13. Commerce
١٣۔ كِتَابُ الْبُيُوعِ
[Machine] "That we make it a store, but what you have done with your own hands, there is no harm in it." Ibn Wahb said, and Malik said to me about the sale of the Qur'ans and their purchases, there is no harm in it."
أَنْ نَجْعَلَهُ مُتَّجَرًا وَلَكِنْ مَا عَمِلْتَ بِيَدَيْكَ فَلَا بَأْسَ بِهِ قَالَ ابْنُ وَهْبٍ وَقَالَ لِي مَالِكٌ فِي بَيْعِ الْمَصَاحِفِ وَشِرَائِهَا لَا بَأْسَ بِهِ
[Machine] The Qur'ans were not sold. A man would come with a piece of paper to the Prophet ﷺ , and the man would stand up, calculate, and then write. Then another man would stand up and write until they finished the Qur'an.
كَانَتِ الْمَصَاحِفُ لَا تُبَاعُ كَانَ الرَّجُلُ يَأْتِي بِوَرَقَةٍ عِنْدَ النَّبِيِّ ﷺ فَيَقُومُ الرَّجُلُ فَيَحْتَسِبُ فَيَكْتَبُ ثُمَّ يَقُومُ آخَرُ فَيَكْتُبُ حَتَّى يُفْرَغَ مِنَ الْمُصْحَفِ
[Machine] About Sa'id ibn Jubayr, a similar saying of his is as follows:
عَنْ سَعِيدِ بْنِ جُبَيْرٍ مِثْلَهُ مِنْ قَوْلِهِ
[Machine] That hands were cut off in the selling of manuscripts.
أَنَّ الْأَيْدِيَ قُطِعَتْ فِي بَيْعِ الْمَصَاحِفِ
[Machine] Ibn Umar used to pass by the people of the Qur'an and say, "What a terrible trade."
كَانَ ابْنُ عُمَرَ يَمُرُّ بِأَصْحَابِ الْمَصَاحِفِ فَيَقُولُ بِئْسَ التِّجَارَةُ
[Machine] The companions of the Messenger of Allah ﷺ used to dislike the selling of the Qur'an.
كَانَ أَصْحَابُ رَسُولِ اللهِ ﷺ يَكْرَهُونَ بَيْعَ الْمَصَاحِفِ
[Machine] Al-Shafi'i, may Allah have mercy on him, does not mean that some Iraqis say that there is no harm in buying and selling the Qur'an. And among the people there are those who do not see any harm in its sale, while we dislike its sale. The scholar said, "This dislike is based on the honor and respect of the Qur'an, so as not to belittle it by selling it or making it a trade." It has been narrated from Ibn Mas'ud that he permitted its sale, but the chain of narration is weak. And the saying of Ibn Abbas, "Buy the Qur'an and do not sell it, if this is true from him, indicates that it is permissible to sell it with dislike. And Allah knows best.
الشَّافِعِيُّ رَحِمَهُ اللهُ وَلَيْسُوا يَعْنِي بَعْضَ الْعِرَاقِيِّينَ يَقُولُونَ بِهَذَا لَا يَرَوْنَ بَأْسًا بِبَيْعِهَا وَشِرَائِهَا وَمِنَ النَّاسِ مَنْ لَا يَرَى بِشِرَائِهَا بَأْسًا وَنَحْنُ نَكْرَهُ بَيْعَهَا قَالَ الشَّيْخُ وَهَذِهِ الْكَرَاهَةُ عَلَى وَجْهِ التَّنْزِيهِ تَعْظِيمًا لِلْمُصْحَفِ عَنْ أَنْ يُبْتَذَلَ بِالْبَيْعِ أَوْ يُجْعَلَ مُتَّجَرًا وَرُوِيَ عَنِ ابْنِ مَسْعُودٍ أَنَّهُ رَخَّصَ فِيهِ وَإِسْنَادُهُ ضَعِيفٌ وَقَوْلُ ابْنِ عَبَّاسٍ اشْتَرِ الْمُصْحَفَ وَلَا تَبِعْهُ إِنْ صَحَّ ذَلِكَ عَنْهُ يَدُلُّ عَلَى جَوَازِ بَيْعِهِ مَعَ الْكَرَاهِيَةِ وَاللهُ أَعْلَمُ
الشَّيْخُ هَذَا إِسْنَادٌ ضَعِيفٌ
[Machine] The scholars of this nation do not see any harm in it, Hassan and Shabi.
فَقِيهَا هَذِهِ الْأُمَّةِ لَا يَرَيَانِ بِهِ بَأْسًا الْحَسَنُ وَالشَّعْبِيُّ
[Machine] How excellent is your craftsmanship in conveying the Book of Allah, leaf by leaf, verse by verse, word by word. This is permissible, there is no harm in it. 11074 said and narrated to us Sa'eed, narrated to us Abd al-Aziz ibn Abd al-Samad, narrated to us Malik ibn Dinar that Ikrimah sold a copy of the Qur'an and that Hasan did not see any harm in it.
مَا أَحْسَنَ صَنْعَتَكَ تَنْقُلُ كِتَابَ اللهِ ﷻ وَرَقَةً إِلَى وَرَقَةٍ وَآيَةً إِلَى آيَةٍ وَكَلِمَةً إِلَى كَلِمَةٍ هَذَا الْحَلَالُ لَا بَأْسَ بِهِ 11074 قَالَ وَحَدَّثَنَا سَعِيدٌ ثنا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ الصَّمَدِ ثنا مَالِكُ بْنُ دِينَارٍ أَنَّ عِكْرِمَةَ بَاعَ مُصْحَفًا لَهُ وَأَنَّ الْحَسَنَ كَانَ لَا يَرَى بِهِ بَأْسًا
