْسِ الْمَالِ وَأَمَّا التَّوْلِيَةُ فَهِيَ بَيْعٌ قَالَهُ الْحَسَنُ وَمُحَمَّدُ بْنُ سِيرِينَ وَعَطَاءُ بْنُ أَبِي رَبَاحٍ وَكَذَلِكَ الشَّرِكَةُ عِنْدَنَا فَلَا تَجُوزَانِ فِي السَّلَمِ قَبْلَ الْقَبْضِ؛ لِمَا مَضَى فِي النَّهْيِ عَنْ بَيْعِ الطَّعَامِ قَبْلَ الْقَبْضِ
