١٣۔ كِتَابُ الْبُيُوعِ
[Machine] The Messenger of Allah ﷺ prohibited the sale of deceit (cheating) and the sale of pebbles.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْغَرَرِ وَعَنْ بَيْعِ الْحَصَى
[Machine] Narrated by the Prophet that he allowed the sale of wheat in its stalks when it turns white, and he said, "As for it, it is a type of gharar (uncertainty)." Because it goes through a transformation that cannot be seen. If this narration from the Prophet is established, then we say it is permissible. This ruling was derived from a specific situation that occurred during a particular year. The Messenger of Allah prohibited selling gharar, but he allowed this.
عَنِ النَّبِيِّ ﷺ أَنَّهُ أَجَازَ بَيْعَ الْقَمْحِ فِي سُنْبُلِهِ إِذَا ابْيَضَّ فَقَالَ أَمَّا هُوَ فَغَرَرٌ؛ لِأَنَّهُ مَحُولٌ دُونَهُ لَا يُرَى فَإِنْ ثَبَتَ الْخَبَرُ عَنِ النَّبِيِّ ﷺ قُلْنَا بِهِ وَكَانَ هَذَا خَاصًّا مُسْتَخْرَجًا مِنْ عَامٍّ؛ لِأَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْغَرَرِ وَأَجَازَ هَذَا
[Machine] The Prophet ﷺ forbade selling date palm trees until they bear fruit, and selling wheat until it becomes white and free from defects. He also forbade the seller and the buyer from engaging in dishonesty.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ النَّخْلِ حَتَّى يَزْهُوَ وَعَنْ بَيْعِ السُّنْبُلِ حَتَّى يَبْيَضَّ وَيَأْمَنَ الْعَاهَةَ نَهَى الْبَائِعَ وَالْمُشْتَرِيَ
[Machine] The Prophet ﷺ forbade the selling of grain until it has ripened, and the selling of grapes until they have turned black, and the selling of fruit until it has become ripe. Abu al-Hasan Ali ibn Muhammad al-Muqri informed us. I am al-Hasan ibn Muhammad ibn Ishaq. Yusuf ibn Ya'qub al-Qadi narrated to us. Abu al-Walid al-Tayalisi narrated to us. Hammad ibn Salamah mentioned it, and he mentioned the ripening of grain and the turning black of grapes in this hadith, from what Hammad ibn Salamah had exclusively narrated from Humayd among the companions of Humayd.
نَهَى النَّبِيُّ ﷺ عَنْ بَيْعِ الْحَبِّ حَتَّى يَشْتَدَّ وَعَنْ بَيْعِ الْعِنَبِ حَتَّى يَسْوَدَّ وَعَنْ بَيْعِ الثَّمَرِ حَتَّى يَزْهُوَ أَخْبَرَنَاهُ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي ثنا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ ثنا حَمَّادُ بْنُ سَلَمَةَ فَذَكَرَهُ وَذِكْرُ الْحَبِّ حَتَّى يَشْتَدَّ وَالْعِنَبِ حَتَّى يَسْوَدَّ فِي هَذَا الْحَدِيثِ مِمَّا تَفَرَّدَ بِهِ حَمَّادُ بْنُ سَلَمَةَ عَنْ حُمَيْدٍ مِنْ بَيْنِ أَصْحَابِ حُمَيْدٍ فَقَدْ
[Machine] The Messenger of Allah ﷺ forbade the selling of fruit until it ripens and turns either yellow or red, and the selling of grapes until they become black, and the selling of grains until they are rubbed. Abu Abdullah Al-Hafiz narrated to us, Abu Al-Abbas Muhammad ibn Ya'qub narrated to us, Muhammad ibn Ishaq As-Saghani narrated to us, Yahya ibn Ishaq As-Salihini and Hasan ibn Musa Al-Ashyab narrated to us. They all said that Hammad ibn Salamah mentioned it and said, "And his statement 'until they are rubbed,' if it is with a lowering of the raa' (R sound) before adding the fathah and the ithafa (rubbing), it coincides with the narration of the one who said 'until it becomes intense.' And if it is with a fathah on the raa' and a raised ya' before adding the farq (rubbing) to the one who did not name it, it contradicts the narration of the one who said 'until it becomes intense.' And it is appropriate to purify it from impurities until it is permissible to sell it. And I have not seen anyone among our hadith scholars in our time adhering to that, and the closest opinion is that it should be rubbed with a lowering of the raa', to align with the meaning of the one who said 'until it becomes intense.' أَنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ تُبَاعَ الثَّمَرَةُ حَتَّى يَبِينَ صَلَاحُهَا تَصْفَرَّ أَوْ تَحْمَرَّ وَعَنْ بَيْعِ الْعِنَبِ حَتَّى يَسْوَدَّ وَعَنْ بَيْعِ الْحَبِّ حَتَّى يُفْرَكَ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ ثنا يَحْيَى بْنُ إِسْحَاقَ السَّالَحِينِيُّ وَحَسَنُ بْنُ مُوسَى الْأَشْيَبُ قَالَا ثنا حَمَّادُ بْنُ سَلَمَةَ فَذَكَرَهُ وَقَوْلُهُ حَتَّى يُفْرَكَ إِنْ كَانَ بِخَفْضِ الرَّاءِ عَلَى إِضَافَةِ الْإِفْرَاكِ إِلَى الْحَبِّ وَافَقَ رِوَايَةَ مَنْ قَالَ حَتَّى يَشْتَدَّ وَإِنْ كَانَ بِفَتْحِ الرَّاءِ وَرَفْعِ الْيَاءِ عَلَى إِضَافَةِ الْفَرْكِ إِلَى مَنْ لَمْ يُسَمَّ فَاعِلُهُ خَالَفَ رِوَايَةَ مَنْ قَالَ فِيهِ حَتَّى يَشْتَدَّ وَاقْتَضَى تَنْقِيَتَهُ عَنِ السُّنْبُلِ حَتَّى يَجُوزَ بَيْعُهُ وَلَمْ أَرَ أَحَدًا مِنْ مُحَدِّثِي زَمَانِنَا ضَبَطَ ذَلِكَ وَالْأَشْبَهُ أَنْ يَكُونَ يَفْرِكَ بِخَفْضِ الرَّاءِ؛ لِمُوَافَقَةِ مَعْنَى مَنْ قَالَ فِيهِ حَتَّى يَشْتَدَّ وَاللهُ أَعْلَمُ وَقَدْ
[Machine] The Messenger of Allah ﷺ forbade selling grain until it is threshed, selling palm trees until they bear fruit, and selling fruit until it ripens and becomes edible. It was narrated from Abu Shaybah, from Abu Anas ibn Malik, that he said: "I don't know anything about this." And it was narrated from Jabir al-Ju'fi, from Umm Thawr, that her husband Basrah asked Ibn Abbas when is the best time to buy palm trees. He said: "Until they bear fruit." He also asked him about purchasing crops, which are the grains. He said: "Until they turn yellow." This chain of narration is weak, and the authentic narration in this subject is from Ayyub al-Sakhtiyani, then the narration of Hammad ibn Salama, as we mentioned in their wording. نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْحَبِّ حَتَّى يُفْرَكَ وَعَنْ بَيْعِ النَّخْلِ حَتَّى يَزْهُوَ وَعَنِ الثِّمَارِ حَتَّى تُطْعَمَ وَرُوِي عَنْ أَبِي شَيْبَةَ عَنْ أَبِي أَنَسِ بْنِ مَالِكٍ وَلَيْسَ بِشَيْءٍ وَرَوَاهُ جَابِرٌ الْجُعْفِيُّ عَنْ أُمِّ ثَوْرٍ أَنَّ زَوْجَهَا بِشْرًا سَأَلَ ابْنَ عَبَّاسٍ مَتَى يَشْتَرِي النَّخْلَ؟ قَالَ حَتَّى يَزْهُوَ قَالَ وَسَأَلْتُهُ عَنْ شِرَاءِ الزَّرْعِ وَهُوَ السُّنْبُلُ قَالَ حَتَّى يَصْفَرَّ وَهَذَا إِسْنَادٌ ضَعِيفٌ وَالصَّحِيحُ فِي هَذَا الْبَابِ رِوَايَةُ أَيُّوبَ السِّخْتِيَانِيِّ ثُمَّ رِوَايَةُ حَمَّادِ بْنِ سَلَمَةَ عَلَى مَا ذَكَرْنَا فِي لَفْظِهِ وَاللهُ أَعْلَمُ
[Machine] The Messenger of Allah ﷺ forbade selling fruit until its goodness is evident. Al-Zuhri said that the goodness is evident when scholars say that one should avoid it. And the goodness of crops is evident when the furrow is visible in it.
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ قَالَ الزُّهْرِيُّ وَبُدُوُّ صَلَاحِهِ فِيمَا يَقُولُ الْعُلَمَاءُ أَنْ يَزْهُوَ وَبُدُوُّ صَلَاحِ الزَّرْعِ أَنْ يُرَى فِيهِ الْفَرْكُ
[Machine] Muhammad ibn Sireen used to say, "Do not follow the grain until it becomes white."
أَنَّ مُحَمَّدَ بْنَ سِيرِينَ كَانَ يَقُولُ لَا تَبِعِ الْحَبَّ فِي سُنْبُلِهِ حَتَّى يَبْيَضَّ
