١٣۔٣١ بَابُ مَنْ أَجَازَ قِسْمَةَ الثِّمَارِ بِالْخَرْصِ فِي رُءُوسِ الشَّجَرِ اسْتِدْلَالًا بِقِصَّةِ عَبْدِ اللهِ بْنِ رَوَاحَةَ فِي نَخِيلِ خَيْبَرَ

[Machine] About the scholars who strive to reach a conclusion, it has been stated that the people of Madinah used to say regarding fruits that if a palm tree is located between two individuals, it is permissible for them to divide it by cutting the stalk, and each of them is allowed to take a portion of the palm tree.

عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ فِي الثَّمَرِ يَكُونُ بَيْنَ الرَّجُلَيْنِ أَنَّهُ لَا بَأْسَ أَنْ يُقَسِّمَاهُ فِي رُءُوسِ النَّخْلِ بِالْخَرْصِ فَيَجُوزُ كُلُّ وَاحِدٍ مِنْهُمَا طَائِفَةً مِنَ النَّخْلِ
